Statutairement, les mères légitimes sont associées, sur un mode mineur ou de plein droit dans le cas du veuvage et de l’institution tutélaire, à l’exercice de l’autorité paternelle. Following Karni's seminal work, Walker and other researchers have recently provided gradually convincing evidence that sleep is critical for the consolidation-based enhancement (CBE) of motor sequence learning. Studies in our laboratory using a motor adaptation paradigm, however, show that CBE can also occur after the simple passage of time, suggesting that sleep effects on memory consolidation are task-related, and possibly dependent on anatomically dissociable circuits.

The recognition of a meaningful sensory foundation of perception is central to Maurice Merleau-Ponty’s philosophy. If some commentators do not hesitate to see in the notion of perceptual Gestalt a notion applicable to all domains of being, it is not a priori easy to see how it must be conceived in the more specific context of the perception of others (autrui). However, Merleau-Ponty is very clear on this point: all perception manifests itself in the form of a Gestalt, including the (...) perception of other people. The ambition of this short study is to spell out in rough strokes how this injunction should be heard and thus to explain how others manifest themselves as Gestalts to perceptual consciousness. Human activity is permeated by norms of all sorts: moral norms provide the 'code' for what we ought to do, norms of logic regulate how we ought to reason, scientific norms set the standards for what counts as knowledge, legal norms determine what is lawfully permitted and what isn't, aesthetic norms establish canons of beauty and shape artistic trends and practices, and socio-cultural norms provide criteria for what counts as tolerable, just, praiseworthy, or unacceptable in a community or milieu. Given (...) the diversity of norm-governed phenomena prevailing in our everyday experience, it is not surprising that the question of normativity has recently generated important debates in philosophy. However, the more specific question concerning the nature and function of 'norms in perceptual experience' has received comparatively little attention. An important volume connecting classical studies with feminism, Feminism and Ancient Philosophy provides an even-handed assessment of the ancient philosophers' discussions of women and explains which ancient views can be fruitful for feminist theorizing today. In this paper, I examine a heretofore ignored critic of Descartes on the heterogeneity problem: Anton Wilhelm Amo. Looking at Amo’s critique of Descartes reveals a very clear case of a thinker who attempts to offer a causal system that is not a solution to the mind-body problem, but rather that transcends it. The focus of my discussion is Amo’s 1734 dissertation: The Apathy [ἀπάθεια] of the Human Mind or The Absence of Sensation and the Faculty of Sense in the (...) Human Mind and their Presence in our Organic and Living Body. Amo’s discussion of the interaction, or lack thereof, of the mind and body hinges on the essential feature he identifies for the human mind—apathy, that is, impassivity. In this work, Amo engages explicitly with Descartes’s writing, which allows us to more precisely see the nature of his agreement and disagreement with the Cartesian metaphysics of mind. I proceed by treating Amo’s five stated criteria for spirit-hood which, in turn, reveal the kinds of causal connections that are possible for embodied spirits on his view. My aim is threefold: To lay out what I take to be Amo’s view of and arguments for the five criteria he takes to be required for a substance to be spirit. To locate Amo’s agreement and disagreement with Descartes. To suggest that Amo’s view on mind-body interaction involves a kind of occasional causation. (shrink)

This article discusses what is involved in having full moral status, as opposed to a lesser degree of moral status and surveys different views of the grounds of moral status as well as the arguments for attributing a particular degree of moral status on the basis of those grounds.

This study examined the hypothesis that conditional reasoning involves visual short-term memory resources (Johnson-Laird, 1985). A total of 147 university students were given measures of verbal and visual short-term memory capacity and a series of concrete and abstract conditional reasoning problems. Results indicate that there is a positive correlation between verbal working memory capacity and reasoning with both concrete and abstract premises. A positive correlation was also obtained between visual working memory capacity and reasoning with concrete premises.

