However fruitful the communication of moral principles for providing orientation in modern society might be, a serious omission has been made in that the problem of implementation is not addressed. Two fundamental question have neither been raised nor answered: Why should self‐interested individuals follow the proposed moral principles in their daily conduct? Are societal institutions of such a design that is in the power of the individuals to (...) follow these moral principles? It is shown in this article that an economic theory of morals does systematically address these two questions and therefore provides a firm basis for discussing the possibilities and boundaries of following the moral principles inherent in the long history of moral philosophy. Barsalou's theory of perceptual symbol systems is considered from a metacognitive perspective. Two examples are discussed in terms of the proposed perceptual symbol theory. First, recent results in research on feeling-of-knowing judgement are used to argue for a representation of familiarity with input cues. This representation should support implicit memory. Second, the ability of maintaining a theory of other people's beliefs (theory of mind) is considered and it is suggested that a purely simulation-based view is insufficient to explain the available (...) evidence. Both examples characterize areas where Barsalou's theory would benefit from additional detail. (shrink)

I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. Émile Durkheim remains one of the most controversial, and deeply misunderstood, classics of social theory. His work differs from the dominant version of sociology that has essentially accepted the modernist self-description of contemporary societies; and it contradicts the individualism that has come to dominate the social sciences. For everybody who is interested in constructing theoretical alternatives to this individualism, Durkheim's sociology can be a useful inspiration - not only because of the solutions it suggests, but already because of the questions (...) it asks. Making use of the theoretical possibilities offered by the Durkheimian tradition, however, requires going beyond the familiar appropriations. This chapter addresses the distinction between private and public and the difference between ‘public’ and ‘official’. Drawing on a comparative analysis of Asian cities, it looks at the ways in which the local, the national and the global levels, which serve different, sometimes contrasting, interests, are negotiated and reconciled in the city. The chapter suggests that different forms of reconciliation have brought about an alternative ‘insitutionalisation’ of the public space. Such an institutionalisation is reflected in the access to, and dissemination (...) of, information—e.g., access to the media—and, above all, in the control over the common goods. The public sphere is used to voice discontent, leading to a new definition of the ‘common good’; that is, the inclusion, or non-exclusion, of large sections of the population which, though initially marginal, can become significant in shaping urban politics. P.After some 30 years of incisive intervention in Platonic scholarship, Holger Thesleff here offers us "an attempt to elaborate and ground more firmly some basic theses which I have propounded in various contexts before," (1) a rather modest description of what he also describes as an (...) attempt to contribute toward "a more general agreement on how to read and interpret Plato" (5). The richness of this book makes it impossible to describe in any detail, and I shall content myself with indicating some of what I take to be its principal points of view.Thesleff"s concern for agreement arises from his perception of the vastly discrepant schools of Plato interpretation, of which the most important for him might be labeled esotericist, analytic, and "literary." The last, which can hardly be called a school at all, includes a variety of scholars who downplay "literal" interpretation and emphasize such things as "dramatic artistry, the structure of the dialogues, the characterization of settings and persons, shifts of style, allusions, play, and irony" (3). Thesleff's sympathies clearly lie with these people, perhaps to an extent which, as I shall suggest, will limit the effectiveness of his attempt to move toward a consensus.As the title indicates Thesleff builds his reading around what he calls Plato's two-level model. This two-level model is not, as one might suppose, what has been called Plato's two worlds view, the belief in a world of pure being beyond the perceived world we inhabit. Indeed, it is not a doctrine or set of doctrines at all. Rather "it is an intuitive 'vision' which offers only crude basic patterns and frames for the structures of Plato's thinking, feelings, intuitions, and intentions, from his youth to his old age, and for our understanding of them" (123). Clearly one cannot expect a full and precise articulation of this vision. Thesleff proceeds by discussing in terms of their role in the earlier dialogues ten hierarchic pairs which form part of Plato's vision: divine/human, soul/body, leading/being led (particularly important in the conduct of a Socratic discussion), truth/appearance, knowledge/opinion, intellect/senses, defined/undefined, stability/change, one/many, same/different. These hierarchic or asymmetric pairs are contrasted by Thesleff with what he calls polar opposites like large/small and light/dark. He also stresses that the hierarchic pairs of Plato's two-level model involve no separation (chorismos), but rather a communion (koinônia).As the words "from his youth to his old age" in the quotation of the previous paragraph indicate, Thesleff is a "unitarian" in his approach to Plato. His Plato is not a philosopher whose positions changed through time as a result of reasoned argument. What many scholars take to be doctrines later given up, e.g., the view that learning is being reminded (anamnêsis), are "thought experiments," which are not followed up, thought experiments made within the context of the unchanging two-level vision.Although Thesleff is a unitarian in the sense I have indicated, he does believe that a kind of order of composition can be constructed for the dialogues. I say "kind of" because Thesleff's chronology involves assumptions of revisions over time, multiple authorship, and