We agree with Vaesen that there is evidence for cognitive differences between humans and other primates. However, it is too early to draw firm conclusions about the uniqueness of the cognitive mechanisms underlying human tool use. Tests of causal understanding are in their infancy, as is the study of animals more distantly related to humans.

Could it be right to convict and punish defendants using only statistical evidence? In this paper, I argue that it is not and explain why it would be wrong. This is difficult to do because there is a powerful argument for thinking that we should convict and punish defendants using statistical evidence. It looks as if the relevant cases are cases of decision under risk and it seems we know what we should do in such cases (i.e., maximize expected value). (...) Given some standard assumptions about the values at stake, the case for convicting and punishing using statistical evidence seems solid. In trying to show where this argument goes wrong, I shall argue (against Lockeans, reliabilists, and others) that beliefs supported only by statistical evidence are epistemically defective and (against Enoch, Fisher, and Spectre) that these epistemic considerations should matter to the law. To solve the puzzle about the role of statistical evidence in the law, we need to revise some commonly held assumptions about epistemic value and defend the relevance of epistemology to this practical question. The result is an impoverished conception of the nature of research, an incomplete focus on actors who bear important moral responsibilities, and a system of ethics and oversight highly attuned to the dangers of research but largely (...) silent about threats of ineffective, inefficient, and inequitable medical practices and health systems. -/- In For the Common Good: Philosophical Foundations of Research Ethics, Alex John London defends a conception of the common good that grounds a moral imperative with two requirements. The first is to promote research that generates the information necessary to enable key social institutions to effectively, efficiently, and equitably safeguard the basic interests of individuals. The second is to ensure that research is organized as a voluntary scheme of social cooperation that respects its various contributors' moral claims to be treated as free and equal. Connecting research to the goals of a just social order grounds a framework for assessing and managing research risk that reconciles these requirements and justifies key oversight practices in non-paternalistic terms. RESUMOAs muitas definições de tecnociência são oferecidas como corretivas para um ideal de ciência pura, completamente separada da sociedade. A crítica da pureza nos estudos de ciência e de tecnologia foi precedida por críticas fenomenológicas em Heidegger e em Marcuse. A ideia de pureza não é mais crível. No entanto, o conceito de ciência pura tem desempenhado historicamente um papel na defesa da ciência contra interferências políticas. O conceito de tecnociência corre o risco de abrir a ciência a essa interferência (...) e tem provocado uma defesa renovada e, de certa forma, fútil da sua pureza. O consenso nos Estudos de Ciência e Tecnologia (ECT) de que a ciência é fundamentalmente social parece tornar óbvia a necessidade de um termo como tecnociência. Este artigo sugere uma definição restritiva de tecnociência com base na multiplicação de testes independentes de validade. Esse é um caso extremo da sociabilidade da ciência, porque aqui a ciência e a tecnologia emergem juntas, em vez de a teoria preceder a aplicação. A tecnociência sob essa definição descreveria o trabalho científico, validado cientificamente, que serve simultaneamente em processos comerciais e públicos que têm sua própria lógica e seus testes de validade independentes. De acordo com essa definição, a existência de interações complexas entre ciência e sociedade não obscurece as fronteiras entre esses testes. A tecnociência está inserida na sociedade, como toda ciência, mas é única ao se situar em um “garfo” [ataque duplo no xadrez] entre linguagens e critérios de sucesso distintos. The economic globalization process has integrated different competitive markets and pushes firms in different countries to improve their managerial and operational efficiencies. Given the recent empirical evidence for the benefits to firms and stakeholders of good corporate governance (CG) practice, it is expected that good CG practice would be a common strategy for firms in different countries to meet the increasingly intense competition; however, this is not the case. This study examines the differences in CG practices in firms across different (...) countries using the concept of ethical sensitivity. Through the regression analysis of 271 firms in 12 countries and regions, it is found that Hofstede’s cultural dimensions can explain the differences in CG practices. Furthermore, the results demonstrate the influence of culture on ethical sensitivity, which eventually determines the CG practices in different regions. (shrink)

Ultimately we will only understand biological agency when we have developed a theory of the organization of biological processes, and science is still a long way from attaining that goal. It may be possible nonetheless to develop a list of necessary conditions for the emergence of minimal biological agency. The authors offer a model of molecular autonomous agents which meets the five minimal physical conditions that are necessary (and, we believe, conjointly sufficient) for applying agential language in biology: autocatalytic reproduction; (...) work cycles; boundaries for reproducing individuals; self-propagating work and constraint construction; and choice and action that have evolved to respond to food or poison. When combined with the arguments from preadaptation and multiple realizability, the existence of these agents is sufficient to establish ontological emergence as against what one might call Weinbergian reductionism. Minimal biological agents are emphatically not conscious agents, and accepting their existence does not commit one to any robust theory of human agency. Nor is there anything mystical, dualistic, or non-empirical about the emergence of agency in the biosphere. Hence the emergence of molecular autonomous agents, and indeed ontological emergence in general, is not a negation of or limitation on careful biological study but simply one of its implications. A Biopolítica também faz parte das discussões apresentadas neste trabalho. Boa parte da obra resulta da pesquisa de doutorado que o autor empreendeu na (...) Universidade