This book develops a new approach to naturalizing phenomenology. The author proposes to integrate phenomenology with the mechanistic framework that offers new methodological perspectives for studying complex mental phenomena such as consciousness. While mechanistic explanatory models are widely applied in cognitive science, their approach to describing subjective phenomena is limited. The author argues that phenomenology can fill this gap. He proposes two novel ways of integrating phenomenology and mechanism. First, he presents a new reading of phenomenological analyses as functional analyses. (...) Such functional phenomenology delivers a functional sketch of a target system and provides constraints on the space of possible mechanisms. Second, he develops the neurophenomenological approach in the direction of dynamic modeling of experience. He shows that neurophenomenology can deliver dynamical constraints on mechanistic models and thus inform the search for an underlying mechanism. (shrink)

In the article I discuss functionalist interpretations of Husserlian phenomenology. The first one was coined in the discussion between Hubert Dreyfus and Ronald McIntyre. They argue that Husserl’s phenomenology shares similarities with computational functionalism, and the key similarity is between the concept of noema and the concept of mental representation. I show the weaknesses of that reading and argue that there is another available functionalist reading of Husserlian phenomenology. I propose to shift perspective and approach the relation between phenomenology and (...) functionalism from a methodological perspective, specifically taking into account the functionalist explanatory strategy called functional analysis. I discuss the notion of function in Husserl’s works and Husserl’s idea of functional phenomenology. The key argument I develop is that in functional phenomenology we can find an explanatory strategy which is analogous to the strategy of functional decomposition used in functional analysis. I conclude that the proposed functionalist reading of phenomenology opens a new approach to the integration of phenomenology with cognitive sciences. (shrink)

The aim of this article is to introduce the work of Leopold Blaustein — philosopher and psychologist, who studied under Kazimierz Twardowski in Lvov and under Husserl in Freiburg im Breisgau. In his short academic career Blaustein developed an original philosophy that drew upon both phenomenology and Twardowski’s analytical approach. One of his main publications concerns Husserl’s early theory of intentional act and object, introduced in Logische Untersuchungen. In the first part of the article I briefly present Blaustein’s biography and (...) some general features of his philosophy. The second part provides an overview of Blaustein’s dissertation concerning Husserl’s early phenomenology. In the third and final part I summarize Blaustein’s research, including the critical remarks of Roman Ingarden. (shrink)

This book is the first comprehensive study of Plato’s conception of justice. The universality of human rights and the universality of human dignity, which is recognised as their source, are among the crucial philosophical problems in modern-day legal orders and in contemporary culture in general. If dignity is genuinely universal, then human beings also possessed it in ancient times. Plato not only perceived human dignity, but a recognition of dignity is also visible in his conception of justice, which forms the (...) core of his philosophy. Plato’s Republic is consistently interpreted here as a treatise on justice, relating to an individual and not to the state. The famous myth of the cave is a story about education taking place in the world here and now. The best activity is not contemplation, but acting for the benefit of others. Not ideas, but individuals are the proper objects of love. Plato’s philosophy may provide foundations for modern-day human rights protection rather than for totalitarian orders. (shrink)

Władysław Tatarkiewicz work on philosophical and moral psychology, particularly on theory of happiness is still example of the best kind of analytical and close to phenomenological analysis of our speaking and thinking about the topics in question. He distinguishes four main different meanings of Polish word ‘szczęście’ and present a new classification of them based on two principles: the opposition of subjective and objective and between ordinary and philosophical language. Accordingly we can speak about luck, positive psychological states like different (...) kinds of good emotions or feelings and pleasure, Greek eudaimonia and specifically philosophical, a very correct concept of happiness as a rationally justified deep and comprehensive satisfaction of one’s life taken in its wholeness. Dawkins’ Ballet in the Garden of Theology. A Critical Assessment of Richard Dawkins’ Epistemological Theses on Theistic Beliefs from the God Delusion. Part II My paper presents an analysis and assessment of Richard Dawkins’ assumption from his book The God Delusion that there are no reason against treating belief in God as a scientific hypothesis, because even if the God existence is not disprovable, we could and maybe should ask if His existence is probable or highly improbable. My first aim (...) is to examine Dawkins' argumentation against if he is aware multiple possible ways interpretation of the claim that religious belief in God, construed as the hypothesis that existence of Creator may be treated as a scientific kind of hypothesis. My second aim is to show a nature of relation between his scientific God-hypothesis and his criticism of Thomas Henry Huxley agnosticism. I maintain that the he can't treat his probabilistic account of theism/atheism controversy as a ground for possible evidence for his controversial claim, that scientific knowledge could solve the problem of God's existence. As the matter of facts , things are just the opposite. I argue for claim that his construal of belief in God in terms of probabilistic scientific hypothesis is normatively weak and he can't use it in argumentation against rationality of belief in God even if he would be succesfully show that God-hypothesis is very weak and improbable explanation of origins and complexity of life. The paper refers to the argument from hiddenness as presented in John Schellenberg’s book The Hiddenness Argument and the philosophical views expressed there, making this argument understandable. It is argued that conditionals (1) and (2) are not adequately grounded. Schellenberg has not shown that we have the knowledge necessary to accept the premises as true. His justifications referring to relations between people raise doubts. The paper includes an argument that Schellenberg should substantiate its key claim that God has the resources (...) to accommodate the possible consequences of openness to a relationship with finite persons, making them compatible with the flourishing of all concerned and of any relationship that may come to exist between them. At the end of the text, I propose to treat the argument as a rejection of an anthropomorphic God. (shrink)

