In 1985, Swiss legal philosopher Walter Ott visited Herbert Hart in Oxford and made this record of their meeting, which casts novel light on some of Hart’s ideas. Ott engaged Hart in a fresh encounter with the legal philosophy of Gustav Radbruch, particularly Hart’s and Radbruch’s reasons for a minimum content of justice in law. They also discussed the grudge informer, state responsibility under laws of an earlier régime, and questions of the definition and falsifiability of legal theories. Hart surprisingly (...) reported Hans Kelsen as stating, when they had met at Berkeley in 1961, that Hume (and not Kant, and certainly not Wittgenstein) was the greatest philosopher who had ever lived. The diversity which characterizes our world does not preclude logical regularities due to the coherence of the human mind, which evolved slowly through the paleontological phases of its emergence over millions of years. The anatomical retroaction of the hominids is analyzed to show that, in the long run, anatomy reflected ‘cultural selection’. I introduce the concept of an unobtainable world, and use this to develop an alternative version of the free will defense that is preferable to one based on the concept of transworld depravity. I claim that Berkeley's main argument against abstraction comes into focus only when we see Descartes as one of its targets. Berkeley does not deploy Winkler's impossibility argument but instead argues that what is impossible is inconceivable. Since Descartes conceives of extension as a determinable, and since determinables cannot exist as such, he falls within the scope of Berkeley's argument.

Disputes over territory are a major contributing factor to the disruption of international relations. We believe that a cumulative, integrated, and continuously updated resource providing information about such disputes in an easily accessible form would be of benefit to intelligence analysts, military strategists, political scientists, and also to historians and others concerned with international disputes. We propose an ontology-based strategy for creating such a resource. The resource will contain information about territorial disputes, arguments for and against claims pertaining to sovereignty, (...) proffered evidence for such claims, political and military motives (overt or hidden), and associated conflicts. Our approach is designed to address several issues surrounding the representation of geopolitical conflict, including the tracking and individuation of disputes and the validation of disseminated information. Despite their influence on later philosophers such as Hume, Malebranche's central arguments for occasionalism remain deeply puzzling. Both the famous ‘no necessary connection’ argument and what I call the epistemic argument include assumptions – e.g., that a true cause is logically necessarily connected to its effect – that seem unmotivated, even in their context. I argue that a proper understanding of late scholastic views lets us see why Malebranche would make this assumption. Both arguments turn on the claim that a (...) volition is the only candidate for a cause, because only a volition can include an effect as its intentional content. (shrink)

John Dewey’s theory of value provides a strong alternative to traditional intrinsic value theory that can better address the need for a wide distribution of environmental values. Grounded in his theories of experience and inquiry, Dewey understands values as concrete practices acquired through the interaction of the human organism with its surroundings. Dividing value into acts of immediate valuation and acts of evaluation, Dewey shows that all values start out as desires and through reflective criticism eventuate in value practices. Value (...) inquiry is the practice of responding to problems in the world for which our established value practices are unable to respond adequately. This model of value is shown to be a much needed improvement over intrinsic value theory insofar as it is inclusive of human desire, limiting the capacity to value to human beings, avoids much of the metaphysical and ethical conflict in the biocentrism/ecocentrism debate, as well as rejects the artificial distinction between instrumental and intrinsic value. The case for Dewey’s theory of value is further strengthened by how closely Aldo Leopold’s experience-based practice of value in A Sand County Almanac parallels Dewey’s theory of value, especially with respect to the importance of desire, science, and education. Philosophers of the modern period are often presented as having made an elementary error: that of confounding the attitude one adopts toward a proposition with its content. By examining the works of Locke and the Port-Royalians, I show that this accusation is ill-founded and that Locke, in particular, has the resources to construct a theory of propositional attitudes.

