This article proposes a reflection on the persistence of Nazi jurisdictional models in contemporary legal theory, briefly comparing the work of authors such as Wolf, Larenz, Schmitt, Dworkin and Alexy. It aims to demonstrate the authoritarian and radically undemocratic character of certain theoretical constructions used in adjudication, particularly in Brazil. For this purpose, three representative judicial decisions from 2016 are analyzed, highlighting typical structural features of Nazi legal theory which remain accepted by current legal theory, such as the (...) disregard for legality, the personification of the community as judge and the appeal to social values which are taken as self-evident. Perdurance is a mode of persistence. The heart of perdurance is a space-time analogy: a perduring object is extended in time in a way that is analogous to how a composite object is extended in space. This paper is a discussion of perdurance in light of the distinction between mereologically structured and unstructured objects. I show that while the standard formulation of perdurance captures the space-time analogy for unstructured objects, it fails to capture the space-time analogy for temporally and (...) spatially structured objects. Philippe Huneman has recently questioned the widespread application of mechanistic models of scientific explanation based on the existence of structural explanations, i.e. explanations that account for the phenomenon to be explained in virtue of the mathematical properties of the system where the phenomenon obtains, rather than in terms of the mechanisms that causally produce the phenomenon. Structural explanations are very diverse, including cases like explanations in terms of bowtie structures, in terms of the topological properties of the system, (...) or in terms of equilibrium. The role of mathematics in bowtie structured systems and in topologically constrained systems has recently been examined in different papers. However, the specific role that mathematical properties play in equilibrium explanations requires further examination, as different authors defend different interpretations, some of them closer to the new-mechanistic approach than to the structural model advocated by Huneman. In this paper, we cover this gap by investigating the explanatory role that mathematics play in Blaser and Kirschner’s nested equilibrium model of the stability of persistent long-term human-microbe associations. We argue that their model is explanatory because: i) it provides a mathematical structure in the form of a set of differential equations that together satisfy an ESS; ii) that the nested nature of the ESSs makes the explanation of host-microbe persistent associations robust to any perturbation; iii) that this is so because the properties of the ESS directly mirror the properties of the biological system in a non-causal way. The combination of these three theses make equilibrium explanations look more similar to structural explanations than to causal-mechanistic explanation. (shrink)

With the development and support of modern technologies such as digital media and online live stream, it has become an effective way to promote the online transaction of museum cultural and creative products. Based on the Technology Acceptance Model combined with the Post-Acceptance Model of Information System Continuance and the theories on customer satisfaction index, this research introduces perceived interest and media richness as variables and constructs a model of the influencing factors of online consumers’ persistent purchase of museum products. (...) The research model and related hypotheses were verified through structural equation modeling. The research found that perceived value and satisfaction are the key variables that have impact on the PP of consumers. Perceived quality, brand trust, MR, PI, and perceived usefulness have significant effects on PV and SAT. Involvement in purchasing decisions positively moderates the impact on SAT of PV. One of the central issues in comparative law and political economy is whether the forces of globalization will result in the convergence of public policies across countries. Noting in particular that taxes collected still cover a considerable range across industrialized countries — from a low of 20% of GDP to a high of 50% — some have argued that globalization has not resulted in a loss of tax sovereignty. However, following a review of the evidence, in this Article we conclude (...) that globalization has had significant but subtle effects on tax levels and structures. Moreover, these pressures will make it increasingly difficult for countries to raise revenue to finance new public needs and to structure their tax systems in order to achieve a more socially acceptable distribution of income than what market forces dictate. Tax levels in most countries have remained essentially flat over the past twenty years, but there is a host of reasons for thinking they would have continued to rise were it not for the pressures of globalization. Statutory corporate tax rates have declined dramatically and, although corporate tax revenues have remained robust, this has been due to factors unrelated to deliberate