In this essay, I attempt to define the 'ethnocategory' mushi in Japanese culture, through a semantic analysis of the Chinese characters bearing the radical "mushi," and fieldwork research in rural Japan. The research offers criteria for an animal's inclusion in the category, reveals the differences in people's perception of mushi according to age and gender, and elicits a structure of the category as a series of concentric circles around a semantic core. In this article, we apply the literature on the ethics of choice-architecture (nudges) to the realm of virtual reality (VR) to point out ethical problems with using VR for empathy-based nudging. Specifically, we argue that VR simulations aiming to enhance empathic understanding of others via perspective-taking will almost always be unethical to develop or deploy. We argue that VR-based empathy enhancement not only faces traditional ethical concerns about nudge (autonomy, welfare, transparency), but also a variant of the semantic variance problem (...) that arises for intersectional perspective-taking. VR empathy simulations deceive and manipulate their users about their experiences. Despite their often laudable goals, such simulations confront significant ethical challenges. In light of these goals and challenges, we conclude by proposing that VR designers shift from designing simulations aimed at producing empathic perspective-taking to designing simulations aimed at generating sympathy. These simulations, we claim, can avoid the most serious ethical issues associated with VR nudges, semantic variance, and intersectionality. (shrink)

We argue that moral judgment studies currently conducted utilizing virtual reality (VR) devices must confront a dilemma due to how virtual environments are designed and how those environments are experienced. We begin by first describing the contexts present in paradigmatic cases of naturalistic moral judgments. We then compare these contexts to current traditional (vignette-based) and VR-based moral judgment research. We show that, contra to paradigmatic cases, vignette-based and VR-based moral judgment research often fails to accurately model the situational features of (...) paradigmatic moral judgments. In particular, we compare and contrast six recent VR studies to support our view that only simulations high in context-realism and perspectival-fidelity can produce ‘virtually real experiences.’ After analyzing the constituents of a virtually-real experience, we go on to propose guidelines for the creation of VR studies. These guidelines serve two purposes. First, we aim to increase the ecological validity of such studies in order to advance our understanding of moral judgments. Second, we believe that such guidelines should inform how Institutional Review Boards assess VR research. Contrary to concerns of some critics, we present evidence that biomedical research is not dominated by a small handful of model organisms. An exhaustive analysis of research literature suggests that the diversity of experimental organisms in biomedical research has increased substantially since 1975. There has been a longstanding worry that organism‐centric funding policies can lead to biases in experimental organism choice, and thus negatively impact the direction of research and the interpretation of results. Critics have argued that a focus on (...) model organisms has unduly constrained the diversity of experimental organisms. The availability of large electronic databases of scientific literature, combined with interest in quantitative methods among philosophers of science, presents new opportunities for data‐driven investigations into organism choice in biomedical research. The diversity of organisms used in NIH‐funded research may be considerably lower than in the broader biomedical sciences, and may be subject to greater constraints on organism choice. (shrink)

Section 1 contains a survey of options in constructing a formal system of dialogue rules. The distinction between material and formal systems is discussed (section 1.1). It is stressed that the material systems are, in several senses, formal as well. In section 1.2 variants as to language form (choices of logical constants and logical rules) are pointed out. Section 1.3 is concerned with options as to initial positions and the permissibility of attacks on elementary statements. The problem of ending a (...) dialogue, and of infinite dialogues, is treated in section 1.4. Other options, e.g., as to the number of attacks allowed with respect to each statement, are listed in section 1.5. Section 1.6 explains the concept of a chain of arguments.From section 2 onward four types of dialectic systems are picked out for closer study: D, E, Di and Ei. After a preliminary section on dialogue sequents and winning strategies, the equivalence of derivability in intuitionistic logic and the existence of a winning strategy (for the Proponent) on the strength of Ei is shown by simple inductive proofs. Buscar-se-á no presente trabalho analisar os discursos acerca da formação do Estado em Rousseau e Locke. Os autores compartilham a teoria de uma forma de contrato social – um acordo deliberado entre seres humanos cuja condição selvagem se extingue neste momento decisório. Dessa forma, em ambos os autores, o Estado surge como um agente, ou corpo, protetor. Em contrapartida, os estudos de Pierre Clastres – etnólogo francês – referentes a grupos primitivos contemporâneos demonstram a existência de uma permanente conjuração contra (...) a possibilidade do surgimento de um poder político alienado do controle do grupo como um todo. Ou seja, uma conjuração contra o Estado. Nesse sentido, o objetivo geral desse trabalho é colidir tais ideias, assim como suas possíveis reverberações atuais. (shrink)

