In discussions of standards of proof, a familiar perspective often emerges. According to what we call specificationism, standards of proof are legal rules that specify the quantum of evidence required to determine that a litigant’s claim has been proven. In so doing, they allocate the risk of error among litigants (and potential litigants), minimizing the risk of certain types of error. Specificationism is meant as a description of the way the rules actually function. We argue, however, that its claims are (...) either mistaken or at a minimum deeply misleading, especially when it comes to standard of proof rules (SPRs) that contain indeterminate formulas, as is typical. As against specificationism, we argue that SPRs are best understood as rules that confer competence to decide whether a given standard has been met—according to whatever vague or inchoate interpretation (if any) of the rule in question triers of fact implicitly or explicitly employ. Several studies highlight the importance of the order of different instructional methods when designing learning environments. Correct but also erroneous worked examples are frequently used methods to foster students’ learning performance, especially in problem-solving. However, so far no study examined how the order of these example types affects learning. While the expertise reversal effect would suggest presenting correct examples first, the productive failure approach hypothesizes the reversed order to be learning-facilitating. In addition, congruency of subsequent exemplified problems was tested as (...) a moderator of the effect of order on learning. For example, with arithmetic tasks, congruent problems target exactly the same calculation while incongruent problems refer to different calculations. Following cascade theory, a model of cognitive skill acquisition, presenting correct examples first should be more effective when the subsequent exemplified problems are different. To test the hypotheses, 83 university students were assigned to one of the four conditions in a 2 × 2 between-subject design. Learners navigated through a slideshow on the topic of Vedic mathematics consisting of explicit instruction, worked examples differing in terms of the experimental condition, and transfer problems. Although no main or interaction effects were found regarding students’ learning performance, mediational analysis offered support for the expertise reversal effect, as it indicated that there is a significant indirect effect of order via mental load on learning. Presenting correct examples first and erroneous examples second resulted in a lower mental load, which in turn was associated with better learning performance. In contrast, presenting erroneous examples first and correct examples second resulted in a more accurate self-assessment of learning performance. These findings offer first insights into the question of how the presentation order of different example types impacts learning and provide practical recommendations for the design of educational media. Results are discussed in light of the ongoing debate regarding the question if less guided instructional methods should precede or succeed more guided methods. (shrink)

El descubrimiento de Neptuno fue uno de los mayores logros de la astronomía del siglo XIX. Armados con las herramientas del cálculo y con las observaciones del movimiento anómalo de Urano, Adams y Le Verrier determinaron, independientemente, la posible ubicación y masa de un hipotético planeta, lo que llevaría a su descubrimiento observacional. En este artículo me propongo demostrar que los métodos empleados por estos estaban influenciados por el método de análisis y síntesis de Newton. Ante las insistentes críticas del mecanicismo continental que caracterizaban la fuerza gravitacional como una “cualidad oculta” Newton redactó en el “Escolio general” una breve respuesta en la que se afirmaba que la fuerza era real y era suficiente la explicación que había dado de ella en los Principia para sostenerla como tal. Al respecto dos interpretaciones han pretendido explicar cuáles son los aspectos metodológicos y matemáticos de esta respuesta de Newton. Citizen science is growing quickly, given its potential to enhance knowledge coproduction by diverse participants, generating large and global data sets. However, uneven participation in CS is still an important concern. This work aims to understand participation dynamics in CS and how they are shaped by participation barriers and drivers. We do so by examining participation in CONECT-e, a CS project that uses a wiki-like platform to document traditional ecological knowledge. More precisely, we analyze quantitative data on participants’ profile and (...) activity patterns and qualitative data on barriers and drivers of participation. Our findings suggest that overcoming the education, age, and residence participation barriers is challenging even in cocreated CS projects. This is potentially due to issues of perceived self-illegitimacy and low access to information and communication technologies. Our results also point out that participants’ alliance with the project’s objectives and trust relationships with the project team are important drivers of participation in CS projects. Finally, we also highlight the need to think beyond participation as single actions and rather consider participation diversity in CS as functional diversity in ecosystems, with participants performing a diverse set of interconnected tasks or functions. The discovery of Neptune was one of the greatest achievements of nineteenth-century astronomy. Using nothing but calculus and some observations of the Uranus’ anomalous motion, Adams and Le Verrier got to determine, independently, the possible place and mass of a hypothetical planet, which would produce its observational discovery. In this paper I will demonstrate that the methods used by these astronomers were influenced by Newton’s method of analysis and synthesis. Considering this, I will also expose, that some astronomy’s general epistemological (...) principles could be deduced when we consider these investigation methods. (shrink)

