This article considers HLA Hart's influence in the making of John Finnis's book Natural Law and Natural Rights. In the style of an intellectual biography it traces the history of the interaction between the two Oxford legal philosophers using their correspondence as a starting point. It also delves into Finnis's years in Africa—a period of his life both crucial for the writing of the book and utterly unknown. It argues that Hart's role was significant not only insofar as he was (...) behind the idea of the book but also because of the restrained way in which he freely chose to conduct his role as editor despite the extent of the reservations he had regarding Finnis's work, fully revealed here. Given the importance of Natural Law and Natural Rights for what has been called the ‘new natural law theory’ the article concludes by awarding Hart his due credit in the making of one of that theory's main sources of inspiration. Legitimate expectations should be considered in the transition to a low-carbon society. After explaining under what conditions and circumstances expectations are legitimate, this paper shows that those expectations whose frustration undermines the ability to plan, infringes basic moral rights, or is extremely costly for its bearer might justify a deviation in the baseline of justice in favour of the expectation holder. People should be notified about the likely frustration of their expectations so that they can avoid the frustration of their (...) expectations, adapt their life plans and minimise costs. Since the frustration of legitimate expectations seems unavoidable in the transformation to a low-carbon society, priority should be given to the protection of the expectations of those who cannot be materially compensated. Still, if two groups are eligible for material compensation, we should give priority to protecting the expectation of those who cannot continue with the same life plan as before if their expectations are frustrated. Humanizar la muerte requiere, ante todo, el reconocimiento del valor que en sí misma tiene la experiencia de la muerte y la importancia trascendental que, para todo individuo, posee afrontar con el respaldo sanitario y emocional necesario ese momento decisivo. En este sentido, el enfoque que toma como base la idea de la imposibilidad de vivir la muerte, y no sólo la con frecuencia cuestionada preparación del personal sanitario para ayudar al paciente terminal a afrontarla, tiene mucho que ver en (...) el escamoteo y ocultamiento de tal experiencia. Frente a esto hay que considerar que la muerte es algo que se vive, aunque obviamente no se sobrevive a ella. No sobrevivir a la muerte no resta valor a la experiencia de la muerte. (shrink)

From the most prominent thinkers in Latin American philosophy, literature, politics, and social science comes a challenge to conventional theories of globalization. The contributors to this volume imagine a discourse in which revolution requires no temporalized march of progress or takeovers of state power but instead aims at local control and the material conditions for human dignity.

The aim of this work is to analyse the concept of semi-sentence from a linguistic, formal and computational point of view. A semi-sentence can be characterised as a sentence which, from a grammatical perspective, is neither absolutely correct nor incorrect . This study focuses on: - a characterisation of the semi-sentences in the setting of the grammar of a language. This study will help to analyse in depth the concept of grammaticality [3]; - the correlate of semi-sentences in formal languages, (...) i.e., semi-strings, which arise from applying productions that deviate from that which is strictly permitted by the rules of grammar [6]; - a Prolog program for handling semi-grammaticality in a computational manner [2]. It is shown here that the modal logic K and any extension of it with a finite number of axioms can be characterised by a polynomial semantics. Moreover, some comments are made about the possibility of using algebraic computation to determine deducibility on these logics.

En este artículo intentaremos demostrar que precisamente una aparente confusión de Plutarco, desconocemos si intencionada o no, nos puso en contacto con el sentido ordinario que el término "Biblioteke" tendrá posteriormente hasta la actualidad. Llegar a esta conclusión supone un detallado análisis de la fundación de la Biblioteca de Alejandría atendiendo a su punto de partida desde la aplicación de la filosofía aristotélica a la configuración no sólo de un espacio ordenado para libros sino de un ámbito imaginario de lectura (...) desde el que se establece el mundo de relaciones helenístico. Este monopolio que, como industria del libro, nace y se desarrolla con la filología alejandrina, por obra de Calimaco y sus Pínakes se convierte en una "guía" platónica para la generalización de la biblioteca como una entidad de posible reproducción en cualquier parte, cambiando así el primitivo sentido del término e incluso su función restringida a un solo lugar. In this article, we aim to evaluate the role of robots’ personality-driven behavioural patterns on users’ intention to use in an entertainment scenario. Toward such a goal, we designed two personalities: one introverted with an empathic and self-comparative interaction style, and the other extroverted with a provocative and other-comparative interaction style. To evaluate the proposed technology acceptance model, we conducted an experiment (N = 209) at a public venue where users were requested to play a game with the support of (...) the TIAGo robot. Our findings show that the robot personality affects the acceptance model and three relevant drivers: perceived enjoyment, perceived usefulness, and social influence. The extroverted robot was perceived as more useful than the introverted, and participants who interacted with it were faster at solving the game. On the other hand, the introverted robot was perceived as more enjoyable but less useful than the extroverted, and participants who interacted with it made fewer mistakes. Taken together, these findings support the importance of designing proper robot personalities in influencing users’ acceptance, featuring that a given style can elicit a different driver of acceptance. In this paper, we argue for an instrumental form of existence, inspired by Hilbert’s method of ideal elements. As a case study, we consider the existence of contradictory objects in models of non-classical set theories. Based on this discussion, we argue for a very liberal notion of existence in mathematics.

