Zusammenfassung: Der Beitrag systematisiert, kontextualisiert und evaluiert den eigentumstheoretischen Hintergrund der derzeit breit geführten Debatte um bezahlbaren Wohnraum in deutschen Großstädten. Ausgehend von der These, dass hinter der sogenannten ‚Wohnungskrise‘ eigentlich eine ‚Bodenkrise‘ steht, werden drei zentrale Konflikte um die politische Rahmung des Eigentums an Boden diskutiert: die Frage nach dem Gebrauch, der Verwertung und dem Eigentumsschutz. Dabei werden die normativen Potentiale eines immanenztheoretischen, apriorisch pflichtgebundenen Eigentumsverständnisses für eine zeitgemäße Wohnraum- und Bodenpolitik ausgelotet.

Saying so can make it so, J. L. Austin taught us long ago. Famously, John Searle has developed this Austinian insight in an account of the construction of institutional reality. Searle maintains that so-called Status Function Declarations, allegedly having a “double direction of fit”, synchronically create worldly institutional facts, corresponding to the propositional content of the declarations. I argue that Searle’s account of the making of institutional reality is in tension with the special theory of relativity—irrespective of whether the account (...) is interpreted as involving causal generation or non-causal grounding of worldly institutional facts—and should be replaced by a more modest theory which interprets the results of Status Function Declarations in terms of mere Cambridge change and institutional truth. I end the paper by indicating the import of this more modest theory for theorizing about the causal potency of institutional phenomena generated by declarations. (shrink)

According to the algebraic approach to spacetime, a thoroughgoing dynamicism, physical fields exist without an underlying manifold. This view is usually implemented by postulating an algebraic structure (e.g., commutative ring) of scalar-valued functions, which can be interpreted as representing a scalar field, and deriving other structures from it. In this work, we point out that this leads to the unjustified primacy of an undetermined scalar field. Instead, we propose to consider algebraic structures in which all (and only) physical fields are (...) primitive. We explain how the theory of natural operations in differential geometry—the modern formalism behind classifying diffeomorphism-invariant constructions—can be used to obtain concrete implementations of this idea for any given collection of fields. For concrete examples, we illustrate how our approach applies to a number of particular physical fields, including electrodynamics coupled to a Weyl spinor. (shrink)

This paper presents arguments from empirical research and from philosophical considerations to the effect that phenomenality and content are two distinct and independent features of mental representations, which are both relational. Thus, it is argued, classical arguments that infer phenomenality from content have to be rejected. Likewise, theories that try to explain the phenomenal character of experiences by appeal to specific types of content cannot succeed. Instead, a dynamic view of consciousness has to be adopted that seeks to explain consciousness (...) by certain ways of processing representations. Therefore, only empirical methods that are able to investigate the dynamics of the mind can be used for the “quest for consciousness” proper. Moreover, the central intuitions about consciousness are best explained when phenomenality and content are clearly distinguished. (shrink)

How do people judge the degree of causal responsibility that an agent has for the outcomes of her actions? We show that a relatively unexplored factor -- the robustness of the causal chain linking the agent’s action and the outcome -- influences judgments of causal responsibility of the agent. In three experiments, we vary robustness by manipulating the number of background circumstances under which the action causes the effect, and find that causal responsibility judgments increase with robustness. In the first (...) experiment, the robustness manipulation also raises the probability of the effect given the action. Experiments 2 and 3 control for probability-raising, and show that robustness still affects judgments of causal responsibility. In particular, Experiment 3 introduces an Ellsberg type of scenario to manipulate robustness, while keeping the conditional probability and the skill deployed in the action fixed. Experiment 4, replicates the results of Experiment 3, while contrasting between judgments of causal strength and of causal responsibility. The results show that in all cases, the perceived degree of responsibility increases with the robustness of the action-outcome causal chain. (shrink)