The fact of religious diversity is vital for the philosopher of religion but also, to some extent, for the believer of a given faith. It takes place in such a dimension in which the views of a given believer or the meaning of the practice of a given religion presupposes the truthfulness of specific claims concerning a given religion or the beliefs included in it. If now on the part of the philosopher of religion or the followers of another religion, (...) there is a direct or indirect challenge to such a key proposition, religious disagreement with epistemic dimension is involved. At the same time, it is not the case that any religious diversity is a case of epistemically significant religious dissent. The paper, by distinguishing different aspects of religions and functions performed by religion, tries to show in which situations religious diversification leads to religious disagreement. Both the follower of religion and the philosopher of religion can and should seek the truth in matters of crucial importance to religion. The difference is that the follower of a given religion is more interested in the salvific and practical functions of religion, along with the associated sense of value and meaningfulness of life and, to a lesser degree, the theoretical certainty that her religion is correct at crucial points. On the other hand, the achievement of ‘the soteriological’ purpose of religion based on false belief is impossible, just as the meaningfulness of life 'based on the sand and not on the rock’. It is because the false foundation is devoid of higher value. That is why there is a community of a philosopher of religion and a follower of a given religion to search for the truth of it. (shrink)

Philosophizing and the True Knowledge of Human Being -/- The article presents the principles and method of classical philosophy. This kind of philosophy, developed mainly in ancient and medieval times, is still viable and interesting today. What is more important, it can be used as grounds for academic philosophy. Doing so provides a philosopher with resources for autonomy in her philosophical inquiry as well as the usefulness and application of its results for various cultural, social, and political tasks. The last (...) part of the article explains the manner in which the principles of philosophy may be connected with different ways of classical philosopher’s concern the with knowledge of the human being understood as a special, unique being, with her transcendence behind her biological nature and human society. In the conclusion, several tasks for philosophical reflection are given. In all its parts, the article emphasizes the importance of the concept of philosophizing person for the understanding of philosophy. (shrink)

My aim in this paper is to show that some parts of J. M. Bocheński’s account of the logic of religion are useful for epistemological investigation of a religious belief, particularly for the questions of realistic and cognitive interpretations of a religious discourse, the problems of justification and warrant of a religious belief and for the problem of the place of criticism in a religious discourse. Referring to Bocheński's understanding of the structure of religious/theological thinking, I present the criteria for (...) the gradual rationality of religion and claim that religions may differ in rationality and that there may be a rational and critical religion that uses the achievements of science and philosophy - contrary to what the New Atheists claim. The Issues of God’s Omnipotence – Things New and Old -/- The purpose of this paper is to shortly introduce into the philosophical issues of omnipotence in the history of philosophy and philosophically oriented theology, and to show how the articles included in the special issue on God’s power fits with it. There are three main subjects of debate on the power of God (gods). First, how to precisely define omnipotence, in philosophically as well as theologically adequate way, by using (...) correct terms. This task has two sides, semiotic and the corresponding metaphysical one – how should we correctly understand the very nature of God’s power. The second topic, or rather set of topics is to map the scope of omnipotence up and delineate its limits. And the last, third subject concerning omnipotence is to establish the relation of omnipotence to others attributes as well as to the God’s nature as such. All the issues are placed in the context of historical and actual debates. The paper distinguish with some detail different subtopics connected with each main issues. The problem of correct, adequate main term used in definiens of God’s power definition and task to detect paradoxes of omnipotence, to find it’s sources, and remove them, if it is possible are connected with first. It includes the task of distinguishing of different kinds of God’s power. In the second group of topics the paper lists nine different questions concerning the scope and limits of power of God, for example some connected with the ways of acting of God in the world, the relations between power of God and human freedom, God’s omnipotence and evil, with possibility of creating of different world or world with different value status or even with different moral laws. One of this paper task is to show the importance and actuality of issues of omnipotence of God, so the topics of nineteen of papers included in this special issue of “Filo-Sofija” are presented in their proper, historical and actual, context. The paper presents some historical (Plato, Aristotle, Plotin, Augustine, Boethius, Aquinas) and main contemporary topics about different accounts of goodness of God understood as ontological goodness, perfection and as ethical goodness - impeccability and benevolence. The arguments for goodness of God are presented, mainly from stance of Thomas Aquinas classical theism as well as arguments against compatibility of essential goodness and omnipotence (N. Pike) and being an moral agent. The article draws perspective of different philosophical issues connected with goodness of (...) God, like a problem of evil, the Euthyphro dilemma, divine command ethics and divine motivation theory. (shrink)

