This book by Dr. Desmarais is by all means a positive contribution in the field of Yoga, Indology and cognitive neurosciences. It covers Eastern and Western, ancient and modern, religion and metaphysics, psychology and epistemology, as well as the cultural heritage for these. The book is arranged in six chapters using our common concept of show as a metaphysical stage: getting ready for the show; entering the theatre; taking the stage; all the world as stage; following the plot; thickening (...) of the plot; and finally, the lights come up. This has its source in the Samkhya metaphor of prakrti as analogous to a divine actor, on the world stage and in a cosmic drama. Another symbolic metaphor that comes before our mind is that of Ardhanarinatesvara of Lord Siva, depicted as the Cosmic divine Supreme actor endowed with half-female in his person. The reader, the spectator or audience member, symbolizes the Purusa of Samkhya and yoga. (shrink)

We discuss the variety of sorts of sympathy Hume recognizes, the extent to which he thinks our sympathy with others’ feelings depends on inferences from the other’s expression, and from her perceived situation, and consider also whether he later changed his views about the nature and role of sympathy, in particular its role in morals.

This paper assesses James M. Buchanan's claim of following a positive approach in stark contrast to the normative approach to public finance of Richard A. Musgrave. The goal of this paper is to shed light on the foundations of modern American public finance by analysing one aspect of the methodology of its two most prominent fathers. I show (1) that it is difficult to distinguish Musgrave's and Buchanan's theories of public goods along the positive/normative dividing line and (2) that Buchanan's (...) theory can also be considered normative. In the first three parts, I follow the Weberian methodological tradition in looking for value judgements in the theories, and by reflecting on the nature of ideal types. In the last part, I propose a broader interpretation of Buchanan's methodological stance within the academic context of the 1960s. (shrink)

It is becoming more common that the decision-makers in private and public institutions are predictive algorithmic systems, not humans. This article argues that relying on algorithmic systems is procedurally unjust in contexts involving background conditions of structural injustice. Under such nonideal conditions, algorithmic systems, if left to their own devices, cannot meet a necessary condition of procedural justice, because they fail to provide a sufficiently nuanced model of which cases count as relevantly similar. Resolving this problem requires deliberative capacities uniquely (...) available to human agents. After exploring the limitations of existing formal algorithmic fairness strategies, the article argues that procedural justice requires that human agents relying wholly or in part on algorithmic systems proceed with caution: by avoiding doxastic negligence about algorithmic outputs, by exercising deliberative capacities when making similarity judgments, and by suspending belief and gathering additional information in light of higher-order uncertainty. On doit à l’économiste américain d’origine allemande, Richard A. Musgrave, la formulation des critères d’Équité Horizontale (ÉH) et d’Équité Verticale (ÉV). Étant donnée une base fiscale, l’ÉH veut que les égaux soient traités également, alors que l’ÉV exige que les inégaux soient traités inégalement (par exemple que les plus riches payent proportionnellement plus d’impôts). Musgrave opère en 1959 une redescription créative de considérations d’équité qui ont une longue histoire de Hobbes à Buchanan, en passant notamment par la fameuse maxime de (...) Adam Smith. La reconstruction généalogique montre que l’ÉV et l’ÉH relèvent de la justice distributive au sens aristotélicien du terme. Un critère purement formel, l’équité en matière d’impôt signifie l’égalité proportionnelle dans la répartition des charges communes à tous les individus membres d’une communauté politique. Mithilfe der Verfahren des Embryo-Splittings werden unter Laborbedingungen aus einem Embryo mehrere, genetisch identische Embryonen gewonnen. Gegenwärtig wird in Fachbeiträgen debattiert, die in der Nutztierzucht etablierten Verfahren auf die humane Reproduktionsmedizin auszuweiten. Eine solche Anwendung wird derzeit flächendeckend als reproduktives Klonen verstanden und ist in allen Staaten per Gesetz oder Richtlinie untersagt. Bei der Prüfung ausgewählter Einwände gegen die prinzipielle Zulässigkeit einer Anwendung des Embryo-Splittings als assistierter Reproduktionstechnologie zeigt sich, dass sich die Einwände gegen das reproduktive Klonen nicht auf den (...) Fall des Splittings übertragen lassen. Insbesondere liegt dem Splitting nicht die ‚narzisstische‘ Replikation des Genoms einer bereits lebenden Person zugrunde. Die Gleichsetzung mit anderen Formen des reproduktiven Klonens verdeckt darüber hinaus eigene regulative Fragen zum Umgang mit gesplitteten Embryonen, die hinsichtlich einer potenziellen klinischen Anwendung adressiert werden müssen. Schließlich wird deutlich, dass die Maßgabe, Embryonen zu schützen, bisher einseitig als ausreichender Grund für eine restriktive Regulierung des Splittings herangezogen wurde. Diese Argumentation erweist sich in einer pluralistischen Gesellschaft jedoch als unzureichend. (shrink)

