Neuroeconomic studies are liable to fall into the reverse inference fallacy, a form of affirmation of the consequent. More generally neuroeconomics relies on two problematic steps, namely the inference from brain activities to the engagement of cognitive processes in experimental tasks, and the presupposition that such inferred cognitive processes are relevant to economic theorizing. The first step only constitutes the reverse inference fallacy proper and ways to correct it include a better sense of the neural response selectivity of the targeted (...) brain areas and a better definition of relevant cognitive ontologies for neuroeconomics. This second way also allows increased coherence between the cognitive processes actually involved in neuroeconomics experiments and the theoretical constructs of economics. We suggest means of increasing neural response selectivity in neuroeconomic experimental paradigms. We also discuss how the choice of cognitive ontologies can both avoid implicit reductionist strategies (from economic constructs to neural patterns) and irrelevance, as cognitive processes engaged in experimental tasks may lack immediate bearing on the study of economic behavior. With these joint improvements neuroeconomics can be a progressive science. (shrink)

Do laypeople think that moral responsibility is compatible with determinism? Recently, philosophers and psychologists trying to answer this question have found contradictory results: while some experiments reveal people to have compatibilist intuitions, others suggest that people could in fact be incompatibilist. To account for this contradictory answers, Nichols and Knobe (2007) have advanced a ‘performance error model’ according to which people are genuine incompatibilist that are sometimes biased to give compatibilist answers by emotional reactions. To test for this hypothesis, we (...) investigated intuitions about determinism and moral responsibility in patients suffering from behavioural frontotemporal dementia. Patients suffering from bvFTD have impoverished emotional reaction. Thus, the ‘performance error model’ should predict that bvFTD patients will give less compatibilist answers. However, we found that bvFTD patients give answers quite similar to subjects in control group and were mostly compatibilist. Thus, we conclude that the ‘performance error model’ should be abandoned in favour of other available model that best fit our data. (shrink)

A coherent practice of mens rea (‘guilty mind’) ascription in criminal law presupposes a concept of mens rea which is insensitive to the moral valence of an action’s outcome. For instance, an assessment of whether an agent harmed another person intentionally should be unaffected by the severity of harm done. Ascriptions of intentionality made by laypeople, however, are subject to a strong outcome bias. As demonstrated by the Knobe effect, a knowingly incurred negative side effect is standardly judged intentional, whereas (...) a positive side effect is not. We report the first empirical investigation into intentionality ascriptions made by professional judges, which finds (i) that professionals are sensitive to the moral valence of outcome type, and (ii) that the worse the outcome, the higher the propensity to ascribe intentionality. The data shows the intentionality ascriptions of professional judges to be inconsistent with the concept of mens rea supposedly at the foundation of criminal law. (shrink)

Framing effects occur when different descriptions of the same decision problem give rise to divergent decisions. They can be seen as a violation of the decisiontheoretic version of the principle of extensionality (PE). The PE in logic means that two logically equivalent sentences can be substituted salva veritate. We explore what this notion of extensionality becomes in decision contexts. Violations of extensionality may have rational grounds. Based on some ideas proposed by the psychologist Craig McKenzie and colleagues, we contend that (...) framing effects are justified when the selection of one particular frame conveys choice relevant information. We first discuss this idea from a philosophical point of view, and proceed next to formalize it first in the context of the Bolker–Jeffrey decision theory. Finally, we extend the previous analysis to non-expected utility theories using the Biseparable Preference model introduced by Ghirardato and Marinacci (2001) and therefore show that the analysis is independent of the assumptions of Bayesian decision theory. Recent research shows that in reasoning tasks, subjects usually produce an initial intuitive answer, accompanied by a metacognitive experience, which has been called feeling of rightness. This paper is aimed at exploring the complimentary experience of feeling of error, that is, the spontaneous, subtle sensation of cognitive uneasiness arising from conflict detection during thinking. We investigate FOE in two studies with the “bat-and-ball” reasoning task, in its standard and isomorphic control versions. Study 1 is a generation study, in which participants (...) are asked to generate their own response. Study 2 is an evaluation study, in which participants are asked to choose between two conflicting answers. In each study, the FOE is measured by the FOE questionnaire. Results show that the FOE is significantly present in the standard B&B task when participants give a wrong answer, that our questionnaire can measure it, and furthermore, that it is diagnostic of genuine error. Contingent valuation surveys generally elicit stated preferences by asking how much a respondent would be willing to pay for an environmental improvement. By drawing on linguistic theory, we propose that the modal phrasing of this question establishes a particular type of commitment towards a hypothetical payment, namely a subjective want or desire. Based on the idea that beyond subjective desires, considerations about what is morally adequate may guide expressed values and that elicitation of these can be linguistically facilitated, we employ (...) an experimental framework to investigate the effects of different modals ( willing, should and appropriate) in the elicitation question on stated preferences. We find that elicited amounts with appropriate are higher than those elicited with willing and should for environmental improvements more associated with use values, while differences are non-significant for environmental improvements more associated with non-use values. We discuss the implications of our findings for stated preference studies, as well as the potential broader theoretical implications that our study entails regarding linguistic representations of the moral entrenchment of environmental values. Neuroeconomics is a recent extension of behavioral economics which aims at uncovering the brain mechanisms and activities that mediate regular and anomalous behaviour. Gul and Pesendorfer have launched a critique against the neuroeconomic research program, based on what they argue is the incommensurability of the theoretical constructs employed by each respective discipline. To respond to their argument we envision and illustrate several "directions of instruction" between neuroscience and economics, and provide counter-examples to their critique. This disciplinary cross-talk suggests that neuroeconomics (...) may play a crucial conceptual and methodological role in fostering the unity of behavioral sciences. (shrink)