In philosophical literature terms: „natural theology” (or „rational theology”) and „philosophical theology” are used as exchangeable. The author argues that natural and philosophical theology are different philosophical disciplines. It is possible to point out a philosophic theology, different from natural theology, the former aims are not only supposed to show that God exists but to unifícate, interpret and explain (understand) religious faith and her tasks are not primary apologetic. The author considers that the aims of the latter discipline are bound (...) with the preference of cognitive values such as certainty, rationality and being able to use one ’s rationality to convince your opponent. In the end of this article author introduces a sketch of method of philosophical theology as different form natural theology, which could overcome one-sided views about role of philosophical argument in study of religious belief and faith and their propositional content and lead not only to a more adequate analysis of the researched reality but also to the development of other disciplines. The article analyzes and criticizes the assumptions of Peter Van Inwagen’s argument for the alleged contradiction of the foreknowledge of God and human freedom. The argument is based on the sine qua non condition of human freedom defined as access to possible worlds containing such a continuation of the present in which the agent implements a different action than will be realized de facto in the future. The condition also contains that in every possible continuation of the present state of (...) affairs, the same propositions about the ‘present past’ (the past before the present moment) are true as are true in the present state of affairs. The paper argues that Van Inwagen’s reasoning is inconclusive, it contains the type of mistake of confusing conditional impossibility with unconditional and presents a methodologically wrong method of solving a philosophical problem. It is because in the very construction of the problem determining the available solution. The article points to the possibility that the human freedom of some action is not excluded by the fact that specific past facts logically entail that this event will occur. (shrink)

On Relation between the Individual Character of Propositional Knowledge and Its Value -/- The paper presents two aspects of human propositional knowledge, objective and subjective. The former is based on the truth condition, and the latter on the belief condition. Then several problems of the value of knowledge are briefly presented. The last part contains two arguments for the sine qua non belief condition of knowledge, one of which concerns the problem of epistemic luck assumed in virtue.

This article presents Alvin Plantinga’s views on epistemic justification. The first part situates Plantinga’s epistemological views in the context of his epistemology of religion and debates of general epistemology. The second part discusses Plantinga’s argument that the internalism of 20th century epistemology stems from deontologism and that the views on the epistemic justification of analytic philosophers reflect the relationship between classical deontologism and classical internalism. The last part points to the objections with which the Plantinga’s conception met and tries to (...) balance the depth and weakness of its position. (shrink)

I present argument for different than traditional continental classification of epistemological issues. Paper has two parts, first concerned with K. Ajdukiewicz and J. Woleński conception of epistemology and its branches and with different methods of epistemological inquiry based on different task posed for epistemology. Second part discuss main important topics of current postgettieral analytic epistemology like virtue epistemology, ethics of belief, problems of epistemic value, epistemic value monism and pluralism, metaepistemology and concludes that in traditional continental classification the issues of (...) a truth and the issues of nature of knowledge should be united in broaden set of topics concerned with valuable cognition and knowledge, which has descriptive, normative, and regulative subparts. Short paper about debate on cognitive meaning of religious use of language in early analytic philosophy of religion. Published in Companion to Philosophy of Religion, edited by Janusz Salamon, Cracow: WAM, 2016.

