The representation of knowledge in the law has basically followed a rule-based logical-symbolic paradigm. This paper aims to show how the modeling of legal knowledge can be re-examined using connectionist models, from the perspective of the theory of the dynamics of unstable systems and chaos. We begin by showing the nature of the paradigm shift from a rule-based approach to one based on dynamic structures and by discussing how this would translate into the field of theory of law. In order (...) to show the full potential of this new approach, we start from an experiment with NEUROLEX, in which a neural network was used to model a corpus of French Council of State decisions. We examine the implications of this experiment, especially those concerning the limits of the model used, and show that other connectionist models might correspond more adequately to the nature of legal knowledge. Finally, we propose another neural model which could show not only the rules which emerge from legal qualification (NEUROLEX's goal), but also the way in which a legal qualification process evolves from one concept to another. Les avancées rapides dans les technologies numériques ont considérablement changé et amélioré la façon dont les données, informations et outils peuvent être diffusés, gérés, utilisés et réutilisés dans la recherche, et ont créé de nouvelles opportunités pour accélérer le progrès dans la science et l’innovation. Ces développements sont principalement dus au large mouvement formel ou informel de la peer production et à la diffusion globale de l’information mobilisant la coopération de communautés distribuées œuvrant dans des environnements en réseaux. Les initiatives (...) comme celle de Science Commons s’appuient sur un modèle économique de la science évoluant dans un environnement numérique et plus précisément sur un socle de partage et d’échange entre communautés de pairs comme modalité de production. Beaucoup d’autres initiatives de ce type sont en cours . Nous avons choisi Science Commons, dont l’objectif, au-delà de la communication scientifique, vise à accélérer la traduction des données en découverte – en débloquant tous les verrous y compris juridiques qui empêchent que la société bénéficie plus rapidement des résultats scientifiques. La philosophie et les outils pratiques de Science Commons seront décrits comme constitutifs d’une approche résolument ouverte de la connaissance scientifique, dans la lignée de la déclaration de Berlin .Rapid advances in the digital technologies have profoundly changed and improved the way in which data, information and tools can be disseminated, managed, used and re-used in research, and have created new opportunities to speed up progress in science and innovation. These developments are mainly due to an emerging broader movement in support of formal and informal « peer production » and global dissemination of information drawing on the cooperation of distributed science and knowledge communities working in open networked environments. Initiatives like the Science Commons rely on an economic model where science evolves in a digital environment, and more specifically on sharing and exchanges between peer communities as a basis for production. Many other initiatives of this kind are under way . We have chosen the Science Commons, whose objective, over and above scientific communication, is to speed up the translation of data into discovery by removing all barriers, including legal obstacles, that prevent society from enjoying the benefits of scientific results as quickly as possible. The philosophy and practical tools of the Science Commons are described as making up a resolutely open approach to scientific knowledge, as recommended by the Berlin Declaration. (shrink)

Unlike usual real graphs which have a low number of edges, we study here a dense network constructed from legal citations. This study is achieved on the simple graph and on the multiple graph associated to this legal network, this allows exploring the behavior of the network structural properties and communities by considering the weighted graph and see which additional information are provided by the weights. We propose new measures to assess the role of the weights in the network structure (...) and to appreciate the weights repartition. Then we compare the communities obtained on the simple graph and on the weighted graph. We also extend to weighted networks the amphitheater-like representation of this legal network. Finally we evaluate the robustness of our measures and methods thus taking into account potential errors which may occur by getting data or building the network. Our methodology may open new perspectives in the analysis of weighted networks. (shrink)