We propose the Selfish Goal model, which holds that a person's behavior is driven by psychological processes called goals that guide his or her behavior, at times in contradictory directions. Goals can operate both consciously and unconsciously, and when activated they can trigger downstream effects on a person's information processing and behavioral possibilities that promote only the attainment of goal end-states (and not necessarily the overall interests of the individual). Hence, goals influence a person as if the goals themselves were (...) selfish and interested only in their own completion. We argue that there is an evolutionary basis to believe that conscious goals evolved from unconscious and selfish forms of pursuit. This theoretical framework predicts the existence of unconscious goal processes capable of guiding behavior in the absence of conscious awareness and control (theautomaticity principle), the ability of the most motivating or active goal to constrain a person's information processing and behavior toward successful completion of that goal (thereconfiguration principle), structural similarities between conscious and unconscious goal pursuit (thesimilarity principle), and goal influences that produce apparent inconsistencies or counterintuitive behaviors in a person's behavior extended over time (theinconsistency principle). Thus, we argue that a person's behaviors are indirectly selected at the goal level but expressed (and comprehended) at the individual level. (shrink)

In a recent article in this journal, Brian Alters argued that, given the many ways in which the nature of science is described and poor student responses to NOS instruments such as Nature of Scientific Knowledge Scale, Nature of Science Scale, Test on Understanding Science, and others, it is time for science educators to reconsider the standard lists of tenets for the NOS. Alters suggested that philosophers of science are authorities on the NOS and that consequently, it would be wise (...) to investigate their views of current NOS tenets. To that end, he conducted a survey of members of the Philosophy of Science Association, and, via various statistical techniques, made claims about the nature and extent of variation among philosophers of science regarding basic beliefs about the NOS. As three philosophers of science, we laud Alters’ attempt to understand philosophers of science’ view on the NOS. We believe, however, that his techniques for investigating this question are inappropriate and that consequently, several of his conclusions are unwarranted. In this comment, we will substantiate these criticisms. In addition, we will address some of the important questions that motivate Alters’ research and attempt to unravel the “byzantine complexity” of philosophical views about the NOS. We begin with our concerns regarding Alters’ research. We then provide a taxonomy of philosophic issues; and finally, we suggest some roles for philosophy of science in science teaching and the education of science teachers. (shrink)

The National Institutes of Health and other federal health agencies are considering establishing a national biobank to study the roles of genes and environment in human health. A preliminary public engagement study was conducted to assess public attitudes and concerns about the proposed biobank, including the expectations for return of individual research results. A total of 141 adults of different ages, incomes, genders, ethnicities, and races participated in 16 focus groups in six locations across the country. Focus group participants voiced (...) a strong desire to be able to access individual research results. Recognizing the wide range of possible research results from a large cohort study, they repeatedly and spontaneously suggested that cohort study participants be given ongoing choices as to which results they received. When we consider early modern philosophers who engage with sceptical arguments, Nicolas Malebranche is not usually among the first names to come to mind. But, while Malebranche does not spend much time with this topic, the way in which he responds to it when he does is nevertheless valuable. This is because his response underlines the central role of a particular principle in his system: the utter dependence of all created things on God. In this paper, I argue that the (...) end of Malebranche’s engagement with scepticism in general is to show that it is a position, like atheism, that is only possible if one has a disordered imagination. And, importantly, one feature of a disordered imagination is the questioning or denial of what Malebranche takes to be a foundational principle of human knowledge: that we, and all other finite things, utterly depend on God for everything. The notions of perceptual normativity and optimality have generated much discussion in the last decade or so in the literature on Merleau-Ponty. Husserl’s position on the topic has been far less extensively investigated. Surprisingly, however, Husserl wrote a great deal about the question of perceptual optimality. Not only are there a considerable number of important passages scattered throughout the manuscripts, the archive also contains a few important full texts on precisely this issue. Given the role of fulfillment for Husserl’s concept (...) of intentionality, this should not really come as a surprise, since the teleological nature of the fulfillment structure terminates in an experience of the optimum. Hence, however marginal this topic might seem at first glance, reflecting on it rapidly leads us to the heart of Husserl’s project and sheds further light on his conception of intentional experience. Recent debates about inequality have focused almost exclusively on the distribution of wealth and disparities in income, but little notice has been paid to the distribution of free time. Free time is commonly assumed to be a matter of personal preference, a good that one chooses to have more or less of. Even if there is unequal access to free time, the cause and solution are presumed to lie with the resources of income and wealth. In Free Time, Julie (...) Rose argues that these views are fundamentally mistaken. First, Rose contends that free time is a resource, like money, that one needs in order to pursue chosen ends. Further, realizing a just distribution of income and wealth is not sufficient to ensure a fair distribution of free time. Because of this, anyone concerned with distributive justice must attend to the distribution of free time. On the basis of widely held liberal principles, Rose explains why citizens are entitled to free time—time not committed to meeting life's necessities and instead available for chosen pursuits. The novel argument that the just society must guarantee all citizens their fair share of free time provides principled grounds to address critical policy choices, including work hours regulations, Sunday closing laws, public support for caregiving, and the pursuit of economic growth. Delving into an original topic that touches everyone, Free Time demonstrates why all citizens have, in the words of early labor reformers, a right to "hours for what we will.". (shrink)