A central method within analytic philosophy has been to construct thought experiments in order to subject philosophical theories to intuitive evaluation. According to a widely held view, philosophical intuitions provide an evidential basis for arguments against such theories, thus rendering the discussion rational. This method has been the predominant way to approach theories formulated as conditional or biconditional statements. In this paper, we examine selected theories of musical expressivity presented in such logical forms, analyzing the possibilities for constructing thought experiments (...) against them. We will argue that philosophical intuitions are not available for the evaluation of the types of counterarguments that would need to be constructed. Instead, the evaluation of these theories, to the extent that it can succeed at all, will centrally rely on inferential, non-immediate access to our subjective musical experiences. Furthermore, attempted thought experiments lose their methodological function because no proper distinction can be drawn between the persons figuring in the thought-experimental scenario and the evaluator of the scenario. Consequently, some of the central contributions to what is generally understood to be analytic philosophy of art are shown to represent a form of aesthetic criticism, offering much less basis for rational argumentation than is often thought. Setting off from a familiar distinction in the philosophy of properties, this paper introduces a tripartite distinction between sparse causation, abundant causation and mere abundant causation. It is argued that the contrast between sparse and mere abundant causation allows us to resolve notorious philosophical issues having to do with negative causation, causation involving institutional properties and physical macro-causation in a way that is unified, intuitive and in line with scientific doctrines and practices.

I argue that Mumford and Anjum’s recent theory of simultaneous causation among powerful meso-level objects is problematic in several respects: it is based on a false dichotomy, it is incompatible with standard meso-level physics, it is explanatory deficient, and it threatens to render the powers metaphysics incoherent. Powers theorists are advised, therefore, to adopt a purely sequential conception of causation.

Three arguments for the conclusion that objects cannot endure in B-time even if they remain intrinsically unchanged are examined: Carter and Hestevolds enduring-objects-as-universals argument (American Philosophical Quarterly 31(4):269-283, 1994) and Barker and Dowe's paradox 1 and paradox 2 (Analysis 63(2):106-114, 2003, Analysis 65(1):69-74, 2005). Este problema es comúnmente analizado desde la perspectiva de la suerte. La meta de los defensores de la punición igualada es erradicar a la suerte de los juicios de responsabilidad penal. Para hacerlo, antes deben diferenciar entre la suerte que afecta los resultados de las acciones y otras clases de suerte involucradas. Rivera López (...) trató de justificar tal límite en el campo de la moral, y si sus ideas pudieran trasladarse al reino del derecho penal podrían ser de gran ayuda para los partidarios de la punición igualada. In this paper, we provide a detailed review of previous classifications of 2 × 2 games and suggest a mathematically simple way to classify the symmetric 2 × 2 games based on a decomposition of the payoff matrix into a cooperative and a zero-sum part. We argue that differences in the interaction between the parts is what makes games interesting in different ways. Our claim is supported by evolutionary computer experiments and findings in previous literature. ZUSAMMENFASSUNGDer Aufsatz geht davon aus, dass Charles Taylors viel beachtetes Werk Ein säkulares Zeitalter neben verschiedenen anderen Erkenntnisinteressen auch auf eine ›religionsphilosophische Rehabilitierung der christlichen Religion‹ zielt. Es wird darum das Verfahren, mit dem Taylor dabei zu Werke geht, auf seine argumentativen Gehalte hin rekonstruiert und auf einige neuralgische Punkte aufmerksam gemacht. Die wesentliche These ist dabei, dass – unbeschadet aller Errungenschaften des Buchs – Fragen der Geltung in Taylors Religionsphilosophie letztlich zu kurz kommen.SUMMARYThe article assumes that Charles Taylor's highly (...) acclaimed A Secular Age attempts, in addition to several other interests, to offer a ›religio-philosophical rehabilitation of the Christian religion‹. Therefore, Taylor's chain of reasoning is reconstructed in regards to its argumentative content and attention is drawn to some critical points of his approach. In sum, the article's main thesis is that – notwithstanding all the achievements of Taylor's A Secular Age – questions of the validity in Taylor's philosophy of religion ultimately come up too short. I outline a deflationary truthmakers account of social groups. Potentially, the approach allows us to say, with traditional ontological individualists, that there are only pluralities of individuals out there, ontologically speaking, but that there are nevertheless colloquial and social-scientific truths about social groups. If tenable, this kind of theory has the virtue of being both ontologically parsimonious and compatible with ordinary and social-scientific discourse—a virtue which the stock reductive / ontological dependence accounts of social groups arguably lack.