We present the resistive switching characteristics of Metal-Insulator-Metal devices based on amorphous Al2O3which is deposited by Atomic Layer Deposition. A maximum processing temperature for this memory device is 300°C, making it ideal for Back-End-of-Line processing. Although some variations in the forming, set, and reset voltages are obtained for many of the measured MIM devices, thememristoreffect has been obtained after cyclicI-Vmeasurements. These resistive transitions in the metal oxide occur for bothbipolarandunipolarconditions, while theIOFF/IONratio is around 4–6 orders of magnitude and is formed (...) at gate voltages ofVg<4 V. In unipolar mode, a gradual reduction inVSETis observed and is related to combined incomplete dissolution of conductive filaments which leaves some residuals and thickening of chemically reduced Al2O3during localized Joule heating. This is important because, by analyzing the macroscopic resistive switching behavior of this MIM structure, we could indirectly relate it to microscopic and/or nanoscopic phenomena responsible for the physical mechanism upon which most of these devices operate. This paper characterizes José Celestino Mutis’ appropriation of Newton in the Viceroyalty of New Granada. First, we examine critically traditional accounts of Mutis’ works highlighting, on the one hand, their inadequacy for directing their claims toward the nineteenth-century independence from Spain and, on the other, for not differentiating between Newtonianism and Enlightenment. Next, we portray Mutis’ complex Newtonianism from his own statements and from printed sources, including a variety of works and translations from British, Dutch, and French authors, in addition (...) to a wide range of Newton’s writings, unusual for an eighteenth-century reader in the Americas. Finally, we analyze a salient claim of Mutis’ Newtonianism in order to depict his appropriation and transformation of Newton’s ideas: the characterization of Newtonian experimental physics as a useful science. ABSTRACT This article interprets a recently recovered manuscript, Tratado de astronomía y la reformaçión del tiempo, composed by Antonio Sánchez in New Granada c.1696, in the context of the Spanish and Renaissance cosmographies. Sánchez’s Tratado proposes a spherical astronomy, in which celestial bodies – including comets — move in orbs containing pyramidal knots that explain the changing speed observed in the motion of planets. From this astronomy and following the peninsular style of repertorios, Sánchez derives two major conclusions: the corrected (...) length of the solar year and a revised birth date of Jesus. Taking as center of reference Vélez, where Sánchez was based, these claims led to conclusions in domains ranging from calendric astronomy to eschatology, including the incorporation of the indigenous peoples into salvation narrative and a demonstration of the arrangement of the celestial orbs at the Last Judgment. Sánchez’s Tratado constitutes an expansion of the Spanish mathematical cosmography that sheds light on the production of knowledge in the Spanish-American world and, at the same time, provides elements to reassess our understanding of the global circulation of Renaissance and early modern ideas. L'obiettivo di questo lavoro è analizzare la percezione che gli insegnanti di scuola secondaria di secondo grado dell’area metropolitana di Bologna (Italia) hanno della storia e del suo insegnamento. Attraverso una ricerca quantitativa svolta attraverso la somministrazione di un questionario su scala Likert a novantanove insegnanti dell’area metropolitana di Bologna si sono potuti identificare risultati ambivalenti. Da una parte, gli insegnanti possiedono generalmente una ottima e spesso consapevole, ma migliorabile, concezione epistemologica nei confronti della storia e del suo insegnamento; tuttavia, (...) emerge una concezione non olistica del patrimonio, degli strumenti e delle metodologie didattiche a disposizione nella pratica docente; infatti gli insegnanti affermano di utilizzare in classe prevalentemente la spiegazione frontale, lasciando alle attività laboratoriali legate alle fonti un ruolo marginale. Ambos pueden encontrarse en otros textos de Reyes escritos entre 1914 y 1924 en Madrid, donde él se había autoexiliado. In “Risk Based Passenger Screening in Aviation Security: Implications and Variants of a New Paradigm”, Sebastian Weydner-Volkmann describes the current paradigm shift from ‘traditional’ forms of screening to ‘risk based passenger screening’ (RBS) in aviation security. This paradigm shift is put in the context of the wider historical development of risk management approaches. Through a discussion of Michel Foucault, Herfried Münkler and Ulrich Beck, Weydner-Volkmann analyses the shortcomings of such approaches in public security policies, which become especially evident in the (...) aviation security context. As he shows, the turn towards methods of RBS can be seen as an attempt to address a trade-off ‘trilemma’ between the effective provision of security, the implied costs for industry and passengers, and the ethical, legal and societal implications of the screening procedures. In order to analyse foreseeable outcomes of embracing RBS, he differentiates three prototypical variants of the new paradigm on the basis of their main referent and rationale. For each variant, he then subsequently assesses the implications for the ‘trilemma’, after having unveiled the criteria of analysis that will necessarily have to be followed within a serious appraisal of RBS methods. We argue that Wittgenstein’s philosophical perspective on Gödel’s most famous theorem is even more radical than has commonly been assumed. Wittgenstein shows in detail that there is no way that the Gödelian construct of a string of signs could be assigned a useful function within (ordinary) mathematics. — The focus is on Appendix III to Part I of Remarks on the Foundations of Mathematics. Meta-ethical expressivism was traditionally seen as the view that normative judgements are not beliefs. Recently, quasi-realists have argued, via a minimalist conception of “belief”, that expressivism is fully compatible with normative judgements being beliefs. This maneuver is successful, however, only if quasi-realists have really offered an expressivist-friendly account of belief that captures all platitudes characterizing belief. But, quasi-realists’ account has a crucial gap, namely how to account for the propositional contents of normative beliefs in an expressivist-friendly manner. In particular, quasi-realists (...) haven’t yet developed their preferred option, a “minimalist” or “deflationist” account of such contents. This paper aims to close that gap. I argue that expressivists who accepts conceptual role semantics and use an account of that-clauses in their use in belief-attributions based on Wilfrid Sellars’ work can give a deflationary account of the contents of beliefs that is compatible with normative judgements being beliefs, even if expressivism is true. Este artículo tiene dos partes, una plantear el tema de la necesidad del diálogo de la Teoría Crítica con la Filosofía de la Liberación, para aunar esfuerzos en la crítica al capitalismo. La otra, ver algunas relaciones que se dieron en el siglo XX con los pensadores de la Escuela de Frankfurt, que las nuevas generaciones tendrían que retomar. Para que esto sea real y también crítico es necesario que el diálogo sea analógico, que se respeten las diferencias.

