Optimism about our ability to enhance societal decision‐making by leaning on Machine Learning (ML) for cheap, accurate predictions has palled in recent years, as these ‘cheap’ predictions have come at significant social cost, contributing to systematic harms suffered by already disadvantaged populations. But what precisely goes wrong when ML goes wrong? We argue that, as well as more obvious concerns about the downstream effects of ML‐based decision‐making, there can be moral grounds for the criticism of these predictions themselves. We introduce (...) and defend a theory of predictive justice, according to which differential model performance for systematically disadvantaged groups can be grounds for moral criticism of the model, independently of its downstream effects. As well as helping resolve some urgent disputes around algorithmic fairness, this theory points the way to a novel dimension of epistemic ethics, related to the recently discussed category of doxastic wrong. Public discourse implicitly appeals to what we call the “Traumatic Untrustworthiness Argument” (TUA). To motivate, articulate, and assess the TUA, we appeal to Hawley’s (2019) commitment account of trust and trustworthiness. On Hawley’s account, being trustworthy consists in the successful avoidance of unfulfilled commitments and involves three components: the actual avoidance of unfulfilled commitments, sincerity in one’s taking on elective commitments, and competence in fulfilling commitments one has incurred. In contexts of testimony, what’s at issue is the speaker’s competence and (...) sincere intention to speak truthfully. The TUA targets trauma victims’ competence rather than their sincerity. According to the TUA, empirical evidence shows that trauma undermines victims’ trustworthiness with regard to speaking truthfully about their trauma by undermining their competence to remember the relevant event. We argue that what the evidence shows is rather that remembering traumatic events involves a distinct “mode of manifesting” the competence to remember particular events from the personal past. Trauma victims are competent to speak truthfully about their trauma and ought to be trusted at least with regard to the central details of the event. By suggesting otherwise, the TUA threatens an insidious form of epistemic injustice which Hawley’s account helps us locate. (shrink)

The dispute over the exact nature and status of possible worlds in Leibniz’s philosophy has proven difficult to resolve. The standard view, that there is one unique actual world and that possible worlds exist solely as ideas within God’s understanding, sits in tension with important metaphysical and theological components of Leibniz’s system. For example, Leibniz takes possible individuals to have some “essence or reality” in themselves and to strive for existence, which allows him to ground counterfactual claims and to overcome (...) necessitarianism. However, scholars have long seen these claims as being at odds with God’s creation of one unique actual world. Catherine Wilson (2000) challenges the standard view’s claim that possible worlds are substantially different from the actual world, arguing instead that Leibniz’s metaphysical commitments are consistent with there being more than one actual world and that Leibniz has no way to block the claim that God would generate more than one such world. In this paper, I expand on Wilson’s account and argue, contrary to the standard view, that the key theses at the heart of Leibniz’s philosophical system entail modal realism—for Leibniz, there can be no ontological difference between possible and actual worlds. Epistemic modal operators give rise to something very like, but also very unlike, Moore's paradox. I set out the puzzling phenomena, explain why a standard relational semantics for these operators cannot handle them, and recommend an alternative semantics. A pragmatics appropriate to the semantics is developed and interactions between the semantics, the pragmatics, and the definition of consequence are investigated. The semantics is then extended to probability operators. Some problems and prospects for probabilistic representations of content and context are explored.

Focusing on cases which involve binding into epistemic modals with definite descriptions and quantifiers, I raise some new problems for standard approaches to all of these expressions. The difficulties are resolved in a semantic framework that is dynamic in character. I close with a new class of problems about de re readings within the scope of modals.

Deontologists have been slow to address decision-making under risk and uncertainty, no doubt because the standard approaches to non-moral decision theory appear superficially similar to consequentialist moral reasoning. I identify some central tenets of simple decision theory and show that they should not put deontologists off, before showing where we should go next to develop a comprehensive deontological decision theory.

