One of the overriding interests of the literature on health care economics is to discover where personal choice in market economies end and corrective government intervention should begin. Our study addresses this question in the context of John Stuart Mill’s utilitarian principle of harm. Our primary objective is to determine whether public policy interventions concerning more than 35,000 online pharmacies worldwide are necessary and efficient compared to traditional market-oriented approaches. Secondly, we seek to determine whether government interference could enhance personal (...) utility maximization, despite its direct and indirect costs on medical e-commerce. This study finds that containing the negative externalities of medical e-commerce provides the most compelling raison d’etre of government interference. It asserts that autonomy and paternalism need not be mutually exclusive, despite their direct and indirect consequences on individual choice and decision-making processes. Valuable insights derived from Mill’s principle should enrich theory-building in health care economics and policy. (shrink)

The mismatch between the demand for, and supply of, health products has led to the increasing involvement of courts worldwide in health promotion and marketing. This study critically examines the implementation of one country’s Milk Code within the framework of the International Code of Marketing of Breast-Milk Substitutes, and the efficacy of the judicial process in balancing corporate marketing and state regulatory objectives. Drawing upon the Philippine experience with its own Milk Code, it evaluates the capacities of courts to determine (...) policy costs and risks against the benefits of delineating and containing corporate marketing strategies for milk substitutes and supplements. The study finds that the methodological and information-based challenges faced by courts in resolving multi-dimensional health issues may not be overcome without serious questions concerning the legitimacy of the judicial process itself. Despite the deficiencies of litigation and adjudication, the study notes the catalytic potential of a judicial decision in opening up vital policy space for future renegotiations among rival parties and interests. In this article we examine the role and ethics of communications in planning for an influenza pandemic. We argue that ethical communication must not only he effective, so that pandemic plans can be successfully implemented, communications should also take specific account of the needs of the disadvantaged, so that they are not further disenfranchised. This will require particular attention to the role of the mainstream media which may disadvantage the vulnerable through misrepresentation and exclusion.