We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. We explore one aspect of the structure of a codified legal system at the national level using a new type of representation to understand the strong or weak dependencies between the various fields of law. In Part I of this study, we analyze the graph associated with the network in which each French legal code is a vertex and an edge is produced between two vertices when a code cites another code at least one time. We show that this network (...) distinguishes from many other real networks from a high density, giving it a particular structure that we call concentrated world and that differentiates a national legal system (as considered with a resolution at the code level) from small-world graphs identified in many social networks. Our analysis then shows that a few communities (groups of highly wired vertices) of codes covering large domains of regulation are structuring the whole system. Indeed we mainly find a central group of influent codes, a group of codes related to social issues and a group of codes dealing with territories and natural resources. The study of this codified legal system is also of interest in the field of the analysis of real networks. In particular we examine the impact of the high density on the structural characteristics of the graph and on the ways communities are searched for. Finally we provide an original visualization of this graph on an hemicyle-like plot, this representation being based on a statistical reduction of dissimilarity measures between vertices. In Part II (a following paper) we show how the consideration of the weights attributed to each edge in the network in proportion to the number of citations between two vertices (codes) allows deepening the analysis of the French legal system. A groundbreaking examination of Michel Foucault's history of truth. Many blame Michel Foucault for our post-truth and conspiracy-laden society. In this provocative work, Daniele Lorenzini argues that such criticism fundamentally misunderstands the philosopher’s project. Foucault did not question truth itself but what Lorenzini calls “the force of truth,” or how some truth claims are given the power to govern our conduct while others are not. This interest, Lorenzini shows, drove Foucault to articulate a new ethics and politics of truth-telling precisely (...) in order to evade the threat of relativism. The Force of Truth explores this neglected dimension of Foucault’s project by putting his writings on regimes of truth and parrhesia in conversation with early analytic philosophy and by drawing out the “possibilizing” elements of Foucault’s genealogies that remain vital for practicing critique today. In this paper, I argue that the vindicatory/unmasking distinction has so far prevented scholars from grasping a third dimension of genealogical inquiry, one I call possibilising. This dimension has passed unnoticed even though it constitutes a crucial aspect of Foucault’s genealogical project starting from 1978 on. By focusing attention on it, I hope to provide a definitive rebuttal of one of the main criticisms that has been raised against genealogy in general, and Foucauldian genealogy in particular, namely the idea that (...) Foucault’s genealogical project lacks normative grounding and is therefore ultimately incapable of telling us why we should resist and fight against the mechanisms of power it nevertheless reveals in an empirically insightful way. This conclusion, I argue, is mistaken because it conceives of Foucauldian genealogy exclusively as an unmasking or problematising method, whereas I claim that Foucault’s genealogical project possesses a possibilising dimension that provides his work with sui generis normative force. Despite considerable differences, Stanley Cavell and Jean-Luc Nancy share the demand for a renewal of thinking produced through and with the concept of the world. Their articulation of the legacy bequeathed by Heidegger and Wittgenstein begins with an understanding of the world in excess of knowledge and insists on this impossible mastery as the most productive incentive for thinking. Inasmuch as philosophy has understood itself as producer of worldviews, systems and principle, philosophy has constantly suppressed the thinking of the world, (...) for any worldview absorbs and dissolves the world in its vision. For both Cavell and Nancy an insistence on this suppression leads to an emphasis on film. Two gestures can be said to intertwine in their thinking of film: to recapture our relation to the world as one that is not based on knowing as certainty, but on the reception of the singular; to recapture thinking as that which is attracted and called for by the insurgence of the singular, by the seam in experience. Nancy and Cavell reverse the idea of cinema as completing the regime of representation stressing how cinema produces a step away from thinking as representation in view of what the article names thinking as patience. The article concludes by asking: what does it mean for philosophy to understand itself as patience? (shrink)

In a recent blog post, Joshua Clover rightly notices the swift emergence of a new panoply of “genres of the quarantine.”1 It should not come as a surprise that one of them centers on Michel Foucault’s notion of biopolitics, asking whether or not it is still appropriate to describe the situation that we are currently experiencing. Neither should it come as a surprise that, in virtually all of the contributions that make use of the concept of biopolitics to address the (...) current coronavirus pandemic, the same bunch of rather vague ideas are mentioned over and over again, while other—no doubt more interesting—Foucauldian insights tend to be ignored. In what follows, I discuss two of these insights, and I conclude with some methodological remarks on the issue of what it may mean to “respond” to the current “crisis.”. (shrink)

