Africa, before European colonization, knew no other form of legal system outside customary arrangements. Based on secondary sources and a primary survey conducted between 2009 and 2010 on the situation of women and land rights in anglophone Cameroon, this paper examines the grounds for discrimination in customary laws against women's rights to land in the context of legal pluralism, and discusses the implications of this custom of gender discrimination. In drawing from Cameroon as an exemplar, it concludes that the strong (...) influence and impact of customs on current land tenure systems have global implications on women's land rights, food security and sustainable development, and that gender equality in land matters can be possible only where the critical role of ethics is recognized in pursuit of the economic motive of land rights. In this article, we examine how the U.N. Convention on the Rights of the Child can be useful in pediatric bioethics. Adopted in 1989, the CRC reflects norms that have been deliberated upon for a long period of time and endorsed by most nations. Biblical Christianity should be a powerful, life-forming, paradigm-shifting experience leading to increasing levels of Christlikeness. Unfortunately, the experience of many Christians today is far short of the transformation described in Scripture. This article reports on a portion of mixed-methods research examining the transformative learning reported by alumni of a 22-lesson discipleship process called the Immersion Experience by Aphesis Group Ministries. Holistic spiritual health involves listening to our emotions, confronting toxic shame, addressing childhood defenses, and untangling our distorted spirituality.

The ‘standard interpretation’ of John Taurek’s argument in ‘Should the Numbers Count?’ imputes two theses to him: first, ‘numbers scepticism’, or scepticism about the moral force of an appeal to the mere number of individuals saved in conflict cases; and second, the ‘equal greatest chances’ principle of rescue, which requires that every individual has an equal chance of being rescued. The standard interpretation is criticized here on a number of grounds. First, whilst Taurek clearly believes that equal chances are all-important, (...) he actually argues for a position weaker than the equal greatest chances principle. Second, the argument Taurek gives for the importance of equal chances ought to commit him to being more hospitable to the significance of numbers than he seems to be. Third, and as a result, Taurek should not have dismissed the significance of numbers but embraced a form of pluralism instead. Fourth, this result should be welcomed, because pluralism is more plausible than either the equal greatest chances principle or the saving the greater number principle. (shrink)

In this paper, I analyze the ‘Da ti’ chapter of the Han Feizi 韓非子. This chapter is often read as one of the so-called Daoist Chapters of text. However, a deeper study of this chapter allows us to see that, while Daoist terminology is employed, it is done so in a way that is certainly not reminiscent of either the Zhuangzi 莊子 or the Laozi 老子. Neither, though, does it have quite the flavor of other chapters in the Han Feizi (...) where scholars have often read Han Fei s advocating a system of government based on laws promulgated by the ruler, the content of which is left solely to the ruler’s discretion. Throughout this paper, I hope to demonstrate that a reading of the ‘Da ti’ chapter allows us to understand that Han Fei is not simply advocating a system of government based on laws promulgated by the ruler, the content of which is left solely to the ruler’s discretion. This chapter can help us begin to understand that Han Fei has a much more nuanced system and that he advocates law that accords with the overarching pattern of the universe. In doing this, I will show that the idea of fa 法 (standard, law) that we see utilized by Han Fei, both in these chapters do not fall neatly into Western conceptions of law, and thus previous scholars who have worked based on these conceptions have missed important aspects of Han Fei’s thought. I also attempt to demonstrate that this interpretation of law is consistent with the way that it is used in the rest of the Han Feizi. (shrink)

Music is a natural human expression present in all cultures, but the functions it serves are still debated. Previous research indicates that rhythm, an essential feature of music, can enhance coordination of movement and increase social bonding. However, the prolonged effects of rhythm have not yet been investigated. In this study, pairs of participants were exposed to one of three kinds of auditory stimuli (rhythmic, arrhythmic, or white‐noise) and subsequently engaged in five trials of a joint‐action task demanding interpersonal coordination. (...) We show that when compared with the other two stimuli, exposure to the rhythmic beat reduced the practice effect in task performance. Analysis of the behavioral data suggests that this reduction results from more temporally coupled motor movements over successive trials and that shared exposure to rhythm facilitates interpersonal motor coupling, which in this context serves to impede the attainment of necessary dynamic coordination. We propose that rhythm has the potential to enhance interpersonal motor coupling, which might serve as a mechanism behind its facilitation of positive social attitudes. (shrink)

