This article examines an omission in the study of discretionary time that bears on proposals currently being evaluated in this part of political philosophy. Specifically, this is the tendency in many jobs for work time to bleed into what is meant to be protected or discretionary time. I refer to this phenomenon as the relative proximity of labour and capital, which has become more prevalent in the labour market due to increased use of mobile communications technology. Ignored by the literature (...) is the fact that whether a job exhibits a high degree of proximity of labour and capital will influence workers' access to their discretionary time entitlements, including policies such as workplace flexibility and the four-day week. To account for this, I provide a descriptive and normative account of the proximity of labour and capital, in response to which I propose a remedial policy that provides workers with greater autonomy over how and when they take up their discretionary time entitlements. There is evidence for increase, followed by decline, in synaptic numbers during development. Dendrites do not function in isolation. A constructive neuronal process may underpin a selectionist cognitive process. The environment shapes both ontogeny and phylogeny. Phylogenetic natural selection and neural selection are compatible. Natural selection can yield both constructivist and selectionist solution to adaptuive problems.

Legal frameworks are in place to protect those who lack the capacity to consent to research, such as the Mental Capacity Act in the UK. Assent is sought instead from a proxy, usually a relative. However, the same legislation may, perversely, affect the welfare of those who lack capacity and of others by hindering the process of recruitment into otherwise potentially beneficial research. In addition, the onus of responsibility is moved from those who know most about the study (ie, the (...) scientific community) to those who know less (the proxies). In this paper, we describe the characteristics of a sample at different stages of the recruitment process of an influenza vaccine-based randomised control trial in elderly care home residents (the FEVER study). 62% (602/968) of potential subjects lacked capacity but only 29% (80/277) of those actually randomised. Older age, being female and living in an Elderly Mentally Ill care home were the only variables associated with lacking capacity. Considering this was a study based in a care home setting where the prevalence of dementia approximates 80%, the trial, like many others, was thus significantly biased. We believe that difficulties seeking proxy assent contributed significantly to this problem. Further thought should be given to how assent to enter research for those who lack capacity should be provided, and we suggest avenues for further discussion such as independent risk/benefit expert panels. A prevailing issue in clinical research is the duty clinicians have to treat or prevent the progression of disease during a study that they are conducting. While all clinical researchers have a duty of care for the patients who participate in clinical research, intervening at the onset or progression of disease may skew results and have a negative impact on the scientific validity of a study. Extreme examples of failures to intervene can be found in the Tuskegee syphilis study and (...) in an attempt to determine if cervical smears were an accurate predictor of cancer, which was uncovered by the Cartwright Inquiry. However, the issue arises in all research where delay in intervention can cause harm. A current study in Singapore is investigating the significance of an ‘ultra-high risk’ state that may constitute the prodromal phase of psychosis. This project called ‘The Longitudinal Youth at Risk Study’ is potentially contentious because it is recruiting young people who are identified as being ‘at risk’ of developing psychosis. In this paper, the decision to offer treatment to all participants as well as a fast track for those who are assessed to have developed serious mental illness into treatment is discussed. It is argued that this approach is ethically justified because of the duty of care that is owed to research participants, and suggests that the principle of equipoise may be used to guide intervention decisions in other clinical research protocols. In The Triumph of Practice over Theory in Ethics James Sterba is not concerned merely to show that there is much convergence in the practical application of Utilitarianism, Kantianism, and Aristotelian virtue ethics. His project is the much more ambitious one of arguing that the theories do not really diverge very much at the theoretical level, and thus supplying an explanation for the apparent convergence at the practical level. Although I applaud him for the boldness, some might even say (...) audacity, of the attempt, I do not think he succeeds. I focus my critique on Sterba’s use of two principles that are crucial to his arguments, the principle of non-question-beggingness, and the “ought implies can” principle. I also criticize his arguments for a biocentric position in his disagreement with Singer over the status of nonsentient life. (shrink)

