The article examines a number of methodological and conceptual features in the philosophical work of S.L. Rubinstein of the early (Marburg) period. It is assumed that the copies of Rubinstein’s doctoral inaugural dissertation available at the university of Marburg (Germany) and it the private archive of K.A. Abulkhanova represents two parts of one research, which understated expect in it’s first part (the text submitted for defense) an interpretation and criticism of Hegel’s absolute rationalism, and in the second part (...) an exposition of the author’s own concept. It is proved that Rubinstein overcomes the logical limitation the Hegelian philosophical absolutization – the opposition of being and consciousness, the author fuses object and subject in a single being as a domain of accommodation of both, the construction of the internal consistent picture of being as the actual being of a leaving subject. Web scraping involves using computer programs for automated extraction and organization of data from the Web for the purpose of further data analysis and use. It is frequently used by commercial companies, but also has become a valuable tool in epidemiological research and public health planning. In this paper, we explore ethical issues in a project that “scrapes” public websites of U.S. county jails as part of an effort to develop a comprehensive database to enhance HIV surveillance and improve continuity (...) of care for incarcerated populations. We argue that the well-known framework of Emanuel et al. provides only partial ethical guidance for the activities we describe, which lie at a complex intersection of public health research and public health practice. We suggest some ethical considerations from the ethics of public health practice to help fill gaps in this relatively unexplored area. (shrink)

The world of Nazartn appears, on the relentlessly gray surface of its film stock, the most conventional in any of Buñuel's works. Its story of a persecuted priest is left to progress without worrisome spatial or temporal discontinuities. Emotional valences are respected: there is nothing perplexing about the characters' reactions and interplayings. And things are in their place. Such an account of Nazartn recalls Robbe-Grillet's account of Balzacian fiction: All the technical elements of narrative—systematic use of the past tense and the third person, unconditional adoption of chronological development, linear plots, regular trajectory of the passions, impulses of each episode toward a conclusion, etc.—everything tended to impose the image of a stable, coherent, continuous, unequivocal, decipherable universe. Since the intelligibility of the world was not even questioned, to tell a story did not raise a problem. The style of the novel could be innocent, (p. 32) I trust there is no reason to belabor the frailness (I mean with respect to any reading of Balzac) of an argument that pushes to that last sentence. Still, the point is plain enough, and, in its way, and, in its limits, true enough. Because Nazarin (based, by the way, on a novel of Galdós) tells a story in an age when "To tell a story has become strictly impossible" (p. 33) it cannot lay claim to a place in the realm of New Narrative. A speaker wishes to persuade a listener to accept a certain request. The conditions under which the request is justified, from the listener’s point of view, depend on the values of two aspects. The values of the aspects are known only to the speaker and the listener can check the value of at most one. A mechanism specifies a set of messages that the speaker can send and a rule that determines the listener’s response, namely, which aspect he checks and (...) whether he accepts or rejects the speaker’s request. We study mechanisms that maximize the probability that the listener accepts the request when it is justified and rejects the request when it is unjustified, given that the speaker maximizes the probability that his request is accepted. We show that a simple optimal mechanism exists and can be found by solving a linear programming problem in which the set of constraints is derived from what we call the L-principle. (shrink)