This article offers an interpretation of the first part – most often neglected by commentators – of « A Few Words on Non-Intervention » by John Stuart Mill. It shows that these pages are not a naive apology of the English foreign policy: on the contrary we have to seriously consider the ideas concerning public opinion and the need for diplomats to reform their language, which are here exposed. Indeed, it is only possible to understand the emancipatory aims of John (...) Stuart Mill in this article, by determining what are for him the nature of public opinion and its role in the foundation of an effective “principle of non-intervention”. The comparison with the texts of his predecessors – Bentham and James Mill – then serve to shed light on the new and decisive function of the “public spirit” in international relations as it appears here. This book analyses anthropological debates on "relationism" (referring to methodological and theoretical issues) and sets out to reconsider these discussions with regards to the notion of "substance" (generally associated with the body). Reflecting on the philosophical origins and implications of these two concepts, the author aims to bring them to the heart of contemporary anthropological discourse and addresses the erasure (or blurring) of "substance" in favour of "relation." The argument put forward is that the conceptual pairing of "substance-relation" should be (...) substituted for the "nature-culture" dualism that has been dominant in structural anthropology. The chapters engage with the work of scholars such as Philippe Descola, Eduardo Viveiros de Castro and Wang Mingming as part of a decentring and questioning of the tradition in which anthropology is rooted. The book also considers the role that the anthropology of China plays in the re-evaluation of the relationship between relation and substance. The concept of "submutance" is introduced with Chinese ethnographic material to explore the possibility of moving beyond the relation-substance dualism of Western heritage. For several years, the official European method for deciding whether or not shellfish were fit for human consumption was the mouse bioassay, which was eventually replaced by chemical testing. In this paper, we examine the process of this change, looking at how devices of social, technical, and organisational risk management were re-negotiated locally, nationally, and across the continent. We also show how the political decision to replace a precautionary standard with a management-vigilance device was the result of various dynamics. I argue that, because of its greater power and flexibility, the Structuralist View better explains the patterns of ignorance that we observe, better illuminates the connection to white racial domination, and is overall better suited to the project of ameliorating racial injustice. In these Carus Lectures, Annette Baier looks at the relation between individual and shared reasoning, intending, and moral reflection. In each case she emphasizes the interdependence of minds and the role of social practices in setting the norms governing these activities.

Disagreement persists about when, if at all, disenfranchisement is a fitting response to criminal wrongdoing of type X. Positive retributivists endorse a permissive view of fittingness: on this view, disenfranchising a remarkably wide range of morally serious criminal wrongdoers is justified. But defining fittingness in the context of criminal disenfranchisement in such broad terms is implausible, since many crimes sanctioned via disenfranchisement have little to do with democratic participation in the first place: the link between the nature of a criminal (...) act X (the ‘desert basis’) and a fitting sanction Y is insufficiently direct in such cases. I define a new, much narrower account of the kind of criminal wrongdoing which is a more plausible desert basis for disenfranchisement: ‘political wrongdoing’, such as electioneering, corruption, or conspiracy with foreign powers. I conclude that widespread blanket and post-incarceration disenfranchisement policies are overinclusive, because they disenfranchise persons guilty of serious, but non-political, criminal wrongdoing. While such overinclusiveness is objectionable in any context, it is particularly objectionable in circumstances in which it has additional large-scale collateral consequences, for instance by perpetuating existing structures of racial injustice. At the same time, current policies are underinclusive, thus hindering the aim of holding political wrongdoers accountable. (shrink)

