In 1935, the Nazi government introduced what came to be known as the abrogation of the pro- hibition of analogy. This measure, a feature of the new penal law, required judges to stray from the letter of the written law and to consider instead whether an action was worthy of pun- ishment according to the ‘sound perception of the people’ and the ‘underlying principle’ of existing criminal statutes. In discussions of Nazi law, an almost unanimous conclusion is that a system (...) of criminal law ought not to contain legislation of this sort. This conclusion is often based on how the abro- gation relates to the normative claim that the law ought to be predictable. In particular, it has been argued that since the law ought to be predictable, and since this type of analogy legis- lation implied, caused or contributed to the diminution of the law’s predictability, this type of legislation ought to be prohibited. In this paper, we argue that this argument is not entirely correct. While we believe that the law ought to be predictable and that there is evidence for the claim that the Nazis’ intro- duction of analogical reasoning implied, caused, or contributed to a diminution of predictability, this fact is logically too weak to ground the conclusion that necessarily a penal system ought not to contain legislation of this kind. Despite the undeniable wickedness of the Nazi penal system, this type of analogical reasoning can be made consistent with the pre- dictability of the law. We argue that consistency of this sort depends on whether the use of analogy is supplemented by certain contextual background conditions. The occurrence of these conditions blocks an inference from the fact that the law ought to be predictable to the conclusion that a penal system ought not to allow for this type of analogical reasoning. In a penetrating analysis of student unrest, the Dean for Institute Relations at M.I.T (and former chief of the psychiatric services both there and at Wellesley College) isolates a major cause of campus conflict: the overwhelming, nonproductive mass of unstated academic and social norms that divert the student from creative intellectual effort and from the attempt to define and reach his goals as independently as he is able.

Many philosophical discussions of the narrative self touch upon the end of life. End-related terms and concepts that occur in these discussions include finitude, completion, closure, telos, retroactive meaning-conferral, life shape, and a closed beginning-middle-and-end structure. Those who emphasise life’s end in non-philosophical narrative contexts are perhaps clearer on its significance. The end is thought to play a key role in the story of a life, securing or enhancing the life narrative’s meaning or value, and thereby warranting special treatment and (...) attention. Call this thought ‘the special-ends hypothesis’. In this paper, I test the applicability of the special-ends hypothesis within philosophical narrativist accounts of the self. I examine narrativist claims pertaining to the end of life, taking seriously the specific terms they deploy, and considering the contexts in which they occur. Superficially it seems that narrativists endorse the special-ends hypothesis, overtly or by implication. But as perspective is gained on the broader theoretical context in which the concepts are situated, this apparent support diminishes. Ultimately, for most narrativists, the end of life has no special role to play in securing or enhancing the meaning or value of life as a whole. (shrink)