Presentaré la red teórica de leyes especiales que surgen de la especialización de esta ley fundamental. Supondré el estructuralismo como marco metateórico. The concept of fitness has generated a lot of discussion in philosophy of biology. There is, however, relative agreement about the need to distinguish at least two uses of the term: ecological fitness on the one hand, and population genetics fitness on the other. The goal of this paper is to give an explication of the concept of ecological fitness by providing a reconstruction of the theory of natural selection in which this concept was framed, that is, based on the (...) way the theory was put to use in Darwin’s main texts. I will contend that this reconstruction enables us to account for the current use of the theory of natural selection. The framework presupposed in the analysis will be that of metatheoretical structuralism. This framework will provide both a better understanding of the nature of ecological fitness and a more complete reconstruction of the theory. In particular, it will provide what I think is a better way of understanding how the concept of fitness is applied through heterogeneous cases. One of the major advantages of my way of thinking about natural selection theory is that it would not have the peculiar metatheoretical status that it has in other available views. I will argue that in order to achieve these goals it is necessary to make several concepts explicit, concepts that are frequently omitted in usual reconstructions. (shrink)

This is a draft of my chapter on Negligence for the forthcoming Oxford Handbook in Moral Psychology. It discusses philosophical, psychological, and legal approaches to the attribution of culpability in cases of negligent wrongdoing.