In this paper, I take issue with the idea that Michel Foucault might be considered a theorist of epistemic injustice, and argue that his philosophical premises are incompatible with Miranda Fricker’s. Their main disagreement rests upon their divergent ways of conceiving the relationship between reason and power, giving rise to the contrasting forms of normativity that characterize their critical projects. This disagreement can be helpfully clarified by addressing the different use they make of the genealogical method. While Fricker’s genealogy of (...) Testimonial Justice aims to ground her claim that reason and power can be neatly pulled apart, thus avoiding the reductionist and relativist conclusions entailed by Foucault’s genealogies, I argue that Foucault’s mature, overlooked definition of genealogy is based on a sophisticated distinction between games and regimes of truth, and is thus not vulnerable to these criticisms. Consequently, Foucault’s genealogical inquiries prove helpful for understanding issues that normally fall under the umbrella of epistemic injustice in a new light, while also allowing us to avoid some of the main objections that threaten Fricker’s project. Philosophers debate about which logical system, if any, is the One True Logic. This involves a disagreement concerning the sufficient conditions that may single out the correct logic among various candidates. This paper discusses whether there are necessary conditions for the correct logic; that is, I discuss whether there are features such that if a logic is correct, then it has those features, although having them might not be sufficient to single out the correct logic. Traditional rationalist arguments suggest that (...) the necessary conditions of thought are necessary and sufficient conditions singling out the correct logical and mathematical theories. In the contemporary debate, Chalmers advocates a view along this line. Jago, analogously, suggests that the necessary conditions for thought—or, as he calls them, our basic epistemic expectations—single out a family of logical and mathematical theories. Warren and Williamson, on the other hand, argue that there are no necessary conditions of thought. I argue that there are necessary conditions for thought, and these are necessary but not sufficient conditions to be the correct logic; indeed, these are features that all logics—correct or incorrect—share. No view we can understand is ruled out by the necessary conditions for thought, but we cannot understand quite any view. Human linguistic and conceptual abilities are genetically constrained, and these constraints are our best guide to the boundaries of logic. Arguing for this, I tackle two dogmas of modern rationalism: namely, the view that the biological constraints of human cognition have no bearing on the boundaries of the epistemic space, and the view that the boundaries of thought coincide with the boundaries of language. We attempt to justify the use of synthetic biology in response to the climate crisis, based on the premise that it is impossible to avert runaway climate change without sequestering sufficient greenhouse gases (GHG), which could only become possible through Negative Emissions Technologies (NETs). Then, moving from a consequentialist standpoint, we acquiesce to how the consequences of using NETs through synthetic biology are preferable to the catastrophic consequences of runaway climate change. It is commonly hypothesized that scientists are more likely to engage in data falsification and fabrication when they are subject to pressures to publish, when they are not restrained by forms of social control, when they work in countries lacking policies to tackle scientific misconduct, and when they are male. Evidence to test these hypotheses, however, is inconclusive due to the difficulties of obtaining unbiased data. Here we report a pre-registered test of these four hypotheses, conducted on papers that were (...) identified in a previous study as containing problematic image duplications through a systematic screening of the journal PLoS ONE. Image duplications were classified into three categories based on their complexity, with category 1 being most likely to reflect unintentional error and category 3 being most likely to reflect intentional fabrication. We tested multiple parameters connected to the hypotheses above with a matched-control paradigm, by collecting two controls for each paper containing duplications. Category 1 duplications were mostly not associated with any of the parameters tested, as was predicted based on the assumption that these duplications were mostly not due to misconduct. Categories 2 and 3, however, exhibited numerous statistically significant associations. Results of univariable and multivariable analyses support the hypotheses that academic culture, peer control, cash-based publication incentives and national misconduct policies might affect scientific integrity. No clear support was found for the “pressures to publish” hypothesis. Female authors were found to be equally likely to publish duplicated images compared to males. Country-level parameters generally exhibited stronger effects than individual-level parameters, because developing countries were significantly more likely to produce problematic image duplications. This suggests that promoting good research practices in all countries should be a priority for the international research integrity agenda. (shrink)

Philosophical analysis of mathematical knowledge are commonly conducted within the realist/antirealist dichotomy. Nevertheless, philosophers working within this dichotomy pay little attention to the way in which mathematics evolves and structures itself. Focusing on mathematical practice, I propose a weak notion of objectivity of mathematical knowledge that preserves the intersubjective character of mathematical knowledge but does not bear on a view of mathematics as a body of mind-independent necessary truths. Furthermore, I show how that the successful application of mathematics in science (...) is an important trigger for the objectivity of mathematical knowledge. (shrink)

