:Brain–computer interfaces are driven essentially by algorithms; however, the ethical role of such algorithms has so far been neglected in the ethical assessment of BCIs. The goal of this article is therefore twofold: First, it aims to offer insights into whether the problems related to the ethics of BCIs can be better grasped with the help of already existing work on the ethics of algorithms. As a second goal, the article explores what kinds of solutions are available in that body (...) of scholarship, and how these solutions relate to some of the ethical questions around BCIs. In short, the article asks what lessons can be learned about the ethics of BCIs from looking at the ethics of algorithms. To achieve these goals, the article proceeds as follows. First, a brief introduction into the algorithmic background of BCIs is given. Second, the debate about epistemic concerns and the ethics of algorithms is sketched. This article investigates the hitherto under-examined relations between affirmative action, paternalism and respect. We provide three main arguments. First, we argue that affirmative action initiatives are typically paternalistic and thus disrespectful towards those intended beneficiaries who oppose the initiatives in question. Second, we argue that not introducing affirmative action can also be disrespectful towards these potential beneficiaries because such inaction involves a failure to adequately recognize their moral worth. Third, we argue that the paternalistic disrespect involved in affirmative action is (...) alleviated when the potential beneficiaries’ preferences against such initiatives are adaptive. We conclude that although there is a relevant sense in which paternalistic affirmative action is disrespectful, it may well be more disrespectful not to pursue such policies. (shrink)

This volume examines the concept of falsification as a central notion of semantic theories and its effects on logical laws. The point of departure is the general constructivist line of argument that Michael Dummett has offered over the last decades. From there, the author examines the ways in which falsifications can enter into a constructivist semantics, displays the full spectrum of options, and discusses the logical systems most suitable to each one of them. While the idea of introducing falsifications into (...) the semantic account is Dummett's own, the many ways in which falsificationism departs quite radically from verificationism are here spelled out in detail for the first time. The volume is divided into three large parts. The first part provides important background information about Dummett’s program, intuitionism and logics with gaps and gluts. The second part is devoted to the introduction of falsifications into the constructive account and shows that there is more than one way in which one can do this. The third part details the logical effects of these various moves. In the end, the book shows that the constructive path may branch in different directions: towards intuitionistic logic, dual intuitionistic logic and several variations of Nelson logics. The author argues that, on balance, the latter are the more promising routes to take. "Kapsner’s book is the first detailed investigation of how to incorporate the notion of falsification into formal logic. This is a fascinating logico-philosophical investigation, which will interest non-classical logicians of all stripes." While COVID-19 vaccines provide light at the end of the tunnel in a difficult time, they also bring forth the complex ethical issue of global vaccine distribution. The current unequal global distribution of vaccines is unjust towards the vulnerable living in low-income countries. A vaccine tax should be introduced to remedy this. Under such a scheme, a small fraction of the money spent by a country on vaccines for its own population would go into a fund, such as COVAX, dedicated (...) to buying vaccines and distributing them to the world’s poorest. A vaccine tax would provide a much-needed injection of funds to remedy the unequal distribution of vaccines. The tax allows for a distribution that, to a lesser degree, reflects the ability to pay and is superior to a donation-based model because it minimises the opportunity for free-riding. (shrink)

Several attempts have been made to apply the choice-sensitive theory of distributive justice, luck egalitarianism, in the context of health and healthcare. This article presents a framework for this discussion by highlighting different normative decisions to be made in such an application, some of the objections to which luck egalitarians must provide answers and some of the practical implications associated with applying such an approach in the real world. It is argued that luck egalitarians should address distributions of health rather (...) than healthcare, endorse an integrationist theory that combines health concerns with general distributive concerns and be pluralist in their approach. It further suggests that choice-sensitive policies need not be the result of applying luck egalitarianism in this context. (shrink)

