The goal of this paper is to define and analyze systems which exhibit brittle behavior. This behavior is characterized by a sudden and steep decline in performance as the system approaches the limits of tolerance. This can be due to input parameters which exceed a specified input, or environmental conditions which exceed specified operating boundaries. An analogy is made between brittle commmunication systems in particular and materials science.

European Enlightenment thinkers like Emer de Vattel in his epic work The Laws of Nations argued that engaging in warfare should comply, as much as possible, with humane rules in the treatment of both combatants and noncombatants. Encapsulated by the phrase jus in bello, or justice in warfare, the question remains whether this idealist doctrine had application in military actions conducted during the Revolutionary War fought over the issue of American independence. This essay concludes that in such frontier regions as (...) the Mohawk Valley of New York, the doctrine of jus in bello had virtually no impact in restraining wartime cruelties. What actually occurred in such areas was vicious partisan warfare, or a contagion of violence characterized by brutal retribution and retaliation among combatants, along with merciless actions directed against civilian noncombatants. The Revolutionary War, at least in regions like frontier New York where partisan fighting predominated, had more in common wit.. (shrink)

The modern practice of organ donation after cardiocirculatory death (DCD) emerged in the 1990s as a response to the alarmingly wide gap between the number of transplantable organs available through organ donation after neurological death and the urgent organ transplantation needs of persons in end-organ failure. Various important ethical dimensions of DCD have been considered and debated by prominent organ donation/transplantation theorists and clinicians.In this article, consideration of some of these ethical elements provides a foundation for a proposed set of (...) ethically informed, pragmatic conditions that could assist in the development of health policies to guide the practice of organ donation after cardiocirculatory death. Since the global financial crisis in 2008, corporations have faced a crisis of trust, with growing sentiment against ‘elites and ‘big business’ and a feeling that ‘something ought to be done’ to re-establish public regard for corporations. Trust and trustworthiness are deeply moral significant. They provide the ‘glue or lubricant’ that begets reciprocity, decreases risk, secures dignity and respect, and safeguards against the subordination of the powerless to the powerful. However, in deciding how to restore trust, it is difficult to (...) determine precisely what should be done, by whom, and who will bear the cost, especially if any action involves a risk to overall market efficiency and corporate profitability. The paper explores whether corporations have a moral duty to be trustworthy, to bear the cost of being so and thus contribute to resolving the current crisis of trust. It also considers where the state and other social actors have strong reason to protect and enforce such moral rights, while acknowledging that other actors have similar obligations to be trustworthy. It outlines five ‘salient factors’ that trigger specific rights to trustworthiness and a concomitant duty on corporations to be trustworthy: market power, subordination (threat and intimidation), the absence of choice, the need to preserve systemic trust, and corporate political power which might undermine a state’s legitimacy. Absent these factors and corporations do not have a general duty to be trustworthy, since a responsible actor in fair market conditions should be able to choose between the costs and benefits of dealing with generally trustworthy corporations. This article explores the controversial practice of transnational gestational surrogacy and poses a provocative question: Does it have to be exploitative? Various existing models of exploitation are considered and a novel exploitation-evaluation heuristic is introduced to assist in the analysis of the potentially exploitative dimensions/elements of complex health-related practices. On the basis of application of the heuristic, I conclude that transnational gestational surrogacy, as currently practiced in low-income country settings , is exploitative of surrogate women. Arising out of consideration of (...) the heuristic's exploitation conditions, a set of public education and enabled choice, enhanced protections, and empowerment reforms to transnational gestational surrogacy practice is proposed that, if incorporated into a national regulatory framework and actualized within a low income country, could possibly render such practice nonexploitative. The 2008 financial crisis has raised serious ethical questions about behaviors associated with the free market system and the effectiveness of undergraduate business ethics education. We offer opposing interpretations of the crisis, a “Markets Work” and a “Critical” perspective, in order to provide students with an opportunity to examine their ethical assumptions. We frame our discussion around legitimacy; therefore, we utilize an institutional theory lens to frame the processes by which financial organizations are rewarded with social legitimacy for using “proper” (...) structures and following “appropriate” procedures and punished when they do not. By presenting these two opposing narratives of the crisis, we provide a richer framework for discussing the crisis and relating it to the larger issue of corporate malfeasance. We draw upon a wealth of readily available, easily accessible material. We identify films, readings, and provide notes that may use to set the direction and tenor of classroom discussion. (shrink)