Limited Aggregation is the view that when there are competing moral claims that demand our attention, we should sometimes satisfy the largest aggregate of claims, depending on the strength of the claims in question. In recent years, philosophers such as Patrick Tomlin and Alastair Norcross have argued that Limited Aggregation violates a number of rational choice principles such as Transitivity, Separability, and Contraction Consistency. Current versions of Limited Aggregation are what may be called Comparative Approaches because they involve assessing (...) the relative strengths of various claims. In this paper, we offer a non-comparative version of Limited Aggregation, what we call the Threshold Approach. It states that there is a non-relative threshold that separates various claims. We demonstrate that the Threshold Approach does not violate rational choice principles such as Transitivity, Separability, and Contraction Consistency, and we show that potential concerns regarding such a view are surmountable. In their critiques of my book, Julia Driver, Brad Hooker, and Alastair Norcross have focused on my argument from rationality to morality that attempts to complete the Kantian project of justifying morality and my use of the “ought” implies “can” principle to reconcile the differences between Kantian and utilitarian ethical perspectives. While treating respectfully the ingenious arguments and counterexamples that each of my critics employs against my views, I explain, in detail, why their arguments and counterexamples do not work (...) against my views, properly interpreted, although they do suggest ways that I might better present my views in the future in order to attract more adherents to my reconciliationist project. What explains the outcomes of chance processes? We claim that their setups do. Chances, we think, mediate these explanations of outcome by setup but do not feature in them. Facts about chances do feature in explanations of a different kind: higher-order explanations, which explain how and why setups explain their outcomes. In this paper, we elucidate this 'mediator view' of chancy explanation and defend it from a series of objections. We then show how it changes the playing field in four (...) metaphysical disputes concerning chance. First, it makes it more plausible that even low chances can have explanatory power. Second, it undercuts a circularity objection against reductionist theories of chance. Third, it redirects the debate about a prominent argument against epistemic theories of chance. Finally, it sheds light on potential chancy explanations of the Universe's origin. (shrink)

In their upcoming article, Henk Jasper van Gils-Schmidt and Sabine Salloch highlight the supposed responsibilities of healthcare professionals in addressing the global health challenges posed by climate change. They argue that healthcare professionals’ duties to future generations and their ‘climate-related obligations’ have been neglected, primarily due to potential conflicts with other responsibilities, such as providing optimal care to current patients and maintaining patient trust. The authors suggest that these competing obligations should be viewed as part of the multifaceted identities individuals (...) hold, encompassing roles as both physicians and environmentalists, each with normative and competing commitments. They propose that a transformative shift in physicians’ professional ethos, expanding from the predominant focus on individual patients to include obligations towards climate protection, could pave the way for identifying effective mechanisms to address these challenges. While acknowledging the authors’ emphasis on sustainable healthcare practices, we argue that a duty to climate protection as part of healthcare professionals’ identity lacks ethical support. We identify serious concerns that stem from the transformative shift in physicians’ professional ethos, particularly in the authors’ presentation of reasons for action. First, envisaging a stable disposition that compels healthcare professionals to ensure optimal care conditions for both immediate and potential future encounters is unrealistic. While Léger accepts the one mistake in the book that Khoury correctly identifies, he takes issue with nearly everything else in Khoury’s review, which involves fallacies, misquotations, reductive arguments, misdirection and failure to mention anything that would contradict Khoury’s generally false claims. A Historical Prolegomenon to Thomas Farrell’s Norms of Rhetorical CultureCarol PosterThe description of various works of logical and rhetorical theory as “Aristotelian,” although far from unusual, is not particularly informative, because it assumes, incorrectly, that there is some ultimate singular Aristotle being imitated by all authors who consider themselves, or who are labeled by others, Aristotelian. In fact, there never has been an interpretation of (...) Aristotle that satisfies the canon of St. Vincent of Lerins, “quod ubique, quod semper, quod ab omnibus creditum est”; instead, there have been almost as many Aristotles as there have been interpreters of Aristotle. Thomas Farrell’s Norms of Rhetorical Culture (1993), therefore, is not so much situated against the background of some single, unique, undisputed Aristotle but, rather, as he himself mentions, within an evolving tradition of Aristotelianism.The historical transformations of Aristotle include two distinct