This paper defends a version of the realist view that fictional characters exist. It argues for an instance of abstract realist views, according to which fictional characters are roles, constituted by sets of properties. It is argued that fictional names denote individual concepts, functions from worlds to individuals. It is shown that a dynamic framework for understanding the evolution of discourse information can be used to understand how roles are created and develop along with story content. Taking fictional names to (...) denote individual concepts provides accounts of a number of uses of fictional names. These include non-fictional uses, fictional uses, metafictional uses, interfictional uses, counterfictional uses, and negative existentials. Den zentralen Bezugspunkt von Carnaps wissenschaftslogischen Arbeiten bildet die von Frege und Russell entwickelte mathematische Logik. Dies gilt auch für die Zweistufenkonzeption, mit der Carnap ein allgemeines Schema zur Analyse der Bedeutung von Begriffen nichtmathematischer Theorien entwirft. Dabei wird die Abhängigkeit der begrifflichen Bedeutung von den Aussagen der jeweiligen Theorie explizit anerkannt, was eine Überwindung der Dogmen des Empirismus innerhalb des Logischen Empirismus einschlieβt. Allerdings geht Carnap in seinen Arbeiten zur Semantik formaler Sprachen auf die spezifischen Eigenschaften von theoretischen Termen nicht ein, so daβ die Überwindung der Dogmen des Empirismus unvollständig bleibt. According to luck egalitarianism, it is unjust if some are worse off than others through no fault or choice of their own. The most common criticism of luck egalitarianism is the ‘harshness objection’, which states that luck egalitarianism allows for too harsh consequences, as it fails to provide justification for why those responsible for their bad fate can be entitled to society's assistance. It has largely gone unnoticed that the harshness objection is open to a number of very different interpretations. (...) We present four different interpretations of the harshness objection in which the problem pertains to counterintuitive implications, badness of outcome, disproportionality, or inconsistency, respectively. We analyse and discuss appropriate luck egalitarian replies. Disentangling these different versions clarifies what is at the heart of this dispute and reveals the point of the harshness objection. We conclude that only the inconsistency version involves a durable problem for luck egalitarianism. (shrink)

Hassoun argues that the poor in the world have a right to health and that the Global Health Impact Index provides consumers in well-off countries with the opportunity to ensure that more people have access to essential medicines. Because of this, these consumers would be ethically obliged to purchase Global Health Impact Index-labeled products in the face of existing global inequalities. In presenting her argument, Hassoun rejects the so-called democratic account of ethical consumption in favor of the positive change account. (...) Two versions of the democratic change account are relevant. One underscores the importance of democratic procedures and institutions, while the other stresses our fundamental moral equality. While at least one prominent institutionalist account has problems, revised versions would be less vulnerable to Hassoun’s counterexamples. Furthermore, institutionalist accounts come with the epistemological gains from democratic procedures and deliberations, which may be especially important under uncertainty. Finally, and perhaps more challenging for the Global Health Impact index project, this measure may place the burden unfairly on those who need to buy medicines. This is a pivotal insight from the non-institutionalist version of the democratic account of ethical consumption. (shrink)

In this chapter I propose to understand the current paradigm shift in biology as the origination of a biology of subjects. A description of living beings as experiencing selves has the potential to transform the current mechanistic approach of biology into an embodied-hermeneutic one, culminating in a poetics of nature. We are at the right moment for that: The findings of complex systems research, autopoiesis theory, and evolutionary developmental biology are converging into a picture where the living can not longer (...) be described in terms of causal mechanisms (as is, e. g., the Watson-Crick “central dogma”). Instead, organisms bring forth themselves physically and thereby generate a hermeneutic standpoint, interpreting external and internal stimuli interfering with their auto-creation according to embodied values. This can be observed empirically during embryonic develoment, where genetic instructions do not act as orders, but rather as perturbations being interpreted by an auto-maintaining developmental centre. The notion of organic subjectivity opens the living realm to a hermeneutic perspective. Since any encounter has a meaning and is interpreted accordingly, it creates a perspective of innerness or self. This self experiences all external and internal stimuli as values. The innerness is coextensive with the material dimensions of biochemical processes as their other, or symbolic, side. By this process the subjective perspective of organisms is open to other’s experience. Meaning and value become visible, as they are generated in material, embodied form. Instead of being separate from nature as pure “mind” or “language”, man shares with any other being the same “conditio vitae” of experienced meaning and expressive feeling. (shrink)