tax policy choices. Personal marginal tax rates have also declined sharply and tax revenues have been increasingly raised by regressive consumption taxes. These trends stem from tax competition brought on by the forces of globalization, not from changing ideas or other political variables. In this Article we conclude that in order to prevent tax competition from completely eroding the ability of countries to fashion their own tax systems, there will have to be considerable cooperation among the major countries and some harmonization of aspects of their tax systems, particularly as they apply to footloose factors of production. Previous research reported that in processing structurally ambiguous sentences comprehenders often preserve an initial incorrect analysis even after adopting a correct analysis following structural disambiguation. One criticism is that the sentences tested in previous studies involved referential ambiguity and allowed comprehenders to make inferences about the initial interpretation using pragmatic information, suggesting the possibility that the initial analysis persisted due to comprehenders' pragmatic inference but not to their failure to perform complete reanalysis of the initial misanalysis. Our study investigated (...) this by testing locally ambiguous relative clause sentences in Japanese, in which the initial misinterpretation contradicts the correct interpretation. Our study using a self-paced reading technique demonstrated evidence for the persistence of the initial analysis with this structure. The results from an eye-tracking study further suggested that the phenomenon directly reflected the amount of support given to the initial incorrect analysis prior to disambiguating information: The more supported the incorrect main clause analysis was, the more likely comprehenders were to preserve the analysis even after the analysis was falsified. Our results thus demonstrated that the preservation of the initial analysis occurs not due to referential ambiguities but to comprehenders' difficulty to fully revise the highly supported initial interpretation. This is an examination of an avian-shaped feature that rests below a network of cellular structures found on a mound within the Argyre Basin of Mars. The area examined is located near 48.0° south and 55.1° west. A set of four supportive images provided by the Mars Global Surveyor and Mars Reconnaissance Orbiter spacecraft show the feature is persistent over a period of more than 20 years. The images reveal defining aspects of this avian feature, including a head, beak, body, (...) eye, legs, feet, toes, wing, and feathers. When taken together, these components induce the visual impression of an avian-shaped formation that exhibits a unique set of proportional features. The claim of artificial construction is offered and the geoscientist author will examine natural mechanisms that could contribute to the creation of this feature and the testimony of three veterinarians will provide a critical analysis of the avian features. A terrestrial comparison of aesthetic and iconographic motifs is investigated. The request for further study and additional images of these structural components are also encouraged. (shrink)

New modes of environmental regulation are said to have transcended the public/private divide. These new regulatory schemes - referred to as non-coercive orderings, self-regulation, co-regulation, metaregulation and social regulation - set aside the formal nature of the regulating entity, the regulated entity, and the tools of regulation. Instead of asking whether the means, objects and formulators of the regulation are public or private, the focus lies on the substance and effectiveness of the regulation in mitigating environmental harms. In this Article (...) we argue that despite these claims, often advanced by new governance proponents, the public/private divide in in fact alive and well, informing and impacting the ways in which various regulatory schemes are justified and legitimated. We exemplify this argument through an analysis of the role of three entities in international environmental regulation: the state, local governments, and civil society entities. This Article then suggests three consequences of the persistence of the public/private dichotomy and its denial: it produces a “tilt” towards the private; it tends to hide conflicts and disagreements, projecting an image of a frictionless world; and it prevents an imagination of a different world that transcends the structure of social life embedded in it. Mathematically gifted students are precious human resources, educators of which make a great difference in helping them realize their potential. The retention of qualified teachers of mathematically gifted students is an issue worthy of in-depth exploration. In China, mathematics competitions are an important part of mathematics gifted education, and the teaching of the Mathematical Olympiad is a challenging profession with a high attrition rate. This qualitative study takes four seasoned and outstanding Chinese teachers as cases, collects data through individual semi-structured (...) interviews, and uses the thematic analysis method based on Herzberg’s two-factor theory to analyze why they can persist in the field of Mathematical Olympiad teaching for more than 20 years. The results show that the motivation factors affecting retention are recognition, achievement, possibility of growth, work itself, and responsibility, and the hygiene factors are policy and interpersonal relationships. Motivation factors are the main reason for their long-term persistence, while hygiene factors are conducive to their persistence as a whole. Finally, enlightenment to educational policy and school management and suggestions for retention and development of teachers of the mathematically gifted are provided. (shrink)