This collection of papers investigates the most recent debates about individualism and holism in the philosophy of social science. The debates revolve mainly around two issues: firstly, whether social phenomena exist sui generis and how they relate to individuals. This is the focus of discussions between ontological individualists and ontological holists. Secondly, to what extent social scientific explanations may and should, focus on individuals and social phenomena respectively. This issue is debated amongst methodological holists and methodological individualists. -/- In social (...) science and philosophy, both issues have been intensively discussed and new versions of the dispute have appeared just as new arguments have been advanced. At present, the individualism/holism debate is extremely lively and this book reflects the major positions and perspectives within the debate. Julie K. Ward examines Aristotle's thought regarding how language informs our views of what is real. First she places Aristotle's theory in its historical and philosophical contexts in relation to Plato and Speusippus. Ward then explores Aristotle's theory of language as it is deployed in several works, including Ethics, Topics, Physics, and Metaphysics, so as to consider its relation to dialectical practice and scientific explanation as Aristotle conceived it.

Some interesting exceptions notwithstanding, the traditional logic of economic efficiency has long favored hierarchical forms of organization and disfavored democracy in business. What does the balance of arguments look like, however, when values besides efficient revenue production are brought into the picture? The question is not hypothetical: In recent years, an ever increasing number of corporations have developed and adopted socially responsible behaviors, thereby hybridizing aspects of corporate businesses and social organizations. We argue that the joint pursuit of financial and (...) social objectives warrants significant rethinking of organizational democracy’s merits compared both to hierarchy and to non-democratic alternatives to hierarchy. In making this argument, we draw on an extensive literature review to document the relative lack of substantive discussion of organizational democracy since 1960. And we draw lessons from political theory, suggesting that the success of political democracy in integrating diverse values offers some grounds for asserting parallel virtues in the business case. Encouraged by the financial incentives in the Health Information Technology for Economic and Clinical Health Act of 2009, electronic health record adoption is on the rise. According to a study by the Centers for Disease Control and Prevention published in 2014, 78% of office-based physicians had adopted some type of EHR system, up from 18% in 2001. Implementation of EHRs able to support the Department of Health and Human Services “meaningful use” requirements has also significantly increased since 2010. Such a (...) growth in EHR adoption with the capacity to achieve “meaningful use” standards suggests that the goal of nationwide, interoperable health records is moving closer to a reality.While movement toward a system-wide, interoperable EHR promises benefits of such an electronic information management tool, the risks related to patients’ privacy of their health information remains a concern. Today, a major challenge for climate science is to overcome what is called the “usability gap” between the projections derived from climate models and the needs of the end-users. Regional Climate Models (RCMs) are expected to provide usable information concerning a variety of impacts and for a wide range of end-users. It is often assumed that the development of more accurate, more complex RCMs with higher spatial resolution should bring process understanding and better local projections, thus overcoming the usability gap. (...) In this paper, I rather