The Metaphysics of Experience styles itself as "a Sherpa guide to Process and Reality, whose function is to assist the serious reader in grasping the meaning of the text and to prevent falls into misinterpretation." Although originally published in 1925, Process and Reality has perhaps even more relevance to the contemporary scene in physics, biology, psychology, and the social sciences than it had in the mid-twenties. Hence its internal difficulty, its quasi-inaccessibility, is all the more tragic, since, unlike most (...) metaphysical endeavors, it is capable of interpretating and unifying theories in the above sciences in terms of an organic world view, instead of selecting one theory as the paradigm and reducing all others to it. KrausIntroductionThe personal stories submitted by physicians and researchers for this symposium add much–needed dimension to conversations on conflicts of interest in medicine and research. Narratives from individuals living with conflicts of interest can serve as a unique lens through which to consider psychological and economic theories and survey data on (...) physician and patient views. In our reading of these personal narratives, we identified four primary themes that will serve as springboards for our commentary. We aim to triangulate clusters of meaning drawn from the narratives with relevant data from published empirical studies and identify gaps in knowledge where more research is needed. These themes are: the unique environments of medicine and research; weighing the potential benefits of conflicts of interest against the risks; conflict of interest management; and the roles and responsibilities of diverse stakeholder groups.The Unique Challenges of the Medical and Research EnvironmentsThe reflections of the narrative authors draw attention to many of the unique environmental aspects of medicine and medical research that make physicians and researchers especially vulnerable to conflicts of interest. Conflicts of interest may be more ubiquitous in medicine than in any other industry (Kassirer, 2006). As the narratives demonstrate, conflicts of interest emerge across a range of health care delivery and research activities. Surveys have shown that 94 percent of physicians have some kind of relationship with industry (Campbell, Gruen, Mountford, et al., 2007). There is also evidence that physician interactions with medical industry begin early and are a regular part of a physician’s professional practice along the career continuum (Wazana, 2000).Medicine as a profession is distinct from banking or law. It is often said that medicine is an art; in treating patients, creative individualized solutions and gut instinct are as (if not more) important than the application of scientific knowledge. Uncertainty surrounds medical decision making. There is limited precision with respect to diagnoses and prognoses, limited data regarding the effectiveness of many treatments, and a range of patient values and preferences. Because of this uncertainty, rules about practice standards, especially with respect to avoidance and management of conflicts of interest, cannot be as explicit as they are in law or business. As demonstrated by the story presented by Sal Cruz–Flores, research and practice often intersect. And, there is no system in greater need of reform—and no system about which there are more divergent opinions as to what shape that reform should take—than the United States health care [End Page 91] system. The narratives of Tony Mikulec, Govind Nagaldinne, and David M. Zientek demonstrate how various aspects of the structure of healthcare service provision and third–party payer arrangements have the potential to harm patients. Conflicts of interest comprise more than relationships with pharmaceutical and medical device manufacturers.The narratives of Laura Jean Bierut and David M. Zientek also discuss examples of conflicts of interest that arise from factors beyond relationships with industry or the direct potential for financial gain. This may be somewhat unique to the medical milieu. Non-financial conflicts such as a desire for the prestige bestowed upon scientists who make key discoveries, a requirement to publish for tenure and promotion, the need to maintain one’s license or other privileges, or simply the pressure of a competitive environment can influence physician and researcher behavior. As noted by Bierut, more research on how to identify and manage non-financial conflicts is needed.The Potential Benefits and Harms of Conflicts of InterestConflicts of interest are usually presented in a negative light, particularly those that involve physician relationships with the pharmaceutical industry. To “have a conflict of interest” is to be in a situation or role where there is potential for personal interests to be prioritized over professional responsibilities. However, in terms of public perception, it seems that conflicts of interest have become almost synonymous with wrongdoing. Perhaps this is due to the barrage of media reports during the last decade on significant harms caused by financial conflicts of interest in business, journalism, and sports as well as in medicine (Steinbrook, 2004). This paper discusses the role of Law and Legal Thinking in Critical Theory with specific reference to the arguments that Michael Hardt and Antonio Negri offer in their book Commonwealth. The core idea is that Critical Theory is no less radical, but much more concrete, when it is performing not only an external, but also an internal critique of the Law. It shows that the role of the law in critical theory emerges as a (...) problem when the latter claims that ‘there is no outside’ and that ‘the legal base of the system structures our lives.’ It then discusses optimistic and pessimistic strategies to overcome the problem, and argue for a demanding strategy which consist in articulating the external and the internal critique of the law. To make this point, the paper goes back to the epistemic context in which critical attitudes are deployed (the ‘Conflict of the Faculties’), describes the four theoretical moves constitutive of the historical moment in which, at the end of the 18th Century, modern law as we know it was conceived of and founded; and sketches the key moments of the history of the internal critique of the law. It then illustrates the demanding strategy with examples taken from the field of Intellectual Property, and concludes that the Law is malleable and open enough to allow the thinking and practicing of radical alternatives from within the legal system and also that alternatives spoken in the language of the law are no less radical, but certainly, more concrete than others. Explanatory economic analysis of the common law has long been subject to deep philosophical skepticism for two reasons. First, common law decisions appear to be cast in the language of deontic morality, not the consequentialist language of efficiency. For this reason, philosophers have claimed that explanatory economic analysis cannot satisfy the transparency criterion, which holds that a legal theory's explanation must provide a plausible account of the relationship between the reasoning it claims judges actually use to decide cases and (...) the express reasoning judges provide in their opinions. Philosophers have doubted that the economic analysis has a plausible account of why judges would use deontic moral terms to explain cases they decide using consequentialist economic reasoning, arguing instead that only a deontic moral account of judicial reasoning can be squared with the judicial use of deontic moral language. Second, the common law has a bilateral structure, in which a plaintiff's right to recover and a defendant's duty to compensate are treated as correlative. Philosophers have observed that this structure seems custom tailored to retrospective moral rights adjudication and ill suited to prospective efficient regulation. Recently, two philosophers, Jules L. Coleman and Stephen A. Smith, have developed these ideas into a full-scale assault on the explanatory credentials of the economic analysis. I defend the economic analysis by arguing that the bilateral structure of the common law either constitutes a "second best" approach to providing incentives for efficient behavior, as economic analysts have maintained, or that it is the vestigial remnant of the common law's originally deontic conception. I also claim that the economic analysis satisfies the transparency criterion by arguing that terms with a deontic plain meaning have acquired a consequentialist contextual meaning within the common law. Although this "contextualist convergence" thesis is counterintuitive, I build on Coleman's semantic theory to explain how it is possible. To demonstrate that it is plausible as well, I argue that evolutionary forces would have naturally led to this result over the course of the common law's development. In particular, I claim that the substantial indeterminacy of deontic moral theory, and the superior determinacy of the economic analysis, explains why judges would be intuitively attracted to reasoning that is best reconstructed in economic terms, notwithstanding the superior normative force of deontic moral theory. Thus, the core of my defense of explanatory economic analysis is that its critics overlook the central theoretical and practical role determinacy plays in explanation and justification generally, and in the explanation of judicial reasoning in particular, where determinacy is prized, if not above all else, no less than any other virtue. In this paper we discuss some questions proposed by Prof. Newton da Costa on the foundations of quasi-set theory. His main doubts concern the possibility of a reasonable semantical understanding of the theory, mainly due to the fact that identity and difference do not apply to some entities of the theory’s intended domain of discourse. According to him, the quantifiers employed in the theory, when understood in the usual way, rely on the assumption that identity applies (...) to all entities in the domain of discourse. Inspired by his provocation, we suggest that, using some ideas presented by da Costa himself in his seminars at UFSC and by one of us in some papers, these difficulties can be overcome both on a formal level and on an informal level, showing how quantification over items for which identity does not make sense can be understood without presupposing a semantics based on a ‘classical’ set theory. ROBERT CAPONIGRI THE HUMANISMOf Giovanni Gentile has gradually come to be recognized as one of the major speculative achievements of our time. The great strength and appeal of this position lie chiefly in the manner in which it meets the exigencies of the modem analysis of man and human existence while retaining the basic classical insights of (...) western thought. It achieves a synthesis which possesses at once historical, speculative, and cultural value and which rectifies many of the unilateral analyses so much in evidence. At the same time, serious limitations have been alleged to mar the Gentilean view of man. The most important of these allegations concerns the notion most intimately associated with the humanism of the west: the person. Strangely, it has