If we are looking for an Ur-explanation for the persistence of the Ur-myth, or any other myth, in our literature, could we not more directly find it in the structure of a mind which does not have to remember in order to imitate? E-science, or networked, collaborative and multidisciplinary scientific research on a shared e-infrastructure using computational tools, methods and applications, has also brought about new networked organizational forms in the transition of higher education towards the entrepreneurial academy. While the under-representation of women in ICTs is well-recorded, it is also known that the potential of new organizational forms such as networked structures to promote gender equality remains ambiguous, as they tend to perpetuate already existing inequalities due to their embeddedness in larger and (...) longer-term structural or institutional gender effects. Based on a year-long ethnographic study in a networked academic e-science collaboration in Sweden and 45 in-depth, semi-structured interviews with its affiliated researchers, this article analyzes the multi-level obstacles to achieving gender equality in e-science to highlight the ways in which gendered disparities persist in this new, project-based academic networked organization in Sweden, hereafter called eSec. At the _organizational level_ eSec remains deeply embedded in the traditional disciplinary and institutional academic setting, inadvertently reproducing existing gender imbalances across sciences. Furthermore, as a project-based organization, it is also embedded in the shift towards an entrepreneurial university model driven by new managerialism, the latter having a well-documented adverse effect in gender equality. This represents _a structural-level_ obstacle which leads to especially female junior faculty leaving academy for industry. An _individual level_ obstacle is observed alongside these as disavowal (_Verleugnung_) of gender disparities, an affect identified as a key mechanism of subjectivation in neoliberalism. (shrink)

De nombreux problèmes conceptuels et pratiques concernant ce paramètre apparaissent et sont alors menés de nombreux travaux de développement d’alternatives à ces modèles qui semblent dépassés. How do groups of people persist through time? Groups can change their members, locations, and structure. In this paper, I present puzzles of persistence applied to social groups. I first argue that four-dimensional theories better explain the context sensitivity of how groups persist. I then exploit two unique features of the social to argue for the stage theory of group persistence in particular. First, fusion and fission cases actually happen to social groups, and so cannot be marginalized as (...) “pathological.” Second, it is implausible that groups spatially coincide pre-fission. This means that theories that depend on pre-fission spatial coincidence, such as some endurance theories and the worm theory, cannot explain fission cases. All things considered, the stage theory offers the best explanation of how groups persist. (shrink)

The effect of early emotional memories have been one of the most researched topics in modern scientific psychology. On the other hand, rigorous qualitative studies have been relatively rare, investigating the lived consequences of early emotional memories. The purpose of this paper is to report on some human scientific research results on the phenomenon, the lived persistent psychological meaning of early emotional memories. The study utilized Giorgi's descriptive phenomenological psychological method. A general psychological structure was discovered indicating constituents such as, (...) the vividness of early emotional memories; emotional needs coping strategies; everyday and life choices; as well as personal values attached to the meaning of an object that was present during the early emotional situation . The results might have implications for human service professionals in that they can contribute to a human scientific foundation in terms of understanding the persistent psychological meaning of early emotional memories as well as opening up for new venues of research on phenomena related to human memory, personality, and life-span developmental psychology. I offer two counterexamples, and consider two possible responses to a natural objection to them, neither of which support the view that it is a metaphysical truth that social groups persist through changes in their membership, or persist by virtue of the maintenance of their structure and/or function.