What is it to deceive someone? And how is it possible to deceive oneself? Does self-deception require that people be taken in by a deceitful strategy that they know is deceitful? The literature is divided between those who argue that self-deception is intentional and those who argue that it is non-intentional. In this study, Annette Barnes offers a challenge to both the standard characterisation of other-deception and current characterizations of self-deception, examining the available explanations and exploring such questions as (...) the self-deceiver's false consciousness, bias, and the irrationality and objectionability of self-deception. She arrives at a non-intentional account of self-deception that is deeper and more complete than alternative non-intentional accounts and avoids the reduction of self-deceptive belief to wishful belief. Recent research in empirical moral psychology attempts to understand (rather than place judgment on) the salient normative differences that laypeople have when making moral decisions by using survey methodology that is based on the operationalized principles from moral theories. The PPIMT is the first measure designed to assess respondents’ preference for the precepts implied in the three dominant moral theories: virtue ethics, deontology, and consequentialism. The current study used a latent modeling approach to determine the most theoretically and psychometrically-sound model (...) for the PPIMT using a combined sample of college students from a southeastern university in U.S. and MTurk respondents. The PPIMT model fit was acceptable (χ2 = 84.125, df = 40, p = 0.001; RMSEA = 0.052, 90%CI = 0.037 to 0.068; CFI = 0.980; SRMR = 0.035) with four items for Virtue, four items for Deontology, and three items for Consequentialism. _Postures of the Mind _was first published in 1985. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. Annette Baier develops, in these essays, a posture in philosophy of mind and in ethics that grows out of her reading of Hume and the later Wittgenstein, and that challenges several Kantian or analytic articles of faith. She questions the assumption that intellect has authority over (...) all human feelings and traditions; that to recognize order we must recognize universal laws—descriptive or prescriptive; that the essential mental activity is representing; and that mental acts can be analyzed into discrete basic elements, combined according to statable rules of synthesis. In the first group of essays—"Varieties of Mental Postures"—Baier evaluates the positions taken by philosophers ranging from Descartes to Dennett and Davidson. Among her topics are remembering, intending, realizing, caring, representing, changing one's mind, justifying one's actions and feelings, and having conflicting reasons for them. The second group of essays—"Varieties of Moral Postures" - explores the sort of morality we get when all of these capacities become reflective and self-corrective. Some deal with particular moral issues—our treatment of animals, our policies regarding risk to human life, our contractual obligations; others, with more general questions on the role of moral philosophers and the place of moral theory. These essays respond to the theories of Hobbes, Kant, Rawls, and MacIntyre, but Baier's most positive reaction is to David Hume; _Postures of the Mind _ affirms and cultivates his version of a moral reflection that employs feeling and tradition as well as reason. Little is known about how bow mechanical characteristics objectively and quantitatively influence violinists' preferences and performance. Hypothesizing that the bow shape and mass distribution modifications would alter both violinists' appreciations of a bow and objective assessments of their performance, we recruited 10 professional violinists to play their own violin using 18 versions of a single bow, modified by combining three cambers and six mass distributions, in random order. A musical phrase, composed for this study, was played legato and spiccato at (...) three octaves and two tempi. Each violinist scored all 18 bows. Then, experts assessed the recorded performances according to criteria inspired by basic musical analysis. Finally, 12 audio-descriptors were calculated on the same note from each trial, to objectivise potential acoustic differences. Statistical analysis reveals that bow camber impacted the violinists' appreciations, and that heavier bow tips gave lower scores for spiccato playing. The expert evaluations reveal that playing with a lighter bow, or with a bow whose camber's maximum curvature is close to the frog, had a positive impact on some violinists' performance. The “camber-participant” interaction had significant effects on the violinists' appreciations, on the expert's evaluation and on almost all the audio-descriptors. While trends were identified, multiple camber-participant interactions suggest that bow makers should provide a variety of cambers to satisfy different violinists. (shrink)