This article discusses two views associated with narrative conceptions of the self. The first view asserts that our whole life is reasonably regarded as a single unit of meaning. A prominent strand of the philosophical narrative account of the self is the representative of this view. The second view—which has currency beyond the confines of the philosophical narrative account—is that the meaning of a life story is dependent on what happens at the end of it. The article argues that the (...) connection between these two views is more tentative than often supposed: philosophical narrativists that see life as a single unit of value and meaning nonetheless provide grounds for arguing that the end of life is not the best and may be a particularly bad time to approach and intervene in the matter of how well one's life as a whole has gone. We write as Australian youth work educators. We consider some of the ethical challenges involved in teaching youth work ‘in a warm climate’, situated in the diaspora of English youth work but where youth work also has a uniquely Australian character, placing us in an ethically liminal space in our teaching between an understanding of youth work that is robustly defended as being both ‘good’ and ‘true’, and what we do, which is different from this, and has its own character (...) and strengths. We situate this in the policy history of youth work in Australia, particularly in the ‘neoliberal turn’ that this has taken in the last four decades which has created ethical challenges for us, just as it has for those elsewhere. Two guiding questions shape this paper. The first is, given our differences, what challenges do we face in maintaining connections with ‘good’ youth work and its value base as traditionally defined and defended in England, and relatedly, given that policy and funding regimes in the UK seem to be aligning more with an Australian model, is there anything that the youth work community in the UK can learn from the Australian experience? We examine the perceived importance of three organizational preconditions theorized to be critical for ethics program effectiveness. In addition, we examine the importance of ethical leadership and congruence between formal ethics codes and informal ethical norms in influencing employee perceptions. Participants from a large southern California government agency completed a survey on the perceived effectiveness of the organization’s ethics program. Results suggest that employee perceptions of organizational preconditions, ethical leadership and informal ethical norms were related to perceptions of ethics program (...) effectiveness. Based on these findings, organizations should evaluate the presence of essential preconditions and take steps to ensure that leaders model espoused organizational values to foster perceptions of effective ethics programs. The growth of autistic self-advocacy and the neurodiversity movement has brought about new ethical, theoretical and ideological debates within autism theory, research and practice. These debates have had genuine impact within some areas of autism research but their influence is less evident within early intervention research. In this paper, we argue that all autism intervention stakeholders need to understand and actively engage with the views of autistic people and with neurodiversity as a concept and movement. In so doing, intervention researchers (...) and practitioners are required to move away from a normative agenda and pay diligence to environmental goodness-of-fit, autistic developmental trajectories, internal drivers and experiences, and autistic prioritized intervention targets. Autism intervention researchers must respond to these debates by reframing effectiveness, developing tools to measure autistic prioritized outcomes, and forming partnerships with autistic people. There is a pressing need for increased reflection and articulation around how intervention practices align with a neurodiversity framework and greater emphasis within intervention programmes on natural developmental processes, coping strategies, autonomy, and well-being. This provocative work provides a radical reassessment of the emergence and nature of Christian sexual morality, the dominant moral paradigm in Western society since late antiquity. While many scholars, including Michel Foucault, have found the basis of early Christian sexual restrictions in Greek ethics and political philosophy, Kathy L. Gaca demonstrates on compelling new grounds that it is misguided to regard Greek ethics and political theory—with their proposed reforms of eroticism, the family, and civic order—as the foundation of Christian (...) sexual austerity. Rather, in this thoroughly informed and wide-ranging study, Gaca shows that early Christian goals to eradicate fornication were derived from the sexual rules and poetic norms of the Septuagint, or Greek Bible, and that early Christian writers adapted these rules and norms in ways that reveal fascinating insights into the distinctive and largely non-philosophical character of Christian sexual morality. Writing with an authoritative command of both Greek philosophy and early Christian writings, Gaca investigates Plato, the Stoics, the Pythagoreans, Philo of Alexandria, the apostle Paul, and the patristic Christians Clement of Alexandria, Tatian, and Epiphanes, freshly elucidating their ideas on sexual reform with precision, depth, and originality. Early Christian writers, she demonstrates, transformed all that they borrowed from Greek ethics and political philosophy to launch innovative programs against fornication that were inimical to Greek cultural mores, popular and philosophical alike. The Septuagint's mandate to worship the Lord alone among all gods led to a Christian program to revolutionize Gentile sexual practices, only for early Christians to find this virtually impossible to carry out without going to extremes of sexual renunciation. Knowledgeable and wide-ranging, this work of intellectual history and ethics cogently demonstrates why early Christian sexual restrictions took such repressive ascetic forms, and casts sobering light on what Christian sexual morality has meant for religious pluralism in Western culture, especially among women as its bearers. Employee attributions and emotional reactions to unethical behavior of top leaders in an organization recently involved in a highly publicized ethics scandal were examined. Participants (n = 76) from a large southern California government agency completed an ethical climate assessment. Secondary data analysis was performed on the written commentary to an open-ended question seeking employees' perceptions of the ethical climate. Employees attributed the organization's poor ethical leadership to a number of causes, including: lack of moral reasoning, breaches of trust, hypocrisy, (...) and poor ethical behavior role modeling. Emotional reactions to corruption included cynicism, optimism, pessimism, paranoia and fear, and were targeted at top leaders, organizational practices (i.e., the old boy network, nepotism, and cronyism) and ethics interventions. Implications for leadership training and other organizational ethics interventions are discussed. (shrink)