The article aims to determine whether it is possible to build the reliably practiced classical philosophy, understood as a metaphysical research, directed towards the nature of objective reality. The purpose of this kind of philosophizing is knowledge and truth. Moreover, the practice of such philosophizing and its results should meet some of the characteristics of science. The paper establishes a set of conditions that have been imposed on the science of metaphysics by Kazimierz Twardowski. Among the conditions of such philosophizing (...) are anti-dogmatism, criticism, inter-subjectivity of philosophizing and its results, proper epistemic justification of philosophical beliefs, application of the analysis method, rigorous language and reasoning, the use of experience and scientific knowledge. The paper considers these conditions to be correct in most cases and argues that metaphysics can meet them. The existing cases of analytical metaphysics show that metaphysics is possible as a science. Next, the article argues that the late Twardowski failed to substantiate his claim that metaphysical positions which he classified as a world-view philosophy could not be scientifically justified, which could have been possibly done with differentiating ways of understanding what such a scientific justification should be. The article argues that he did not take into account a reductive conception of the metaphysical philosophy, which even though it allows the plurality of metaphysical explanations and does not force anyone to accept one position as the only possible and correct explanation, would have an objective value, if such metaphysics were elaborated indeed. In the article, I develop some ideas introduced by Edmund Husserl concerning time-consciousness and embodiment. However, I do not discuss the Husserlian account of consciousness of time in its full scope. I focus on the main ideas of the phenomenology of time and the problem of bodily sensations and their role in the constitution of consciousness of time. I argue that time-consciousness is primarily constituted in the dynamic experience of bodily feelings. In the first part, I outline the main ideas (...) of Husserl’s early phenomenology of consciousness of time. In the second part, I introduce the phenomenological account of bodily feelings and describe how it evolved in Husserl’s philosophy. Next, I discuss the idea of bodily self-affection and the affective-kinaesthetic origin of consciousness’ temporal flow. In order to better understand this “pre-phenomenal temporality”, I analyse the dynamics of non-intentional, prereflective bodily self-affection. In the third part, I try to complement Husserl’s account by describing the specific dynamics of bodily experience. In order to do so, I appeal to Daniel Stern’s psychological account of dynamic bodily experience, which he calls the “vitality affect”. I argue that the best way to understand the pre-phenomenal dynamics of bodily feelings is in terms of the notion of rhythm. (shrink)

Paper reconstructs three different accounts of the rationality of religious belief that we found in Plantinga's epistemology of theistic and religious belief. Taken into account are works (papers and books) from GAOM to first two books about a warrant. In the end, the article formulates some questions about rationality and evaluation of the importance of property of rationality of religious belief concerning other positive epistemic statuses.

I argue that Ireneusz Ziemiński doesn't justify his skepticism about knowledge of existence of God. First, he reduces a question to metaphysical one - do we have sound, valid proofs of God's existence and imposes too heavy conditions on arguments for God. Second, he doesn't show that disagreement between philosophers in that question justify his negative assessment of arguments. Third, Ziemiński omits epistemological question what is knowledge of God's existence, especially in its direct form as well as externalistic account's of (...) knowledge of God, for example Plantinga's and Alston's. A Higgsless model for strong, electroweak and gravitational interactions is proposed. This model is based on the local symmetry group SU(3)×SU(2)L×U(1)×C,where C is the local conformal symmetry group. The natural minimal conformally invariant form of total Lagrangian is postulated. It contains all standard model fields and gravitational interaction. Using the unitary gauge and the conformal scale fixing conditions, we can eliminate all four real components of the Higgs doublet in this model. However, the masses of vector mesons, leptons, and quarks (...) are automatically generated and are given by the same formulas as in the conventional standard model. In this manner one gets the mass generation without the mechanism of spontaneous symmetry breaking and without the remaining real dynamical Higgs field. The gravitational sector is analyzed, and it is shown that the model admits in the classical limit the Einsteinian form of gravitational interactions. (shrink)

In the article I discuss the conceptual problem of other minds and different approaches to mental concepts. Firstly, I introduce the conceptual problem and argue that solutions proposed by theory-theory and direct perception approach are inadequate. I claim that mental concepts are neither theoretical terms nor observational terms. Then, I consider third option which states that mental concepts are dispositional terms, i.e. they concern particular patterns (stereotypes) of behavior. Finally, I argue that dispositional approach is to some extent coherent with (...) phenomenological account and that phenomenological concept of embodiment can improve this position. (shrink)