The Swiss philosopher Anton Marty (Schwyz, 1847 - Prague, 1914) belongs, with Carl Stumpf, to the first circle of Brentano’s pupils. Within Brentano’s school (and, to some extent, in the secondary literature), Marty has often been considered (in particular by Meinong) a kind of would-be epigone of his master (Fisette & Fréchette 2007: 61-2). There is no doubt that Brentano’s doctrine often provides Marty with his philosophical starting points. But Marty often arrives at original conclusions which are diametrically opposed to (...) Brentano’s views. This is true of his views about space and time and about judgment, emotions and intentionality. In the latter case, for example, Marty develops Brentano’s view and its implications in great detail (Mulligan 1989; Rollinger 2004), but uses them to formulate a very unBrentanian account of intentionality as a relation of ideal assimilation (Chrudzimski 1999; Cesalli & Taieb 2013). Marty’s philosophy of language, on the other hand, is one of the first philosophies worthy of the name. In what follows, we contrast briefly their accounts of (i) judgment and states of affairs and of (ii) emotings and value (two topics of foremost significance, for Brentano and Marty’s theoretical and practical philosophies respectively) (§1), and their philosophies of language (§2). Brentano’s view of language is based on his philosophy of mind. Marty takes over the latter and turns a couple of claims by Brentano about language into a sophisticated philosophy of language of a kind made familiar much later by Grice. Marty’s philosophy of states of affairs and value and of the mind’s relations to these also takes off from views sketched by the early Brentano, views forcefully rejected by the later Brentano. This is the first volume of a two-volume project whose aim is to publish all the known Middle English manuscript translations of the French Somme le mi, a thirteenth-century manual of religious instruction offering teaching on the Decalogue, the seven deadly sins and their remedies, compiled by the Dominican friar Laurent of Orleans. The project extends and deepens our knowledge of the influence of this popular French text, known today only from the versions entitled The Ayen bite of Inwit and (...) The Book of Vices and Virtues, published in 1866 and 1942, respectively. This volume presents the versions extant in BL MSS Royal 18. A. x and Add. 37677; the second will cover the versions in Cambridge, Corpus Christi College, MS 494, Oxford, Bodleian Library, MS Ashmole 1286, and Oxford, Bodleian Library, MS e Musaeo 23. The texts of both volumes have been prepared with the help of the recently-published edition of the French text, a circumstance from which the earlier English editions were unable to benefit. It is likely that the versions edited here for the first time will make a considerable contribution to our understanding of the processes of textual transmission and to that of translation itself in English literary circles of the fifteenth century. resumo O artigo pretende revisitar a interpretação hegeliana dos Fundamentos do Direito Natural de Fichte, não propriamente seus elementos críticos, presentes na Differenzschrift e no Naturrechtaufsatz, mas antes a possibilidade de uma assimilação positiva. Em primeiro lugar, oferecemos uma interpretação da passagem entre os §3 e §4 da obra de Fichte, entre a discussão da Aufforderung e a dedução do reconhecimento jurídico, que procura articulála como interface entre educação e direito. Na segunda parte, procuramos revelar o pano de fundo “histórico-espiritual” (...) que permite considerar, no jovem Hegel, um embate entre formas inclusivas e excludentes de intersubjetividade. Na terceira parte, o objetivo é considerar a relação entre a eticidade, enquanto Einssein do universal e do singular, o direito e a educação. Antipsychotic medications are sometimes imposed on psychiatric patients deemed dangerous to themselves and others. This is based on the assumption that treatment is safe and effective, and that recovery depends on biological adjustment. Under new laws, patients can be required to remain on these medications after leaving hospitals. However, survivors attest that forced treatment used as a restraint can feel like torture, while the consequences of withdrawal can also be severe.

