Biblical theology is confronted with tensions between love and justice. There are sometimes attempts to avoid these tensions by dissolving one side of the opposing concept. One such attempt is to identify love and mercy as the essence of Christian theology, overcoming law and reciprocal justice. However, such a dissolution is irresponsible not only ethically, but also theologically--as the discussion in a number of the studies collected in the present volume will demonstrate.

We are moving towards a future where Artificial Intelligence (AI) based agents make many decisions on behalf of humans. From healthcare decision-making to social media censoring, these agents face problems, and make decisions with ethical and societal implications. Ethical behaviour is a critical characteristic that we would like in a human-centric AI. A common observation in human-centric industries, like the service industry and healthcare, is that their professionals tend to break rules, if necessary, for pro-social reasons. This behaviour among humans (...) is defined as pro-social rule breaking. To make AI agents more human-centric, we argue that there is a need for a mechanism that helps AI agents identify when to break rules set by their designers. To understand when AI agents need to break rules, we examine the conditions under which humans break rules for pro-social reasons. In this paper, we present a study that introduces a ‘vaccination strategy dilemma’ to human participants and analyzes their response. In this dilemma, one needs to decide whether they would distribute COVID-19 vaccines only to members of a high-risk group (follow the enforced rule) or, in selected cases, administer the vaccine to a few social influencers (break the rule), which might yield an overall greater benefit to society. The results of the empirical study suggest a relationship between stakeholder utilities and pro-social rule breaking (PSRB), which neither deontological nor utilitarian ethics completely explain. Finally, the paper discusses the design characteristics of an ethical agent capable of PSRB and the future research directions on PSRB in the AI realm. We hope that this will inform the design of future AI agents, and their decision-making behaviour. (shrink)

The aim of this paper is to shed light on and develop what I call a phenomenological conception of experiential justification. According to this phenomenological conception, certain experiences gain their justificatory force from their distinctive phenomenology. Such an approach closely connects epistemology and philosophy of mind and has recently been proposed by several authors, most notably by Elijah Chudnoff, Ole Koksvik, and James Pryor. At the present time, however, there is no work that contrasts these different versions of PCEJ. This (...) paper not only bridges this gap, but also reveals problems in current versions of PCEJ. The 1992 incorporation of an article by referendum in the SwissConstitution mandating that the federal government issue regulations onthe use of genetic material that take into account the dignity ofnonhuman organism raises philosophical questions about how we shouldunderstand what is meant by ``the dignity of nonhuman animals,'' andabout what sort of moral demands arise from recognizing this dignitywith respect to their genetic engineering. The first step in determiningwhat is meant is to clarify the difference between dignity when appliedto humans and (...) when applied to nonhumans. Several conceptions of humandignity should be rejected in favor of a fourth conception: the rightnot to be degraded. This right implies that those who have it have thecognitive capacities that are prerequisite for self-respect. In the caseof nonhuman organisms that lack this capacity, respecting their dignityrequires the recognition that their inherent value, which is tied totheir abilities to pursue their own good, be respected. This value isnot absolute, as it is in the case of humans, so it does not prohibitbreeding manipulations that make organisms more useful to humans. But itdoes restrict morally how sentient animals can be used. In regard togenetic engineering, this conception requires that animals be allowedthe uninhibited development of species specific functions, a positionshared by Holland and Attfield, as opposed to the Original Purposeconception proposed by Fox and the Integrity of the Genetic Make-upposition proposed by Rolston. Barnett and Block (Journal of Business Ethics, 2009 ) attack the heart of modern banking by claiming that the practice of borrowing short and lending long is illicit. While their claim of illegitimacy concerning fractional reserve banking can be defended, their justification lacks substance. Their claim is herein strengthened by a legal analysis of deposits and loans based on Huerta de Soto (Money, Bank Credit and Economic Cycles, 2006 ). A combined legal and economic analysis shows that while lending deposits (...) can be regarded as illicit, the maturity mismatching of loans is legitimate contrary to Barnett and Block’s claim. No over-issuance of property rights is involved with this practice once the distinction between present and future goods is taken into account. However, while the practice is not illicit per se , it is greatly assisted and developed through the presence of a fractional reserve banking system, and can sometimes breed detrimental effects. Barnett and Block (J Bus Ethics 18(2):179–194, 2011 ) argue that one cannot distinguish between deposits and loans due to the continuum problem of maturities and because future goods do not exist—both essential characteristics that distinguish deposit from loan contracts. In a similar way but leading to opposite conclusions (Cachanosky, forthcoming) maintains that both maturity mismatching and fractional reserve banking are ethically justified as these contracts are equivalent. We argue herein that the economic and legal differences between genuine deposit and (...) loan contracts are clear. This implies different legal obligations for these contracts, a necessary step in assessing the ethics of both fractional reserve banking and maturity mismatching. Extending previous results from work on the complexity of cut elimination for the sequent calculus LK, we discuss the role of quantifier alternations and develop a measure to describe the complexity of cut elimination in terms of quantifier alternations in cut formulas and contractions on such formulas.

