Antimicrobial resistance (AMR) is an urgent threat to global public health and development. Mitigating this threat requires substantial short-term action on key AMR priorities. While international legal agreements are the strongest mechanism for ensuring collaboration among countries, negotiating new international agreements can be a slow process. In the second article in this special issue, we consider whether harnessing existing international legal agreements offers an opportunity to increase collective action on AMR goals in the short-term. We highlight ten AMR priorities (...) and several strategies for achieving these goals using existing “legal hooks” that draw on elements of international environmental, trade and health laws governing related matters that could be used as they exist or revised to include AMR. We also consider the institutional mandates of international authorities to highlight areas where additional steps could be taken on AMR without constitutional changes. Overall, we identify 37 possible mechanisms to strengthen AMR governance using the International Health Regulations, the Agreement on the Application of Sanitary and Phytosanitary Measures, the Agreement on Trade-Related Aspects of Intellectual Property Rights, the Agreement on Technical Barriers to Trade, the International Convention on the Harmonized Commodity Description and Coding System, and the Basel, Rotterdam, and Stockholm conventions. Although we identify many shorter-term opportunities for addressing AMR using existing legal hooks, none of these options are capable of comprehensively addressing all global governance challenges related to AMR, such that they should be pursued simultaneously with longer-term approaches including a dedicated international legal agreement on AMR. Many ideas grow better when transplanted into another mind than the one where they sprang up.

Recent studies :98–144, 2002; Weismann, J Bus Ethics 88:615–66, 2009) revealed that in the first 28 years of its existence, the Foreign Corrupt Practices Act was not enforced by the federal government. The Weismann study further concluded that the FCPA, designed by Congress as a self-regulatory model of corporate governance, failed to achieve the regulatory goal of deterring global bribery by U.S. companies. The current article addresses the reasons that the FCPA remains an ineffective measure to control bribery as (...) a global market entry strategy despite the highly publicized 2006 Department of Justice initiative to increase prosecutions and tighten enforcement efforts. The failure arises out of both the increased use of informal dispositions of case prosecutions,, which has made “getting caught” merely an increased “cost of doing business” and the failure to close the regulatory gaps in the statute that permit violators to slip through the enforcement net. The article updates and compiles the case prosecution data for every reported case prosecuted between 1977 and 2011. That data are then compared to the results of a 2010 integrity risk survey performed by Deloitte Financial Advisory Services and Forbes which reveal a widely held global business perception that compliance and integrity risks appear to be rising sharply and that the FCPA is ineffective in deterring bribery and corruption in foreign markets. The article aims to serve as a predictive tool for policy makers and business professionals in assessing risk in the global markets, particularly as commerce intensifies in the BRIC countries, notable for bribery and corruption. Adi Da argues that no solutions currently proposed are sufficient to righten the present unsustainable trajectory of life on Earth, because there is no integrated approach to the ordering of society and use of the planet. The presumption of separateness—manifesting collectively as separate “tribes” vying for control—characterizes human affairs, rather than the prior (“a priori”) unity of existence. The struggle for dominance is the “stave in the wheels” of the Earth-system's inherent capacity to self-correct. A new institution, “the Global (...) Cooperative Forum,” is proposed—invoked by “everybody-all-at-once” (a global populace awakened as a single force, capable of cooperatively effecting global change). (shrink)

Many are calling for transformative food systems changes to promote population and planetary health. Yet there is a lack of research that considers whether current food policy frameworks and regulatory approaches are suited to tackle whole of food systems challenges. One such challenge is responding to the rise of ultra-processed foods (UPF) in human diets, and the related harms to population and planetary health. This paper presents a narrative review and synthesis of academic articles and international reports to critically examine (...) whether current food policy frameworks and regulatory approaches are sufficiently equipped to drive the transformative food systems changes needed to halt the rise of UPFs, reduce consumption and minimise harm. We draw on systems science approaches to conceptualise the UPF problem as an emergent property of complex adaptive food systems shaped by capitalist values and logics. Our findings reveal that current food policy frameworks often adjust or reform isolated aspects of food systems (e.g., prices, labels, food composition), but under-emphasise the deeper paradigms, goals and structures that underlie the rise of UPFs as a systems phenomenon, and its socio-ecological implications. We propose that a ‘leverage points’ framework illuminates where to intervene in food systems to generate multi-level changes, while the theory of ecological regulation highlights how to respond to complex multi-factorial problems, like the rise of UPFs, in diverse ways that respect planetary boundaries. More research is needed to better understand the transformative potential of ecological regulation to advance food systems transformation and attenuate whole of food systems challenges. (shrink)