A growing literature testifies to the persistence of place as an incorrigible aspect of human experience, identity, and morality. Place is a common ground for thought and action, a community of experienced particulars that avoids solipsism and universalism. It draws us into the philosophy of the ordinary, into familiarity as a form of knowledge, into the wisdom of proximity. Each of these essays offers a philosophy of place, and reminds us that such philosophies ultimately decide how we make, use, and (...) understand places, whether as accidents, instruments, or fields of care. Our central concern is with the extent to which nations are using communication to address issues of social justice. Issues associated with disadvantage and vulnerability to infection in the event of an influenza pandemic raise (...) distinct questions about how well less well off groups will be protected. The potential for a public health emergency of this type to exacerbate existing inequalities, making those in less well off positions worse off, makes social justice an important consideration for pandemic planners. National PI plans offer insights into the ways that nations may use communication to address issues of disadvantage, thereby providing a way of examining how communication strategies are presented and their potential to mitigate inequities. Our research reviewed 12 national PI plans and assessed the extent to which nations are using communication to assist and limit possible harms to less well off groups. We outline in this paper some important issues and considerations associated with social justice and flu planning, in particular if and how plans are addressing inequalities. Conversational interactions depend on partners making contingent responses. This experiment examined the responses of five chimpanzees, Washoe, Moja, Tatu, Dar and Loulis, to four conversational conditions. Following the chimpanzee’s request, a human interlocutor either: complied with the request, provided an unrequested item or activity, refused to comply or did not respond to the request. The chimpanzees’ responses were contingent on the conversational input of the interlocutor. When their requests were satisfied, the chimpanzees most often ceased signing. However, when their requests (...) were misunderstood, refused or not acknowledged, the chimpanzees repeated and revised. This pattern of responses is comparable to patterns of conversational responses in human children. In lieu of an abstract, here is a brief excerpt of the content:Life as Dialogue:Remembering RogerHarry WellsI first met Roger when we both attended a colloquium on "Buddhist Thought and Culture" at the University of Montevello, Alabama, in April 1988. Roger read a paper that was thoroughly engaging, called "Becoming a Dialogian: How to do Buddhist-Christian Dialogue without Really Trying." At that point, I was hooked on getting to know this funny little man with a British accent who (...) could deliver an excellent reflection without being bothered by his occasional stammering.What struck me about Roger's paper was that it was meant to engage the one who heard it. It was written with a sense of interpretive transparency—a reflection on experience that was his own but also bigger than his own. It was one of those times where in hearing the account of his experience, one found one's own experience mirrored and affirmed. The paper was an autobiographical reflection on his journey into the interior ambiguity of interreligious dialogue, which at times can be very challenging when one tries truly to listen deeply to the visions of two distinct religious traditions. But his life was testament to the integrity of the journey and to an emergent overarching trust, or faith, that something very real and true was being birthed in the midst of it all.In the paper, which I use as an introductory essay for my Interreligious Dialogue course, he delightfully describes his boyhood "conversions" from one religious tradition to another in his own imagination as his pocket money purchases from Penguin Press "brought the world to my front door." One evening he emerges from his bedroom to inform his parents that he had become a Buddhist. "I had been reading all about it, I explained, and it was clear that I was already a Buddhist. It was as if I were remembering something from a past life. 'That's nice dear' commented my mother, 'have you finished your homework yet?' "He goes on to describe his theological studies, and his ever increasing grasp of, and being grasped by, the Eucharistic celebration. But he recounts:I was now in a quandary. Buddhism made sense to me, Meditation worked, and the Four Noble Truths seemed indeed to be true. But, now Christianity also made sense. In the Bible and the Mass some Power greater, more serene, and more loving than any other power I had known, was trying to contact me. Apparently, it was God, the same God, I presumed, that Buddhism denied.I did not know what to do, other than to be loyal somehow or another to what I had discovered, even though what I had discovered was self-contradictory. I always looked forward to hearing Roger speak, because he had a unique way of taking scholarship seriously by not being stuck in the mold of academic presentation. Some of these will be observations; some will be practical inferences. One of them, though, involves the crossing of an expectation, or maybe a fear, I had brought with me to Minneapolis. Since this has to do with the whole tone of the conference, we might as well (...) begin with it.It, of course, was the question of the polemical nature of this gathering. Would this conference be diagnostic and denunciatory in nature, or would it seek to start something truly new? Certainly we all feel the need of something new—not new, either, in the sense that movements or ideological positions claim to be new, but in the sense of a fresh gathering of common attention in the place where literature is, the place where each of us who loves literature already goes alone. This would be a possibility for something original rather than just another novelty—which makes the question of polemics all the more urgent. An association that founded itself in complaint would be only one more identity-group making a virtue out of its grudge. And the grudge, in that case, would have been a sad reflex of feeling superseded and powerless.But where have the polemics against current orthodoxies been? I am delighted not to have heard them in any strenuous capacity. Even their relative absence hasn’t commanded any extended attention, and that may be an even more telling point. I take this to be partly the result of foresight and good sense. But the clean air here has been more than a reward for our mutual constraint. Instead, it seems evidence of the fact [End Page 193] that, when literature occupies our attention, there is no need for self-defense. Justice, or justification, happens by itself when we “do our own work,” as Socrates recommended.What is our own work, then? The morning panel on “Intellectual Craftsmanship” seemed unified in its concern with the disciplined ways by which we commit ourselves to literary experience. Literature itself, as well as what we do with it, teaches us this discipline, which is “aesthetic” in every sense of that word. Roger Shattuck set the tone when he described the discipline of reading as an issue of preparation and assimilation on the one hand, and as a kind of complete perceptual openness on the other. Such openness, in our normal experience, allows us to be surprised, to see actual things, perhaps, instead of their institutional categories. But literature also requires that we craft our receptivity. The surprises we prepare ourselves to undergo are achieved breakthroughs, which makes them no less unpredictable but all the more deeply affecting.Criticism cultivates such surprising experience. (I think experience is the crucial word, by the way, since everyone on that first panel seemed to be devoted to a kind of free empiricism.) The spectacular moments of visionary power that Robert Alter isolated in Dickens are places that startle and disturb us—and we track our own surprise, and intensify it, when we look closely at how those dark places of power emerge from Dickens’s refiguring of a world where darkness otherwise tends toward an entirely unredeemable opacity. We have to read “synesthetically,” as Shattuck says, “with both eyes open,” to let ourselves be for a moment blinded by such literary places.Once again, the discipline of reading—devotedly and resistantly—frees us for the achieved experience. Slowing down, in Sven Birkerts’s sense of “retardation and deceleration,” is precisely a matter of stepping into a field of experience shaped (or, in an auditory sense, fostered and conserved) by the special demands of literature. Roger Bacon’s On the Multiplication of Species is an attempt to analyze efficient causality in terms of forces that are multiplied from agent to patient. This essay argues that this has significant implications for the traditional distinction between appearance and reality in that Bacon refuses to think efficient cause in terms of some other reality that does not appear and yet is the ground of appearance.

