What kind of reality is legal reality, how is it created, and what are its a priori foundations? These are the central questions asked by the early phenomenologists who took interest in social ontology and law. While Reinach represents the well-known “realist” approach to phenomenology of law, Felix Kaufmann and Fritz Schreier belonged to the “positivist” “Vienna School of Jurisprudence,” combining Hans Kelsen’s Pure Theory of Law with Edmund Husserl’s phenomenology—and thereby challenging Reinach’s views on how legal reality and the (...) legal a priori were to be conceived. This paper addresses the controversy between these positivist and realist approaches to phenomenology of law, with the goal of introducing the lesser known theories of Kaufmann and Schreier. The special focus on their critique of Reinach’s outline should give us an overview of their positions vis-à-vis the basic and a priori elements of which legal reality consists and the role that phenomenology plays in analyzing them. There is one general tendency to be noted: While the phenomenological legal positivists see the root of legal reality in an act of interpretation according to a “normative scheme of interpretation,” Reinach locates the roots of legal reality in social interaction and argues for the existence of entities independent of any interpretation. Este capítulo es una guía para conocer los elementos básicos de la fundamentación metafísica. Ofrece una revisión accesible de sus características y usos, comparando este concepto con otras formas de dependencia que se pueden encontrar en la literatura. Enfatiza dos roles teóricos centrales que la fundamentación supuestamente juega en la teorización filosófica: (i) dar cuenta de una forma distintiva de determinación no causal y (ii) entender mejor la estructura jerárquica de la realidad. This paper examines and compares the ways in which intentions of the singular kind and the plural kind are subjective. Are intentions of the plural kind ours in the same way intentions of the singular kind are mine? Starting with the singular case, it is argued that “I intend” is subjective in virtue of self-knowledge. Self-knowledge is special in that it is self-identifying, self-validating, self-committing, and self-authorizing. Moving to the plural form, it is argued that in spite of apparent differences, (...) attitudes of the form “we intend” are subjective in the same way. The self-knowledge at work here is plural rather than singular. This supports a plural subject account of collective intentionality. It is argued that the worries sometimes raised in the literature against the metaphysical “spookiness” of plural subjects are due to a fundamental misconception of the way in which attitudes of either kind –singular and plural – are subjective. El proceso educativo sufrió un drástico cambio debido a la pandemia que padecimos a nivel mundial, tuvimos que aprender a usar las herramientas tecnológicas en la enseñanza y en el aprendizaje. Por lo que siguiendo esta tendencia planteamos la utilización de la aplicación “Física M-Lab” en su primera versión para la enseñanza de la cinemática.Como estamos en el campo de las ciencias sociales, utilizamos el diseño cuasiexperimental que nos permitió concluir en que los aprendizajes mejoraron significativamente.

This chapter examines Bunge’s distinction between the logical concept of existence and the ontological one. We introduce a new conceptual existence predicate in an intensional environment that depends on the evaluation world. So that we can investigate restricted areas where the different kinds of concepts might exist. We hope this new predicate would encompass Bunge’s philosophical position which he designates as conceptualist and fictional materialism. The basic hybridization acts as a bridge between intensions and extensions because @ works as a (...) useful rigidifier. In hybrid logic, the accessibility relation and many properties this relation might have can be easily expressed in the formal language. The initial hypothesis is that hybridization and intensionality can serve as unifying tools in the areas involved in this research; namely, Logic, Philosophy of Science and Linguistics. (shrink)

This article will address the Kantian concept of respect for persons from the constructivist approach of philosopher Carla Bagnoli. Her proposal is an inspiring and elaborate update of the concept, but some aspects suggest difficulties. I will argue that these difficulties would have to do with issues that would need to be clarified and with some tensions, understood as arising from certain interpretations and redefinitions, that would also raise the need to consider a revision of what constitutes the status of (...) a person. There are a wide variety of potential applications of artificial intelligence (AI) in Defence settings, ranging from the use of autonomous drones to logistical support. However, limited research exists exploring how the public view these, especially in view of the value of public attitudes for influencing policy-making. An accurate understanding of the public’s perceptions is essential for crafting informed policy, developing responsible governance, and building responsive assurance relating to the development and use of AI in military settings. This study is (...) the first to explore public perceptions of and