Responding to Michael Luntley's article, ‘Learning, Empowerment and Judgement’, the author shows he cannot successfully make the following three moves: (1) dissolve the analytic distinction between learning by training and learning by reasoning, while advocating the latter; (2) diminish the role of training in Wittgenstein's philosophy, nor attribute to him a rationalist model of learning; and (3) turn to empirical research as a way of solving the philosophical problems he addresses through Wittgenstein. Drawing on José Medina's analysis of the (...) fundamental role of training in Wittgenstein's later philosophy, the paper offers a tour of key passages in the Investigations and other works to develop an understanding of what Wittgenstein meant by ‘mastery of techniques’. In opposition to Luntley's liberal‐individual, or his subject as rational agent, the author explores Wittgenstein's non‐foundationalist, forms of life approach to how we act with agreement. More effort must be given to differentiating Wittgenstein's view from that of the analytic school, which Luntley appears to echo despite his criticism of the analytic divide. (shrink)

LampPerhaps none of the words Augustus, the first sole ruler of Rome who reigned from 27 BCE to 14 CE, actually said are quite as memorable as the ones Cassius Dio has attributed to him: "I found Rome built of clay and I leave it to you in marble" (1987, 56.30).1 Suetonius too discusses Augustus's building program, (...) offering an alleged quote along with an explanation of his motivation: "Since the city was not adorned as the dignity of the empire demanded, and was exposed to flood and fire, he so beautified it that he could justly boast that he had found it built of brick and left it in marble" (1998, Aug.28.3). Though Suetonius's explanation is practical, Dio argues Augustus's "city of brick" had a more metaphoric or symbolic meaning: "In saying this he was not referring literally to the state of the buildings, but rather to the strength of the empire" (1987, 56.30).Both historians, then, perceive a connection between the physical appearance of the city and Rome's place at the head of the (Roman) world. Maecenas, Augustus's right-hand man who was essentially the minister of culture, explicitly draws attention to this strategy in a speech fabricated by Dio. Maecenas advises Augustus, "Make this capital beautiful, spare no expense in doing so, and enhance its magnificence with festivals of every kind. It is right for us who rule over so many peoples to excel all others in every field of endeavor, and even display of this kind tends to implant [End Page 171] respect for us in our allies and to strike terror into our enemies" (1987, 52.30). Here Dio suggests, albeit in hindsight, that Augustus's building program was a conscious "display" of Rome's supremacy meant to elicit a reaction, particularly from those who dwelled outside the city.Though from this passage of Dio's it is possible to argue that the physical appearance of the city of Rome was meant to persuade, or at least elicit some response, the passage does not provide support for the claim that architecture, monuments, and city planning functioned rhetorically in ancient Rome. After all, Quintilian reminds us that "many other things have the power of persuasion" (1970, 2.15.6-9). Nonetheless, this passage does generate questions about the relationship between the Augustan building program, or more broadly the Augustan cultural campaigns, and rhetoric in the principate—specifically about the way in which the cultural campaigns functioned rhetorically to help Augustus gain and maintain power.Recently, I have argued that the Ara pacis Augustae, an Augustan monument commissioned in 13 BCE, functioned as a visual example of a rhetorical text, meant not only to celebrate Augustus's successful campaigns is Spain and Gaul but also to garner public support for Augustus's heir and the process of dynastic succession. Because specific rhetorical techniques often associated with the epideictic genre clearly function on the altar, the Ara pacis demonstrates that Augustus and/or his ministers were thinking rhetorically when constructing at least some Augustan monuments (Lamp 2009). Similarly, architectural historian Diana Favro has argued that certain aspects of Augustan architecture made use of rhetorical techniques related to the canon of memory (1996). These findings are perhaps not surprising given that George Kennedy, writing nearly forty years ago, acknowledged that Augustus, a figure he called "the greatest rhetorician of antiquity, " "developed new techniques of verbal and visual persuasion which took over some of the functions and adapted some of the methods of traditional oratory" (1972, 378, 382).Still, very little attention has been paid to Augustus as a rhetorical figure, which is not to say that scholars of rhetoric have paid no attention to Roman rhetoric. While the classicist Theodore Mommsen, writing in the latter half of the nineteenth century, went as far as to refer to the principate as the "end to the entire discipline of rhetoric" (1992, 125), the decline narrative in regards to Roman rhetoric is shifting. The law within each legal system is a function of the practices of some social group. In short, law is a kind of socially grounded norm. H.L.A Hart famously developed this view in his book, The Concept of Law, by arguing that law derives from a social rule, the so-called “rule of recognition.” But the proposition that social facts play a foundational role in producing law is a point of consensus for all modern jurisprudents in the Anglo-American tradition: not (...) just Hart and his followers in the positivist school, most prominently Joseph Raz and Jules Coleman, but also the anti-positivist Ronald Dworkin, who argues that law necessarily synthesizes moral considerations with social facts. But which group’s practices ground each legal system? In particular, which group’s practices undergird U.S. law? Positivists since Hart have universally pointed to either officials or judges as the “recognitional community” (my term): the group such that its rules, conventions, cooperative activities, or practices in some other sense are the social facts from which the law of a given legal system derives. So Hart and all other positivists would identify either U.S. officials or U.S. judges as the recognitional community for U.S. law. This Article grapples with the tension between the positivist’s official- or judge-centered account of the recognitional community and the “popular constitutionalism” now so widely defended by constitutional scholars such as Larry Kramer, Robert Post, Reva Siegel, Mark Tushnet, Jeremy Waldron, and many others. Surely the popular constitutionalist would want to claim that U.S. citizens, not judges or officials, are the recognitional community for U.S. law. I term this position “deep popular constitutionalism.” Indeed, it turns out that Dworkin’s account of law, in its ambition to generate associative moral obligations for the citizenry as a whole, implies deep popular constitutionalism. Here there is a disagreement, hitherto unnoticed, between Dworkin and the positivists. My solution to this disagreement – to the debate between deep popular constitutionalists and deep official or judicial supremacists -- is to dissolve it by providing a group-relative account of law. Social norms, such as norms of dress or eating, are clearly group-relative. A particular dressing or eating behavior may be socially appropriate relative to one group’s norms, yet socially inappropriate relative to another’s. This Article extends the group-relative view from social norms to law itself, with a particular focus on U.S. law and constitutionalism. Part I surveys the jurisprudential literature. It shows how Hart and successor positivists identify the rule of recognition as a social practice engaged in by officials or some subset of officials (judges), rather than citizens generally, and argues that Dworkin by contrast sees the citizenry as a whole as his recognitional community. Parts II and III defend a group-relative account of law. Part II argues, with reference to the U.S. experience, that multiple groups can simultaneously instantiate the kind of social fact that undergirds law, be it a convention, a social norm, a “shared cooperative activity” (SCA), or something else. At many points in U.S. constitutional history, multiple official or citizen groups, defined along departmental, partisan, regional, state-federal, religious, or other lines, have accepted competing rules of recognition for U.S. law. Part III argues that “law” functions, primarily, as either an explanatory or a normative construct, and that insisting on a single recognitional community for each legal system would be arbitrary, both for explanatory purposes and for normative purposes. The subject of my dissertation is "rationality". In this book I undertake a comprehensive, systematic and independent treatment of the problem of rationality. This furthers progress toward a general theory of rationality, one that represents and defends a uniform conception of reason. The structure and general outline are as follows: Part I: General Definition of the Concept; Part II: Rationality in the Theoretical Realm; Part III: Rationality in the Practical Realm (parts II and III are divided respectively into A. Relative (...) Reasons and B. Absolute Reasons); Part IV: Grounds for the Principle of Reason. My aim in this work is to prove that a conception of rationality as justification of our usage of language is more significant than has been classically recognized, without, however, reducing the concept of rationality. After a definition of the term is provided in the first chapter by means of language analysis, the following three questions are dealt with in the subsequent chapters: a) Exhaustion of rationality in relative reasons—i.e., is reasoning exhausted by reference to existing views and goals, or does rationality also exist in a strong sense? The latter would be the case if the views and goals referred to the relative conception must themselves be justified de novo. I argue that such an absolute justification of views and goals cannot be provided. To this end, in the theoretical domain, I discuss a question prominent in the debate over the rationality of worldviews, namely the question of whether the standards of theoretical rationality are merely culturally relative (chapter V.). Here I arrive at the position that standards of theoretical rationality are only transcultural insofar as there are goals which are not themselves culturally-dependent. With regard to practically fundamental goals, the core standards of modern science can be justified. This justification strategy therefore requires that such goals be established. In practical terms, first I address (in Chapter VII) the so-called "final justification" of norms problem. Here I discuss above all the transcendental-pragmatic proposal and the contractualist conception. According to my view, neither succeed in providing a final rational grounding for norms. That grounding pertains instead to the rationale for objectives, and Chapter VIII demonstrates that even a final justification of objectives is impossible. This does not mean, however, that a person's goals cannot be criticized as irrational. But the warrant in this case depends on the rules that govern the genesis of desires being accepted by the subject. b) If substantive rationality does not exist because no absolute grounding for opinions and goals can obtain, then the question of how strong or weak the concept of rationality is acquires further weight. On that basis, relative theoretical and practical rationality is examined in detail. I aim with this analysis of (relative) rationality to apprehend the structural parallelism between rationality in both the practical and the theoretical domain, and therefore to defend a uniform conception of reason or rationality. This is accomplished by identifying a concept that exhibits the same structure in both theoretical and practical domains: the term "rational" is applied to actions and opinions in order to claim, first of all, that they are "well-founded." For example, one must inquire into the precise rational justification for opinions or actions. To determine the individually necessary and jointly sufficient conditions required for an opinion or action to be rational, one must first provide a formal characterization of the rationality of those opinions or actions. What is to count as a rational ground can only be explained by formal procedures and results achievable via those procedures. To be more specific, I claim that the process of opinion formation and practical reflection is subject to rational justification based on internalist rules. The rules governing theoretical rationality can have their content transformed in a further move, if one takes the result of the process of rational opinion-formation as the product of an epistemological determination, that is, as a decision about which opinion to hold that is made on the basis of epistemological or prudential goals. Implicit in this position is the controversial idea that one can actually decide to believe something. The rules of practical reason are the rules that guide the rational selection of objectives and actions. The structural parallelism of theoretical and practical rationality consists, therefore, in the fact that both refer to mental processes that are controlled by rules which one freely accepts and follows. In both cases, these rules are to be understood as governing the rational choice of a mental or physical action. c) Therefore, the question of whether rationality—being rational—can in turn be grounded by reasons can be answered in the following way: The rules of rationality can only be justified with reference to a person’s goals, as the best strategy for achieving those goals. If someone does not desire the optimal realization of his goals, there is no other way of arguing directly for rationality. One can only attempt to demonstrate—if the person is open to argument—that it is typically in the person's own best interest to adhere to the rules of rationality. (shrink)

The Hoffman Report scandal demonstrates that ethics is not objective and ahistorical, contradicting the comforting progressive story about ethics many students receive. This modern-day ethical failure illustrates some of the weaknesses of the current ethics code: it is rule-based, emphasizes punishments for noncompliance, and assumes a rational actor who can make tricky ethical decisions using a cost–benefit analysis. This rational emphasis translates into pedagogy: the cure for unethical behavior is more education. Yet such an approach seems unlikely to foster ethical (...) behavior in the real world, either for students or for mature scientists. This article argues for an alternative ethical system and a different way of teaching ethical behavior. Virtue ethics emphasizes the development of ethical habits and traits through regular practice and reflection. We show how virtue ethics complements a feminist approach to science, in which scientists are encouraged to reflect on their own biases, rather than attempting to achieve an impossible objectivity. Our article concludes with pedagogical suggestions for teaching ethical behavior as a practical and intelligent skill. (shrink)

