This article seeks to decentre the proprietary author in copyright law by attending to some peripheral matters of Immanuel Kant’s periodical essay, ‘On the Wrongfulness of Reprinting’ (1785), as indices of its medial-material conditions of possibility. We consider not only the epitextual background of the German Enlightenment in which the Berlinische Monatsschrift was produced, but also the peritextual specimens of catchwords, signature marks, and various front matter of Kant’s essay. This medial reading suggests the periodical to be deeply involved in (...) the operations of a print machinery preceding the authorial figure, the existence of which perturbs copyright law’s attachment to original authorship. It is a consequence of the theory of imprecise credences that there exist situations in which rational agents inevitably become less opinionated toward some propositions as they gather more evidence. The fact that an agent's imprecise credal state can dilate in this way is often treated as a strike against the imprecise approach to inductive inference. Here, we show that dilation is not a mere artifact of this approach by demonstrating that opinion loss is countenanced as rational by a substantially (...) broader class of normative theories than has been previously recognised. Specifically, we show that dilation-like phenomena arise even when one abandons the basic assumption that agents have (precise or imprecise) credences of any kind, and follows directly from bedrock norms for rational comparative confidence judgements of the form `I am at least as confident in p as I am in q'. We then use the comparative confidence framework to develop a novel understanding of what exactly gives rise to dilation-like phenomena. By considering opinion loss in this more general setting, we are able to provide a novel assessment of the prospects for an account of inductive inference that is not saddled with the inevitability of rational opinion loss. Loneliness in medicine is a serious problem not just for patients, for whom illness is intrinsically isolating, but also for physicians in the contemporary condition of medicine. We explore this problem by investigating the ideal physician-patient relationship, whose analogy with friendship has held enduring normative appeal. Drawing from Talbot Brewer and Nir Ben-Moshe, we argue that this appeal lies in a dynamic form of companionship incompatible with static models of friendship-like physician-patient relationships: a mutual refinement of embodied virtue that draws (...) both persons together. The ideal physician-patient relationship has a dialectical character that fosters each member's improvement of phenomenologically recognizing and embodying moral virtues. A key component of this dynamic is a commitment to the common goal of the patient's health, realized through joint interactivities and conversations over time. The physician's presence to the patient's suffering—understood best as an alienating phenomenological condition for the patient—orients and discloses possibilities for virtuous caregiving by structuring the meanings of the goals, conversations, and joint narrative constitutive of their relationship. Presence to suffering, paradoxically, is perhaps an important prerequisite for this dynamic partnership. These activities dialectically build an interpretive horizon of understanding through which moral goods and character refinement—in and for the other—may become revealed for both persons in their shared being-in-the-world. This analysis of suffering, mood, and revealing of (possible) moral goods has implications for addressing the modern problem of loneliness for patients and physicians, who are increasingly inhibited from building flourishing relationships with each other. How might people be wronged in relation to their feelings, moods, and emotions? Recently philosophers have begun to investigate the idea that these kinds of wrongs may constitute a distinctive form of injustice: affective injustice (Archer & Mills 2019; Mills 2019; Srinivasan 2018; Whitney 2018). In previous work, we have outlined a particular form of affective injustice that we called emotional imperialism (Archer & Matheson 2022). This paper has two main aims. First, we aim to provide an expanded account of (...) the forms that emotional imperialism can take. We will do so by drawing inspiration from William Reddy’s concept of an emotional regime and investigating ways in which colonial powers of the 18th to 20th Centuries sought to impose their emotional regimes on their colonial subjects. Second, we will offer more expansive accounts of both emotional imperialism and affective injustice that can accommodate these additional forms of emotional imperialism. (shrink)

“Informed consent” implicitly links the transmission of information to the granting of permission on the part of patients, tissue donors, and research subjects. But what of the corollary, informed refusal? Drawing together insights from three moments of refusal, this article explores the rights and obligations of biological citizenship from the vantage point of biodefectors—those who attempt to resist technoscientific conscription. Taken together, the cases expose the limits of individual autonomy as one of the bedrocks of bioethics and suggest the need (...) for a justice-oriented approach to science, medicine, and technology that reclaims the epistemological and political value of refusal. Berger and Whistler provide a ground-breaking account of Schelling's first controversy with his critic A.C.A. Eschenmayer in 1801, which focused on the philosophy of nature. They argue that key Schellingian concepts, such as identity, potency and abstraction, were first forged in his early debate with Eschenmayer.

