Modern states claim rights of jurisdiction and control over particular geographical areas and their associated natural resources. Boundaries of Authority explores the possible moral bases for such territorial claims by states, in the process arguing that many of these territorial claims in fact lack any moral justification. The book maintains throughout that the requirement of states' justified authority over persons has normative priority over, and as a result severely restricts, the kinds of territorial rights that states can justifiably claim, and (...) it argues that the mere effective administration of justice within a geographical area is insufficient to ground moral authority over residents of that area. The book argues that only a theory of territorial rights that takes seriously the morality of the actual history of states' acquisitions of power over land and the land's residents can adequately explain the nature and extent of states' moral rights over particular territories. Part I of the book examines the interconnections between states' claimed rights of authority over particular sets of subject persons and states' claimed authority to control particular territories. In this book, Alan Berger further develops the new theory of reference -- as formulated by Kripke and Putnam -- applying it in novel ways to many philosophical problems concerning reference and existence. Berger argues that his notion of anaphoric background condition and anaphoric links within a linguistic community are crucial not only to a theory of reference, but to the analysis of these problems as well. The book is organized in three parts. In part I, Berger distinguishes between (...) two styles of rigid designation. Based on this distinction, he develops a theory of reference change for rigid designator terms and shows how this distinction sheds light on identity statements. In part II, he offers an account of belief attribution containing vacuous names within the belief context, of intentional identity statements, and of true negative existential statements. Alan Bailey offers a clear exposition and defence of the philosophy of Sextus Empiricus, one of the most influential of ancient thinkers, the father of philosophical scepticism.

There is a traditional conception of sensory experience on which the experiences one has looking at, say, a cat could be had by someone merely hallucinating a cat. Disjunctivists take issue with this conception on the grounds that it does not enable us to understand how perceptual knowledge is possible. In particular, they think, it does not explain how it can be that experiences gained in perception enable us to be in ‘cognitive contact’ with objects and facts. I develop this (...) chal- lenge to the traditional conception and then show that it is possible to accommo- date an adequate account of cognitive contact in keeping with the traditional conception. One upshot of the discussion is that experiences do not bear the explanatory burden placed upon them by disjunctivists. (shrink)

There is a tendency in current philosophical thought to treat sensory experiences as a peculiar species of propositional attitude. Alan Millar argues against this view. While allowing that experiences may in some sense bear propositional content, he presents a view of sensory experiences asa species of psychological state. He applies the resulting analytical framework to a discussion of justified belief, dealing, firstly, with how beliefs may derive justification from other beliefs, and secondly, with how current sensory experiences may contribute (...) to the justification of a person'sbeliefs. A key theme in his general approach is that justified belief results from the competent exercise of conceptual capacities, some of which involve an ability to respond appropriately to current experience. In working out this approach the author develops a view of concepts and theirmastery, explores the role of groundless beliefs drawing on suggestions of Wittgenstein, illuminates aspects of the thought of Locke, Hume, Quine, and Goldman, and finally offers a response to a sophisticated variety of scepticism. Using the context of controversies surrounding evolutionary developmental biology (EvoDevo) and the possibility of an Extended Evolutionary Synthesis, I provide an account of theory structure as idealized theory presentations that are always incomplete (partial) and shaped by their conceptual content (material rather than formal organization). These two characteristics are salient because the goals that organize and regulate scientific practice, including the activity of using a theory, are heterogeneous. This means that the same theory can be structured differently, in part because (...) theory presentations (as idealizations) intentionally depart from different features known to be present in a theory. Since there are diverse and potentially incompatible theory structures derived from heterogeneous goals found in scientific practices, a question arises about the absence of a unifying theory structure in the background. The notion of a “theory façade” offers a fruitful perspective on this potentially unsettling result. (shrink)

