There are two things about Siewert's project that worry me. First, it's not clear to me that by taking Siewert's first-person approach, we can come to grasp what he means by 'consciousness'. And second, even if we are able to come to grasp what he means by this term, it's not clear to me that all the "consciousness-neglectful theoreticians of mind" - for example, Dennett, Rosenthal, and Tye - have failed to give an account of the property which Siewert's term (...) picks out. For nearly a decade, David Rosenthal has proposed that a mental state M of a creature C is conscious just in case C has a suitable higher-order thought directed toward M. While this theory has had its share of criticism in recent years, I believe that the real difficulties have been ignored. In this essay, I show that the presence of a higher order is insufficient for conscious experience, even if we suppose that the thought satisfies the constraints that Rosenthal (...) lists . The only way Rosenthal's view could possibly yield sufficient conditions is by requiring that the higher-order thought be suitably causally related to its object. Yet, as I also show, the only causal constraint strong enough to do the job is not only ill-motivated but probably false. (shrink)

Abrams, Rosenthal, and Strevens have recently presented interpretations of the objective probabilities posited by some scientific theories that build on von Kries’s idea of identifying probabilities with ranges of values in a space of possible states. These interpretations face a problem, forcefully pointed out by Rosenthal, about how to determine ‘input probabilities.’ I argue here that Abrams’s and Strevens’s attempts to solve this problem do not succeed. I also argue that the problem can be solved by recognizing the possibility of (...) laws of nature that manifest themselves not as universal regularities, but instead as constraints on relative frequencies. The article will attempt to show that Velasquez's Las Meninas can be viewed as an allegorical enactment of some of the current debates and controversies in the philosophy of cognition and self-representation. I will focus on two very different philosophical trajectories, to which the allegory of the painting can be linked. The first, analytic, trajectory relates Las Meninas to the notion of representation and self-representation in the work of philosophers David Rosenthal, Robert Van Gulick, Uriah Kriegel and Bruce Mangan, (...) and neurologists Bernie Baars and Rodolfo Llinas. The second, continental, trajectory begins by relating to the painting Merleau-Ponty's phenomenological 'embodied self-representation'. This trajectory, which can be further linked to John Ziman's 'second person view' of reality, proceeds to relate Las Meninas to Lacan's 'object gaze' and the 'unbearable fragility of representation', ending with Bataille's (non)concept of 'sovereignty' as essential yet non-representable losses in representation. I will conclude by suggesting that the evolution of the cognitive state experienced by an observer of Las Meninas can be viewed as an 'ontogenetic' recapitulation of the more 'phylogenic' progression of the philosophical history of representation and self-representation alluded to by the canvas. The 'playful affirmation', as Uziel Awret calls it, turns into a joyful affirmation of a theoretical challenge in a philosophical space set up by the many questions concerning the nature of consciousness. This is especially because the 'Las Meninas and the search for self-representation' (Awret, this volume) has been written in the spirit of an interplay between different modes and approaches, and also the different philosophical traditions, for dealing with the 'enigma' it presents. Bringing Velasquez's Las Meninas into the bigger (...) picture of consciousness studies means a change in methodological perspective. Not only does it support the idea so dear to the tradition of phenomenology and philosophical hermeneutics of claiming back the truth value for the experience of work of art, but the author also succeeds in showing the relevance of this 'truth' to recent theoretical approaches to problems of representationalism and self-representation (like those of David Rosenthal, Robert Van Gulick, Bruce Mangan and Uriah Kriegel, for example). The United States Army’s Future Combat Systems Project, which aims to manufacture a “robot army” to be ready for deployment by 2012, is only the latest and most dramatic example of military interest in the use of artificially intelligent systems in modern warfare. This paper considers the ethics of a decision to send artificially intelligent robots into war, by asking who we should hold responsible when an autonomous weapon system is involved in an atrocity of the sort that would normally (...) be described as a war crime. A number of possible loci of responsibility for robot war crimes are canvassed; the persons who designed or programmed the system, the commanding officer who ordered its use, the machine itself. I argue that in fact none of these are ultimately satisfactory. Yet it is a necessary condition for fighting a just war, under the principle of jus in bellum, that someone can be justly held responsible for deaths that occur in the course of the war. As this condition cannot be met in relation to deaths caused by an autonomous weapon system it would therefore be unethical to deploy such systems in warfare. (shrink)

Consciousness and Mind presents David Rosenthal's influential work on the nature of consciousness. Central to that work is Rosenthal's higher-order-thought theory of consciousness, according to which a sensation, thought, or other mental state is conscious if one has a higher-order thought that one is in that state. The first four essays develop various aspects of that theory. The next three essays present Rosenthal's homomorphism theory of mental qualities and qualitative consciousness, and show how that theory fits with and helps sustain (...) the HOT theory. A crucial feature of homomorphism theory is that it individuates and taxonomizes mental qualities independently of the way we're conscious of them, and indeed independently of our being conscious of them at all. So the theory accommodates the qualitative character not only of conscious sensations and perceptions, but also of those which fall outside our stream of consciousness. Rosenthal argues that, because this account of mental qualities makes no appeal to consciousness, it enables us to dispel such traditional quandaries as the alleged conceivability of undetectable quality inversion, and to disarm various apparent obstacles to explaining qualitative consciousness and understanding its nature. Six further essays build on the HOT theory to explain various important features of consciousness, among them the complex connections that hold in humans between consciousness and speech, the self-interpretative aspect of consciousness, and the compelling sense we have that consciousness is unified. Two of the essays, one an extended treatment of homomorphism theory, appear here for the first time. This collection of new essays on the systematic thought and intellectual legacy of the American philosopher Wilfrid Sellars (1912–1989) comes at a time when Sellars’s influence on contemporary debates about mind, meaning, knowledge, and metaphysics has never been greater. Sellars was among the most important philosophers of the twentieth century, and many of his central ideas have become philosophical stock-in-trade: for example, his conceptions of the ‘myth of the given’, the ‘logical space of reasons’, and the ‘clash’ between the ‘manifest (...) and scientific images of man-in-the-world’. This volume of well-known contemporary philosophers who have been strongly influenced by Sellars – Robert Brandom, Willem deVries, Robert Kraut, Rebecca Kukla, Mark Lance, John McDowell, Ruth Millikan, James O’Shea, David Rosenthal, Johanna Seibt, and Michael Williams – critically examines the groundbreaking ideas by means of which Sellars sought to integrate our thought, perception, and rational agency within a naturalistic outlook on reality. Topics include Sellars’s inferentialist semantics and normative functionalist view of the mind; his attempted reconciliations of internalist and externalist aspects of thought, meaning, and knowledge; his novel nominalist account of abstract entities; and a speculative ‘pure process’ metaphysics of consciousness. Robert Alexy develops his influential theory of legal reasoning exploring the nature of legal argumentation and its relation to practical reasoning. In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