This article defends the normative relevance of the representation of non-citizens in democracies. I argue that representation within nation-states constitutes a realistic institutionalisation of the All-Affected Principle, allowing justificatory practices towards non-citizens and establishing political institutions that can realise the ideal of inclusion of all externally affected individuals. I defend electoral, non-electoral and surrogate forms of representation of affected interests that satisfy both the cosmopolitan concern for the equal consideration of interests and the statist defence of the importance of a (...) territorially and civically bounded demos. I assess piecemeal implementations of representation practices, namely reciprocal representation, ombudspersons, self-appointed representatives and deliberative and advocacy groups. Gradual and pluralised means of representation constitute necessary and feasible first steps to consider affected interests and offer an alternative route to an all-or-nothing defence of inclusion as national enfranchisement. When philosophers consider factors compromising autonomy in consent, they often focus solely on the consent-giver’s agential capacities, overlooking the impact of the consent-receiver’s conduct on the consensual character of the activity. In this paper, I argue that valid consent requires justified trust in the consent-receiver to act only within the scope of consent. I call this the Trust Condition (TC), drawing on Katherine Hawley’s commitment account of trust. TC constitutes a belief that the consent-receiver is capable and willing to act (...) as we expect from them. If such trust is not warranted, I argue, consent lacks the appropriate normative grounds. After establishing TC, I explore its application in the sexual arena, asserting that due to the non-contractual dimensions of sexual activity — such as the dynamic nature of sexual desires and the absence of external factors effectively binding sexual partners to the terms of consent—trust is warranted in sexual consent by means of care. I define care as a special sensitivity and attention toward the partner’s will and discuss how this approach leads to safer intimate relationships in practice. (shrink)

For several decades, Carnap's philosophy of mathematics used to be either dismissed or ignored. It was perceived as a form of linguistic conventionalism and thus taken to rely on the bankrupt notion of truth by convention. However, recent scholarship has revealed a more subtle picture. It has been forcefully argued that Carnap is not a linguistic conventionalist in any straightforward sense, and that supposedly decisive objections against his position target a straw man. This raises two questions. First, how exactly should (...) we characterise Carnap's actual philosophy of mathematics? Secondly, is his position an attractive alternative to established views? I will tackle these issues by looking at Carnap's response to the incompleteness theorems. Drawing on arguments put forward by Gödel and Beth, I show that some crucial aspects of Carnap's positive account have remained underdeveloped. Suggestions on what a full evaluation of Carnap's position requires are made. (shrink)

The aim of this paper is establish the difference between aesthetics and the philosophy of art. Part of the argument is that only a philosophy of art can give an adequate philosophical account of works of art. The argument is advanced drawing on the writings of Immanuel Kant and Gunter Figal.

While game theory has been transformative for decision making, the assumptions made can be overly restrictive in certain instances. In this work, we investigate some of the underlying assumptions of rationality, such as mutual consistency and best response, and consider ways to relax these assumptions using concepts from level-k reasoning and quantal response equilibrium (QRE) respectively. Specifically, we propose an information-theoretic two-parameter model called the quantal hierarchy model, which can relax both mutual consistency and best response while still approximating level-k, (...) QRE, or typical Nash equilibrium behavior in the limiting cases. The model is based on a recursive form of the variational free energy principle, representing higher-order reasoning as (pseudo) sequential decision-making in extensive-form game tree. This representation enables us to treat simultaneous games in a similar manner to sequential games, where reasoning resources deplete throughout the game-tree. Bounds in player processing abilities are captured as information costs, where future branches of reasoning are discounted, implying a hierarchy of players where lower-level players have fewer processing resources. We demonstrate the effectiveness of the quantal hierarchy model in several canonical economic games, both simultaneous and sequential, using out-of-sample modelling. (shrink)