Even the turn to structural racism is largely circumscribed to inclusion without substantive challenge to existing processes or profit margins. When portions of the racist public are targeted, it is often the least elite members of society. Managing learning continuity is critical for successful MOOC learning. Thus, enabling learners to have learning persistence needs to be integrated into the MOOC learning design. Motivation effort is a critical component enabling students to maintain continuous MOOC learning. The expectancy–value theory explains why learners engage in learning: they have a higher perceived ability for learning success, place value on learning, and avoid psychological costs. However, it is unclear how these factors affect MOOC learning persistence and how learners’ motivation (...) is formed from this perspective. This experimental study explored how learners’ motivational variables affect their learning persistence, focusing on the expectancy–value theory. The results of this study indicated that academic self-efficacy and task value had significant positive effects on learning persistence. The structural relationship of antecedent, process, and outcome variables showed that teaching presence as an antecedent had a significantly positive effect on academic self-efficacy and task value. Among the three factors of the expectancy–value theory, only the task value influenced learning persistence through student engagement as a mediator. Based on the results, suggestions are provided for motivating MOOC environments that support learners’ continuous MOOC learning. (shrink)

The term “legacy effect” has been used in ecology since the early 1990s by authors studying plant succession, invasive-plant impacts, herbivory impacts, ecosystem engineering, and human land-use impacts. Although there is some variability in usage, the term is normally used to describe impacts of a species on abiotic or biotic features of ecosystems that persist for a long time after the species has been extirpated or ceased activity and which have an effect on other species. For example, human agricultural activities (...) may have a legacy effect on soil structure and vegetative communities that lasts for centuries and which alters current communities. The concept may be related to the idea of ecological inheritance in evolutionary biology but would refer only to a subset of the features of this concept. In particular, legacy effects could refer to those kinds of ecological inheritance where a physical or biological change in ecosystem state is caused by one species, where this change persists after the extirpation of the causal species and alters selection pressure of another species much later in time. We define an order independent version of default unification on typed feature structures. The operation is one where default information in a feature structure typed with a more specific type, will override default information in a feature structure typed with a more general type, where specificity is defined by the subtyping relation in the type hierarchy. The operation is also able to handle feature structures where reentrancies are default. We provide a formal semantics, prove order independence and demonstrate the utility (...) of this version of default unification in several linguistic applications. First, we show how it can be used to define multiple orthogonal default inheritance in the lexicon in a fully declarative fashion. Secondly, we show how default lexical specifications (introduced via default lexical inheritance) can be made to usefully persist beyond the lexicon and interact with syntagmatic rules. Finally, we outline how persistent default unification might underpin default feature propagation principles and a more restrictive and constraint-based approach to lexical rules. (shrink)

Today, almost 30 years after the Harvard Ad Hoc Committee’s definition of death and 20 years after the Quinlan decision, the questions of death and dying are still with us. Recently, the question of physician-assisted suicide once again gained national [End Page 378] attention with the trials of Dr. Kevorkian and the decisions of the Ninth and Second Circuit Courts on the constitutionality of the Washington and New York state laws prohibiting physician-assisted suicide. At the same time, questions and controversies about the appropriate extent of treatment and the determination of death in relationship to treatment continue to be problematic in health care.As I reviewed the literature in the area of death and dying, one central question emerged: Why, after so much reflection, energy, and discussion, do the problems around death and dying continue to persist? There is a recurring character to these questions that is indeed a wonder. In reviewing these moral controversies, one might ask what these controversies and their persistent character tell us about bioethics that can help us to understand the issues and the field.Some might blame the development of medical technology for the persistence of these issues of death and dying. The development and use of technological resources certainly is an important element of these continuing controversies. The use of medical technologies at the end of life allows us the possibility to sustain lives that would have been lost just a few decades ago. However, while medical technology certainly opens new horizons and possibilities, the development and deployment of technology does not sufficiently explain why these issues are so difficult and persistent. The question underlying the use of medical technology at the end of life is the question about which criteria are to be used to make judgments about the appropriate use of such technology. If the use of medical technology depends on the moral views one holds about death, suffering, and the appropriate use of resources, then such issues will be morally controversial in a society that is morally pluralistic.To address these questions, it is important to remember what is all too obvious and yet often forgotten. Death is not only a