This chapter examines Thoreau’s experiences on Mt. Katahdin, vis-à-vis exposure science and wilderness therapy. A close reading of Thoreau’s account suggests the experience had a profound effect on him, emotionally and philosophically, an effect that is relevant to environmental exposure and eco-vulnerability in the contexts of the COVID-19 pandemic and climate change. Thoreau’s experience on that mountain presented to him an aspect of wilderness antithetical to the romantic, transcendentalist notions he previously held and ultimately led to more nuanced, therapeutic depictions (...) found in works like “Walking” and Walden. That such a reconciliation was possible for Thoreau suggests a privileged insulation from trauma not afforded to many. It also indicates the value of both philosophical contemplation and wilderness therapy to promote psychological resilience and adaptability. The author argues philosophers should begin to engage conceptually and normatively with exposure, vulnerability, and resilience. (shrink)

In this article I claim that service-learning experiences, wherein students work directly with individuals in need—individuals from whom studentscan learn what they cannot learn elsewhere—are invaluable, and perhaps necessary, for any curriculum with an aim toward the development of ethical understanding, personal moral character and commitment, and/or conscientious citizenship, both local and global. My argument rests on Emmanuel Levinas’s philosophical ethical theory that re-envisions the ethical relation as arising out of revelation from the unique and precious Other, rather than reason (...) and the rational determinations and conceptions of the ethical agent. This study assesses the impact had by institutional isomorphic pressures in the organisational fields of 185 businesses operating within the United Kingdom. The emphasis throughout is on how external institutions affect the socially and environmentally responsible aspects of an organization’s purchasing practice. Factor analyses and a linear regression model are employed to test the influence of these pressures. Initial findings suggest that what other industry participants are doing in this area is not as important in affecting the procurement practice of (...) the focal organisation as is the managers’ perception of how legitimacy is awarded by stakeholders and, indeed, if competitors with well-developed social and environmental supply chain management programs are perceived favourably in the industry. This paper will focus on two elements, viz. experience and inquiry, which are central to John Deweys philosophy and their relation to the movement known as pragmatism. Although each of these concepts has received extensive treatment by other schools of thought, the pragmatists, and particularly Dewey, did much to redefine each in hopes of alleviating the tension between conflicting philosophical viewpoints. An explication of Deweys view on experience is the first step in understanding his application of the pragmatic method towards (...) reconstructing philosophical thinking. Therefore, this paper will explore the meaning that Dewey gave to each and how that meaning is helpful to the overall pragmatist project of reuniting philosophical speculation with practical consequences. This dissertation will compare the concept of nature as it appears in the philosophies of the American pragmatist John Dewey and the Chinese daoist Zhuangzi and will defend two central claims. The first of these is that Dewey and Zhuangzi share a view of nature that is non-reductive, philosophically liberal, and more comprehensive than the accounts recurrent in much of the Western tradition. This alternate conception of nature is non-reductive in the way that it avoids the physically mechanistic outlook underwriting (...) much of contemporary Anglo-American thought. It is philosophically liberal in that it accepts a more generous and progressive position than predominant Western orthodoxies. And, it is more comprehensive in scope insofar as it draws as much from the social sciences as it does from the natural sciences. The second claim defended will be that the synoptic vision gained from such a comparison offers a new heuristic program for research into the philosophical position known as naturalism, a program that can, at once, avoid the scientistic tendencies of the current, mainstream treatment of nature and reconnect with earlier, more inclusive models. Where Dewey's and Zhuangzi's ideas converge, one finds similarities in the prescriptions each made for human action, and where they differ, one finds mutually complementary insights. Finally, this heuristic will be used to refute various interpretations of Dewey and Zhuangzi that tend to understate or ignore the importance of nature within their schemes. (shrink)