It shows how contemporary logic may be useful in the analysis of legislation, legislative drafting and legal reasoning concerning different contexts of lawmaking. Elaborations of the process of lawmaking have variously emphasised its political, social or economic aspects. Yet despite strong interest in logical analyses of law, questions remains about the role of logical tools in lawmaking. (...) Dialogue is a seminal concept within the work of the Brazilian adult education theorist, Paulo Freire, and the Russian literary critic and philosopher, Mikhail Bakhtin. While there are commonalities in their understanding of dialogue, they differ in their treatment of dialectic. This paper addresses commonalities and dissonances within a Bakhtin-Freire dialogue on the notions of dialogue and dialectic. We are the funny organisms that make and follow rules. To understand us, one must understand what is it to institute and follow a rule, to perform correctly or in error. This question is more important than it might at first seem for linguistic meaning is constituted by rules that govern uses of expressions. For example, the fact that 'squid' is correctly applied to squid and incorrectly applied to cuttlefish is part of what makes 'squid' mean what it does. Philosophers (...) sometimes argue further that all representations are rule-governed so that a theory of representation must explain the possibility of misrepresentation. ;The rule-following problem makes an explanation of correctness surprisingly difficult. Philosophers have also not been clear on just what is the problem with rules. I provide a statement of the features of rules and the problems they drive. I then show that some well-known accounts of rule following---Kripke's, Wright's, Blackburn's---are inadequate. My formulation also shows that some favored theories of content---causal, evolutionary, interpretivist---are inadequate. ;Positively, I argue that an essentially social and irreducibly normative organization---a practice---solves the rule-following problem. Therefore, only participants in social practices can follow rules and thence traffic in linguistic meaning. Still, an account of the correctness of a linguistic performance is not yet an explanation of its representational content. I argue that linguistic content is constituted by correctness facts but also by the representational purport of expressions. I explain an expression's purport to represent naturalistically in terms of syndromes of psychological and behavioral symptoms. A theory of linguistic representation, then, must join the non-natural social facts that constitute correctness with the natural individualistic facts that constitute representational purport. ;Such a hybrid theory reveals that thought and language are not as intimately connected as philosophers assume. Whereas linguistic content constitutively partakes of the social organization that sets humans apart from other creatures, thought content involves only refinements of the psycho-behavioral syndromes that we share with most vertebrates. The seventeenth century saw dramatic advances in mathematical theory and practice. With the recovery of many of the classical Greek mathematical texts, new techniques were introduced, and within 100 years, the rules of analytic geometry, geometry of indivisibles, arithmatic of infinites, and calculus were developed. Although many technical studies have been devoted to these innovations, Mancosu provides the first comprehensive account of the relationship between mathematical advances of the seventeenth century and the philosophy of mathematics of the period. Starting (...) with the Renaissance debates on the certainty of mathematics, Mancosu leads the reader through the foundational issues raised by the emergence of these new mathematical techniques, including the influence of the Aristotelian conception of science in Cavalieri and Guldin, the foundational relevance of Descartes' Geometrie, the relation between geometrical and epistemological theories of the infinite, and the Leibnizian calculus and the opposition to infinitesimalist procedures. In the process Mancosu draws a sophisticated picture of the subtle dependencies between technical development and philosophical reflection in seventeenth century mathematics. (shrink)

In this paper, I investigate the variety and richness of the taxonomical practices between the end of the nineteenth and the early twentieth centuries. During these decades, zoologists and paleontologists came up with different quantitative practices in order to classify their data in line with the new biological principles introduced by Charles Darwin. Specifically, I will investigate Florentino Ameghino’s mathematization of mammalian dentition and the quantitative practices and visualizations of several German-speaking paleontologists at the beginning of the (...) twentieth century. In so doing, this paper will call attention to the visual and quantitative language of early twentieth-century systematics. My analysis will therefore contribute to a prehistory of the statistical frame of mind in biology, a study which has yet to be written in full. Second, my work highlights the productive intertwinement between biological practices and philosophical frameworks at the turn of the nineteenth century. Deeply rooted in Kantian bio-philosophy, several biologists sought to find rules in order to apply ordering principles to chaotic taxonomic information. This implies the necessity to investigate the neglected role of Kantian and Romantic bio-philosophy in the unfolding of twentieth-century biology. (shrink)

If you don’t feel it you can’t be taught it. Either you can play Schumann or you can’t. Successful performances of Western classical music exhibit both technical mastery and aesthetic insight. While legacies of music teachers have distilled schools of technique and stylistic performance practices, the aesthetic components of interpretation have not received systematic treatment. This may be due to inherent difficulties with teaching aesthetics: musical meaning is hard to express in words, and even demonstrating for students does (...) not guarantee their understanding. 'Practices without foundations' is, in genesis and in effect, a discussion of the following quotation , which serves therefore as an epigraph to it: ;Nelson Goodman's discussion of the 'new riddle of induction' ... deserves comparison with Wittgenstein's work. Indeed ... the basic strategy of Goodman's treatment of the 'new riddle' is strikingly close to Wittgenstein's sceptical arguments .... Although our paradigm of Wittgenstein's problem was formulated for a mathematical problem it ... is completely general and can be (...) applied to any rule or word. In particular, if it were formulated for the language of color impressions, as Wittgenstein himself suggests, Goodman's 'grue', or something similar, would play the role of 'quus'. But the problem would not be Goodman's about induction--"Why not predict that grass, which has been grue in the past will be grue in the future?"--but Wittgenstein's about meaning: "Who is to say that in the past I didn't mean grue by 'green', so that now I should call the sky, not the grass, 'green'?" vskip9pt ;This fascinating remark of Kripke's suggests a project, that of charting out both the interpretive and philosophic points of connection and disconnection between Wittgenstein, Goodman and Kripke. That project is this dissertation. ;My work severely tests Kripke's remark. For I argue that Kripke not only misreads Wittgenstein, but also mistakes the extremity of the 'scepticism' of his version of Wittgenstein for the priority of the philosophical puzzle that Goodman has bequeathed to us. ;To reach this conclusion, I show that Kripke's Wittgenstein's 'meaning-scepticism' is unanswerable if statable, but actually unstatable; and that, under certain interpretations, the same is true of putative scepticisms derivable from Goodman's text. The upshot is that the sceptical reading of most twentieth century philosophy must be displaced in favour of 'post-scepticism' and 'philosophical ethnography'. The latter concepts, sketched toward the end of the dissertation, are perhaps its telos. (shrink)