been charged that the humanism of Gentile not only fails to develop an adequate concept of the person but directly involves the diminution and constriction of this concept as it has developed historically and influenced the western view of man. His, it is asserted, is a humanism without the person, which is but a small remove from the paradoxical assertion that it is a humanism without man? In many ways this charge is most perplexing. Were it correct, it would certainly have the limiting and constrictive effects his critics have pointed out. The real perplexity resides, however, not in spelling out the probable consequences of the allegation, but in determining how it might ever have arisen and gained such credence and championship. The fact is that nothing could be further from Gentile's intention and (what is more important) more alien to the burden of his text than the least diminution of the person. On the contrary, the person constitutes the central and pivotal notion of the entire structure of Gentilean humanism. This article reinterprets Hegel’s much discussed “failure” to theorize a remedy for the poverty that disrupts modern society. I argue that Hegel does not offer any solution to the problem of poverty because, in his view, the sovereign state depends upon the persistence of poverty. Whereas a state’s achievement of external sovereignty requires the presence of another state, its achievement of internal sovereignty requires the presence of a different, internal other. This role is played by the impoverished and (...) rebellious “rabble,” which opposes the state’s unity and stability. Ethical life cannot eliminate poverty because poverty, and the insecurity that it engenders, are dialectical conditions of the state’s highest development. This interpretation reveals a critical dimension to Hegel’s political philosophy, insofar as the state’s promise of actualized freedom can only be sustained in relation to a mass of internal “outsiders” to whom that freedom does not extend. End-of-life decision-making in patients with dementia is a complex topic. Belgium and the Netherlands have been at the forefront of legislative advancement and progressive societal changes concerning the perspectives toward physician-assisted death (PAD). Careful consideration of clinical and social aspects is essential during the end-of-life decision-making process in patients with dementia. Geriatric assent provides the physician, the patient and his family the opportunity to end life with dignity. Unbearable suffering, decisional competence, and awareness of memory deficits are among the clinical (...) considerations that physicians should incorporate during the end-of-life decision-making process. However, as other societies introduce legislature granting the right of PAD, new social determinants should be considered; Mexico City is an example. Current perspectives regarding advance euthanasia directives (AED) and PAD in patients with dementia are evolving. A new perspective that hinges on the role of the family and geriatric assent should help culturally heterogeneous societies in the transition of their public health care policies regarding end-of-life choices. It is supposed that any scientific theory (here we consider physical theories only) has an underlying logic, even if it is not made explicit. The role of the underlying logic of a theory T is mainly to guide the proofs and the accepted consequences of the theory’s principles, usually described by its axioms. In this sense, the theorems of the underlying logic are also theorems of the theory. In most cases, if pressed, the scientist will (...) say that the underlying logic of most physical theories is classical logic or some fragment of a set theory suitable for accommodating the theory’s mathematical and logical concepts. We argue that no physical theory and no philosophical discussion on the basis of the theory should dismiss its underlying logic, so the arguments advanced by some philosophers of physics in that certain entities (the considered case deals with quantum entities) can be only weakly discerned or be just ‘relationals’ and that they cannot be absolutely identified by a monadic property, are fallacious if one remains within a ‘standard’ logico-mathematical framework, grounded on classical logic. We also discuss the claim that some properties (as those that came from logic) would be ‘illegitimate’ for discerning these entities is not justifiable. Thus, this paper may be interesting for logicians, physicists, and philosophers. (shrink)

In his classic monograph, The Death of Contract, Grant Gilmore argued that Christopher Columbus Langdell, Oliver Wendell Holmes, and Samuel Williston trumped up the legal credentials for their classical bargain theory of contract law. Gilmore's analysis has been subjected to extensive criticism, but its specific, sustained, and fundamental charge that the bargain theory was based on a fraudulent misrepresentation of precedential authority has never been questioned. In this Essay, I argue that Gilmore's case against the classical theorists rests (...) on the suppressed premise that the precedential authority of cases resides in the express judicial reasoning used to decide them. In contrast, I argue that the classical theorists implicitly presuppose that the precedential authority of cases consists in the best theory that explains their outcomes, even if that theory is inconsistent with the case's express judicial reasoning. The classical view of precedential authority completely defuses Gilmore's charge of fraud. In Gilmore's view, merely demonstrating the inconsistency between the proposition for which the classical theorists cited a case and the express reasoning in that case suffices as proof of misrepresentation. But in the classical theorists' view, the express reasoning in a case is simply a theory of its precedential authority, which, like any theory, can be wrong. Thus, the classical theorists simply reject Gilmore's claim that a case cannot properly be cited for a proposition inconsistent with its express reasoning. The real dispute, then, between Gilmore and the classical theorists is over the nature of precedential authority and not the content of contract law. Having reframed the classic death-of-contract debate, I then trace these competing conceptions of precedential authority through the major schools of contemporary contract theory. I argue that a contract theory's embrace of one view instead of the other can be explained by the relative priority it accords to each of the two components in a conception of adjudicative legitimacy. A conception of adjudicative legitimacy consists in a theory of what it means for a decision to be based on law and a theory of what is required for law to be justified. I explain why theories according priority to the former tend to subscribe to the precedents-as-outcomes view, while theories according priority to the latter tend to favor the express reasoning view. The Essay concludes by arguing that the economic analysis of contract law subscribes to the precedents-as-outcomes view and therefore is the contemporary jurisprudential successor to the late nineteenth-century classical theorists. In lieu of an abstract, here is a brief excerpt of the content:372 THE ROLE OF REASON IN HUME'S THEORY OF BELIEF Much has been written on Hume's theory of belief, yet problems of interpretation remain as serious as ever. The most pervasive and persistent problem relates to the role reason plays in Hume's conception of belief. When Hume says that belief is a matter of feeling, does he mean to say that reason has nothing (...) to do with it, or that belief is not a matter of choice? Does he imply that one cannot be blamed for believing as one does? The view that belief is unavoidable and not a matter of choice, and its implication, seem counter-intuitive, if not drastic. Are there grounds for attributing such a view to Hume? There is indeed a tendency to interpret Hume as saying that reason plays no role, not just in the moral sphere, but in the understanding as well. Thus, Barry Stroud claims that "in Hume's hands the denigration of the role of reason and the corresponding elevation of feeling and sentiment is generalized into a total theory of man." Elsewhere I have argued against this view insofar as it relates 2 to Hume's moral theory. But the dismay at Hume's (alleged) denigration of reason is even greater in the case of belief. For instance, Antony Flew considers Hume's view that belief is "a species of natural instincts, which no reason or process of the thought and understanding is able either to produce or to prevent" as a "drastic and disastrous conclusion." According to Flew, one drastic and disastrous consequence of such a view is that "insofar as belief really is necessary and unavoidable we can neither criticize others for the irrationality of their convictions nor retain any 4 confidence about the rationality of our own." 373 In a more sympathetic reading of Hume, J. A. Passmore has cited evidence to show that Hume acknowledges that belief can be a matter of choice, 5 and thus there can be an ethics of belief. However, in doing so Passmore presents an inconsistency in Hume's view of belief, and does nothing to account for this inconsistency. Barbara Winters also sees inconsistencies, or paradoxes, in Hume's treatment, not only within Book I of the Treatise, but also between it and the other two Books (and between the Enquiries). Her resolution of the paradox is the suggestion that there are two conceptions of reason in Hume, the "traditional" and the "naturalistic," the former "plays no role in our acquisition of fundamental beliefs," and the latter is such that we do indeed "arrive at our beliefs through reasoning." In this paper I wish to argue that there are no inconsistencies, or paradoxes, in Hume's treatment of belief, and that his view is neither drastic nor disastrous. I wish to show that there is no 'denigration' of reason, " and that while belief is a matter of feeling, it is also, to an important degree, a matter of choice. In promoting the "undoubted truth, that belief is nothing but a peculiar feeling," Hume does write in such a way as to encourage the interpretation that he subordinates the role of reason to feelings (or sentiments, or passions), or worse, that he denigrates the role of reason. He tells us that belief is not "some new idea, such as that of reality or existence, which we join to the simple conception of an object" (T 623). If it were, "it wou'd be in a man's power to believe what he 374 pleas 'd" (T 624), as the mind can mix or join any two ideas. Hume tells us that we can easily "discover by experiments" that belief "arises immediately, without any new operation of the reason or imagination" (T 102). The widely quoted sentence is the following: "When the mind... passes from the idea or impression of one object to the idea or belief of another, it is not determin'd by reason..." (T 92). In this book, I will discuss three main topics: the roots and aims of scientific knowledge, scientific knowledge in society, and science and values I understand scientific knowledge as being a planned and continuous production of the general and common knowledge of scientific