As Quine observed, the following sentence has a reading which, if true, would be of special interest to the authorities: Ralph believes that someone is a spy. This is the reading where the quantifier is naturally understood as taking wide scope relative to the attitude verb and as binding a variable within the scope of the attitude verb. This essay is interested in addressing the question what the semantic analysis of this kind of reading should look like from a Fregean (...) perspective—a perspective according to which attitude states are generally relations to structured Fregean thoughts composed of senses. The Fregean view faces a challenge of compositionality here. This essay describes the challenge and offers a response on the Fregean's behalf. (shrink)

This paper critiques a number of standard ways of understanding the role of the metalanguage in a semantic theory for natural language, including the idea that disquotation plays a nontrivial role in any explanatory natural language semantics. It then proposes that the best way to understand the role of a semantic metalanguage involves recognizing that semantics is a model-based science. The metalanguage of semantics is language for articulating features of the theorist's model. Models are understood as mediating instruments---idealized structures used (...) to represent select aspects of the world, aspects the theorist is seeking some theoretical understanding of. The aspect of reality we are seeking some understanding of in semantics is a dimension of human linguistic competence---informally, knowledge of meaning. (shrink)

The temporal structure for motivating, monitoring, and making sense of agency depends on encoding, maintaining, and accessing the right contents at the right times. These functions are facilitated by memory. Moreover, in informing action, memory is itself often active. That remembering is essential to and an expression of agency and is often active suggests that it is a type of action. Despite this, Galen Strawson (Proceedings of the Aristotelian Society, 103, 227–257, 2003) and Alfred Mele (2009) deny that remembering is (...) an action. They claim that memory fails to admit of control. Remembering is automatic—once remembering starts, the process can neither be stopped nor intervened on. Moreover, the agent does not initiate remembering. An agent has control over an event or process if and only if she has the capacity and opportunity to initiate and intervene on that event or process. Actions are events over which an agent has control. Since it is automatic, we fail to have control over remembering. Thus, remembering is not an action. In this paper, I draw out an assumption of Strawson’s and Mele’s accounts: an event-type whose tokens exhibit automaticity cannot, for that reason, be an action (§2). Against this assumption, I draw parallels between skilled bodily action and memory. I show that memory exhibits two defining features of skill: it can be learned with practice and it admits of attributions of excellence (§3). These features reveal how intelligent control is exerted in the exercise of skill despite apparent automaticity—control is gained over time (§4). Since exercises of skill are by definition actions and since memory exemplifies the defining features of skill, memory is a skill and instances of remembering are actions too. (shrink)

This volume is a tribute to the thought of Seth Benardete by contributors who had the rare good fortune of studying with him or those who discovered the treasure of his writings. Benardete was fully immersed in the world of the ancients, starting with Homer, but their works opened up for him a way to the fundamental questions-about justice and love, nature and law, human and divine. Finding "the problem of the human good grounded in the city, and the (...) problem of being in god," he was led to the conclusion that "Political philosophy is the eccentric core of philosophy." While Benardete wrote this statement reflecting on the theological-political issue in the work of his teacher, Leo Strauss, the paradoxical notion of an "eccentric core," in giving this volume its title, is meant to capture a characteristic of his own way of thinking. The essays in this collection-on the Bible and Homer, the pre-Socratics, Plato, Aristotle, and the Roman writers-indicate the range of Benardete's studies and teaching. The centrality of Plato is evident at the same time in those pieces as well as in the reviews of Benardete's books included here, along with three of his own previously unpublished essays. I develop a conception of expressivism according to which it is chiefly a pragmatic thesis about some fragment of discourse, one imposing certain constraints on semantics. The first half of the paper uses credal expressivism about the language of probability as a stalking-horse for this purpose. The second half turns to the question of how one might frame an analogous form of expressivism about the language of deontic modality. Here I offer a preliminary comparison of two expressivist lines. The first, (...) expectation expressivism, looks again to Bayesian modelling for inspiration: it glosses deontically modal language as characteristically serving to express decision-theoretic expectation (expected utility). The second, plan expressivism, develops the idea (due to Gibbard 2003) that this language serves to express 'plan-laden' states of belief. In the process of comparing the views, I show how to incorporate Gibbard's modelling ideas into a compositional semantics for attitudes and modals, filling a lacuna in the account. I close with the question whether and how plan expressivism might be developed with expectation-like structure. (shrink)

This paper defends a counterexample to Modus Tollens, and uses it to draw some conclusions about the logic and semantics of indicative conditionals and probability operators in natural language. Along the way we investigate some of the interactions of these expressions with 'knows', and we call into question the thesis that all knowledge ascriptions have truth-conditions.