ABSTRACT:The profound influence of Thomas Donaldson and Thomas Dunfee’s integrative social contracts theory on the field of business ethics has been challenged by Andreas Scherer and Guido Palazzo’s Habermasian approach, which has achieved prominence of late with articles that expressly question the defensibility of ISCT’s hypernorms. This article builds on recent efforts by Donaldson and Scherer to bridge their accounts by providing discursive foundations to the hypernorms at the heart of the ISCT framework. Extending prior literature, we propose an ISCT* (...) framework designed to retain ISCT’s practical virtue of managerial guidance while answering the demands of Scherer and Palazzo’s discursive account. By subscribing to a suitable portfolio of discursively justified hypernorms, we argue, companies unlock the valuable moral guidance of ISCT*, which says to treat these hypernorms as unequivocal outer bounds to the pursuit of business and as a starting point to tailor local norms through discursive stakeholder engagement. Advances in artificial intelligence research allow us to build fairly sophisticated agents: robots and computer programs capable of acting and deciding on their own. These systems raise questions about who is responsible when something goes wrong—when such systems harm or kill humans. In a recent paper, Sven Nyholm has suggested that, because current AI will likely possess what we might call “supervised agency”, the theory of responsibility for individual agency is the wrong place to look for an answer to the (...) question of responsibility. Instead, or so argues Nyholm, because supervised agency is a form of collaborative agency—of acting together—the right place to look is the theory of collaborative responsibility—responsibility in cases of acting together. This paper concedes that current AI will possess supervised agency, but argues that it is nevertheless wrong to think of the relevant human-AI interactions as a form of collaborative agency and, hence, that responsibility in cases of collaborative agency is not the right place to look for the responsibility-grounding relation in human-AI interactions. It also suggests that the right place to look for this responsibility-grounding relation in human-AI interactions is the use of certain sorts of agents as instruments. (shrink)