medical event. In this century, particularly in the last 40 years, we have reduced death to a medical event, yet, the medical meanings do not exhaust the event (see Engelhardt 1996, pp. 189–238). Death is also a social, cultural, and often religious event and the medical realities of death must be interpreted within these different contexts. As such, death will be the locus of different meanings and interpretations. By keeping these different structures of interpretation in mind, we are better able to understand why controversies around death and dying persist. Just as the meaning of death will vary from culture to culture, so too will the criteria of death vary. Different moral communities have different criteria for death—e.g., pulmonary or cognitive function. This book describes a program of research in computable structure theory. The goal is to find definability conditions corresponding to bounds on complexity which persist under isomorphism. The results apply to familiar kinds of structures (groups, fields, vector spaces, linear orderings Boolean algebras, Abelian p-groups, models of arithmetic). There are many interesting results already, but there are also many natural questions still to be answered. Physical information is a property of nature. How does physical information persist over time? Does it do so as an object, process, or event, which are things considered in the current persistence theories? Physical information is none of these, however, this implies that persistence theories cannot explain the persistence of information. We therefore study the persistence of snowflakes, ephemeral natural structures, to better understand the persistence of natural things, such as physical information. The transitory nature (...) of snowflakes suggests that physical information persists as nature’s latent order, therefore, it is associated with natural structures, but it is not identical to them. This interpretation preserves the properties attributed to physical information, particularly its foundational character. The concept of physical information as latent order accords with Burgin’s General Theory of Information (GTI), which is currently the most comprehensive conceptualization of information that has been proposed. Whitehead’s cosmology centers on the self-creation of actual occasions that perish as they come to be, but somehow do combine to constitute societies that are persistent agents and/or patients. “Instance Ontology” developed by D.W. Mertz concerns unification of relata into facts of relatedness by specific intensions. These two conceptual systems are similar in that they both avoid the substance-property distinction: they differ in their understanding of how basic units combine to constitute complex unities. “Process Structural Realism” (PSR) draws from (...) both of these approaches in developing an account of how combinations of processes may produce ontologically significant coherences. When a group of processes achieves such closure that a set of states recurs continually, the effects of that coherence differ from what would occur in the absence of that closure. Such altered effectiveness is an attribute of the system as a whole, and would have consequences. This indicates that the network of processes, as a unit, has ontological significance. The closed network of processes, together with the conditions that prevail, constitute the form of definiteness of the coherence. That form continues to obtain as long as the coherence persists. Constituents contribute to, rather than share, that characteristic. Aspects of some recent research in systems biology, microeconomics, and social psychology illustrate the application of PSR. This article outlines the emergence of “genetic epistemology” in the seventeenth century, when the seemingly antithetical character of the conceptual pair was reworked into a productive epistemological theory, especially in Descartes, Hobbes, Spinoza, and Leibniz, who increasingly used diachronic (genetic) narratives to explain the (...) synchronic (structural) features in their theories. Against Cassirer, I argue that it was Descartes rather than Hobbes who first presented structural issues genetically. In Descartes’ natural philosophy, his frequent claims that showing how a thing is produced reveals its true nature foreshadow precisely what Hobbes and Isaac Barrow later describe as causal definitions of geometric figures, in which the process of ideal generation by motion is what constitutes the very essence of a figure. I link this method to the historicizing discourse on origins in the Enlightenment and conclude by suggesting that there is a trace of Platonic idealism in genetic epistemology. (shrink)

Teacher persistence has been a growing issue in recent decades. This raises the problem of the sustainability of the teaching workforce, the professionalism of working teachers and preserving the quality of education. In this study we aim to create and test an empirical model that makes it possible to predict teachers’ plans to remain in or leave the profession. Proceeding from earlier research, this study focuses on investigating the role of motivations, job demands, and school climate as potential factors (...) of teacher retention. A sample of 373 teachers responded to an electronic questionnaire compiled using questions from FIT-Choice, Norwegian Teacher Self-Efficacy Scale, and the Delaware School Climate Survey. Structural equation modelling was applied to find the model that predicts teachers’ plans to remain in or leave the profession. The findings revealed two main factors – the combination of perceived teaching ability and intrinsic motivation, and job security – that have a positive impact on plans to continue teaching. Perceived teaching ability and intrinsic motivation, in turn, is affected by relations with students and maintaining discipline in class. Emotional exhaustion and workload impacting the latter, predict the risk of attrition. Contrary to earlier research, age and years of teaching experience appeared to be unrelated to plans to continue teaching. (shrink)