Non-human animals are as a matter of routine used as means to human ends. They are killed for food, employed for labour or sport, and experimented on in the pursuit of human health, knowledge, comfort and beauty. Lip-service is paid to the obligation to cause no unnecessary suffering, but human necessity is interpreted so generously that this is a negligible constraint. The dominant traditions of Western thought, religious and secular, have provided legitimation of the low or non-existent moral status of (...) beasts. The rival tradition, which includes the Neo-Platonists, Plutarch and Montaigne, is eccentric and archaic. But the teleologies and hierarchies of orthodoxy are equally incredible now and owe their greater respectability and influence to the inertia of custom. Disregard for beasts is supported partly by the vestigial and unowned belief that they are intended for our use, partly by a more recent piece of lore which is not only thought to be compatible with, but is sometimes held to be integral to, an enlightened scientific outlook, namely that beasts are mere complex stimulus—response mechanisms. The latter is a vexatious obstacle to progress but despite that the state of scientific and philosophical knowledge is now enormously more propitious for a re-appraisal of the moral status of beasts. Two moral philosophers, Peter Singer and Stephen Clark, have recently published books in which such a re-appraisal is attempted. Here I try to compare and assess some of the main features of their very different approaches. (shrink)

The purpose of this study is to explore customers’ orientation toward return behaviors, and to develop a return orientation assessing these dimensions. This research identified three dimensions relevant to consumer return behavior: the planned/unethical returner; the eager returner; and the reluctant/educated returner. A retest with another sample confirmed these three dimensions. Each dimension was analyzed for its relationship with (...) consumer ethical beliefs as measured by the Muncy–Vitell Consumer Ethics Scale, ethical philosophies and shopping behaviors. These relationships supported the ethical and unethical aspects of returner orientation. Results of this research imply that the core aspect of returner orientation is relevant to ethical behavior and misuse of retail return policies. abstract Why do we routinely betray moral commitments that, in some sense, we authentically embrace? One explanation involves inattention: failure to attend to morally important aspects of our lives. Inattention ranges from an unmotivated lack of focus, or “simple” inattention, to more purposeful and wilful self‐deception. Self‐deception has received exhaustive and insightful treatment by philosophers and psychologists; what remains unexamined is the less complex, but more pervasive phenomenon of simple inattention. Since inattention is at least equally important in accounting for (...) our routine moral failures, this gap is an important one to fill. In this essay I examine moral dimensions of inattention: what makes it problematic, what vices it reflects, what duties we have to overcome it, and how we might try to do that. I argue that inattention obscures responsibilities to prevent harm, erodes autonomy, manifests a lack of virtue, and undermines integrity. For these reasons, we have obligations of attentiveness. I propose that we should attend (at least) to apparent violations of our moral values in which we are personally implicated, which we have power to affect, and to which we have been directed by clues that something is amiss. I end with practical suggestions for enhancing our attentiveness. (shrink)

There is a fear of death that persistently eludes adequate explanation by contemporary philosophers of death. The reason for this is their focus on mortal harm issues, such as why death is bad for the person who dies. Claims regarding the fear of death are assumed to be contingent on the resolution of questions about the badness of death. In practice, however, consensus on some mortal harm issues has not resulted in comparable clarity on mortal fear. I contend we cannot (...) do justice to fear of death unless we detach it from theories about the badness of death, including the overwhelmingly-popular deprivation theory. The case for this involves disambiguation of certain aspects of mortal harm, a broad conception of what is involved in accounting for an emotion, and close attention to the nature of the fear in question. The source of fear of death is our departure from a context in which self-directed emotions have coherent application; our attitudes become ‘unmoored,’ in Samuel Scheffler’s phrase. While this does not result in a fear that is sui generis, it does demand that we remove the object of fear from the realm of well-being in order to make sense of it. (shrink)

This article contributes to the development of a professional responsibility theory of public relations ethics. Toward that end, we examine the roles of a public relations practitioner as a professional, an institutional advocate, and the public conscience of institutions served. In the article, we review previously suggested theories of public relations ethics and propose a new theory based on the public relations professional's dual obligations to serve client organizations and the public interest.