assume that the credibility of climate information should be pursued together with two other criteria of usability, which are salience and legitimacy. Based on the Swiss climate change scenarios, I study the attempts at meeting the needs of end-users and outline the trade-off modellers and users have to face with respect to the cascade of uncertainty. A conclusion of this paper is that the trade-off between salience and credibility sets the conditions under which RCMs can be deemed adequate for the purposes of addressing the needs of end-users and gearing the communication of the projections toward direct use and action. Most twentieth‐century European philosophers have attempted to think anew the Kantian question about the necessary conditions of experience. A rapid survey of last century's European philosophy would easily show that in spite of the various criticisms formulated against the very project of transcendental foundationalism, the vast majority of the philosophers in the so‐called Continental tradition have not abandoned the project of formulating transcendental arguments altogether. These transcendental inquiries into the conditions of possibility of all these phenomena are certainly more immediately (...) visible in the early works, especially those on Husserl, but a patient reading would show that they are still very much present in the later writings as well. The overcoming of classical transcendentalism at work in deconstruction is indeed the outcome of an ultra‐transcendental strategy. In Of Grammatology, Derrida exposes this ultra‐transcendental logic for the first time when he famously claims that a “pathway” through the transcendental is necessary. (shrink)

Corporate Social Responsibility (CSR) programs are increasingly popular corporate marketing strategies. This paper argues that CSR programs can fall along a continuum between two endpoints: Institutionalized programs and Promotional programs. This classification is based on an exploratory study examining the variance of four responses from the consumer stakeholder group toward these two categories of CSR. Institutionalized CSR programs are argued to be most effective at increasing customer loyalty, enhancing attitude toward the company, and decreasing consumer skepticism. Promotional CSR programs are (...) argued to be more effective at generating purchase intent. Ethical and managerial implications of these preliminary findings are discussed. (shrink)

This book is the most comprehensive and rigourous critique of the ways disciplinary boundaries still inhibit knowledge-production and integration.

My aim in this paper is to determine how Locke understands suspension and the role it plays in his view of human liberty. To this end I, 1) discuss the deficiencies of the first edition version of ‘Of Power’ and why Locke needed to include the ability to suspend in the second edition, then 2) analyze Locke’s definitions of the power to suspend with a focus on his use of the terms ‘source’, ‘hinge’, and ‘inlet’ to describe the power. I (...) determine from these descriptions that the ability to suspend is a passive power and is a necessary condition for the rational deliberation that Locke takes to be necessary for acting as a free agent. In 3) I connect Locke’s view of the power to suspend to his discussion in the sections that precede ‘Of Power.’ I argue that the kind of judgment that Locke endorses in his discussion of the Molyneux problem is also at work in acts of suspension. In 4) I apply my interpretation to Locke’s description of the connection between the power to suspend and liberty. In 5) I conclude with a discussion of a passage from the fifth edition of the Essay. Locke adds this passage to address worries raised by Limborch over the course of their correspondence. According to Chappell, it lends evidence to the view that Locke takes suspensions to be caused by undetermined volitions. (shrink)