Cosmopolitan political theorists hold that our obligations to distribute resources to others do not halt at state borders, but most do not advocate a restructuring of the global system to achieve their distributive aims. This article argues that promoting democratically accountable economic and political integration between states would be the most effective way to enable cosmopolitan, or routine, tax-financed, trans-state distributions. Movement toward a more integrated global system should encourage the view that larger sets of persons have interests (...) in common that should be protected and promoted in common. Democratically accountable integration also should enable those within less-affluent states to more vigorously press trans-state distributive claims. The still-evolving E.U. is examined as a partial model for the integrated alternative in other geographic regions, as well as, in the much longer term, for some form of democratic global government capable of ensuring that any person born anywhere would have access to adequate resources and life opportunities. The United Kingdom is the first and so far only country to pass explicit legislation allowing for the licensed use of the new reproductive technology known as mitochondrial replacement therapy. The techniques used in this technology may prevent the transmission of mitochondrial DNA diseases, but they are controversial because they involve the manipulation of oocytes or embryos and the transfer of genetic material. Some commentators have even suggested that MRT constitutes germline genome modification. All eyes were on the United Kingdom (...) as the most likely location for the first MRT birth, so it was a shock when, on September 27, 2016, an announcement went out that the first baby to result from use of the intervention had already been born. In New York City, United States-based scientist John Zhang used maternal spindle transfer to generate five embryos for a woman carrying oocytes with deleterious mutations of the mitochondrial DNA. Zhang then shipped the only euploid embryo to Mexico, where it was transferred to the mother's uterus. Zhang's team's travel across international borders to carry out experimental procedures represents a form of scientific tourism that has not been properly ethically explored; it can, however, have seriously detrimental effects for developing countries. More and more human beings find themselves not sharing in the collective identity of their host countries, while enjoying certain rights and benefits as guest workers or permanent residents. The entitlement to social rights, which T. H. Marshall had considered the pinnacle of citizenship, has been dissociated from shared collective identity and political membership. This chapter begins by considering the disaggregation of citizenship; then, building on the promise of “jurisgenerative politics,” it develops the concept of “democratic iterations” as offering normative (...) and institutional solutions to the paradoxes of democratic legitimacy. Examining several cases from contemporary European debates concerning the rights of foreigners and immigrants, the chapter then illustrates processes of democratic iteration at work. Democratic iterations are complex ways of mediating the will- and opinion-formation of democratic majorities and cosmopolitan norms. In conclusion, the chapter discusses the ontological puzzles of cosmopolitan norms. (shrink)

Fundamental aspects of human use of the environment can be explained by game theory. Game theory explains aggregate behaviour of the human species driven by perceived costs and benefits. In the 'game' of global environmental protection and conservation, the stakes are the living conditions of all species including the human race, and the playing field is our planet. The question is can we control humanity's hitherto endless appetite for resources before we irreparably harm the global ecosystem and cause (...) extinction of even more species? The central problem is that some proportion of the individuals or groups will behave selfishly. The inducement for using more than a fair share, or 'cheating', increases as that resource becomes rarer, thus the benefits of cheating increase. In addition, the total number of people is increasing, so the proportion of cheaters must decrease to even keep total resource use constant. Cost benefit analysis of the effect of regulation and incentives on potential cheaters may provide a rational approach to controlling environmental problems. While it is debatable that environmental values are constant across cultures, communal use of resources seems to follow global rules. Cooperative use and punishment of those who use more than their share appear to be ubiquitous in human societies. Schemes for controlling human impact on the global environment must take into consideration basic behaviours including development of social norms and the positive feedback created because resources become more valuable with increasing rarity leading to more incentive for consumption. In this paper I outline a critical justification of the practice of political whistleblowing as exemplified by the case of Edward Snowden. At first, I argue that the question of justifiability cannot be settled with regard to absolutely binding principles such as special loyalties or the categorical duty to inform fellow citizens. What is required instead is the careful weighing of all relevant consequential and deontic reasons. However, this weighing process has to be publically justified. I will therefore turn to (...) the theory of civil disobedience which provides us with two roots of public justification: widely accepted constitutional values and the primacy of public deliberation. In this view, political whistleblowing is to be seen as a special case of civil disobedience and can be justified along the lines of both liberal and republican approaches. However, in the end of the paper I will indicate that we have to transcend the state-based model of civil disobedience. Snowden’s acts of whistleblowing have a further cosmopolitan intention and need to be justified in terms of avant-garde principles of global justice. (shrink)