On interprète assez souvent le succès actuel des médecines parallèles comme une réaction à une double insatisfaction que la médecine scientifique laisse au patient dans nos sociétés occidentales. D'une part, la difficulté d'être entendu comme sujet dans sa maladie, comme une personne globale affectée dans la totalité de son être, dans le sens qu'elle donne à sa vie, à ses relations, etc. Et d'autre part, la difficulté d'être appréhendé d'une manière unitaire par le médecin, corps et esprit réunis. Les différents (...) auteurs de cet ouvrage, qu'ils soient théologiens, philosophes, médecins ou historiens de la médecine, ont tous pris au sérieux ces appels à dépasser ce que l'on peut appeler les impasses de la biomédecine en proposant, selon différentes inspirations, une anthropologie renouvelée du corps humain. En particulier, s'il s'agit de faire droit aux convictions du patient et du professionnel de santé, à quelles conditions - épistémologiques mais aussi politiques - un dialogue entre l'Eglise et la science peut-il s'avérer légitime et fécond? Que peuvent nous apprendre les écrits hippocratiques et les textes bibliques pour construire une autre représentation du corps humain et de la maladie? Le modèle des soins palliatifs ne pourrait-il pas fournir à la biomédecine un nouveau paradigme de prise en charge du patient où celui-ci reste un sujet, capable de relation, une personne jusqu'au bout? The notion of epistemic coherence is interpreted as involving not only consistency but also stability. The problem how to consolidate a belief system, i.e., revise it so that it becomes coherent, is studied axiomatically as well as in terms of set-theoretical constructions. Representation theorems are given for subtractive consolidation (where coherence is obtained by deleting beliefs) and additive consolidation (where coherence is obtained by adding beliefs).

The Gamer's Dilemma challenges us to find a distinction between virtual murder and virtual pedophilia. Without such a distinction, we are forced to conclude that either both are morally acceptable or that both should be morally illicit. This paper argues that the best way to solve the dilemma is, in one sense, to dissolve it. The Gamer's Dilemma rests on a misunderstanding in the sense that it does not distinguish between the form of a simulation and its surface content. A (...) greater appreciation of the way structural features of a simulation affect subject experience will help us see why only simulations of murder and pedophilia generating virtually real experiences are likely to be seen as wrong. I argue that a simulation’s structural elements powerfully affect how subjects experience simulated content and hence is an important, and previously neglected, variable necessary to dissolve the Gamer's Dilemma. Properly understood, virtually real simulations of murder and pedophilia are both likely to be treated by players as morally wrong. Similarly, virtually unreal murder and pedophilia will be less likely to be judged as wrong. Subject judgments are thus consistent once a simulation’s structural variables are accounted for. The Gamer's Dilemma dissolves as a dilemma once we acknowledge these structural features of simulations and how they affect experience and moral judgment. (shrink)

This chapter provides a brief overview of the increasing importance of experimentation in the life sciences from the seventeenth century to the present day. In the wake of the Scientific Revolution initiated in physics, numerous scientists have regularly attempted to introduce experimentation and the quantification of phenomena into the life sciences. These attempts have been difficult and have systematically come up against the fact that living organisms are individuals, i.e. both totalities that are difficult to decompose and transient results of (...) an evolutionary process that gives them specific characteristics. Experimentation has thus only been possible in biology thanks to the adaptation of a mechanistic perspective to such particularities of living bodies. (shrink)