attitudes towards AI in Defence. A series of four focus groups were conducted with 20 members of the UK public, aged between 18 and 70, to explore their perceptions and attitudes towards AI use in general contexts and, more specifically, applications of AI in Defence settings. Thematic analysis revealed four themes and eleven sub-themes, spanning the role of humans in the system, the ethics of AI use in Defence, trust in AI versus trust in the organisation, and gathering information about AI in Defence. Participants demonstrated a variety of misconceptions about the applications of AI in Defence, with many assuming that a variety of different technologies involving AI are already being used. This highlighted a confluence between information from reputable sources combined with narratives from the mass media and conspiracy theories. The study demonstrates gaps in knowledge and misunderstandings that need to be addressed, and offers practical insights for keeping the public reliably, accurately, and adequately informed about the capabilities, limitations, benefits, and risks of AI in Defence. En el marco de la reflexión sobre las relaciones entre ética y política como dimensiones de la experiencia humana y de la vida en común, se presenta una aproximación comparativa a la noción de democracia del filósofo estadounidense John Dewey y la del neozapatismo mexicano. Se señalan algunos puntos de encuentro entre estas nociones, principalmente, la consideración de la democracia como forma de vida comunitaria, como ethos, no sólo como forma de gobierno, y la afirmación de la coexistencia entre lo (...) diverso, en distintas escalas, como condición de la democracia —el pluralismo en Dewey y el pluriversalismo en el neozapatismo—. Se indican también importantes diferencias como el énfasis en el desarrollo de las potencialidades humanas individuales presente sólo en Dewey, y la historicidad y las relaciones de poder que contempla la noción de democracia de los neozapatistas, a diferencia de la de Dewey. El texto afirma la posible fecundidad del diálogo entre distintas tradiciones de pensamiento para la comprensión de la democracia en un sentido más radical, en el que se imbriquen ética y política. A wide range of more objectivist norms appear to leave uncharted an important part of normative space. In the beginning of this paper I briefly outline two broad ways of seeking more subject-directed norms: perspectivism and feasibilism. According to feasibilism, the ultimate reason why more objectivist norms are inadequate on their own is not that they fail to take into account the limits of an agent’s perspective, but that they are not sensitive to limits on what ways of choosing, acting, (...) and believing are feasible in a given situation. I think of these ways of choosing, acting, and believing in terms of an agent's dispositions. In this paper I focus on a knowledge-first implementation of feasibilism, a view in epistemology that supplements a knowledge norm with a norm urging one to manifest dispositions that are among the most knowledge-conducive feasible ones. A view with different norms that sometimes cannot be jointly satisfied raises questions about the status of these norms. By drawing on two general hypotheses about the relationship between succeeding (e.g. knowing) and manifesting dispositions conducive to success, I argue for a view on which the prescriptive and the hypological come radically apart. The result is that an epistemic analogue of a thesis that many have assumed to hold in the moral realm should be rejected. This thesis is Only Blameworthy for Wrongs: we can only ever be blameworthy for acts that are morally wrong. I argue that on the picture presented, we can be epistemically blameworthy for doxastic states that do not violate any prescriptive epistemic norms. I then generalise the considerations to the moral realm, arguing against Only Blameworthy for Wrongs. (shrink)

Under normal circumstances, saying that you have a thought, a belief, a desire, or an intention differs from saying that somebody (who happens to be you) has that attitude. The former statement comes with some form of first person authority and constitutes commitments that are not involved in the latter case. Speaking with first person authority, and thereby publicly committing oneself, is a practice that plays an important role in our communication and in our understanding of what it means to (...) be a person. In their Group Agency, Christian List and Philip Pettit argue that some corporations are agents with attitudes of their own, and they claim that they are persons. The question on which this paper is focused is: Can corporations (groups with attitudes and the capacity for linguistic communication) participate in this practice, that is, can they express their attitudes with first person authority, and thereby enter first person commitments? The first section of the paper gives a rough (and, I hope, ecumenical) account of some features of first person authority and commitment. The second section examines if and how this account of first person authority carries over to corporations. It is argued that the possibility for groups to express their attitudes with straightforward first person authority, and thus to enter first person commitments, are extremely limited. The third part of the paper argues that