Western Kansas is one of the most important agricultural regions in the world. Most agricultural production in this semi-arid region depends on the consumption of nonrenewable groundwater from the High Plains Aquifer, which will be 70 % depleted by 2070. The problem of depletion has drawn significant attention from local citizens and policymakers at the federal, state, and local levels for at least 40 years, resulting in a variety of policies and institutions to manage groundwater from the aquifer as a (...) common pool resource. Yet depletion has persisted. We explain this conundrum as an outcome of a mismatch between the scale of resource management, which has become more intensively local, and the scale of resource exchange, which has rendered the High Plains Aquifer a global common pool resource. We then explain the deeper, structural origins of the management–exchange scale mismatch. Drawing on concepts from structural human ecology theory and empirical evidence from Southwest Kansas, we show that agriculture is predicated on local metabolic rift in the hydrological cycle that is exacerbated through ecological unequal exchange with higher-income, core areas beyond the region. We conclude by highlighting two key policies that, if implemented together, may lessen the deleterious effects of these structural dynamics and thus promote a more sustainable relationship between society and environment in this region and other water-scarce regions that are net-exporters of groundwater. Although they are continually compositionally reconstituted and reconfigured, organisms nonetheless persist as ontologically unified beings over time – but in virtue of what? A common answer is: in virtue of their continued possession of the capacity for morphological invariance which persists through, and in spite of, their mereological alteration. While we acknowledge that organisms‟ capacity for the “stability of form” – homeostasis - is an important aspect of their diachronic unity, we argue that this capacity is derived from, and grounded (...) in a more primitive one – namely, the homeodynamic capacity for the “specified variation of form”. In introducing a novel type of causal power – a „structural power‟ – we claim that it is the persistence of their dynamic potential to produce a specified series of structurally adaptive morphologies which grounds organisms‟ privileged status as metaphysically “one over many” over time. It is certainly the case that morality governs the interactions that take place between individuals. But what if morality exists because of these interactions? This book, first published in 2007, argues for the claim that much of the behaviour we view as 'moral' exists because acting in that way benefits each of us to the greatest extent possible, given the socially structured nature of society. Drawing upon aspects of evolutionary game theory, the theory of bounded rationality, and computational models of (...) social networks, it shows both how moral behaviour can emerge in socially structured environments, and how it can persist even when it is not typically viewed as 'rational' from a traditional economic perspective. This book also provides a theory of how moral principles and the moral sentiments play an indispensable role in effective choice, acting as 'fast and frugal heuristics' in social decision contexts. Listening appears as elusive as it is crucial to democratic life, particularly in conditions of structural injustice. Dominant groups benefit from histories and habits of inattention and, when enlisted, common responses of denial, defensiveness, and resentment. What lies behind this pervasive and persistent failure to listen to claims of structural injustice by more advantaged groups, and what does this mean for democratic engagement? This paper addresses this question via three interventions: first, it develops a novel account of listening (...) that reveals why listening to claims of structural injustice often proves difficult. Second, it examines how inhabiting positions of relative advantage shapes whether and how people listen to such claims. Finally, it explores the implications these challenges have for the design of democratic processes that seek to engage advantaged groups regarding structural injustice. To develop this account, I draw together current scholarship regarding listening and structural injustice with original fieldwork of recent and current efforts to engage more advantaged communities regarding a specific form of structural injustice: specifically, interviews and observation of the ten organizations across Aotearoa New Zealand most active in efforts to engage communities regarding socio-economic inequality in the country. This book develops a philosophical structure for historical explanation that resolves disputes about the scientific status of history that have persisted since the nineteenth century. It does this by showing why historical explanations must take the form of a narrative and by making their logic explicit. The books formulates a unique positive account of the logic of narrative explanations. This logic reveals how the rational evaluation of narrative explanation becomes possible. The book also develops a nonrealist (irrealist) metaphysics and epistemology (...) of history--that is, it argues that there exists no one fixed past but many pasts. It includes a novel reading of Kuhn's The Structure of Scientific Revolutions, displaying how Kuhn offers a narrative explanation of theory change in science. The book situates narrative explanations within a naturalistic framework. Naturalism regards all canons of rational inquiry as evolving and contingent. The book also argues for the general philosophical significance of historical explanation. The first four chapters defuse methodological and the metaphysical objections to narrative explanations. The final three chapters explore how narrative explanations relate to other sciences. This paper offers an overview of the ways agents might extend over time and the characteristic