In this paper, we argue that, under a specific set of circumstances, designing and employing certain kinds of virtual reality (VR) experiences can be unethical. After a general discussion of simulations and their ethical context, we begin our argu-ment by distinguishing between the experiences generated by different media (text, film, computer game simulation, and VR simulation), and argue that VR experiences offer an unprecedented degree of what we call “perspectival fidelity” that prior modes of simulation lack. Additionally, we argue that (...) when VR experiences couple this perspectival fidelity with what we call “context realism,” VR experiences have the ability to produce “virtually real experiences.” We claim that virtually real experiences generate ethical issues for VR technologies that are unique to the medium. Because subjects of these experiences treat them as if they were real, a higher degree of ethical scrutiny should be applied to any VR scenario with the potential to generate virtually real experiences. To mitigate this unique moral hazard, we propose and defend what we call “The Equivalence Principle.” This principle states that “if it would be wrong to allow subjects to have a certain experience in reality, then it would be wrong to allow subjects to have that experience in a virtually real setting.” We argue that such a principle, although limited in scope, should be part of the risk analysis conducted by any Institutional Review Boards, psychologists, empirically oriented philosophers, or game designers who are using VR technology in their work. Esse estudo objetivou analisar a violência infantil no contexto brasileiro, correlacionando-a com fatores socioeconômicos, socioculturais, geracionais e de gênero, investigando o impacto dos mesmos na saúde das crianças. Realizou-se um estudo epidemiológico descritivo, realizado a partir de dados de artigos científicos e documentos oficiais sobre e violência infantil, além do banco de dados do Sistema de Informação de Agravos de Notificação (SINAN) e da plataforma SciELO e Google Acadêmico. Encontrou-se uma maior prevalência de violência física e negligência, maior índice de (...) violência sexual contra o sexo feminino e negligência no sexo masculino. Os principais agressores identificados foram o pai e a mãe. Acerca da etnia, crianças pardas foram as mais agredidas, bem como as de menor escolaridade. As consequências da violência infantil se estendem para além do momento da agressão, ao perturbar funções cognitivas e mesmo influenciar na gênese de transtornos psiquiátricos. (shrink)

