Recent iterations in international legal thought of the debate over the transformative potential of law have tended to echo the long-standing assumption that radical movements, when they employ law-based tactics, do so in the same manner as reformist movements: they mobilise the legitimacy of law for short-term goals, only with more radical long-term goals in mind. However, movements such as the 2012 student strike in the Canadian province of Quebec demonstrate more diverse, creative engagements with law that openly mock the (...) legal system in an effort to simultaneously delegitimise the current legal order. This article argues that this movement’s approach is consistent with the notion of an ‘impudent’ use of law as politics but also extends it further to include ideas raised by this movement’s theatrical ‘over-compliance’ with law, through which the movement turned law itself into a public spectacle. The article examines instances of the state’s unprecedented mobilisation of the legal system to contain the student strike and the student strikers’ creative and subversive engagements with law in response, illustrating how the ideas thrown up by this movement can advance theoretical discussion in legal scholarship about law’s transformative potential. Previous research indicates that students in engineering self-report cheating in college at higher rates than those in most other disciplines. Prior work also suggests that participation in one deviant behavior is a reasonable predictor of future deviant behavior. This combination of factors leads to a situation where engineering students who frequently participate in academic dishonesty are more likely to make unethical decisions in professional practice. To investigate this scenario, we propose the hypotheses that (1) there are similarities in the decision-making (...) processes used by engineering students when considering whether or not to participate in academic and professional dishonesty, and (2) prior academic dishonesty by engineering students is an indicator of future decisions to act dishonestly. Our sample consisted of undergraduate engineering students from two technically-oriented private universities. As a group, the sample reported working full-time an average of six months per year as professionals in addition to attending classes during the remaining six months. This combination of both academic and professional experience provides a sample of students who are experienced in both settings. Responses to open-ended questions on an exploratory survey indicate that students identify common themes in describing both temptations to cheat or to violate workplace policies and factors which caused them to hesitate in acting unethically, thus supporting our first hypothesis and laying the foundation for future surveys having forced-choice responses. As indicated by the responses to forced-choice questions for the engineering students surveyed, there is a relationship between self-reported rates of cheating in high school and decisions to cheat in college and to violate workplace policies; supporting our second hypothesis. Thus, this exploratory study demonstrates connections between decision-making about both academic and professional dishonesty. If better understood, these connections could lead to practical approaches for encouraging ethical behavior in the academic setting, which might then influence future ethical decision-making in workplace settings. Humans are one of the most cooperative and altruistic species on the planet. At the same time, humans have a long history of violent and deadly intergroup conflicts, i.e. wars. Recently, contemporary evolutionary theorists have revived Charles Darwin’s idea that human in-group altruism and out-group hostility might have co-evolved. Groups with more cooperatively aggressive men, they suggest, were more likely to prevail in the frequent lethal quarrels of human pre-history, and these men, therefore, more likely to have passed on their (...) genes. After a short introduction to evolutionary perspectives on war heroism, we describe selected characteristics of 988 modern war heroes, the US-American Medal of Honor recipients of WWI, WWII, the Korean and the Vietnam War, and discuss whether an evolutionary perspective can help us understand why these men risked their lives ‘beyond the call of duty’. We report three studies which test a sexual selection hypothesis for male war heroism. Based on evolutionary theories of mate choice we hypothesize that men signal their fitness through displaying heroism in combat. First, we report the results of an archival study on US-American soldiers who fought in World War II. We compare proxies for reproductive success between a control sample of 449 regular veterans and 123 surviving Medal of Honor recipients of WWII. Results suggest that the heroes (...) sired more offspring than the regular veterans. Supporting a causal link between war heroism and mating success, we then report the results of two experimental studies. We find evidence that female participants specifically regard men more sexually attractive if they are war heroes. This effect is absent for male participants judging female war heroes, suggesting that bravery in war is a gender specific signal. Finally, we discuss possible implications of our results. (shrink)