In his collection of essays Having the World in View (2009), John McDowell draws a distinction between empirical experience (conceived as the conceptual activity relevant to judgment) and empirical judgment (i.e., the full-fledged assertoric content itself ). McDowell’s latest proposal is that the form of empirical experience is transferable into judgment, but it is not itself a judgment. Taking back the view he advanced in Mind and World, McDowell now believes that perception does not have propositional content as such, but (...) the content of perception can, however, always be actualized in a judgment. There is, in other words, a strict parallelism between the deliverances of sensibility and potential future judgments of experience. The early Husserl disagrees with this and recognizesexplicitly the existence of coherent forms of perceptual engagement with the world that is independent of the mastery of language and the use of concepts.Perception constitutes—together with certain other embodied practices—our primary mode of access to the world, and this occurs before and independently ofour thinking activity. However, the realization of the centrality of time for intentionality will lead Husserl after 1905 to recognize a kind of lawfulness internal tothe sensuous materials themselves, prior to any egoical achievement. The most immediate consequence of this paradigm change is that the very idea of non-conceptual content now seems unwarranted. Indeed, if time is that which keeps the process of sense formation unified even at the lowest levels of constitution, then the world-disclosing activity of the ego cannot be discontinuous with the conceptual realm. Against this background, it will be argued that the dialectic between the conceptual and non-conceptual ultimately makes no sense on a phenomenological basis. Once temporality has entered the scene, the only meaningful opposition that stands is that between the conceptual and pre-conceptual spheres. (shrink)

From the Supreme Court to the bedroom, privacy is an intensely contested interest in our everyday lives and privacy law. Some people appeal to privacy to protect such critical areas as abortion, sexuality, and personal information. Yet, privacy skeptics argue that there is no such thing as a right to privacy. I argue that we cannot abandon the concept of privacy. If we wish to avoid extending this elusive concept to cover too much of our lives or shrinking it to (...) cover too little, we must come to understand it. After exploring the privacy arguments of philosophers and constitutional and tort privacy law, I argue for a new definition of privacy and an explanation of its value that clarifies and resolves many of our conflicts. Privacy is critical because it allows us to protect a realm in which we can have intimate relations with others. (shrink)

In the recent methodological individualism-holism debate on explanation, there has been considerable focus on what reasons methodological holists may advance in support of their position. We believe it is useful to approach the other direction and ask what considerations methodological individualists may in fact offer in favor of their view about explanation. This is the background for the question we pursue in this paper: Why be a methodological individualist? We start out by introducing the methodological individualism-holism debate while distinguishing two (...) forms of methodological individualism: a form that says that individualist explanations are always better than holist accounts and a form that says that providing intervening individualist mechanisms always makes for better explanations than purely holist ones. Next, we consider four lines of reasoning in support of methodological individualism: arguments from causation, from explanatory depth, from agency, and from normativity. We argue that none of them offer convincing reasons in support of the two explanatory versions of individualism we consider. While there may well be occasions in which individualists’ favorite explanations are superior, we find no reason to think this always must be the case. (shrink)

The paper is organized around two ideas that come out in Steve Crowell’s Normativity and Phenomenology in Husserl and Heidegger and that I discuss critically in turn. The first concerns the reach of Crowell’s claim according to which the connection between intentionality, meaning and normativity is necessary in all forms of intentional experience. I make my point by considering the case of imagining experiences, which are—I argue—meaningful, intentional, but not necessarily normative in any relevant sense. The second question is about (...) Crowell’s criticism of the role of bodily self-awareness in Husserl’s phenomenology of perception. While Crowell is right to maintain that the norm of proper functioning relevant to bodily skills can’t be understood as arising from a system of kinaesthetic sensations alone, I argue that bodily self-awareness still has a normative role to play in perception inasmuch as it allows me to cast my own experience in evaluative terms. One issue of dispute between methodological individualists and methodological holists is whether holist explanations are dispensable in the sense that individualist explanations are able to do their explanatory job. Methodological individualists say they are, whereas methodological holists deny this. In the first part of the paper, I discuss Elder-Vass’ version of an influential argument in support of methodological holism, the argument from emergence. I argue that methodological individualists should reject it: The argument relies on a distinction between individualist and holist (...) explanations that they find unacceptable and Elder-Vass’ reasons in support of his way of drawing this distinction are not good ones. In the second part, I examine what, if anything, would be good reasons in support of a particular way of differentiating between individualist and holist explanations. I propose that a good reason is one which shows, in an acceptable manner, that the distinction, drawn in the same way in all contexts, is useful from the perspective of offering explanations of the social world. I show that if this criterion is adopted, it will result in a fruitful reorientation of the whole debate between methodological individualists and methodological holists. (shrink)