This article examines the relationship between online dispute resolution (ODR) and trust. We discuss what trust is, why trust is important, and how trust develops. Our claim is that efforts to implement online dispute resolution on a site or service in a manner that promotes trust need to consider ODR as just one tool in a broader toolbox of trust-building tools and techniques. These techniques are amongst others marketing, education, trust seals, and transparency. By evaluating ODR in its (...) proper context as one component of a larger trust strategy, we can more accurately set expectations for its results and position our projects for success. (shrink)

Capable of being otherwise, human actions are in the field of variability and probability, not of constancy and necessity. Therefore it is not possible to find any fixed and complete set of moral rules and ethical principles, in accordance with which one can act morally. All those kinds of rules and principles are disputable – theoretically at least, and every new circumstance encountered in life requires a new deliberation and practical reasoning for deciding what is to be done, so that (...) the decisions taken are not unquestionable either. Nevertheless, this situation does not preclude attempts to set moral rules and ethical principles as guidelines leading actions, behaviours, and conducts; it is a matter of fact that the history of humanity is full of numerous examples of such attempts. Codes of ethics, which play a key role in professional ethics, can be regarded as reflections on the aforementioned general rules and principles in professional life. From this aspect, they also seem disputable and questionable, and they cannot offer a complete prescription fulfilling all the necessary requirements either, yet they fill a great gap in finding solutions to problems that occur in various forms of professional life. Another similarity between codes of ethics, and general moral rules and ethical principles, is that they are all based on an account of humanity and morals; especially, it is impossible to establish a normative ethical theory or to write a worthwhile code of ethics without any philosophical account of humanity and morals. This paper attempts to offer such an account through a philosophical interpretation of ‘non-finito’ sculpture technique and thus to provide a philosophical foundation for any codes of ethics. But the regress argument bears equally on both these notions: if there is an explanatory regress of rules, then there is an explanatory regress of practices as well. Why then does Wittgenstein invoke the notion of a practice, apparently by way (...) of diagnosing the error on which the regress argument rests? I suggest that he invokes that notion to emphasize certain aspects of rule-following which we are apt to neglect, when we forget that rule-following is---not, rests upon---participating in a practice. This paper provides a conceptual exploration of the implication of Jeffrey’s rule of belief revision to account for rule-following behavior in a game-theoretic framework. Jeffrey’s rule reflects the fact that in many cases learning something new does not imply that one has full assurance about the true content of the information. In other words, the same information may be both perceived and interpreted in several different ways. I develop an account of rule-following behavior according to which, in the (...) context of strategic interactions, following a rule is defined by two conditions. First, that agents must frame the interaction in a sufficiently similar way and be aware of the same salient properties, i.e. they must have the same partition of the event. Second, they must ascribe to others the same revised probabilities to what they take to be the common partition. In a game-theoretic framework, this also indicates that rule-following behavior cannot be identified merely to the existence of a common prior. (shrink)

BackgroundEthics is the science of moral and ethical rules recognised in human life and attempts to verify what is morally right and wrong. Healthcare ethics is seen as an integrated part of the daily activities of health facilities. Healthcare professionals’ standardisation and uniformity in healthcare ethics are urgent and basic requirements. Therefore, this study aimed to assess the practice of the code of ethics and associated factors among health professionals in Central Gondar Zone public hospitals, Northwest Ethiopia, 2021.MethodsA facility-based cross-sectional (...) study design with a mixed method was conducted on 631 health professionals from Central Gondar Zone public hospitals. For the quantitative part, pre-tested self-administered questionnaires were used, and for the qualitative part, key informant interviews with a semi-structured questionnaire were used. Variables with a p value of < 0.2 in binary logistic regression entered into a multivariable logistic regression, then p value < 0.05 and AOR were used to declare statistically significant variables in quantitative data. A thematic content analysis was used for qualitative data analysis.ResultsThis study revealed that only 286 health professionals had good practice of the code of ethics. Good ethical knowledge, favourable attitude, and satisfaction of health professionals with their jobs were significantly associated with the practice of health care ethics.ConclusionsHealth professionals' overall level of practice of health care ethics in the Central Gondar Zone public hospitals was poor. This necessitates practical training, ongoing follow-up, availing of necessary medical equipment, a smooth working environment, and modification of the recognition system for health professionals. MinerAs several contemporary writers have noted, Giambattista Vico defends the idea of practical knowledge, a type of knowledge that cannot be fully expressed by propositions and defies reductions to method. 1 The defense of practical knowledge, against Descartes and the rise of objectifying science, is most clearly articulated in a group of Vico’s early writings: the oration (...) De nostri temporis studiorum ratione (1709), the metaphysical book De antiquissima Italorum sapientia ex linguae latinae originibus eruenda (1710), and two rejoinders (Prima and Seconda risposte) to critics of the De antiquissima. In these texts Vico criticizes Cartesian method in terms that remind us of Aristotle, or at least the Aristotle of the Nicomachean Ethics and Politics. “If you were to import the geometrical method into practical life, you would do no more than exhaust yourself in becoming a rational lunatic” (A 7.5). 2This comment and many others like it seem to suggest that Vico is an “Aristotelian,” but any simple classification is problematic. In the same text in which Vico defends the Aristotelian topos he also announces that “the true and the made are convertible” (verum et factum convertuntur). The emphasis on the [End Page 53] role of “making” in truth seems incompatible with the Aristotelian idea of phronesis, whose knowledge is associated with praxis and cannot be reduced to techne. It would be simpler if Vico distinguished between a realm in which the verum-factum principle applied and one in which prudentia was supreme. However, Vico not only situates mathematics and experimental science within the metaphysical framework governed by verum-factum, but also implies strong connections between making and ethics. The prominence Vico assigns to making in all areas of human endeavor gives him a distinctly modern appearance in the fashion of Bacon, Galileo, and Hobbes.This gives rise to both hermeneutical and philosophical problems. Is Vico simply hesitating between the old and new? Contrary to the popular assumption that linguistically mediated social practices constitute the normativity of action (Kiverstein and Rietveld, 2015; Rietveld, 2008a,b; Rietveld and Kiverstein, 2014), I argue that it is affective care for oneself and others that primarily constitutes this kind of normativity. I argue for my claim in two steps. First, using the method of cases I demonstrate that care accounts for the normativity of action, whereas social practices do not. Second, I show that a social practice (...) account of the normativity of action has unwillingly authoritarian consequences in the sense that humans act only normatively if they follow social rules. I suggest that these authoritarian consequences are the result of an uncritical phenomenology of action and the fuzzy use of “normative”. Accounting for the normativity of action with care entails a realistic picture of the struggle between what one cares for and often repressive social rules. (shrink)