According to recent discussion, cross-explanatory integration in cognitive science might proceed by constraints on mechanistic and dynamic-mechanistic models provided by different research fields. However, not much attention has been given to constraints that could be provided by the study of first-person experience, which in the case of multifaceted mental phenomena are of key importance. In this paper, we fill this gap and consider the question whether information about first-person experience can constrain dynamic-mechanistic models and what the character of this relation (...) is. We discuss two cases of such explanatory models in neuroscience, namely that of migraine and of epilepsy. We argue that, in these cases, first-person insights about the target phenomena significantly contributed to explanatory models by shaping explanatory hypotheses and by indicating the dynamical properties that the explanatory models of these phenomena should account for, and thus directly constraining the space of possible explanations. Si tomamos las disposiciones constitucionales en serio tenemos que aceptar que algunas valoraciones morales o que algunas proferencias [utterances] valorativas pueden ser verdaderas o falsas y que nos informan acerca de una realidad objetiva. Por otro lado, en la teoría del derecho polaca y en los cursos universitarios de lógica para abogados se encuentran definiciones (...) de la justificación axiológica de las normas y de normas axiológicas (normas que poseen una justificación axiológica) que presuponen que ningún valor es objetivo y que no pueden ser conocidos — se presupone un no-cognoscitivismo axiológico. Arthura Kaufmanna filozofia prawa wyrasta przede wszystkim z neokantyzmu aksjologicznego reprezentowanego przez „późnego” Gustava Radbrucha, którego uważał on za najważniejszego ze swych nauczycieli, oraz z hermeneutyki filozoficznej Hansa-Georga Gadamera. W późniejszym okresie znaczący wpływ na Kaufmanna wywarł Charles S. Peirce, którego pracami posiłkował się opracowując problematykę analogii (wiążąc ją z opracowanym przez Pierca zagadnieniem abdukcji) oraz ontologii relacji. Niektóre wątki poglądów Kaufmanna nawiązują do egzystencjalizmu Karla Jaspersa oraz antropologii Karla Löwitha. Obecne są także inspiracje tomistyczne i arystotelesowskie. Jest to filozofia (...) prawa o charakterze maksymalistycznym. Kaufmann wpisuje się w sięgającą starożytności tradycję uprawiania filozofii, w której stawia się pytania o całość; filozofia pyta o to, co to jest "byt w ogóle", byt "w całości"; filozofia prawa stawia pytania o to, co to jest prawo "w całości", prawo "w ogóle" . Podejmuje wprost fundamentalne zagadnienia należące do zasadniczych dziedzin filozoficznych – epistemologiczne, ontologiczne, etyczne, nie stroniąc także od zagadnień z zakresu logiki. Uprawiana przez niego filozofia ma charakter systemowy, co sprawia, że jej zrozumienie zakłada ujęcie całości propozycji. Sam Kaufmann uważa, że systemy filozofii prawa należą już do historii, jednak ta uwaga jest o tyle jedynie trafna w odniesieniu do niego samego, że jego filozofia prawa – w zgodzie z jego deklaracjami – nie zmierza do „gotowych rozwiązań” konkretnych kwestii prawnych, ale zmierza do ukształtowania pewnego sposobu refleksji nad prawem. Jego koncepcja jest ważnym głosem w sporze klasycznego pozytywizmu z koncepcjami niepozytywistycznymi. Za prawo w pełnym tego słowa znaczeniu uznaje konkretne rozstrzygnięcie, co niewątpliwie łączy jego podejście z amerykańskim realizmem prawnym. Rekonstruowana przez Kaufmanna struktura procesu „urzeczywistniania” prawa, dokonywana w kontekście i na użytek kultury prawnej typu kodeksowego, kontynentalnego, uwyraźnia obecność elementów typowych dla kultury prawa precedensowego –wnioskowanie od przypadku do przypadku. Jednocześnie za istotny problem każdego porządku normatywnego uznaje uogólnienie. Jest to znamienny teoretyczny wyraz narastającej świadomości współwystępowania obok siebie zasadniczych elementów każdego z tych typów kultur prawnych. Kaufmann trafnie dostrzega, że w konkretnym rozstrzygnięciu są obecne elementy normatywne wykraczające poza to, co jest zawarte w aktach normatywnych. Podobnie jak Ronald Dworkin, Kaufmann wskazuje, że dokonujący rozstrzygnięcia, czy tego chce, czy nie, „stosuje” szereg elementów normatywnych spoza aktów normatywnych. Analizy prowadzą do wniosku, że propozycja Kaufmanna zawodzi, gdy przechodzi on do ontologicznych uogólnień, przede wszystkim przez brak uwzględnienia w swych podstawach takich punktów odniesienia, które są zewnętrzne wobec badanego procesu „urzeczywistniania” prawa. To, czym jest osoba, determinowane jest systemem prawnym i kulturą, w której prawo funkcjonuje. Przy takim ujęciu Kaufmann nie osiąga jednego z ważnych celów, do którego zmierzał, nie wskazuje kryteriów pozwalających stwierdzić, czy stopniowa – dokonywana zgodnie z odkrytymi przez hermeneutykę filozoficzną wymaganiami poprawnego rozumienia – zmiana normatywnego sensu systemu prawnego zmierza ku „ustawowemu bezprawiu”, czy też nie. This study aims to identify various meanings of the expression (name) “dignity”, with particular emphasis on the meanings of this expression as it appears in the text of the Constitution of the Republic of Poland. The meaning of the name “dignity” is the concept of dignity; in turn, the different concepts of dignity encompass dignity of particular types. Twelve different meanings of the expression “dignity” are indicated – twelve different concepts of dignity, and thus twelve types of dignity. Half of (...) them are meanings (concepts) that recognize dignity as something belonging to a human being as a subject of law. They were considered in the essay Godność jako właściwość osoby. Typy godności – propozycja systematyzacji [Dignity as a Quality of Person – a Proposed Systematisation]. This group of meanings includes three concepts of dignity which recognize dignity as something constitutive of being a person: (1) inherent dignity of the person, (2) dignity established by qualities specific to a thinking being, and (3) dignity as a historically emergent social status of all human beings. The expression “the dignity of the Nation” can be understood in four different ways: (i) analogously to the understanding of dignity of the person, (ii) of personal dignity, (iii) of dignity as moral excellence, and (iv) of dignity as appropriateness of attitude or behaviour. The expression “dignity” when designating something institutionally grounded can designate (4) the dignity of social roles, (5) the dignity of a profession, and – specifically to the Polish language – (6) dignity meaning a surname. -/- The author argues that it is unacceptable to ascribe different concepts of dignity to the expression “dignity” appearing in a specific legal provision. An interlocking-directorates monitoring system The subject of the study was interlocking directorates in Polish joint stock companies. In order to explore this area a monitoring system has been developed which consists of a database and query system. Data is automatically introduced from printed announcements into the MySQL database using PHP scripts.The phenomenon of interlocking directorates in Polish joint stock companies is comparable with other countries. Board members in Poland are significantly younger than, for example, in the USA. Women constitute an (...) important group of board members. Insurance companies and investment funds are closely connected with other companies, but banks are not.The monitoring system developed enables us to identify who is, and who was, a board member of every joint stock company. It also enables us to identify, for every person, which board he or she now serves on, and has served on, in the past. The system also enables us to produce different reports concerning, for example, changes in certain indexes in subsequent years. The system is also accessible via the Internet. (shrink)

