Insights into the problem of our relation to language Kenneth Burke and Contemporary European Thought: A Rhetoric in Transition reflects the present transitional nature of rhetoric and society. In this paper I'm interested in the prospects for the Right Reasons theory of creditworthiness. The Right Reasons theory says that what it is for an agent to be creditworthy for X-ing is for that agent to X for the right reasons. The paper has a negative goal and a positive goal. The negative goal is to show that a class of Right Reasons theories are doomed. These theories all have a Conceptualization Condition on acting for the right reasons. (...) Conceptualization Conditions demand that agents who act for the right reasons deploy or be able to deploy certain normative concepts in acting. I argue that views of this type run into a host of overintellectualization problems. Recientemente, son muchos los trabajos que han aparecido en el área de la psicología y de la ciencia cognitiva con el propósito de analizar las maneras de razonar y las capacidades intelectuales de sujetos diagnosticados como autistas. Tal es el caso de una investigación de McKenzie, Evans y Handley. Nosotros revisamos en este trabajo su investigación y sostenemos que contiene problemas metodológicos. Así, tratamos de mostrar cuáles son dichos problemas y proponemos la estructura que, a nuestro juicio, deberían tener experimentos (...) futuros en la misma línea y con el mismo objetivo. Recurrimos, igualmente, al concepto de neurodiversidad para apoyar nuestro enfoque y para defender que los resultados de McKenzie, Evans y Handley pueden ser interpretados de diversas maneras y en función de distintos marcos teóricos. Recently, many papers have been presented in the area of cognitive science and psychology in order to analyze modes of reasoning and intellectual abilities in individuals diagnosed as autistic. Such is the case of a research by McKenzie, Evans and Handly. In this paper, I review that research and argue that contains methodological problems. So, I try to show what these problems and hold that future experiments in the same way and with the same objective should be another structure. I focus equally on the concept of neurodiversity to support my approach and hold the outcomes presented by Mckenzie, Evans and Handly can be interpreted in different ways and according to various theoretical approaches. This paper argues that intellectual property rights are incompatible with Rawls’s principles of justice. This conclusion is based upon an analysis of the social stratification that emerges as a result of the patent mechanism which defines a marginalized group and ensure that its members remain alienated from the rights, benefits, and freedoms afforded by the patent product. This stratification is further complicated, so I argue, by the copyright mechanism that restricts and redistributes those rights already distributed by means of (...) the patent mechanism. I argue that the positions of privilege established through both the patent and the copyright mechanisms are positions that do not “allow the most extensive liberty compatible with a like liberty for all.” They do not “benefit the least advantaged.” Nor are they “open to all under conditions of fair equality of opportunity.” In making this argument I critically assess the utilitarian defense of intellectual property rights and find it insufficient to respond to the injustices manifest in our current arrangement for the protection of intellectual property rights. Amongst the multiple key philosophers who have addressed critical issues pertaining to music education since the mid-1900s, Bennett Reimer was one voice that began a systematic examination of the nature and value of music and music education as a foundation for a philosophy of music education. With the musical experience at the center of his philosophy, Reimer sought to explain how music articulates feeling, a core of who we are as human beings. In Intellectual Life in the Ḥijāz before Wahhabism, Naser Dumairieh argues that, as a result of changing global conditions facilitating the movement of scholars and texts, the seventeenth-century Ḥijāz was one of the most important intellectual centers of the Islamic world, acting as a hub between its different parts. Positioning Ibrāhīm al-Kūrānī (d. 1101/1690) as representative of the intellectual activities of the pre-Wahhabism Ḥijāz, Dumairieh argues that his coherent philosophical system represents a synthesis of several major post-classical (...) traditions of Islamic thought, namely kalām and Akbarian appropriations of Avicennian metaphysics. In “Conditions and Analyses of Knowledge”, Robert Shope focuses on the conditions that must be satisfied for a person to have knowledge, specifically knowledge that something is so. Traditionally, knowledge has been analyzed in terms of justified true belief. Shope addresses philosophers’ disagreements concerning the truth and belief conditions. After introducing the justification condition, he presents challenges that have provoked several attempts to replace or to supplement the justification condition for knowledge. Frederich Engels (1820-1895) was a German businessman and political theorist renowned as one of the intellectual founders of communism. In 1842 Engels was sent to Manchester to oversee his father's textile business, and he lived in the city until 1844. This volume, first published in German in 1845, contains his classic and highly influential account of working-class life in Manchester at the height of its industrial supremacy. Engels' highly detailed descriptions of urban conditions and contrasts between the different classes (...) in Manchester were informed from both his own observations and his contacts with local labour activists and Chartists. Extensively researched and written with sympathy for the working class, this volume is one Engels' best known works and remains