This is a study in the meaning of natural language probability operators, sentential operators such as probably and likely. We ask what sort of formal structure is required to model the logic and semantics of these operators. Along the way we investigate their deep connections to indicative conditionals and epistemic modals, probe their scalar structure, observe their sensitivity to contex- tually salient contrasts, and explore some of their scopal idiosyncrasies.

The view that actually has a reading on which it is a two-dimensional indexical modal operator has some problems.

Institutional differentiation has been one of the central concerns of sociology since the days of Auguste Comte. However, the overarching tendency among institutionalists such as Durkheim or Spencer has been to treat the process of differentiation from a macro, "outside in" perspective. Missing from this analysis is how institutional differentiation occurs from the "inside out, "or through the efforts and struggles of individual and corporate actors. Despite the recent efforts of the "new institutionalism" to fill in this gap, a closer (...) look at the literature will uncover the fact that (1) it has tended to conflate macro-level institutions and meso-level organizations and (2) this has led to a taken for granted approach to institutional dynamics. This article seeks to develop a general theory of institutional autonomy; autonomy is a function of the degree to which specialized corporate units are structurally and symbolically independent of other corporate units. It is argued herein that the process by which these "institutional entrepreneurs" become independent can explain how institutions become differentiated from the "inside out." Moreover, this article offers five dimensions that can be operationalized, measuring the degree to which institutions are autonomous. (shrink)

Conservatism and Pragmatism illustrates the intersections between classical British Conservative thought and classical American Pragmatist philosophy with regard to methodology in politics, ethics, and law.

I provide a novel, non-reductive, action-first skill-based account of active imagining. I call it the Skillful Action Account of Imagining (the skillful action account for short). According to this account, to actively imagine something is to form a representation of that thing, where the agent’s forming that representation and selecting its content together constitute a means to the completion of some imaginative project. Completing imaginative projects stands to the active formation of the relevant representations as an end. The account thus (...) bakes in the means-end order that some in action theory take to be definitional of intentional action. Moreover, in the spirit of this conception of intentional action, I hold that a central feature of the means-end order exhibited in active imagining is the agent’s direct non-observational knowledge both of her act of imagining and of its having this order. The agent knows that she’s actively imagining (that-)p and knows why she actively imagines this–to carry on the pretense, engage in the fiction, predict another’s behavior, reason about possibility or necessity, reason about contingent matters of fact, just imagine for its own sake, and so on. I show that the account accounts for the possibility of misimagining while holding onto the idea that we imagine what we intend to imagine. I likewise show that the account unifies imagining across types of imaginative project like those just listed in a way that tolerates conflict in the roles that imagining plays in the mental economy across those projects. Finally, I show that the account can accommodate passive imagining like involuntary and automatic imagining as well as mind wandering. (shrink)

