The rule ‘Keep your promises’ is often presented as a challenge to consequentialism, because the ground of your moral obligation not to break a promise seems to lie in the past fact that you made the promise, which is not a consequence of the act. A different picture emerges, however, when we move beyond the question of whether you have any moral obligation at all to the related question of how strong that obligation is.If I promise to (...) meet you and some other mutual friends for a casual lunch, then my moral obligation to meet you is not as strong as when I promise to drive you to the airport to catch an important flight. Why not? The natural answer is that, if I break the lunch promise, not much bad will happen. You will still have a pleasant lunch with our other friends, and you and I can still have lunch some other time. I have some moral obligation to meet you, but not a very strong one. In contrast, if I break my driving promise, then my failure will cause much more harm, assuming that you will not find another way to get to the airport in time for your flight. These harmful consequences to you seem to be what give strength to my moral obligation to keep this promise.The relevant kind of strength is measured by how much is needed to override the obligation. I would need much stronger reasons to justify breaking my promise to drive you to the airport than to justify breaking my promise to meet you for lunch. The principal aim of this book is to develop and defend an analysis of the concept of moral obligation. The analysis is neutral regarding competing substantive theories of obligation, whether consequentialist or deontological in character. What it seeks to do is generate solutions to a range of philosophical problems concerning obligation and its application. Amongst these problems are deontic paradoxes, the supersession of obligation, conditional obligation, prima facie obligation, actualism and possibilism, dilemmas, supererogation, and (...) cooperation. By virtue of its normative neutrality, the analysis provides a theoretical framework within which competing theories of obligation can be developed and assessed. This study is a major contribution to metaethics that will be of particular interest to all philosophers concerned with normative ethical theory. (shrink)

According to second‐personal approaches to moral obligation, the distinctive normative features of moral obligation can only be explained in terms of second‐personal relations, i.e. the distinctive way persons relate to each other as persons. But there are important disagreements between different groups of second‐personal approaches. Most notably, they disagree about the nature of second‐personal relations, which has consequences for the nature of the obligations that they purport to explain. We argue that individuals who have access to vaccines and for whom vaccination is not medically contraindicated have a moral obligation to contribute to the realisation of herd immunity by being vaccinated. Contrary to what some have claimed, we argue that this individual moral obligation exists in spite of the fact that each individual vaccination does not significantly affect vaccination coverage rates and therefore does not significantly contribute to herd immunity. Establishing the existence of a moral obligation (...) to be vaccinated despite the negligible contribution each vaccination can make to the realisation of herd immunity is important because such moral obligation would strengthen the justification for coercive vaccination policies. We show that two types of arguments—namely a utilitarian argument based on Parfit’s Principle of Group Beneficence and a contractualist argument—can ground an individual moral obligation to be vaccinated, in spite of the imperceptible contribution that any single vaccination makes to vaccine coverage rates. We add a further argument for a moral obligation to be vaccinated that does not require embracing problematic comprehensive moral theories such as utilitarianism or contractualism. The argument is based on a “duty of easy rescue” applied to collectives, which grounds a collective moral obligation to realise herd immunity, and on a principle of fairness in the distribution of the burdens that must be borne to realise herd immunity. Typical agreements can be seen as joint decisions, inherently involving obligations of a distinctive kind. These obligations derive from the joint commitment' that underlies a joint decision. One consequence of this understanding of agreements and their obligations is that coerced agreements are possible and impose obligations. It is not that the parties to an agreement should always conform to it, all things considered. Unless one is released from the agreement, however, one has some reason to conform to it, whatever else (...) is true. In this sense, one is under an obligation to the other parties. The Ethics of Need: Agency, Dignity, and Obligation argues for the philosophical importance of the notion of need and for an ethical framework through which we can determine which needs have moral significance. In the volume, Sarah Clark Miller synthesizes insights from Kantian and feminist care ethics to establish that our mutual and inevitable interdependence gives rise to a duty to care for the needs of others. Further, she argues that we are obligated not merely to meet others’ needs (...) but to do so in a manner that expresses "dignifying care," a concept that captures how human interactions can grant or deny equal moral standing and inclusion in a moral community. Many philosophers hold that whether an act is overall morally obligatory is an ‘objective’ matter, many that it is a ‘subjective’ matter, and some that it is both. The idea that it is or can be both may seem to promise a helpful answer to the question ‘What ought I to do when I do not know what I ought to do?’ In this article, three broad views are distinguished regarding what it is that obligation essentially concerns: the maximization (...) of actual value, the maximization of expected value, and the perceived maximization of actual value. The first and third views are rejected; the second view is then refined and defended. The unfortunate upshot is that there may be no very helpful answer to the question just mentioned. As to the question posed in the title of the article, the answer unsurprisingly depends on what ‘objective’ and ‘subjective’ are taken to mean. (Published Online November 24 2006). (shrink)