Graebe (Steubenville, OH: Emmaus Academic, 2021), 351 pp.Though Mary's undiminished virginity in giving birth (virginitas in partu) was long understood to be an event as miraculous and a teaching as authoritative as her virginity (...) in conceiving (virginitas ante partum), virginitas in partu underwent a kind of existential reinterpretation in the middle of the twentieth century. Authors such as Albert Mitterer and Karl Rahner suggested that, physically speaking, Jesus's birth might have happened like any other, rupturing the hymen, distending the birth canal, and causing Mary pain, albeit not in the spiritually disintegrating way common to postlapsarian humanity. These arguments effectively "unsettled" the traditional understanding of virginitas in partu, leading theologians of the highest stature to distinguish between the doctrine itself and the anatomical aspects attached to it over time. Fr. Brian Graebe has written a fine book arguing that the bodily dimensions of the virgin birth, including the physical "seal" of virginity, belong to the substance of the doctrine. This more inclusive understanding not only does better justice to the data of tradition, he argues, but illuminates the ecclesiology of the Second Vatican Council. The book impresses by its theologically reflective method, its clarity of exposition, [End Page 1106] and its depth of research—especially into the archival and antepreparatory sources of Vatican II.Vessel of Honor responds in effect to Rahner's argument that physical intactness is peripheral to the dogmatic core of Mary's virginity in partu. To show otherwise, Rahner contended, one would need to show that such a doctrine can be found directly in the apostolic teaching, or that it, "being implicitly contained therein, has grown out of the apostolic doctrine, by a legitimate historical, logical, and theological process, as its authentic development" (68–69). If the bodily aspects of this doctrine really belonged to the deposit of faith, in other words, one would need to show how they are implied in the traditio divino-apostolica, as well as how they cohere organically with the rest of the deposit. The two major parts of Vessel of Honor respond in turn to each aspect of Rahner's challenge.The first three chapters argue that Mary's bodily integrity in parturition belongs at least implicitly to the traditio divino-apostolica. Turning first to the postapostolic tradition, Fr. Graebe shows that—apart from the early exceptions of Origen and Tertullian—patristic sources either affirm or strongly imply a miraculous delivery. This constant witness culminates in the Lateran Council (649 AD), which, while not itself an ecumenical council, was received into the magisterium of Pope Martin and affirmed by the Third Council of Constantinople (680 AD). Its teaching that Mary "gave birth without corruption" (incorruptibiliter... genuisse) would be defended by Paschasius, Ratramnus, Thomas Aquinas, and others. This consensus remained undisturbed until the eve of Vatican II.Even at Vatican II, Fr. Graebe argues in the next chapter, the Council Fathers intended to reaffirm the more inclusive idea of virginitas in partu against those who would marginalize its bodily dimensions. University president Sr. Margaret Carney, O.S.F., and Fr. Michael Cusato, O.F.M., director of The Franciscan Institute and dean of the School of Franciscan (...) Studies, presented the medal during an Academic Convocation at 7 p.m. in The Regina A. Quick Center for the Arts. A reception followed in the Dresser-Rand Atrium. During the Convocation, Giovanni Miccoli gave a presentation, “A Reading of the Christian Proposal of Francis According to His First Biographers,” continuing a longtime focus on the study of Francis of Assisi and his contributions to the Church. Professor Miccoli, who was born in Trieste, Italy, in 1933, studied in Pisa at the Scuola Normale Superiore and the Università, in Munich at the Monumenta Germaniae Historica, and London at the Warburg Institute. He has taught in Pisa, Venice and his native Trieste, where he is now a professor emeritus at the Università di Trieste. A historian of the Middle Ages and of the Roman Catholic Church, he has combined those loves to specialize first in the Gregorian Reformation, reforms undertaken within the Church under Pope Gregory VII at the end of the 11th century. Turning his eyes to more modern times, he is also an expert on the relationship between the Catholic Church and Fascism in Italy, including the questions related to Pius XII’s pontificate during World War II. His study of the Church in Italy during the Middle Ages led to a focus on Francis of Assisi and his impact on the Church, which led to his becoming one of foremost Franciscan scholars of modern times. Miccoli is particularly known for his contribution to 1974’s “La Storia Religiosa” (Religious History of Italy), which is the second volume of “Storia d’Italia” (History of Italy). In “La Storia Religiosa” he examined how Francis and his movement influenced the history and development of the Church in Italy. 