Protein turnover (PT) has been formally defined only in equilibrium conditions, which is ill‐suited to quantify PT during dynamic processes that occur during embryogenesis or (extra) cellular signaling. In this Hypothesis, we propose a definition of PT in an out‐of‐equilibrium regime that allows the quantification of PT in virtually any biological context. We propose a simple mathematical and conceptual framework applicable to a broad range of available data, such as RNA sequencing coupled with pulsed‐SILAC datasets. We apply our framework to (...) a published dataset and show that stimulation of mouse dendritic cells with LPS leads to a proteome‐wide change in PT. This is the first quantification of PT out‐of‐equilibrium, paving the way for the analysis of biological systems in other contexts. (shrink)

Exploitation: Perspectives from Philosophy, Politics, and Economics brings together recent work on the topic of exploitation from philosophy, political science, and economics in one volume, organized around three main questions: What is exploitation? Why is exploitation wrong? What should we do about it? These questions are increasingly relevant in public policy discussions. The past decade has witnessed the rise of populism and an increasing sense that politics is a game rigged to benefit certain classes of persons at the expense of (...) others. Interestingly, this sense of unfairness has been shared across the political spectrum though, of course, the left and right differ in both their moral diagnosis and their political prescription. Current debates over minimum wage laws, immigration reform, and undue corporate influence on politics can all be understood as drawing on and developing these concerns over exploitative political treatment. At the same time, the literature on exploitation has blossomed. What was once a topic of relatively narrow interest to philosophers working in the tradition of analytical Marxism has been reinvigorated and diversified. The essays in this book both represent and extend that diversity. While the condition of labor remains an important and central topic, the current volume extends the analysis to such neglected topics as the relationship between children and parents, interactions between states, and interactions between generations. In this paper, I discuss a subset of preferences in which a person desires the fulfillment of a choice they have made, even if it involves the violation of their desires, as in rape fantasies. I argue that such cases provide us with a unique insight into personal autonomy from a proceduralist standpoint. In its first part, I analyze some examples in light of Frankfurt's endorsement theory and argue that even when we cannot endorse a practical decision that involves being (...) violated, we nonetheless regard those cases as instances of autonomy. Therefore, autonomy does not necessarily require endorsement. Instead, I propose that the nature of the relevant highest-order volition dictates the procedure that should be established in one’s desire structure for its fulfillment. In the second part, I discuss how an agent may effectively consent to the violation of their decision by another person. Ordinary consent typically refers to actions but fails to communicate one's higher-order desires or commitments. To address this limitation, I propose a practical tool that accomplishes this by signaling shifts in the normative context where the agents are interacting. (shrink)

This paper reconstructs Oskar Becker’s phenomenology of race, a project he called “paraontology.” For Becker, a fervent National So-cialist, paraontology provided a phenomenological account of “na-ture”—a realm of ahistorical essences encompassing both the “super-historical” truths of mathematics and metaphysics and the “sub-historical” forces of “blood and soil.” The impetus for this reconstruc-tion is the re-emergence of this term in contemporary Black studies, where it is used to problematize ontology’s usefulness for thinking black life. This paper asks what the possibility of (...) such an iteration shows about Becker’s project and its investment in non-historical repetition, arguing it reveals a profound disavowal of the historical at the heart of Becker’s project rather than a phenomenological disclosure of the natural. We argue that P. F. Strawson's hugely influential account of moral responsibility in ‘Freedom and Resentment’ (FR) is inextricably bound up with his barely known account of morality in ‘Social Morality and Individual Ideal’ (SMII). Reading FR through the lens of SMII has at least three far-reaching implications. First, the ethics–morality distinction in SMII gives content to Strawson's famous distinction between personal and moral reactive attitudes, which has often been thought to be a merely formal distinction. Second, the ethics–morality distinction (...) sheds light on the scope of moral responsibility in FR, which is narrower than commentators think. Third, Strawson's discussion of morality shows that he was not insensitive to issues of power, as several critics have claimed. The link between morality and power helps to make clear that Strawson allows for criticism of our moral responsibility practices. (shrink)