Object files are mental representations that enable perceptual systems to keep track of objects as numerically the same. How is their reference fixed? A prominent approach, championed by Zenon Pylyshyn and John Campbell, makes room for a non-satisfactional use of properties to fix reference. This maneuver has enabled them to reconcile a singularist view of reference with the intuition that properties must play a role in reference fixing. This paper examines Campbell’s influential defense of this strategy. After criticizing it, a (...) new approach is sketched. The alternative view introduces representational contents to explain perceptual individuation. After arguing that those contents are not satisfactional, it is concluded that there is room for a third view of reference fixing that does not fit into the singularist/descriptivist dichotomy. The past decade has seen a flurry of social scientific research on the use of racial categories in human genetics research. This literature has critically analyzed how U.S. race relations are being shaped by and themselves shaping research on human biological difference and disease. Recent work, however, suggests that the particular configurations of science and ethnoracial politics in the US are not exportable. Instead, research on human biology in other contexts reveals the importance of not just racial categories, but national, (...) ethnic, regional and linguistic classifications of bodies and communities... This paper argues that habits, just like beliefs, can guide intentional action. To do this, a variety of real-life cases where a person acts habitually but contrary to her beliefs are discussed. The cases serve as dissociations showing that intentional agency is possible without doxastic guidance. The upshot is a model for thinking about the rationality of habitual action and the rationalizing role that habits can play in it. Theories of emotional justification investigate the conditions under which emotions are epistemically justified or unjustified. I make three contributions to this research program. First, I show that we can generalize some familiar epistemological concepts and distinctions to emotional experiences. Second, I use these concepts and distinctions to display the limits of the ‘simple view’ of emotional justification. On this approach, the justification of emotions stems only from the contents of the mental states they are based on, also known as their (...) cognitive bases. The simple view faces the ‘gap problem’: If cognitive bases and emotions (re)present their objects and properties in different ways, then cognitive bases are not sufficient to justify emotions. Third, I offer a novel solution to the gap problem based on emotional dispositions. This solution (1) draws a line between the justification of basic and non-basic emotions, (2) preserves a broadly cognitivist view of emotions, (3) avoids a form of value skepticism that threatens inferentialist views of emotional justification, and (4) sheds new light on the structure of our epistemic access to evaluative properties. Durante la década de 1950 Karlheinz Stockhausen adhirió a los principios modernistas promovidos por la Escuela de Darmstadt que dieron lugar al desarrollo del serialismo integral. En su búsqueda de renovación del lenguaje musical, Stockhausen intentó aplicar esta técnica a la composición de obras electrónicas en el laboratorio de la WDR (Westdeutscher Rundfunk) en Colonia. Este artículo indaga, por medio del concepto de mediación técnica propuesto por Bruno Latour, cómo el intercambio de propiedades entre humanos y no humanos propiciado por (...) el laboratorio fue modificando el proyecto serial. Como resultado de ese proceso, Stockhausen compuso una serie obras que no pudieron ser completamente prefiguradas a priori, hecho que demandó la creación de nuevas formas de escucha y notación musical. A partir de ello, buscaremos caracterizar la práctica compositiva de Stockhausen desde una perspectiva no modernista, haciendo hincapié en el carácter híbrido y relacional de los eventos musicales. Philosophical accounts of moral responsibility are standardly framed by two platitudes. According to them, blame requires the presence of a moral defect in the agent and the absence of excuses. In this chapter, this kind of approach is challenged. It is argued that (a) people sometimes violate moral norms due to performance mistakes, (b) it often appears reasonable to hold them responsible for it, and (c) their mistakes cannot be traced to their moral qualities or to the presence of excuses. The theme of the sickness of the soul is in the mind of late antique Christian philosopher, Evagrius of Pontus, a frontier topic between the two major thematic areas in which his work can be divided: the psycho-spiritual and metaphysics. Reflect and try to define the origin and status of disease in Evagrio implies, in effect, pay attention to a transversal topic of his work: the ignorance. The consideration of this psycho-spiritual condition, it is necessary to achieve a coherent conceptual (...) definition of the concept of disease in Evagrius. Similarly, understanding how the ignorance is the source of passionate disorder that operates in the states of mental imbalance, implies considering their causal link with immoderate love of self or philautia. In the scheme evagriano the philautia is, in turn, the common origin of evil and destabilizing thoughts that are the characteristic cognitive activity of the disease state and that Evagrius calls logismoi. This paper introduces a body of research on Organizational Behavior and Industrial/organizational Psychology that expands the range of empirical evidence relevant to the ongoing character-situation debate. This body of research, mostly neglected by moral philosophers, provides important insights to move the debate forward. First, the OB/io scholarship provides empirical evidence to show that social environments like organizations have significant power to shape the character traits of their members. This scholarship also describes some of the mechanisms through which this process of (...) reshaping character takes place. Second, the character-situation debate has narrowly focused on situational influences that affect behavior episodically and haphazardly. The OB/io research, however, highlights the importance of distinguishing such situational influences from influences that, like organizational influences, shape our character traits because they are continuous and coordinated. Third, the OB/io literature suggests that most individuals display character traits that, while local to the organization, can be consistent across situations. This puts pressure on the accounts of character proposed by traditional virtue ethics and situationism and provides empirical support to interactionist models based on cognitive-affective processing system theories of personality. Finally, the OB/io literature raises important challenges to the possibility of achieving virtue, provides valuable and untapped resources to cultivate character, and suggests new avenues of normative and empirical research. Este libro analiza y reconstruye una de las teorías científicas que más discusiones han provocado en el ámbito de la biología, de la filosofía y de la sociedad: la teoría de la selección natural. Esta teoría, que ocupa un lugar central en la biología evolutiva, se encuentra en el centro de la revolución darwiniana, uno de los cambios más radicales ocurridos en la historia de la ciencia y, sin dudas, uno de los que más consecuencias han tenido sobre la ciencia (...) en general, sobre la filosofía y sobre el mismo modo en que nos percibimos en el mundo. -/- Si bien se trata de una teoría que parece sencilla de comprender, ha sido especialmente elusiva a los intentos de reconstrucción, no hay acuerdo con respecto a su estructura ni a cuáles son sus conceptos fundamentales. En este trabajo, asumiendo el marco conceptual brindado por el estructuralismo metateórico, se propone una reconstrucción que permite no solo dar cuenta adecuadamente del modo en que la teoría funciona en la práctica científica actual, sino que, además, permite explicitar la importancia filosófica antes aludida. -/- Frente a los desacuerdos marcados en la filosofía de la biología, pero también en textos y manuales de los biólogos evolutivos, respecto del modo de presentación adecuado y la naturaleza de la teoría, la estrategia reconstructiva consiste en discutir la teoría en su origen, tal como apareció en los textos de uno de sus codescubridores, Charles Darwin. La intención del libro es, entonces, no solo explicitar la estructura de la teoría, sino, además, su lugar en el pensamiento de Darwin, en la revolución darwiniana y en la biología evolutiva. El objetivo de este artículo es compartir con la comunidad académica el resultado de investigación de la tesis doctoral de filosofía intitulada La parresía como heterotopía en el último Foucault: otro modo crítico y específico de ser, pensar, decir y vivir. En efecto, intento esbozar el itinerario de la obra del úlltimo Foucault como una genealogía de la parresía, que recoge las conclusiones más relevantes de cuatro años de indagación. Finalmente, resalto la retrospectiva y la prospectiva de la parresía foucaultiana (...) como un arte integral de vivir a partir del cuidado de sí, desarrollado por sus autores más estudiosos y otras corrientes contemporáneas afines a este tópico. Todo converge en la “heterotopía” como ese tetraédrico otro modo crítico y específico o línea de fuga: ser, pensar, decir y vivir, que culmina con una relectura desde el ámbito latinoamericano como una propuesta pertinente altermundialista focalizada en una “cuidadanía” —más que ciudadanía— ética en todos los ámbitos humanos, sobre todo el que más nos compete: el educativo. In this article, I examine recent debates concerning the existence and the nature of basic actions. The discussion is structured around four theses, with which Arthur Danto introduced basic actions to contemporary theorists. The theses concern (i) the relationship between agency and causality, (ii) the distinction between basic and complex actions, (iii) the regress argument for basic actions, and (iv) the structure of practical knowledge in the light of these actions.