Al aplicar la ética en la política se desvela un problema fundamental consistente entre su supuesta relación, llegando a entenderse como saberes opuestos, es preciso pues, reflexionar en torno a su posible aplicación, o si por el contrario, normatizar éticamente la política es imposible, utilizando la ayuda de métodos analíticos, deductivos e histórico-comparativos que sirvan de marco teórico. A causa de la negación ética en los procederes políticos surge una práctica política amoral, que mediante el sometimiento y la costumbre se (...) termina aceptando como algo políticamente normal, degenerando en una serie de problemas y creencias que imposibilitan cada vez más la aplicación de juicios morales a actuares políticos, es por ello que en la actualidad es normal pensar que lo único importante en la política es únicamente el fin, ignorando el daño que se pueda generar en el proceso. Sin embargo, la ética y política son acciones humanas, por lo tanto se debe reflexionar sobre ellas con las herramientas brindadas por la ética política, aplicando juicios éticos y morales a los actuares inmediatos y prácticos encontrados en la política. Resumo: Propõe-se uma leitura de três episódios da Odisseia, nos quais há o uso de um phármakon. São Helena, Circe e Hermes as personagens que administram as phármaka. Trata-se de leitura: 1) vinculada a um projeto: o levantamento e a interpretação de discursos que se distanciem e/ou questionem a perspectiva da “guerra às drogas”, algo como um projeto de extração de elementos textuais que possam servir como ferramentas teóricas, na construção de uma perspectiva menos mortífera em relação às substâncias; 2) (...) guiada por três princípios, os quais podem ser ditos anticoloniais e antirracistas. Leitura centrada no phármakon, mas que o articula à comida floral dos lotófagos e à relação de xenía; dela, apresenta-se a proposta segundo a qual, no texto homérico, há a valorização de algo que pode ser chamado de multivalência.: The aim of this paper is to analyze three episodes of the Odyssey in which a pharmakon is used. Helen, Circe and Hermes are the characters that administer the pharmaka. This analysis is linked to a project - the survey of discourses that distance themselves and/or question the perspective of the “war on drugs”, a project that aims to extract textual elements that can serve as tools of thought in the construction of a less deadly path in relation to substances - and guided by three principles - which can be called anti-colonial and anti-racist. From this focus, centered on the pharmakon, also articulating it to the floral food of the lotophagi and the relationship of xenia, a thesis is put forward according to which, in the Homeric texts, one can find something that can be called multivalence. L'ordre juridique qui se met en place, en France, aux derniers siècles du Moyen Âge a encore tout récemment été l'objet de riches débats : l'auto-développement des coutumes, l'autorité des droits savants et l'interventionnisme du roi de France ont notamment été au cœur de vives controverses historiographiques. La lecture des sources est à l'origine de querelles interprétatives, auxquelles s'ajoutent des difficultés méthodologiques que rencontrent les historiens du droit. Tandis que l'historien n'a accès qu'à une proportion infime du concret, celui-ci s'efforce (...) de combler ces lacunes, parfois même à l'aide d'une projection des catégories juridiques contemporaines. Cet anachronisme des concepts – parfois couplé à un anachronisme des faits – ne constitue-t-il pas l'un des vices rédhibitoires de la discipline? Cette méthode ne présente-t-elle pas, à l'inverse, une indéniable vertu heuristique et disciplinaire? Certains estiment alors que la théorie du droit est anhistorique, quand d'autres critiquent l'emploi par les historiens des concepts contemporains, comme la hiérarchie des normes, la souveraineté ou encore l'État. Outre de telles projections, c'est le sens donné à certains signifiants médiévaux ou modernes qui peut être relativisé, comme c'est le cas notamment pour les notions de droit positif, de droit commun ou encore de loi. Ces difficultés révèlent aussi à certains égards l'ambivalence de l'histoire du droit, écartelée entre science historique et dogmatique juridique. Ce livre propose alors une réflexion épistémologique sur l'un des grands enjeux de l'historiographie juridique contemporaine : peut-on penser l'ordre juridique médiéval et moderne à partir des catégories juridiques contemporaines? This Article examines ability taxation, which is a tax on a person’s earning ability or potential earnings, rather than earned income. Despite this regime’s longstanding favor as a theoretical ideal for fair and efficient taxation among public finance economists, certain political philosophers, and tax law scholars, insufficient effort has been made to provide an analysis of what ‘potential earnings’ means. This Article explores competing understandings of this notion, and situates them within a multipart taxonomy. In so doing, it unearths a (...) tension at the core of the ability tax program involving a fundamental misalignment between the metaphysics (or correct conceptual analysis) of potential earnings and the economics of its taxation. It concludes that once we correctly understand its requirements, we should reject ability taxation as the first-best normative ideal it has been held out to be on the grounds that it is overly burdensome and unfair to certain individuals. El presente trabajo, expone los resultados de una investigación sobre la apropiación y desarrollo de saberes docentes del profesorado novel durante sus primeras experiencias de ejercicio profesional en el estado de Sinaloa (México). Las evidencias, permitieron advertir un ambiente alterno de inserción que aportaba saberes constreñidos por un contexto delincuencial endémico de comunidades afectadas por el narcotráfico. De ahí que el posicionamiento teórico atendió las relaciones sociales de violencia y poder ante su valor epistémico re-significante del efecto choque con la (...) realidad, propio de esta etapa donde se experimenta una incipiente socialización profesional. La metodología fue de naturaleza cualitativa con sustento en la etnosociología y la entrevista de tipo relato de vida, recuperando las vivencias de 70 profesores nóveles elegidos mediante una muestra no probabilística, caso típico-ideal. Los resultados se agruparon, según sus recurrencias, en cuatro dimensiones jerárquicas: 1) personal, 2) escolar, 3) comunitaria y 4) delincuencial, acorde con su nivel de afectación. Entre las conclusiones, se advierte que la inserción del profesor novel inmersa en un ambiente dominado por la subcultura del narcotráfico, transfigura el aprendizaje de la profesión con saberes docentes específicos y utilizables para sobrevivir esta contingencia dada su influencia intra e inter-áulica. This article criticizes what it calls perspectival thought experiments, which require subjects to mentally simulate a perspective before making judgments from within it. Examples include Judith Thomson's violinist analogy, Philippa Foot's trolley problem, and Bernard Williams's Jim case. The article argues that advances in the philosophical and psychological study of empathy suggest that the simulative capacities required by perspectival thought experiments are all but impossible. These thought experiments require agents to consciously simulate necessarily unconscious features of subjectivity. To complete these (...) experiments subjects must deploy theory-theoretical frameworks to predict what they think they would do. These outputs, however, systematically mislead subjects and are highly prone to error. They are of negligible probative value, and this bodes poorly for their continued use. The article ends with two suggestions. First, many thought experiments are not problematically perspectival. Second, it should be possible to carry out “in-their-shoes” perspectival thought experiments by off-loading simulations onto virtual environments into which philosophers place subjects. (shrink)