It has recently been suggested that meta-normative expressivism is best seen as a meta-semantic, rather than a semantic view. One strong motivation for this is that expressivism becomes, thereby, compatible with truth-conditional semantics. While this approach is promising, however, many of its details are still unexplored. One issue that still needs to be explored in particular, is what accounts of propositional contents are open to meta-semantic expressivists. Quasi-realism prominently figures in the expressivist research program. However, many complain that it has become increasingly unclear what exactly quasi-realism involves. This paper offers clarification. It argues that we need to distinguish two distinctive views that might be and have been pursued under the label “quasi-realism”: conciliatory expressivism and quasi-realism properly so-called. Of these, only conciliatory expressivism is a genuinely meta-ethical project, while quasi-realism is a first-order normative view. This paper demonstrates the fruitfulness of these clarifications by using them to (...) address Terence Cuneo’s recent challenge that quasi-realist expressivists lack the resources to plausibly accommodate certain sorts of data points. Vielmehr verweist der Sicherheitsbegriff immer auf ein komplexes Gefüge von Urteils- und Wertungszusammenhängen, die es im situativen Kontext von Mensch-Maschine-Interaktionen zu explizieren gilt.

Functions play an important role in neo-pragmatism. This paper advances neo-pragmatism’s prospects by investigating how functions are to be understood on this account. It argues that prominent ways of understanding functions do not suit neo-pragmatists’ meta-semantic commitments or their preferred methodology. It then presents an account that fits both, based on Laura and François Schroeter’s theory of rationalizing self-interpretation. On this account, a term’s function is what it allows us to do that makes our tradition with the term rational.

Moral responsibility seems to presuppose personal identity. However, there are problems with this view, raised by Derek Parfit’s arguments for the view that personal identity isn’t what matters for our practical concerns. While Parfit discusses moral responsibility only in passing, the problems that arise for the connection between moral responsibility and personal identity have recently been sharpened by David Shoemaker. This paper defends the claim that moral responsibility presupposes personal identity against these problems. It argues, first, that only reductionist views (...) about personal identity have problems with the connection between responsibility and identity, which suggests that personal identity is a non-reductionist concept. Second, it argues that while non-reductionism is problematic, there is a novel view—non-representationalism about personal identity, according to which we account for personal identity in terms of a distinctive non-representational function—that is equally well-positioned to rescue the connection as non-reductionism, without suffering from non-reductionism’s problems. This is an introduction to a Filipino virtue ethics which is a relationship-oriented virtue ethics. The concepts to be discussed are the result of the unique history of the Philippines, namely a Southeast Asian tribal and animist tradition mixed with a Spanish Catholic tradition for over 300 years. Filipino virtue ethics is based on two foundational concepts in Filipino culture. The first is loób, which can easily be misunderstood when literally translated into English as ‘inside’ but which is better translated (...) as ‘relational will’, and the second is kapwa, which is literally translated as ‘other person’ but is better understood as ‘together with the person’. Despite the efforts of meta-ethical expressivists to rebut such worries, one objection raised over and over again against expressivism is that, if the theory is true, matters of morality must be mind-dependent in some objectionable way. This paper develops an argument which not only shows that this is and cannot be the case, but also – and perhaps more importantly – offers a diagnosis why philosophers are nevertheless so often led to think otherwise.

Im Alltag äußern wir nicht nur Aussagen darüber, wie die Welt tatsächlich beschaffen ist, sondern auch darüber, was notwendigerweise oder möglicherweise der Fall ist. Doch worin ist die Wahrheit solcher sogenannten Modalaussagen fundiert? Auf diese Frage gibt Gottfried Wilhelm Leibniz bereits in der Frühen Neuzeit eine höchst interessante Antwort: Für ihn sind modale Wahrheiten im Intellekt Gottes fundiert. Diese Modalitätskonzeption analysiert Sebastian Bender in der vorliegenden Studie auf systematisch informierte Weise. Dabei kommt er zu folgenden Ergebnissen: Erstens vertritt Leibniz, anders (...) als häufig angenommen, eine nicht-reduktionistische Metaphysik der Modalität– Modales wird von ihm also nicht auf etwas Nicht-Modales reduziert. Zweitens ist Leibniz' Theorie der Modalität kombinatorisch geprägt. Drittens repräsentieren mögliche Welten für Leibniz nicht alles metaphysisch Mögliche. Gott kann im Prinzip auch Ansammlungen von Substanzen erschaffen, die keine Welten konstituieren. Viertens schließlich ist das für Leibniz zentrale Prinzip des zureichenden Grundes kontingent und nicht, wie häufig vorausgesetzt, notwendig. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. This paper examines potential predictors of ethical decisions regarding insider trading. An interactionist perspective is taken, in which person variables, situational variables, and the interaction of these two sets of variables are viewed as influencing ethical decisions. The results of our study support such a perspective. Ethical decisions regarding insider trading appear to be a function of a complex set of interacting variables related to both the person and the situation. The implications of these findings are discussed.