structure of extended human agency. Agency can extend in two distinct but combinable modes: the ontological, which gives rise to simple continuous agents; and the conceptual, which gives rise to agents who conceive of and care about distal times, and have minimal planning abilities. Our extended form of agency combines both. But we are still limited by the temporal locality in the operation of our (...) psychological and executive powers. To account for this locality, I introduce the notion of 'temporal selves,' as the loci of immediacy in the agent's determination of their psychology, conduct, and practical standpoint. I argue that the passage of time generates, by itself, the threat of temporal alienation from distant temporal selves. A genuinely extended agency requires temporal identification: the sharing, by separate temporal selves, of a temporally extended and integrated practical standpoint. This temporal identification cannot be produced simply by temporal identity as continuity. What is required is temporal identity in the mode of unity and integration. This identity does not precede temporal identification but is co-constituted with it. I offer a preliminary account of the structure of the units of integration for agents who aspire to persist in the mode of unity and integration. I close with a cautionary note: the complex structure of integration, although familiar in everyday life, is often missed by standard philosophical accounts, which tend to focus on simple models of extended agency. Greenwood (2019) casts doubts upon whether a certain view about social groups (the view that social groups persist throughout changes in their membership, by virtue of the maintenance of their structure or function) is a fundamental metaphysical truth about social groups, rather than a theoretical truth about some or many social groups. In this note, I introduce a distinction between absolute and relative metaphysics, and argue that there are no 'fundamental metaphysical truths‘ (as Greenwood conceives of them) at all. The history of biology is mottled with disputes between two distinct approaches to the organic world: structuralism and functionalism. Their persistence across radical theory change makes them difficult to characterize: the characterization must be abstract enough to capture biologists with diverse theoretical commitments, yet not so abstract as to be vacuous. This Element develops a novel account of structuralism and functionalism in terms of explanatory strategies (Section 2). This reveals the possibility of integrating the two strategies; the explanatory successes (...) of evolutionary-developmental biology essentially depend on such integration (Section 3). Neither explanatory strategy is universally subordinate to the other, though subordination with respect to particular explanatory tasks is possible (Section 4). Beyond structuralism and functionalism, philosophical analysis that centers explanatory strategies can illuminate conflicts within evolutionary theory more generally (Section 5). (shrink)

Student evaluations of teaching (SET) are typically highly biased. In this paper, three experiments are reported, examining gender bias in SET by manipulating lecturer gender and counterstereotypes. Each experiment involved a vignette about a lecture, with a different context: Study 1 − noisy students disrupting the lesson; Study 2 − students asking for consideration; Study 3 − neutral context of a routine lecture. Structural equation modeling (SEM) revealed that the effect of lecturer gender on SET depended on the context (...) and was both directly (Study 1) and indirectly (Studies 2 and 3) mediated by gender stereotypes. The effect of student's gender was indirect and mediated by gender stereotypes in all studies. Counterstereotypical descriptions did not affect stereotypical perceptions in any of the experiments. The findings are discussed in terms of social dominance theory (SDT) and social role theory (SRT). They offer novel insights into the mechanism that explains gender and context bias in SET. In terms of practical implications, SET should be considered with caution, particularly when used for critical decisions such as tenure status. Finally, applying additional assessments and statistical methods to control for gender bias is important. (shrink)

Canadian children’s literature rarely depicts characters labelled with intellectual disabilities, yet when it does it often remains mired in stereotypes that recycle prevalent myths and misconceptions. Even as more recent literature attempts to push back against such stereotypes, it nevertheless predominantly remains caught in these dangerous representational repertoires. This article offers a brief history of Canadian literary depictions of intellectual disability and a critique of the Canadian publishing spheres. Through a critical analysis of Lorna Schultz Nicholson’s book Fragile Bones, we (...) discuss the limits of representation of intellectual disability in children’s fiction. We also offer a critique of the ableist publishing climate in Canada and suggest that structural barriers prevent disabled writers from entering the literary marketplace on an equal playing field. These barriers to publishing lead to the vast underrepresentation of disabled authors and the misrepresentation of disability in general and intellectual disability in particular in Canadian children’s literature. Recent work on social injustice has focused on implicit bias as an important factor in explaining persistent injustice in spite of achievements on civil rights. In this paper, I argue that because of its individualism, implicit bias explanation, taken alone, is inadequate to explain ongoing injustice; and, more importantly, it fails to call attention to what is morally at stake. An adequate account of how implicit bias functions must situate it within a broader theory of social structures and structural (...) injustice; changing structures is often a precondition for changing patterns of thought and action and is certainly required for durable change.