Attention has a role in much of perception, thought, and action. On the erotetic theory, the functional role of attention is a matter of the relationship between questions and what counts as answers to those questions. Questions encode the completion conditions of tasks for cognitive control purposes, and degrees of attention are degrees of sensitivity to the occurrence of answers. Questions and answers are representational contents given precise characterizations using tools from formal semantics, though attention does not depend on language. (...) The erotetic theory proposes an integrated account of attention in cognitive control and of attentional focus in perception. The functional role of attentional focus on objects, properties, and locations has to do with picking out something that corresponds to what a task is ‘about’. The erotetic theory of attention opens new avenues in theorizing about the relationship between attention, representational content, phenomenal character, and practical reason. A novel representationalist account of salience is proposed. The theory also provides an account of distraction that suggests when distraction is a defect in practical reasoning. (shrink)

This paper shows that the law, in subtle ways, may set hitherto unrecognized incentives for the adoption of explainable machine learning applications. In doing so, we make two novel contributions. First, on the legal side, we show that to avoid liability, professional actors, such as doctors and managers, may soon be legally compelled to use explainable ML models. We argue that the importance of explainability reaches far beyond data protection law, and crucially influences questions of contractual and tort liability for (...) the use of ML models. To this effect, we conduct two legal case studies, in medical and corporate merger applications of ML. As a second contribution, we discuss the trade-off between accuracy and explainability and demonstrate the effect in a technical case study in the context of spam classification. (shrink)

In current debates, many philosophers of science have sympathies for the project of introducing a new approach to the scientific realism debate that forges a middle way between traditional forms of scientific realism and anti-realism. One promising approach is perspectivism. Although different proponents of perspectivism differ in their respective characterizations of perspectivism, the common idea is that scientific knowledge is necessarily partial and incomplete. Perspectivism is a new position in current debates but it does have its forerunners. Figures that are (...) typically mentioned in this context include Dewey, Feyerabend, Leibniz, Kant, Kuhn, and Putnam. Interestingly, to my knowledge, there exists no work that discusses similarities to the phenomenological tradition. This is surprising because here one can find systematically similar ideas and even a very similar terminology. It is startling because early modern physics was noticeably influenced by phenomenological ideas. And it is unfortunate because the analysis of perspectival approaches in the phenomenological tradition can help us to achieve a more nuanced understanding of different forms of perspectivism. The main objective of this paper is to show that in the phenomenological tradition one finds a well-elaborated philosophy of science that shares important similarities with current versions of perspectivism. Engaging with the phenomenological tradition is also of systematic value since it helps us to gain a better understanding of the distinctive claims of perspectivism and to distinguish various grades of perspectivism. ‘India’s founding moment’ a moment of breath-taking political imagination and it is one of the great achievements of Madhav Khosla. to unpack important parts of its pre-history and emergence. This article will look at two questions—one about alternatives and the other about contexts. Regarding alternatives, I am interested in the paths not taken and an understanding of possibilities. I try to get a sense of possible alternative futures or modernities that the founding generation pondered, in the best case allowing us (...) to wonder what we can learn from the choices made as well as from the paths rejected. The other question I raise is the question of the intellectual contexts, in which the founding took place. Coming from a non-Indian perspective, I am interested in the entanglements, the contexts and potentially migrating ideas that emerge. (shrink)