It is argued that seeing that P is a mode of knowing that P that is to be explained in terms of the exercise of visual-perceptual recognitional abilities. The nature of those abilities is described. The justification for believing that P, when one sees that P, is provided by the fact that one sees that P. Access to this fact is explained in terms of an ability to recognize of seen objects that one is seeing them. Reasons for resistance to (...) such an account are considered. This book, first published in 1987, investigates what distinguishes the part of human behaviour that is action from the part that is not. The distinction was clearly drawn by Socrates, and developed by Aristotle and the medievals, but key elements of their work became obscured in modern philosophy, and were not fully recovered when, under Wittgenstein’s influence, the theory of action was revived in analytical philosophy. This study aims to recover those elements, and to analyse them in terms of a (...) defensible semantics on Fregean lines. Among its conclusions: that actions are bodily or mental events that are causally explained by their doers’ propositional attitudes, especially by their choices or fully specific intentions; that choice cannot be reduced to desire and belief, and hence that the traditional concept of will as intellectual appetite must be revived. The prospect for widespread therapeutic use of human fetal tissues has aroused strong emotions and prompted several objections. Fetal tissue transplantation circumscribed by medical and moral limits will not erode important ethical values, but the pace of scientific research must not preempt public debate and a verdict consistent with societal values.

Sustainable investment, which integrates social, environmental and ethical issues, has grown from a niche market of individual ethical investors to embrace institutional investors resulting in £764 billion in assets under management in the UK alone [Eurosif, 2008: ‘European SRI Study 2008’ ]. Explaining this growth is complex, involving shifts in personal and collective values, reactions to corporate scandals, scientific and media pronouncements about climate change, Government initiatives, responses from financial markets and the influence of SI innovators in The City of (...) London. The article examines the influence of human agency through interviews with 14 SI champions who have variously been responsible for launching SI funds and changing investment processes and organisational structures in order to enhance SI. Interviewees were asked about their motivations and persuasive strategies, the obstacles they faced and how they overcame them as well as broader implications of SI for financial markets. The following key categories inform the results and the discussion: Values; Conservatism, Antipathy and Incredulity; Optimism and Sympathy from Insiders; The Social and Political Context; The Business Case; Organisational Constraints; Inappropriate forms of Remuneration; Short-termism; The Nature of Capitalism. Three discourses were also identified. The first is the necessity to make a business case for SI; the second is the benefits that SI can bring to the quest of overcoming short-termism; the third is a belief that for SI to have a significant influence, greater government intervention is required. In recent years, major disasters have figured prominently in the media. While corporate response to disasters may have raised corporate philanthropy to a new level, it remains an understudied phenomenon. This article draws on comparative research on corporate social responsibility (CSR) and corporate philanthropy to explore the geography of corporate philanthropic disaster response. The study analyzes donation announcements made by Fortune Global 500 firms from North America, Europe and Asia to look for regional patterns across three recent disasters: the South (...) Asian Tsunami, Hurricane Katrina, and the Kashmiri earthquake. The results reveal inter-regional differences in the overall likelihood of donations and in their cash value, in addition to the identification of home-region- and local presence effects. Implications for researchers and practitioners are discussed. (shrink)

The broader context for the formal darwinism project established by two of the commentators, in terms of reconciling the Modern Synthesis with Darwinian arguments over design and in terms of links to other types of selection and design, is discussed and welcomed. Some overselling of the project is admitted, in particular of whether it claims to consider all organic design. One important fundamental question raised in two commentaries is flagged but not answered of whether design is rightly represented by an (...) optimisation program, and another from one commentary of whether the coreplicon dissolves in the face of multi-generational imprinting. Calls for the project to be extended to design at levels above and below the individual are considered sympathetically, but judged impractical at the high level of abstraction of the project. All claims of substantive technical error are emphatically rejected. Close technical readings are welcomed that, among other things, represent the project as 'axiomatizing fitness'. The prospects for the project are set out in the light of this highly varied set of commentaries. (shrink)

In this essay I will argue, as does Bernard Williams, that lying and misleading are both commonly wrong because they involve an aim to breach a trust. I will also argue, contrary to Williams, that lying and misleading threaten trust differently, and that when they are wrong, they are wrong differently. Indeed, lying may be wrong when misleading is not.