Estadual do Sudoesta da Bahia e na França, onde realizou estágio doutoral em 2014, com bolsa da CAPES no Programa de Doutorado Sanduíche no Exterior. A obra de Foucault influenciou diretamente cada escrito que compõe esta coletânea. Ela é um convite para pensar com Foucault. Em outras palavras, o autor nos convida a entrar na ordem do pensamento de Michel Foucault por meio da memória e dos corpos em filmes franceses de horror, tratando-os sob o prisma da arqueogenealogia. Panentheism is best understood as a philosophical research program. Identifying the core of the research program offers a strong response to the demarcation objection. It also helps focus both objections to and defenses of panentheism — and to show why common objections are not actually criticisms of the position we are defending. The paper also addresses two common criticisms: the alleged inadequacy of panentheism’s double “in” specification of the relationship between God and world, and the “double God” objection. Once the (...) research program framework is in place, topics like these become opportunities for panentheists to engage in the kind of careful constructive work in theology and philosophy — historical, analytic, and systematic — that is required for making long-term, positive contributions to our field. American Academy of Pediatrics (AAP) and American College of Medical Genetics (ACMG) recently provided two recommendations about predictive genetic testing of children. The Clinical Sequencing Exploratory Research Consortium's Pediatrics Working Group compared these recommendations, focusing on operational and ethical issues specific to decision making for children. Content analysis of the statements addresses two issues: (1) how these recommendations characterize and analyze locus of decision making, as well as the risks and benefits of testing, and (2) whether the guidelines conflict or (...) come to different but compatible conclusions because they consider different testing scenarios. These statements differ in ethically significant ways. AAP/ACMG analyzes risks and benefits using best interests of the child and recommends that, absent ameliorative interventions available during childhood, clinicians should generally decline to order testing. Parents authorize focused tests. ACMG analyzes risks and benefits using the interests of the child and other family members and recommends that sequencing results be examined for additional variants that can lead to ameliorative interventions, regardless of age, which laboratories should report to clinicians who should contextualize the results. Parents must accept additional analysis. The ethical arguments in these statements appear to be in tension with each other. (shrink)

This chapter surveys elements of non-human cognition to explore ways to think across the boundary that is usually asserted between living and machinic intelligence, mainly drawing on the work of Catherine Malabou and N. Katherine Hayles. Many continental philosophers follow Martin Heidegger in his sceptical approach to modern technology, even if Heidegger advocates for a more authentic retrieval of Greek techne. Here, however, this chapter engages with Catherine Malabou’s recent book, Morphing Intelligence, to see how she conjoins a biological model (...) of neuroplasticity to a machinic conception of artificial intelligence. Malabou argues that the science of epigenetics applies to both living organisms and machines. Although her earlier work focuses more on biology and the living brain, Malabou comes to view AI in more plastic terms as well. She claims that a better understanding of automatism views plasticity in both neurological and cybernetic terms. These forms of plasticity not only are shaped but also shape material, machinic, and biological form in new and generative ways. Plasticity is not simply malleability, but a kind of programmativity that embodies a kind of metamorphosis. Hayles’s work helps supplement Malabou’s insights. In her book Unthought, Hayles demonstrates how cognition operates beyond consciousness in both organic and machinic terms. The expansion of cognition beyond its restriction to human consciousness allows a better, more plastic, ecology within which to think about all these various forms of intelligence, artificial or otherwise. This article investigates the role of the body in Jean-Luc Nancy’s powerful essay Corpus, and critiques it from the standpoint of Agamben’s biopolitics. For Nancy, the body becomes the privileged site of both existence and sense in a way that threatens to obscure the logic of exceptional decision that Agamben takes from Carl Schmitt. As an alternative to Nancy’s understanding of the body, we can see in Deleuze a series of bodies that works in parallel to a series of sense (...) or language, where sense and body do not get collapsed into each other. At the same time, contemporary continental philosophy resists the idealistic separation of thinking and embodiment. Deleuze calls this relation between sense and body a cut, but we could also consider a parallax, following Slavoj Zizek. Finally, African-American historian of religion Charles H. Beginning with Kant and German idealism, including the German responses to Kant in the work of Hölderlin, Fichte, Schelling, and Hegel, this book then carefully draws out the ways that Bergson, Sartre, Merleau-Ponty, Derrida, Foucault, and Deleuze all work against this understanding of thinking as judging by showing how our experience and our thought precede the categories of judgment.In chapter 1, Somers-Hall carefully sets out Kant's model of thinking and shows how the categories of philosophical thought are fundamentally based on how we judge our sensible intuitions. This chapter discusses the connection between postmodernism and natural theology. It argues that, in a narrow sense, we need to get beyond the limits of a postmodernism obsessed with language and culture to the exclusion of nature, which is partly the consequence of its American reception and engagement by philosophers, social scientists, and literary theorists who have applied post-structuralism to the contemporary American academy, with its strong methodological divide between the humanities and the natural sciences. In a broad sense, postmodern (...) and post-structuralist insights and ideas are still vitally relevant to re-conceptualizing nature in various ways, including theological ones. In this article I draw on John Rawls’ conception of political liberalism to suggest that the epistemic criterion is an inappropriate basis for the political community’s shaping of children’s beliefs.