For the first time in print, this article reports passages from John Rawls’s graduate papers and annotations on books and manuscripts from his personal library. The analysis of this material shows the historical inaccuracy of the widespread assumption that Rawls’s philosophy owes very little to American pragmatism. Peirce’s notion of truth, as well as the holistic critique of pragmatism thatMortonWhite began in the late 1940s, prove significant at the very beginning of Rawls’s philosophical enterprise. In the light of this material, (...) it might be argued that Rawls’s elaboration of ‘reflective equilibrium’ started at least in part as an attempt to overcome the pending problems of pragmatism. We show that linear logic can serve as an expressive framework in which to model a rich variety of combinatorial auction mechanisms. Due to its resource-sensitive nature, linear logic can easily represent bids in combinatorial auctions in which goods may be sold in multiple units, and we show how it naturally generalises several bidding languages familiar from the literature. Moreover, the winner determination problem, i.e., the problem of computing an allocation of goods to bidders producing a certain amount of revenue (...) for the auctioneer, can be modelled as the problem of finding a proof for a particular linear logic sequent. Chang's MV algebras are the algebras of the infinite-valued sentential calculus of ukasiewicz. We introduce finitely additive measures (called states) on MV algebras with the intent of capturing the notion of average degree of truth of a proposition. Since Boolean algebras coincide with idempotent MV algebras, states yield a generalization of finitely additive measures. Since MV algebras stand to Boolean algebras as AFC*-algebras stand to commutative AFC*-algebras, states are naturally related to noncommutativeC*-algebraic measures.

In this paper, we present a number of problems for intellectualism about knowledge-how, and in particular for the version of the view developed by Stanley & Williamson 2001. Their argument draws on the alleged uniformity of 'know how'-and 'know wh'-ascriptions. We offer a series of considerations to the effect that this assimilation is problematic. Firstly, in contrast to 'know wh'-ascriptions, 'know how'-ascriptions with known negative answers are false. Secondly, knowledge-how obeys closure principles whose counterparts fail for knowledge-wh and knowledge-that. Thirdly, (...) as opposed to knowledge-wh and knowledge-that, knowledge-how is inferentially isolated from further knowledge-that. We close by providing some evidence against the further reduction of knowledge-wh to knowledge-that, which is presupposed by the intellectualist theory under discussion. (shrink)

Among the various experiments in ‘new governance’, the model of Responsible Research and Innovation is emerging in the European landscape as quite promising. Up to now, there have been two versions of RRI: a socio-empirical version which tends to underline the role of democratic processes aimed at identifying values on which governance needs to be anchored and a normative version which stresses the role of EU goals as ‘normative anchor points’ of both governance strategies and policy making. Both versions are (...) unsatisfactory. The first since it suggests movable anchorage which could clash with prefixed values, such as individual rights. The second since it does not safeguard fundamental rights in the process of balancing ‘anchor points’. This result is counterintuitive because it exposes governance to the risk of facing adverse court decisions in the defense of individual rights, thus losing its anticipative attitude. In order to avoid this outcome, the paper argues that it is only through better integration between the system of human rights and that of EU fundamental rights that the anticipative feature of RRI can be preserved. Whistleblowing is the act of disclosing information from a public or private organization in order to reveal cases of corruption that are of immediate or potential danger to the public. Blowing the whistle involves personal risk, especially when legal protection is absent, and charges of betrayal, which often come in the form of legal prosecution under treason laws. In this article we argue that whistleblowing is justified when disclosures are made with the proper intent and fulfill specific communicative constraints in (...) addressing issues of public interest. Three communicative constraints of informativeness, truthfulness and evidence are discussed in this regard. We develop a ‘harm test’ to assess the intent for disclosures, concluding that it is not sufficient for justification. Along with the proper intent, a successful act of whistleblowing should provide information that serves the public interest. Taking cognizance of the varied conceptions of public interest, we present an account of public interest that fits the framework of whistleblowing disclosures. In particular, we argue that whistleblowing is justified inter alia when the information it conveys is of a presumptive interest for a public insofar as it reveals an instance of injustice or violation of a civil or political right done against and unbeknown to some members of a polity. Graham Priest proposed an argument for the conclusion that ‘nothing’ occurs as a singular term and not as a quantifier in a sentence like (1) ‘The cosmos came into existence out of nothing’. Priest's point is that, intuitively, (1) entails (C) ‘The cosmos came into existence at some time’, but this entailment relation is left unexplained if ‘nothing’ is treated as a quantifier. If Priest is right, the paradoxical notion of an object that is nothing plays a role in our (...) very understanding of reality. In this note, we argue that Priest's argument is unsound: the intuitive entailment relation between (1) and (C) does not offer convincing evidence that ‘nothing’ occurs as a term in (1). Moreover, we provide an explanation of why (1) is naturally taken to entail (C), which is both plausible and consistent with the standard, quantificational treatment of ‘nothing’. (shrink)