This article explores the lived experiences of Polish nurses’ transition into the Norwegian healthcare system and analyses the emerging differences in nursing practices and professional identities between Poland and Norway. It draws on ethnographic findings and argues that nursing is a complex practice, which involves not only nursing knowledge, but also less obvious and often taken for granted nursing imaginaries and actions. In doing so, the article looks at different ways of walking, speaking and listening, which are not merely nurses’ (...) daily habits, but also the embodiments of hierarchical relations, agency and empowerment in healthcare settings. This kind of analytical perspective of the existing differences in nursing practices and professional identities between Poland and Norway raises crucial questions about transitional contexts of nurse migration and shows that nursing is not static, but rather a dynamic and processual way of conduct. Alvin Plantinga claims that Christian believer can rationally disbelieve in some elements of the theory of evolution: the Common Ancestry Thesis; Darwinism, taken as explanation of origin of life by the mechanism of natural selection operating on random genetic mutation, and Naturalistic Origins Thesis - the view that present life itself developed from nonliving matter without special activity of God. After the justification of the possibility of conflicts between faith and science, Plantinga's arguments are examined and assessed as successful, with (...) a few exceptions. The main thesis of this paper is that Plantinga is right claiming that rational disbelieving in evolution is possible, but his arguments are not enough to justify special creationism as theistic knowledge, supposing that knowledge warrants the truth. "Dignity as a Quality of Person: Types of Dignity – a Proposed Systematisation" This study aims to identify various meanings of the expression (name) “dignity”, with particular emphasis on the meanings of the expression as it appears in the text of the Constitution of the Republic of Poland. The meaning of the name “dignity” is the concept of dignity; in turn, the concept of dignity encompasses dignity of particular types. Twelve different meanings of the expression “dignity” are indicated – twelve (...) different concepts of dignity, and thus twelve types of dignity. Half of them are meanings (concepts) that recognize dignity as something belonging to a human being as a subject of law, and this essay is devoted to this group of meanings. This group of meanings includes three concepts of dignity which encompass dignity as something constitutive of being a person: (1) inherent dignity of the person, (2) dignity established by qualities specific to a thinking being, and (3) dignity as a historically emergent social status of all human beings. Only the first of these three concepts of dignity is adequate to the interpretation of the preamble and art. 30 of the Polish Constitution. Znaczeniem nazwy „godność” jest pojęcie godności; z kolei pojęcie godności ujmuje samą godność danego typu. Wskazanych zostaje dwanaście różnych znaczeń wyrażenia „godność” – dwanaście różnych pojęć godności, zatem i dwanaście jej typów. Połowa z nich to znaczenia (pojęcia), które ujmują godność jako coś przynależnego człowiekowi jako podmiotowi i tym znaczeniom (i odpowiadającym im typom godności) poświęcone jest niniejsze opracowanie. W tej grupie znaczeń odróżnione zostają trzy pojęcia godności, które ujmują godność jako coś konstytutywnego dla bycia osobą – (1) przyrodzoną i niezbywalną godność osobową, (2) godność opartą na obserwowalnych i zmiennych cechach specyficznych dla istoty rozumnej i (3) godność opartą na historycznie ukształtowanym statusie społecznym przypisanym wszystkim ludziom. Jedynie pierwsze z tych pojęć jest adekwatne do interpretacji preambuły i art. 30 Konstytucji RP. W drugiej grupie znaczeń ujmujących godność jako coś przysługującego człowiekowi są pojęcia ujmujące godność jako cechę osoby – (4) godność osobistą (cześć i dobre imię), (5) godność osobowościową (poziom moralny) oraz (6) godność jako dyspozycja do stosownego sposobu bycia. Druga połowa znaczeń ujmuje godność jako coś przynależnego czemuś lub jako coś o charakterze konwencjonalnym, instytucjonalnym. Te znaczenia będą omawiane w kolejnym opracowaniu Godność jako cecha podmiotów zbiorowych lub cecha ugruntowana instytucjonalnie. Typy godności – Propozycja systematyzacji – Część 2. Konstytucja RP mówi o (1) godności Narodu, (2) godności urzędu lub funkcji, oraz o (3) godności publicznej (godnościach publicznych. Wyrażenie „godność” jako desygnujące coś przynależnego czemuś może także desygnować (4) godność statusu społecznego opartego na przynależności do jakiejś grupy społecznej, (5) godność zawodu oraz – co specyficzne dla języka polskiego – (6) godność jako nazwisko. Autor argumentuje, że niedopuszczalne jest przypisywanie wyrażeniu „dignity” występującym w danym przepisie prawnym, różnych pojęć godności. (shrink)