Saskia Sassen today and Jane Adams more than 100 years ago are both social scientists and public philosophers of reconstruction. Both offer defining contributions to a philosophical tradition that will be identified here as “radical pragmatism”. Sassen’s theoretical stance “before method” serves as a key to understand Addams’s locally embedded urban activist projects as a form of social scientific inquiry. Sassen introduces the concept of “territory making” as a spark of hope against rampant and destructive global trends of “expulsions”, which (...) her approach reveals. In this article this concept of “territory making” will be explored in various contexts and with particular attention to Addams’s Hull house project. It will be shown how a pragmatist brand of human imagination is critical in “territory making”. This leads to reconsidering the role of art in social transformation projects. (shrink)

Todorčević showed that Rado's Conjecture implies CC*, a strengthening of Chang's Conjecture. We generalize this by showing that also CC**, a global version of CC*, follows from RC. As a corollary we obtain that RC implies Semistationary Reflection and, i.e. the statement that all forcings that preserve the stationarity of subsets of ω1 are semiproper.

The aim of this paper is twofold. The first is an interpretative one as I wish to provide a detailed account of Husserl’s conception of experiential justification. Here Ideas I and Introduction to Logic and Theory of Knowledge: Lectures 1906/07 will be my main resources. My second aim is to demonstrate the currency and relevance of Husserl’s conception. This means two things: Firstly, I will show that in current debates in analytic epistemology there is a movement sharing with Husserl the (...) basic idea that certain experiences gain their justificatory force simply from their distinctive phenomenal character. Secondly, I shall reveal the benefits of Husserl’s specific version of this view. Thus, one of my aims is to show that debates in current analytic epistemology could profit from adopting certain Husserlian elements. More precisely, I will defend Husserl’s claim that perceptual experiences are justifiers due to their self-giving phenomenal character as opposed to the currently popular view that it is the phenomenology of pushiness that makes them justifiers. Foundationalism and coherentism are two fundamentally opposed basic epistemological views about the structure of justification. Interestingly enough, there is no consensus on how to interpret Husserl. While interpreting Husserl as a foundationalist was the standard view in early Husserl scholarship, things have changed considerably as prominent commentators like Christian Beyer, John Drummond, Dagfinn Føllesdal, and Dan Zahavi have challenged this foundationalist interpretation. These anti-foundationalist interpretations have again been challenged, for instance, by Walter Hopp and Christian Erhard. One might suspect that (...) inconsistencies in Husserl’s writings are the simple reason for this disagreement. I shall argue, however, that the real question is not so much how to read Husserl, but how to define foundationalism and that there is overwhelming textual evidence that Husserl championed the most tenable version of foundationalism: a moderate foundationalism that allows for incorporating coherentist elements. Perceptual experiences justify. When I look at the black laptop in front of me and my perceptual experience presents me with a black laptop placed on my desk, my perceptual experience has justificatory force with respect to the proposition that there is black laptop on the desk. The present paper addresses the question of why perceptual experiences are a source of immediate justification: What gives them their justificatory force? I shall argue that the most plausible and the most straightforward answer (...) to this question consists in what I call the phenomenological conception of perceptual justification. Perceptual experiences justify by virtue of their distinctive presentive phenomenology. This is a truly internalist conception that enjoys significant advantages over rival conceptions. In the course of his paper, I demonstrate the advantages of the phenomenological conception and defend it against a recent objection. (shrink)