traditions, one oriented toward scientific-technical philosophy andthe other toward rhetorical-poetic and ethical humanism.1 The technical-philosophccical tradition, in which Aristotle was conceived primarily [End Page 375] as metaphysician and natural philosopher, emphasized the logical treatises of the organon, the speculative systems of the Physics and Metaphysics, and the scientific works of the biological treatises. This rhetorical-humanistic tradition was a relatively negligible aspect of Aristotle’s ancient reception, had a slight presence in the Islamic and Latin traditions, developed in certain strands of Renaissance humanism, and came to fruition in the late eighteenth century, primarily, though not exclusively, within a Protestant tradition. In eighteenth-and early nineteenth-century Britain, the rhetorical-humanistic Aristotle found expression directly in neoclassical poetics and, in a more complicated fashion, in a group of authors (including the Scottish moderates and the slightly later Oxford Noetics) who enlisted Aristotle in a battle against skepticism and materialism. The most familiar philosophical conception of objective chance renders determinism incompatible with non-trivial chances. This conception – associated in particular with the work of David Lewis – is not a good fit with our use of the word ‘chance’ and its cognates in ordinary discourse. In this paper we show how a generalized framework for chance can reconcile determinism with non-trivial chances, and provide for a more charitable interpretation of ordinary chance-talk. According to our proposal, variation in an admissible ‘evidence (...) base’ generates a spectrum of different chance functions. Successive coarse-grainings of the evidence base generates a partial ordering of chance functions, with finer trumping coarser if known. We suggest that chance-attributions in ordinary discourse express different chance functions in different contexts, and we sketch a potential contextual mechanism for making particular chance functions salient. The mechanism involves the idea that admissible evidence is available evidence: propositions that could be known. A consequence is that attributions of objective chances inherit the relatively familiar context-sensitivity associated with the modal ‘could’. We show how this context-dependency undermines certain arguments for the incompatibility of chance with determinism. (shrink)

This is to say that I am not evading the objection made by Jean-Pierre Changeux in a recent discussion, namely, that religion as such produces violence. I (...) do not wish to evade the objection nor to hide behind the collateral explanation that it is when religion is detoured by politics that it produces violence. It is the presupposition that religion produces violence that brings me into discussion with René Girard. I encountered his work several decades ago and I have met him intermittently, with moments of distancing and rediscovery. This is the case for me again today regarding one of his later books, The Scapegoat. I cannot forget the dazzling excitement of 1972 when Violence and the Sacred first appeared. And then for me came a moment of hesitation, of doubt: isn't this explanation too psychologizing? Aren't the Gospels too easily exonerated ofthe accusation ofviolence? But I thereafter experienced disappointment with alternative accounts, principally sociological ones, and in particular with the one given by Maurice Bloch in La Violence du religieux. I am going to take the risk of a personal interpretation ofthe intimate relation between religion and violence. My own conviction, at bottom, is that I have been able, by broadening and deepening the issue, to discern the point where this very movement of going deeper bifurcates and branches out toward external violence. I have clarified my position in La Critique et la conviction and in my more recent debate with J.R Changeux, Ce quifait que nouspensons on this complicity between religion and violence. And it was in pursuing the direction opened up in La Critique et la conviction that I rediscovered an 2 Paul Ricoeur interest in The Scapegoat. I found his interpretation not only to be complementary to my own, but its necessary complement. I will now proceed to show how René Girard's thesis is necessary to my own thinking. So now I will go directly to my interpretive proposal, then I will turn to the position of Bloch in La Violence du religieux, a sociological interpretation, in order to come back in the end to Girard. It is by way of reflection on tolerance considered as a progressive initiation that I arrived at the interpretation I am going to present. At its minimal state, we find only the tolerance ofthe intolerant person, who states, "I don't agree with what you believe, I disapprove of it, but I cannot prevent it. I tolerate it in the sense of not being able to prevent it; I would like to prevent it, but I do not have the power to do so." At a second level, tolerance is more positive, saying, "I maintain the conviction that I am the one who has the truth, but I recognize, by way of being accommodating, that you have the right to profess what I hold as false, and I do this in the name ofjustice. That is to say, you certainly have the right, and it is one equal to mine, to profess what you believe, although I