L'interpretation analytique est attentive aux proprietes logiques et semantiques du cogito, proprietes qui peuvent apporter des solutions a certains problemes cartesiens, traditionnels ou apparus en philosophie analytique. C'est ainsi que la forme logique et les aspects pragmatiques du cogito permettent d'evaluer son caractere intuitif et la certitude qu'il comporte. De meme l'analyse de son caractere indexical met-elle en evidence la plausibilite d'un mode de renvoi subjectif a des pensees objectives. De meme encore la transition du cogito a la res cogitans (...) reste concevable, a la croisee d'une perspective a la premiere personne et d'une contrainte referentielle objective. Il ressort de ces analyses une epistemologie et une ontologie cartesiennes minimales qui ne pretent a aucune inference vers un dualisme radical, mais qui favorisent plutot une certaine analogie dans l'attribution des predicats mentaux et corporels, prise dans la perspective de la premiere personne. Zalta's notion of encoding which lies at the core of his theory of abstract objects is refined so that it can capture cognitive dynamic phenomena such as multiple object-tracking in particular intentional contexts; namely hypothetical stipulation concerning abstract objects and counter-essential conceivability about ordinary ones. Zalta's Modal Axiom of Encoding is weakened and the notion of 'quasi-encoding' is spelt out.

Une analyse de la prière rogatoire (de demande) dirigée vers un état de choses passé est proposée. Je sais qu'un Boeing s'est abîmé en mer, je prie pour qu'un être cher, peut-être déjà mort, ait survécu. On examine les conditions sous lesquelles une telle demande est i) rationnelle et ii) peut être efficace. Deux réponses traditionnelles à ces questions sont particulièrement examinées: la solution moliniste d'une part et les discussions talmudiques sur la prière vaine d'autre part.

We consider the potentially major role of lay economic representations in economic theoretical modelling. Departing both from the rational expectation hypothesis, that supposes a maximal cognitive fit between agents’ representations and the variables in the model, and from an approach in terms of psychological biases that would externally affect agents’representation of their environment, we consider that lay representations have essential features that make them potentially valuable tools for the reconciliation of normative and practical perspectives in macroeconomics. By reviewing a series (...) of studies in the sub-field of the psychology of lay economics, we first emphasize the collective and pragmatically-oriented features of these lay economic representations. We thereby uncover the major role of language and meaning, seemingly non-economic human institutions, in laying down the basis for economic understanding. Secondly, we directly address the question of the internal logic and cognitive features of these representations and uncover/in uncovering typical circular causal reasoning in lay macroeconomics. We finally re-assess the question of the maximal fit between ordinary economic psychology and predictive economic modelling. (shrink)