For many, the Holocaust made thinking about ethics in traditional ways impossible. It called into question the predominance of speculative ontology in Western thought, and left many arguing that Western political, cultural and philosophical inattention to universal ethics were both a cause and an effect of European civilization's collapse in the twentieth century. Emmanuel Levinas, Elie Wiesel and Richard Rubenstein respond to this problem by insisting that ethics must be Western thought's first concern. Unlike previous thinkers, they locate humanity's source (...) of universal ethical obligation in the temporal world of experience, where human suffering, rather than metaphysics, provides the ground for ethical engagement. All three thinkers contend that Judaism’s key lesson is that our fellow human is our responsibility, and use Judaism to develop a contemporary ethics that could operate with or without God. _Ethics and Suffering since the Holocaust_ explores selected works of Levinas, Wiesel, and Rubenstein for practical applications of their ethics, analyzing the role of suffering and examining the use each thinker makes of Jewish sources and the advantages and disadvantages of this use. Finally, it suggests how the work of Jewish thinkers living in the wake of the Holocaust can be of unique value to those interested in the problem of ethics in the twentieth and twenty-first centuries. Presenting a thorough investigation of the work of Levinas, Wiesel and Rubinstein, this book is of key interest to students and scholars of Jewish studies, as well as Jewish ethics and philosophy. A major difficulty for currently existing theories of inductive inference involves the question of what to do when novel, unknown, or previously unsuspected phenomena occur. In this paper one particular instance of this difficulty is considered, the so-called sampling of species problem.The classical probabilistic theories of inductive inference due to Laplace, Johnson, de Finetti, and Carnap adopt a model of simple enumerative induction in which there are a prespecified number of types or species which may be observed. But, realistically, this (...) is often not the case. In 1838 the English mathematician Augustus De Morgan proposed a modification of the Laplacian model to accommodate situations where the possible types or species to be observed are not assumed to be known in advance; but he did not advance a justification for his solution. Brian Skyrms (1987, 1990, 1993, 1997) has discussed the role of dynamic coherence arguments in the theory of personal or subjective probability. In particular, Skryms (1997) both reviews and discusses the utility of martingale arguments in establishing the convergence of beliefs within the context of radical probabilism. The classical martingale converence theorem, however, assumes the countable additivity of the underlying probability measure; an assumption rejected by some subjectivists such as Bruno de Finetti (see, e.g., de Finetti 1930 and 1972). This paper expands the definition of gray-marketing to include some ethically problematic marketing activities and techniques used in personal selling in China. Based on this, a conceptual model of gray-marketing for a particular type of selling in which both the sellers and the buyers exhibit problematic ethics in an exchange and the associated hypotheses are developed and tested. The findings show that, first, the respondents have different ethical evaluations of different marketing practices used in personal selling such as giving and (...) accepting gifts, buying and accepting meals, and offering and accepting kickbacks. Some of these practices may not be considered unethical. Second, in terms of ethical assessment, gray-marketing practiced by buying agents is more unacceptable than when practiced by sales agents. Third, a person's ethical evaluation of gray-marketing behavior, empathy for gray-marketing, and belief that gray-marketing has serious consequences, significantly affects his inclination to use gray-marketing. This paper concludes with a discussion of some possible applications of our research findings. (shrink)

Joachim Schulte’s introduction provides a distinctive and masterful account of the full range of Wittgenstein’s thought. It is concise but not compressed, substantive but not overloaded with developmental or technical detail, informed by the latest scholarship but not pedantic. Beginners will find it accessible and seasoned students of Wittgenstein will appreciate it for the illuminating overview it provides.