communities. I begin my discussion with a brief analysis of the main differences between sciences, on the one hand, and everyday experience, philosophies, religions, and ideologies, on the other. I define the concept of science as a set (...) of family resemblances (in Wittgenstein's sense). The sciences can be distinguished along three lines, in terms of the difference between empirical and non-empirical sciences, differences in degrees of theoretical and methodological structure among individual sciences and scientific disciplines. Scientific knowledge is based upon some grounds, paradigmatic knowledge bases. Scientific knowledge is founded on a unified paradigmatic knowledge base. The latter includes fundamental theories, basic facts, generally accepted empirical regularities (laws), scientific research methods, scientific explanations, and established relations to other sciences. Scientific knowledge in general is defined well in classical terms by the definition that knowledge is a true and rationally-justified belief. In this connection, scientific truth is relative, depending on the given paradigmatic knowledge base and on the precision and accessibility of the measurements and observations involved. In the book's first part, I consider the production and testing of scientific hypotheses, scientific explanations, the structure of scientific theories, and the problem of scientific realism. I consider explanation an integral part of a wider nexus of heuristic and theoretical activities in science like giving reasons, understanding, clarification, and founding. Continuous production of scientific explanations is a necessary condition for the systematic reproduction of scientific knowledge. Accordingly, it does not suffice to describe them in terms of the logical structure of the arguments on which they are based, but rather, scientific explanations ought to be given complete with an epistemic and pragmatic context of the explanation. I consider especially deductive-nomological, inductive-statistical, dispositional, teleological-functional, and genetic explanations. I emphasize the ever-increasing importance of explanations by analogy and by model. Orthogonal to these distinctions lies the distinction between causal and epistemic explanation. Epistemic explanations relate scientific discoveries to epistemic progress, and causal explanations are these epistemic explanations that relate scientific discoveries to reality too. Causal explanations inform us that certain changes occur in the world as agents of other changes, or rather, that certain changes are real consequences of other changes. Thus, by having explanations of causes, we can intervene in the world to induce by design certain changes in some course of phenomena. I consider scientific theories as logically and epistemically ordered wholeness of scientific knowledge in a realm of research that enables us to construct useful models of reality. After the discussion of different 'statement' views on theories and different interpretations of the theory-experience relation, I introduce the 'model' theoretical (non-statement) views on theories, especially the structural theory of science. The model views on theories transcend the realism-antirealism dualism by introducing models between theory and reality. Therefore, the question of scientific realism is not merely whether and, if so, which element(s), of scientific theories represent reality, but rather which conditions suffice to infer from a theory that one of its models truly expresses reality. In other words, under which conditions do models of a theory represent models of reality? Generally, models are just as much images of reality in a theory as they are images of a theory in reality. The actual problem of scientific realism doesn't originate in the observable-unobservable distinction (even if this distinction is otherwise theoretically loaded), but rather in ontological quandaries, of the sort especially encountered in modern physical theories such as quantum mechanics, relativity theory, and cosmological theories, although they are known to arise in other sciences as well. Scientific theories may be real, even if they describe nothing about the world. However, such theories can be given this status only if their formal, mathematical postulates exhibit some formal homology between reality and mathematical forms. The very fact that it is possible to describe reality with the help of mathematics even in cases, where every (representational, conceptual) language and thought fall short, would indicate that even mathematics itself is, in some sense, a part of reality, although 'outside' of the empirical world. It follows we have to distinguish the non-empirical reality and the empirical world. Formal objectivity and non-arbitrariness of theories do not emerge from either our language or thoughts, or from the world of facts, causes, and effects, but rather from non-empirical reality, which frames the world as some kind of objective transcendental condition for the possibility of the existence of the world, thoughts, and language. In the second part of the book, I consider the incorporation of scientific work and scientific knowledge into modern society and its relations to values and ethics. Production of scientific knowledge goes on as a parallel distributed process of a special kind of social (shared) cognition. The central part of this cognition is the presentation of parts of the world by scientific (theoretical) models which are warranted by the shared and public practice of justification, and in reflective acting in the world as it would. I consider various formal concepts of collective propositional knowledge (distributed, mutual, common knowledge). Scientific knowledge is an achievement to be ascribed to a scientific community or, indirectly, to all those who apply or expand it, rather than to individuals per se. It presents the continuous and partially planned production of non-trivial common knowledge of the research communities in modern societies. However, besides common knowledge, shared dispositional knowledge (knowledge how of scientific teams) and shared knowledge by acquiring (knowledge of fundamental similarities and differences in scientific teams) are parts of the real body of scientific knowledge. Scientific common knowledge implies the projection into idealized universal knowledge of all real or potentially rational and well-informed individuals. The respect of scientific knowledge thus presents the norm of rationality. Science as the intensively shared and socially distributed kind of cognition enters into modern society as a special kind of work (general work), as a productive force (social invention drive), and as a form of capital (human, social, cultural, informational, etc.). However any of these categories can adequately represent the socio-economical role of science in modern societies, and we are still waiting for a more adequate general concept that would theoretically cover the 'scientification' of modern societies. My thesis is that the most important general effect of scientification is (and will be) the growth of social processes that structurally resemble parallel distributed shared social cognition of science, and not so much the rise of the use of scientific knowledge and scientifically based information in all kinds of production. Scientification of modern societies inevitably includes a much stronger need for moral and social responsibility of scientists for their work and its effects in their local society and the global world. This need comes in contradiction with the quite large accepted idea (and even the 'norm') on value-free research. I discuss to some degree different arguments for the absence of non-epistemic values and ethical reasoning from science and find them non-convincing. The sound idea of value-free research lies in the need for the absence of categorical value statements from scientific explanations and theoretical deductions. Values and ethical judgment have, and sometimes they even have to play an important role in another part of research and its application in science or outside it. Not the value-loudness of research is a danger for science but its blind, non-reflective use. It leads to the ideologization and politicization of science. A similar danger lies in the purely value-neutrality of research. It leads to the instrumentalization of science to the technical or bureaucratic means for 'any' aims. (shrink)

Schrödinger logics are logical systems in which the principle of identity is not true in general. The intuitive motivation for these logics is both Erwin Schrödinger's thesis (which has been advanced by other authors) that identity lacks sense for elementary particles of modern physics, and the way which physicists deal with this concept; normally, they understandidentity as meaningindistinguishability (agreemment with respect to attributes). Observing that these concepts are equivalent in classical logic and mathematics, which underly the usual physical theories, we (...) present a higher-order logical system in which these concepts are systematically separated. A classical semantics for the system is presented and some philosophical related questions are mentioned. One of the main characteristics of our system is that Leibniz' Principle of the Identity of Indiscernibles cannot be derived. This fact is in accordance with some authors who maintain that quantum mechanics violates this principle. Furthermore, our system may be viewed as a way of making sense some of Schrödinger's logical intuitions about the nature of elementary particles. (shrink)

Rare copy number variants have a prominent role in the aetiology of schizophrenia and other neuropsychiatric disorders. Substantial risk for schizophrenia is conferred by large CNVs at several loci, including microdeletions at 1q21.1, 3q29, 15q13.3 and 22q11.2 and microduplication at 16p11.2. However, these CNVs collectively account for a small fraction of cases, and the relevant genes and neurobiological mechanisms are not well understood. Here we performed a large two-stage genome-wide scan of rare CNVs and report the significant association of (...) copy number gains at chromosome 7q36.3 with schizophrenia. Microduplications with variable breakpoints occurred within a 362-kilobase region and were detected in 29 of 8,290 patients versus 2 of 7,431 controls in the combined sample. All duplications overlapped or were located within 89 kilobases upstream of the vasoactive intestinal peptide receptor gene VIPR2. VIPR2 transcription and cyclic-AMP signalling were significantly increased in cultured lymphocytes from patients with microduplications of 7q36.3. These findings implicate altered vasoactive intestinal peptide signalling in the pathogenesis of schizophrenia and indicate the VPAC2 receptor as a potential target for the development of new antipsychotic drugs. © 2011 Macmillan Publishers Limited. Much debate has occurred as to whether or not moral responsibility should be ascribed to corporate entities. The present study advances the theory that moral responsibility is a self-imposed or attributable aspect of corporate operations which extends beyond the parameters established by law.In this context, the corporation must consciously endeavor to discharge its moral responsibility to avoid, minimize, eliminate and compensate for the potential or actual harm which its operations cause. To achieve this objective, consideration is given to (...) the establishment of a Moral Audit Committee, an internal monitoring mechanism, with a proposed generic structure. The corporate Mission Statement and Code of Ethics play a vital role as well in building an institutional environment which supports this self-appraisal process. With this system in place, the ambit of a Moral Audit is then examined. This study concludes with a case analysis, which partly depicts the Moral Audit process. (shrink)