Legitimate political authority is often said to involve a “right to rule,” which is most plausibly understood as a Hohfeldian moral power on the part of the state to impose obligations on its subjects (or otherwise to change their normative situation). Many writers have taken the state’s moral power (if and when it exists) to be a correlate, in some sense, of an obligation on the part of the state’s subjects to obey its directives. Thus legitimate political authority is (...) said to entail a general obligation to obey the law, and a general obligation to obey the law is said to entail legitimate political authority. With some version of this idea in mind, many writers attempt to establish full (or partial) legitimate political authority by first arguing for the intermediate conclusion that there exists a general (or partial) obligation to obey the law. This article argues that such a strategy is fundamentally mistaken, because while legitimate authority does indeed entail an obligation to obey the law, an obligation to obey the law does not, in and of itself, entail legitimate authority. This can be referred to as “the reverse entailment problem.” To avoid this problem, a theory of political authority must argue directly for the existence of the appropriate kind of moral power on the part of the state. This article argues for the “value-based” conception of a moral power, which states, very roughly, that one person holds a power over another if there is sufficient value in the former possessing the capacity intentionally to impose an obligation on the latter (or otherwise to change her normative situation). This seemingly simple understanding of a moral power gives rise to surprisingly strong adequacy conditions on what can count as an acceptable theory of legitimate political authority, and these conditions decisively rule out most of the standard theories in the literature. The rapid growth of next-generation genetic sequencing has prompted debate about the responsibilities of researchers toward genetic incidental findings. Assuming there is a duty to disclose significant incidental findings, might there be an obligation for researchers to actively look for these findings? We present an ethical framework for analyzing whether there is a positive duty to look for genetic incidental findings. Using the ancillary care framework as a guide, we identify three main criteria that must be present to give (...) rise to an obligation to look: high benefit to participants, lack of alternative access for participants, and reasonable burden on researchers. Our analysis indicates that there is no obligation to look for incidental findings today, but during the ongoing translation of genomic analysis from research to clinical care, this obligation may arise. It begins by focusing on the relation between Kant's account of obligation and his view of autonomy, arguing that this leaves room for Kant to be a realist about value. Stern then considers where this places Kant in relation to the question of moral scepticism, and in relation to the principle of 'ought implies can', and examines this principle in its own right. I present a novel account of unconditional obligation and of its relationship to conditional obligation and bring this account to bear upon Chisholm's puzzle concerning contrary-to duty obligation.

In many histories of modern ethics, Kant is supposed to have ushered in an anti-realist or constructivist turn by holding that unless we ourselves 'author' or lay down moral norms and values for ourselves, our autonomy as agents will be threatened. In this book, Robert Stern challenges the cogency of this 'argument from autonomy', and claims that Kant never subscribed to it. Rather, it is not value realism but the apparent obligatoriness of morality that really poses a challenge to our (...) autonomy: how can this be accounted for without taking away our freedom? The debate the book focuses on therefore concerns whether this obligatoriness should be located in ourselves, in others or in God. Stern traces the historical dialectic that drove the development of these respective theories, and clearly and sympathetically considers their merits and disadvantages; he concludes by arguing that the choice between them remains open. Something is subject to luck if it is beyond our control. In Luck's Mischief, Haji argues that owing frequently to precluding our being able to otherwise, luck limits both the range of what is morally obligatory for us and things for which we are morally responsible.

The purpose of this paper is to reject what I call the entitlement model of directed obligation: the view that we can conclude from X is obligated to Y that therefore Y has an entitlement against X. I argue that rejecting the model clears up many otherwise puzzling aspects of ordinary moral interaction. The main goal is not to offer a new theory of obligation and entitlement. It is rather to show that, contrary to what most philosophers have (...) assumed, directed obligation and entitlement are not the same normative concept seen from two different perspectives. Since Oregon implemented its Death with Dignity Act, many additional states have followed suit demonstrating a growing understanding and acceptance of aid in dying processes. Traditionally, the patient has been the one to request and seek this option out. However, as Death with Dignity acts continue to expand, it will impact the role of physicians and bring up questions over whether physicians have the ethical obligation to facilitate a conversation about AID with patients during end of life discussions. Patients (...) have the right to make informed decisions about their health, which implies that physicians have an obligation to discuss with and inform patients of the options that will accomplish the patients’ goals of care. We will argue that physicians have an ethical obligation to inform certain patients about AID during end of life care discussions. We will also address what this obligation encompasses and explore guidelines of when and how these conversations should occur and proceed. Earlier guidelines, presented by various palliative care and ethics experts, for proceeding with such conversations have mostly agreed that the discussion of hospice and end of life care with patients should be initiated early and that the individual goals of a patient during the remaining duration of life should be thoroughly examined before discussion of appropriate options. In discussing AID, physicians should never recommend but inform patients about the basics so that they can make an informed decision. If patients express further interest in AID, the physician should open up the dialogue to address the reasoning behind this decision versus other possible treatments to ensure that patients clearly comprehend the process and implications of their decision. Ultimately, any end of life choice should be made by patients with the full capacity to express what they envision for the remaining duration of life and to comprehend the advantages and disadvantages of all the possible options. Objectivists about obligation hold that obligations are determined by all of the normatively relevant facts. Perspectivalists, on the other hand, hold that only facts within one's perspective can determine what we are obligated to do. In this paper I argue for a perspectivalist view. On my view, what you are obligated to do is determined by the normative reasons you possess. My argument for my view is anchored in the thought that our obligations have to be action-guiding in a (...) certain sense--we have to be able to act for the reasons that obligate us. I argue that we have this ability--the ability to act for the right reasons--only if we possess those reasons. Thus, objectivism is false. In the second half of the paper I argue that problems having to do with new information do not plague my particular perspectival view. (shrink)