The Uppsala School in philosophy and the Vienna Circle are prima facie similar currents in contemporary philosophy. Both reject metaphysics, claim that reality is a spatio­‑temporal realm and adhere to noncognitivism in terms of values. However, justifications of these assumptions are quite different. In the following article we reconstruct main theses of both mentioned currents and then we indicate their impact on one of the major jurisprudential movements, namely Scandinavian Legal Realism. We focus on Alf Ross’ legal philosophy, as it (...) was an attempt to accommodate both: the philosophy of the Uppsala School and of the Vienna Circle. We trace those two sources of inspiration in Ross’ theory of legal validity and of legal concepts. (shrink)

Artykuł przedstawia polskie regulacje prawne z lat 1998-2007 będące podstawą lustracji. Analizuje szereg aktów prawnych prezentując zakładane cele lustracji, jej zakres, procedury i przewidywane sankcje karne. Celem autora jest identyfikacja aksjologicznych podstaw regulacji prawnych dotyczących lustracji. W trakcie analiz wskazuje on m. in. na brak proporcji między sankcjami karnymi a winą jednostek, zwłaszcza w niektórych przypadkach penalizacji oświadczeń lustracyjnych niezgodnych z prawdą lub penalizacji niezłożenia oświadczeń. Autor argumentuje także, że analizowane rozwiązania zakładały – wbrew deklarowanym celom – przeniesienie odpowiedzialności za (...) zło systemu politycznego z jego aktywnych twórców na jednostki wbrew woli poddane działaniu tego systemu. Ponadto argumentuje, że lustracja oparta na przeprowadzanym przez państwo „teście moralności” radykalnie ingeruje w wewnętrzną sferę moralności jednostki i stąd zakłada elementy typowe dla aksjologii systemów totalitarnych; państwo nakazuje dokonać działania, które bezpośrednio i wprost zmierza do realizacji ściśle wewnętrznej wartości moralnej opartej na zgodności oświadczenia z przekonaniami, i jednocześnie państwo ustanawia siebie nie tylko obserwatorem i sędzią realizacji tej wartości, ale także autorem wzorca przekonań, z którymi oświadczenie ma być zgodne. Problem of Axiological Legitimization of the Universal System of the Protection of Human Rights Summary In this paper it is argued that legitimization of the universal system of the protection of human rights depends primary not from the content of values recognised as fundamental but rather from metaaxiological solutions related to the way of existence and to the possibility of cognition of these values. Legitimisation is based on the recognition of an objective nature and of cognoscibility of basic values. Realisation (...) of the primary aim of this paper is linked to the problem of different meanings of the notion of universality, used in the context of the universal system of the protection of human rights. First, descriptive and normative meanings have to be distinguished. In the case of normative sense, there are moral and legal meanings of “universality”. An axiological justification of the universality of human rights in the legal sense leads to the legitimisation of the universal system. It is shown that modifications of – broadly accepted in the Polish theory of law – definitions of an axiological justification of legal norms are needed. These definitions base such a justification on the valuations made by particular groups of subjects. It is argued that it is much more convenient to refer to valuations understood as meanings of sentences of certain kind. -/- Streszczenie W artykule zmierza się do uzasadnienia tezy, że legitymizacja uniwersalnego systemu ochrony praw człowieka jest oparta nie tyle na treści wartości uznawanych w tym systemie, ale na uznanych w nich rozstrzygnięciach metaaksjologicznych, dotyczących tego, jak istnieją wartości podstawowe dla tego systemu i czy są one poznawalne. Walor legitymizacyjny posiada przede wszystkim uznanie obiektywnego charakteru tych wartości i ich poznawalności. Realizacja zasadniczego celu zakłada uporządkowanie podstawowych pojęć dotyczących problematyki powszechności praw człowieka – termin „powszechność” stosowany w odniesieniu do praw człowieka w kontekście uniwersalnego systemu ochrony ma wiele znaczeń. Przede wszystkim odróżnić trzeba powszechność w aspekcie opisowym i w aspekcie normatywnym. W przypadku powszechności w aspekcie normatywnym w grę może wchodzić powszechność w sensie ideowym i powszechność w sensie pozytywnoprawnym. Uzasadnienie tej ostatniej jest też uzasadnieniem poszukiwanej tu legitymizacji uniwersalnego systemu ochrony praw człowieka. Prowadzone analizy prowadza także do sformułowania postulatów dotyczących sposobu definiowania uzasadnienia aksjologicznego norm prawnych. Modyfikacji wymagają powszechnie przyjmowane w polskiej teorii prawa definicje relatywizujące takie uzasadnienie do ocen przyjmowanych przez konkretne podmioty oceniające lub ich grupy. (shrink)