Proposed educational outcomes for the health humanities in medical education range from empathy to visual thinking skills to social accountability. This lack of widely agreed-upon high-level curricular goals limits humanities educators’ ability to design purposeful curricula toward clear, common ends and threatens justifications for scarce curricular time. We propose a novel approach to the hoped-for outcomes of health humanities training in medical schools, which has the potential to encompass traditional health humanities knowledge, skills, and behaviors while also being concrete and (...) measurable: humanistic practice. Humanistic practice, adapted from the concept of ethical sensitivity, is an intentional process of applying humanities knowledge and skills to a clinical scenario by 1) noticing that the scenario requires humanities knowledge or skills, 2) informing one’s clinical and interpersonal strategy and behavior with humanities knowledge or skills, 3) reflecting on the effectiveness of the strategy and behavior, and 4) reorienting to develop new approaches for future practice. The construct of humanistic practice may help address some of the foundational problems in health humanities outcomes research since it transcends the traditional diverse content domains in the health humanities, can link patient and provider experiences, and may bridge the divide among the additive, curative, and intrinsic epistemic positions of humanities to medical education. Objective: To identify factors that predict physicians’ intent to comply with the American Medical Association’s ethical guidelines on gifts from the pharmaceutical industry.Methods: A survey was designed and mailed in June 2004 to a random sample of 850 physicians in Florida, USA, excluding physicians with inactive licences, incomplete addresses, addresses in other states and pretest participants. Factor analysis extracted six factors: attitude towards following the guidelines, subjective norms , facilitating conditions , profession-specific precedents , individual-specific precedents and intent. Multivariate regression (...) modelling was conducted.Results: Surveys were received from 213 physicians representing all specialties, with a net response rate of 25.5%. 62% of respondents were aware of the guidelines; 50% had read them. 48% thought that following the guidelines would increase physicians’ credibility and professional image; 68% agreed that it was important to do so. Intent to comply was positively associated with attitude, subjective norms, facilitators and sponsorship of continuing medical education events, while individual-specific precedents had a negative relationship with intent to comply. Predictors of intent were attitude, subjective norms, the interaction term , sponsorship of CME events and individual-specific precedents.Conclusions: Physicians are more likely to follow the AMA guidelines if they have positive attitudes towards the guidelines, greater subjective norms, fewer expectations of CME sponsorship and fewer individual-specific precedents. Physicians believing that important individuals or organisations expect them to comply with the guidelines are more likely to express intent, despite having fewer beliefs that positive outcomes would result through compliance. Authority qua empowerment is the weak reading of authority in Hans Kelsen's writings. On the one hand, this reading appears to be unresponsive to the problem of authority as we know it from the tradition. On the other hand, it squares with legal positivism. Is Kelsen a legal positivist?Not without qualification. For he defends a normativity thesis along with the separation thesis, and it is at any rate arguable that the normativity thesis mandates a stronger reading of authority than that (...) modelled on empowerment. I offer, in the paper, a prima facie case on behalf of a stronger reading of authority in Kelsen. I go on to argue, however, that the textual evidence weighs heavily in favour of the weak reading. Both nomostatics and nomodynamics are pervasive points of view in the Pure Theory of Law, and both reflect species of empowerment as the endpoint of Kelsen's reconstructions. (shrink)

Among various cases that equally admit of evidentialist reasoning, the supposedly evidentialist solution has varying degrees of intuitive attractiveness. I suggest that cooperative reasoning may account for the appeal of apparently evidentialist behavior in the cases in which it is intuitively attractive, while the inapplicability of cooperative reasoning may account for the unattractiveness of evidentialist behaviour in other cases. A collective causal power with respect to agreed outcomes, not evidentialist reasoning, makes cooperation attractive in the Prisoners' Dilemma. And a natural (...) though unwarranted assumption of such a power may account for the intuitive appeal of the one-box response in Newcomb's Problem. (shrink)

The purpose of this paper is to make a simple observation regarding the Johnson -Carnap continuum of inductive methods. From the outset, a common criticism of this continuum was its failure to permit the confirmation of universal generalizations: that is, if an event has unfailingly occurred in the past, the failure of the continuum to give some weight to the possibility that the event will continue to occur without fail in the future. The Johnson -Carnap continuum is the mathematical consequence (...) of an axiom termed Johnson 's sufficientness postulate, the thesis of this paper is that, properly viewed, the failure of the Johnson -Carnap continuum to confirm universal generalizations is not a deep fact, but rather an immediate consequence of the sufficientness postulate; and that if this postulate is modified in the minimal manner necessary to eliminate such an entailment, then the result is a new continuum that differs from the old one in precisely one respect: it enjoys the desideratum of confirming universal generalizations. Inducing the rubber hand illusion (RHI) requires that participants look at an imitation hand while it is stroked in synchrony with their occluded biological hand. Previous explanations of the RHI have emphasized multisensory integration, and excluded higher cognitive functions. We investigated the relationship between the RHI and higher cognitive functions by experimentally testing task switch (as measured by switch cost) and mind wandering (as measured by SART score); we also included a questionnaire for attentional control that comprises two subscales, attention-shift (...) and attention-focus. To assess experience of RHI, the Botvinick and Cohen (1998) questionnaire was used and illusion onset time was recorded. Our results indicate that rapidity of onset reliably indicates illusion strength. Regression analysis revealed that participants evincing less switch cost and higher attention-shift scores had faster RHI onset times, and that those with higher attention-shift scores experienced the RHI more vividly. These results suggest that the multi-sensory hypothesis is not sufficient to explain the illusion: higher cognitive functions should be taken into account when explaining variation in the experience of ownership for the rubber hand.