The new technologies of television viewership following the digital turn have introduced new anxieties and possibilities. While new screen cultures facilitate a transnational viewership, the importance of ethically and morally grounded representations cannot be overstated. In this context, Delhi Crime, the Emmy award-winning Indian series based on the Delhi gang rape and murder of a 23-year-old woman in Delhi, will be instrumental in informing the ethico-political concerns that ought to be prioritized while representing the subaltern subject and the novel socialites (...) fashioned through the new viewership patterns. This article attempts to understand the way in which the emerging screen economies provide new terrains for ethical representation and engendering digital publics. Diagrams have distinctive characteristics that make them an effective medium for communicating research findings, but they are even more impressive as tools for scientific reasoning. Focusing on circadian rhythm research in biology to explore these roles, we examine diagrammatic formats that have been devised to identify and illuminate circadian phenomena and to develop and modify mechanistic explanations of these phenomena.

Political actions by Fridays for Future, Extinction Rebellion, and other climate activists often involve violations of legal regulations – such as compulsory education requirements or traffic laws – and have been criticized for this in the public sphere. In this essay, I defend the view that these violations of the law constitute a form of morally justified civil disobedience against climate policies. I first show that these actions satisfy the criteria of civil disobedience even on relatively strict conceptions of civil (...) disobedience. I then argue that they meet plausible justification conditions for civil disobedience because they are directed against serious and clear injustices, which legal means of influence have failed to remedy for decades. Finally, I reject the objection that civil disobedience against climate policy violates basic democratic principles because it claims authority to override democratically enacted agreements. When addressed to Fridays for Future activists, the objection misfires for the reason alone that these activists are largely minors that are excluded from democratic participation. Moreover, disobedience even by adult activists is justified by the existence of serious democratic deficits in our climate policies, especially since it can help to correct them. Such deficits include the lack of representation of the interests of people affected by climate change in the future and globally. (shrink)

Many necessitarians about cause and law (Armstrong 1983; Mumford 2004; Bird 2007) have argued that Humeans are unable to justify their inductive inferences, as Humean laws are nothing but the sum of their instances. In this paper I argue against these necessitarian claims. I show that Armstrong is committed to the explanatory value of Humean laws (in the form of universally quantified statements), and that contra Armstrong, brute regularities often do have genuine explanatory value. I finish with a Humean attempt (...) at a probabilistic justification of induction, but this fails due to its assumption that the proportionality syllogism is justified. Although this attempt fails, I nonetheless show that the Humean is at least as justified in reasoning inductively as Armstrong. (shrink)

In an age of apparent disrepair as the climate crisis takes hold and neoliberalism fails to liberate, as the cost of living rises and rights are retracted, the need for a reparative turn is overdue. But what is repair? If repair is contained in moments of total breakdown, then the reparative acts of care that sustain the world are denied. Countering these forces and the urgency prescribed by the crisis of disrepair and in what too often appears as the proprietary (...) epistemology of repair, in this paper I offer an account of ‘repairability’. Structured in relation to the reparative gaze of feminist theory and poetic thinking, repairability assumes a material trace, I contend, through the vernacular archive of Cuban artist-ethnographer Ernesto Oroza. Oroza’s work offers a compelling case study through which to think the possibility of repair as an act of worldly becoming. (shrink)

It is widely accepted in science that the universe is a closed deterministic system in which everything can, ultimately, be explained by purely physical causation. And yet we all experience ourselves as having the freedom to choose between alternatives presented to us — ‘we’ are in the driving seat. The puzzling status of volition is explored in this issue by a distinguished body of scientists and philosophers.

My aim in this chapter is to explore an analogy between logic and ethics, as Wittgenstein understands them in the Tractatus. First, I argue that Wittgenstein regards logic as a condition of the possibility of meaning, in the sense that logic makes meaningful language and thought possible. Second, I ask why Wittgenstein calls both logic and ethics ‘transcendental’. I suggest that, while logic is a condition of the possibility of semantic meaning, ethics is a condition of the possibility of existential (...) meaning. Without ethics, life could not be meaningful. Third, I show that harmony and agreement play a crucial role in Wittgenstein’s accounts of logic and ethics. A meaningful proposition can be true or false, a meaningful life can be happy or unhappy, and both truth and happiness consist in some kind of harmony or agreement with reality. (shrink)