a vivid portrait of contemporary urban England. I present an account of an aspect of people’s intellectual characters that has yet to receive such direct treatment in the literature on the intellectual virtues. That aspect is our capacity to influence others in ways that make inquiry go more successfully, which I call “intellectual charisma”. In presenting this account, I first draw on work in empirical psychology to build a partial picture of intellectual charisma as a social-psychological phenomenon. I then draw on this partial (...) picture in defining intellectual charisma, explaining some important features of it, and making the case that it meets some important conditions for qualifying as an intellectual virtue. I conclude by first discussing some of the ways that including intellectual charisma within our overall picture of the intellectual virtues changes that picture, and then outlining some of the benefits that result from those changes. This chapter argues for three related points. First, answerability is the key to intellectual autonomy. However, in order to enjoy that status that befits an intellectually autonomous subject, other epistemic subjects must also recognize that one is answerable for one’s believing. Second, systemic conditions of social oppression impede recognition since they promote situations in which members of oppressed groups are disabled in their attempts to make themselves answerable for their believing. In this important new book, the leading philosopher François Laruelle examines the role of intellectuals in our societies today, specifically with regards to criminal justice. He argues that, rather than concerning themselves with abstract philosophical notions like justice, truth and violence, intellectuals should focus on the human victims. Drawing on his influential theory of ‘non-philosophy’, he shows how we can submit the theorizing of intellectuals to the scrutiny of the everyday suffering of the victims of crime. While philosophy consistently takes the voice away from victims of suffering, non-philosophy is able to construct a theory of violence and crime that gives voice to the victim. An inclusive survey from Frederick Douglass to the voices of Black Lives Matter.

This paper addresses an apparent dilemma that must be resolved in order to respond ethically to global climate change. The dilemma can be presented as follows. Responding ethically to global climate change requires technological innovation that is accessible to everyone, including inhabitants of the least developed countries. Technological innovation, according to many, requires strong intellectual property protection, but strong intellectual property protection makes it highly unlikely that patent-protected technologies will be accessible to developing countries at affordable prices. Given (...) this, responding ethically to global climate change is highly unlikely. I argue that this apparent dilemma – which I call ‘the patent dilemma in global climate change’ – should be taken seriously. I discuss a number of possibilities for resolving it, and I argue that any acceptable strategy must satisfy the criteria of near-term feasibility and non-paternalism. Finally, I propose a multi-pronged, multi-tiered strategy that meets these conditions. (shrink)

This essay offers a defense of ‘intellectual authority’, primarily by pointing out the untoward implications of its conceptual opposite, ‘institutional authority’, in a wide variety of contexts. An opening discussion explores conditions for the possibility of intellectual authority in legal, humanistic, and aesthetic disciplines. Social science literature documenting and describing the biasing influence of institutional authority is then canvassed and analyzed in some detail. The article analyzes an important concept of contemporary virtue epistemology – the concept of intellectual vice, that is a trait of intellectual character that hinders responsible research. The purpose of this article is to formulate a hypothesis that, today, in the modern culture, a significant part of epistemic vices are implicit attitudes. The first part of the article explores the concept of implicit attitude, examines examples of implicit attitudes that have become widespread in the research literature: implicit sexism (...) and racism. The second part of the article shows that in cases of implicitly biased behavior there is a manifestation of epistemic vice, and that the “motivational” theory based on Zagzebski’s ideas cannot explain the manifestation of intellectual vice in cases of implicit bias. In the third section of the article, it is demonstrated that implicit attitudes can be traits of the agent’s character : they can be acquired, rooted in the personality, and can be corrected. The fourth paragraph of the article analyses the conditions under which intellectual vices can be explicit attitudes. It is possible if the agent is a diabolical being, has egoistic vices, or is irrational. In the final section, it is shown that the spread of critical thinking in modern society should lead to the transition of intellectual vices from explicit attitudes to implicit ones. The conclusion is made about the theoretical and practical significance of the hypothesis under discussion. From a theoretical point of view, it allows us to explain why intellectual vices are widespread and difficult to eradicate, to place vices as character traits between the local and global levels, to apply to the concept of epistemic vice all the research concerning implicit attitudes, to develop a theory of epistemic responsibility. In practical terms, this hypothesis can be used to analyze the manifestations of implicit vices in various spheres. (shrink)

