Our concerns fall into three areas: (1) Barsalou fails to make clear what simulators are (vs. what they do); (2) activation of perceptual areas of the brain during thought does not distinguish between the activation's being constitutive of concepts or a mere causal consequence (Barsalou needs the former); and (3) Barsalou's attempt to explain how modal symbols handle abstraction fails.

No attempt is made to justify any particular possession or denial of rights. It is, however, a theory about rights in general, and not just about either legal or moral rights. This reflects the writer's belief that conceptual problems about the nature of rights can be satisfactorily tackled only if a unified approach (...) is adopted. In each of the first three chapters a leading theory of rights is examined, criticised and rejected. These theories are benefit theories, choice theories, theories of overriding. Particular attention is given to the writings of John Austin, HLA Hart and RM Dworkin. In the fourth chapter Hohfeld's claim for the diversity of rights is examined and rejected as unproven. In the fifth chapter an attempt is made to provide a more satisfactory theory of moral rights. This draws a distinction between rights as assessments of that which the right-holder may do and as assessments of that which others must do for the right-holder. Rights of the first type are explained in terms of a strong sense of permission; those of the second type as an instance of welfare principles. In the succeeding chapter this explanation is extended to legal rights. Finally, an attempt is made to provide a theory of the nature of property rights in general, and of ownership in particular. What are legal fictions? Professor Lon Fuller discussed the matter at some length. One interpretation of his answer is this: they are lies that are not intended to deceive. This solution fails, in the end, to be convincing. But some remarks of Fuller provide the clue to another way of looking at the problem: fictions are means of changing the application of the law by relying on a tension between two classifications of fact.

With the many changes occurring in today's healthcare organizations, patients are increasingly equipped with a vast quantity of health care data and being more included in the healthcare decision-making process. The new approach we propose incorporates a new patient-organization framework that examines relevant historical, legal and ethical elements within the doctrine of informed consent in addition to examining the role of new healthcare organizations' obligations to include data to support addressing issues such as population health, health outcomes and health disparities (...) within the informed consent. There is a growing consensus among healthcare professionals that using an evidencebased organizational informed consent framework to improve the informed consent process can lead to better comprehension, health outcomes, transparency and improved patient trust and retention overall. In this paper we analyze results from 114 face-to-face qualitative interviews of people who had evacuated from the New Orleans area in the wake of Hurricane Katrina, interviews that were completed within weeks of the 2005 storm in most cases. Our goal was to understand the role information and knowledge played in people's decisions to leave the area. Contrary to the conventional wisdom underlying many disaster communication studies, we found that our interviewees almost always had extensive storm-related information from a (...) variety of sources, including media reports and (in many cases) other background knowledge gleaned from experiences with previous storms, often from interpersonal sources. However, consistent with a theme in communication research that has been identifiable since at least the 1940s, interpersonal communication networks were most often what ultimately caused these individuals to act on this information, and therefore those with “weak ties” (a concept borrowed from sociology) to the broader “mainstream” community may have been disadvantaged, slower to leave, and thus more vulnerable to the storm's main effects. From our evidence, the end result was less a function of discrimination as it was one of differential activation of a relevant social network. These results argue for the rejection of a “deficit model” that assumes varied reactions to natural disaster result from some kind of an information deficiency, and remind us that behavior under such circumstances is the result of a process of collective behavior, not only individual cognition. Overall, the leading Western states responded to genocide in the 1990s with too little, too late. Their political leaders chose a shortsighted strategy of denial, obfuscation, and deception rather than live, up to their solemn obligation to stop genocide. Humanity suffered greatly as a consequence. However, if genocide scholars can join and give direction to the ongoing debate within the national security community about how to prevent future Rwandas and Srebrenicas, then there is some hope that this new century may (...) be less barbarous than the one we just left. We wish to describe and acknowledge the exceptional contributions to medical ethics, both in the UK and internationally, made by Edward Shotter1 who died at home on 3 July 2019. He was founder of the London Medical Group2 3 and instigator of similar student-led medical ethics groups throughout the UK; founder of the Institute of Medical Ethics4 and founder of the Journal of Medical Ethics. Ted Shotter transformed the study of medical ethics in the UK in the interests of patients (...) and professionals alike. In 1963, he established the pioneering ‘Medical Group’ model, an innovative bottom-up method whereby students in the health professions could gain a grounding in ethics that had previously been denied to the profession.5 It was with these Medical Groups that many of the leading figures in contemporary UK medical ethics and law began their careers in the subject including Sir Kenneth Calman, Sir Ian Kennedy, Professor Margaret Brazier OBE, Professor John Harris and Professor Sir Jonathan Montgomery to name but …. SummaryThe Gainj of highland Papua New Guinea do not use contraception but have a total fertility rate of only 4·3 live births per woman, one of the lowest ever recorded in a natural fertility setting. From an analysis of cross-sectional demographic and endocrinological data, the causes of low reproductive output have been identified in women of this population as: late menarche and marriage, a long interval between marriage and first birth, a high probability of widowhood at later reproductive ages, low (...) effective fecundability and prolonged lactational amenorrhoea. These are combined with near-universal marriage, a low prevalence of primary sterility and a pattern of onset of secondary sterility similar to that found in other populations. Of all the factors limiting fertility, by far the most important are those involved in birth spacing, especially lactational amenorrhoea. (shrink)