In an article entitled “Is an Aristotelian Philosophy of Mind Still Credible? A Draft,” Myles Burnyeat suggested that we might do “what the seventeenth century did . . . [with the Aristotelian concept of the mind] . . . junk it.” Burnyeat buttressed this controversial claim, in large part, on the premise that it is difficult to believe that mental facts are not supervenient on physical facts in the wake of post-enlightenment thinking. Various valiant attempts to save Aristotle’s philosophy of (...) mind from being junked soon followed. One strategy that found favor among some scholars was that of arguing that Aristotle’s physics really is not in conflict with the idea that mental facts supervene upon physical facts. Scholars such as Michael Wedin and Victor Caston read Aristotle as maintaining a supervenience thesis in Physics 7.3. I disagree with the view that ascribes supervenience physicalism to Aristotle. The general strategy for providing support for my view is as follows: I first aim to discredit the view that ascribes supervenience physicalism to Aristotle on the basis of Physics 7.3. Thereafter, I turn to more psychological and biological texts to argue that Aristotle’s central views therein are unfriendly to supervenience physicalism. (shrink)

In "Contextualism and Confusability" I defend Epistemological Contextualism. Contextualists think that the statements "I know that I have hands," "I don't know that I'm not a brain in a vat," and "if I don't know that I'm not a brain in a vat, I don't know that I have hands," are all true—albeit not simultaneously. The first statement is true when an individual is not cognizant of the hypothesis that he might be a brain in a vat receiving just those (...) sense impressions he is currently receiving. However, once the hypothesis is considered, the standards for knowing become more strict—so strict that the statement "I know that I have hands" is false. People have mistakenly thought that the three statements present a paradox because they have failed to recognize that the skeptical hypothesis really does issue in stricter standards for knowing.The main critic of this approach has been Stephen Schiffer. Schiffer believes that it is implausible that language users would overlook the context sensitivity at work. I begin by explaining and setting out the virtues of accepting the contextualist approach to skepticism. Subsequently, I set out Schiffer's argument and attempt to meet Schiffer's criticism. Specifically, I argue that people can confuse the context of an utterance when that context is relatively unfamiliar. The reason one mistakenly thinks that he knows he has hands, while entertaining the skeptical hypothesis, is that he is overwhelmingly more familiar with the context in which he knows that he has hands. Institutional review boards, tasked with facilitating ethical research, are often pulled in competing directions. In what we call the protection-inclusion dilemma, we acknowledge the tensions IRBs face in aiming to both protect potential research participants from harm and include under-represented populations in research. In this manuscript, we examine the history of protectionism that has dominated research ethics oversight in the United States, as well as two responses to such protectionism: inclusion initiatives and critiques of the term vulnerability. We look at (...) what we know about IRB decision-making in relation to protecting and including “vulnerable” groups in research and examine the lack of regulatory guidance related to this dilemma, which encourages protection over inclusion within IRB practice. Finally, we offer recommendations related to how IRBs might strike a better balance between inclusion and protection in research ethics oversight. (shrink)

This book explores issues at the core of modern linguistics and cognitive science. Why are all languages similar in some ways and in others utterly different? Why do languages change and change variably? How did the human capacity for language evolve, and how far did it do so as an innate ability? Simon Kirby looks at these questions from a broad perspective, arguing that they can be studied together. The author begins by examining how far the universal properties of (...) language may be explained by examining the way it is used, and how far by the way it is structured. He then considers what insights may be gained by combining functional and formal approaches. In doing so he develops a way of treating language as an adaptive system, in which its communicative and formal roles are both crucial and complementary. In order to test the effectiveness of competing theories and explanations, Simon Kirby develops computational models to show what universals emerge given a particular theory of language use or acquisition. He presents here both the methodology and the results. Function, Selection, and Innateness is important for its argument, its methodology, and its conclusions. It is a powerful demonstration of the value of looking at language as an adaptive system and goes to the heart of current debates on the evolution and nature of language. (shrink)