Condition essentielle de la responsabilité civile, la notion de causalité reste aujourd’hui difficile à saisir et sujette à nombreuses discussions. Les contributions présentées dans cet ouvrage abordent la question à nouveaux frais, en adoptant un point de vue résolument interdisciplinaire mêlant philosophie, droit et économie. Sont envisagées successivement des difficultés que le contentieux de la causalité met régulièrement en évidence. Ainsi, la difficile articulation entre causalité juridique et causalité scientifique conduit à s’interroger sur le rôle de la science : doit-elle (...) guider le droit ou faut-il considérer que la causalité en droit n’est qu’un “construit” juridique dégagé de toute perspective scientifique ? Sont également évoquées les diverses tentatives de formalisation analytique de la causalité comme l’analyse contrefactuelle, le critère NESS et les définitions probabilistes de la causalité, ainsi que leur capacité à répondre aux questions redoutables suscitées par la présence de co-auteurs multiples ou d’hypothèses de “surdétermination causale”. Ces réflexions fondamentales ouvrent alors sur les autres aspects clefs de la causalité en droit et en économie comme la preuve et le rôle du raisonnement probabiliste, ou les modalités de la contribution à la dette de réparation en présence d’une pluralité de co-auteurs. Est alors mis en évidence l’apport des sciences économiques, qui permet de classer les différentes techniques d’attribution de la responsabilité et de discuter des propriétés économiques des règles de répartition de la charge de la dette de réparation. Cet ouvrage s’adresse aux chercheurs et aux praticiens confrontés aux questions délicates posées par la causalité dans le droit de la responsabilité civile. (shrink)

A conceptual and mathematical model of a social community behavior in a choice situation under a veil of ignorance, where two alternative policies—Rawlsian maximin and Harsanyian utilitarianism—can be implemented through the aggregation of individual preferences over these two policies, is constructed and investigated. We first incorporate in our conceptual model psychological features such as risk-aversion and prosocial preferences that likely underlie choices of welfare policies. We secondly develop and select the mathematical model presented it by means of an autonomous system (...) of ordinary differential equations. A qualitative analysis of this system global phase-plane behavior shows possible tendencies of community development under social choices over Rawlsian or utilitarian societies depending on psychological parameters such as risk aversion and prosocial preferences. We propose an axiomatization of aversion to incomplete preferences. Some prevailing models of incomplete preferences rely on the hypothesis that incompleteness is temporary and that by keeping their opportunity set open individuals reveal a preference for flexibility. We consider that the maintenance of incomplete preference is also aversive. Our model allows us to show how incompleteness induces an aversive attitude in two different ways: intrinsic and instrumental. Intrinsic aversion holds when one instance of incomplete preference in the set suffices to (...) decrease its utility. Instrumental aversion holds only insofar dominating options are affected by incompleteness. Given two partially overlapping sets of axioms on the binary relation over sets we formalize their consistency with the two types of aversion to incompleteness. Finally, we relate our model to the classical Sen’s distinction between tentative and assertive incompleteness. The spelling out of this distinction in the terms of our approach uncovers to what extent aversion to incompleteness may be compatible with a preference for flexibility. (shrink)