SummaryThe effects of infant suckling patterns on the post-partum resumption of ovulation and on birth-spacing are investigated among the Gainj of highland New Guinea. Based on hormonal evidence, the median duration of lactational anovulation is 20·4 months, accounting for about 75% of the median interval between live birth and next successful conception. Throughout lactation, suckling episodes are short and frequent, the interval changing slowly over time, from 24 minutes in newborns to 80 minutes in 3-year olds. Maternal serum prolactin concentrations (...) decline in parallel with the changes in suckling patterns, approaching the level observed in non-nursing women by about 24 months post-partum. A path analysis indicates that the interval between suckling episodes is the principal determinant of maternal prolactin concentration, with time since parturition affecting prolactin secretion only in so far as it affects suckling frequency. The extremely prolonged contraceptive effect of breast-feeding in this population thus appears to be due to a slow decline in suckling frequency with time since parturition and absence of a decline over time in hypothalamic–pituitary responsiveness to the suckling stimulus. This multidisciplinary collection explores three key concepts underpinning psychiatry -- explanation, phenomenology, and nosology -- and their continuing relevance in an age of neuroimaging and genetic analysis. While both accepted the forward movement of cognition in art and aesthetics, my concern is that some cognitively minded individuals neglect the part played by imaginative intuition in the creative process. Much recent art is lacking in both imagination and beauty. Although it may be rich in concept, according to Kant creative intuition is also necessary. Postmodernists' focused emphasis on the oblique, fleeting, transient, and ephemeral—short-lived, fugitive fashions or superficial trends in art and aesthetics—confuses the fleeting and moving present, rushing us forward into the future when we might do better to look back historically and constructively at the more enduring influence of Kant and Kandinsky. Of course, it might in one sense be in the "apparently unremarkable and evanescent that our lives sometimes find their greatest meaning,"2 but this does not imply that we cannot also learn from the past.Imaginative Representation in Kant and KandinskyIn his painting of 1926, Several Circles, Kandinsky depicts a group of overlapping, partially transparent discs that appear to drift freely against a black background. Will Grohmann has described this abstract scenario as a "cosmic metaphor" that points symbolically to a "limited infinite."3 Clearly, Kandinsky is concerned here with some transcendent meaning. Jung has remarked on the poetic association of the avian contour at the lower left of the painting—perhaps this is a metaphor for flight or spiritual freedom.4 The picture, he says, seems to represent a state of universalized equilibrium and harmony. This picture constitutes, to my mind, the expression, in a Kantian sense, of aesthetic ideas,5 mediating as it does between concepts and intuitions [End Page 105] and concerned as it is with the expression of artistic ideas in an imaginative, aesthetically harmonious form. On this topic Kandinsky has said: "If your imagination is not powerful enough to develop visions which are truly your own, and which, reduced to the state of ideas, can be translated into images, then go back to the study of nature"6Nature, we are told, Kant elevated above fine art in the sense that the beauty of nature's handiwork is the sole basis of the immediate interest that is taken in it7—it is untainted by desire or any concept of perfection or use (the merely agreeable), it is pleasurably imbued with "purposiveness without purpose" in the teleological implication of the "kingdom of ends." The dynamical and morally sublime, however, implied genius. Had Kant been living in our modern age, though he still might not have been a great art lover as such, he would surely not have dismissed Kandinsky's abstract compositions—as El Lissitzky did—as being mere wallpaper patterning, decorative arabesques, and the like; Kant would surely have recognized the symbolic power of these images as art!The Gestalt TheoryAccording to Immanuel Kant (1724-1804), aesthetic ideas are representations of the imagination. Following Rudolf Arnheim, a "representation" may be understood as either a man-made image or external figuration or, in another sense, as a "mental image."8 These ideas suggest that representation, through art, involves both the internal and the external. Representation in science is the means by which we generate images of the object "out there"—the basis of an objectivist epistemology. A scientific "representation" of the Giant's Causeway, supposedly built by Finn MacCool, might involve a computer simulation of columnar polygonal fractures in topographical detail. Kant, however, was concerned with representations of ideas, specifically aesthetic ideas as distinct from rational ideas. These were based on the animating principle of the soul, or Geist. It is widely agreed among broadly Anselmian theists that God is in some sense the 'delimiter of possibilities.' In other words, the scope of possibility is explained by the manner in which the universe emanates from God. However, existing accounts of God's role here—in terms of freedom, choice, or power—face serious difficulties. The present paper provides a new account of God's role as the delimiter of possibilities in terms of the different manner in which the non-actuality of non-actual states of (...) affairs is explained. Intuitively and metaphorically, we can think of the menu of states of affairs being 'whittled down' in successive stages of a process of divine decision-making, with the different species of impossibility corresponding to when and how the states of affairs are ruled out. I argue that this approach provides genuine contingency while also preserving the Principle of Sufficient Reason. (shrink)