Expectations play a central role in understanding scientific and technological changes. Future-oriented representations are also central with regard to nanotechnologies as they can guide policy activities, provide structures and legitimation, attract different interests, focus policy-makers’ attention and foster investments for research. However, the emphasis on future scenarios tends to underrate the complexity of the challenges of the present market of nanotechnologies by flattening them under the needs and promises of scientific research. This is particularly apparent if we consider the viewpoint (...) of the regulator who faces two different ranges of problems with regard to the market and research and is expected, simultaneously, to manage two different types of regulatory instruments, pursuing at the same time the same goals. Instead, by favoring only the future scenarios, the regulator runs the risk of abruptly shifting from more flexible and elastic tools to forms of hard legislation, wasting, thus, the resources of the soft-regulation, in particular those of self-regulation. By referring primarily to the European context, human rights, also thanks to their normative structure of principles, can help in strengthening both the legislation needed for regulating the present market and the soft instruments needed for steering research and for fostering the stakeholders’ participation without sacrificing the coherence of the regulatory response. This paper surveys the impact on neuropsychology of Wittgenstein's elucidations of memory. Wittgenstein discredited the storage and imprint models of memory, dissolved the conceptual link between memory and mental images or representations and, upholding the context-sensitivity of memory, made room for a family resemblance concept of memory, where remembering can also amount to doing or saying something. While neuropsychology is still generally under the spell of archival and physiological notions of memory, Wittgenstein's reconceptions can be seen at work in its (...) leading-edge practitioners. However, neuroscientists, generally, are finding memory difficult to demarcate from other cognitive and noncognitive processes, and I suggest this is largely due to their considering automatic responses as part of memory, termed nondeclarative or implicit memory. Taking my lead from Wittgenstein's On Certainty, I argue that there is only remembering where there is also some kind of mnemonic effort or attention, and, therefore, that so-called implicit memory is not memory at all, but a basic, noncognitive certainty. In this paper, I focus on Gianni Vattimo’s and Paolo Diego Bubbio’s notion of kenosis showing that (1) they both understand kenotic sacrifice in a strongly hermeneutical sense, and connect it with a perspectival account of truth and knowledge; (2) they both emphasize that kenotic sacrifice has a fundamentally ethical aspect; and (3) they both maintain that kenotic sacrifice is an “un-natural” act that is implied in the withdrawal of one’s self. However, I intend to show that nature can be (...) understood positively through the notion of kenosis, and that it is possible to envisage an ethical theory that concretely tackles the self-proclaimed centrality of human agency within nature, therefore, implementing an effective and non-anthropocentric form of kenotic sacrifice. In this sense, I conclude by arguing that kenotic sacrifice can primarily be seen as an act of making room for other ways of being. (shrink)

This dissertation is generally concerned with Plato’s conception of philosophy, as the conception is ascertainable from the Republic and certain ‘post-Republic’ dialogues. It argues that philosophy, according to Plato, is multi-disciplinary; that ‘philosophy’ does not mark off just one art or science; that there are various philosophers corresponding to various philosophical sciences, all of which come together under a common aim: betterment of self through intellectual activity. A major part of this dissertation is concerned with Plato's science par excellence, ‘the (...) science of dialectic’. The science of dialectic is distinguished in Plato by being concerned with Forms or Kinds as such; the science of dialectic, alone amongst the philosophical sciences, fully understands what it means for Form X to be a Form. I track the science of dialectic, from its showcase in Republic VI and VII, and analyze its place in relation to the other philosophical sciences in certain post-Republic dialogues. Ultimately, I show that, whilst it is not the only science constituting philosophy, Plato’s science of dialectic represents the intellectual zenith obtainable by man; the expert of this science is the topmost philosopher. In this dissertation I also argue that Socrates, as variously depicted in these dialogues, always falls short of being identified as the philosopher par excellence, as that expert with positive knowledge of Forms as such. Yet I also show that, far from being in conflict, the elenctic Socrates and the philosopher par excellence form a complementary relationship: the elenctic philosopher gets pupils to think about certain things in the right way prior to sending them off to work with the philosopher par excellence.