This article argues that many situations in social life can be analyzed by their requirement for the justification of action. It is in particular in situations of dispute that a need arises to explicate the grounds on which responsibility for errors is distributed and on which new agreement can be reached. Since a plurality of mutually incompatible modes of justification exists, disputes can be understood as disagreements either about whether the accepted rule of justification has not been violated or about (...) which mode of justification to apply at all. The article develops a grammar of such modes of justification, called orders of worth (grandeur), and argues that the human capacity for criticism becomes visible in the daily occurrence of disputes over criteria for justification. At the same time, it is underlined that not all social situations can be interpreted with the help of such a sense of justice, which resides on a notion of equivalence. Regimes of love, of violence or of familiarity are systematically distinct from regimes of justification. (shrink)

Si Vivre implique la recherche et l'obtention de conditions favorables, n'y a-t-il de vie qu'à distance de la mort? Cependant et non sans suivre certains philosophes tels Nietzsche ou Bataille, la biologie cellulaire ne nous enseigne-t-elle pas que Vivre implique de ne précisément pas cesser de " correspondre " avec la Mort? Le " dialogue " entre (...) la tendance de toute cellule à se laisser disparaître & la suspension de cette tendance chez toute cellule qui reste en Vie ne réfute-t-il pas l'antique suprématie - de Platon au néodarwinisme - de la vie sur la mort? Les recherches contemporaines sur l'auto-effacement cellulaire - sur l'" apoptose " et la Mort cellulaire " programmée " - permettent d'aborder ces questions en détail. Elles supposent, avec l'équivocité des phénomènes Vitaux, une dialectique Vie-Mort dont l'issue n'est nullement acquise d'avance. Elles nous invitent à repenser le sens même de la conservation, incorporant y compris en ses forces les plus Vives quelque chose comme l'a-Mort. En définitive, les concepts issus de la recherche en biologie cellulaire et l'interprétation épistémologique et philosophique qu'il est possible d'en donner ne concernent pas exclusivement des processus et des entités cellulaires. Notre Vie déployée dans la connaissance, dans l'art ou dans l'amour de la Vie jusque dans la Mort, répond, elle aussi, d'une telle équivocité. (shrink)