It appears to have been established that it is not possible for us to harm distant future generations by failing to adopt long-range welfare policies which would conserve resources or limit pollution. By exploring a number of possible worlds, the present article shows, first, that the argument appears to be at least as telling against Aristotelian, rights-based and Rawlsian approaches as it seems to be against utilitarianism, but second, and most importantly, that it only holds if we fail to view (...) moral agents as individuals. The article also concludes that the argument has profoundly counter-intuitive implications. (shrink)

Occupational fraud frequently involves the direct or indirect participation of professional accountants. To reduce fraud, companies often focus on the incentive/pressure and opportunity legs of the fraud triangle, perhaps believing that rationalization is beyond their control. We argue that rationalization reduction is necessary to minimize occupational fraud. We propose that educators and PA consider incorporating fences as controls to reduce rationalization. Because they focus on compliance and risk avoidance and are non-negotiable, fences appeal to accountant’s Myers Briggs personalities and conventional (...) level of moral development. Educators can teach students about the fences used in practice, and explain how they help new professionals resist pressures and temptations. By adding fences to existing professional guidance, accountants can reduce the likelihood that they will be a party to fraud. (shrink)

The second issue relates to the unwillingness of the interviewees to give voice to their concerns, not only externally, but also within their employing organisations. This paper outlines the background and significance of philosophy of technology as a focus of inquiry emerging within nursing scholarship and research. The thesis of the paper is that philosophy of technology and nursing is fundamental to discipline development and our role in enhancing health care. It is argued that we must further our responsibility and interest in critiquing current and future health care systems through philosophical inquiry into the experience, meaning and implications of technology. This paper locates nurses as (...) important contributors to the use and integration of health care technology and identifies nursing as a discipline that can provide specific insights into the health experience of individuals, cultures and societies. Nurses are encouraged to undertake further examination of epistemological, ontological and ethical challenges to arise from technology as a focus of philosophical inquiry. The advancement of philosophy of technology and nursing will make a profound contribution to inquiry into the experience of technology, the needs of humanity and the development of appropriate health care. Free marketeers claim that theirs is the only economic mechanism which respects and furthers human freedom. Socialism, they say, has been thoroughly discredited. Most libertarians treat the state in anything other than its minimal, 'nightwatchman' form as a repressive embodiment of evil. Some reject the state altogether. But is the 'free market idea' a rationally defensible belief? Or do its proponents fail to examine the philosophical roots of their so-called freedom? Anti-libertarianism takes a sceptical look at the conceptual tenets of (...) free market politics. This article addresses the question of what it is that visual depictions of illness portray, particularly images executed by or on behalf of people who have suffered serious illness. It takes up two lines of inquiry, both to do with the work that such pictures might perform. On the one hand, as works of art, there are questions about the form of signification in visual representations of this kind. On the other, as works of illness, there are issues concerning the (...) role of image-making for sufferers bearing witness to their situation. The article examines the issue of what it is to look at pictures of bodies scarred by treatment for serious disease, and follows this into questions about what it is possible and necessary to show in order to render illness experience tangible. By examining, as exemplars, two particular images of sufferers, it is argued that such portrayals work not just through making visible certain objects for scrutiny, but by figuratively instantiating persons so as to produce a `vision of the non-visual'. In this way picturing illness finds its place in what might be called a politics of care. (shrink)