Recent interest in phenomena of simulation, pretense, and play has given rise to new philosophical debates on the basic structure of human action and action planning. Some philosophers sought to transform Hume's desire-belief-action model by sophisticating its basic structure. For example, they introduced “hypothetical world boxes” or imaginary “i-desires” and “i-beliefs” into the standard model, in order to account for the representational and motivational structures of imaginary scripts. Others used phenomena of behavior driven by imagination to attempt a more fundamental (...) critique of the Humean tradition. This article aims to show how the pragmatist tradition could be used as a resource in reframing current debates on imagination, pretense, and simulation in the cognitive sciences. Rationality bashing has become a popular sport. Critiques have quite rightly challenged models of rational planning that follow a linear progression from predefined ends to achieved goals. There have been several alternative theoretical and empirical developments including incrementalist projects, network theories, critical communication approaches, and heuristic models. Notwithstanding critiques of linear models of policy-making and planning, rationality as a general idea remains an important reference point for designing and evaluating policy-making and for orientating planning projects. We suggest that the concept (...) of rationality needs to be revised rather than abandoned and this article discusses how rationality in decision making may be reconstructed. We first review and critique some of the main preconceptions of rationality in policy-making and planning. We then discuss the nature and purpose of rationality from the perspective of John Dewey’s pragmatist philosophy and in light of contemporary theoretical and empirical analyses. We position rationality as a procedural standard of excellence that evolves and informs practices in the context of problematic situations. We propose that a theory of rationality, as a guide for planning and policy, should be developed for application in concrete problematic situations and at the same time should play a normative role and be orientated to moral, socio-historical, and ecological considerations. Dewey’s pragmatist theory is a promising source for such considerations. In this article we identify four ‘pillars’ of pragmatism to support such a revised rationality construct: (i) situationality, (ii) normativity, (iii) philosophical via media between foundationalism and relativism, and (iv) democratic inquiry. We discuss the application of a pragmatist rationality, that we refer to as ‘situational transactive’ rationality, using a model of decision making that builds on current understandings in planning and policy science. Finally, we discuss some of the possible advantages and challenges of undertaking such a pragmatist revision of rationality. (shrink)

This book offers a phenomenological conception of experiential justification that seeks to clarify why certain experiences are a source of immediate justification and what role experiences play in gaining (scientific) knowledge. Based on the author's account of experiential justification, this book exemplifies how a phenomenological experience-first epistemology can epistemically ground the individual sciences. More precisely, it delivers a comprehensive picture of how we get from epistemology to the foundations of mathematics and physics. The book is unique as it utilizes methods (...) and insights from the phenomenological tradition in order to make progress in current analytic epistemology. It serves as a starting point for re-evaluating the relevance of Husserlian phenomenology to current analytic epistemology and making an important step towards paving the way for future mutually beneficial discussions. As is well known, the late Husserl warned against the dangers of reifying and objectifying the mathematical models that operate at the heart of our physical theories. Although Husserl’s worries were mainly directed at Galilean physics, the first aim of our paper is to show that many of his critical arguments are no less relevant today. By addressing the formalism and current interpretations of quantum theory, we illustrate how topics surrounding the mathematization of nature come to the fore naturally. Our (...) second aim is to consider the program of reconstructing quantum theory, a program that currently enjoys popularity in the field of quantum foundations. We will conclude by arguing that, seen from this vantage point, certain insights delivered by phenomenology and quantum theory regarding perspectivity are remarkably concordant. Our overall hope with this paper is to show that there is much room for mutual learning between phenomenology and modern physics. (shrink)

Depositors have perceived banks as acting unethically during the most recent recession. One area of consternation is the ambiguity of the legal obligations entailed by the deposit contract when it is backed with only fractional reserves. In this article, we apply an existing analysis of the legitimacy and ethicality of banking practices to a wider range of financial transactions, including insurance policies, securities lending, perpetual bonds, and callable loans. Securities lending in particular creates rights violations analogous to those in fractional-reserve (...) banking. Both callable loans and perpetual bonds have clear legal obligations which are not inherently problematic, though we herein clarify what these obligations are. Finally, we apply our ethical framework to demonstrate that insurance products are distinct from banking deposit contracts, and that perceived parallels between the two products underestimate these differences. Polysemous concepts with multiple related meanings pervade natural languages, yet some philosophers argue that we should eliminate them to avoid miscommunication and pointless debates in scientific discourse. This paper defends the legitimacy of polysemous concepts in science against this eliminativist challenge. My approach analyses such concepts as patchworks with multiple scale-dependent, technique-involving, domain-specific and property-targeting uses (patches). I demonstrate the generality of my approach by applying it to "hardness" in materials science, "homology" in evolutionary biology, "gold" in chemistry and "cortical (...) column" in neuroscience. Such patchwork concepts are legitimate if the techniques used to apply them produce reliable results, the domains to which they are applied are homogenous, and the properties they refer to are significant to describe, classify or explain the behavior of entities in the extension of the concept. By following these normative constraints, researchers can avoid miscommunication and pointless debates without having to eliminate polysemous patchwork concepts in scientific discourse. (shrink)