Scholars who favor shareholder primacy usually claim either that managers should not fulfill corporate duties of beneficence or that, if they are required to fulfill them, they do so by going against their obligations to shareholders. Distinguishing between structurally different types of duties of beneficence and recognizing the full force of the normative demands imposed on managers reveal that this view needs to be qualified. Although it is correct to think that managers, when acting on behalf of shareholders, are not (...) required to fulfill wide duties of charity, they are nevertheless required to fulfill a variety of narrow duties of beneficence. What is more, the obligation to fulfill these duties arises precisely because they are acting on behalf of shareholders. As such, this article 1) refines our understanding of the duties of corporate beneficence and 2) helps to identify which duties of beneficence are imposed on managers when they are acting on behalf of shareholders. In this review, I discuss recent advances in philosophical and psychological approaches to self-control. The review is divided in 4 parts, in which I discuss: a) different conceptions of self-control; b) standard methods for studying it; c) some models of how self-control is exercised; and d) the connections between self-control and other relevant psychological constructs. The review was originally commissioned by the John Templeton Foundation to provide an informative overview that would knit together different strands of current debates in the (...) field. According to MODERATISM, perceptual justification requires that one independently takes for granted propositional hinges like <There is an external world>, <I am not a brain in a vat (BIV)>, and so on. This view faces the truth problem: to offer an account of truth for hinges that is not threatened by skepticism. Annalisa Coliva has tried to solve the truth problem by combining the claim that external world propositions have a substantive truth property like correspondence with the claim that hinges (...) have a deflationary truth property. I argue that the resulting view cannot offer a coherent characterization of ‘skeptical switch scenarios’ while providing an effective anti-skeptical strategy. In a more positive vein, I defend an approach that combines a correspondence conception of truth with epistemological disjunctivism. (shrink)

This paper defends a version of the Simple View, the claim that someone intentionally φs only if the person intends to φ. To do this, I raise a problem for Bratman’s classic argument (1984, 1987) against it. The problem brings into focus an evaluative dimension behind the View, whose recognition allows for an improved version of it. With this improved version, I then go on to answer other criticisms that have been raised to it.