Engaging a listener’s trust imposes moral demands upon a presenter in respect of truthtelling and completeness. An agent lies by an utterance that satisfies what are herein defined as signal and mendacity conditions; an agent deceives when, in satisfaction of those conditions, the agent’s utterances contribute to a false belief or thwart a true one. I advert to how we may fool ourselves in observation and in the perception of our originality. Communication with others depends upon a convention or practice (...) of presumed nonuniversal truthfulness. In support of an asserted duty of nondeceptiveness, I offer a reconciliation of pertinent Kantian passages, a sketch of arguments within utilitarianism, contractarianism, and other views, and an account arguing for application of that duty to assertions, implicatures, omissions, equivocation, prevarication, and sophistry insofar as they affect listeners’ doxastic states. For scholarship, this duty is exceptionless. I describe the kernel of intellectual honesty as a virtuous disposition such that when presented with an incentive to deceive, the agent will not deceive. Intellectual honesty delivers candor when it counts. I contrast this with complementary virtues and the surpassing virtue of ingenuousness. An account is given of the connection between intellectual honesty and an influential physical model of integrity. (shrink)

The state of national economies development varies and is characterized by many indicators. Economically developed countries are known as doubtless leaders that are in progress and form political stability, social and economics standards, scientific and technical progress and determine future priorities. It is worth mentioning that the progressive development of national economies in conditions of globalization can take place only in case of the increase of their intellectualization level, through saturation of people`s life, economic relations and production by brain activity, (...) knowledge, creativity, innovation, culture, ethical considering of the historical heritage. The main aim of the research is national economies intellectualization evaluating in globalization conditions. In order to gain this aim, the following tasks were defined: to identify existing indices of the national economies intellectualization level evaluation, develop the authors’ methodological approach to the national economies intellectualization level, determine the areas of measurement results application. While conducting the research, systematic approach, the methods of analysis, synthesis, grouping, abstracting, generalization, imaginary experiment and grounding were used. In the modern world, there are a large number of indicators which characterize differences in intellectual state of the national economy. When comparing the state of national economies intellectualization, the problems arise with different number of countries, duplication of indicators, disproportionate number of the components of indicators, various years of publication, etc. Therefore, to ensure comparability, we choose four general indicators – the index of human development, the global innovation index, the global competitiveness index and the knowledge economy index. Using these indices, we do the research and determine the state of national economies intellectualization in the world economy. According to the calculated results, as of 2013, we have divided 190 national economies by level of intellectualization into five groups: countries with the highest (30 countries), high (30 (countries), low (30 countries), the lowest (35 countries) and the countries with uncertain state of intellectualization (65 countries). The leaders in the state of intellectualization are Switzerland, Sweden, The Netherlands, Finland and the USA. The countries with the highest level of intellectualization serve as an example to all other countries of the world. These countries are characterized by developed market economy; a dominant position in the international economy, which allows actively engaging own and imported resources in the economic turnover; the shift of the center of gravity of economic activity into the services sector and the dominance of service economy; the greatest exhaustion of sources and factors of industrial development; advanced post-industrial development. The economic policy of the first group of countries has a decisive influence on the state and dynamics of the global economy, defining the main directions of its scientific and technological development and structural adjustment. The average index of the national economy intellectualization (AINEI), calculated by the authors, shows the place of each country in the world community as to their intellectual capital. Considering the continued deployment of R&D progress, the growing role of high-tech production and the complexity of social and economic relations, AINEI can serve as a reliable indicator of the macroeconomic environment intellectualization state. Therefore, the following organizations, bodies and individuals can use the comparative results of this study: the international organizations while developing international economic development programs; the state authorities of the countries in foreign and domestic policy forming; companies that create innovative and investment policy; migrants, tourists and persons who perform professional and transit activity for the formation of human potential and capital; scientists and teachers who develop mechanisms of intellectualization. In the context of the global intellectualization, human capital is the determining factor in the innovation development and the international competitiveness of countries. In the XXI century. the leading component of human capital are qualitatively new information, communication and network technologies. Particular importance are education and training, professionalism, high level of human resources management, building up, reproduction and human capital development. These factors are the prerequisite for the growth of the competitive advantages of the country in the conditions of globalization.