The aim of this paper is to establish a phenomenological mathematical intuitionism that is based on fundamental phenomenological-epistemological principles. According to this intuitionism, mathematical intuitions are sui generis mental states, namely experiences that exhibit a distinctive phenomenal character. The focus is on two questions: what does it mean to undergo a mathematical intuition and what role do mathematical intuitions play in mathematical reasoning? While I crucially draw on Husserlian principles and adopt ideas we find in phenomenologically minded mathematicians such as (...) Hermann Weyl and Kurt Gödel, the overall objective is systematic in nature: to offer a plausible approach towards mathematics. (shrink)

In the past decade, research on the dark triad of personality (Machiavellianism, narcissism, and psychopathy) has demonstrated a strong relationship to a number of socially aversive moral judgments such as sacrificial utilitarian decisions in moral dilemmas. This study widens the scope of this research program and investigates the association between dark triad personality traits and anti-natalist views, i.e., views holding that procreation is morally wrong. The results of this study indicate that the dark triad personality traits of Machiavellianism and psychopathy (...) are strongly associated with anti-natalist views. Further, depression is found to be both standing independently in a relationship with anti-natalist views as well as functioning as a mediator in the relationships between Machiavellianism/psychopathy and anti-natalist views. This pattern was replicated in a follow-up study. These findings add to the literature on dark triad personality traits and their relationship to moral judgments, suggesting that personality and mood play a substantive part in variation in anti-natalist views in a lay population. Can phenomenologists allow for the existence of unobservable entities such as atoms, electrons, and quarks? Can we justifiably believe in the existence of entities that are in principle unobservable? This paper addresses the relationship between Husserlian transcendental phenomenology and scientific realism. More precisely, the focus is on the question of whether there are basic epistemological principles phenomenologists are committed to that have anti-realist consequences with respect to unobservable entities. This question is relevant since Husserl’s basic epistemological principles, such as the (...) “principle of all principles,” seem to suggest that epistemic justification is limited to what can be originally given in the sense that if an object cannot be given in an originary presentive intuition, then one cannot be justified in believing that this object exists. It is the main aim of this paper to show (i) that interpretative reasons exist for not reading Husserl in such a way and (ii) that systematic reasons exist as to why phenomenologists should not subscribe to this criterion. I shall put forward a different criterion of justification that satisfies the spirit of Husserlian transcendental phenomenology and allows for justifiably believing in the existence of unobservable scientific entities. Peter Lombard is best known as the author of a celebrated work entitled Book of Sentences, which for several centuries served as the standard theological textbook in the Christian West. It was the subject of more commentaries than any other work of Christian literature besides the Bible itself. The Book of Sentences is essentially a compilation of older sources, from the Scriptures and Augustine down to several of the Lombard's contemporaries, such as Hugh of Saint Victor and Peter Abelard. Its (...) importance lies in the Lombard's organisation of the theological material, his method of presentation, and the way in which he shaped doctrine in several major areas. Despite his importance, however, there is no accessible introduction to Peter Lombard's life and thought available in any modern language. This volume fills this considerable gap. Philipp W. Rosemann begins by demonstrating how the Book of Sentences grew out of a long tradition of Christian reflection-a tradition, ultimately rooted in Scripture, which by the twelfth century had become ready to transform itself into a theological system. Turning to the Sentences, Rosemann then offers a brief exposition of the Lombard's life and work. He proceeds to a book-by-book examination and interpretation of its main topics, including the nature and attributes of God, the Trinity, creation, angelology, human nature and the Fall, original sin, Christology, ethics, and the sacraments. He concludes by exploring how the Sentences helped shape the further development of the Christian tradition, from the twelfth century through the time of Martin Luther. (shrink)

