Zusammenfassung Die rasanten Entwicklungen im Bereich der Künstlichen Intelligenz und Robotik stellen nicht nur die Ethik, sondern auch das Recht vor neue Herausforderungen, gerade im Bereich der Medizin und Pflege. Grundsätzlich hat der Einsatz von KI dabei das Potenzial, sowohl die Heilbehandlungen als auch den adäquaten Umgang im Rahmen der Pflege zu erleichtern, wenn nicht sogar zu verbessern. Verwaltungsaufgaben, die Überwachung von Vitalfunktionen und deren Parameter sowie die Untersuchung von Gewebeproben etwa könnten autonom ablaufen. In Diagnostik und Therapie können Systeme (...) die behandelnde Ärztin unterstützen. Intelligente Betten ermöglichen eine Frühmobilisierung der Patient:innen bei gleichzeitig geringerem Personalaufwand. Gleichwohl birgt der Einsatz der Systeme rechtliche Herausforderungen. So besteht das Risiko einer Verletzung der beteiligten Personen. Im Gegensatz zu herkömmlichen Technologien „leidet“ KI unter der „Black-Box-Problematik“: Die von den Systemen generierten Ergebnisse sind nicht mehr vollständig vorhersehbar und nachvollziehbar. Der Einsatz birgt unbekannte und unkalkulierbare Risiken, was sich insbesondere auf die zivilrechtliche Haftung und strafrechtliche Verantwortung auswirkt. Wem die Entscheidungen der Systeme normativ zuzurechnen sind, ist eine Kernfrage des juristischen Diskurses. Die aus praktikabilitätsgründen naheliegende Wahl, dem letztentscheidenden Menschen das Verhalten eines KI-Systems zuzurechnen, überzeugt nicht in allen Fällen, sondern degradiert ihn häufig zum symbolischen Haftungsknecht und legt ihm einseitig die Risiken der Technologien auf. Weiterhin ergeben sich im Bereich der Medizin und Pflege Fragen hinsichtlich der Zulassung von KI-Systemen, da die Maschinen während der Nutzung weiterlernen und so ihren strukturellen Aufbau kontinuierlich verändern. Es ist daher angebracht, sich frühzeitig mit dem Konfliktpotential aus ethischer und rechtlicher Sicht auseinander zu setzen, um einer potenziellen gesellschaftlichen Angst vor derartigen Systemen vorzubeugen und einen praxisgerechten Handlungsrahmen zu schaffen. Making good decisions in extremely complex and difficult processes and situations has always been both a key task as well as a challenge in the clinic and has led to a large amount of clinical, legal and ethical routines, protocols and reflections in order to guarantee fair, participatory and up-to-date pathways for clinical decision-making. Nevertheless, the complexity of processes and physical phenomena, time as well as economic constraints and not least further endeavours as well as achievements in medicine and healthcare (...) continuously raise the need to evaluate and to improve clinical decision-making. This article scrutinises if and how clinical decision-making processes are challenged by the rise of so-called artificial intelligence-driven decision support systems (AI-DSS). In a first step, this article analyses how the rise of AI-DSS will affect and transform the modes of interaction between different agents in the clinic. In a second step, we point out how these changing modes of interaction also imply shifts in the conditions of trustworthiness, epistemic challenges regarding transparency, the underlying normative concepts of agency and its embedding into concrete contexts of deployment and, finally, the consequences for (possible) ascriptions of responsibility. Third, we draw first conclusions for further steps regarding a ‘meaningful human control’ of clinical AI-DSS. (shrink)

Critical reasoning (CR) when confronted with contradictory information from multiple sources is a crucial ability in a knowledge-based society and digital world. Using information without critically reflecting on the content and its quality may lead to the acceptance of information based on unwarranted claims. Previous personal beliefs are assumed to play a decisive role when it comes to critically differentiating between assertions and claims and warranted knowledge and facts. The role of generic epistemic beliefs on critical stance and attitude in (...) reflectively dealing with information is well researched. Relatively few studies have been conducted on the influence of domain-specific beliefs, i.e. beliefs in relation to specific content encountered in a piece of information or task, on the reasoning process, and on how these beliefs may affect the information-processing and decision-making processes. This study focuses on students’ task- and topic-related beliefs that may influence their reasoning when dealing with multiple and partly contradictory sources of information. To validly assess CR among university students, we used a newly developed computer-based performance assessment in which the students were confronted with an authentic task which contains theoretically defined psychological stimuli for measuring CR. To investigate the particular role of task- and topic-related beliefs on CR, a purposeful sample of 30 university students took part in a performance assessment and then were interviewed immediately afterwards. In the semi-structured cognitive interviews, the participants’ task-related beliefs were assessed. Based on qualitative analyses of the interview transcripts, three distinct profiles of decision-making among students have been identified. More specifically, the different types of students’ beliefs and attitudes derived from the cognitive interview data suggest their influence on information processing, reasoning approaches and decision-making. The results indicated that the students’ beliefs had an influence on their selection, critical evaluation and use of information as well as on their reasoning processes and final decisions. (shrink)