This article aims at examining the limits of change in the field of worship through a study on the origins of the ḥukm[religious ruling] of Shawwāl fasting that is widely practiced in the different parts of Muslim world. The study, firstly, deals with the evolution of the ḥukm of Shawwāl fasting chronologically among four sunnī schools of law, then analyzes the solitary reports on the topic. It concludes that in Mālikīand Ḥanefīschools, the ḥukm of this specific worship changed within the (...) limits of karāha [reprehensibility], ibāha [permissibility], and nadb [recommendation]. This ḥukm was constructed based on solitary reports which later became a paradigmatic source of religious legitimacy in the Ḥanbalīschool beginning with the eponymous Imām and in the Shāfiʿīlong after the founding authorities. It also claims that it is strongly probable that the solitary reports on the topic go back to a deduced opinion in the age of companions, but then reached to a form of prophetic solitary report in the corpus of hadīth reports. Ultimately, this specific worship that has restricted number of fasting was established with the paradigmatic effect of the approach to solitary reports as the only authentic way of transmitting the sunna, even though it is at odds with the fact that this worship had not been implemented in the first two centuries after hijra, i.e. contrary to the established practice [ʿamal]. Summary: The issue of change of rulings in Islamic law comes up frequently on various occasions, and an increasing number of academic studies are trying to determine the characteristics and limits of this change in numerous books, articles and papers. These studies mostly seem to focus on bringing together the arguments that can be compiled under the title of ‘the flexibility of Islamic law in response to the challenges of modernity’. Although the change of rulings in Islamic law is an undeniable fact, reading it only from the lens of the change in Islamic law depending on the requirements of time is an inadequate reading. The change of rulings in Islamic law has different motives; and the change of time, more precisely the change of custom, is only one of them.On the other hand, another issue that comes up in relation to the change of rulings is the claim that this change can only take place in terms of the rulings regulating the interpersonal relations, i.e. muʿāmalāt. In fact, this claim relies on the abovementioned approach that limits the change in Islamic law with the change of custom. Hence, because other two main areas of Islamic law, worships (ʿibādāt) and punishments (ʿuqūbāt) are not open to change through custom, their rulings will not change at all. This article will try to reveal that the change in rulings might reside in a sort of another change emerged in relation to the sources of these rulings, which is a neglected point. Thus, by exposing that the field of worships which is mostly considered as a closed area for change in rulings is actually open to it, this article will examine the limits of this change.For this analysis, the article deals with the fasting of six days in the month of Shawwāl as an example, which is widely practiced in various parts of the Islamic world. The main evidence on which this fasting is based on is a report transmitted in the considerably authentic hadith sources of Ahl al-Sunnah, which reads as follows “Whoever fasts the Ramaḍān and adds six days from Shawwāl, will get reward of the entire year”. This fasting, which is the subject of a great agreement on its ruling as recommended (mustaḥāb) practice today, was actually regarded as reprehensible (makrūh) by the two great eponymous jurists of the first two schools of law in the second Hijrī century, namely Mālik b. Anas and Abū Ḥanīfa. In his al-Muwaṭṭaʾ,Mālik clearly expresses that he did not recognize any scholar who keeps this fast, and that no [authentic] report has reached him on this. The fact that both Mālik b. Anas and Abū Ḥanīfa declared an opinion on the subject shows that this practice started to appear in the first half of the second ḥijrī century as a practice or as a solitary report (khabar al-wāḥid). However, both imāms have stated that such a specific worship would be makrūh. In spite of these very sharp expressions, the schools of law, which were founded by the followers of these two eponymous scholars, abandoned their views and widely accepted Shawwāl fasting as mustaḥāb. This article examines why this sharp change occurred in a worship in the schools of law and in which way it took place.Accordingly, the fundamental motive in this change is a paradigmatic transformation in understanding and identifying the sunna as a source of normativity. Although an agreement was formed on the validity of solitary reports as a source of knowledge in the second ḥijrī century, it was not yet accepted that these narrations are identical to sunna as a source of normativity. For that reason, both Abū Ḥanīfa and Mālik did not hesitate to reject any solitary report that contradicted a stronger evidence. However, as a result of the extraordinary efforts of Ahl al-Ḥadīth, the epistemic value of solitary reports has reached to an authority equating them to the sunna with a very rapid acceleration as of the end of the second century and throughout the third century. This situation led later scholars of schools to abandon the views of the eponymous scholars of these schools on certain topics in favor of certain solitary reports. This was also the process for the change in Shawwāl fasting.This thesis will be put under two headings, a section that tries to determine the periods and processes for the Sunnī schools of law in considering this fasting as mustaḥāb; and another section that provides an evaluation of transmitted reports in relation to the Shawwāl fasting. Accordingly, in the Mālikī and Ḥanafī schools, due to the effect of the reports, the ruling of Shawwāl fasting has been transformed from makrūh into the mustaḥāb as a result of the interpretational activities that started in the fourth ḥijrī century. Shawwāl fasting was accepted as mustaḥāb in the Shāfiʿī school, although there was no transmitted opinion on the subject from the founding imāms, in the fifth ḥijrī century; and in the Ḥanbalī school directly by the founding imām Aḥmad b. Ḥanbal, whose main aim was to follow a concept of religion that puts the transmitted reports at the center. When the reports on the subject are examined, it demonstrates that the mustaḥāb ruling is mainly rooted in a report by Saʿd b. Saʿīd transmitted in the famous hadīth compilations including Muslim’s Ṣaḥīḥ.Yet, this report was criticized in its both chain and text. Combining the facts that the same report with the same chain was also transmitted as the words of the companion in some sources and the verse that declares good deed will be rewarded ten times higher than what it deserves will make the following explanation a valid one: As Mālik put it such a fasting practice was commonly unknown to the Muslim society in the first two centuries after the ḥijra. Sometime after the death of the Prophet, an inference was made probably by a companion(s) as that it would be a good deed if someone who fasted an entire month already and got used to the fasting to fast six more days in order to get a reward of fasting for the entire year according to the verse that rewards good deeds with ten times higher. Since it is a recommended practice in essence, i.e. fasting for the sake of Allah, this inference transformed into a report and easily passed through the filters of hadīth scholars who are linked to a sort of piety promoting worships among people. After the solitary reports gained an authority to the extent that they can rarely be challenged, the followers of later schools of law preferred to get in a process of re-interpreting the opinions of their imāms in order either to reconcile them with the content of report, or at least to show why these imāms actually spoke against this fasting. Eventually, the later scholars of madhhab decided for the standard opinion of the madhhab depending on the reports in favor of the Shawwāl fasting rather than following their eponymous imāms. Nick Dyer-Witheford and Greig de Peuter. Games of Empire: Global Capitalism and Video Games . Minneapolis: University of Minnesota Press. 