This study explores the evolutionary-based hypothesis that facial attractiveness (a guiding force in mate selection) is a cue for physical fitness (presumably an important contributor to mate value in ancestral times). Since fluctuating asymmetry, a measure of developmental stability, is known to be a valid cue for fitness in several biological domains, we scrutinized facial asymmetry as a potential mediator between attractiveness and fitness. In our sample of young women, facial beauty indeed indicated physical fitness. The relationships that pertained to (...) asymmetry were in the expected direction. However, a closer analysis revealed that facial asymmetry did not mediate the relationship between fitness and attractiveness. Unexpected problems regarding the measurement of facial asymmetry are discussed. (shrink)

Both classical psychophysical work and recentfunctional imaging studies have suggested acritical role for the primary visual cortex(V1) in resolving the perceptual ambiguitiesexperienced during binocular rivalry. Here weexamine, by means of single-cell recordings andoptical imaging of intrinsic signals, thespatial characteristics of suppression elicitedby rival stimuli in cat V1. We find that the interocular suppression field of V1 neuronsis centred on the same position in space and isslightly larger (by a factor of 1.3) than theminimum response field, measured through thesame eye. Suppression (...) is always strongest at asingle position corresponding very closely tothe centre of the classical receptive field,and reduces responses through the other eye byup to 90% but typically around 40%. Thespatial pattern of interocular suppression, asrevealed by optical imaging, closely matchesthe cortical representation of the stimulus,which is being suppressed, both in terms of itsorientation and the eye of origin. Theseresults indicate that interocular suppressionis directly related to the functionalarchitecture of V1; it is probably caused bydirect inhibitory interactions betweenneighbouring cortical columns of oppositeocular dominance. Der folgende Beitrag setzt sich mit den Begriffen „Normalität“ und „psychische Erkrankung“ auseinander. Es zeigt sich, dass beide zu einem erheblichen Maße unterbestimmt sind und beiden nicht nur ein deskriptiver, sondern ein nicht unerheblicher normativer Gehalt innewohnt, der sich der Reflexion nicht selten entzieht. Problematisch ist die mitunter synonyme Verwendung von „Normalität“ und „psychische Gesundheit“ bzw. „Anormalität“ und „psychische Krankheit“, da damit nicht nur inhaltlich unterschiedlich gelagerte Begrifflichkeiten, sondern auch diskrepante Begriffslogiken vermischt werden. Während in Bezug auf ausgeprägte psychische Störungen (...) diese Tatsache weniger von Belang zu sein scheint, da hier die Zuschreibung einer psychischen Erkrankung allgemein zustimmungsfähig ist, wird die Begriffsvermischung im Graubereich zwischen psychischer Krankheit und Gesundheit deutlich relevanter. Hier scheint man sich unausgesprochen an Kriterien der Normalität zu orientieren, womit ein ausgeprägt normatives Moment zum Tragen kommt. Dieser normative Sog hin zur statistischen Mitte kann auch als eine Form von Optimierung verstanden werden, die psychisches Leiden möglichst reduzieren möchte. Auch wenn dies auf den ersten Blick wünschenswert sein könnte, übersieht man dabei doch die nicht immer nur negativ zu interpretierende Bedeutung, die psychisches Leid für menschliches Leben haben kann. This article presents a structured and systematic approach for identifying and modelling compliance risks. The sophistication with which modern business is carried out and the unprecedented access to a global market means that businesses are exposed to increasing and diverse regulatory requirements in and across jurisdictions. Compliance with such requirements is practically challenging, partly due to the complexity of regulatory environments. One possibility in this regard is a risk-based approach to compliance, where resources are allocated to those compliance issues that (...) are most risky. Despite the need for risk-based compliance, few specific methods and techniques for identifying and modelling compliance risks have been developed. Due to the lack of methodological and tool support, compliance risk identification often involves unstructured brainstorming, with uncertain outcomes. The proposed approach consists of a five-step process for the structured identification and assessment of compliance risks. This process aims at facilitating the identification of compliance risks and their documentation in a consistent and reusable fashion. As part of the process, the article provides a systematic approach for a graphical modelling of compliance risks, which aims at facilitating communication among experts from different backgrounds. The creation of graphical models can be partly automated based on natural language patterns for regulatory requirements. Furthermore, the structuring of the compliance requirement in a template aims at simplifying the modelling of compliance risks and facilitating a potential future automated model. (shrink)