Nozick argues, in “Anarchy, State, and Utopia”, correctly I think, that we can go from an equal distribution of wealth to an unequal one through just means. Nozick then asks: If people voluntarily move from a just distribution of wealth, D1, to a different distribution, D2, “isn’t D2 also just?” While Nozick thinks the new distribution of wealth, D2, is just, I think that it is at least possible to go from a just state of affairs to an un-just state (...) of affairs by just means. I then argue that any unequal distribution of wealth can not maximize the good derived from wealth. Therefore, on the basis of plausible utilitarian ideas, any distribution of wealth that isn’t at least roughly equal is un-just, even it was arrived at by just means from aa equal and just distribution of wealth. At the heart of this book is the age-old question of how law and morality are related. The legal positivist, insisting on the separation of the two, explicates the concept of law independently of morality. The author challenges this view, arguing that there are, first, conceptually necessary connections between law and morality and, second, normative reasons for including moral elements in the concept of law. While the conceptual argument alone is too limited to establish a sufficiently strong connection between law (...) and morality, and the normative argument alone fails to address the nature of law, the two arguments together support a nonpositivistic concept of law, toppling legal positivism qua comprehensive theory of law. In this context, it mostly denotes a digital substitute for a real object or process. Virtual reality is perhaps the best-known term in this respect. With these digital (...) connotations, “virtuality” has also been used in science and research: Chemists use virtual laboratories, biologists do virtual scanning of molecular structures, and geologists engage in virtual field trips. But the concept of the virtual has a much longer tradition, dating back to long before the dawn of the digital age. Virtual images and virtual displacements were introduced in classical physics already in the late seventeenth and eighteenth centuries, respectively. They represent auxiliary objects or processes without instantiation, with the purpose of efficiently describing specific physical systems. In today’s physics, the term “virtual” is mostly associated with the quantum world, first and foremost with the “virtual particle” of quantum field theory. It has become such an integral part of modern high energy physics that its ontological character may be considered to go beyond the purely auxiliary, which is typically associated with the virtual. What has led scientists to call one entity “virtual” and not another? Do all virtual entities in science have the same roots and meet the same characteristics? Are they more than auxiliary objects or processes? Why does physics seem to occupy a specific position with respect to the use of the notion of virtuality? These are some points that led us to discuss virtual entities in science during a workshop, out of which grew the present collection. We invited contributions that addressed the historical formation and philosophical interpretation of concepts of virtual entities in physics and other disciplines—in whatever terms they may come. This study of the political philosophy of William Ernest Hocking be gan as a doctoral dissertation at Tulane University. Hocking (1873- 1966) was for many years Alford Professor of Natural Religion, Moral Philosophy, and Civil Polity at Harvard University. Although he is relatively well-known among American philosophers, particularly by students of metaphysics and the philosophy of religion, very little atten tion has been given to his political philosophy. Some general studies of his thought summarize his political writings in a very (...) cursory fashion, but they do not discuss his contributions in detail or relate them to significant issues in political philosophy. Most important general works on modern political philosophy or American political thought do not even mention Hocking; a few note his name in passing. Because he is almost completely unknown in the social sciences, the original purpose of this study was to explore, systematize, and present his extensive writings in political philosophy. It then became apparent that his entire political philosophy is oriented around the concepts of liberty and community. When his thought is analyzed in terms of these themes, its unity and coherence are more obvious. Moreover, his writings become more significant when they are related to liberty and community, for these are focal concepts for important problems in modern political philosophy. This study of Hocking's political philosophy will, it is hoped, help us to see how liberty and community can be more understandable, attainable, and compatible with one another. (shrink)

Solomon's thesis is that we are significantly responsible for our emotions, which are evaluative judgments that in effect we choose. There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. According to the necessity thesis, the legitimacy of proportionality analysis is (...) a question of the nature of constitutional rights, according to the contingency thesis, it is a question of interpretation. The author's thesis is that there is a conceptually necessary connection between law and morality which means legal positivism must fail as a comprehensive theory. The substantiation of this thesis takes place within a conceptual framework which shows that there are at least 64 theses to be distinguished, concerning the relationship of law and morality. The basis for the author's argument in favour of a necessary connection, is formed by the thesis that individual legal norms and decisions as well as (...) whole legal systems necessarily make a claim to correctness. The explication of this claim within the frame of discourse theory shows that the law has a conceptually necessary, ideal dimension, which connects law with a procedural, universalistic morality.