An important argument in favour of recognising the cultural relativism and against universality of dignity and human rights, is the claim that the concept of dignity is a genuinely modern one. An analysis of a passage from the Demiurge’s speech in Timaeus reveals that Plato devoted time to reflecting on the question of what determines the qualitative difference between certain beings (gods and human being) and the world of things, and what forms the basis for the special treatment of these (...) beings – issues that using the language of today can be described reasonably as dignity. The attributes of this form of dignity seem to overlap with the nature of dignity as we know it today. Moreover, Plato proposes a response both to the question of what dignity is like, as well as the question of what dignity is. It is existential perfection, rooted in a perfect manner of existence, based on a specific internal unity of being. Dignity is therefore primordial in regard to particular features and independent of their acquisition or loss. Plato’s approach allows him to postulate that people be treated as ends in themselves; an approach therefore that prohibits the treatment of people as objects. Both the state and law are ultimately subordinated to the good of the individual, rather than the individual to the good of the state. -/- Istotny argument na rzecz relatywizmu kulturowego i przeciwko powszechności godności i wynikających z niej praw człowieka, oparty jest na poglądzie, że godność uznana została dopiero w czasach nowożytnych. Analiza fragmentu mowy Demiurga z Platońskiego dialogu Timajos ujawnia, że Platon rozwinął refleksję nad czymś, co stanowi o jakościowej różnicy między pewnymi istotami (bogami i ludźmi) a światem rzeczy, i co jest podstawą szczególnego traktowania tych istot, a co językiem współczesnym zasadnie można określić jako godność. Zbieżna jest charakterystyka tej godności z charakterystyką przyjmowaną współcześnie. Co więcej, Platon daje propozycję odpowiedzi nie tylko na pytanie, jaka jest godność, ale także na pytanie, czym jest godność. Jest ona doskonałością egzystencjalną, ugruntowanym w szczególnie doskonałym sposobie istnienia, opartym na szczególnej wewnętrznej jedności bytu. Jako doskonałość istnienia ogarnia ona cały byt, wszystkie jego cechy; jest nieoddzielalna od bytu (jest przyrodzona i niezbywalna). Jako pierwotna wobec partykularnych cech, jest niezależna od ich nabywania lub utraty. Platońskie ujęcie pozwala w oparciu o ujęcie godności formułować postulaty zbieżne z formułowanymi dziś dyrektywami nakazującymi traktować osoby jako cele same w sobie i zakazującymi traktowania osób w sposób czysto instrumentalny, przedmiotowy. Okazuje się, że – zdaniem Platona – jednostki nie wolno traktować czysto instrumentalnie dla dobra państwa; zarówno państwo, jak i prawo są podporządkowane dobru jednostki. (shrink)

W NINIEJSZYM opracowaniu analizuję klauzulę dobra wspólnego zawartą w art. 1 Konstytucji Rzeczypospolitej Polskiej z 2 kwietnia 1997 r., zmierzając do uwyraźnienia, w jakim sensie można mówić o jej prawnonaturalnym charakterze (zatem i do zarysowania możliwych znaczeń zwrotu "prawnonaturalny charakter klauzuli dobra wspólnego") oraz do ujawnienia „momentów" prawnonaturalnych, które mogą wchodzić w grę przy interpretacji tej klauzuli.