In, the author proposes a survey of Zalta’s Object Theory and, more specifically, of the Modal Axiom of Encoding. MAE claims that if something x possibly encodes a property F, then x necessarily encodes F. According to Bourgeois-Gironde, MAE fails to account for intentional phenomena which occur in conceivability-contexts. His solution is based on the notion of quasi-encoding: x quasi-encodes F iff x possibly encodes F. In this paper, I show that Bourgeois-Gironde’s concern is misguided and (...) that Zalta’s framework captures the conceivability-phenomena at issue by modeling Husserl’s notion of Noemata. I then argue that his solution is superior to Bourgeois-Gironde’s. The philosophical significance of such a discussion nonetheless goes well beyond the debate between these two authors. Indeed, Zalta’s theory of Noemata is only sketched and needs to be further explored to see, on the one hand, whether and how Object Theory successfully describes the behavior of objects in conceivability-contexts, and, on the other hand, to test the efficacy of its primitive notions that are – as the contemporary debate on Neomeinongianism largely shows – anything but uncontroversial. This article advances a new account of Kant’s views on conceptualism. On the one hand, I argue that Kant was a nonconceptualist. On the other hand, my approach accommodates many motivations underlying the conceptualist reading of his work: for example, it is fully compatible with the success of the Transcendental Deduction. I motivate my view by providing a new analysis of both Kant’s theory of perception and of the role of categorical synthesis: I look in particular at the categories of (...) quantity. Locating my interpretation in relation to recent research by Allais, Ginsborg, Tolley and others, I argue that it offers an attractive compromise on this important theoretical and exegetical issue. De Montesquieu à Posner, de Durkheim à Foucault, la recherche d'un schéma de causalité qui expliquerait synthétiquement les variations entre les systèmes historiques de pénalité sur une échelle unique d’observation est une entreprise ambitieuse à l'intersection de la sociologie du droit et d'une matière peu à peu décriée : la philosophie de l'Histoire. Aujourd'hui, deux corps théoriques complexes et éclatés prétendent au titre de sciences de l'évolution pénale. Le premier est fondé sur une analogie poussée entre évolution culturelle et évolution (...) biologique, et emprunte à l'analyse économique du droit ainsi qu’aux dernières révolutions des sciences naturelles. Le second trouve ses racines dans la pensée marxiste et perçoit le système pénal comme une machine d'oppression qui évolue au gré des passations de pouvoir. Ces deux courants semblent à première vue théoriser l’évolution pénale d’une façon satisfaisante. Mais en imprimant leur volonté normative sur des considérations descriptives, ces doctrines occultent certaines discontinuités historiques et en façonnent d'autres, nous forçant à voir des ruptures matérielles là où il n'y a que des changements d'intention. Between 1927 and 1936, Martin Heidegger devoted almost one thousand pages of close textual commentary to the philosophy of Immanuel Kant. This article aims to shed new light on the relationship between Kant and Heidegger by providing a fresh analysis of two central texts: Heidegger’s 1927/8 lecture course Phenomenological Interpretation of Kant’s Critique of Pure Reason and his 1929 monograph Kant and the Problem of Metaphysics. I argue that to make sense of Heidegger’s reading of Kant, one must resolve two (...) questions. First, how does Heidegger’s Kant understand the concept of the transcendental? Second, what role does the concept of a horizon play in Heidegger’s reconstruction of the Critique? I answer the first question by drawing on Cassam’s model of a self-directed transcendental argument, and the second by examining the relationship between Kant’s doctrine that ‘pure, general logic’ abstracts from all semantic content and Hume’s attack on metaphysics. I close by sketching the implications of my results for Heidegger’s own thought. Ultimately, I conclude that Heidegger’s commentary on the Critical system is defined, above all, by a single issue: the nature of the ‘form’ of intentionality. (shrink)

The structure of this article is very simple. In the first half, I will introduce a sophisticated way of reading Heidegger as a relativist; I draw here on the work of Kusch and Lafont. In the second half, I present the counter-argument. As I see it, Heidegger is not a relativist; but understanding the relations between his approach and a relativistic one is crucial for an evaluation of both his own work and the broader trajectory of post-Kantian thought.

This book offers a fundamentally new account of the arguments and concepts which define Heidegger's early philosophy, and locates them in relation to both contemporary analytic philosophy and the history of philosophy. Drawing on recent work in the philosophy of mind and on Heidegger's lectures on Plato and Kant, Sacha Golob argues against existing treatments of Heidegger on intentionality and suggests that Heidegger endorses a unique position with respect to conceptual and representational content; he also examines the implications of (...) this for Heidegger's views on truth, realism and 'being'. He goes on to explore Heidegger's work on the underlying issue of normativity, and focuses on his theory of freedom, arguing that it is freedom that links the existential concerns of Being and Time to concepts such as reason, perfection and obligation. The history of science is often understood as a succession of theories. However, this conception of the history of science does not do justice to the complexity of the dynamics implemented in scientific development. To illustrate this, we focus on a type of phenomena that cannot be described as a simple linear succession : the desuetude of certain theories and particularly the temporary desuetude of the theory of neuroplasticity. This volume examines the problems of legal and linguistic diversity in the EU legal system. In a union of 27 member states, with 23 different languages, how can the coherence of EU law be guaranteed? Is there a common understanding between lawyers from different national backgrounds as to the meaning and domestic application of EU law? The volume addresses these central questions from a range of theoretical and practical perspectives.