Background Palliative care is an integral part of health care, which in term has become increasingly technologized in recent decades. Lately, innovative smart sensors combined with artificial intelligence promise better diagnosis and treatment. But to date, it is unclear: how are palliative care concepts and their underlying assumptions about humans challenged by smart sensor technologies (SST) and how can care benefit from SST? -/- Aims The paper aims to identify changes and challenges in palliative care due to the use of (...) SST. In addition, normative guiding criteria for the use of SST are developed. -/- Methods The principle of Total Care used by the European Association for Palliative Care (EAPC) forms the basis for the ethical analysis. Drawing on this, its underlying conceptions of the human and its socio-ethical aspects are examined with a phenomenological focus. In the second step, the advantages, limitations, and socio-ethical challenges of using SST with respect to the Total Care principle are explored. Finally, ethical-normative requirements for the application of SST are derived. -/- Results and Conclusion First, SST are limited in their measurement capabilities. Second, SST have an impact on human agency and autonomy. This concerns both the patient and the caregiver. Third, some aspects of the Total Care principle are likely to be marginalized due to the use of SST. The paper formulates normative requirements for using SST to serve human flourishing. It unfolds three criteria according to which SST must be aligned: (1) evidence and purposefulness, (2) autonomy, and (3) Total Care. (shrink)

When making a decision, humans consider two types of information: information they have acquired through their prior experience of the world, and further information they gather to support the decision in question. Here, we present evidence that data from search engines such as Google can help us model both sources of information. We show that statistics from search engines on the frequency of content on the Internet can help us estimate the statistical structure of prior experience; and, specifically, we outline (...) how such statistics can inform psychological theories concerning the valuation of human lives, or choices involving delayed outcomes. Turning to information gathering, we show that search query data might help measure human information gathering, and it may predict subsequent decisions. Such data enable us to compare information gathered across nations, where analyses suggest, for example, a greater focus on the future in countries with a higher per capita GDP. We conclude that search engine data constitute a valuable new resource for cognitive scientists, offering a fascinating new tool for understanding the human decision-making process. (shrink)

The serotonin transporter plays an important role in regulating serotonergic transmission via removal of serotonin from synaptic clefts. Alterations in 5-HTT expression and subsequent 5-HT transmission have been found to be associated with changes in behaviour, such as fearfulness or activity, in humans and other vertebrates. In humans, alterations in 5-HTT expression have been suggested to be able to lead to better learning performance, with more fearful persons being better at learning. Similar effects of the variation in the 5-HTT on (...) fearfulness have been found in chickens, and in this study, we investigated effects on learning. Therefore, we tested 52 adult laying hens, differing in their functional 5-HTT genotype in an operant learning paradigm in three different phases and in a tonic immobility test for fearfulness. We found that the 5-HTT polymorphism affects the initial learning performance of laying hens, with homogeneous wild-type hens being the slowest learners, and the most fearful birds. W/W hens, showed significantly more choices to solve the initial learning task and had the highest latencies in a tonic immobility test, indicating the highest fearfulness. Our results provide interesting first insights into the role of 5-HTT in chickens and its sensitive interaction with the environment. We further suggest that the 5-HTT gene can be an interesting target gene for future breeding strategies as well as for further experimental studies. (shrink)
