In Japan, income, authority, and prestige are unequally distributed between men and women, even if they share the same occupational level. These inequalities are perceived as an ethical issue because they go against the principle of equal treatment at work. Nowadays, Japanese companies are under growing political and regulatory pressure to increase the hiring, promotion, and empowerment of female employees. In this context, the first equity index that tracks the financial performance of the best Japanese companies in terms of gender (...) diversity performance—the MSCI Japan Empowering Women Index —was launched in 2010. It aims to satisfy the growing demand of investors who want to reduce gender discrimination in Japanese workplaces. This paper compares the financial performance of the WIN stock index to the conventional parent index over the period 2010–2018, offering a unique setting to assess the effects of gender diversity screens on portfolio risk-adjusted performance. Our results are robust to a battery of risk-adjusted performance indicators and clearly indicate that investing in the WIN equity index does not come at a cost compared to investing in its conventional peer. This evidence is expected to reinforce confidence of investors who have an appetite for justice in increasing their investment in financial products that support the participation and the advancement of women in the Japanese workforce. This paper proposes an empirical assessment of the main factors behind the decision of a corporate sponsor to launch a socially responsible fund. Our analysis is performed on a database that encompasses 414 SR fund creations by 46 corporate sponsors between 1990 and 2012. We provide evidence that economic and human resources slack, leverage, low media coverage and high extra-financial performance of the corporate sponsor contribute to an increase of the probability to propose SR funds. These results lead us to (...) argue that the introduction of such funds goes beyond the economic objective of enlarging the market share of the corporate sponsor. It may thus be seen as a particular strategy in terms of communication and signaling, due to the specific characteristics of SR funds. (shrink)

