Naturalized metaphysicians defend the thesis that science licenses meta- physics, such that only metaphysical results that are based on the best science are to be considered legitimate. This view is problematic, due to the fact that the reasons they identify for such license are apparently self-defeating. Chakravartty defends a revised approach to understanding the licensing relation. I argue that the proposed response is a step forward on behalf of naturalizing metaphysics, but still does not take seriously the contention that science (...) involves, inextricably, a contribution from the a priori. I argue that current projects in ‘naturalized metaphysics’ fail to be properly naturalistic, and thereby fail in their stated aim to take one’s metaphysics from science. I argue that naturalism must involve the idea of taking science seriously, and that this can only be spelled out in terms of taking not only the theories of science seriously, but also its practice and its socio-linguistic situatedness seriously as well. This accords with naturalism because not doing so draws an artificial (non-natural) distinction (...) between the epistemic products of science as essence, and its socio-linguistic and practical features as accidents. The picture of naturalism which falls out of this is a form of pragmatism. Once this is spelled out, the question becomes, what is the appropriate attitude for the pragmatist/naturalist to have toward ontology? It is not the same as that of traditional metaphysics, since such an attitude (that metaphysical theorizing can make positive epistemic contributions) requires a priori commitments which themselves are (1) not subject to empirical review, and (2) are anthropocentric and so potentially distorted. But the pragmatist/naturalist will not go the opposite way, and say that metaphysics is meaningless either, since (true to their pragmatic commitments) ontology does things for the scientist and the layperson. It is a mistake to reject it wholesale, since the task of asserting what there is, exposing such an ontology to criticism, both empirical and logical, and revising it, has both small-scale and large-scale consequences. On the small-scale, ontologies are a guide for thinking—scientists, engineers, and lay people can and do use models of existence to navigate occurent problems in their day-to-day lives. Whether this is posing research hypotheses, developing protocols for generating new materials, or cooling off a cup of coffee, ontology plays a role. Large-scale consequences are more weighty, and more difficult to see. These large-scale consequences have to do with the aims and values which individuals and societies possess, and their interrelation with ontology. This certainly was at the forefront of the earliest ontologies—the Epicureans and Stoics built their moral philosophy on the basis of what ontology they thought was correct. This sort of practice goes on, unabated, today, though with virtually no overt acknowledgement of this important interdependency. How, for the pragmatist, do we make sense of ontological talk, if we are to eschew traditional metaphysics? Ontology—the naturalist/pragmatist declares—is a tool. Ontology helps us do things, whether it be predict behavior, understand phenomena, blame or forgive someone, and hope or despair about a life after this one (for example). Building an ontology is about building our own concepts, and this, in turn is a negotiation between our beliefs, experiences, and commitments, and the beliefs, experiences, and commitments of with whom we’re discursively engaged. While there is now considerable anxiety about whether the psychological theory presupposed by virtue ethics is empirically sustainable, analogous issues have received little attention in the virtue epistemology literature. This paper argues that virtue epistemology encounters challenges reminiscent of those recently encountered by virtue ethics: just as seemingly trivial variation in context provokes unsettling variation in patterns of moral behavior, trivial variation in context elicits unsettling variation in patterns of cognitive functioning. Insofar as reliability is a condition on epistemic virtue, (...) we have reason to doubt that human beings possess the cognitive materials required for epistemic virtue, and thereby reason to think that virtue epistemology is threatened by skepticism. We conclude that while virtue epistemology has resources for addressing this challenge, exploiting these resources forces tradeoffs between empirical and normative adequacy. (shrink)

A system effect arises when the properties of an aggregate differ from the properties of its members, taken one by one. The failure to recognize system effects leads to fallacies of division and composition, in which the analyst mistakenly assumes that what is true of the aggregate must also be true of the members, or that what is true of the members must also be true of the aggregate. Examples are (1) the fallacious assumption that if the overall constitutional order (...) is to be democratic, each of its component institutions must be democratic, taken one by one; (2) the fallacious assumption that if judges are politically biased, courts will issue politically biased rulings. In these cases and many others I will discuss, system effects are an indispensable analytic tool for legal theory. A systemic approach implies that the choices of legal actors are strategically interdependent: the best course of action for any given actor will depend upon what other actors do. Judges deciding how to interpret statutes and the constitution, for example, cannot simply assume, idealistically, that it would be best for them to adopt the approach that would be best for all if adopted by all. If others do not adopt that approach, then the nature of the best approach for the given judge may itself change, taking others' actions as nonideal constraints. The implication is a second-best approach to constitutionalism and legal interpretation.The judge who takes system effects into account may change her approach in light of the behavior of her colleagues and the behavior of other institutions. Although such a judge is strategic, it does not follow that she is unprincipled. Rather, under identifiable conditions, the systemically-minded judge will be a strategic legalist who attempts to act, within the constraints that arise from others' behavior, so as to nudge the legal system toward the best possible state, according to her view of the law. Indeed, the systemically-minded judge may even be a legal chameleon who changes her approach as the legal environment, including the behavior of other judges, changes around her, until the court as a whole reaches an equilibrium of optimal diversity. Although such a course