2009. 320pp. pbk. $19.95 ISBN-13: 978-0816666119. In Games of Empire , Nick Dyer-Witheford and Greig de Peuter expand an earlier study of “the video game industry as an aspect of an emerging postindustrial, post-Fordist capitalism” (xxix) to argue that videogames are “exemplary media of Empire” (xxix). Their notion of “Empire” is based on Michael Hardt and Antonio Negri’s Empire (2000), which (...) characterizes the contemporary world order as a decentralized system of global economic, political, and economic power that transcends national boundaries. In the view of the authors, Hardt and Negri’s account sets itself apart from other analyses of international politics by offering a “comprehensive account of conditions of work, forms of subjectivity, and types of struggle in contemporary capital” (xx). Dyer-Witheford and de Peuter thus divide Games of Empire into three sections to reflect each of these aspects of Empire ’s argument, seeing their work as the first account to explore “virtual games within a system of global ownership, privatized property, coercive class relations, military operations, and radical struggle” (xxix). Books in the University of Minnesota Press’s Electronic Mediations series “explore the humanistic and social implications” of new technologies that spark “significant changes in society and culture, politics and economics, thinking and being.” That’s an abstract goal, and one that Games of Empire surely meets. Yet at times it can be difficult to understand exactly which specific intervention this book seeks to make. It is unclear whether the authors of Games of Empire see their work as an indictment of game scholars’ lack of attention to political economy, or whether it’s a work of political theory hoping to show that other disciplines should be paying more attention to the production and play of videogames. Because Dyer-Witheford and de Peuter don’t directly criticize previous political critiques of gaming—such as Edward Castronova’s exploration of the “porous membrane” allowing two-way traffic between virtual economies and those of the real world, or Alexander Galloway’s unraveling of control protocols in algorithmic design, or Ian Bogost’s idea of political procedural rhetoric—they sometimes leave the reader wondering how to situate the book in the broader discourse on games and politics, either separately or together. Thus, Games of Empire might best be seen as an introduction to the writings of Hardt and Negri for game players and designers, rather than as a text for communicating the basic concepts of game studies and design. It is neither a truly new theory of games or digital media, nor is it a new theory of Empire—and that’s not a criticism. It is instead an introduction to Empire through popular culture, as Zizek does for Lacan in Looking Awry . If one were teaching an introductory course on contemporary political theory, this book would offer obvious inroads into Negri and Hardt’s thinking for a number of reasons. Despite its radical ideological bent, the book isn’t off-putting to readers who don’t necessarily share the authors’ politics. It synthesizes complex ideas from difficult thinkers like Marx, Foucault, and Guattari while integrating modifications and critiques of Empire theory itself. And although the book is dense, sometimes feeling longer than it actually is (just over 200 pages), Games of Empire maintains a breezy readability by tightly coupling core concepts of Empire theory to well-known games and widely-publicized conflicts within the videogame industry. The first section of the book focuses on immaterial labor, the accumulation of “cognitive capital,” and the global process of manufacturing videogame consoles. It is significant for the authors that videogames began as hacker experiments within research institutes of the military industrial complex, programmed on stolen time, before becoming a commodity (7). This is the first in a string of examples showing how creative dissidence and conflict fuel the continuing evolution of Empire’s control. Dyer-Witheford and de Peuter explain that the videogame industry now constitutes an international production apparatus dominating both creative work in developed nations and manual labor in developing ones. Because game industries in the United States, Western Europe, and Japan are predominately non-unionized, they serve as an exemplary system for analyzing how global capital exploits contemporary intellectual work—including an excellent analysis of the “EA Spouse” scandal of 2004. On the side of the consumer, the authors argue that rabid “console races” that drive the industry forward from a technological perspective serve to structure gamer identity and combat piracy; later in the book, these machines offer a window into the worlds of Congolese coltan mining and electronic waste (222-224). In the second section, Dyer-Witheford and de Peuter move on to deep case studies of individual games to show how the most popular game genres embed imperial assumptions about conflict, exchange, and urban life. First they argue that military training games such as Full Spectrum Warrior —co-developed by university researchers, industry developers, and military contractors—contribute to the “banalization” of war, a subjective state wherein perpetual preparedness for war is accepted as a part of everyday life (100). Chapter five covers Michel Foucalt’s notion of “biopower,” the extension of capital accumulation to life itself. The authors argue that virtual worlds such as World of Warcraft , which take market capitalism as a given and force players into essentialist roles and racial antagonisms, are organized to maximize control and profit (often on the backs of virtual currency “farmers” in China and southeast Asia). Finally, they criticize the naïve assumption that humor and cynicism in the popular sandbox game franchise Grand Theft Auto offer any remedy to its racialized, violent content. Instead, such games indulge and normalize the fantasy of getting rich at any cost by keeping the realities of contemporary urban life and corporate greed at a safe distance (181). Part three of Games of Empire focuses on “games of multitude,” a preliminary attempt to escape from Empire’s order through alternate modes of videogame development and play. Multitude is defined dialectically, as “the engine and the enemy” of Empire (187). This is the most important, yet also most contradictory section of the text. It lays bare the process by which Empire and its media feed our creative and intellectual development to overabundance. At a certain point, the force of the multitude reaches such a level that it threatens the stability of Empire; however, instead of following Hardt and Negri’s utopian assumptions about the radical potential of the multitude, the authors here follow Paolo Virno’s warning that Empire is “very good at adopting apparently iconoclastic practices and utopian ideas as management techniques and revenue