In this paper, we suggest that affect meets the traditional definition of “cognition” such that the affect–cognition distinction is phenomenological, rather than ontological. We review how the affect–cognition distinction is not respected in the human brain, and discuss the neural mechanisms by which affect influences sensory processing. As a result of this sensory modulation, affect performs several basic “cognitive” functions. Affect appears to be necessary for normal conscious experience, language fluency, and memory. Finally, we suggest that understanding the differences between (...) affect and cognition will require systematic study of how the phenomenological distinction characterising the two comes about, and why such a distinction is functional. Public participation is well known for its practitioner insights and wealth of case reports. This knowledge is essential and has been well employed. Likewise, the theoretical literature on public participation is growing rapidly. The need for better conceptual and theoretical understandings of public participation has become clear. Public participation theories have not received great attention, and few have been proposed or tested. Yet theory offers much to practitioners of various interventions. The authors summarize work toward developing a public participation theory (...) and propose a way to conceptualize its skeletal components. The authors recognize that any theory must acknowledge that different people have different beliefs about what public participation should accomplish. Further, contextual variables affect a process’s character and outcomes. The authors begin with a discussion of theory’s importance to scholars, practitioners, and participants and provide an overview of existing approaches. The authors present findings from two empirical case studies used to further develop their theory of fair and competent public participation. They conclude with some observations about challenges and ways forward. (shrink)

Cancer biology features the ascription of normal functions to parts of cancers. At least some ascriptions of function in cancer biology track local normality of parts within the global abnormality of the aberration to which those parts belong. That is, cancer biologists identify as functions activities that, in some sense, parts of cancers are supposed to perform, despite cancers themselves having no purpose. The present paper provides a theory to accommodate these normal function ascriptions—I call it the Modeling Account of (...) Normal Function (MA). MA comprises two claims. First, normal functions are activities whose performance by the function-bearing part contributes to the self-maintenance of the whole system and, thereby, results in the continued presence of that part. Second, MA holds that models of system-level activities that are (partly) constitutive of self-maintenance are improved by including a representation of the relevant function-bearing part and by making reference to the activity/activities that part performs which contribute(s) to those system-level activities. I contrast MA with two other accounts that seek to explicate the ascription of normal functions in biology, namely, the organizational account and the selected effects account. Both struggle to extend to cancer biology. However, I offer ecumenical readings which allow them to recover some ascriptions of normal function to parts of cancers. So, though I contend that MA excels in this respect, the purpose of this paper is served if it provides materials for bridging the gap between cancer biology, philosophy of cancer, and the literature on function. Making decisions is an important component of everyday living, and issues surrounding autonomy and self-determination are crucial for persons with intellectual disabilities. Article 12 (Equal Recognition before the Law) of the UN Convention on the Rights of Persons with Disabilities addresses this issue of decision-making for persons with disabilities: the recognition of legal capacity. Legal capacity means recognizing the right to make decisions for oneself. Article 12 is also moving in the direction of supported decision-making, as an alternative to substituted (...) decision-making. The objective of this paper is to show conceptually the connection between supported decisionmaking and the preservation of personal autonomy for persons with intellectual disabilities. This paper discusses supported decision-making based on Bach and Kerzner's model: (a) legally independent status, (b) supported decision- making status, and (c) facilitated decision-making status. Arguments will be made based on John Stuart Mill's concept of autonomy and arguments against it using Sarah Conly's argument for paternalism. (shrink)

This study examines how meritocracy as a collective social imaginary promoting social justice and fairness reproduces class and caste inequalities and fosters ethical violence. We interrogate discourse of merit in the narratives of the professional–managerial class-in-making at an Indian business school. Empirically, we draw on interviews, full-text responses to a qualitative questionnaire, and a student’s poem. We describe how business school students articulate merit as a neoliberal ethic, emphasizing prudential, enterprising attitudes, and responsibility. However, this positive, aspirational façade of merit (...) masks practices of ethical violence, wherein individuals invoke an ethical principle as grounds for moral condemnation and linguistic injuries. These practices of ethical violence desubjectify disadvantaged students and result in silence as a form of inequality. We contribute to organizational research on inequalities by foregrounding ethical violence and desubjectification. We detail the possibilities of discursive agency in contesting and interrupting ethical violence. (shrink)

Recent work in AI ethics often calls for AI to advance human values and interests. The concept of “AI for people” is one notable example. Though commendable in some respects, this work falls short by excluding the moral significance of nonhumans. This paper calls for a shift in AI ethics to more inclusive paradigms such as “AI for the world” and “AI for the universe”.