We set out an account of how self-domestication plays a crucial role in the evolution of language. In doing so, we focus on the growing body of work that treats language structure as emerging from the process of cultural transmission. We argue that a full recognition of the importance of cultural transmission fundamentally changes the kind of questions we should be asking regarding the biological basis of language structure. If we think of language structure as reflecting an accumulated set of (...) changes in our genome, then we might ask something like, “What are the genetic bases of language structure and why were they selected?” However, if cultural evolution can account for language structure, then this question no longer applies. Instead, we face the task of accounting for the origin of the traits that enabled that process of structure-creating cultural evolution to get started in the first place. In light of work on cultural evolution, then, the new question for biological evolution becomes, “How did those precursor traits evolve?” We identify two key precursor traits: the transmission of the communication system through learning; and the ability to infer the communicative intent associated with a signal or action. We then describe two comparative case studies—the Bengalese finch and the domestic dog—in which parallel traits can be seen emerging following domestication. Finally, we turn to the role of domestication in human evolution. We argue that the cultural evolution of language structure has its origin in an earlier process of self-domestication. (shrink)

How do cognitive biases and mechanisms from learning and use interact when a system of language conventions emerges? We investigate this question by focusing on how transitive events are conveyed in silent gesture production and interaction. Silent gesture experiments have been used to investigate cognitive biases that shape utterances produced in the absence of a conventional language system. In this mode of communication, participants do not follow the dominant order of their native language, and instead condition the structure on the (...) semantic properties of the events they are conveying. An important source of variability in structure in silent gesture is the property of reversibility. Reversible events typically have two animate participants whose roles can be reversed. Without a syntactic/conventional means of conveying who does what to whom, there is inherent unclarity about the agent and patient roles in the event. In experiment 1 we test a novel, fine-grained analysis of reversibility. Presenting a silent gesture production experiment, we show that the variability in word order depends on two factors that together determine how reversible an event is. We relate our experimental results to principles from information theory, showing that our data support the “noisy channel” account of constituent order. In experiment 2, we focus on the influence of interaction on word order variability for reversible and non-reversible events. We show that when participants use silent gesture for communicative interaction, they become more consistent in their usage of word order over time, however, this pattern less pronounced for events that are classified as strongly non-reversible. We conclude that full consistency in word order is theoretically a good strategy, but word order use in practice is a more complex phenomenon. (shrink)

Through cultural transmission, repeated learning by new individuals transforms cultural information, which tends to become increasingly compressible . Existing diffusion chain studies include in their design two processes that could be responsible for this tendency: learning and reproducing . This paper manipulates the presence of learning in a simple iterated drawing design experiment. We find that learning seems to be the causal factor behind the increase in compressibility observed in the transmitted information, while reproducing is a source of random heritable (...) innovations. Only a theory invoking these two aspects of cultural learning will be able to explain human culture's fundamental balance between stability and innovation. (shrink)

New materialisms argue for a more science-friendly humanities, ventilating questions about methodology and subject matter and the importance of the non-human. However, these new sites of attention - climate, biology, affect, geology, animals and objects - tend to leverage their difference against language and the discursive. Similarly, questions about ontology have come to eclipse, and even eschew, those of epistemology. While this collection of essays is in kinship with this radical shake-up of how and what we study, the aim is (...) to re-navigate what constitutes materiality. These efforts are encapsulated by a rewriting of the Derridean axiom, 'there is no outside text' as 'there is no outside nature.' What if nature has always been literate, numerate, social? In language, recombination of a discrete set of meaningless building blocks forms an unlimited set of possible utterances. How such combinatorial structure emerged in the evolution of human language is increasingly being studied. It has been shown that it can emerge when languages culturally evolve and adapt to human cognitive biases. How the emergence of combinatorial structure interacts with the existence of holistic iconic form-meaning mappings in a language is still unknown. The experiment presented in this paper studies the role (...) of iconicity and human cognitive learning biases in the emergence of combinatorial structure in artificial whistled languages. Participants learned and reproduced whistled words for novel objects with the use of a slide whistle. Their reproductions were used as input for the next participant, to create transmission chains and simulate cultural transmission. Two conditions were studied: one in which the persistence of iconic form-meaning mappings was possible and one in which this was experimentally made impossible. In both conditions, cultural transmission caused the whistled languages to become more learnable and more structured, but this process was slightly delayed in the first condition. Our findings help to gain insight into when and how words may lose their iconic origins when they become part of an organized linguistic system. (shrink)