Increasing prevalence of depression poses a huge challenge to the healthcare systems, and the success rates of current standard therapies are limited. While 30% of treated patients do not experience a full remission after treatment, more than 75% of patients suffer from recurrent depressive episodes. Eye Movement Desensitization and Reprocessing therapy represents an emerging treatment option of depression, and preliminary studies show promising effects with a probably higher remission rate when compared to control-therapies such as cognitive behavioral therapy. In the (...) present study, 49 patients with severe depression were treated with an integrated systemic treatment approach including EMDR therapy that followed a specific protocol with a treatment algorithm for depression in a naturalistic hospital setting. Following their discharge from the hospital, the patients were followed up by a structured telephone interview after 3 and 12 months. 27 of the 49 patients fulfilled the Beck’s depression criteria of a full remission when they were discharged. At the follow-up interview, 12 months after discharge, 7 of the 27 patients reported a relapse, while the remaining 20 patients had stayed relapse-free. The findings of our observational study confirm reports of earlier studies in patients with depression, showing that EMDR therapy leads to a high rate of remission, and is associated with a decreased number of relapses. Patients with depression receiving EMDR treatment may be more resilient to stressors. (shrink)

Artikelns utgångspunkt är att dagens biomedicinska samhälle ger upphov till frågor om teknikens möjligheter och risker. Avstamp tas i Ulrich Becks diskussion om att dessa motpoler föder en reflexiv modernitet. Ambitionen är att undersöka hur detta reflexiva tillstånd försiggår på ett individuellt plan, närmare bestämt inom en yrkesgrupp som bedriver omdebatterad biomedicinsk forskning. Den empiriska ingången är diskussioner om etik som författaren har haft med forskare från Lund Stem Cell Center. Forskarnas funderingar präglas av komplexitet och motsägelsefullhet. Å ena sidan (...) förekommer ifrågasättande av den egna forskningen, å andra sidan en pragmatisk inställning som innebär att den laboratoriestyrda verksamheten blir riktgivande. Artikeln visar hur reflexioner om etik får ringa betydelse för hur biomedicinsk kunskap produceras – snarare blir de redskap för forskarna att göra yrkesverksamheten kulturellt hanterlig. What is meant by the idea of being democratic seems, however, to be anything but clear. Is it only a question of representing the people through elections, ballots, and political parties, or does it include institutional culture, the division of powers, and the legal regime within a community? A "philosophy of the republic," as developed in this volume's (...) contributions, shows that the current "dominance of the democratic" falls short of accounting for the independent significance to the republican self-organisation of state and society. Induced by intake of the psychedelic substances LSD, psilocybin, DMT and mescaline, psychedelic experiences have been extensively described by subjects as entailing a most unusual increase in the scope and quality of their consciousness. Accordingly, psychedelic experiences have been widely characterised as an “expansion of consciousness.” This article poses the following question, as yet unaddressed in contemporary philosophy and the tradition of phenomenology: to what exactly does “expansion of consciousness” refer as a general characterisation of psychedelic experiences, and what role (...) might attention play therein? On the basis of Aron Gurwitsch’s phenomenology of attention, the following thesis is presented: (a) “expansion of consciousness” refers to a particular restructuration of consciousness in psychedelic experiences. (b) This occurs by means of certain extreme transformations in direction, scope, mode and degree of attention. In order to explicate this thesis, the characteristic features of psychedelic experiences that pertain to expansion of consciousness and attention are first systematically identified from a survey of subject reports. Second, it is demonstrated that the few previous attempts to understand expansion of consciousness in terms of attention as a filter/reducing-valve, spotlight or zoom-lens each fail to explain how consciousness is structured in psychedelic experiences. Third, it is argued that psychedelic expansion of consciousness is a general restructuration of consciousness by means of extreme attentional transformations. In conclusion, brief consideration is given to the question of whether psychedelic expansion of consciousness can have epistemic and ethical value for life. (shrink)