Augustine was aware of objections to the idea of educational progress, and nowhere is this more acute than in his treatment of academic skepticism. While much attention has been paid to Augustine’s theory of knowledge within the Contra Academicos, too often overlooked is the specifically moral significance that he attaches to the skeptic’s critique of knowledge. I argue that Augustine’s chief criticism in this dialogue is not directed against an erroneous epistemology, although he does provide a refutation (...) of that. Rather, itis against the disastrous educational and moral implications that follow from the skeptic’s views. Along the way I show how this interpretation helps to explain some of the novel structural features of the dialogue and allows us more securely to situate its argument against Augustine’s other key early reflections on the limits of knowledge. This article aims to serve as an introductory discussion of the European Continental tradition of pedagogics, specifically from a North American perspective. It begins with an overview of the Continental tradition and its main figures. Here, we find a philosophical and, thus, language-sensitive attitude toward the human, the child; and a specific pedagogical terminology, i.e., descriptions and interpretations about the reality of education, such as educational practices, goals, norms, and organizational forms of educational institutions. John Dewey's educational theories exemplify the (...) North American perspective on Continental pedagogics and its study of the fundamental nature of knowledge, reality, and existence. Dewey's writings diverge notably from this tradition, as he integrated into his work American pragmatism and an interest in the scientific method, an interest that plays a role in today's policy trends in the United States and elsewhere. Then again, Dewey took a critical stand toward instrumentalizing pedagogics for political aims. On this point, the German-born political philosopher Hannah Arendt agreed with him. As Arendt can be seen as an example of a Continental perspective on philosophy that includes a strong warning to separate politics and education, she relates to Dewey's argument against instrumentalization. Thus, this article also features some of her work. The overall intention is to contribute to a renewal of a language for pedagogics by delineating a historical-philosophical perspective on this specific field of professional practice. (shrink)

In this article, I discuss education in a time in the history when the human impact on Earth is massive and pervasive, with devastating consequences on the conditions for life. Within various academic fields, this era is increasingly distinguished as the Anthropocene. The term highlights the new, dominant position of the human species in Earth’s history, but is contentious, hiding as much as it reveals. Humanity is surely not one, but many, participating in a complex web of relations (...) constituted by other species and the material world. Moreover, the Anthropocene is also a time of global corporate capitalism, when the magnitude and the consequences of human activities are unequally distributed among humans and more-than humans alike. The ethical and political dimensions involved in this determine the reflections in this article. Specifically, I examine Wolfgang Klafki’s educational theory as an expression of and a response to the Anthropocene. Klafki is a salient contributor to the rethinking of North European general didactics in the 20th century, in which Bildung, formations of the self, plays a key role. In Klafki’s later works, epochal key problems are integrated in his concept of Bildung, addressing environmental crisis, social inequity, and threats to peace on Earth, in a global outlook that transcends Bildung’s traditionally national scope. At the same time, Klafki’s educational response expresses an anthropocentric outlook, which calls for rethinking. In such a rethinking I suggest to see the mediating element of the common, crucial in Klafki’s Bildung theory, not as limited to human interests but as including concerns for life on Earth, and to conceive of historical situatedness as an aspect of the commonality of Bildung. Patients with psychotic disorders experience a range of reality distortions. These often include auditory-verbal hallucinations, and thought insertion to a lesser degree; however, their mechanisms and relationships between each other remain largely elusive. Here we attempt to establish a integrative model drawing from the phenomenology of both AVHs and TI and argue that they in fact can be seen as ‘spectra’ of experiences with varying degrees of agency and ownership, with ‘silent and internal own thoughts’ on one extreme and ‘fully (...) external and clearly audible voices’ in the absence of a speaker on the other. We believe a spectral model will add emphasis to the continuity of experience and help to better understand how one type of psychotic symptom may interact with another, and put forward the argument that the experience of TI itself is not sufficient to classify as a delusion. In addition we aim to discuss some of the conceptual issues surrounding AVHs and TI with first-person accounts and current philosophical and neuropsychological theories in mind. We propose that the mechanisms behind AVHs and TI are more complex than source-monitoring deficits; indeed, to understand such phenomena one must appreciate that their very ‘existence’ and ‘reality’ as experienced by the individual have much deeper implications and meaning, both philosophically and clinically. Based on the extended conceptualization of corporate citizenship, as provided by Matten and Crane :166–179, 2005), this paper examines the new role of corporations in society. Taking the ideas of Matten and Crane one step further, we argue that the status of corporations as citizens is not solely defined by their factual engagement in the provision of citizenship rights to others. By analysing political and sociological citizenship theories, we show that such engagement is more adequately explained by a change (...) in the self-conception of corporate citizens from corporate bourgeois to corporate citoyens. While the corporate bourgeois acts primarily for private business purposes, the corporate citoyen engages in society, performing civil and political rights and duties. As an intermediate actor in society, shaped by the principle of subsidiary task-sharing, the corporate citoyen undertakes co-responsibility for social and civic affairs and actively collaborates with fellow citizens below, beside and beyond governmental regulation. Prompted by contemporary discussions in philosophy of mind, the authors of this volume make a turn to the past, to Descartes and to two of his successors, Hume and Berkeley. The rationale for this turn lies in the authors’ view that philosophy is essentially problem solving and that Descartes is the inaugurator of a still-unsolved problem. Descartes’s primary epistemological concern—the problem he wants to solve—is “how we get information from and about the external world, given the new theories of science”. (...) The theory of ideas found especially in the Meditations is his attempt at a solution, an attempt that the Hausmans contend is useful today. Yet their historical turn has a nonhistorical core, for they contend that the problem itself has a logic that escapes the context of its origin. Guided by the “logic of the problem,” the authors select passages from the Meditations and from “Comments on a Certain Broadsheet” in order to put together an option neglected in current studies: a semantic doctrine of innate ideas. Thus the authors return to the origin of a problem not to understand the origin, but to work out a solution that is timely. They focus on portions of a text in abstraction from the whole writing in which they occur, an omission that is not so much of historical, as of philosophical consequence. They never question their understanding of philosophy, which is heir to that consciously founded by Descartes. (shrink)

The idea that legal theories seek not only to explain but to evaluate the moral justification of particular areas of law is quite familiar. Yet little attention has been paid to the minimal criteria of adequacy for justificatory legal theories. Whereas many theories claim to identify the moral grounds that justify a particular area of law, such as contracts or torts, none of them explains how its justification determines the outcomes of adjudication governed by the law in that area. In (...) this brief Essay for the William and Mary Law Review Symposium on Law and Morality, I argue that a particular area of law can be justified only by identifying moral reasons that fully determine the results of adjudication. No matter how compelling the moral reasons a legal theory identifies, and how tight the fit between those reasons and the structure and content of the legal rules governing a judicial decision, a legal theory fails to justify a particular area of law if the reasoning it identifies falls short of fully determining the results in the judicial decisions governed by that law. Though this bold claim may seem unrealistic, I argue that legal theories can satisfy this determinacy requirement by identifying determinate but inconclusive reasoning that explains outcomes in adjudication. While such reasoning may prove to be erroneous, that does not undermine its justificatory force. (shrink)