sources” (188). At every turn, advances in player configurative power provide new sources of revenue and advertising angles for the game industry. A disappointing shortcoming of these latter pages is the lack of truly new examples for radical resistance within game development. Instead, it turns out that the radical left seems satisfied with the same mild successes that the left-of-center also has celebrated: artist’s mods, virtual world activism, and critical counterplay within strategy- and wargames. Having been frequently cited by many authors before Dyer-Witheford and de Peuter, this idea of subversion or resistance through play feels tired and unpersuasive. It is unclear if the authors believe it is possible to embrace game design itself as a way of pursuing what they call “exodus” from Empire, or if an all-too-fashionable subversion is the only workable strategy. While the book does explore how the earliest independent game studios were eventually subverted and incorporated into the game industry proper, it doesn’t affirm or critique more recent non-commercial, DIY game development projects such as Klik-of-the-Month Club and Ludum Dare. Dyer-Witheford and de Peuter’s analysis of so-called “tactical games,” including the editorial works of La Molleindustria, leads to an even more ambivalent take on the contemporary design ecology. At the conclusion of his essay on “Countergaming,” Galloway asserts that avant-garde videogame artists “should create new grammars of action […] should create alternative algorithms” (Galloway 125). Yet Dyer-Witheford and de Peuter characterize works such as McDonald’s Video Game and Oiligarchy as didactic, suggesting that the role of radical political games might be “limited to that of agitprop” (199). They are concerned that games like those of Molleindustria rigidly structure the activities of their players in order to prove a point. Yet, despite their repeated assertion that the equation of greater interactivity with democratic digital liberation is flawed, the authors see potential in policy simulators that “allow players to edit or tweak” (202) their parameters in response to what Bogost has called simulation fever , the simultaneous drive toward and fear of simulation (Bogost 108). The possibility of practicing radical design is bucked, and early attempts at critical game development like those of Molleindustria’s seem to be relegated to the status of exceptions that prove the rule for player-centered exodus. Overall, there is one glaring question Games of Empire leaves unanswered: how exactly are videogames the “exemplary media” of Empire, and what are the implications of videogames being exemplary in this way? Presumably Dyer-Witheford and de Peuter want to avoid essentialist claims, so they’re not keen on following Wark’s desire to mark “the game’s difference from [legacy media] as something that speaks to changes in the overall structure of social and technical relations” (Wark 225). It is also unclear how the production apparatuses, labor standards, and subjectivizing processes involved in the creation and use of other any other kind of digital media would fail to justify their equally exemplary status. Even the book’s concluding paragraph holds that virtual games “are one molecular component of this undecidable collective mutation” (Dyer-Witheford and de Peuter 229) of intellect, labor, and daily life. In the end, the authors seem to back away from their focus on games as exemplary to bring their work in line with broader theories of the gradual digitization of the everyday, in line with Galloway and Manovich. Despite these flaws, there is an undeniable elegance to Games of Empire ’s contrasting of gaming’s overwhelmingly imperial content with its multitudinous form . And its ambivalence about the potential of independent or political game development might be seen by scholars of Empire as a strength rather than a weakness, an acceptance that every new expression of multitude offers another opportunity for the expansion of Empire. The book also functions as a strong, all-encompassing call to greater responsibility on the part of mainstream game developers to be more conscious of the ideologies they embed in their work, of the way their intellectual property is used and manipulated by those who employ them, and of the material impact their industry has on the world at large. For players it offers a toolbox of concepts for radical examinations of their own play activities, asking them to be more cognizant of the consequences of their consumption of digital media and the ways in which their virtual lives interface with the real. Can there be rules of language which serve both to determine meaning and to guide speakers in ordinary linguistic usage, i.e., in the production of speech acts? We argue that the answer is no. We take the guiding function of rules to be the function of serving as reasons for actions, and the question of guidance is then considered within the framework of practical reasoning. It turns out that those rules that can serve as reasons for linguistic utterances cannot be (...) considered as normative or meaning determining. Acceptance of such a rule is simply equivalent to a belief about meaning, and does not even presuppose that meaning is determined by rules. Rules that can determine meaning, on the other hand, i.e., rules that can be regarded as constitutive of meaning, are not capable of guiding speakers in the ordinary performance of speech acts. The rule-following debate, in its concern with the metaphysics and epistemology of linguistic meaning and mental content, goes to the heart of the most fundamental questions of contemporary philosophy of mind and language. I address the question of whether naturalism can provide adequate means for the scientific study of rules and rule-following behavior. As the term "naturalism" is used in many different ways in the contemporary debate, I will first spell out which version of naturalism I am targeting. Then I will recall a classical argument against naturalism in a version presented by Husserl. In the main part of the paper I will sketch a conception of rule-following behavior that is influenced (...) by Sellars and Haugeland. I will argue that rule-following is an essential part of human nature and insist in the social dimension of rules. Moreover, I will focus on the often overlooked fact that genuine rule-following behavior requires resilience and presupposes an inclination to calibrate one's own behavior to that of the other members of the community. Rule-following, I will argue, is possible only for social creatures who follow shared rules, which in turn presupposes a shared (first-person plural) perspective. This implies, however, that our scientific understanding of human nature has to remain incomplete as long as it does not take this perspective, which prima facie seems alien to it, into account. This work explores the later Wittgenstein’s philosophy of mathematics in relation to Lakatos’ philosophy of mathematics and the philosophy of mathematical practice. I argue that, while the philosophy of mathematical practice typically identifies Lakatos as its earliest of predecessors, the later Wittgenstein already developed key ideas for this community a few decades before. However, for a variety of reasons, most of this work on philosophy of mathematics has gone relatively unnoticed. Some of these ideas and their significance as precursors for (...) the philosophy of mathematical practice will be presented here, including a brief reconstruction of Lakatos’ considerations on Euler’s conjecture for polyhedra from the lens of late Wittgensteinian philosophy. Overall, this article aims to challenge the received view of the history of the philosophy of mathematical practice and inspire further work in this community drawing from Wittgenstein’s late philosophy. On Moral Certainty, Justification and Practice presents a view of morality that