Words refer to objects in the world, but this correspondence is not one-to-one: Each word has a range of referents that share features on some dimensions but differ on others. This property of language is called underspecification. Parts of the lexicon have characteristic patterns of underspecification; for example, artifact nouns tend to specify shape, but not color, whereas substance nouns specify material but not shape. These regularities in the lexicon enable learners to generalize new words appropriately. How does the lexicon (...) come to have these helpful regularities? We test the hypothesis that systematic backgrounding of some dimensions during learning and use causes language to gradually change, over repeated episodes of transmission, to produce a lexicon with strong patterns of underspecification across these less salient dimensions. This offers a cultural evolutionary mechanism linking individual word learning and generalization to the origin of regularities in the lexicon that help learners generalize words appropriately. It has become somewhat a commonplace in recent political philosophy to remark that all plausible political theories must share at least one fundamental premise, ‘that all humans are one another's equals’. One single concept of ‘basic equality’, therefore, is cast as the common touchstone of all contemporary political thought. This paper argues that this claim is false. Virtually all do indeed say that all humans are ‘equals’ in some basic sense. However, this is not the same sense. There are not (...) one but two concepts of basic equality, and they reflect not a grand unity within political philosophy but a deep and striking division. I call these concepts ‘Equal Worth’ and ‘Equal Authority’. The former means that each individual’s good is of equal moral worth. The latter means that no individual is under the natural authority of anyone else. Whilst these two predicates are not in themselves logically inconsistent, I demonstrate that they are inconsistent foundation stones for political theory. A theory that starts from Equal Worth will find it near impossible to justify Equal Authority. And a theory that starts from Equal Authority will find any fact about the true worth of things, including ourselves, irrelevant to justifying legitimate action. This helps us identify the origin of many of our deepest and seemingly intractable disagreements within political philosophy, and directs our attention to the need for a clear debate about the truth and/or relationship between the two concepts. In short, my call to arms can be summed up in the demand that political philosophers never again be allowed to claim ‘that all human beings are equals’ full stop. They must be clear in what dimension they claim that we are equals—Worth or Authority. (shrink)

Historically, the triage of temporarily scarce health resources has served narrow utilitarian ends. The recent H1N1 pandemic experience provided an opportunity for expanding the theoretical foundations/understandings of critical care triage in the context of declared infectious pandemics. This paper briefly explores the ethics-related challenges associated with the development of modern critical care triage protocols and provides descriptions of some ‘enhanced fairness’ features which were developed through the use of an inclusive deliberative engagement process by a Canadian provincial Department of Health.

This paper assesses the most well thought out contemporary conception of republican liberty put forward by Philip Pettit and Quentin Skinner. I demonstrate that it is incoherent: at least insofar as it seeks to pick out a form of unfreedom not captured by the negative conception of liberty. This incoherence arises because Pettit and Skinner cannot both hold that republican unfreedom is defined by one agent’s mere capacity to interfere arbitrarily with another agent and, at the same time, claim that (...) republican freedom can be promoted by deterrence mechanisms. My contribution to contemporary republican theory is to suggest that a coherent republican conception can be achieved, however, through an important revision. This is to replace Pettit and Skinner’s antonym of republican liberty—the power to interfere arbitrarily—with a higher order power—the power to determine arbitrarily rules with respect to interference. This revised conception does pick out a genuinely distinct extension of unfreedom from the negative liberty conception. I believe it also reflects an important intuitive sense in which we may understand ourselves to be unfree, that is, to live under the rule of another. (shrink)

This paper offers a targeted five-point critique of the current debate about the problem of basic equality. First, it argues that the debate should be refocussed away from any particular concept(ion) of basic equality to a more agnostic proposition about the possibility of establishing equality in any basic moral property. Second, it re-articulates the problem in terms of grounding relations rather than supervenience. Third, it argues that proponents of predominant approach to solving this problem have failed to properly distinguish between (...) two different non-scalar properties defined in terms of scalar properties: ‘range properties’ and ‘bare properties’. Once disambiguated it is clear as to why such an approach must fail. However, this critique does direct our attention to a possible alternative strategy, that is, grounding our equality upon a ‘relative property’. (shrink)