BackgroundReducing the number of animals used in experiments has become a priority for the governments of many countries. For these reductions to occur, animal-free alternatives must be made more available and, crucially, must be embraced by researchers.MethodsWe conducted an international online survey for academics in the field of animal science (N = 367) to explore researchers’ attitudes towards the implementation of animal-free innovations. Through this survey, we address three key questions. The first question is whether scientists who use animals (...) in their research consider governmental goals for animal-free innovations achievable and whether they would support such goals. Secondly, responders were asked to rank the importance of ten roadblocks that could hamper the implementation of animal-free innovations. Finally, responders were asked whether they would migrate (either themselves or their research) if increased animal research regulations in their country of residence restricted their research.ResultsWhile nearly half (40%) of the responders support governmental goals, the majority (71%) of researchers did not consider such goals achievable in their field within the near future. In terms of roadblocks for implementation of animal-free methods, ~ 80% of the responders considered ‘reliability’ as important, making it the most highly ranked roadblock. However, all other roadblocks were reported by most responders as somewhat important, suggesting that they must also be considered when addressing animal-free innovations. Importantly, a majority reported that they would consider migration to another country in response to a restrictive animal research policy. Thus, governments must consider the risk of researchers migrating to other institutes, states or countries, leading to a ‘brain-drain’ if policies are too strict or suitable animal-free alternatives are not available.ConclusionOur findings suggest that development and implementation of animal-free innovations are hampered by multiple factors. We outline three pillars concerning education, governmental influence and data sharing, the implementation of which may help to overcome these roadblocks to animal-free innovations. (shrink)

Determinist thought with its sui generis view on life, nature and being as a whole is a point of view that could be observed in many different cultures and beliefs. It was thanks to Greek thought that it ceased to be a cultural element and transformed into a systematic cosmology. Schools such as Leucippos, then Democritos and Stoa attempted to integrate the determinist philosophy into ontology and cosmology. In the course of time, physics and metaphysics-based determinism approaches were introduced, and (...) a wide spectrum has emerged from genetics to behaviorism, from culture to psychology, from atomism to divinity. Determinism, whether physical or metaphysical origin, ignores freedom of will and deny agency competence over human behavior. Due to this feature, it is opposed by ethical theories, legal philosophies and religions. When the arguments for determinism are possible to disprove logically and philosophically, this is not so easy when the claims base themselves on scientific base. As the logical consequence of this novel fact, it is important to question the epistemological value of scientific knowledge and critically analyze the data of experiments and clinical studies in terms of methodology when answering any hypothesis such as neuro-biological, neuro-psychological, or neuro-theological argumentations. On the other hand, it is necessary to reach alternative experiments on the same subject or to show that it is possible to interpret them in different ways, as in the example of the Libet experiment. The neurobiological determinism based on biological reductionism, emerged as the result of ignoring the ontological difference of the mind, equating the mind with the brain, or defining mentality as an epiphenomenon of the brain. The main divergence stems from the acceptance of materialist philosophy. Paradigms that reduce existence only to matter do not take the metaphysical possibilities into account. In this case, although the problems called qualia or subjective experience stand there unresolved, the claim is preserved. Although many new developments such as the discovery of the entropy law, the big bang theory, and quantum physics have shaken the materialist philosophy, modern science resists an epistemological revision. However, with the current epistemology, it does not seem possible to grasp both the universe and the being as a whole. This is the most important reason why every attempt to understand the nature and spiritual side of human beings fails despite numerous experiments on the brain. However, the human brain is an organ that seems sophisticated and its secrets cannot be easily solved. Since there is not enough information about the brain, there is not enough evidence to claim that the brain, and therefore the mind, are part of the deterministic universe. Increasing brain researches since the last quarter of the twentieth century has revealed that genes, neurons and particularly brain chemistry claim much greater role than expected in human behavior. These results have been instrumentalized by some researchers for a radical claim that free will is an illusion, while by others it has led to the acceptance of will as less important over actions than was thought. Both ideas adopted a model of biological determinism in which freedom of will was ignored. Hypotheses based on controversial interpretations of various experiments raised concerns about religious, moral, and legal responsibility. Although man cannot be thought of as a non-free being from the point of view of common sense, the smog screen over the truth would not be lifted unless the scientific data in question had a correct interpretation. At first glance, it seems unreasonable to discuss universal determinism in the quantum universe. Nevertheless, the claim that strong causality prevails in the material world, including consciousness, remains in place. Therefore, firstly criticizing determinism and then examining biological determinism will help to fix the conceptual framework. This article aims to explain why genetics and neurobiology, while acknowledging their importance in the realization of behavior, can’t completely abolish moral agency. Some hypotheses attribute consciousness and free will to the physico-shimic structure of the brain, the random activity of neurons, or the ability to automatically transform inputs into outputs with the advantage of genetic information. This is the most sensitive and important point of being human; it attacks free will. Paradoxically, while global civilization of our time promises infinite freedom to human beings the science of the same age tries to prove that it is not free. (shrink)

Introduction Reza Davari Ardakni, the Iranian contemporary philosopher, distinguishes development from Western modernity; in that it considers modernity as natural and organic changes that Europe has gone through, but sees development as a planned design for implementing modernity in other countries. As a result, the closedness of development concerns only the developing countries, not Western modern ones. Davari emphasizes that the Western modernity has a universality that pertains to a unique reason and a unified world. The only way of thinking (...) in this world is a philosophical thought based on human self-centered reason, and given the pervasiveness of Western civilization. Therefore, Davari does not consider Westernization as mere imitation of Western customs and methods, but rather as a way of existence in the world. Westernization is a subjective view of the world and beings. Westernization is not optional, enabling non-Western people to avoid it. According to the Westernization scenario, the world today is entirely Westernized, and Davari considers Westernization as the inevitable fate of the people of this era, seeing two alternatives for them, both of which ultimately lead to the same destination, which is to embrace development; either they seize the power of science and technology and join the process of global modernization and participate in it, or they become subdued by this process and accept it without participation. Davari regards the first type of Westernization as active and the second type as passive. Problematique Therefore, underdevelopment is not a concept of the ancient world, nor even of a world between the ancient and the modern, or on the threshold of modernization. Underdevelopment is a condition of suspension and timelessness and being exposed to modernization. To escape the paradox of underdevelopment, which is the inevitable historical fate of non-modernized societies, Davari sees no way out other than embracing development. In other words, Westernized societies, which have become confused due to modernization, have no escape route other than turning to development. Therefore, some critics of Davari accuse the theory of Westernization of being a theoretical rupture. M. T. Tabatabaei, by rejecting the theoretical rupture in the theory of Westernization, believes that in the argument of Davari, we are only faced with a shift from a philosophical to an intellectual level. Tabatabaei, by avoiding providing a philosophical response to the critics of the theoretical rupture, believes that the introduction of active Westernization and collaboration in science and technology as a solution to escape from underdevelopment conditions, is only a shift from a philosophical level to an intellectual level and does not involve a rupture. Therefore, it seems that the philosophical issue of how or the possibility of escaping from underdevelopment conditions is still an open non answered problem. In this study, seeking a philosophical answer to this problem, an attempt has been made to summarize Davari's definitions of development, underdevelopment, participation in the world of science, and the role of humanities and social sciences in development, using his writings and speeches. It is proposed that a way to escape from the clesedness of development based on Davari's views, is to make use of analytical method with emphasizing on concepts and theories of the philosophy and metaphysics of science. Argument According to Davari, the social and human sciences that are responsible for development planning in underdeveloped societies must consider the characteristics of underdevelopment in order to facilitate the transition to more favorable conditions. Davari identifies the following conditions for successful development: 1) replacing tradition with science as the organizing and coordinating principle in society, 2) recognizing the universality of philosophy and science of the Western modernity and the impossibility of blindly imitation and adopting it, 3) inevitability of actively engaging and interacting with development, 4) recognizing the internal dynamics of scientific progress and avoiding authoritarian control, and 5) promoting free participation in the scientific paradigms. Therefore, Davari suggests the following steps towards development: 1) recognizing and understanding the problems of society and the local ecosystem, 2) understanding the philosophical and cultural foundations of Western civilization, 3) understanding the historical context and paradigms of science, 4) understanding the philosophical and metaphysical foundations of science, 5) recognizing the intellectual and philosophical capacities of our own community, and 6) reflecting our own philosophical and metaphysical assumptions in the scientific world in a way that is compatible with scientific methods. Given the motivations for change in science at both the global and national levels, including the emergence of heterodox or indigenous sciences, and the inevitable nature of development, Davari points to the possibility of a path between absolute rejecting or accepting the mainstream social and human sciences. However, this path is challenging and contingent upon the aforementioned conditions and steps of transition. Conclusion It is necessary to seek this path within the realm of the philosophy and metaphysics of science, particularly in the origins and foundations of the social and human sciences. Research in the