is inspired by the later Wittgenstein. Hermann explores the ethical implications of Wittgenstein's remarks on doubt, justification, rule-following, certainty and training, offering an alternative to interpretations of Wittgenstein's work that view it as being intrinsically ethical. The book scrutinises cases in which doubt and justification do not make sense, and contrasts certain justificatory demands made by philosophers with the role of moral justification in concrete situations. It offers (...) an account of moral certainty, which is linked to a view of moral competence. Contrary to the views propounded by philosophers who emphasise the importance of moral principles, it is argued that moral agency is first and foremost a matter of having certain capacities. The book takes an anti-intellectualist stance and remains close to concrete practices. In her seminal article ‘Modern Moral Philosophy’ (1958) Elizabeth Anscombe argued that we need a new ethics, one that uses virtue terms to generate absolute prohibitions against certain act-types. Leading contemporary virtue ethicists have not taken up Anscombe's challenge in justifying absolute prohibitions and have generally downplayed the role of rule-following in their normative theories. That they have not done so is primarily because contemporary virtue ethicists have focused on what is sufficient for characterizing the deliberation and action of (...) the fully virtuous person, and rule-following is inadequate for this task. In this article, I take up Anscombe's challenge by showing that rule-following is necessary for virtuous agency, and that virtue ethics can justify absolute prohibitions. First, I offer a possibility proof by showing how virtue ethics can generate absolute prohibitions in three ways: by considering actions that directly manifest vice or that cannot be performed virtuously; actions that are prohibited by one's institutional roles and practical identities; and actions that are prohibited by the prescriptions of the wise. I then seek to show why virtue ethicists should incorporate rule-following and absolute prohibitions into their theories. I emphasize the central role that rules have in the development of virtue, then motivate the stronger view that fully virtuous agents follow moral rules by considering the importance of hope, uncertainty about consequences, and taking responsibility for what eventuates. Finally, I provide an account of what Anscombe called a ‘corrupt mind’, explaining how our understanding of virtue is corrupted if we think that virtue may require us to do vicious actions. (shrink)

:Most game-theoretic accounts of institutions reduce institutions to behavioural patterns the players are incentivized to implement. An alternative account linking institutions to rule-following behaviour in a game-theoretic framework is developed on the basis of David Lewis’s and Ludwig Wittgenstein's respective accounts of conventions and language games. Institutions are formalized as epistemic games where the players share some forms of practical reasoning. An institution is a rule-governed game satisfying three conditions: common understanding, minimal awareness and minimal practical rationality. This monograph presents Azzouni’s new approach to the rule-following paradox. His solution leaves intact an isolated individual’s capacity to follow rules, and it simultaneously avoids replacing the truth conditions for meaning-talk with mere assertability conditions for that talk. Kripke’s influential version of Wittgenstein’s rule-following paradox—and Wittgenstein’s views more generally—on the contrary, make rule-following practices and assertions about those practices subject to community norms without which they lose their cogency. Azzouni summarizes and develops Kripke’s original version (...) of Wittgenstein’s rule-following paradox to make salient the linchpin assumptions of the paradox. By doing so, Azzouni reveals how compelling Kripke’s earlier work on the paradox was. Objections raised over the years by Fodor, Forbes Ginsborg, Goldfarb, Tait, Wright, and many others, are all shown to fail. No straight solution can be made to work. Azzouni illustrates this in detail by showing that a popular family of straight solutions due to Lewis and refined by Williams, “reference magnetism,” fail as well. And yet an overlooked sceptical solution is still available in logical space. Azzouni describes a series of “disposition-meaning” private languages that he shows can be successfully used by a population of speakers to communicate with one another despite their ideolectical character. The same sorts of languages enable solitary “Robinson Crusoes” to survive and flourish in their island habitats. These languages—sufficiently refined—have the same properties normal human languages have; and this is the key to solving the rule-following paradox without sacrificing the individual’s authority over her self-imposed rules or her ability to follow those rules. Azzouni concludes this unusual monograph by uncovering a striking resemblance between the rule-following paradox and Hume’s problem of induction: he shows the rule-following paradox to be a corollary of Hume’s problem that arises when the problem of induction is applied to an individual’s own abilities to follow rules. The seventeenth century saw dramatic advances in mathematical theory and practice. With the recovery of many of the classical Greek mathematical texts, new techniques were introduced, and within 100 years, the rules of analytic geometry, geometry of indivisibles, arithmetic of infinites, and calculus were developed. Although many technical studies have been devoted to these innovations, Mancosu provides the first comprehensive account of the relationship between mathematical advances of the seventeenth century and the philosophy of mathematics of the period. Starting (...) with the Renaissance debates on the certainty of mathematics, Mancosu leads the reader through the foundational issues raised by the emergence of these new mathematical techniques, including the influence of the Aristotelian conception of science in Cavalieri and Guldin, the foundational relevance of Descartes' Geometrie, the relation between geometrical and epistemological theories of the infinite, and the Leibnizian calculus and the opposition to infinitesimalist procedures. This article criticizes Bourdieu's and Giddens's overintellectualizing accounts of human activity on the basis of Wittgenstein's insights into practical under standing. Part 1 describes these two theorists' conceptions of a homology between the organization of practices (spatial-temporal manifolds of action) and the governance of individual actions. Part 2 draws on Wittgenstein's discussions of linguistic definition and following a rule to criticize these conceptions for ascribing content to the practical understanding they claim governs action. In recent years, a number of commentators have expressed dissatisfaction with Spinoza’s account of practical reason. In this paper, I defend his account against the most prominent objections, showing that the dictates of reason play an important role in guiding thought and action. However, against the standard interpretation, I propose that we view these rules not as exceptionless, instrumental prescriptions—hypothetical imperatives with necessary antecedents, as Curley memorable put it—but rather as adaptable guideposts that aid us in the complex, dynamic process (...) of acquiring a habit of virtue. Rules proliferate; some are kept with a bureaucratic stringency bordering on the absurd, while others are manipulated and ignored in ways that injure our sense of justice. Under what conditions should we make exceptions to rules, and when should they be followed despite particular circumstances? The two dominant models in the literature on rules are the particularist account and that which sees the application of rules as normative.