Cross-cultural research suggests that East Asians display a holistic attentional bias by paying attention to the entire field and to relationships between objects, whereas Westerners pay attention primarily to salient objects, displaying an analytic attentional bias. The assumption of a universal pan-Asian holistic attentional bias has recently been challenged in experimental research involving Japanese and Chinese participants, which suggests that linguistic factors may contribute to the formation of East Asians' holistic attentional patterns. The present experimental research explores differences in attention (...) and information processing styles between Korean and Chinese speakers, who have been assumed to display the same attentional bias due to cultural commonalities. We hypothesize that the specific structure of the Korean language predisposes speakers to pay more attention to ground information than to figure information, thus leading to a stronger holistic attentional bias compared to Chinese speakers. Findings of the present research comparing different groups of English, Chinese, and Korean speakers provide further evidence for differences in East Asians' holistic attentional bias, which may be due to the influence of language. Furthermore, we also extend prior theorizing by discussing the potential impact of other cultural factors. In line with critical voices calling for more research investigating differences between cultures that are assumed to be culturally similar, we highlight important avenues for future studies exploring the language-culture relationship. On cherche ici à pallier ce manque par une étude des rapports entre Hobbes et Bentham dans le champ de la philosophie politique, juridique et morale. On espère ainsi expliquer les points communs, influences, réappropriations, différences et oppositions existant entre ces deux (...) pensées et contribuer par là à faire mieux comprendre leur rôle dans l’histoire de la philosophie moderne anglaise. Abstract:Designers whose projects are inspired by a community’s unique sense of spatial identity often focus on a site’s observable context, i.e. historic forms and surface aesthetics. Focus on typological components, however, overlooks generative relationships between the phenomenology of place and human energy investment. Recognizing Kubler’s dictum that material history is an observable continuum then, at its most fundamental level, the history of spatial production is the history of energy use. For most of human history, place was a unique socio-cultural expression (...) because it fused energy expenditure with site-specific conditions, including climate, topography and materials. This paper introduces the concept of burden distance, the distance needed to travel to material sources and bring them back from origin points to their place of use. This proposed concept parallels Walter Christaller’s Central Place Theory idea of “range,” but applied in terms phenomenological implications of energy investment and placemaking. Understanding burden distance and its role in placemaking, is an important step in identifying why built environments have a spatial specificity that contributes to mitigate spatial alienation and instead root people to their built environment. Pour reconstruire philosophiquement cette pensée, en s’attachant plus spécifiquement au rapport entre économie et politique, on explique d’abord leur commune opposition aux colonies et aux politiques étrangères bellicistes. On montre ensuite comment ils comprennent le commerce international, l’économie et le marché en relation avec l’État, et enfin qu’on ne saurait constituer une théorie politique internationale assurant la sécurité, la paix (...) et la prospérité qui soit autonome et séparée de la théorie de l’État. Son approche accélérationniste contraste avec les sensibilités actuellement dominantes dans les pensées écologistes européennes.

A questão da representação é central para Carl Schmitt. Em mais de um escrito, tal questão é analisada com detalhes. Além disso, é um tópico recorrente em intérpretes da obra schmittiana. Nosso propósito nesse artigo é voltar à elaboração da noção de representação em Schmitt. Veremos como ele apresenta tal noção, principalmente em sua Teoria da Constituição. A partir da exposição da análise schmittiana, realizaremos uma crítica ao modo como ele elabora tal ideia, apresentando uma maneira distinta de ver a (...) questão: não haveria uma separação entre representação e identidade, como quer Schmitt, mas representação seria ela mesma identidade. A partir dessa crítica, podemos perceber os limites da visão de Schmitt, além de evidenciar os motivos que o levaram a tal noção de representação. (shrink)

The aim of this paper is to develop a conception of God that works with the identification of being-before-the-law and being-with-God. In addition, it argues that developing a rethinking of God along such lines necessitates, equally, the development of the concomitant political theology and philosophical anthropology that such a repositioning of God envisages. Processes of subject creation have to be thought in relation to any philosophical engagement with the law.