L'homme ne se rapporte droitement a lui-meme qu'en se rapportant a la totalite du monde qui l'entoure. Ce monde qui est unique selon Platon, sans qu'il soit double par le monde intelligible dont parlera le neoplatonisme, est rendu possible par la rencontre de l'intelligible et du sensible. Ainsi, le logos, par quoi l'homme a acces aux Formes, est ce qui permet d'operer la deliaison proprement philosophique du corps et de l'ame, selon les termes du Phedon, sans qu'il faille poser un (...) dualisme cosmique qui se retrouverait dans l'homme. De meme que le sensible s'intelligibilise par la Participation et ainsi se maintient comme phenomene stable, de meme l'homme peut avoir un usage harmonieux de son corps et de ses sensations. Deliaison n'est pas rupture. L'enfance, la sexuation, le sommeil, les reves, la mort et la parole, ici interroges, montrent que l'anthropologie de Platon ne condamne ni le plaisir, ni le corps. La vie de la pensee ne s'absente pas des mouvements corporels qu'elle accompagne. C'est pourquoi le corps est le signe de l'ame. (shrink)

Retrace l'histoire du néant en Occident en étudiant ses étapes décisives et ses principales désignations.

Toutes les democraties egalitaires, detribalisees et secularisees d'Occident sont confrontees aux memes defis du communautarisme et de la reislamisation d'une partie de l'immigration - accrus par un continuel afflux de clandestins : le probleme de l'integration se pose donc moins en termes franco-francais de Republique que plus globalement de societe ouverte. Dans la perspective de Karl Popper et en usant de la liberte d'esprit et de parole chere a Jean-Francois Revel, il s'agit ici, a partir des faits, de montrer que (...) cette situation critique resulte d'abord de la forfaiture morale et parfois juridique de politiques qui n'ont pas voulu faire respecter ledroit commun democratique. Mais, surtout et en amont, de l'emprise d'une ideologie pretendument antiraciste, sans-frontieriste et acquise au relativisme multiculturel qui a perverti les valeurs de tolerance et d'ouverture: en elle se retrouvent les veritables et paradoxaux nouveaux ennemis de la societe ouverte. Faisant grand cas de l'emergence d'une resistance intellectuelle de tradition anti-totalitaire a cette bien-pensance et du combat emancipateur des musulmans libres, cette reflexion pointe le pathos masochiste qui fait oeuvrer les societes ouvertes contre elles-memes. This book addresses current practices in customary law. It includes contributions by scholars from various legal systems (the USA, France, Israel, Canada et cetera), who examine the current impacts of customary law on various aspects of private law, constitutional law, business law, international law and criminal law. In addition, the book expands the traditional concept of the rule of law, and argues that lawyers should not narrowly focus on statutory law, but should instead pay more attention to the impact of (...) practices on "real legal life." It states that the observation of practices calls for a stronger focus on usage, customs and traditions in our legal systems - the idea being not to replace statutory law, but to complement it with customary observations. In popular culture psychopaths are inaccurately portrayed as serial killers or homicidal maniacs. Most real-world psychopaths are neither killers nor maniacs. Psychologists currently understand psychopathy as an affective disorder that leads to repeated criminal and antisocial behavior. Counter to this prevailing view, I claim that psychopathy is not necessarily linked with criminal behavior. Successful psychopaths, an intriguing new category of psychopathic agent, support this conception of psychopathy. I then consider reactive attitude theories of moral responsibility. Within this tradition, psychopaths are (...) thought to be blameless as a result of their pronounced affective deficits. Psychopaths are considered morally blind because they lack the moral emotions that make us sensitive to moral reasons. I argue that, even if they are morally blind, psychopaths remain open to forms of blame stemming from non-moral reactive attitudes. These reactive attitudes remain appropriate because psychopaths can express hateful, disgusting, or contemptible non-moral values in their judgments. (shrink)

On a souvent résumé la présence importante des avocats dans la vie politique française sous la III e République à travers l’expression de « République des avocats. » De manière plus complexe, il s’agit de montrer comment les avocats sont au cœur, dans les premières décennies de la République, de la construction d’un champ politique marquée par la codification des règles électorales et une certaine démocratisation du personnel politique. Dans les décennies qui suivent, on note une diversification des formes d’investissement (...) du barreau en politique, moins marqué par l’investissement dans le champ politique proprement dit que par l’engagement à travers la défense judiciaire de causes.