metaphysics and philosophy of the social sciences provides the opportunity for active scientific engagement in the scientific paradigms and a reconsideration of the foundations of science, allowing for different philosophical foundations while are compatible with scientific methods. Successfully finding a path between absolute rejecting or accepting the existing social sciences will lead to an internal transformation within the field of science and, in fact, will advance the boundaries of knowledge. Therefore, it is possible, while adhering to the conditions of transition and actively participating in the world of science and technology, and accepting the unity of modernity and avoiding selectivity and imitation, to search for a way to overcome the closedness of development through a reconsideration of the philosophical and metaphysical foundations of science, while recognizing our own intellectual heritage and critically assessing Western science and technology. In this basically expository paper we discuss the role of logic and mathematics in researches concerning the ontology of scientific theories, and we consider the particular case of quantum mechanics. We argue that systems of logic in general, and classical logic in particular, may contribute substantially with the ontology of any theory that has this logic in its base. In the case of quantum mechanics, however, from the point of view of philosophical discussions concerning identity and individuality, those (...) contributions may not be welcome for a specific interpretation, and an alternative system of logic perhaps could be used instead of a classical system. In this sense, we argue that the logic and ontology of a scientific theory may be seen as mutually influencing each other. On the one hand, logic contributes to shape the general features of the ontology of a theory; on the other hand, the theory also puts constraints on the possible understanding of ontology and, respectively, on possible systems of logic that may be the underlying logic of the theory. The study aimed to identify the role of administrative procedures and systems in enhancing the performance of the educational institutions in the Islamic University in Gaza. To achieve the research objectives, the researchers used the analytical descriptive approach to collect information. The researchers used the questionnaire distributed to three categories of employees at the Islamic University (senior management, faculty members, their assistants and members of the administrative board). A random sample of 314 employees was selected and 276 questionnaires were (...) retrieved with a recovery rate of 88.1%. The Statistical Analysis Program (SPSS) was used to enter process and analyze data. The results of the research showed a positive role for the administrative procedures and systems in enhancing the performance of the Islamic University from the point of view of the members (senior management, teaching staff and their assistants and the administrative body), where the relative weight of all the paragraphs (73.728%). The analysis of the results revealed that the administrative procedures at the Islamic University in Gaza are used to an acceptable degree. The relative weight of all the paragraphs is 70%. This indicates a relationship between administrative procedures and regulations and the performance of the Islamic University in the Gaza Strip. The study found that there was a good degree of approval from the sample regarding the administrative procedures and their relationship to the job performance. There exist a sufficient degree of powers to the deans and department managers to carry out their tasks, with the use of plans as control tools. And that there are rules and procedures provided for decision-making in the University Council. It also has full powers to manage the university to improve the teaching and learning environment. The researchers also recommended a number of recommendations, including the need to follow up on the procedures and systems of management and update them continuously in the light of changes that may occur and to ensure the existence of a strong system of electronic information systems within the university. There is a need to provide mechanisms for obtaining information about the surrounding external environment, and effective mechanisms to provide managers with the necessary information in a timely manner. The importance of providing channels of communication that enables staff to communicate information about any violations and breaches. The study also recommended the follow-up, review, procedures and administrative systems, and work to modify them in line with the mission of the university and the objectives that the university seeks to reach. The INBIOSA project brings together a group of experts across many disciplines who believe that science requires a revolutionary transformative step in order to address many of the vexing challenges presented by the world. It is INBIOSA’s purpose to enable the focused collaboration of an interdisciplinary community of original thinkers. This paper sets out the case for support for this effort. The focus of the transformative research program proposal is biology-centric. We admit that biology to date has been more fact-oriented (...) and less theoretical than physics. However, the key leverageable idea is that careful extension of the science of living systems can be more effectively applied to some of our most vexing modern problems than the prevailing scheme, derived from abstractions in physics. While these have some universal application and demonstrate computational advantages, they are not theoretically mandated for the living. A new set of mathematical abstractions derived from biology can now be similarly extended. This is made possible by leveraging new formal tools to understand abstraction and enable computability. [The latter has a much expanded meaning in our context from the one known and used in computer science and biology today, that is "by rote algorithmic means", since it is not known if a living system is computable in this sense (Mossio et al., 2009).] Two major challenges constitute the effort. The first challenge is to design an original general system of abstractions within the biological domain. The initial issue is descriptive leading to the explanatory. There has not yet been a serious formal examination of the abstractions of the biological domain. What is used today is an amalgam; much is inherited from physics (via the bridging abstractions of chemistry) and there are many new abstractions from advances in mathematics (incentivized by the need for more capable computational analyses). Interspersed are abstractions, concepts and underlying assumptions “native” to biology and distinct from the mechanical language of physics and computation as we know them. A pressing agenda should be to single out the most concrete and at the same time the most fundamental process-units in biology and to recruit them into the descriptive domain. Therefore, the first challenge is to build a coherent formal system of abstractions and operations that is truly native to living systems. Nothing will be thrown away, but many common methods will be philosophically recast, just as in physics relativity subsumed and reinterpreted Newtonian mechanics. -/- This step is required because we need a comprehensible, formal system to apply in many domains. Emphasis should be placed on the distinction between multi-perspective analysis and synthesis and on what could be the basic terms or tools needed. The second challenge is relatively simple: the actual application of this set of biology-centric ways and means to cross-disciplinary problems. In its early stages, this will seem to be a “new science”. This White Paper sets out the case of continuing support of Information and Communication Technology (ICT) for transformative research in biology and information processing centered on paradigm changes in the epistemological, ontological, mathematical and computational bases of the science of living systems. Today, curiously, living systems cannot be said to be anything more than dissipative structures organized internally by genetic information. There is not anything substantially different from abiotic systems other than the empirical nature of their robustness. We believe that there are other new and unique properties and patterns comprehensible at this bio-logical level. The report lays out a fundamental set of approaches to articulate these properties and patterns, and is composed as follows. -/- Sections 1 through 4 (preamble, introduction, motivation and major biomathematical problems) are incipient. Section 5 describes the issues affecting Integral Biomathics and Section 6 -- the aspects of the Grand Challenge we face with this project. Section 7 contemplates the effort to formalize a General Theory of Living Systems (GTLS) from what we have today. The goal is to have a formal system, equivalent to that which exists in the physics community. Here we define how to perceive the role of time in biology. Section 8 describes the initial efforts to apply this general theory of living systems in many domains, with special emphasis on crossdisciplinary problems and multiple domains spanning both “hard” and “soft” sciences. The expected result is a coherent collection of integrated mathematical techniques. Section 9 discusses the first two test cases, project proposals, of our approach. They are designed to demonstrate the ability of our approach to address “wicked problems” which span across physics, chemistry, biology, societies and societal dynamics. The solutions require integrated measurable results at multiple levels known as “grand challenges” to existing methods. Finally, Section 10 adheres to an appeal for action, advocating the necessity for further long-term support of the INBIOSA program. -/- The report is concluded with preliminary non-exclusive list of challenging research themes to address, as well as required administrative actions. Evolutionary psychology and human sociobiology often reject the mere possibility of symbolic causality. Conversely, theories in which symbolic causality plays a central role tend to be both anti-nativist and anti-evolutionary. This article sketches how these apparent scientific rivals can be reconciled in the study of disgust. First, we argue that there are no good philosophical or evolutionary reasons to assume that symbolic causality is impossible. Then, we examine to what extent symbolic causality can be part of the theoretical toolbox (...) of the evolutionary social sciences. This examination leads to the conclusion that it is possible to make evolutionary sense of Mary Douglas’s theory of disgust, and that her view of symbolic causality can and should inform evolutionary theories of (sociocultural) disgust. According to the semantic view, a theory is characterized by a class of models. In this paper, we examine critically some of the assumptions that underlie this approach. First, we recall that models are models of something. Thus we cannot leave completely aside the axiomatization of the theories under consideration, nor can we ignore the metamathematics used to elaborate these models, for changes in the metamathematics often impose restrictions on the resulting models. Second, based on a parallel between van (...) Fraassen’s modal interpretation of quantum mechanics and Skolem’s relativism regarding set-theoretic concepts, we introduce a distinction between relative and absolute concepts in the context of the models of a scientific theory. And we discuss the significance of that distinction. Finally, by focusing on contemporary particle physics, we raise the question: since there is no general accepted unification of the parts of the standard model (namely, QED and QCD), we have no theory, in the usual sense of the term. This poses a difficulty: if there is no theory, how can we speak of its models? What are the latter models of? We conclude by noting that it is unclear that the semantic view can be applied to contemporary physical theories. (shrink)