8 GIOVANNI MICCOLI Since that time, he has published several major articles on Franciscan issues, largely drawing from early Franciscan documents and sources, which have been translated from Italian to English and published in Greyfriars Review, a publication of the Franciscan Institute. H´ector-Neri Casta˜neda-Calder´on (December 13, 1924–September 7, 1991) was born in San Vicente Zacapa, Guatemala. He attended the Normal School for Boys in Guatemala City, later called the Military Normal School for Boys, from which he was expelled for refusing to fight a bully; the dramatic story, worthy of being filmed, is told in the “De Re” section of his autobiography, “Self-Profile” (1986). He then attended a normal school in Costa Rica, followed by studies in philosophy at the University of San (...) Carlos, Guatemala. He won a scholarship to the University of Minnesota, where he received his B.A. (1950), M.A. (1952), and Ph.D. (1954), all in philosophy. His dissertation, “The Logical Structure of Moral Reasoning”, was written under the direction of Wilfrid Sellars. He returned to teach in Guatemala, and then received a scholarship to study at Oxford University (1955–1956), after which he took a sabbatical-replacement position in philosophy at Duke University (1956). His first full-time academic appointment was at Wayne State University (1957– 1969), where he founded the philosophy journal Noˆus (1967, a counter-offer made to him by Wayne State to encourage him to stay there rather than to take the chairmanship of philosophy at the University of Pennsylvania). In 1969, he moved (along with several of his Wayne colleagues) to Indiana University, where he eventually became the Mahlon Powell Professor of Philosophy and, later, its first Dean of Latino Affairs (1978–1981). He remained at Indiana until his death. He was also a visiting professor of philosophy at the University of Texas at Austin (1962–1963) and a fellow at the Center for Advanced Study in the Behavioral Sciences (1981–1982). He received grants and fellowships from the Guggenheim Foundation (1967–1968), the T. Andrew Mellon Foundation, the National Endowment for the Humanities, and the National Science Foundation. He was elected President of the American Philosophical Association Central Division (1979– 1980), named to the American Academy of Arts and Sciences (1990), and received the Presidential Medal of Honor from the Government of Guatemala (1991). Chronic shortage in organs for transplantation worldwide is leading many policy-makers to consider various incentives that may increase donation rates.1 These range from giving holders of donor cards some priority on the transplant waiting list or a discount on health insurance premiums, to giving families who consent to donation a medal of honour, reimbursement of funeral expenses, tax incentives or even financial compensation.2–4 Of the various proposed incentive mechanisms, the one that has consistently garnered the most criticism and objection (...) in the literature is that of paying families who consent to donate the organs of a deceased loved one.Arguments against such a policy abound: it could exploit the poor, influence the family to prematurely withdraw care, encourage families to withhold medical information that would result in transplant-transmission of disease, and finally, it would commercialise the value of human life and result in the perception of human organs as commodities. Indeed, to date no Western country has adopted a policy of financial compensation to families for consenting to organ donation.2Recently, a country suffering from severe shortage in organs has implemented a policy of financial incentives that uses cash payments. Wu and Fang5 describe a recent pilot programme in China that compensates families for postmortem donation, through an independent third party and based on consent or presumed consent of the deceased. We investigated the role of honour concerns in mediating the effect of nationality and gender on the reported intensity of anger and shame in reaction to insult vignettes. Spain, an honour culture, and The Netherlands, where honour is of less central significance, were selected for comparison. A total of 260 (125 Dutch, 135 Spanish) persons participated in the research. Participants completed a measure of honour concerns and answered questions about emotional reactions of anger and shame to vignettes depicting insults in (...) which type of threat was manipulated. It was found that Spanish participants responded especially intensely to insults that threaten family honour, and that this effect of nationality on emotional reactions to threats to family honour was mediated by individual differences in concern for family honour. The shortage of organs (...) for transplantation has been an ongoing problem for more than 20 years. In June1981, Representative Philip Crane (R-IL) introduced legislation in the U.S. House of Representatives proposing a $25,000 income tax deduction and a $25,000 estate tax exclusion for donating an organ (Tax Incentives 1981). Still the National Organ Transplant Act enacted in October 1984 prohibited the offering of any "valuable consideration" in return for organs (United States 1984).The developments of a legal market for tissues in the