of action is psychologically demanding, the systemic benefits that the legal chameleon creates can be attained at the systemic level instead. Scholars who deal with Heidegger’s philosophy often remark the scarcity of his references to phenomenological reduction as a means to grant access to the point of view of the being-in-the-world of the Dasein, the central theme of his early philosophy. Also the role of phenomenological reduction in Heidegger’s philosophy makes problem, as he criticizes Husserl for making of reduction a mere tool to reveal a pure, timeless and extra-worldly conscience – an untenable claim, according to Heidegger, for Dasein’s being-in-the-world, as (...) his most original way of being, can never be put out of play by any reduction. This book defends antitheodicism, arguing that theodicies, seeking to excuse God for evil and suffering in the world, fail to ethically acknowledge the victims of suffering. The authors argue for this view using literary and philosophical resources, commencing with Immanuel Kant's 1791 "Theodicy Essay" and its reading of the Book of Job. Three important twentieth century antitheodicist positions are explored, including "Jewish" post-Holocaust ethical antitheodicism, Wittgensteinian antitheodicism exemplified by D.Z. Phillips and pragmatist antitheodicism defended by William James. The authors argue (...) that these approaches to evil and suffering are fundamentally Kantian. 'Thought insertion' in schizophrenia involves somehow experiencing one's own thoughts as someone else's. Some philosophers try to make sense of this by distinguishing between ownership and agency: one still experiences oneself as the owner of an inserted thought but attributes it to another agency. In this paper, we propose that thought insertion involves experiencing thought contents as alien, rather than episodes of thinking. To make our case, we compare thought insertion to certain experiences of 'verbal hallucination' and show that they (...) amount to different descriptions of the same phenomenon: a quasi-perceptual experience of thought content. We add that the agency/ownership distinction is unhelpful here. What requires explanation is not why a person experiences a type of intentional state without the usual sense of agency, but why she experiences herself as the agent of one type of intentional state rather than another. In this first book-length study in English of Kant's legal metaphors and their role in the first Critique, Sofie Møller shows that they are central to Kant's account of reason. Through an analysis of the legal metaphors in their entirety, she demonstrates that Kant conceives of reason as having a structure mirroring that of a legal system in a natural right framework. Her study shows (...) that Kant's aim is to make cognisers become similar to authorized judges within such a system, by proving the legitimacy of the laws and the conditions under which valid judgments can be pronounced. This book integrates pragmatism and transcendental philosophy in examining the most serious problem defining the human condition, death and mortality. Its analysis of human limits and finitude is intended to be relevant to the concerns of philosophers specializing in, for example, transcendental philosophy, philosophical anthropology, pragmatism, Wittgenstein, and the philosophy of religion. Mortality is studied as providing a necessary framework within which questions concerning the meaningfulness or meaninglessness of human life become possible.

This book examines the ideology of elite lawyers and judges from the Gilded Age through the New Deal. Between 1866 and 1937, a coherent outlook shaped the way the American bar understood the sources of law, the role of the courts, and the relationship between law and the larger society. William M. Wiecek explores this outlook--often called "legal orthodoxy" or "classical legal thought"--which assumed that law was apolitical, determinate, objective, and neutral. American classical legal thought was forged in the heat (...) of the social crises that punctuated the late nineteenth century. Fearing labor unions, immigrants, and working people generally, American elites, including those on the bench and bar, sought ways to repress disorder and prevent political majorities from using democratic processes to redistribute wealth and power. Classical legal thought provided a rationale that assured the legitimacy of the extant distribution of society's resources. It enabled the legal suppression of unions and the subordination of workers to management's authority. As the twentieth-century U.S. economy grew in complexity, the antiregulatory, individualistic bias of classical legal thought became more and more distanced from reality. Brittle and dogmatic, legal ideology lost legitimacy in the eyes of both laypeople and ever-larger segments of the bar. It was at last abandoned in the "constitutional revolution of 1937", but--as Wiecek argues in this detailed analysis--nothing has arisen since to replace it as an explanation of what law is and why courts have such broad power in a democratic society. In this paper I discuss Hume’s theory of pride and the ‘remarkable mechanism’ of sympathy. In the first part of the paper I outline the ways in which Hume’s theory can accommodate the sense in which the passions are directed on things or possess intentionality while still holding to his view that passions are simple feelings. In the second part of the paper I consider a problem internal to Hume’s account of pride which arises in his discussion of the love (...) of fame and the functioning of sympathy; I explain how the tensions can be reconciled by recognising that Hume’s theory of sympathy is more nuanced than has commonly been recognized. In the third part I turn back to the evaluation of Hume’s theory of pride and argue that while it is unfair to complain that Hume does not make self-evaluation a central component of pride, Hume’s treatment of the idea of self in his theory of the passions is inadequate because he can make no proper room for the phenomenon of vicarious pride. Danielle Wenner has crafted novel arguments in defense of republican accounts of freedom. I learned a lot from her discussion of how Philip Pettit's neorepublican account of freedom as nondomination does a better job than standard accounts of freedom as noninterference of explaining how power over an agent can restrict their freedom to act autonomously. The real crux of Wenner's argument, however, is that freedom as nondomination can do this work in a way that those who defend an account of (...) relational autonomy cannot. I will start with Wenner's defense of freedom as nondomination and of what it can do as the background for assessing her critique of relational autonomy.