The dominant theory of cross-disciplinarity represents multidisciplinarity as ‘lower’ or ‘less interesting’ than interdisciplinarity. In this paper, it is argued that this unfavorable representation of multidisciplinarity is ungrounded because it is an effect of the theory being incomplete. It is also explained that the unfavorable, ungrounded representation of multidisciplinarity is problematic: when someone adopts the dominant theory of cross-disciplinarity, the unfavorable representation supports the development of a preference for interdisciplinarity over multidisciplinarity. However, being ungrounded, the support the representation provides for (...) a preference for interdisciplinarity, is invalid. The issue is even more pressing because research policy makers and funding bodies are among the adopters of the theory, which means that there is a risk of policies reflecting an unjustified preference for interdisciplinarity over multidisciplinarity. This paper presents an improved version of the dominant theory of cross-disciplinarity, obtained by completing the original version with the information it was missing. Because the improved version is more neutral regarding the value of different types of cross-disciplinarity, it is better suited for use by research policy makers and funding bodies. (shrink)

Machine learning methods have recently created high expectations in the climate modelling context in view of addressing climate change, but they are often considered as non-physics-based ‘black boxes’ that may not provide any understanding. However, in many ways, understanding seems indispensable to appropriately evaluate climate models and to build confidence in climate projections. Relying on two case studies, we compare how machine learning and standard statistical techniques affect our ability to understand the climate system. For that purpose, we put five (...) evaluative criteria of understanding to work: intelligibility, representational accuracy, empirical accuracy, coherence with background knowledge, and assessment of the domain of validity. We argue that the two families of methods are part of the same continuum where these various criteria of understanding come in degrees, and that therefore machine learning methods do not necessarily constitute a radical departure from standard statistical tools, as far as understanding is concerned. The topic of professionalism has dominated the content of major academic medicine publications during the past decade and continues to do so. The message of this current wave of professionalism is that medical educators need to be more attentive to the moral sensibilities of trainees, to their interpersonal and affective dimensions, and to their social conscience, all to the end of skilled, humanistic physicians. Urgent calls to address professionalism from such groups as the Association of American Medical Colleges, the American (...) Board of Internal Medicine, and the Accreditation Council for Graduate Medical Education, among others. In fact, at the 2004 annual meeting of the AAMC six separate presentations addressed professionalism with such titles as "Evaluating Humanism and Professionalism," Professionalism: Expectation, Education, Evaluation," or "Toward Assessing Professional Behaviors of Medical Students through Peer Observations". Professionalism, then, has become part of the current academic medicine parlance, used by administrators, clinical faculty, residency programs, and professional organizations with an expectation of shared meanings and goals. All of these stakeholders focus on what has become a consistent list of attributes deemed to be the essence of professionalism, which usually include variations on altruism, duty, excellence, honor and integrity, accountability, and respect. In fact, most of the scholarly work to date has been listing, describing, decrying, and measuring/evaluating it. In this collection of essays, we don’t argue with these attributes. Instead, we ask questions of the discourse from which they arise, how the specialized language of academic medicine disciplines has defined, organized, contained, and made seemingly immutable a group of attitudes, values, and behaviors subsumed under the label "professional" or "professionalism." This collection aims to be a critical text, one that questions the profession’s beliefs about the nature of its work and how such beliefs are enacted in medical education, particularly as they fuel the professionalism discourse. In addition, we will scrutinize how the discourse is enacted in both the formal and hidden curriculum, and in the larger medical environment. (shrink)