Food security policy, programs, and infrastructure have been incorporated into Public Health and other areas of the Provincial Government in British Columbia, including the adoption of food security as a Public Health Core Program. A policy analysis of the integration into Public Health is completed by merging findings from 48 key informant interviews conducted with government, civil society, and food supply chain representatives involved in the initiatives along with relevant documents and participant/direct observations. The paper then examines the results within (...) the context of historic and international trends and theoretical models of food policy, community food security, and applied policy research. Public Health re-emerged as a driver of food security in BC—both as a key player and in positing the public’s health as a driver in food security and food systems. While Public Health’s lead role supported an increase in legitimacy for food security in BC, interviewees described a clash of cultures between Public Health and civil society. The clash of cultures occurred partly as a result of Public Health’s limited food security mandate and top down approach. Consequently civil society voice at the provincial level was marginalized. A social policy movement toward a new political paradigm—regulatory pluralism—calls for greater engagement of civil society, and for all sectors to work together toward common goals. A new, emerging policy map is proposed for analyzing the dynamics of food security and health promotion initiatives in BC. (shrink)

Several tasks in artificial intelligence require the ability to find models about knowledge dynamics. They include belief revision, fusion and belief merging, and abduction. In this paper, we exploit the algebraic framework of mathematical morphology in the context of propositional logic and define operations such as dilation or erosion of a set of formulas. We derive concrete operators, based on a semantic approach, that have an intuitive interpretation and that are formally well behaved, to perform revision, fusion and abduction. This study focuses on investigating habits in perioperative nursing culture, which are often simply accepted and not normally considered or discussed. A hermeneutical approach was chosen as the means of understanding perioperative nurses' experiences of and reflections on operating theatre culture. Focus group discussions were used to collect data, which was analysed using hermeneutical text analysis. The results revealed three main categories of habits present in perioperative nursing culture: habits that promote ethical values (by temporary friendship with patients, showing respect (...) for each other, and spending time on reflection on ethics and caring); habits that hinder progress (by seeing the patient as a surgical case, not acknowledging colleagues, and not talking about ethics); and habits that set the cultural tone (the hidden power structure and achieving more in less time). We live in an increasingly globalizing world, in which countries are closely linked by international trade and investment ties. Cross-cultural comparative studies of national values and ethics have attracted growing research interest in recent years, because shared practices, values and ethical standards depend on shared beliefs. However, the findings of such studies have been unable to reach a consensus on the impact of culture on ethics-related attitudes and behavior. Empirically, many "cross–cultural" differences reported by previous studies might actually stem from (...) cross-national differences. In order to partially fill this gap, this study advocates an analytical framework that isolates the role of cultural and national differences in order to test their relationship to individual level variables. Within this framework, we test competing hypotheses based on both cultural and national contexts by comparing groups of Chinese and American respondents together with a "bridging group" of Chinese Chinese-Americans. Theoretically, this contextual approach helps resolve the debate on the role of culture, by showing that culture plays a far more important role in shaping value orientations than the national background. Specifically, the two ethnic Chinese groups had many cultural values in common, and differed significantly from the Caucasian group. Implications are discussed. (shrink)

The Shenzi Fragments is the first complete translation in any Western language of the extant work of Shen Dao (350–275 B.C.E.). Though his writings have been recounted and interpreted in many texts, particularly in the work of Xunzi and Han Fei, very few Western scholars have encountered the political philosopher's original, influential formulations. This volume contains both a translation and an analysis of the Shenzi Fragments. It explains their distillation of the potent political theories circulating in China during the Warring (...) States period, along with their seminal relationship to the Taoist and Legalist traditions and the philosophies of the Lüshi Chunqiu and the Huainanzi. These fragments outline a rudimentary theory of political order modeled on the natural world that recognizes the role of human self-interest in maintaining stable rule. Casting the natural world as an independent, amoral system, Shen Dao situates the source of moral judgment firmly within the human sphere, prompting political philosophy to develop in realistic directions. Harris's sophisticated translation is paired with commentary that clarifies difficult passages and obscure references. For sections open to multiple interpretations, he offers resources for further research and encourages readers to follow their own path to meaning, much as Shen Dao intended. The Shenzi Fragments offers English-language readers a chance to grasp the full significance of Shen Dao's work among the pantheon of Chinese intellectuals. (shrink)