The influence of liberal political ideology on nursing sciencePrevious notions of science as impartial and value-neutral have been refuted by contemporary views of science as influenced by social, political and ideological values. By locating nursing science in the dominant political ideology of liberalism, the author examines how nursing knowledge is influenced by liberal philosophical assumptions. The central tenets of liberal political philosophy — individualism, egalitarianism, freedom, tolerance, neutrality, and a free-market economy — are primarily manifested in relation to: (i) the (...) individualistic focus of our science; (ii) our view of society as essentially egalitarian and equitable; (iii) our preference for politically neutral knowledge development, and (iv) an economy of knowledge development that supports rather than challenges the status quo. I argue that exposing, rather than ignoring, the liberal ideological values inherent in nursing science will render these assumptions open to debate, stimulate ongoing development of critically oriented knowledge, and increase our capacity to influence the social, political and economic determinants of health. This study examines activities and processes through which projects of moral regulation are implemented as well as lived, transformed, and resisted by their targeted actors. Our ethnographic study focuses on discourses and practices of civic duty for orderly and hygienic conduct in the rehabilitation of marketplaces in Yaoundé, Cameroon. By drawing on the inhabited institutions approach and the literature on ethics as practice, our analysis extends research on moral work to put forward a perspective on moral regulation as a situated (...) practice. We show how moral work is built on individual reflections but is simultaneously negotiated through actors’ relationships, that is, responsibilities to family, interactions within the community, and personal history. English uses the relative Reference Frame which includes the speaker’s viewpoint assigning directions to identify a Located Object and a Reference Object. Projective prepositions express the position of the LO and the RO along the front-back and left-right axes: the speaker’s egocentric axes are either mapped onto the RO under a 180-degree rotation so that the speaker’s right is the listener’s left; or the speaker’s egocentric axes are translated onto the RO without rotation. When the RO is a non-fronted object, (...) English refers to it without rotation along the left-right axis, but it depicts it with rotation along the front-back line. In comparison to this model, this paper explores the way English treats the location of a RO represented by animate and human entities. The use of projective prepositions to consider animate, fronted items used as RO is here examined through spoken corpora collected with English-speaking students, describing the position of such items with or without rotation. Cet article présente les premiers résultats d’un des volets d’une vaste recherche-action portée par une équipe pluridisciplinaire entre 2018 et 2021 et centrée sur les rapports familles/institutions. L’accueil et l’éducation des enfants dans le monde contemporain est en effet au cœur des problématiques institutionnelles et la famille, tout comme les institutions relevant de l’éducation, de la santé et du social, connaît d’importantes mutations tant structurelles qu’organisationnelles qui ont des conséquences au niveau des sujets, des groupes et des sociétés. Le présent (...) article apportera quelques éléments de compréhension de ce qui organise singulièrement les liens entre les familles et les collèges. L’auteure s’intéresse ici à la nature des liens qui unissent professionnels et parents autour des collégiens et autour des valeurs propres aux établissements ayant participé à la recherche. Elle propose quelques hypothèses pour appréhender ces rapports à nouveaux frais, entre défiance, résistance et créativité, du côté tant des familles que des professionnels et plus globalement des institutions. In recent decades in North American social and moral philosophy, alongside the development and discussion of widely influential theories of justice, taken as Rawls takes it as the ‘first virtue of social institutions,’ there has been a counter-movement gathering strength, one coming from some interesting sources. For some of the most outspoken of the diverse group who have in a variety of ways been challenging the assumed supremacy of justice among the moral and social virtues are members of those sections (...) of society whom one might have expected to be especially aware of the supreme importance of justice, namely blacks and women. Those who have only recently won recognition of their equal rights, who have only recently seen the correction or partial correction of long-standing racist and sexist injustices to their race and sex, are among the philosophers now suggesting that justice is only one virtue among many, and one that may need the presence of the others in order to deliver its own undenied value. Among these philosophers of the philosophical counterculture, as it were - but an increasingly large counterculture - I include Alasdair MacIntyre, Michael Stocker, Lawrence Blum, Michael Slote, Laurence Thomas, Claudia Card, Alison Jaggar, Susan Wolf and a whole group of men and women, myself included, who have been influenced by the writings of Harvard educational psychologist Carol Gilligan, whose book In a Different Voice caused a considerable stir both in the popular press and, more slowly, in the philosophical journals. David Hume has been invoked by those who want to found morality on human nature as well as by their critics. He is credited with showing us the fallacy of moving from premises about what is the case to conclusions about what ought to be the case; and yet, just a few pages after the famous is-ought remarks in A Treatise of Human Nature, he embarks on his equally famous derivation of the obligations of justice from facts about the cooperative (...) schemes accepted in human communities. Is he ambivalent on the relationship between facts about human nature and human evaluations? Does he contradict himself – and, if so, which part of his whole position is most valuable? Between the famous is-ought passage and the famous account of convention and the obligations arising from established cooperative schemes once they are morally endorsed, Hume discusses the various meanings of the term “natural.” “Shou'd it be ask'd, Whether we ought to search for these principles [upon which all our notions of morals are founded] in nature or whether we must look for them in some other origin? I wou'd reply, that our answer to this question depends upon the definition of the word, Nature, than which there is none more ambiguous and equivocal.” The natural can be opposed to the miraculous, the unusual, or the artificial. It is the last contrast that Hume wants, for his contrast between the “artificial” culturally variant, convention-dependent obligations of justice and the more invariant “natural virtues,” and what he says about that contrast in this preparation for his account of the “artificial” virtues, makes it clear why he can later refer to justice as “natural” and to the general content of the rules of justice – that is, of basic human conventions of cooperation – as “Laws of Nature”. This article starts by following the original itinerary of the project of reconciliation with indigenous peoples. This project is expressed, in the context of the Americas, by the work of Bartolomé de las Casas (1484-1566), as well as the dialogue to which it was invited by the work of Felipe Guaman Poma de Ayala (~1536-1616). From a transnational and transcultural genealogical perspective and with a dialectical and sociological hermeneutic approach, the aim is to interpret the ontological transformations (subjectivity, truth, power) (...) expressed in these classical and founding texts, in relation to the contemporary problematic of reconciliation in Canada. Finally, the author proposes to arbitrate a conflict of interpretations between Enrique Dussel and Walter Mignolo about the meaning of Bartolomé de las Casas’ work. (shrink)

This article explores several issues pertaining to the role of titles in Byzantine literature. Firstly, some methodological questions are raised regarding their authority and authorship as well as the delineation of the research subject. Secondly, a specific case is discussed of how a 9th/10th-century anthology uses titles to identify the writings it quotes from. In a more extensive third and final section, the semantic evolution is retraced of the term ὑπόμνημα, which has been used with quite diverging meanings throughout Greek (...) literature. (shrink)