This article brings to bear findings from the debate on the boundary problem in democratic theory on discussions of workplace democracy to argue that workplace democrats’ focus on workers is unjustified and that more constituencies will have to be included in any prospective scheme of workplace democracy. It thereby provides a valuable and underdiscussed perspective on workplace democracy that goes beyond the debate’s usual focus on the clarification and justification of workplace democrats’ core claim. It also goes beyond approaches like (...) stakeholder theory in law and economics that determine decision-making rights without taking into account genuinely democratic considerations. My discussion proceeds by considering three principles for inclusion from democratic theory for the specific case of the corporation. I submit that two of them, the all-coerced and the all-subjected principle, are not appropriate for this specific case, because they cannot capture the distinguishing features of the corporation. The all-affected principle however is appropriate but has a very wide range. I further argue that this is not as big of a problem as it first might seem and that this principle is still the most appropriate for defining the demos of the democratic corporation. The article closes by pointing out the consequences of this result for the workplace democracy debate and for the legitimacy of the market as a coordination mechanism. (shrink)

Borderline personality disorder is a complex psychopathological phenomenon. It is usually thought to consist in a vast instability of different aspects that are central to our experience of the world, and to manifest as “a pervasive pattern of instability of interpersonal relationships, self-image, and affects, and marked impulsivity” [American Psychiatric Association, 2013, p. 663]. Typically, of the instability triad—instability in self, affect and emotion, and interpersonal relationships—only the first two are described, examined, and conceptualized from an experiential point of view. (...) In this context, disorders of self have often motivated analyses of self-experience and the sense of self, affective disorders have been frequently considered in the light of emotional experience and its phenomenological structure. Patterns in the phenomenology of social experience have found comparatively little traction when it comes to the conceptualization of the interpersonal disturbances in borderline. In this paper, I argue that interpersonal instability in borderline consists in much more than fragile and shifting relationships but, most importantly, also involves certain styles in experiencing others. These styles, I suggest, may play an explanatory role for the borderline-typical patterns of interpersonal turmoil and so deserve more attention. To better describe and understand these styles, I explore the phenomenological structure of borderline affective instability and discuss the implications it might have for how a person experiences and relates to other people. Considering core aspects of borderline affective instability, such as alexithymia, emotional contagion, emotion dysregulation, and chronic emptiness, I propose borderline can be interpreted as a disturbance of interaffective exchange, which gives rise to certain ways of experiencing others that imply a social impairment. Developing tools is a crucial aspect of experimental practice, yet most discussions of scientific change traditionally emphasize theoretical over technological change. To elaborate on the role of tools in scientific change, I offer an account that shows how scientists use tools in exploratory experiments to form novel concepts. I apply this account to two cases in neuroscience and show how tool development and concept formation are often intertwined in episodes of tool-driven change. I support this view by proposing common normative (...) principles that specify when exploratory concept formation and tool development succeed to initiate scientific change. (shrink)

In this paper, I shall show that for Husserl, (a) evidence determines epistemic justification and (b) evidence is linked to originary givenness in the sense that one's ultimate evidence consists of one's originary presentive intuitions. This means that in contemporary analytic terminology, Husserl is a proponent of evidentialism and mentalism. Evidentialism and mentalism have been introduced into current debates by Earl Conee and Richard Feldman. Finally, I shall highlight that there is one significant difference between Husserl and Earl Conee and (...) Richard Feldman. Although Conee and Feldman argue that the fundamental principles of epistemology are principles of best explanation, Husserl opts for phenomenological principles as the most fundamental epistemic principles. The main difference is that for Husserl, experiences gain their justificatory force by virtue of their phenomenal character, namely, their originary givenness. (shrink)

The concept of elementary epimorphism is introduced. Inverse systems of such maps are considered, and a dual of the elementary chain lemma is found (Cor. 4.2). The same is done for pure epimorphisms (Cor. 4.3 and 4.4). Finally, this is applied to certain inverse limits of flat modules (Thm. 6.4) and certain inverse limits of absolutely pure modules (Cor. 6.3).