Suele señalarse la fuerte influencia que la teología natural tuvo sobre Darwin en su conceptualización del fenómeno de la adaptación. La teoría de la selección natural explicaría el mismo fenómeno que los teólogos naturales querían explicar: la adaptación. Recientemente ha sido señalado, sin embargo, que la forma darwiniana de conceptualizar la adaptación es novedosa. Las adaptaciones de la teología natural presupondrían la idea de que los organismos existen para la realización y manutención del equilibrio natural establecido por el creador. El (...) punto de este trabajo discutir esta cuestión, asumiendo el marco del estructuralismo metateórico. The strong influence that natural theology had over Darwin’s conceptualization of the adaptation phenomenon is frequently noted. The natural selection theory would explain the same phenomenon that the natural theologist intended to explain: the adaptation. Recently has been claimed, on the contrary, that the Darwinian way of conceptualizing adaptation is new. The concept of adaptation from natural theology presupposes the idea that organisms exist for realization and support of the natural equilibrium stated by the creator. In this work I will discuss this point, assuming the metatheoretical structuralism frame. (shrink)

In _Basic Concepts_, Heidegger claims that "Being is the most worn-out" and yet also that Being "remains constantly available." Santiago Zabala radicalizes the consequences of these little known but significant affirmations. Revisiting the work of Jacques Derrida, Reiner Schürmann, Jean-Luc Nancy, Hans-Georg Gadamer, Ernst Tugendhat, and Gianni Vattimo, he finds these remains of Being within which ontological thought can still operate. Being is an event, Zabala argues, a kind of generosity and gift that generates astonishment in those who experience (...) it. This sense of wonder has fueled questions of meaning for centuries-from Plato to the present day. Postmetaphysical accounts of Being, as exemplified by the thinkers of Zabala's analysis, as well as by Nietzsche, Dewey, and others he encounters, don't abandon Being. Rather, they reject rigid, determined modes of essentialist thought in favor of more fluid, malleable, and adaptable conceptions, redefining the pursuit and meaning of philosophy itself. (shrink)

Abstract: In Mind and World, McDowell conceives of the content of perceptual experiences as conceptual. This picture is supposed to provide a therapy for skepticism, by showing that empirical thinking is objectively and normatively constrained. The paper offers a reconstruction of McDowell's view and shows that the therapy fails. This claim is based on three arguments: 1) the identity conception of truth he exploits is unable to sustain the idea that perception-judgment transitions are normally truth conducing; 2) it could be (...) plausible only from an externalist point of view that is in tension with the view of normativity that motivates conceptualism; 3) the identity conception of truth is incompatible with McDowell's recent version of conceptualism in terms of ‘non-propositional intuitive contents’. Xenophon’s conception of the dialectical method shares many similarities with Antisthenes’ point of view regarding the relation between language and reality. The key element supporting this reading is the parallel between Xenophon’s method of dialegein kata genē and Antisthenes’ method of episkepsis tōn onomatōn. In this paper, I claim that a correct understanding of both methods yields a clear structural proximity between the two Socratics on the issue of dialectics. Although they present some significant differences, which I will also explore, (...) I will argue that both variants express a single Socratic motive with regard to dialectics. That is that dialectics, in its basic structure, consists of organizing reality through discourse in order to make it comprehensible. In particular, this is done through establishing unified instances capable of comprehending a multiplicity. This nuclear position could also be extended to include middle Plato’s concept of dialectics. This concurrence takes up different forms in Plato, Xenophon and Antisthenes. Nevertheless, they share the same structure, which indicates quite plausibly a major characteristic of Socratic philosophies, as opposed to previous attempts by the Presocratics and the Sophists. :In this essay, I present an account of forgiveness as a process of emotional distancing. The central claim is that, understood in these terms, forgiveness does not require a change in judgment. Rationally forgiving someone, in other words, does not require that one judges the significance of the wrongdoing differently or that one comes to the conclusion that the attitudes behind it have changed in a favorable way. The model shows in what sense forgiving is inherently social, shows why we (...) should be pluralists about it, and provides a basis for arguing against the existence of necessary conditions of forgiving.