Our view is that fundamental appetitive and defensive motivation systems evolved to mediate a complex array of adaptive behaviors that support the organism’s drive to survive—defending against threat and securing resources. Activation of these motive systems engages processes that facilitate attention allocation, information intake, sympathetic arousal, and, depending on context, will prompt tactical actions that can be directed either toward or away from the strategic goal, whether defensively or appetitively determined. Research from our laboratory that measures autonomic, central, and somatic (...) reactions when processing emotional scenes is described which indicates that motivationally relevant cues, whether appetitive or defensive, capture attention preferentially, prompt enhanced perceptual processing and information gathering, and occasion metabolic arousal that mobilizes the organism for coping actions. Annotated logics were introduced by V.S. Subrahmanian as logical foundations for computer programming. One of the difficulties of these systems from the logical point of view is that they are not structural, i.e., their consequence relations are not closed under substitutions. In this paper we give systems of annotated logics that are equivalent to those of Subrahmanian in the sense that everything provable in one type of system has a translation that is provable in the other. Moreover these new systems (...) are structural. We prove that these systems are weakly congruential, namely, they have an infinite system of congruence 1-formulas. Moreover, we prove that an annotated logic is algebraizable (i.e., it has a finite system of congruence formulas,) if and only if the lattice of annotation constants is finite. (shrink)

One Rawlsian response to G. A. Cohen’s criticisms of justice as fairness which Cohen canvasses, and then dismisses, is the 'Freedom Objection'. It comes in two versions. The 'First Version' asserts that there is an unresolved trilemma among the three principles of equality, Pareto-optimality, and freedom of occupational choice, while the 'Second Version' imputes to Rawls’s theory a concern to protect occupational freedom over equality of condition. This article is mainly concerned with advancing three claims. First, the 'ethical solution' Cohen (...) advances against the First Version of the Freedom Objection does not grant a fair hearing to the Freedom Objection. Second, the distinction Cohen presses between the legal and moral right of occupational choice in his response to the Second Version cannot save him from worries about Stalinist coercion. Third, Cohen’s response to the First Version of the Freedom Objection is actually in tension with his response to the Second Version of the Freedom Objection. (shrink)