As human beings do we at all have a common ground for dialogue and mutual understanding? Yes: what we as human beings have in common, is that we can use and understand arguments. In other words: that we are rational beings. 2. Is our capability for argumentation the only ground we have in common as the basis for dialogue and mutual understanding? There is no argumentation against argumentation. Argumentation can´t be transcended. Thus argumentation, more precisely: the capability of argumentation – (...) i.e. reason - is the only ground we have in common as human beings. 3. Does religion play a role in this respect? Isn´t religion superfluous for a rational human being? No, not in the sense Kant has ascribed to it. To know about the boundaries of knowledge (of reason) and to humbly marvel about the miraculous existence of world, life and reason can rightly be seen as the form of religion - as the form of attitude towards the "beyond" - which is adequate (and unavoidable) for a rational being. Religion is the source of truth and ethics if it means: humble acknowledgment of the un-knowable and hence of the fact that in our search for orientation we are relegated to ourselves as fellow human beings, as brothers and sisters. The state of development of modern society can be described as a systemic social crisis. The state of crisis as an integral element of social development becomes familiar to the philosophy and ideology of postmodernism, which allows not only a plurality of views, but also a variety of solutions. In any destructive phenomenon caused by the crisis, the crisis itself can become a necessary moment of the dialectical transition to a new, orderly state of the system, a necessary factor and (...) catalyst for modernization processes. Crisis-free state of development of society - a state that hinders its development. However, while recognizing the important role of crises in development, societies should still have mechanisms in place to protect people from their negative impacts, which should reduce their risks of transition and, by anticipating development trends, possibly reduce the transition process itself. Analyzing the tendency of modern society to sustainable development, it is necessary to clarify that the solution of such a problem should actually be carried out by various actors, civil society associations, research institutions, etc. However, the main part of this task depends on the political power, the main functions of which include ensuring stable development and security in society, as well as the management of society as a whole and its economic, spiritual, political and social spheres in particular. At the same time, political power must not just resolve conflicts and ensure order in society, but, most importantly, find a balance between the common good and the changing aspirations of different social groups to pursue their interests. Thus, the task of overcoming the current crisis depends primarily on the responsibility of political power, especially the state. It is the state that must accumulate all resources and coordinate the actions of business, science, religion, etc. for its effective solution. (shrink)

The types of errors that emerge in the development and maintenance of software are essentially different from the types of errors that emerge in the development and maintenance of engineered hardware products. There is a set of standard responses to actual and potential hardware errors, including: engineering ethics codes, engineering practices, corporate policies and laws. The essential characteristics of software errors require new ethical, policy, and legal approaches to the development of software in the global arena.

The global signal, which was once regarded as a nuisance of functional magnetic resonance imaging, has been proven to convey valuable neural information. This raised the following question: what is a GS represented in local brain regions? In order to answer this question, the GS topography was developed to measure the correlation between global and local signals. It was observed that the GS topography has an intrinsic structure characterized by higher GS correlation in sensory cortices and lower GS (...) correlation in higher-order cortices. The GS topography could be modulated by individual factors, attention-demanding tasks, and conscious states. Furthermore, abnormal GS topography has been uncovered in patients with schizophrenia, major depressive disorder, bipolar disorder, and epilepsy. These findings provide a novel insight into understanding how the GS and local brain signals coactivate to organize information in the human brain under various brain states. Future directions were further discussed, including the local-global confusion embedded in the GS correlation, the integration of spatial information conveyed by the GS, and temporal information recruited by the connection analysis. Overall, a unified psychopathological framework is needed for understanding the GS topography. (shrink)

Peter Carruthers argues that the global workspace theory implies there are no facts of the matter about animal consciousness. The argument is easily extended to other cognitive theories of consciousness, posing a general problem for consciousness studies. But the argument proves too much, for it also implies that there are no facts of the matter about human consciousness. A key assumption of the argument is that scientific theories of consciousness must explain away the explanatory gap. I criticize this assumption (...) and point to an alternative strategy for defending scientific theories of consciousness, one that better reflects the ongoing scientific practice. I argue there are introspectable inferential connections from phenomenal concepts to functional concepts that scientists can use to individuate the global workspace in terms of capacities that animals and humans share.