This book focuses on the significance of the body in contemporary feminist scholarship. Whether the body is treated as biological bedrock or subversive metaphor, it is implicated in the cultural and historical construction of sexual difference as well as asymmetrical power relations. The contributors to this volume examine the role of the body as socially shaped and historically colonized territory and as the focus of individual womenÆs struggles for autonomy and self-determination. They also analyze its centrality to the feminist critique (...) of male-stream science as dualistic, distanced, and decontextualized. While the body has become a "hot item" in contemporary social theory and research, the renewed interest has received a mixed reaction from feminists. The body may be back, but the "new" body theory often proves to be just as disembodied as it ever was. The body revival seems to be less an attempt to re-embody masculinist science than just another expression of the same condition that evoked the feminist critique in the first place: a flight from femininity and everything that is associated with it in Western culture. Drawing on insights from contemporary feminist theories of gender and power, this book offers a timely critical appraisal of the recent "body revival." Embodied Practices not only sets an agenda for research about the body, but for an embodied perspective on the body as well. The contemporary animal rights movement encompasses a wide range of sometimes-competing agendas from vegetarianism to animal liberation. For people for whom pets are family members—animal lovers outside the fray—extremist positions in which all human–animal interaction is suspect often discourage involvement in the movement to end cruelty to other beings. In _Loving Animals_, Kathy Rudy argues that in order to achieve such goals as ending animal testing and factory farming, activists need to be better attuned to the profound emotional, even (...) spiritual, attachment that many people have with the animals in their lives. Offering an alternative to both the acceptance of animal exploitation and radical animal liberation, Rudy shows that a deeper understanding of the nature of our feelings for and about animals can redefine the human–animal relationship in a positive way. Through extended interviews with people whose lives are intertwined with animals, analysis of the cultural representation of animals, and engaging personal accounts, she explores five realms in which humans use animals: as pets, for food, in entertainment, in scientific research, and for clothing. In each case she presents new methods of animal advocacy to reach a more balanced and sustainable relationship association built on reciprocity and connection. Using this intense emotional bond as her foundation, Rudy suggests that the nearly universal stories we tell of living with and loving animals will both broaden the support for animal advocacy and inspire the societal changes that will improve the lives of animals—and humans—everywhere. As bearers of the divine image, all of us are storytellers and artists. However, few people today believe in truth that is not empirically knowable or verifiable, the sort of truth often trafficked through direct forms of communication. Drawing on the works of Soren Kierkegaard, Benson P. Fraser challenges this penchant for direct forms of knowledge by introducing the indirect approach, which he argues conveys more than mere knowledge, but the capability to live out what one takes to be (...) true. Dr. Fraser suggests that stories aimed at the heart are powerful instruments for personal and social change because they are not focused directly on the individual listener; rather, they give the individual room or distance to reconsider old meanings or ways of understanding. Indirect communication fosters human transformation by awaking an individual to attend to images or words that carry deep symbolic force and that modify or replace one's present ways of knowing, and ultimately make one capable of embodying what he or she believes. Erasmus' Adages, a vast collection of the proverbial wisdom of Greek and Roman antiquity, was published in 1508 and became one of the most influential works of the Renaissance. It also marked a turning point in the history of Western thinking about literary property. At once a singularly successful commercial product of the new printing industry and a repository of intellectual wealth, the Adages looks ahead to the development of copyright and back to an ancient philosophical tradition that ideas should (...) be universally shared in the spirit of friendship. Engaging in self-narrative is often touted as a powerful antidote to the bad effects of illness. However, there are various examples of what may broadly be termed “aversion” to illness narrative. I group these into three kinds: aversion to certain types of illness narrative; aversion to illness narrative as a whole; and aversion to illness narrative as an essentially therapeutic endeavor. These aversions can throw into doubt the advantages claimed for the illness narrator, including the key benefits of repair to (...) the damage illness does to identity and life-trajectory. Underlying these alleged benefits are two key presuppositions: that it is the whole of one’s life that is narratively unified, and that one’s identity is inextricably bound up with narrative. By letting go of these assumptions, illness narrative advocates can respond to the challenges of narrative aversions. (shrink)