United States and a black market for organs around the world have raised the question of whether donation without compensation is the only ethically viable option. Some critics of the current system claim reliance on donation actually promotes a black market in organs (Kaserman and Barnett 2002, p. 38; Palmer 1999, p. 36). In addition, a new set of compensation issues has arisen as living kidney donor transplantations begin to rival those performed with cadaveric organs (United States 2001).As a result, current suggestions for incentives go far beyond the traditional death benefit payment to include such ideas as medals of honor for donors, reimbursement for funeral expenses, exchange programs for organ donation, and special medical insurance for living organ donors. Numerous bills introduced into the 107th Congress have proposed such incentives (Delmonico et al. 2002.) This essay distinguishes between honor-typical and authoritarian behavior in humans and animals. Whereas authoritarianism concerns hierarchies coordinated by control and obedience, honor concerns rankings of prestige determined by fair contests. Honor-typical behavior is identifiable in non-human species, and is to be expected in polygynous species with non-resource-based mating systems. This picture lends further support to an increasingly popular psychological theory that sees morality as constituted by a variety of moral systems. If moral cognition is pluralistic in this (...) way, then the question of moral agency is better considered in terms of particular moral modes, one of which will be “honor-agency.” The universal principles of honorable conduct suggest a handful of criteria for counting as an honorable agent (human or otherwise), and these criteria can be specified without commitment to any particular account of what it takes to be an agent in general. In this paper, I consider the difficult relationship between Rawls, religion and the values that religious believers might consider important in order to lead the good life. Contrary to many of Rawls’ defenders, I argue that at least some of the values that religious citizens are likely to hold cannot be accounted for under Rawls’ theory or under his conception of the good life. I argue that the model of goods which Rawls takes to be part of a thin theory (...) of the good is tied to his belief that under the Original Position justice can be derived from calculations of self-interest alone. To perform my critique, I consider the paradigmatic case of honour in so-called traditional societies. I argue that the way Rawls thematizes primary goods in A Theory of Justice , including concepts like esteem, cannot account for the way honour manifests itself inside traditional communities. I conclude the paper by considering how Rawls might be able to defend his theory against my objection, by considering the relationship between Rawls’ theory, and the rationalization and secularization of society. “Busyness” plainly relates to externally observable work or leisure activities, but nevertheless the state itself is entirely subjective. I will argue in what follows, that there may have been fundamental changes in the connection between the external circumstances of work and leisure and internal feelings of “busyness”. Through the last century there have been fundamental shifts in the relationship between the pattern of daily activities, and patterns of societal sub- and superordination. “Are you busy?” may have had a quite different (...) meaning as addressed to an upwardly mobile member of the Victorian English or American middle classes, as compared to an office worker at the turn of the third millennium. Individuals’ representations of their states of “busyness” play an important, and changing, role in establishing their positions in the order of social stratification. A leisure class at the end of the 19th century perhaps, but the dominant groups in the early 21st are in the most straightforward sense of the word, workers. I will suggest that, reflecting this fundamental shift in social structure, the social construction of “busyness” has also changed. (shrink)

Many cases of scientific fraud have been exposed publicly, and journals and academic institutions have deployed different measures worldwide in this regard. However, the influence of specific social and cultural environments on scientific fraud may vary from society to society. This article analyzes how scientists in Japan deal with accusations of scientific fraud. For such a purpose, a series of scientific fraud cases that took place in Japan (...) has been reconstructed through diverse sources. Thus, by analyzing those cases, the social basis of scientific fraud and the most relevant aspects of Japanese cultural values and traditions, as well as the concept of honour which is deeply involved in the way Japanese scientists react when they are accused of and publicly exposed in scientific fraud situations is examined. The moral sense is at the heart of Hutcheson's system. Its prominent role in this philosopher's morals and posterior commentary eclipses the rest of the senses, but there is at least one sense that deserves more attention in scholarship: the sense of honour. The reason the sense