In NX v. Cabrini Medical Center, New York's highest court overruled a divided Appellate Division and held that, as a matter of law, a jury could find a hospital negligent for its failure to protect a patient from sexual assault. The court refused, however, to adopt a higher standard of tort liability for health-care providers who treat incapacitated patients.

Although other quasi-Kantian theories have been adapted, Jürgen Habermas’s discourse theory has been largely ignored in discussions of environmental ethics. Indeed on some versions of what an environmental philosophy must entail, Habermas’s anthropocentric approach must be disqualified from the start. Yet, there are some environmentally friendly implications of his discourse theory. They may not give us everything we would wish, but in the contemporary political context we must treasure any moral theory that can draw on the still-extensive theoretical and political (...) resources of liberalism. Writers (...) who were dealing with sainthood (Camus, Kazantzakis, Genet, Kerouac, O'Connor, Werfel, etc.) are discussed, as well as non-Catholics acclaimed as ‘saints’ (Simone Weil, Dietrich Bonhoeffer) and persons admired as ‘living saints’ (Albert Schweitzer, Padre Pio). Part 3 considers the influence of some major canonisations in the inter-war era (e.g., Joan of Arc, Thomas More) and the widespread access to Vatican spectacle afforded by photojournalism and newsreel. Four routes of analysis are pursued: the veneration of saints as a response to wartime suffering and loss; the vigour of the vocabulary of sainthood, uncontaminated by Nazi or Stalinist abuse; the special appeal of the ‘outsider’ saint; and the political interests of the Vatican and Christian Democratic parties. The charge that the limit-frequency theory of probability is inconsistent due to incompatibility between the required features of randomness and limit convergence is inapplicable when probability sequences are taken to be empirically (i.e., extensionally) generated, as they must be on a strictly empirical conception of probability. All past attempts to meet this charge by formulating constructive definitions of randomness that would still allow for a demonstrable limit-convergence have, in their exclusive concern with logically (i.e., intensionally) prescribed sequences, left the logic (...) of extensional classes essentially untouched. In the light of a strict differentiation between intensional and extensional classes a generalized approach is possible under which several closely connected senses of randomness, i.e., the formal, material, restricted and unrestricted senses may be easily distinguished and related to the notion of relevance. The relationship of man himself to his environment is an inseparable part of ecology; for he also is an organism and other organisms are a part of his environment. Ecology, therefore, broadly conceived and rightly understood, instead of being an academic science merely, out of touch with humanistic interests, is really that part of every other biological science which brings it into immediate relation to human kind. The proper place of humans in ecological study has been a recurring issue for (...) ecology. Of course humans are part of Nature writ large, but are they part of the ecologist's nature? In this study, I surveyed students' evaluative perceptions of instructor behavior and their possible influence on academic dishonesty. Slightly over 20% of 1,369 student respondents admitted to academic dishonesty in at least 1 class during 1 term at college. Students who admitted to acts of academic dishonesty had lower overall evaluations of instructor behavior than students who reported not committing academic dishonesty. Implications for student learning and the enhancement of academic integrity in the classroom are discussed.

This article continues a discussion the authors have had with Mats Wahlberg on evolutionary theodicies. We have previously suggested a theodicy where there are token unique goods that could only have been actualized through indeterministic evolution. Wahlberg objects that we cannot appeal to such goods, since given indeterminism, God cannot know that such goods will appear. In this article we respond by arguing that God can know well enough that certain kinds of token goods will appear, without knowing in detail (...) their specific character, or when they will happen. The introduction of the concept of capital inCapital– with the words ‘we find’ – has provoked a great deal of discussion about the precise relation between the categories of simple circulation and the concept of capital. In this article, I argue that Marx derives the concept of capital by way of an analysis of the immanent contradictions of money, and that this dialectical derivation can be understood as a conceptual movement in which the concepts of money and capital progressively change (...) their modal status. Furthermore, I examine the development of this transition to capital throughout Marx’s writings from the period 1857 to 1872, arguing that the same arguments can be found in all the relevant writings. Finally, the article provides a critical review of the literature on the transition to capital. (shrink)