If moral responsibilities prescribe how agents ought to behave, are there also intellectual responsibilities prescribing what agents ought to believe? Many theorists have argued that there cannot be intellectual responsibilities because they would require the ability to control whether one believes, whereas it is impossible to control whether one believes. This argument appeals to an “ought implies can” principle for intellectual responsibilities. The present paper tests for the presence of intellectual responsibilities in social cognition. Four experiments show that intellectual responsibilities (...) are attributed to believe things and that these responsibilities can exceed what agents are able to believe. Furthermore, the results show that agents are sometimes considered responsible for failing to form true beliefs on the basis of good evidence, and that this effect does not depend on the seriousness of the consequences for failing to form a belief. These findings clarify when and how responsibilities for belief are attributed, falsify a conceptual entailment between ability and responsibility in the intellectual domain, and emphasize the importance of objective truth in intellectual evaluations. Where does entitlement to trust come from? When we trust someone to φ, do we need to have reason to trust them to φ or do we start out entitled to trust them to φ by default? Reductivists think that entitlement to trust always “reduces to” or is explained by the reasons that agents have to trust others. In contrast, anti-reductivists think that, in a broad range of circumstances, we just have entitlement to trust. even if we don’t have positive (...) reasons to do so. In this paper, we argue for a version of anti-reductivism. Roughly, we argue that we have default entitlement to trust someone to φ so long as there is an operative norm that requires S to φ. At least in such circumstances (and absent defeaters), we don’t need any positive reasons to trust S to φ. (shrink)

In an influential paper, Peter Singer claims that affluent people have a strong obligation to relieve famine. If they fail, they allow others to die, and makes them murderers. In responding to this outrageous claim, which has given uneasy conscience to many, I show that Singer is engaged in indefensible moralizing that substitutes bullying for reasoned argument and gives a bad name to morality.

The moral principle of fairness or fair play is widely believed to be a solid ground for political obligation, i.e., a general prima facie moral duty to obey the law qua law. In this article, I advance a new and, more importantly, principled objection to fairness theories of political obligation by revealing and defending a justificatory gap between the principle of fairness and political obligation: the duty of fairness on its own is incapable of preempting the citizen’s (...) liberty to reciprocate fairly in ways other than obeying the law. This justificatory gap is unaffected by the ongoing debate between the voluntarist and the nonvoluntarist accounts of fairness, and it cannot be bridged by the two arguments that are perhaps implicit in Klosko’s account, namely the presumptive benefits argument and the democratic procedure argument. Whose Keeper? is a profound and creative treatise on modernity and its challenge to social science. Alan Wolfe argues that modern liberal democracies, such as the United States and Scandinavia, have broken with traditional sources of mortality and instead have relied upon economic and political frameworks to define their obligations to one another. Wolfe calls for reinvigorating a sense of community and thus a sense of obligation to the larger society.

This paper presents a nonmonotonic deontic logic based on commonsense entailment. It establishes criteria a successful account of obligation should satisfy, and develops a theory that satisfies them. The theory includes two conditional notions of prima facie obligation. One is constitutive; the other is epistemic, and follows nonmonotonically from the constitutive notion. The paper defines unconditional notions of prima facie obligation in terms of the conditional notions.

The second essay of Nietzsche's Genealogy of Morality (GM) offers a naturalistic and developmental account of the emergence of conscience, a faculty uniquely responsive to remembering and honoring obligations. This article attempts to solve an interpretive puzzle that is invited by the second essay's explanation of nonmoral obligation, prior to the capacity to feel guilt. Ostensibly, Nietzsche argues that the conscience and our concept of obligation originated within contractual (“creditor-debtor”) relations, when creditors punished delinquent debtors (GM II:5). However, (...) this interpretation, which I call the contractualist reading, is incoherent and subject to an insoluble bootstrapping problem. I argue instead that Nietzsche provides two accounts of nonmoral obligation in the second essay, and that the conscience originated in the morality of custom to track rule prohibitions (“I will nots” [GM II:3]), which Nietzsche conceives of as involuntary or reciprocal obligations that, unlike contractual debts, do not require the making of promises.