while under normal circumstances, a member’s expression of her group’s attitudes in first person plural terms does not constitute straightforward first person authority, it does come with something resembling some aspects of the first-personal commitments encountered in the singular case. By reconstructing the teleological conceptions of Thomas Aquinas, Suarez, Descartes, Spinoza, and Leibniz, the author argues against the common view that mechanical philosophers in the Early Modern Period rejected natural teleology because of its association with an Aristotelian picture of the world. First, many thinkers in the Early Modern Period did not reject teleological explanations for natural phenomena. Second, many scholastic thinkers already believed that pure natural teleology was problematic because they held that authentic teleological explanations are only possible when (...) goals can be recognized.". La sobrecarga de información resulta un problema epistemológico que preocupa a distintas áreas del conocimiento tales como al campo de las ciencias cognitivas, en su intento por modelar sistemas capaces de detectar relevancia como a la ya olvidada enciclopedística, practicada durante los siglos XVI- XVIII y abocada a la organización, disposición y difusión de la información científica de la época. El presente artículo intenta dar cuenta del fracaso de estos dos campos de investigación a la hora de hallar soluciones ante (...) la problemática de la sobrecarga informacional. Para abordar nuestra cuestión clave, examinaremos particularmente las miradas relativamente pesimistas de H. Dreyfus y de Novalis. Los tratamientos de estos autores demuestran que la sobrecarga de información no puede, ni podrá ser resuelta, si no se recurre a otra vía de investigación por fuera de aquellas que se muestran como insuficientes, a saber: el modelo computacional de la mente (Dreyfus) y la operación enciclopedística clasificatoria (Novalis). Dass Edmund Husserl am Problem der Intersubjektivität gescheitert ist, gilt als ausgemacht - und ebenso, welche Konsequenzen daraus zu ziehen sind. Entgegen dem allenthalben pauschal erklärten `Abschied vom Subjekt' spricht aber vieles dafür, dass es in der gegenwärtigen Sozialtheorie eher um eine Reformulierung transzendentaler Subjektivität geht. Diese Interpretationsthese wirft ein neues Licht auf den sozialtheoretischen Diskurs, der im deutschen Sprachraum in den vergangenen dreissig Jahren vom Gegensatz von Jürgen Habermas' und Niklas Luhmanns Theorien bestimmt war: `Diskurs' und `System' erscheinen als (...) gegensätzliche Versuche, `Subjektivität' und `Interität' in ein theoretisch befriedigendes Verhältnis zu setzen. Wenn aber - so die kritische These dieses Buches - weder die Reformulierung von Subjektivität als `Interität' noch die Reformulierung von Subjektivität ohne `Interität' das Problem der Intersubjektivität überzeugend löst, ist dies ein Grund, neuerlich in eine direkte Auseinandersetzung mit Husserls Theorie transzendentaler Subjektivität einzutreten. Dabei stellt sich heraus, dass Husserls vielkritisierter und -skandalisierter Versuch, den Sinn `Anderer' im `Eigenen' zu fundieren, in der transzendentalphänomenologischen Subjekttheorie durch ein umgekehrtes Begründungsverhältnis konterkariert wird. Bei aller Problematik dieser Theorieanlage - welche nur in Gegenwendung zu den Gewohnheiten der Husserl-Interpretation, vor allem aber auch zu Husserls Selbstinterpretation in den Blick kommt - zeigt sich, dass der phänomenologische Begriff des transzendentalen Subjekts seinen Reformulierungen als Diskurs und als System in mancher Hinsicht überlegen ist. This volume contributes to a current debate within the psychology of thought that has wide implications for our ideas about creativity, decision making, and economic behavior. The essays focus on the role of implicit, unconscious thinking in creativity and problem solving, the interaction of intuition and analytic thinking, and the relationship between communicative heuristics and thought. O presente artigo pode ser justificado como um breve panorama do debate entre modernidade e pós-modernidade em suas implicações ao campo da educação e formação humana, diante da emergência de nova humanidade, fruto do capitalismo tardio, com suas promessas não cumpridas, diante da colonização de todas as esferas, inclusive da própria educação. Assim, este trabalho visa a traçar alguns contornos do complexo liame entre modernidade e pós-modernidade, bem como a concepção de homem decadente, por um lado, e de homem emergente, (...) de outro, ante essa nova condição geracional. Para tal, o trabalho se constitui de uma pesquisa de metodologia teórico-conceitual, propondo-se como uma contribuição ao recorrente questionamento sobre a relevância das metanarrativas na formação humana, tomando como autores “estelares” Kant e Nietzsche, justificando, inclusive, uma espécie de pré-história do debate entre os metarrelatos. Daí, portanto, as escolhas conceituais deste artigo, que se deu por agenciamentos que possibilitassem a defesa de uma concepção vitalista, inerentemente criativa, como uma disciplina do pensamento indispensável a uma humanidade que se queira para além da mera reprodução erudita, do cinismo mercadológico ou, ainda, dos desígnios tecnocientíficos e rudeza materialista-determinista que rondam o tempo presente. Portanto, o