Ethical descriptivism is the view that all ethical properties are descriptive properties. Frank Jackson has proposed an argument for this view which begins with the premise that the ethical supervenes on the descriptive, any worlds that differ ethically must differ also descriptively. This paper observes that Jackson's argument has a curious structure, taking a linguistic detour between metaphysical starting and ending points, and raises some worries stemming from this. It then proposes an improved version of the argument, which avoids these (...) worries, and responds to some potential objections to this version of the argument. (shrink)

In Better Never to Have Been, David Benatar argues that existence is always a harm. His argument, in brief, is that this follows from a theory of personal good which we ought to accept because it best explains several ‘asymmetries’. I shall argue here that Benatar's theory suffers from a defect which was already widely known to afflict similar theories, and that the main asymmetry he discusses is better explained in a way which allows that existence is often not a (...) harm. This article reviews 1 decade of research on cheating in academic institutions. This research demonstrates that cheating is prevalent and that some forms of cheating have increased dramatically in the last 30 years. This research also suggests that although both individual and contextual factors influence cheating, contextual factors, such as students' perceptions of peers' behavior, are the most powerful influence. In addition, an institution's academic integrity programs and policies, such as honor codes, can have a significant influence on students' behavior. (...) Finally, we offer suggestions for managing cheating from students' and faculty members' perspectives. (shrink)

Despite tendencies to compete for a prime place in moral theory, neither virtue ethics nor the four principles approach should claim to be superior to, or logically prior to, the other. Together they provide a more adequate account of the moral life than either can offer on its own. The virtues of principlism are clarity, simplicity and (to some extent) universality. These are well illustrated by Ranaan Gillon’s masterly analysis of the cases he has provided. But the vices of this (...) approach are the converse of its virtues: neglect of emotional and personal factors, oversimplification of the issues, and excessive claims to universality. Virtue ethics offers a complementary approach, providing insights into moral character, offering a blend of reason and emotion, and paying attention to the context of decisions. The cases provided can be more adequately understood if we combine the approaches. Both should foster the virtues of humility and magnanimity. (shrink)