Glauben und unser Begriff von ihm stehen seit wenigstens hundert Jahren mit im Zentrum der theoretischen Philosophie. Glauben im weitesten Sinn: jederlei Art des Fürwahrhaltens. Die Frage, was es ist und welchen Begriff wir davon haben, war und bleibt ein Thema insbesondere auch der Erkenntnistheorie, der Philosophie des Geistes und der Ontologie. Welche Auskünfte bietet die Philosophie heute darüber, was das Glauben ist? Wie gut sind sie? Inwieweit lassen sie sich aus dem Begriff begründen, den wir vom Glauben haben? Was (...) für ein Begriff ist das eigentlich? Können wir Wissen vom Glauben haben, wenigstens vom eigenen? Solchen Fragen geht dieser Essay nach, oft ohne definitive Antwort. Es ist eher der Versuch, erkennbar werden zu lassen, weshalb die Erwartung, es gebe solche Antworten, keinen guten philosophischen Grund hat. The wishes of registered organ donors are regularly set aside when family members object to donation. This genuine overruling of the wishes of the deceased raises difficult ethical questions. A successful argument for providing the family with a veto must (a) provide reason to disregard the wishes of the dead, and (b) establish why the family should be allowed to decide. One branch of justification seeks to reconcile the family veto with important ideas about respecting property rights, preserving autonomy, and (...) preventing harm. These arguments are ultimately unsuccessful. Another branch of arguments is consequentialist, pointing out the negative consequences of removing the veto. Whether construed as concerning family distress or as a potential drop in the organs available, these arguments are unsuccessful; the first fails to recognize the tremendous distress associated with waiting for an organ, while the second has little supporting evidence. A final section considers and rejects whether combining some of the arguments just examined could justify the family veto. We should thus remove the family veto in organ donation. (shrink)

Due to the shortage of organs, it has been proposed that the ban on organ sales is lifted and a market-based procurement system introduced. This paper assesses four prominent proposals for how such a market could be arranged: unregulated current market, regulated current market, payment-for-consent futures market, and the family-reward futures market. These are assessed in terms of how applicable prominent concerns with organ sales are for each model. The concerns evaluated are that organ markets will crowd out altruistic donation, (...) that consent to sell organs is invalid, that sellers will be harmed, and that commodification of organs will affect human relationships in a negative way. The paper concludes that the family-reward futures market fares best in this comparison but also that it provides the weakest incentive to potential buyers. There is an inverse relationship between how applicable prominent critiques are to organ market models and the increase in available organs they can be expected to provide. (shrink)

Should priority in the allocation of organs be given to those who have previously donated or declared their willingness to do so? This article examines the Israeli priority rule in light of two prominent critiques of priority rules, pertaining to failure to reciprocate and unfairness. The scope and content of these critiques are interpreted from the perspective of equality of opportunity. Because the Israeli priority rule may be reasonably criticized for unfairness and failing to reward certain behaviors, the article develops (...) an adjusted priority rule, which removes and adjust the elements in the Israeli priority rule deemed problematic. However, such a priority rule is complex to the extent that it may fail to increase donation rates and furthermore introduce new concerns of fairness, as the better off may be better able to navigate the complex adjusted priority rule. As a solution to the boundary problem, the question of who should take part in making democratic decisions, the all-affected principle has gained widespread support. An unexplored issue in relation to the all-affected principle is whether there is an asymmetry between being affected negatively and positively. Is it the case that only being negatively affected, and not positively affected, by a decision generates a claim to inclusion under the all-affected principle? I call this the question of asymmetry. Some answer the (...) question of asymmetry affirmatively. I believe they are wrong and argue, instead, that we must answer this question by looking at the reasons underlying the all-affected principle. I identify two main reasons that have been proposed to underlie the all-affected principle—(1) the opportunity for interest protection and (2) self-government—and show why both of them entail that answering the question of asymmetry affirmatively is unfounded. The upshot is that both being affected negatively and positively by a decision should generate a claim to inclusion on the all-affected principle. This makes a difference for democratic decision making on contemporary issues such as immigration, climate, and welfare policy. (shrink)

In the luck egalitarian literature, one influential formulation of luck egalitarianism does not specify whether equalities that do not reflect people’s equivalent exercises of responsibility are bad with regard to inequality. This equivocation gives rise to two competing versions of luck egalitarianism: asymmetrical and symmetrical luck egalitarianism. According to the former, while inequalities due to luck are unjust, equalities due to luck are not necessarily so. The latter view, by contrast, affirms the undesirability of equalities as well as inequalities insofar (...) as they are due to luck. The symmetrical view, we argue, is by far the more compelling, both by internal luck egalitarian standards and in light of the external rightist emphasis on choice and responsibility to which luck egalitarianism may partly be seen as a response. Our main case for the symmetrical view is that when some people, against a background of equal opportunities, do not exercise their responsibility to the same degree as others, they cannot justifiably call for equalizing measures to be put in place. Indeed, such measures would be positively unfair. The symmetrical view, accordingly, rejects compensation in such cases, whereas the asymmetrical view, implausibly, enjoins it. We also examine two objections to this argument. First, that this view fails to qualify as genuinely egalitarian, instead collapsing the notion of equality into the notion of desert. Second, that the opposing asymmetrical view, in contrast to the symmetrical view, can draw support from its compatibility with sufficientarian concerns. Both objections are rebutted. We conclude that luck egalitarians are best served by endorsing the symmetrical, luck-neutralizing stance. (shrink)