We situate the well-trodden debate about defining health and disease within the project of a metaphysics of science and its aim to work with and contribute to science. We make use of Guay and Pradeu’s ‘metaphysical box’ to reframe this debate, showing what is at stake in recent attempts to move beyond it, revealing unforeseen points of agreement and disagreement among new and old positions, and producing new questions that may lead to progress. This essay discusses four key criticisms recently leveled against the main attempts to use conceptual analysis to understand health and disease. First, it examines the weaknesses of these attempts and suggests a better way to proceed. Next, it briefly discusses another disease debate concerning pathological mechanisms and suggests that this approach could be more fruitful than that of conceptual analysis. The final section demonstrates how Georges Canguilhem's biological philosophy of disease avoids some of the problems associated with conceptual analysis, and (...) how he can contribute to both debates. Canguilhem's appeal to biological normativity is understood as contributing to a theoretical explanation, and a possible naturalization, of what is specific to healthy and pathological phenomena. Debates in fields studying the biological aspects of aging and longevity, such as biogerontology, are often split between ‘anti-aging’ approaches aimed largely at treating diseases and those focusing more on maintaining, promoting, and even enhancing health. However, it is far from clear what this ‘health’ is that would be maintained, promoted, or enhanced. Interestingly, what few have yet to fully reflect on is that there is still no theory of health within the health or aging sciences that would provide an (...) integrative explanatory framework akin to other scientific theories. After clarifying why such a theory could be useful, I discuss five general features of medical theories that could be used to evaluate the utility of a given proposal. With these features in hand, I suggest that philosophers and scientists work together on analyzing actual medical research (experimental analysis), and the ways in which a theoretical construct of ‘health’ is being progressively identified and measured therein. I conclude by suggesting that research fields studying stress and aging might be particularly helpful in developing candidates for theory construction due to their broad scope, increasing specificity, and potential for providing integrative explanations. A critique of conversational epistemic contextualism focusing initially on why pragmatic encroachment for knowledge is to be avoided. The data for pragmatic encroachment by way of greater costs of error and the complementary means to raise standards of introducing counter-possibilities are argued to be accountable for by prudence, fallibility and pragmatics. This theme is sharpened by a contrast in recommendations: holding a number of factors constant, when allegedly higher standards for knowing hold, invariantists still recommend assertion (action), while contextualists do (...) not. Given the knowledge norm of assertion, if one recommendation is preferable to the other, the result favors the preferred recommendation's account of knowledge. In the final section, I offer a unification of these criticisms centering on the contextualist use of 'epistemic position'. Their use imposes on threshold notions of justification, warrant, or knowledge tests that are suitable only to unlimited comparative or scalar notions like confidence or certainty and places them at one with an important strand of sceptical reasoning. When we evaluate moral agents, we consider many factors, including whether the agent acted freely, or under duress or coercion. In turn, moral evaluations have been shown to influence our (non-moral) evaluations of these same factors. For example, when we judge an agent to have acted immorally, we are subsequently more likely to judge the agent to have acted freely, not under force. Here, we investigate the cognitive signatures of this effect in interpersonal situations, in which one agent (“forcer”) forces (...) another agent (“forcee”) to act either immorally or morally. The structure of this relationship allowed us to ask questions about both the “forcer” and the “forcee.” Paradoxically, participants judged that the “forcer” forced the “forcee” to act immorally (i.e. X forced Y), but that the “forcee” was not forced to act immorally (i.e. Y was not forced by X). This pattern obtained only for human agents who acted intentionally. Directly changing participants’ focus from one agent to another (forcer vs. forcee) also changed the target of moral evaluation and therefore force attributions. The full pattern of judgments may provide a window into motivated moral reasoning and focusing bias more generally; participants may have been motivated to attribute greater force to the immoral forcer and greater freedom to the immoral forcee. Existence Value has become an increasingly important concept as the use of cost benefit analysis has spread from traditional applications to attempts to place monetary value on, for instance, a rare wetland habitat. Environmental economists have generally accepted the tensions arising in the existence value concept from the range of recent applications, but it is argued here that their various attempts to resolve the difficulties have largely failed. Critics from outside economics, on the other hand, typically claim that the very (...) notion of existence value as understood in economics is flawed, and urge its abandonment altogether. This paper suggests instead a fundamental redefinition of existence value, which, it is argued, (i) explains a number of diverse problems posed by the usual meaning of the term in economics; (ii) does not strain the intentions of respondents to ' willingness-to-pay' surveys; (iii) is consistent with a more realistic model of rational choice in environmental decision-making; and (iv) is sensitive to criticisms from environmental ethics.2. This chapter elucidates one small sliver of the developments within the philosophy of mind. It has the dual aim of (a) clarifying Chaba's account of cognition and its objects and (b) examining some of the more profound philosophical consequences that flow from this Kadam Tibetan understanding of cognition. The first half of the chapter elucidates the Kadam understanding of the phenomenology of cognition. Here, the author argues that Chaba and his followers should be seen as endorsing a disjunctive theory of (...) perception. The second half takes up the issue of intentionality and how cognition engages objects that are not directly present to it. No piece of the present conjuncture is more alarming than the explosive growth of the American prison population since the late 1970s. The prison has been a critical element of American government since the early 19th century, but the mentalities of rule and the technologies of power linked to the prison, have changed several times during that history. Building more prison cells, therefore, does not have the same constancy of meaning that building more tanks or more strategic bombers does. While (...) the prison has played a crucial role in construction of successful political orders since the American Revolution, its role at present is unprecedented. In the current era of the neo_liberal, neo_conservative, post_New Deal state, which we can call for shorthand, the "Carceral State," the prison has become the very meaning of sovereignty: a steel leviathan in which an increasingly hollowed out version of the state comes to rest with brutal force on selected parts of the population. Metaphysical semantics is supposed to connect the nonfundamental to the fundamental in a distinctively “linguistic” way, explaining how nonfundamental truths can be grounded in fundamental facts , and so inducing a radically eliminative vision of the nonfundamental as mere talk. I wonder how the story goes when a single nonfundamental truth can be grounded in many different fundamental facts. For instance, the truth that Moore has hands can presumably be grounded in many different distributions of fields, arrangements of particles, vibrations (...) of strings, or whatnot. I am asking how metaphysical semantics can accommodate this sort of multiple realizability. (shrink)