Agents sometimes act for normative reasons—for reasons that objectively favor their actions. Jill, for instance, calls a doctor for the normative reason that Kate is injured. In this article I explore a dispositional approach to acting for a normative reason. I argue for the need of epistemic, motivational, and executional dispositional elements of a theory of acting for a normative reason. Dispositions play a mediating role between, on the one hand, the normative reason and its normative force, and the action (...) on the other hand. Thereby, they help to deal with problem cases such as cases of deviant causal chains and improper instrumental motivation. (shrink)

John Morrison has argued that confidences are assigned in perceptual experience. For example, when you perceive a figure in the distance, your experience might assign a 55-percent confidence to the figure’s being Isaac. Morrison’s argument leans on the phenomenon of ‘completely trusting your experience’. I argue that Morrison presupposes a problematic ‘importation model’ of this familiar phenomenon, and propose a very different way of thinking about it. While the article’s official topic is whether confidences are assigned in perceptual experience, it (...) is also about two more general issues: how we can determine which properties are assigned in perceptual experience; and how we transition from perception to belief. We notice a number of interesting overlaps between the views on personhood of Ifeanyi Menkiti and Marya Schechtman. Both philosophers distance their views from the individualistic ones standard in western thought and foreground the importance of extrinsic or relational features to personhood. For Menkiti, it is ‘the community which defines the person as person’; for Schechtman, being a person is to have a place in person-space, which involves being seen as a person by others. But there are also striking differences. (...) Schechtman sees this aspect as expanding the scope of personhood to infants and those who are severely mentally disabled. Menkiti thinks that there is a line to be drawn at some point between those humans that are persons and those who are not. We consider the cases offered in questioning how the dispute between the two views should be resolved. (shrink)

Few writers' unfinished works are considered among their most important, but such is the case with Merleau-Ponty's _The Visible and the Invisible_. What exists of it is a mere beginning, yet it bridged modernism and postmodernism in philosophy. Low uses material from some of Merleau-Ponty's later works as the basis for completion. Working from this material and the philosopher's own outline, Low presents how this important work would have looked had Merleau-Ponty lived to complete it.

As one tries to grasp love and its images within José Leonilson's production, a multiplicity of aspects and meanings are seen that also relate to Louise Bourgeois's oeuvre in regard to the interest in human relations. Through a comparative approach to both artists' poetics, an understanding is created that love is not a simplistic action and all the words read in or applied to their visual discourse must be considered within a wide range of love in visual and literary images. In this paper, we demonstrate how the collaborative and sequential unfolding of a story ties into the constitution of a membership categorization device which we have glossed as ‘us and them’. The data come from a focus group activity where first and second generation immigrants to Denmark have been asked to discuss their situation in Denmark. Using Ethnomethodological Conversation and Membership Categorization Analysis, we present one story which involves a story-teller and his family and an elderly Danish couple living in (...) the same block of flats. In the telling of the story, co-participants align and affiliate, and disalign and disaffiliate, at sequentially relevant junctions. We will argue that not only do such phenomena indicate listenership and possible agreement to the moral of the story in its telling, but also to the morally implicative categorical work involved in the story’s telling. When economists perform experiments, they do so typically in one of two traditions: cognitive psychology experiments in the heuristics and biases tradition (H&B-experiments) and experimental economics in the tradition of Vernon Smith. What sets these two traditions apart? In this paper, I offer a novel conceptualization of their pervasive disagreements. Focusing on how each camp approaches preferences, one of the most fundamental concepts in economics, I argue that experimental economics can be reconstructed as holding that the constituents of preferences can (...) be partially located in agents’ environments, while H&B-experiments implicitly assume that the constituents of preferences are entirely located within agents’ bodies. The paper (i) outlines how my reconstruction can account for the disagreement between the two paradigms, (ii) defends the plausibility of this reconstruction, and (iii) highlights its implications for the debate about the nature of preferences in economics. What happens when mindless symbols of algorithmic AI encounter mindful performative rituals? I return to my criticisms of Habermas’ secularising reading of Kierkegaard’s ethics. Next, I lay out Habermas’ claim that the sacred complex of ritual and myth contains the ur-origins of postmetaphysical thinking and reflective faith. If reflective faith shares with ritual same origins as does communicative interaction, how do we access these archaic ritual sources of human solidarity in the age of AI?