Esta pesquisa empreende um estudo acerca das formas de enunciar o medo em produções fílmicas de horror; ou seja, busca-se, por meio da arqueogenealogia foucaultiana, analisar o enquadramento do medo nas imagens em movimento que foram produzidas para compor a estrutura dos filmes de horror; precisamente, busca-se analisar os modos de produção do corpo contemporâneo demarcado pelo horror nestas imagens. Desta maneira, o objetivo deste trabalho é contribuir com a (re)criação da história dos modos como os medos contemporâneos estão na (...) ordem da constituição dos modos pelos quais os seres humanos se tornam sujeitos nesta época do simultâneo, da justaposição, do próximo, do longínquo, do lado a lado, do disperso. É um empreendimento de inspiração foucaultiana na medida em que operamos com alguns elementos de sua maquinaria teórica tais como: dispositivo; acontecimento discursivo; discurso e enunciado. Biomedical research has always relied on access to human biological materials and clinical information, resources that when combined form biobanks. In the past, it appears that investigators sometimes used these resources with relatively little oversight, and without the consent of the individuals from whom these materials and information were obtained. Several developments in the last ten to fifteen years have converged to place greater emphasis on the role of individual consent in the creation and use of biobanks. The most important (...) by far is the power of information technology, which has transformed our lives in almost every domain. In the research setting, it is now easy to abstract information from electronic medical records. Computers make it possible to analyze enormous datasets and have contributed in essential ways to the dramatic increases in our understanding of genomics and other areas of biomedical science. Theorists concerned about the distributive effects of skilled emigration (brain drain) often argue that its harmful effects can be justly mitigated by restricting emigration from sending countries or by limiting immigration opportunities to receiving countries. I raise moral and practical concerns against restricting the movement of skilled migrants and contend that conceptualizing the moral issue in these terms leads theorists to neglect the moral salience of institutions that determine the distributive effects of migration. Using an analogy to skilled migration in (...) a domestic context, I argue for locating brain drain in a more holistic, institutional context that includes the reform of global institutions and of policies affecting migration. Este trabalho empreende uma discussão a respeito do corpo como materialidade visível no dizível em duas produções cinematográficas de horror (Frontières e À l’interieur), cuja ordem fílmica de horror lança mão das imagens referentes ao acontecimento do Outubro de 2005, o qual foi marcado pelas manifestações e confrontos violentos entre a polícia e os manifestantes nas principais cidades francesas. Esta forma de usar imagens referentes a acontecimentos políticos ou sociais é uma característica das produções cinematográficas americanas de horror dos anos (...) de 1960 a 1970, da qual O massacre da Serra elétrica reconstrói seu roteiro sob a memória do caso de Ed Gein que aconteceu no Estado americano de Wisconsin nos anos de 1950. Nesta discussão, apresentamos uma análise, laçando mão da noção de intericonicidade para tratar das imagens que remetem a outras imagens e, ao mesmo tempo, retomamos a reflexão barthesiana “Como pode um acontecimento ser escrito?”, enunciada, em 1968, para refletir acerca do acontecimento do Maio daquele ano. Biomedical research has always relied on access to human biological materials and clinical information, resources that when combined form biobanks. In the past, it appears that investigators sometimes used these resources with relatively little oversight, and without the consent of the individuals from whom these materials and information were obtained. Several developments in the last ten to fifteen years have converged to place greater emphasis on the role of individual consent in the creation and use of biobanks. The most important (...) by far is the power of information technology, which has transformed our lives in almost every domain. In the research setting, it is now easy to abstract information from electronic medical records. Computers make it possible to analyze enormous datasets and have contributed in essential ways to the dramatic increases in our understanding of genomics and other areas of biomedical science. Notwithstanding an ongoing concern about the low representation of certain groups in higher education, there is reluctance on the part of politicians and policy makers to adopt positive discrimination as an appropriate means of widening participation. This article offers an account of the different objections to positive discrimination and, thereafter, clarifies and criticises the view that universities ought to select those applicants who are expected to be most successful as students. It distinguishes arguments from meritocracy, desert, respect, and productivity and (...) shows how these arguments are compatible with the use of positive discrimination in higher education. As reflexões realizadas aqui, tomam como foco o discurso oficial a partir da Lei Darcy Ribeiro sancionada