Different animal groups exhibit a surprisingly diversity of sex determination systems. Moreover, even systems that are superficially similar may utilize different underlying mechanisms. This diversity is illustrated by a comparison of sex determination in three well‐studied model organisms: the fruitfly Drosophila melanogaster, the nematode Caenorhabditis elegans, and the mouse. All three animals exhibit male heterogamety, extensive sexual dimorphism and sex chromosome dosage compensation, yet the molecular and cellular processes involved are now known to be quite unrelated. The similarities must have (...) arisen by convergent evolution. Studies of sex determination demonstrate that evolution can produce a variety of solutions to the same basic problems in development. How may a society, in a morally defensible way, confront a past of injustice and suffering, and seek to break the spell of violence and disregard for human life? I begin by demonstrating the relevance of this question to the South African Truth and Reconciliation Commission, and I draw attention to André du Toit's long- standing interest in ways in which truth commissions may function to consolidate political change. In the second section of the article, I argue that truth commissions (...) should be regarded as a defensible moral compromise between the values of justice and social unity, and I criticize claims that truth commissions promote transitional justice, when that is understood as a distinctive conception of justice that emerges in circum stances of regime transition. In the third section, I criticize the claim that truth commissions are not a moral compromise at all but embody a superior, restorative conception of justice. I conclude by showing why retribution is required by criminal justice, and why truth commissions must be seen, not as an end in themselves, but as institutions whose function is to emphasize the importance of the rule of law, normal criminal justice, and legal recognition. Many philosophers have understood the representational dimension of affective states along the model of perceptual experiences. This paper argues affective experiences involve a kind of personal level affective representation disanalogous from the representational character of perceptual experiences. The positive thesis is that affective representation is a non-transparent, non-sensory form of evaluative representation, whereby a felt valenced attitude represents the object of the experience as minimally good or bad, and one experiences that evaluative standing as having the power to causally motivate (...) the relevant attitude. I show how this view can make sense of distinctive features of affective experiences, such as their valence and connection to value in a way which moves beyond current evaluativist views of affect. The *Kāśyapaparivarta, an early Mahāyāna sūtra, has a complex history. Sanskrit and Tibetan versions, and some of its Chinese translations, have been available to scholars for almost a century, thanks to Staël-Holstein’s 1926 editio princeps. Yet no comprehensive survey of available sources, or critical appraisal of their antecedants, has been published, and most importantly, essential Chinese materials have long been overlooked. The present contribution focuses most centrally on the Chinese translations of the scripture. In addition, the relation of the sūtra (...) to the Mahāratnakūṭa collection of forty-nine texts and the possible Indic origins of the latter are explored. (shrink)

Many issues are raised by thinking about “The Idea of Text in Buddhism.” This paper concentrates on scriptures of Indian Buddhism, and considers some of the questions raised or inspired by the papers presented at the 2019 Jerusalem conference on “The Idea of Text in Buddhism.” Consideration is given among other topics to multilingualism, in which context a comparison is offered with the traditions of the Targums in Jewish literature.

Within this paper, I examine Godless normative realism, a naturalistic explanation of morality given by Erik Wielenberg and determine whether the theory poses a threat to abductive moral arguments for the existence of God. In particular, I argue that Wielenberg’s theory is a possible explanation for the existence of moral facts and that it offers a motivation for one to act morally, but that theism, as a whole, remains a better explanation for the moral aspects of the world. To do (...) so, I defend the legitimacy of weak forms of DCT, identify a few areas in which Godless normative realism fails to explain moral aspects of the world, and conclude with a few reasons for thinking that the explanatory scope of theism is superior to that of Wielenberg’s theory. I conclude that abductive moral arguments for the existence of God remain largely unscathed by Godless normative realism. (shrink)

Freedom, and in particular, the freedom of human beings, is a hot topic within the field of metaphysics. In this paper, instead of arguing for the truth of a particular position on freedom, I explore whether a particular position, compatibilism, might be consistent with the existence of moral responsibility and retributive justice. To alleviate ambiguity, I construct a model by which the four primary positions on freedom might be clearly understood. I then distinguish between what I call ‘common-sense’ views of (...) moral responsibility, and ‘complex’ views of moral responsibility. I select a particular complex view, which I term the ‘virtue’ theory of moral responsibility, offer some justification for the sensibility of such a theory, and demonstrate how the virtue theory is consistent with compatibilism. Finally, I propose that retributive justice is consistent with the virtue theory of moral responsibility, and consequently, that retributive justice is consistent with compatibilism. (shrink)

Federal policies on human subjects research have performed a near‐about face. In the 1970s, policies were motivated chiefly by a belief that subjects needed protection from the harms and risks of research. Now the driving concern is that patients, and the populations they represent, need access to the benefits of research.

Properties come in clusters. It seems impossible, for instance, that a mass could float free, unattached to any other property. David Armstrong takes this as a reductio of the bundle theory and an argument for substrata, while Peter Simons and Arda Denkel reply by supplementing the bundle theory with accounts of property interdependencies. I argue against both views. Virtually all plausible ontologies turn out to be committed to the existence of free masses. I develop and defend the view that the (...) clustering of properties is a mere contingent truth, on grounds that properties can be subtracted one‐by‐one. This opens the door not just to the (unsupplemented) bundle theory, but also to any plausible account of the relation between objects and properties. (shrink)