Rare diseases pose a particular priority setting problem. The UK gives rare diseases special priority in healthcare priority setting. Effectively, the National Health Service is willing to pay much more to gain a quality-adjusted life-year related to a very rare disease than one related to a more common condition. But should rare diseases receive priority in the allocation of scarce healthcare resources? This article develops and evaluates four arguments in favour of such a priority. These pertain to public values, luck (...) egalitarian distributive justice the epistemic difficulties of obtaining knowledge about rare diseases and the incentives created by a higher willingness to pay. The first is at odds with our knowledge regarding popular opinion. The three other arguments may provide a reason to fund rare diseases generously. However, they are either overinclusive because they would also justify funding for many non-rare diseases or underinclusive in the sense of justifying priority for only some rare diseases. The arguments thus fail to provide a justification that tracks rareness as such. There are no data in this work. (shrink)

An essential part of particularism as a systematic option in philosophical ethics is the structure of perception. In this paper, we defend perception as a central feature against the meta-ethical and meta-epistemological prejudices of rationalism.The insurmountable border between perception and justification, which is central to rationalist ethics, rests on three premises that are rejected by particularism: ethical knowledge is not exclusively inferential or discursive, ethical reflection is not solely deductive reasoning, and the bases of justified actions do not have to (...) be universal laws.Against rationalist ethics, we defend perception as a central and primary source of ethical knowledge, as a way of non-discursive reflection and as a genuine form of ethical justification. Ethical experience is not only reason but the complex responsiveness of persons that develops biographically as a result of situations in social and culturally contingent contexts. (shrink)

Luck egalitarianism is often taken to task for its alleged harsh implications. For example, it may seem to imply a policy of nonassistance toward uninsured reckless drivers who suffer injuries. Luck egalitarians respond to such objections partly by pointing to a number of factors pertaining to the cases being debated, which suggests that their stance is less inattentive to the plight of the victims than it might seem at first. However, the strategy leaves some cases in which the attribution of (...) individual responsibility is appropriate . One such case is oral health or significant aspects of this. It is appropriate, the paper argues, to hold people responsible for a number of factors that affect their oral health. A luck egalitarian approach inspired by John Roemer can assess whether people have acted responsibly by comparing their choices to those of their peers. A luck egalitarian approach to oral health would recommend prioritizing scarce resources in a responsibility-weighted queuing system and include copayment and general taxation among its measures of financing. In December 2015, Wales became the first country in the UK to move away from an opt-in system in organ procurement. The new legislation introduces the concept of deemed consent whereby a person who neither opt in nor opt out is deemed to have consented to donation. The data released by the National Health Service in July 2017 provide an excellent opportunity to assess this legislation in light of concerns that it would decrease procurement rates for living and deceased donation, (...) as well as sparking an increase in family refusals. None of these concerns have come to pass, with Wales experiencing more registered donors, fewer family refusals and more living donations. However, as the number of actual donors has dropped slightly from a high level, the situation must be monitored closely in the years to come. (shrink)

In conversations with Schlick and Waismann from June and December 1930, Wittgenstein began to turn his attention to the topic of games. This topic also centrally concerned Schlick. In his earliest philosophical output, Schlick had relied on the results of evolutionary biology in setting out an account of the emergence of the human species’ ability to play [Spiel] as a prerequisite for the genesis of scientific knowledge. Throughout his subsequent works one finds fragmentary appeals to this early view, e.g. in (...) his oft misunderstood claim that play constitutes the meaning of life. Wittgenstein’s turn to the topic of games in 1930 not only happened while Professor Schlick was in the room, but was also coupled with an explicit response to Schlick’s 1930 book Fragen der Ethik. Schlick here employs the example of chess to distinguish between rules and their application – a distinction which underlies his whole attempt to naturalise ethics as a descriptive psycho-sociological discipline. This paper investigates the relation between Wittgenstein’s and Schlick’s accounts of games in light of Wittgenstein’s criticisms of Schlick’s ethics. Wittgenstein’s objections can be answered by taking Schlick’s theory of play into consideration. (shrink)