Frank Ebersole's extraordinary investigations of certain key philosophical ideas behind problems in epistemology and metaphysics are the subject of this article-review. I have resisted providing what many readers will expect me to provide, namely, a critical examination of his philosophical methodology. I do question his unwilligness to say why his investigations only yield I negative results, and I do have something to say about classifying him as an ordinary language philosopher. However, my main focus is on trying to engage critically (...) with what he actually does in his work. To this end, I provide a narrative of the investigation he carries out into the possibility of comparing the objects of perception and dreams, and I cite other works of his in support of my understanding of that investigation. Although one of his lengthiest essays seems to be devoted to an anticipation of an objection to his approach, I explain why even there he is not concerned with the question of why he always seems to get negative results. After suggesting why some of his later essays seem to be so hard to read, I conclude by saying something about what I take to be his achievement. (shrink)

Promoting a better understanding of the phenomenon of colonization and its connection with environmental knowledge and technology, this article proposes a reframing of research agendas to take into account the municipal character of colonization in the Hispanic realm and to ask new questions. Questions should address what human–ecosystem relations, and the ways of knowing and techniques for transforming the physical realm, can tell us about colonization itself; who the historical agents involved were, and what these actors knew, learned, and did (...) in their environments. Using the Basin of Mexico’s drainage and the agency of commoners, this article proposes that colonization depends on the massive deployment and generation of tacit knowledge about how to harness matter, energy, and time for the reproduction of human societies; the quotidian appropriation and reworking of autochthonous knowledge, techniques, and technology by the colonizing groups; the collaboration of the local populations in whom these are vested; and the agency of commoners with practical skills, environmental knowledge, and technological savvy derived from and honed in the realm of material production. In the Ibero-American realm, these agents were primarily commoners with skills in agropastoral production and the building trades; race, ethnicity, language, and gender were secondary conditions. Abstract. In this paper, which was among Don Browning's last writings before he died, we review and evaluate the main arguments against the United Nations Convention on the Rights of the Child (the “CRC”) that conservative American Christians in particular have opposed. While we take their objections seriously, we think that, on balance, the CRC is worthy of ratification, especially if it is read in light of the profamily ethic that informs the CRC and many earlier human rights instruments. More (...) fundamentally, we think that the CRC captures some of the very best traditional Western legal and theological teachings on marriage, family, and children, which we retrieve and reconstruct for our day. The list is given sometimes as fourteen or fifteen, sometimes as six, as nine, as twelve, as eight, and various other numbers. To a reader remembering the meticulous detail with which Aristotle told his students just how to construct topical notebooks and outlines, it seems quite unthinkable that he (...) could have poured this maze of problems over his audience like a bath-attendant, and left them to shift for themselves in discovering its intended organization. It is claimed that Skinner's primary personal development was from the role of precocious critic to mature theorist; that Skinner's discoveries of behavioral lawfulness enabled him to shed major portions of his earlier reflexological commitment; that his postulation of operants served several nonempirical functions; and that the postulation required that he depart from the restrictive philosophical framework in (...) which he had been working. BACKGROUND: Hallucinations and delusions that complicate Parkinson’s disease could lead to nursing home placement and are linked to increased mortality. Cognitive impairments are typically associated with the presence of hallucinations but there are no data regarding whether such a relationship exists with delusions. OBJECTIVE: We hypothesized that hallucinations would be associated with executive and visuospatial disturbance. An exploratory examination of cognitive correlates of delusions was also completed to address the question of whether they differ from hallucinations. METHODS: 144 PD subjects (...) completed a neuropsychological battery to assess cognition and the SAPS to examine psychosis. Correlational analyses assessed associations between hallucinations and delusions with cognitive domains. RESULTS: 48 subjects reported psychotic symptoms: 25 experienced hallucinations without delusions, 23 had symptoms dominated by delusions. Severity and/or number of hallucination subtypes were significantly correlated with lower scores in language, memory, attention, executive functioning, and visuospatial ability. Correlations with delusions were non-significant. Tests of differences in the size of the correlations between groups revealed a significant relationship between language and visuospatial performance with hallucinations. CONCLUSIONS: Cognitive correlates of hallucinations and delusions appear to be different in PD, suggesting distinct pathogenic mechanisms and possibly anatomical substrates. Hence, delusions may not share the same associations with dementia as hallucinations. Since this is a new finding, further studies will be needed to confirm our results. (shrink)