even dialogues "written down" by people other than Plato. The resulting chronology is complex, and I here only indicate it in rough form in a way which [End Page 272] brings out what I take to be its major points. Leaving out of account those Socratic" dialogues which Thesleff takes to be latish and the posthumously completed Laws, we can say that a series of late dialogues starts with the Parmenides and includes the Timaeus, Critias, Sophist, Politicus, and Philebus. All other dialogues, including the Theaetetus, were written prior to the Parmenides with the exception of the Republic, which Thesleff proposes is in its ultimate shape a late work, representing "only and purely Plato's 'own' and personal philosophy" (115). The existence of neural correlates of consciousness (NCC) is not enough for philosophical purposes. On the other hand, there's more to NCC than meets the sceptic's eye. (I) NCC are useful for a better understanding of conscious experience, for instance: (1) NCC are helpful to explain phenomenological features of consciousness – e.g., dreaming. (2) NCC can account for phenomenological opaque facts – e.g., the temporal structure of consciousness. (3) NCC reveal properties and functions of consciousness which cannot be elucidated either (...) by introspective phenomenology or by psychological experiments alone – e.g., vision. (II) There are crucial problems and shortcomings of NCC: (1) Correlation implies neither causation nor identity. (2) There are limitations of empirical access due to the problem of other minds and the problem of self-deception, and (3) due to the restrictions provided by inter- and intraindividual variations. (4) NCC cannot be catched by neuroscience alone because of the externalistic content of representations. Therefore, NCC are not sufficient for a naturalistic theory of mind, (5) nor are they necessary because of the possibility of multiple realization. (III) Nevertheless, NCC are relevant and important for the mind-body problem: (1) NCC reveal features that are necessary at least for behavioral manifestations of human consciousness. (2) But NCC are compatible with very different proposals for a solution of the mind-body problem. This seems to be both advantageous and detrimental. (3) NCC restrict nomological identity accounts. (4) The investigation of NCC can refute empirical arguments for interactionism as a case study of John Eccles' dualistic proposals will show. The existence of quantum correlates of consciousness (QCC) is doubtful from a scientific perspective. But even if their existence were verified, philosophical problems would remain. On the other hand, there could be more to QCC than meets the sceptic's eye: • QCC might be useful or even necessary for a better understanding of conscious experience or quantum physics or both. The main reasons for this are: the measurement problem (the nature of observation, the mysterious collapse of the wave function, etc.), (...) ostensibly shared features of quantum phenomena and conscious phenomena (e.g., complementarity, nonspatiality, acausality, spontaneity, and holism) and connections (ontology, causation, and knowledge), the qualia problem (subjectivity, explanatory gap etc.). But there are many problems, especially questions regarding realism and the nature and role of conscious observers; • QCC are conceptually challenging, because there are definitory problems and some crucial ontological and epistemological shortcomings. It is instructive to compare them with recent proposals for understanding neural correlates of consciousness (NCC). QCC are not sufficient for a quantum theory of mind, nor might they be necessary except perhaps in a very broad sense; • QCC are also empirically challenging. Nevertheless, QCC could be relevant and important for the mindbody problem: QCC might reveal features that are necessary at least for behavioral manifestations of human consciousness. But QCC are compatible with very different proposals for a solution of the mind-body problem. This seems to be both advantageous and detrimental. QCC restrict accounts of nomological identity. ArgumentIn 1877, a young mathematician named Joseph Boussinesq presented amémoireto theAcadémiedes sciences which demonstrated that some differential equations may have more than one solution. Boussinesq linked this fact to indeterminism and to a possible solution to the free will versus determinism debate. Boussinesq's main interest was to reconcile his philosophical and religious views with science by showing that matter and motion do not suffice to explain all there is in the world. His argument received mixed criticism that addressed both his (...) philosophical views and the scientific content of his work, pointing to the physical “realisticness” of multiple solutions. While Boussinesq proved to be able to face the philosophical criticism, the scientific objections became a serious problem, thus slowly moving the focus of the debate from the philosophical plane to the scientific one. This change of perspective implied a wide discussion on topics such as instability, the sensitivity to initial conditions, and the conservation of energy. The Boussinesq debate is an example of a philosophically motivated debate that transforms into a scientific one, an example of the influence of philosophy on the development of science. (shrink)

The development of artificial intelligence (AI) in medicine raises fundamental ethical issues. As one example, AI systems in the field of mental health successfully detect signs of mental disorders, such as depression, by using data from social media. These AI depression detectors (AIDDs) identify users who are at risk of depression prior to any contact with the healthcare system. The article focuses on the ethical implications of AIDDs regarding affected users’ health-related autonomy. Firstly, it presents the (ethical) discussion of AI (...) in medicine and, specifically, in mental health. Secondly, two models of AIDDs using social media data and different usage scenarios are introduced. Thirdly, the concept of patient autonomy, according to Beauchamp and Childress, is critically discussed. Since this concept does not encompass the specific challenges linked with the digital context of AIDDs in social media sufficiently, the current analysis suggests, finally, an extended concept of health-related digital autonomy.