em 20 de dezembro de 1996, particularmente, dos discursos veiculados como Parâmetros Curriculares Nacionais e Orientações Curriculares Nacionais para o ensino de língua portuguesa, os quais impõem uma nova postura teórica e prática aos professores. Trata-se, nesse trabalho, de traduzir a política oficial de formação de professor e/ou desconstruí-la (Derrida, 1998), identificando a (s) identidade (s) e competências atribuídas aos professores, enfatizando as representações (...) sociais da profissão do professor na sociedade contemporânea brasileira, abrindo a possibilidade para questionarmos a identidade unificada e transparente que os documentos oficiais desenham para os professores. Strong forms of dualism and eliminative materialism block any significant dialogue between the neurosciences and theology. The present article thus challenges the Sufficiency Thesis, according to which neuroscientific explanations will finally be sufficient to fully explain human behavior. It then explores the various ways in which neuroscientific results and theological interpretations contribute to an overall theory of the person. Supervenience theories, which hold that mental events are dependent on their physical substrata but not reducible to them, are explained. Challenging the (...) determinism of “strong” supervenience, I defend a version of “soft” supervenience that allows for genuine mental causation. This view gives rise in turn to an emergentist theory of the person. Still, I remain a monist: there are many types of properties encountered in the world, although it is only the one nature that bears all these properties. The resulting position, emergentist monism, allows for diversity within the context of the one world. This view is open at the top for theological applications and interpretations while retaining the close link to neuroscientific study and its results. Theology offers an interpretation of the whole world based on a yet higher order of emergence, although the notion of God moves beyond the natural order as a whole. It therefore supplements the natural scientific study of the world without negating it. (shrink)

There are countless variations on this theme. The call can come from one of your own physicians who was called by the investigator. Your physician may or may not be well informed on what the reported finding about Disease Y means or how to respond. DNA testing can reveal more than susceptibility to disease. People can learn that they do not have the biological connections — parentage or evidence of ethnic origin — that they thought they did.Colleagues who serve on (...) the Institutional Review Board in my institution tell me that they currently do not permit “cold calls” of the type portrayed in the opening paragraph. Such direct contacts have, however, occurred in the past, with or without the blessing of an IRB. Sharing findings with the individual’s physician, who is then supposed to serve as a learned and wise intermediary, is not without problems either, given that many physicians understand little about complex genetics. Yet the very existence of this project on managing incidental findings in research demonstrates that some people believe that some research findings ought to be available to participants. (shrink)

Despite calls by some commentators for disclosing incidental fndings in genetics research, several factors weigh in favor of caution. The technology of genetics has the power to uncover a vast array of information. The most potent argument for restraint in disclosure is that much research is pursued without consent so that the individual participant may not know that research is being conducted at all. Often the work is done by investigators and at institutions with which the person has no prior (...) contact. Past practice is also relevant; genetics researchers historically have chosen not to disclose incidental fndings, of which misattributed paternity and pleiotropic alleles such as ApoE have been the most common. Many people choose not to have genetic tests when given a choice. It may be desirable to discuss the topic of incidental fndings when consent for research is obtained, but given the risk of unwanted surprise when there has been no prior discussion, the potential utility of incidental fndings should be very high before they are even ofered to individuals. Political scientists generally consider that the incentive for legislators to switch parties lies in their desire to be re-elected. While some scholars attribute defection to the legislators’ popularity and strong connections with their constituents which enable them to be re-elected without relying on party labels, others assert that legislators switch if they perceive that staying put might threaten their chances of re-election. In this paper, we find that the two assumptions, to some extent, contradict each other. More surprisingly, the two (...) contradictory hypotheses cohabit under the single non-transferable vote system. From an analysis of the switching in the Taiwanese Legislative Yuan, the empirical evidence shows that because of fierce intraparty competition in the multimember districts, not only barely elected but also top-ranked legislators switched party affiliation in order to avoid the loss in votes or even seats to their copartisans and to maximize their chances of re-election.