take it as false." I would say that the force of the principle ofjustice as thus expressed is this: any other life is worth as much as mine. Let us say that what I recognize here is the right to error. But at this stage I am torn within by the truth that I believe to be unilaterally mine and the justice that entails recognition ofthe other, which I place on another level from that oftruth. I make a further step in pursuing the issue, at a level farther advanced, when I say, "My adversary has perhaps a part ofthe truth but I don't know what it is." In a challenge to Basic Emotion theories, Ortony suggested in a recent article that the existence of affect-free surprise means that surprise is not necessarily valenced and therefore arguably not an emotion. In an article in response, Neta and Kim argued that surprise is always valenced and therefore is an emotion, with apparent cases of affect-free surprise actually being cases of the cognitive state of unexpectedness rather than surprise. We view Neta and Kim's position as resting on an idiosyncratic stipulation (...) of word usage. We further suggest that rejecting affect-free surprise by appealing to examples of affect-laden surprise has no bearing on whether surprise is always valenced, and propose that when surprise appears to be affect-laden the locus of the experienced valence is a co-occurring emotion. This commentary raises a number of questions in connection with Colin Koopman's paper “Conceptual Analysis for Genealogical Philosophy: How to Study the History of Practices after Foucault and Wittgenstein.” Specifically, this commentary asks about the precise relationship between concepts and practices in Koopman's account and the possibility of resisting certain practices of subjectivation.

Biodiversity is a valuable resource that supports sustainability within agricultural systems, yet in contradiction to this agriculture is recognised as a contributor to biodiversity loss. Agricultural advisory services are institutions that support sustainable agricultural development, employing a variety of approaches including farmer discussion groups in doing so. This study evaluates the impact of a farmland biodiversity management (FBM) communication strategy piloted within Irish farmer discussion groups. A sensemaking lens was applied in this objective to gain an understanding of how this (...) strategy could create an actionable space for FBM promotion amongst farmers. The strategy was piloted with six Irish dairy farmer discussion groups, after which focus groups were conducted with members of these groups. Additionally, baseline and endline surveys were completed by the members to determine their knowledge, attitude and on-farm practices relating to FBM. Analysis of the focus group data identified that the communication strategy supported the affordance of sensemaking with respect to FBM. Analysis of the data from the baseline and endline surveys relating to knowledge, attitudes and practices found that engaging with the communication strategy promoted farmers to improve their attitude in relation to FBM. Results from this study provide important lessons for agricultural advisory services to support farmers in incorporating FBM into the overall management of their farms and, in turn, to promote the improvement of farmland biodiversity and contribute to a sustainable future. John Stuart Mill famously maintained that “animal pleasures” – like enjoying good smells and tastes – are lower quality than the pleasures tied to higher cognition, like the pleasure of enjoying an opera or understanding a mathematical proof. This downgrading is particularly common in the ethical literature about eating animals. Peter Singer, James Rachels, Gary Francione, Alastair Norcross and dozens of other ethicists make quick work of defending vegetarianism by presuming that “gustatory pleasure” is trivial. But is it?

Prior research on engineering students’ understandings of ethics and social responsibility has produced mixed and sometimes conflicting results. Seeking greater clarity in this area of investigation, we conducted an exploratory, longitudinal study at four universities in the United States to better understand how engineering undergraduate students perceive ethics and social responsibility and how those perceptions change over time. Undergraduate engineering students at four U.S. universities were surveyed three times: during their 1st (Fall 2015), 5th (Fall 2017), and 8th semesters (Spring (...) 2019). The students who completed all three surveys (_n_ = 226) comprise the sample that was analyzed in this paper for changes in their scores on five instruments: Fundamentals of Engineering/Situational Judgment, Moral Disengagement, ABET Engineering Work and Practice Considerations, Macroethics, and Political and Social Involvement Scale. We found that students modestly increased their knowledge of ethics and ability to apply that knowledge in situations calling for them to exercise judgment. In addition, they consistently indicated that health and safety considerations in engineering were of highest importance. They also showed steady levels of social consciousness over time, in contrast to other studies which detected a culture of increasing disengagement in engineering students throughout the four years of their undergraduate studies.