In the article, the author shows how the government and the opposition interact in the political process. Actors representing opposition constantly produce political texts illustrating their alternative views. The existence of the opposition subject in a critical state in regards to the existing institutions of power is historically predetermined, which proves an active reflection from prominent theorists of political thought. A free dialogue of the government and the opposition is hardly possible in every single political system. In the case of (...) totalitarian and authoritarian regimes, this dialogue may be difficult. The consequences of free will for the subject of opposition can be quite severe. The author analyzes the political discourse of opposition as exemplified by the Soviet culture. The author is interested in the metaphors of opposition and their political context, which seems to be an inevitable condition and framework limiting creativity of one or another intellectual. The author studies a number of texts of the Soviet culture representatives, who used metaphors of opposition, and had a reputation of troublemakers. Such position of an intellectual generates sanctions of the repressive machine and predetermines very specific forms of presenting texts of opposition and apophasis. For decades, intelligence and achievement tests have registered significant differences between people of different races, ethnicities, classes, and genders. We argue that most of these differences are explained not as reflections of differences in the distribution of intellectual virtues but as evidence for the metacognitive mediation of the intellectual virtues. For example, in the United States, blacks typically score worse than whites on tests of mathematics. This might lead one to think that fewer blacks possess the relevant (...) class='Hi'>intellectual virtues, or that they possess them less fully. However, research on stereotype threat shows that when blacks are not reminded of their race, they do much better on these tests than when they are. Simply raising to salience the race of the student triggers the activation of the stereotype, which in turn leads to poorer performance. However, learning about stereotype threat to a large extent immunizes people against it. This suggests that the psycho-social dimension of intelligence that recognizes the possibility of effects like stereotype threat is a crucial mediating variable in the development and expression of the intellectual virtues. The Socratic, “Know thyself” needs to be expanded to, “Know thyself and thy society.” Self-knowledge and knowledge of relevant stereotypes are a necessary condition for optimal development and expression of the other intellectual virtues. We call such conditionals contrary to time conditionals.Three main aspects will be investigated: Inverse causality from future to past, where a future condition can influence a legal event in the past (this is a man made causality).Comparison with similar features in modern law.New types of temporal logics (...) arising from modelling the Talmudic examples. The seriousness of the COVID-19 pandemic requires a look into the implementation of drug registration rules for COVID-19 vaccines. Amidst the surrounding exigencies, vaccines being a biological product, require comprehensive and continuing pre and post registration rules to ensure their safety and efficacy. The study focuses on Malaysia which has rules on drug registration that have been successfully applied to vaccines. The study shows that the rules have been tailor-made to emergency situations. At the moment, special rules have been introduced (...) including to allow use of COVID-19 vaccines as unregistered product. Recognition of COVID-19 Vaccines Global Access (COVAX) facility and requirement for government sale only, are among the safety valves. The study shows that these however are temporary measures against the backdrops of possible entry of private players in the vaccination process. Therefore, regulatory responses to intellectual property (IP) related conditions underlying drug registration, and measures to ensure risk management involved in vaccine production, approval and administration are needed in the progressive rules pending further development of research in the area. This intellectual biography provides an organic framework for understanding Antonio Gramsci’s process of intellectual development, paying close attention to the historical and intellectual contexts out of which his views emerged. The Gramsci in Notebooks cannot fully account for the young director of L’Ordine Nuovo, or for the communist leader. Gramsci’s development did not occur under conditions of intellectual inflexibility, of absence of evolution. However, there is a strong thread connecting the “political Gramsci” with Gramsci as a (...) “cultivated man.” The Sardinian intellectual’s life is marked by the drama of World