The ‘No Ought From Is’ principle (or ‘NOFI’) states that a valid argument cannot have both an ethical conclusion and non-ethical premises. Arthur Prior proposed several well-known counterexamples, including the following: Tea-drinking is common in England; therefore, either tea-drinking is common in England or all New Zealanders ought to be shot. My aim in this paper is to defend NOFI against Prior’s counterexamples. I propose two novel interpretations of NOFI and prove that both are true.

The philosopher John J. McDermott comes out of the long American tradition that takes the aim of philosophical inquiry to be interpretation of the open meanings of experience, so that we might all live fuller and richer lives. Here, the authors of these nine essays explore his highly original interpretations of philosophy's various questions about our shared existence. How are we to understand the nature of American culture and to carry forward its important contributions? What is the personal importance of (...) embodiment, of living in the realization of death? How does our physical and personal environment nourish bodies and spirits? What does the deliberate pursuit of a morality offer us? How can we carry forward the fundamental tasks of education to enable those who follow us to use our shared past to address their civic and spiritual problems? What are the possibilities for community? Together, these essays offer a clear, multi-layered understanding of the compelling vision that McDermott has presented over the years. In an Afterword, McDermott responds to the authors' queries and concerns, offering a restatement of his understanding of the American philosopher's task. These essays indicate, and McDermott's response confirms, that for him philosophy is not a purely cerebral activity. Philosophy is, rather, an intellectual means of exploring the fullness of human experience, and it functions best when it operates in the context of the broad sweep of the humanities. Similarly, for McDermott the self is no given substantial entity. On the contrary, it is relational, rooted geographically and socially in its place and its fellows, and damaged when these life-giving processes fail. Further, McDermott does not accept any ultimate canopy of meaning. The human journey is a personal project within which provisional meanings must be created to sustain our advance. (shrink)

Moss (2018) argues that rational agents are best thought of not as having degrees of belief in various propositions but as having beliefs in probabilistic contents, or probabilistic beliefs. Probabilistic contents are sets of probability functions. Probabilistic belief states, in turn, are modeled by sets of probabilistic contents, or sets of sets of probability functions. We argue that this Mossean framework is of considerable interest quite independently of its role in Moss’ account of probabilistic knowledge or her semantics for epistemic (...) modals and probability operators. It is an extremely general model of uncertainty. Indeed, it is at least as general and expressively powerful as every other current imprecise probability framework, including lower probabilities, lower previsions, sets of probabilities, sets of desirable gambles, and choice functions. In addition, we partially answer an important question that Moss leaves open, viz., why should rational agents have consistent probabilistic beliefs? We show that an important subclass of Mossean believers avoid Dutch bookability iff they have consistent probabilistic beliefs. (shrink)

Jürgen Habermas is one of the most important German philosophers and social theorists of the late twentieth and early twenty-first century. His work has been compared in scope with Max Weber’s, and in philosophical breadth to that of Kant and Hegel. In this much-needed introduction Kenneth Baynes engages with the full range of Habermas’s philosophical work, addressing his early arguments concerning the emergence of the public sphere and his initial attempt to reconstruct a critical theory of society in _Knowledge (...) and Human Interests_. He then examines one of Habermas’s most influential works, _The Theory of Communicative Action, _including his controversial account of the rational interpretation of social action. Also covered is Habermas’s work on discourse ethics, political and legal theory, including his views on the relation between democracy and constitutionalism, and his arguments concerning human rights and cosmopolitanism. The final chapter assesses Habermas’s role as a polemical and prominent public intellectual and his criticism of postmodernism in _The Philosophical Discourse of Modernity_, in addition to his more recent writings on the relationship between religion and democracy. Habermas is an invaluable guide to this key figure in contemporary philosophy, and suitable for anyone coming to his work for the first time. (shrink)