I will take David Hall and Roger Ames’s idea of “field and focus”—each unique individual is a unique focus in the communal field—as a central theme of the East Asian way of dealing with the relationship between the community and its constituent members. The pairing of these two concepts suggests the essential mutuality of the communal involvement of every person and the “insistent particularity” of each person. The worth of each individual becomes manifest only if the “egocentered” self yields (...) to the “selfless” self. An East Asian sense of justice thereby acquires the sense of attention to each unique focus (particular individual) in the field (community). Liberty and human rights are thus ineluctably bound up with a sense of communal responsibility. (shrink)

This paper argues for two theses: that degrees of belief are context sensitive; that outright belief is belief to degree 1. The latter thesis is rejected quickly in most discussions of the relationship between credence and belief, but the former thesis undermines the usual reasons for doing so. Furthermore, identifying belief with credence 1 allows nice solutions to a number of problems for the most widely-held view of the relationship between credence and belief, the threshold view. I provide a sketch (...) of a formal framework on which both theses are true. This is a modified Bayesian framework; I argue that despite making credences context-sensitive, the framework lets Bayesians hold on to their signature explanatory successes. The sort of context-sensitivity claimed for credences here mirrors the sort of context-sensitivity I have elsewhere claimed for outright belief: one's credences depend, in part, on the space of alternative possibilities one takes seriously in a context. I treat you as a thermometer when I use your belief states as more or less reliable indicators of the facts. Should I treat myself in a parallel way? Should I think of the outputs of my faculties and yours as like the readings of two thermometers the way a third party would? I explore some of the difficulties in answering these questions. If I am to treat myself as well as others as thermometers in this way, it would appear (...) that I cannot reasonably trust my own convictions over yours unless I have antecedent reason to suppose that I am more likely than you to get things right. I appeal to some probabilistic considerations to suggest that our predicament as thermometers might not actually be as bad as it seems. (shrink)

In an influential recent paper, Hawthorne, Rothschild, and Spectre (“HRS”) argue that belief is weak. More precisely: they argue that the referent of believe in ordinary language is much weaker than epistemologists usually suppose; that one needs very little evidence to be entitled to believe a proposition in this sense; and that the referent of believe in ordinary language just is the ordinary concept of belief. I argue here to the contrary. HRS identify two alleged tests of weakness – the (...) neg-raising and weak upper bounds tests, as I call them – which they claim believe and think pass. But I identify several other expressions in ordinary English for attributing belief, all of which fail both tests. Therefore, even if HRS are correct that believe and think refer to a weak attitude, it does not follow that the ordinary concept of belief is weak. I conclude by raising some problems for the accounts of belief as guessing, building on HRS's arguments, due to Kevin Dorst, Matt Mandelkern, and Ben Holguín. (shrink)

The preface paradox does not show that it can be rational to have inconsistent beliefs, because preface writers do not have inconsistent beliefs. I argue, first, that a fully satisfactory solution to the preface paradox would have it that the preface writer's beliefs are consistent. The case here is on basic intuitive grounds, not the consequence of a theory of rationality or of belief. Second, I point out that there is an independently motivated theory of belief – sensitivism – which (...) allows such a solution.