: It has been said that Kant's critical philosophy made it impossible to pursue either the Cartesian rationalist or the Lockean empiricist program of providing a foundation for the sciences (e.g., Guyer 1992). This claim does not hold true for much of nineteenth century French philosophy, especially the eclectic spiritualist tradition that begins with Victor Cousin (1792-1867) and Pierre Maine de Biran (1766-1824) and continues through Paul Janet (1823-99). This tradition assimilated Kant's transcendental apperception of the unity of experience (...) to Descartes's cogito. They then took this to be the method of a philosophical psychology that reveals the active self as substance or cause and thus provides the epistemological grounding for these categories. However, to dismiss these philosophers as simply confused or mistaken would be to overlook the historical role that their interpretations of Kant played in the subsequent development of philosophy and the social sciences in France. Specifically, Émile Durkheim's (1858-1917) sociological theory of the categories was deeply influenced by the eclectic spiritualist tradition and yet at the same time developed in reaction to it, as he thought that its psychological account of the categories failed to bring out their shared or universal character and the extent to which our conceptions of the categories are cultural products. Wisely, the authors begin this book by describing it as a polemic. They argue that most contemporary analytic metaphysics is a waste of time and resources since contemporary ‘neo-scholastic’ metaphysical theorizing cannot hope to attain objective truth given its penchant for making a priori claims about the nature of the world which are backed up by appeal to intuition. In engaging in this activity, metaphysicians have, the authors claim, abandoned hope of locating any interesting connection between their metaphysical pronouncements and (...) how our best empirical theories describe the world. Moreover, the success attained by empirical science just cannot be matched by metaphysical theorizing and so, faced with this asymmetry, empirical science wins: a priori metaphysical theorizing must give way to a naturalistic form of metaphysics, a positive account of which the authors attempt to elucidate in the second and third, rather lengthy chapters of the book.The first chapter consists of a statement of the authors’ negative view, a vigorous, sustained and sometimes withering attack upon contemporary a priori metaphysics. Most ire is reserved for those who indulge in what the authors call ‘pseudo-scientific metaphysics’; that is, those who pay lip service to keeping their metaphysical speculation in tune with physics, only to constrain their ontology in such a way that the entities and processes within it do not even play a role in current physical theory, or are in straightforward contradiction with it. Much philosophy of science and scientific metaphysics is too superficial and simplistic to deserve the name and bears more relation to ‘the philosophy of “A” Level chemistry’. The landscape of social theory has changed significantly over the three decades since the publication of Anthony Giddens and Jonathan Turner’s seminal Social Theory Today. Sociologists in the twenty-first century desperately need a new agenda centered around central questions of social theory. In Social Theory Now, Claudio E. Benzecry, Monika Krause, and Isaac Ariail Reed set a new course for sociologists, bringing together contributions from the most distinctive sociological traditions in an ambitious survey of where social (...) theory is today and where it might be going. Quasi-truth (a.k.a. pragmatic truth or partial truth) is typically advanced as a framework accounting for incompleteness and uncertainty in the actual practices of science. Also, it is said to be useful for accommodating cases of inconsistency in science without leading to triviality. In this paper, we argue that the formalism available does not deliver all that is promised. We examine the standard account of quasi-truth in the literature, advanced by da Costa and collaborators in many places, and argue that it (...) cannot legitimately account for incompleteness in science. We shall claim that it conflates paraconsistency and paracompleteness. It also cannot properly account for inconsistencies, because no direct contradiction of the form S ∧ ¬S can be quasi-true according to the framework; contradictions simply have no place in the formalism. Finally, we advance an alternative interpretation of the formalism in terms of dealing with distinct contexts where incompatible information is dealt with. This does not save the original program, but seems to make better sense of the apparatus. (shrink)

Rudolf Pfeiffer believed that, as a young man, Callimachus wrote four books of Aetia. To these the poet added in his old age a Reply to his Critics , and a slightly revised version of his recent occasional elegy, the Lock of Berenice ; this revised Coma became the last poem in Aetia book 4, to be followed by an Epilogue which may mark a transition to the Iambi. Pfeiffer's theory generally held the field until the brilliant article of (...) P. J. Parsons, in ZPE 25 , 1–50. With the help of newly recovered papyrus fragments Parsons showed that a previously unplaced elegy celebrating a Nemean victory was connected to the story of Molorchus , who entertained Heracles before that hero killed the Nemean lion and instituted the Nemean Games; thus the poem belonged to Aetia book 3. Furthermore, various pieces of evidence converge to make it probable, if not wholly certain, that this substantial poem stood first in its book. So it appears that, at least in the final form of the Aetia, books 3–4 were framed by two poems honouring the wife of Ptolemy III Euergetes, namely Victoria Berenices and Coma Berenices. Soon afterwards a further important advance was made by E. Livrea , who perceived, on grounds of subject-matter as well as papyrology, that the poor man who sets a mousetrap in fr. 177 Pf. must be none other than Molorchus; note particularly the probable mention of Cleonae in fr. 177.37 Pf. = Supplementum Hellenisticum 259.37. Thus a new fragment of 38 lines accrued to the poem. These discoveries have some implications for the composition of the Aetia. Addition of a Coma Berenices to a pre-existent Aetia book 4 could be countenanced easily enough, but, as Parsons says , it would have required a much more radical, and therefore less plausible, revision for Callimachus to have added Victoria Berenices to a pre-existent Aetia book 3. Accordingly Parsons suggested that the original Aetia contained only books 1–2, united by the conversation with the Muses; then in his old age Callimachus compiled two more books, partly at least from poems already composed, and gave them a frame of two poems honouring Queen Berenice. Parsons' view has, I think, been widely accepted; Professor Lloyd-Jones wrote in SIFC 77 , 56 ‘No-one has yet argued against the simple modification of Pfeiffer's theory of the two editions of the Aetia which Mr. Parsons based on this discovery. John Greco’s Putting Skeptics in Their Place is an important book. Greco persuasively argues that the best skeptical arguments cannot be easily dismissed and should not be ignored. These arguments cannot be easily dismissed because they defend important conclusions and make no obvious mistake. The arguments should not be ignored because their proper analysis reveals much about central philosophical notions such as knowledge and evidence. While defending these conclusions Greco offers sophisticated metaepistemological and metaphilosophical reflections. Philosophers properly attending to (...) the strongest skeptical arguments will, according to Greco, find themselves heading in the direction of a virtue-based version of reliabilism. Greco defends this general type of theory and outlines the major components of his preferred version of the theory. Greco stops short of defending a fully precise account of knowledge, but he offers a spirited defense of his claim that such a theory should fall somewhere in the family of virtue-based reliabilist theories, a type of theory that Greco calls “agent reliabilism.” Greco concludes with a brief discussion of moral and religious epistemology in which he applies some of the insights gained in his exploration and defense of agent reliabilism. The research aims to identify the learning organizations and their role in achieving organizational excellence in the Palestinian universities in Gaza Strip. The researchers used descriptive analytical approach and used the questionnaire as a tool for information gathering. The questionnaires were distributed to senior management in the Palestinian universities. The study population reached (344) employees in senior management is dispersed over (3) Palestinian universities. A stratified random sample of (182) workers from the Palestinian universities was selected and the recovery (...) rate was (69.2%). Statistical analysis (SPSS) program was used for analysis and processing the data. The research found the following results: there is a fair degree of approval on "cognitive dimension", there is a high approval about the importance of "organizational dimension", there is moderately consent of the importance of "Community dimension", there is a large degree of consent about the importance of axis of the "leadership excellence", there is a large degree of consent about the importance of axis of the "service-excellence", there is a fair degree approval about the importance of the axis of "cognitive excellence", and there is a moderately consent of the importance of "Organizational Excellence". The research found a group of recommendations including: the need to develop appropriate strategies for the University, employ modern technology in information systems, in addition to provide appropriate environment that achieve learning organizations, develop technological infrastructure, adopt universities for knowledge management in the academic and administrative departments because knowledge is the core of the work of these departments, create technological incubators in universities to adopt excellence academic research projects, and protected them, support them, and market them. Establishing of centers of excellence for scientific research in