In the present work we investigated distinct sources of construct-relevant psychometric multidimensionality in two sport-specific measures of coaches’ need-supportive (ISS-C) and controlling interpersonal (CCBS) styles. A recently proposed bifactor exploratory structural equation modeling (ESEM) framework was employed to achieve this aim. In Study 1, using a sample of floorball players, the results indicated that the ISS-C can be considered as a unidimensional measure, with one global factor explaining most of the variance in the items. In Study 2, using a sample (...) of male ice hockey players, the results indicated that the items in the CCBS are represented by both a general factor and specific factors, but the subscales differ with regard to the amount of variance in the items accounted for by the general and specific factors. These results add further insight into the psychometric properties of these two measures and the dimensionality of these two constructs. (shrink)

This thesis consists of four essays and an introduction dedicated to two main topics: indexicality and presupposition. The first essay is concerned with an alleged problem for the standard treatment of indexicals on which their linguistic meanings are functions from context to content. Since most indexicals have their content settled, on an occasion of use, by the speaker’s intentions, some authors have argued that this standard picture is inadequate. By demonstrating that intentions can be seen as a parameter of the (...) kind of context that characters operate on, these arguments are rejected. In addition, it is argued that a more recent, variable-based framework is naturally interpreted as an intention-sensitive semantics. The second essay is devoted to the phenomenon of descriptive uses of indexicals on which such an expression seems to contribute, not its standard reference as determined by its character, but a property to the interpretation. An argument that singular readings of the cases in question are incoherent is shown to be incorrect, and an approach to descriptive readings is developed on which they arise from e-type uses akin to other well known cases. Further, descriptive readings of the relevant kind are seen to arise only in the presence of adverbs of quantification, and all sentences in which such an adverb takes scope over an indexical are claimed to be ambiguous between a referential and an e-type reading. The third essay discusses a version of the variable analysis of pronouns on which their descriptive meanings are relegated to the so-called phi-features – person, gender and number. In turn, the phi-features are here seen as triggering semantic presuppositions that place constraints on the definedness of pronouns, and ultimately of sentences in which they appear. It is argued that the descriptive information contributed by the phi-features diverges radically from presuppositional information of both semantic and pragmatic varieties on several dimensions of comparison, and instead the main role of the phi-features is seen to be that of guiding hearers’ attempts to ascertain the speaker’s intentions. The fourth essay addresses an issue concerning the treatment of presuppositions in dynamic semantics. Representing a semantic treatment of pragmatic presuppositions, the dynamic framework is shown to incorrectly regard conversational infelicity as sufficient for semantic undefinedness, given the standard way of defining truth in terms of context change. Further, it is shown that a proposal for a solution fail to make correct predictions for epistemic modals. A novel framework is developed on which context change potentials act on contexts that have more structure than the contexts usually countenanced by dynamic semantics, and it is shown that this framework derives truth from context change while making correct predictions for both presuppositions and modals. Judith Shklar was a formative political thinker whose oeuvre defies traditional labels, and whose legacy is subtle but substantial. Her work emerged, as one observer has pointed out, between the "end of ideology" discussions of the 1950s and the early 1990s discussion of the "end of history." Es geht in dem vorliegenden Band um die Rehabilitierung der theoretischen Neugierde für jenes Millennium, das wir Mittelalter nennen. Was heißt es, eine theoretische Einstellung einzunehmen? Gibt es kulturelle Unterschiede oder einen Bedeutungswandel hinsichtlich der curiositas? Was sind die bevorzugten Gegenstandsbereiche der theoretischen Neugier? Hierbei prallen zwei Einstellungen aufeinander: die curiositas als fehlgeleitete und im Grunde eitle und schädliche Neugier oder als ein Naturverlangen, das ein anthropologisches Existential darstellt. Ausgehend vom Wortfeld der theoretischen Neugierde wird die Dialektik und longue durée (...) der curiositas in ihren historischen und systematischen Zusammenhängen thematisiert. An die Stelle von normativen Wertungen treten zeitlich und räumlich weitgespannte Untersuchungen, die dazu beitragen, die begriffliche, motivische und konzeptionelle Entfaltung der theoretischen Neugier im Spannungsfeld theoretischer, kultureller, institutioneller und religiöser Determinanten zu verfolgen und damit zugleich aus der epochenfixierten Engführung zu befreien.