Since the global financial crisis in 2007, social banks have been flooded with deposits. Previous studies have indicated that customers hold deposits with social banks due to social banks' special placement of assets. However, to date it has been far from clear how social banks select their investments, and consequently to what extent the placement of assets meets depositors' preferences. The purpose of this paper is, therefore, to investigate whether the characteristics of social banks’ placement of assets are relevant to (...) depositors’ choice of social banks. A two‐stage study is conducted, using data collected via a document analysis of social banks' investment criteria, a survey of social banks, and an online survey of 609 depositors. The results imply that the characteristics of social banks' placement of assets are indeed relevant to depositors' choice of social banks, but do not explain customer behaviour entirely. Furthermore, the findings indicate that a relevant proportion of customers hold deposits with social banks to avoid “evil” rather than necessarily creating “good.” Based on the findings, a theoretical framework of depositors' choice of social banks is presented that goes far beyond previous explanations by considering various types of social depositors, banks, and borrowers. Business Ethics: A European Review, EarlyView.

The paper takes a close look at Derek Parfit’s example of the Nineteenth Century Russian in 'Reasons and Persons'. Parfit presents it as an example which illustrates the moral consequences of adopting his reductionist view of personal identity in a positive light. I argue that things turn out to be more complex than he envisages, and that it might be far more difficult to live in his world than he allows.

This paper sheds new light on Putnam's hypothesis that watching television, particularly entertainment programs, contributes to an erosion of social trust. Previous studies have been unable to reach convincing evidence regarding this claim. It is argued that this is a consequence of the neglect of indirect, interpersonally mediated TV effects which supplement the influence of direct exposure, and extend even to those who do not watch television. Using data from the 2002 and 2004 waves of the European Social Survey in (...) combination with aggregate data from telemetric audience research, we conduct a multilevel analysis of TV's impact on social trust. Investigating this macro-micro relationship, we find that patterns of general TV use in 25 European societies exert substantial effects on individual social trust that by far exceed those of individual TV use. In line with Putnam's hypothesis, there is a negative impact of total TV time; however, high market shares of public TV increase social trust. (shrink)

What does race add to class, as both are secular social categories? The difficulties of invidious nationalism and the conservation of races that would not foment holy wars of terror persist for both secular or postsecular theorists. Postsecular thinkers are in a stronger position than a secular theorist to challenge religiously inflected social integrations, invidious nationalism, and fundamentalism.Unmasking them as social formation proffers an external criticism, to speak of them as sacralizations of identity exposes them at the root. Secular theorists (...) ignore postsecular sensibility at the peril of failing to challenge the invidious claim to roots that secular nationalism and religious fundamentalism profess. (shrink)

This paper aims to show how Kant’s concept of mathematical intuition and his thesis of the Euclidicity of space have been rehabilitated by recent interpretations that refer to the concepts of practice, diagrams, and the body. This involves criticising the idea of mathematics as a purely logical and axiomatic science, reading Kant’s theory of geometric intuition as a theory of diagrammatic visualizations, and showing how Kant’s idea of the Euclidicity of space can be justified with reference to embodied experience. These (...) readings contradict the critique of Kant voiced by logicism and logical empiricism. They show that Kant’s notion of non-empirical intuition refers to the embeddedness of human cognition in embodied, media-based practices that function as a third epistemological realm alongside the conceptual and the empirical. According to their founders, the DVjs, established in 1923, was supposed to develop a specific focus also for medieval literature and culture. This article analyzes how this program was realized and how the relationship between literary studies and intellectual history (›Geistesgeschichte‹) was shaped in different periods from the early articles of Günther Müller, Wolfgang Stammler or Walther Rehm to the reestablishment by Hugo Kuhn around 1950. The authors reconstruct a particular branch of German medieval studies still relevant today.

Why is there such a striking discrepancy between the flexibility, democracy and empowerment that the Bologna process aims for, and the superficial educational activities that it actually results in? Our answer is based on the ritual theory of the American anthropologist Roy Rappaport and the psychoanalytical framework of the Austrian philosopher Robert Pfaller. Interpreting schoolified education as a ritual, we argue that both the reform initiative and its ensuing educational activities should be interpreted as mainly productive of a certain appearance, (...) of compliance with prominent norms of modern society: the norms are articulated in policy documents and enacted in educational activity. We take schoolified education to be a normal ritual, in that this appearance is accepted ‘as if’ it corresponded with reality, while at the same time most people are aware (in a certain sense) of its superficial and ritualistic character. A twist, however, is added by the fact that modern society is distinctly anti-ritualistic, and therefore constantly tries to make education work ‘for real’. Drawing on Pfaller’s distinction between belief and faith, we show that this pursuit of de-ritualisation actually makes education progressively more formalised and coercive. (shrink)