War I, the first mass conflict in which the great scientific discoveries of the previous decades were applied on a large scale and in which millions of peasants and workers were slaughtered. In all of his theoretical formulations, this dual relation, which epitomizes the instrumental use of “simpletons” by ruling classes, goes beyond the military context of the trenches and becomes full-fledged in the fundamental relations of modern capitalist society. In contrast with this notion of social hierarchy, which is deemed natural and unchangeable, Gramsci constantly affirmed the need to overcome the historically determined rupture between intellectual and manual functions, due to which the existence of a priesthood or of a separate caste of specialists in politics and in knowledge is made necessary. It is not the specific professional activity (whether material or immaterial) that determines the essence of human nature: to Gramsci, “all men are philosophers.” In this passage from Notebooks, we find the condensed form of his idea of “human emancipation,” which is the historical need for an “intellectual and moral reform”: the subversion of traditional relations between rulers and ruled and the end of exploitation of man by man. Michael Smith’s The Moral Problem gives an admirably straightforward condition for moral rightness: an act is morally right in circumstance C only if under conditions of full rationality we would all want to perform that act. I will assume that this condition, if met, would make acts objectively right and therefore vindicate a robust form of metaethical realism. There remains the question, however, of whether this condition can be met. Smith considers several arguments that it cannot, and (...) this paper will argue that his response to one of them— Gilbert Harman’s “successful criminal” argument—is inadequate. Clear and straightforward as it is, Smith’s condition for moral rightness is deceptively strong for it requires a full convergence of desires. It appears that moral facts can exist only if there is unanimous agreement about how we would want to behave if we were fully rational. The unanimity requirement leaves Smith vulnerable to sensible knave style objections. Most importantly, the criminal’s disregard of outsiders is not due to inattention, failure to consider or appreciate certain arguments, ignorance of relevant evidence, errors in reasoning, irrationality, unreasonableness, or weakness of will. Intellectual leadership indicates the informal leadership of professors based on aspects such as knowledge production and dissemination, institutional services, and public engagement. Academic freedom is considered as the overarching condition for individual academics to develop intellectual leadership. Against the backdrop of internationalisation and globalisation of higher education, academics face enormous pressures to produce measurable research outputs, deliver high-quality teaching and meet all kinds of institutional requirements. In modern universities, women scholars, as the non-traditional participants in academia, must (...) tackle with multiple obstacles and bias brought by gender intertwined with academic discipline features, higher education institutions, and sociocultural characteristics. How do women professors protect, negotiate, or strive for academic freedom? Situated in higher education in Hong Kong, this article aims to explore how epistemological norms, institutional management, and gender influence women scholars’ academic freedom. The author has analysed how sixteen established women professors in humanities and social sciences augmented freedom using the cumulative advantage theory. The study finds that women scholars in different sub-groups within HSS had mixed views about freedom and developed diverse patterns to seek freedom for intellectual leadership. (shrink)

Genesis of the scientific ideas and views on intellectual capital is characterized by various approaches highlighting the role of knowledge, skill and professional employees as a form of productive capital. This tendency is mostly revealed at the present stage of economic science development in transiting to an information society. In these conditions the holistic study of intellectual capital requires an expansion of the methodological research base using the evolutionary theory of economic development of the world community, general theory (...) of complex systems, theory of informational economics and other disciplines. Moreover, in Russia there are a number of problems associated with creating a necessary institutional and regulatory environment for protecting the intellectual property. According to the authors, the study of the intellectual capital is necessary from the institutional analysis perspective, as it allows to more accurately determine the current state of the legal status of intellectual assets in the economic activity of an enterprise. In The