of honour, and its subordination to the moral sense, is attention-worthy is that it combats Mandeville's idea of honour as artifice. First, I flesh out the tension between pride and the moral sense and (...) a possible tension between the sense of honour and the moral sense. Next, I show how Hutcheson expanded and elaborated on the sense of honour, particularly in his later works ( System and Compendiaria). ABSTRACT The academic defense of honor for its positive political and moral effects has surged recently among moral philosophers and political theorists. Challenging the narrative that the feudal legacy of honor has become outdated but acknowledging the reasonable points that opponents of honor have made, contemporary defenders aim to render honor compatible with society and politics today. This defense is reminiscent of that in the seventeenth and eighteenth centuries, especially four modes of honor developed respectively (...) by Hobbes, Mandeville, Montesquieu, and Rousseau. Like contemporary scholars, these thinkers were conscious of the problems often associated with honor but appreciated its political usefulness. They aimed to preserve this feudal legacy in the early modern context. However, a comparative examination of these modes of honor reveals that, despite their internal coherence, they conflicted with one another owing to their authors’ conflicting understandings of the nature of honor. This conflict contributed to the tragic failure of the early modern defense of honor and testified to the conceptual elusiveness of honor. It is a cautionary tale for contemporary scholars who develop and defend essentialist and ahistorical understandings of honor. (shrink)

The culture of honour hypothesis offers a compelling example of how human psychology differentially adapts to pastoral and horticultural environments. However, there is disagreement over whether this pattern is best explained by a memetic, evolutionary psychological, dual inheritance, or niche construction model. I argue that this disagreement stems from two shortcomings: lack of clarity about the theoretical commitments of these models and inadequate comparative data for testing them. To resolve the first problem, I offer a theoretical framework for deriving competing (...) predictions from each of the four models. In particular, this involves a novel interpretation of the difference between dual inheritance theory and cultural niche construction. I then illustrate a strategy for testing their predictions using data from the Human Relations Area File. Empirical results suggest that the aggressive psychological phenotype typically associated with honour culture is more common among pastoral societies than among horticultural societies. Theoretical considerations suggest that this pattern is best explained as a case of cultural niche construction. (shrink)

In this paper, I show that the Parmenides provides important insight into how to properly engage in philosophical discussion—or, more accurately, how not to engage in it. From references to age, love-of-winning and love-of-honor, and a paral­lel to the Phaedo, I show that Parmenides is ruled by the spirited part of his soul in a way that compromises his ability to philosophize, and that the Parmenides is a warning about doing philosophy from a love of honor. Ideally, we (...) should do philosophy from a love of wisdom. When we are honor-loving, we are not only motivated by the wrong kind of thing, but our love of honor can also blind us to the specific ways in which we might be falling short of ideal philosophical engagement, such as missing the potential dangers of engaging in philosophy with certain kinds of interlocutors. Kant may be right that people ought to stop killing because they see that it’s wrong. There is one grand question that lies beneath most of what follows. That question is: what is morality I mean morality as it is contrasted with the non-moral, not as it is opposed to the immoral. The question does not ask, say, whether lying to a friend in a certain situation is moral or immoral, but asks what makes something, for instance lying to a friend, a moral problem. Parts of the same question ask what counts as a moral consideration, (...) as opposed to, say, one of efficiency or aesthetics, or ask what makes a motivation moral as opposed to prudential. Of the many far-reaching implications of Fincher & Thornhill's (F&T's) theory, we focus on the consequences of parasite stress for mating strategies, marriage, and the differing roles and restrictions for men and women. In particular, we explain how examination of cultures of honor can provide a theoretical bridge between effects of parasite stress and disproportionate emphasis on female purity.

Elizabeth H. Blackburn, Ph.D., is a leader in the area of telomere and telomerase research—in fact, in 1984 she codiscovered the ribonucleoprotein enzyme telomerase, opening up new potentials in cancer research and therapy. This and subsequent work has earned her numerous honors, not the least of which are the National Academy of Science Award in Molecular Biology, an Honorary Doctorate of Science from Yale University, the American Cancer Society Medal of Honor, and many more awards.