Throughout the text of the _Han Feizi_, we see opposition to traditional (and often Confucian) perspectives on a wide range of state activities, both internally and externally. This antipathy towards the traditional morally-based criteria for justifying state actions extends to the questions of when, how, and if to wage war. In what we may today think of as reasoning akin to Western conceptions of political realism, Han Fei argues that considerations of morality have no place, either in questions of war (...) and peace or, indeed, in broader questions of politics more generally. This is not, though, to say that Han Fei is uninterested in broader questions of when ware and peace are justified. However, such justifications are based not to be justified by appeal to moral concerns. Rather, the fundamental question to be answered is how the strength, security, and flourishing of the state would be affected by warfare. By viewing questions of war and peace from the perspective of state consequentialism, Han Fei believes that we can ascertain the answers to questions not only about when and if to engage in warfare, but also to questions of what particular actions can be justified within the context of war. We present a semantic game for Gödel logic and its extensions, where the players’ interaction stepwise reduces arbitrary claims about the relative order of truth degrees of complex formulas to atomic ones. The paper builds on a previously developed game for Gödel logic with projection operator in Fermüller et al., Information processing and management of uncertainty in knowledge-based systems, Springer, Cham, 2020, pp. 257–270). This game is extended to cover Gödel logic with involutive negations and constants, and then lifted to (...) a provability game using the concept of disjunctive strategies. Winning strategies in the provability game, with and without constants and involutive negations, turn out to correspond to analytic proofs in a version of \ :1941–1958, 2010) and in a sequent-of-relations calculus, Automated reasoning with analytic tableaux and related methods, Springer, Berlin, 1999, pp. 36–51) respectively. Acton to Richard Simpson, 25 September 1861 The sixty-year period that culminated in the First World War witnessed a momentous transformation in the European state system. (...) Italian and German unification, the expulsion of the Ottomans from southeastern Europe, the destruction of the three remaining empires—the Austrian, German, and Russian—as casualties of the war, their replacement by a band of successor states stretching from the Baltic to the Balkans: these developments completely altered the face of Europe, as dynastic states gave way to nation-states. Looking back on this transformation once the war was over, many Europeans believed the decision to rebuild their continent on the basis of nation-states made perfect sense. To establish the principles of self-determination and democracy would contribute to peace and prosperity by solving the nationalities problem that had caused such mischief in the past. But in the 1860s, as this transformation was just beginning, the question looked very different, especially to the young John Dalberg Acton—the future Lord Acton, famous for the Cambridge Modern History—as he contemplated without benefit of hindsight the rise of the modern nation-state. 1 [End Page 129]Acton's views on the nation-state appeared in an article on "Nationality," which he wrote in 1862 for the Home and Foreign Review. 2 Nationality—today we would call it nationalism—was, Acton pointed out to his colleague Richard Simpson, a "new question in political philosophy" 3 ; and Acton's essay was a remarkably precocious treatment of the subject. In this tour de force he placed nationalism in its historical context, enabling readers to understand its significance for their own time and to see in nationalism the most potent force unleashed by the French Revolution. For Acton the Revolution had given a new direction to social protest. Whereas in the past, people had resisted oppression by calling for a return to traditional ways, now, after 1789, they demanded a new social and political order. The Revolution thus spawned protest movements of a wholly unprecedented kind. These movements were "spontaneous and aggressive," he warned. They were "popular, unreasoning, and almost irresistible." They appealed to the masses, encouraging them to be "arbitrary as well as insubordinate" and to disregard tradition, prescription, and established rights. The question, How is style possible? assumes the existence of style and sufficient evidence for this assertion, as well as for determining what it means, appears in the talk about style, in the deployment of stylistic categories. That talk extends in common usage to such attenuated references as styles in dress, styles of social exchange, life-styles. To limit the discussion, I speak here primarily of artistic style, but it will be clear that the ramifications of the argument extend beyond the (...) arts, indeed beyond style as well. When we pursue this line of inference, the practical question of what the use or function of stylistic analysis is plays a controlling role and in effect sets a dialectic in motion. For if, as I suggest, there is a stopping short in the first—adverbial or instrumental—model of style and an amending completeness in the first—verbial or transitive—model, that difference starts from their respective conceptions of the function which stylistic analysis and finally style itself serve. It is important, then, to keep the question of function in mind, to allow it to spend its own force; that question serves, in fact, as a mediating link between the appearance of style and the discourse about it, on the one hand, and the final question of how style is possible, on the other. The two models of style to be described differ explicitly on the last of these points, and they differ at least tacitly in their conception of the mediating link, the question of the function or use of style. Those differences in turn make a practical difference even in the immediate description of particular styles. As a potential approach to solve these difficult problems, tissue‐engineering techniques may provide a precise control on the different cell components of multicellular aggregates and the forming (...) of a construct with‐defined architectures and functional properties. The combined interactions between ESC‐derived pacemaker cells, supporting cells, and matrices may completely reproduce pacemaker properties and result in a steady functional unit to induce rhythmic electrical and contractile activities. As ESCs have a high capability for self‐renewal, proliferation, and potential differentiation, we hypothesize that ESCs can be used as a source of pacemaker cells for tissue‐engineering applications and the ambitious goal of biological cardiac pacemakers may ultimately be achieved with ESCs via tissue‐engineering technology. Art has the capacity to shape and alter our identities. It can influence who and what we are. Those who have had aesthetic experiences know this intimately, and yet the study of art’s impact on the mind struggles to be recognized as a centrally important field within the discipline of psychology. The main thesis of Art and Identity is that aesthetic experience represents a prototype for meaningful experience, warranting intense philosophical and psychological investigation. Re-Engineering Philosophy for Limited Beings is about new approaches to many of the big topics in philosophy of science today, but with a very different take. To begin with, we are urged to reject the received Cartesian-Laplacean myths: Descartes’ certainty and Laplace’s computational omniscience. Instead, Wimsatt re-engineers a philosophy for human beings with all their cognitive limitations. His approaches find their starting point in the actual practices of scientists themselves, which he strongly identifies with engineering practices as the source of (...) researchers’ solutions for dealing with a complex world. He aims to construct an understanding of scientific methodology around the central role of reduction. But he dismisses eliminative reductionism in favor of a heuristic-based realist view. Wimsatt’s world is a complex one, and this means that science needs to do away with all the absolute and simple answers, because they do not reflect the world we are living in. A complex world requires the mindset and tinkering of an engineer to uncover its reality. The appropriate response must be heuristics all the way down as we constantly seek out reliable inferences on often shifting ground. To this end, we aim for models and theories that are robust, just as engineers aim to build robust machines. And although errors occur and approaches are fallible, they allow us to continually adapt the heuristics applied and sharpen our perceptions so as to develop more refined tools for investigating and understanding the world.