the university.The need for cooperation and coordination between local, Arab and international universities for the exchange of knowledge, information, and participation programs and training courses, as it provides an opportunity to develop the capabilities and skills of personnel and expertise. Our aim in this paper is to take quite seriously Heinz Post’s claim that the non-individuality and the indiscernibility of quantum objects should be introduced right at the start, and not made a posteriori by introducing symmetry conditions. Using a different mathematical framework, namely, quasi-set theory, we avoid working within a label-tensor-product-vector-space-formalism, to use Redhead and Teller’s words, and get a more intuitive way of dealing with the formalism of quantum mechanics, although the underlying logic should be modified. We (...) build a vector space with inner product, the Q-space, using the non-classical part of quasi-set theory, to deal with indistinguishable elements. Vectors in Q-space refer only to occupation numbers and permutation operators act as the identity operator on them, reflecting in the formalism the fact of unobservability of permutations. Thus, this paper can be regarded as a tentative to follow and enlarge Heinsenberg’s suggestion that new phenomena require the formation of a new “closed” (that is, axiomatic) theory, coping also with the physical theory’s underlying logic and mathematics. A programme in translation confronts a student with at least two problems. The first is a mixture of theoretical and practical courses in which the link between the two is not always clear. In fact, the justification for suggesting that students take courses in linguistics or linguistic descriptions of particular languages is often expressed in terms of possible needs : some students may become interested in machine translation, for example. The second problem arises when students are asked to trans-late a (...) variety of material from a second language into their mother tongue ; they've never had to write much at all in their mother tongue, especially if they've majored in languages, and what they have written and are still writing, presumably, is academic French or academic English. Now they need to write business letters, advertisements, even poetry. The solution to the second problem is easy. The training of translators has to include the teaching of writing and editing skills. This need has been recognized by the International Federation of Translators' and it also crops up in articles written by teachers of translation2. Member States should recognize in principle that translation is an independent discipline requiring an education distinct from exclusive language teaching and that this discipline re-quires special training. Member States should encourage the establishment of writing programs for translators, especially in connection with translators' professional organizations or associations, universities or other educational institutions, and the organization of seminars or workshops. What I would like to suggest in this paper is that a particular kind of teaching of writing skills can also help solve the first problem, namely the gap between theoretical knowledge about language and the practical manipulation of the grammar of a particular language. John of Rupescissa (OFM, 1310 ca. – 1366)2 is a particularly interesting, eclectic and somewhat extraordinary [End Page 7] author writing around the second third of the 14th century in the wake of the Spiritual Franciscan movement in the South of France.3 (...) In LO XI, Rupescissa theorizes and systematically articulates a complex relationship between inspired knowledge and the normative portrait of what he believes the Franciscan Order should ideally be; he does so against the background of his eschatological concerns. Per Rupescissa's style of exposition and argumentation, these different elements — i.e., inspired epistemology, eschatology, and ecclesiology — are tightly intertwined on a theoretical and foundational level that goes beyond that of mere rhetorics.These themes are both recurrent and pivotal throughout Rupescissa's extremely prolific intellectual output, which counts numerous theological, ecclesiological, eschatological and alchemical treatises.4 LO, composed in [End Page 8] 1356 during Rupescissa's own "Avignon Captivity," is in many ways a sum of Rupescissa's prophetical and eschatological thought within the framing of the author's self-apologetic aims and of his ecclesiological views, in particular concerning the future of the Franciscan Order.5 [End Page 9]Treatise XI is undoubtedly the most theoretical book in LO; with its 489 paragraphs, it is also the longest. Per Rupescissa's eschatological views, such trials would affect the Franciscan Order the hardest and for the longest — hence the need for a detailed guide. At its core, then, LO XI is a deeply ecclesiological treatise and as such it is complementary to the larger systematization established in the Sexdequiloquium.6 It is in this framework that LO XI offers a complex theory of prophecy and illuminative knowledge as they should be embodied in the practices of a true Franciscan.7Given its highly abstract nature and cardinal function within one the most complex works of Rupescissa's maturity, LO XI, combining relevant insights on Rupescissa's ecclesiological, epistemological and prophetical positions, constitutes the ideal case study in order to assess Rupescissa's most refined and articulated account on inspired knowledge, particularly insofar as true and actual prophecy is concerned. This inspired knowledge, according to Rupescissa, is an indispensable tool for the elect to be able to victoriously face the imminent end of times. In the account presented in LO XI, such knowledge is possible exclusively through a form of institutional embedding: divine inspiration, culminating in true prophecy, is in service of the Franciscan Order's soteriological role within the Church as a whole, and can only be achieved by those who are faithful to the spirit of Francis's Rule.8 [End Page 10]Here, I analyze Rupescissa's theory of evangelical poverty and its role as a necessary condition for inspired knowledge, following the internal articulation of LO XI.Overall, in Rupescissa's view, Franciscan poverty and inspiration are two inseparable sides of the same coin. Advaita Vedānta is one of the best-known schools of Indian philosophy, but much of its history-a history closely interwoven with that of medieval and modern Hinduism-remains surprisingly unexplored. This book focuses on a single remarkable work and its place within that history: The Ocean of Inquiry, a vernacular compendium of Advaita Vedānta by the North Indian monk Niścaldās (ca. 1791 - 1863). Though not well known today, Niścaldās's work was once referred to by Vivekananda (himself a key figure in (...) the shaping of modern Hinduism) as the most influential book in India. The present book situates The Ocean of Inquiry as a representative of both a neglected genre (vernacular Vedānta) and a neglected period (ca. 17th-19th centuries) in the history of Indian philosophy. It argues that the rise of Advaita Vedānta to a position of prestige began well before the period of British rule in India, and that vernacular texts like The Ocean of Inquiry played an important role in popularizing Vedāntic teachings. It also offers a new appraisal of the period of late Advaita Vedānta, arguing that it should not be seen as one of barren scholasticism. For thinkers like Niścaldās, intellectual "inquiry" (vicāra) was not an academic exercise but a spiritual practice-indeed, it was the central practice on the path to liberation. The book concludes by arguing that without understanding both vernacular Vedānta and the scholasticism of the period, one cannot fully understand the emergence of modern Hinduism. (shrink)

This book is an appreciative exposition of Bergson’s Two Sources of Morality and Religion. It maintains that Bergson has a "revolutionary doctrine of the nature of morality." Although the author did not attempt to relate Bergson’s moral philosophy to the contemporary philosophical scene, she did fully display a base in which Bergson’s account can be evaluated in contemporary terms. Of particular interest is Bergson’s distinction between morality of obligation and morality of aspiration, or between static and dynamic morality. The (...) former is a morality of social pressure, the latter a morality of exceptionable individuals who reveal to men "new and higher moral goals." Bergson centers his attention to the morality of aspiration on mystical experience as the "peak" emotional experience. Questions may be raised whether this account can appropriately apply to Oriental mystics, for example, Lao-Tzu and Chuang-Tzu and the Zen Buddhists who seem to give no role to emotion in their account of alleged mystical experiences. It is doubtful whether all paradigmatic individuals recognized by Bergson can be regarded as unequivocal expression of the emotion of love. This narrow account of Bergson on the morality of aspiration does not detract from the importance of at least some analogous distinction to focus on the standard-guiding function of paradigmatic individuals in various moral practices. This volume is devoted to exploring a subject which, on the surface, might appear to be just a trending topic. In fact, it is much more than a trend. It relates to an ancient, permanent issue which directly connects with people's life and basic needs: the recognition and protection of individuals' dignity, in particular the inherent worthiness of the most vulnerable human beings. The content of this book is described well enough by its title: 'Human Dignity of the Vulnerable (...) in the Age of Rights'. Certainly, we do not claim that only the human dignity of vulnerable people should be recognized and protected. We rather argue that, since vulnerability is part of the human condition, human vulnerability is not at odds with human dignity. To put it simply, human dignity is compatible with vulnerability. A concept of human dignity which discards or denies the dignity of the vulnerable and weak is at odds with the real human condition. Even those individuals who might seem more skilled and talented are fragile, vulnerable and limited. We need to realize that human condition is not limitless. It is crucial to re-discover a sense of moderation regarding ourselves, a sense of reality concerning our own nature. Some lines of thought take the opposite view. It is sometimes argued that humankind is - or is called to be - powerful, and that the time will come when there will be no vulnerability, no fragility, no limits at all. Human beings will become like God (or what believers might think God to be). This perspective rejects human vulnerability as in intrinsic evil. Those who are frail or weak, who are not autonomous or not able to care for themselves, do not possess dignity. In this volume it is claimed that vulnerability is an inherent part of human condition, and because human dignity belongs to all individuals, laws are called to recognize and protect the rights of all of them, particularly of those who might appear to be more vulnerable and fragile.