Scientific Intellectual, Lewis S. Feuer traces the evolution of this new human type, seeking to define what ethic inspired him and the underlying emotions that created him. Under the influence of Max Weber the rise of the scientific spirit has been viewed by sociologists as an offspring of the Protestant revolution, with its asceticism and sense of guilt acting as causative agents in the rise of capitalism and the growth of the scientific movement. Feuer takes strong issue (...) with this view, pointing out how it is at odds with what we know of the psychological conditions of modern societies making for human curiosity and its expression in the observation of and experiment with nature. This chapter will argue that due to a lack of genuine consent, some of Russell’s practices in his romantic/sexual relationships are morally objectionable according to his own normative theory (utilitarianism) and these practices are intellectually objectionable according to his post-1913 meta-ethics (expressivism) and his understanding of rationality. On utilitarian grounds, Russell’s actions would maximize pleasure and minimize pain for all the parties affected by the relationship if the authenticity of his partners’ consent were maintained either by a more or less (...) equal social and political standing of the partners or, failing that, by the powerful partner’s exercise of the virtue of restraint; neither of these conditions was satisfied in Russell’s relationships with Vivien Eliot or Helen Dudley. On expressivist grounds, the expressions of desires upon which Russell’s romantic/sexual practices were based, such as the disregard for the humanity of women, conflict with his calls for world peace based on a concern for the well-being of humanity. Our aim in this paper is to argue that empathy is an intellectual virtue. Empathy enables agents to gain insight into other people’s emotions and beliefs. The agent who possesses this trait is: (i) driven to engage in acts of empathy by her epistemic desires; (ii) takes pleasure in doing so; (iii) is competent at the activity characteristic of empathy; and, (iv) has good judgment as to when it is epistemically appropriate to engage in empathy. After establishing that empathy (...) meets all the necessary conditions to be classified as an intellectual virtue, we proceed to discuss Battaly’s argument according to which empathy is a skill rather than a virtue. We contend, contra Battaly, that the agent who possesses the virtue of empathy: (a) sometimes foregoes opportunities to engage in the activity characteristic of empathy because it is the virtuous thing to do, (b) does not make deliberate errors, and (c) her actions are always ultimately aiming at epistemic goods. Descartes maintains that we can love God and that it is pleasant and morally beneficial to do so. In this essay, I examine the necessary conditions for such an intellectual love of God. I argue that the intellectual love of God is incited by a judgment that we are joined to God in reality, which is constitutive of an intellectual joy. The Paradox of Intellectual Property in Capitalism is an innovative book that comprehensively discusses and analyses intellectual property under capitalistic social conditions and relations. It not only addresses some historical developments of intellectual property but also brings to the fore the very notion of what knowledge is, knowledge creation, and knowledge production and appropriation within a Marxist framework. Nonetheless, the adopted approach pays heed to multiple fields of knowledge, providing rich discussions that facilitate the understanding of actual (...) social totality in which capitalism, knowledge production and appropriation, and the struggles of appropriation mutually reinforce each other, although not devoid of antagonisms and contradictions. In light of contemporary capitalism, the transformations that social property relations are undergoing must be scrutinised – such as those brought about by the development of digitalisation and the convergence between big pharma and tech giants. What are the conditions of intellectual property creation today? What theoretical assumptions does it make? Under what social relations is intellectual property produced? Throughout, the emphasis is not on individual cases or symptoms but on the overarching logic: the logic of capitalism as revealed in intellectual property. (shrink)

Patients can be harmed by a religiously motivated surrogate decision maker whose decisions are contrary to the standard of care; therefore, surrogate decision making should be held to a high standard. Stewart Eskew and Christopher Meyers proposed a two-part rule for deciding which religiously based decisions to honor: (1) a secular reason condition and (2) a rationality condition. The second condition is based on a coherence theory of rationality, which they claim is accessible, generous, and culturally sensitive. (...)