This article addresses three questions concerning Kant’s views on non-rational animals: do they intuit spatio-temporal particulars, do they perceive objects, and do they have intentional states? My aim is to explore the relationship between these questions and to clarify certain pervasive ambiguities in how they have been understood. I first disambiguate various nonequivalent notions of objecthood and intentionality: I then look closely at several models of objectivity present in Kant’s work, and at recent discussions of representational and relational theories of (...) intentionality. I argue ultimately that, given the relevant disambiguations, the answers to all three questions will likely be positive. These results both support what has become known as the nonconceptualist reading of Kant, and make clearer the price the conceptualist must pay to sustain her position. (shrink)

One of the strongest motivations for conceptualist readings of Kant is the belief that the Transcendental Deduction is incompatible with nonconceptualism. In this article, I argue that this belief is simply false: the Deduction and nonconceptualism are compatible at both an exegetical and a philosophical level. Placing particular emphasis on the case of non-human animals, I discuss in detail how and why my reading diverges from those of Ginsborg, Allais, Gomes and others. I suggest ultimately that it is only by (...) embracing nonconceptualism that we can fully recognise the delicate calibration of the trap which the Critique sets for Hume. (shrink)

Kant’s account of the sublime makes frequent appeals to infinity, appeals which have been extensively criticised by commentators such as Budd and Crowther. This paper examines the costs and benefits of reconstructing the account in finitist terms. On the one hand, drawing on a detailed comparison of the first and third Critiques, I argue that the underlying logic of Kant’s position is essentially finitist. I defend the approach against longstanding objections, as well as addressing recent infinitist work by Moore and (...) Smith. On the other hand, however, I argue that finitism faces distinctive problems of its own: whilst the resultant theory is a coherent and interesting one, it is unclear in what sense it remains an analysis of the sublime. I illustrate the worry by juxtaposing the finitist reading with analytical cubism. -/- . (shrink)

This article examines the phenomenon of thought insertion, one of the most extreme disruptions to the standard mechanisms for self-knowledge, in the context of Kant's philosophy of mind. This juxtaposition is of interest for two reasons, aside from Kant's foundational significance for any modern work on the self. First, thought insertion presents a challenge to Kant's approach. For example, the first Critique famously held that " The 'I think' must be able to accompany all my representations " (Kant, KrV, B132). (...) Yet thought insertion raises the problem of representations which are 'mine' by many natural criteria, and yet which I am unwilling to self-ascribe. Ultimately, my argument will be that thought insertion simultaneously problematises, and yet to some degree also vindicates, the complex distinctions between activity and passivity which underlie Kant's system. Second, I argue that Kant's position contains resources that allow us to model thought insertion, and its broader implications for self-knowledge, in an interesting and distinctive manner. Kant himself held an extreme view of philosophy's competence in the study of mental disorder: in the Anthropology, he suggests that courts must refer such cases to philosophers, rather than medics (Kant, Anth, p.214). My aim is much more modest: to suggest that a Kantian treatment of thought insertion deserves consideration by both philosophers and clinicians. (shrink)

This article advances a new analysis of stupidity as a distinctive form of cognitive failing. Section 1 outlines some problems in explicating this notion and suggests some desiderata. Section 2 sketches an existing model of stupidity, found in Kant and Flaubert, which serves as a foil for my own view. In section 3, I introduce my theory: I analyse stupidity as form of conceptual self-hampering, characterised by a specific aetiology and with a range of deleterious effects. In section 4, I (...) show how this proposal meets the desiderata and I clarify how it diverges from existing accounts. My position is close to a 'public health approach', in contrast to the virtue/vice framework employed by Engel or Mulligan. (shrink)

This paper addresses a number of closely related questions concerning Kant's model of intentionality, and his conceptions of unity and of magnitude [Gröβe]. These questions are important because they shed light on three issues which are central to the Critical system, and which connect directly to the recent analytic literature on perception: the issues are conceptualism, the status of the imagination, and perceptual atomism. In Section 1, I provide a sketch of the exegetical and philosophical problems raised by Kant's views (...) on these issues. I then develop, in Section 2, a detailed analysis of Kant's theory of perception as elaborated in both the Critique of Pure Reason and the Critique of Judgment; I show how this analysis provides a preliminary framework for resolving the difficulties raised in Section 1. In Section 3, I extend my analysis of Kant's position by considering a specific test case: the Axioms of Intuition. I contend that one way to make sense of Kant's argument is by juxtaposing it with Russell's response to Bradley's regress; I focus in particular on the concept of ‘unity’. Finally, I offer, in Section 4, a philosophical assessment of the position attributed to Kant in Sections 2 and 3. I argue that, while Kant's account has significant strengths, a number of key areas remain underdeveloped; I suggest that the phenomenological tradition may be read as attempting to fill precisely those gaps.