In this paper I wish to argue that counterfactual analyses of causation are inadequate. I believe the counterfactuals that are involved in counterfactual analyses of causation are often false, and thus the theories do not provide an adequate account of causation. This is demonstrated by the presentation of a counterexample to the counterfactual analyses of causation. I then present a unified theory of causation that is based upon probability and counterfactuals. Recent discussion of the problem of evil has centered around what is known as the probabilistic or evidential argument from evil. According to this argument the evil in our world is evidence against the existence of God, even though evil is logically consistent with God’s existing. Based on this it is claimed it is irrational to believe one of the traditional theistic religions, unless there is overwhelming positive evidence to counter this negative evidence. One of the most important and widely (...) discussed versions of this argument is due to Paul Draper.1 In this paper I will look at Draper’s argument and argue that he has made a simple fundamental error; as a result his argument is irrelevant to most theists. After discussing this error in Draper’s argument, I will discuss probabilistic arguments from evil from the perspective of confirmation theory. The error in Draper’s argument is easily made and could occur in any probabilistic argument from evil; looking at confirmation theory and probabilistic arguments from evil will provide insight into reasoning about evil and belief in God. This paper explores the classical idea of complementarity in mathematics concerning the relationship of intuition and axiomatic proof. Section I illustrates the basic concepts of the paper, while Section II presents opposing accounts of intuitionist and axiomatic approaches to mathematics. Section III analyzes one of Einstein's lecture on the topic and Section IV examines an application of the issues in mathematics and science education. Semiotic mechanisms involving sacred natural sites – or areas of land or water with special spiritual significance – that have been focal points in agrarian vernacular religion have been transformed in modern Estonian culture. Some sites have accrued new significance as national monuments or tourist attractions and the dominant way of conceptualizing these sites has changed.Sacred natural sites should not be presumed to represent pristine nature. Rather, they are products of complex culture-nature interactions as they have been formed in the (...) course of traditional land management as well as different semiotic practices, including ritual and conservationist ones. The existence of sites encompassed by the term defies and blurs the rigid distinction between nature and culture.Individual sacred natural sites and categories of such sites can act as signifiers for a variety of different signifieds concurrently, acting as confluences of different sign systems and thus exemplifying the creolization of these systems as well as bringing about the hybridization of different landscape traditions in certain loci.Estonian literary culture has adopted motifs and narratives that define sacred natural sites more readily from other literary traditions than from the Estonian vernacular tradition; in turn, the vernacular tradition has also adopted and assimilated literary Romantic motifs. Esikülg on kõrvutuvuslik, st. paljusus, mille elemendid on üksteise kõrval; isekülg on läbistuvuslik, st. paljusus, mille elemendid läbistavad üksteist. Need kaks külge ei sarnane teineteisega ja nende vahel liikumine kätkeb taandamatut ajalisust, ontogeneesi. Artiklis laiendatakse olendi mõistet "vertikaalis" erinevatele keerukustasanditele (eluline, molekuliline, atomaarne jt) ja "horisontaalis" erinevatele individualiseeritusastmetele. A Theory of Beings The paper proposes to work out concepts for describing the individualization of beings on various levels of organization. A being with a certain degree of individuality comes into being when certain processes of differenciation are being integrated together. It is conceived of as having two aspects, self-relation (isekülg) and other-relation (esikülg). The former is a multiplicity where the elements interpenetrate each other and the latter is a multiplicity where the elements are exterior to each other (juxtaposition). The articulations of interpenetrating multiplicity determine how a being can affect its surroundings and be affected by it, and the modes of this articulation can be seen as attractors of the "phase-space" of a being. Ontogenesis is on the one hand the actualization of this virtual phase-space in an actual form with its characteristic ways of spatialization and temporalization. On the other hand, ontogenesis means the revirtualization of juxtaposing elements and processes. The number and intensity of these circuits determines the degree of power of a being. Unlike many of Descartes’s other followers, Pierre-Sylvain Re´gis resists the temptations of occasionalism. By marrying the ontology of mechanism with the causal structure of concurrentism, Re´gis arrives at a novel view that both acknowledges God’s role in natural events and preserves the causal powers of bodies. I set out Re´gis’s position, focusing on his arguments against occasionalism and his responses to Malebranche’s ‘no necessary connection’ and divine concursus arguments.

Hume's views on language have been widely misunderstood. Typical discussions cast Hume as either a linguistic idealist who holds that words refer to ideas or a proto-verificationist. I argue that both readings are wide of the mark and develop my own positive account. Humean signification emerges as a relation whereby a word can both indicate ideas in the mind of the speaker and cause us to have those ideas. If I am right, Hume offers a consistent view on meaning that (...) is neither linguistic idealism nor positivism but a genuine alternative to these, one that deserves to be taken seriously. (shrink)

Locke clearly intends what I call his 'linguistic thesis,' the claim that words signify nothing but ideas, to tell against Aristotelian essentialism. I argue that current interpretations of Locke's anti-essentialist arguments have not accorded the linguistic thesis its proper role. This is largely due to the prevalent misreadings of that thesis. Locke's view is that words reliably indicate ideas in the mind of the speaker. It is only once we see this that we can understand how the thesis functions in (...) Locke's anti-Aristotelian project. In this paper, I argue that Locke is not in fact agnostic about the ultimate nature of the mind. In particular, he produces an argument, much like Jaegwon Kim's exclusion argument, to show that any materialist view that takes mental states to supervene on physical states is committed to epiphenomenalism. This result helps illuminate Locke's otherwise puzzling notion of 'superaddition.'.

Profiles of art education in nineteen countries around the world by citizens or longtime residents of those countries comprise the core of this book. Guidelines for the cross-cultural study of art education are presented by the editors in a general introduction and three part introductions, and also by contributing specialists. The nineteen national profiles, with accompanying examples of children's artwork, make up the largest section of the book, Part II.