An analysis of the collective engagement with the disease known as Alzheimer’s and the dementia reputed of it reveals recourse to a socially standardized formula that attributes causal agency to the brain in the absence of clinching knowledge. I propose that what Baudrillard calls the model of molecular idealism stipulates such a neurological view of determinism in order to provide caregivers with reassurance in the face of the perplexing character of dementia and the depressing reactions to mortality that it brings (...) to the surface. ABSTRACT Isaiah Berlin’s ‘Two Concepts of Liberty’ regards both Hobbes and Constant as supporting the negative version. Both took a favourable view of the freedom to live as one pleases. But this shared preference arose from radically different overall philosophies. Hobbes’s support for freedom as ‘the silence of the laws’ reflected his view of happiness as preference-satisfaction. Constant’s support for freedom as a sphere of absolute rights was supplemented by support for active citizenship and connected with belief in ‘perfectibility’ that (...) was itself linked to religion. These theories involve altogether different understandings of the image of an ‘area’ preserved from interference. Berlin takes over from Constant an appeal to human nature without the idea of progress that had supported it. (shrink)

In the 20th century, genetic explanatory approaches became dominant in both developmental and evolutionary biological research. By contrast, physical approaches, which appeal to properties such as mechanical forces, were largely relegated to the margins, despite important advances in modeling. Recently, there have been renewed attempts to find balanced viewpoints that integrate both biological physics and molecular genetics into explanations of developmental and evolutionary phenomena. Here we introduce the 2017 SICB symposium “Physical and Genetic Mechanisms for Evolutionary Novelty” that was dedicated (...) to exploring empirical cases where both biological physics and developmental genetic considerations are crucial. To further contextualize these case studies, we offer two theoretical frameworks for integrating genetic and physical explanations: combining complementary perspectives and comprehensive unification. We conclude by arguing that intentional reflection on conceptual questions about investigation, explanation, and integration is critical to achieving significant empirical and theoretical advances in our understanding of how novel forms originate across the tree of life. The concept of missed care refers to an irrefragable truth that required nursing care, which is left undone, occurs in the delivery of health care. As a technical concept, missed care offers nurses the opportunity to articulate a problematic experience. But what are we to make of missed care from an ethical perspective? Can nurses be held morally responsible for missed care? Ethically speaking, it is generally accepted that if a person has a moral obligation to do something, s/he needs (...) to have the capacity to do it. If a person does not have the capacity to fulfil a moral obligation, then s/he cannot be held responsible for failing to do so. This is captured by the “ought implies can” (OIC) principle. This paper brings the OIC principle to the forefront of the discussion on missed care. It is contended that nurses – qua moral agents – may be discharged from a moral obligation to carry out a required caring act because of some inability that is not of their making and therefore may not be morally responsible for missed care. However, the OIC principle may not be applied to all situations of missed care depending on their causes. In addition, following in the thought of Sapontzis (The Southern Journal of Philosophy, 1991, XXIX, 383–393) it is contended that when an original obligation to deliver a required act of care cannot be fulfilled, other obligations may be generated as summed up in the “Principle of Making Amends” and the “Principle of Appropriate Feeling.” It is the view of this paper that these further principles could prevent the OIC principle from being used to simply excuse omissions of care from a normative standard and could support the view that nurses continue to have alternative obligations to make amends and to respond with appropriate feelings to missed care. Probabilities figure centrally in much of the literature on the semantics of conditionals. I find this surprising: it accords a special status to conditionals that other parts of language apparently do not share. I critically discuss two notable ‘probabilities first’ accounts of counterfactuals, due to Edgington and Leitgeb. According to Edgington, counterfactuals lack truth values but have probabilities. I argue that this combination gives rise to a number of problems. According to Leitgeb, counterfactuals have truth conditions-roughly, a counterfactual is true (...) when the corresponding conditional chance is sufficiently high. I argue that problems arise from the disparity between truth and high chance, between approximate truth and high chance, and from counterfactuals for which the corresponding conditional chances are undefined. However, Edgington, Leitgeb and I can unite in opposition to Stalnaker and Lewis-style ‘similarity’ accounts of counterfactuals. (shrink)