artigo sugere que o novo paradigma em construção, ao se pautar por uma nova lógica, nos possibilita, considerando as críticas à modernidade, dar vazão a novo horizonte ético, que considere o homem em sua integridade. Ou seja, compreendido como “sujeito peninsular”, e não, como sonhava a modernidade, como homem “insular”, tido como sobrenatural, desenraizado do corpo e da natureza. Palavras-chave: Formação humana. El análisis detenido del pensamiento teológico-musical de Isidoro de Sevilla ha sido repetidamente ignorado por la crítica, hecho que ha provocado que el estado de la cuestión sobre la materia sea prácticamente inexistente. Debido a ello, este trabajo tiene un cuádruple objetivo. En primer lugar, fijar con precisión el citado estado de la cuestión. En segundo lugar, sistematizar el estudio del pensamiento teológico-musical isidoriano dentro de la totalidad de su pensamiento musical para que el primero pueda ser estudiado exhaustivamente y (...) de manera generalizada en el futuro. En tercer lugar, localizar, clasificar e introducir por primera vez todos los textos litúrgico-musicales de Isidoro de Sevilla de cara a su posterior estudio en futuras publicaciones. En cuarto lugar, exponer, también por primera vez, algunas de las ideas más relevantes del pensamiento teológico-musical isidoriano como ejemplo de la sistematización propuesta y como punto de partida para el establecimiento de futuras líneas de investigación. El conocimiento histórico –entendido como un proceso metacognitivo de asimilación constructiva sobre el pasado para explicar fenómenos– comporta un análisis del impacto y la transcendencia de determinados acontecimientos y procesos históricos, en cuya comprensión y valoración influye el concepto de relevancia histórica. Desde esta perspectiva es necesario implementar propuestas de evaluación sólidas, vinculadas al desarrollo competencial. El objetivo de este estudio es diseñar una guía de caracterización de los instrumentos evaluativos –actividades y ejercicios– más utilizados por el profesorado de Historia, (...) con el fin de optimizar los procesos de evaluación de esta competencia mediante una serie de descriptores estructurales, competenciales y transferenciales. Estos indicadores de pertinencia pueden marcar el camino de aquellos docentes que deseen perfeccionar su manera de evaluar lo históricamente determinante. En conclusión, este innovador planteamiento supone un proceso de formación continua del profesorado que contribuye a la mejora de la calidad educativa. (shrink)

There is a widespread assumption in Construction Grammar that the meanings of verbs correlate with or even determine their complementation forms and patterns. There is much less research on noun complementation, however, although this category is even more interesting for a number of reasons such as the potential for valency reduction, nominal topicalization constructions, and additional complementation options, e.g.of-PPs and existential constructions.In this paper we focus on the class of nouns reporting commissive illocutionary acts, and address the question of whether (...) there is a correlation between the meaning of these nouns and their preferred complementation patterns, and between their semantic similarity and their similarity in the distribution of complementation patterns.We report the results of a study of a set of 17 commissive nouns chosen from a wider collection of illocutionary nouns. Two types of analysis were carried out in order to compare the semantic and grammatical characteristics of these nouns. The semantic analysis was based on insights from speech act theory and the philosophy of language. We developed a framework for a systematic comparative description of the nouns in our word field. The results were tallied with a corpus-based grammatical analysis. Two hundred tokens of each noun type were randomly sampled from the Corpus of Contemporary American English. Using these data, the 17 nouns were subjected to an analysis of the relative frequencies of their complementation patterns.Results indicate a general match between noun meanings and complementation patterns. More specifically, however, they indicate that the closeness of this match depends on the prototypicality of nouns as members of the class of commissives.The study, then, contributes to our understanding of the relation between lexis and syntax. At the same time, it confirms the need for a close semantic analysis to account for the great extent to which item-specific information, i.e. properties of individual nouns, have to be taken into consideration at the expense of large-scale generalizations. Nos preguntamos el origen y desarrollo del comportamiento violento en los/as adolescentes y la influencia que ejerce la competencia parental. Pretendemos conocer la percepción que tienen los/as adolescentes de las competencias parentales y de sus dimensiones, analizando si varían en función del curso académico y el sexo. Se opta por un estudio descriptivo con aplicación del método cuantitativo sobre una muestra de 60 adolescentes, aplicando dos cuestionarios (Escala de Competencia Parental Percibida-h y Cuestionario de Agresividad Física y Verbal). Los resultados (...) muestran una atribución a los progenitores de competencia parental media, sin diferencias significativas entre los cursos evaluados. (shrink)
