The writer responds to the essay “Developing, Administering, and Scoring the Healthcare Ethics Consultant Certification Examination,” by Courtenay R. Bruce et al., in the September‐October 2019 issue of the Hastings Center Report.

Continuing his quest to bring American philosophy back to its roots, Bruce Wilshire connects the work of such thinkers as Thoreau, Emerson, Dewey, and James with Native American beliefs and practices. His search is not for exact parallels, but rather for fundamental affinities between the equally "organismic" thought systems of indigenous peoples and classic American philosophers. Wilshire gives particular emphasis to the affinities between Black Elk’s view of the hoop of the world and Emerson’s notion of horizon, and also (...) between a shaman’s healing practices and James’s ideas of pure experience, willingness to believe, and a pluralistic universe. As these connections come into focus, the book shows how European phenomenology was inspired and influenced by the classic American philosophers, whose own work reveals the inspiration and influence of indigenous thought. Wilshire’s book also reveals how artificial are the walls that separate the sciences and the humanities in academia, and that separate Continental from Anglo-American thought within the single discipline of philosophy. Legal decision-making emphasizes, in a very self-conscious way, the justificatory significance of reasons. This paper argues that the obligation to provide reasons for choices, which must be articulated and structured around a set of generally shared and publicly comprehensible categories of thought, can serve to make the space of possible choices ‘concept sensitive’ in a very useful way. In particular, concept sensitivity has the effect of restricting certain movements within the choice space so that some of the systematic difficulties in (...) achieving an equilibrium in social choice which arise out of an excess of rational doing are avoided. The resulting equilibrium is path dependent. But because it is dependent on a choice path which ‘makes sense’ (or is ordered by thought precisely because it is concept sensitive), it is not the sort of arbitary path-dependent social choice which originally concerned Kenneth Arrow. This paper illustrates these points with examples from criminal law procedure, contract law and constitutional law. (shrink)

This book is a exploration of the notion of personal identity. Here it is shown how the various attempts to give an account of personal identity are all based on false assumptions and so inevitably run aground. One of the first Western thinkers to realize this was David Hume, the 18th century empiricist philosopher who argued that self was a fiction. A new interpretation of Hume's no-self theory is put forward by arguing for an eliminative rather than a reductive point (...) of view of personal identity, and by approaching the problem in terms of phenomenology, Buddhist critiques of the notion of the self, and the idea of a constructed self-image. No Self to Be Found explores the problem of personal identity from the most basic level by raising the question of the existence of personal identity itself. (shrink)

First published in 1889. This re-issues the second, revised edition of 1926. Chuang Tzu was to Lao Tzu, the author of Tao Tê Ching, as Hui-neng, the sixth Patriarch of Zen Buddhism, was to Bodhidharma, and in some respects St.Paul to Jesus; he expanded the original teaching into a system and was thus the founder of Tao-ism. Whereas Lao Tzu was a contemporary of Confucius in the sixth century B.C, Chuang Tzu lived over two hundred years later. He was one (...) of the greatest minds produced by China; philosopher, metaphysician, moralist and poet. It is impossible to understand the spiritual depth of the Tao Tê Ching without the aid of Chuang Tzu. (shrink)

The Nature of Sexual Desire takes the reader on a fascinating journey through the psychology, philosophy, and anthropology of this most urgent of human desires. Plagiarism strikes at the heart of academe, eroding the fundamental value of academic research. Recent evidence suggests that acts of plagiarism and awareness of these acts are on the rise in academia. To address this issue, a vein of research has emerged in recent years exploring plagiarism as an area of academic inquiry. In this new academic subject, case studies and analysis have been one of the most influential methodologies employed. Case studies provide a venue where acts of plagiarism can (...) be discussed and analyzed in a constructive manner, and that is the primary purpose of this article. Unlike previous studies, however, we focus on the role of the publisher, a key player in dealing with acts of plagiarism, but one who has received little attention in the academic literature. Specifically, we examine how an academic publisher addressed allegations of plagiarism and how the publisher’s decision-making affected the outcome. We analyze the case by applying the guidelines from different frameworks and ethical theory and develop recommendations from the lessons evidenced, the second main objective of our article. This analysis advances the dialog on academic plagiarism by exploring the role of the publisher from a deontological perspective of ethical absolutism. (shrink)

Summary During the past decade, the cultural restorationist wing of the New Right has sought to impose its own anachronistic and sentimental conception of ?British culture? on schools and colleges. This conception, which is little more than a glib celebration of quintessential ?Englishness?, characterises the national culture in largely monolithic and ethnically undifferen?tiated terms. Concerned about the possible pernicious effects of educational policies inspired by such thinking, we present the findings of a recently completed ethnographic study of 8?11 year?olds? conceptions (...) of British national culture. Our paper considers the extent to which children's understanding of this complex form of collective identity may vary with age, and ethnicity. We conclude by exploring the implications of the findings for anti?racist and multicultural education. (shrink)

In this paper, I wish to consider Watsuji Tetsuro's (1889?1960) concept of climate (fudo), and consider whether it contributes anything to the relationship between climate change and ethics. I will argue that superficially it seems that fudo tells us little about the ethics of climate change, but if considered more carefully, and through the lens of thinkers such as Deleuze and Heidegger, there is ethical insight in Watsuji's approach. Watsuji's major work in ethics, Rinrigaku, provides concepts such as between-ness and (...) trust that enable his philosophy of climate to move from a theory of national characters (as Fudo is often seen to be) to an approach to living well within one's milieu. Despite the popularity of equality as a political value, egalitarianism as a political theory has never, I think, been fully or successfully defended. I aim in this paper to begin the defense of such a view. The egalitarianism I have in mind has as its ideal a condition of equal wellbeing for all persons at the highest possible level of well-being, i.e. maximum equal well-being. Egalitarianism holds that society should be arranged so as to promote and maintain this state. Defending (...) such a view involves, as I see it, three tasks. First, the ideal I have Just mentioned must be made clearer and more specific and its implications for the distribution of particular goods such as material possessions and liberty must be revealed. Second, positive arguments must be given in support of an equal distribution of well-being as a requirement of morality and Justice. And, thirdly, arguments to the effect that there are Just or Justified inequalities which seriously outweigh the claims of equality must be rebutted. (shrink)

Two objections have been raised against the re-creationist thesis that the individual human person can be re-created after death. The objection that the re-created person would not be the same person as the deceased because he would lack spatial-temporal continuity with that person I answer by showing that spatial-temporal continuity with that person is not a necessary condition for all cases of personal identity. To the objection that the decision to call the re-created individual the same as the deceased either (...) uses criteria like memory which themselves presuppose bodily continuity or is merely an unjustified convention, I show that these criteria do not presuppose continuity, and through a decision is called for, it is not an unjustifiable or arbitrary decision. Compulsory psychiatric treatment is the norm in many Western countries, despite the increasingly individualistic and autonomous approach to medical interventions. Community Treatment Orders are the singular best example of this, requiring community patients to accept a variety of interventions, both pharmacological and social, despite their explicit wish not to do so. The epidemiological, medical/treatment and legal intricacies of CTOs have been examined in detail, however the ethical considerations are less commonly considered. Principlism, the normative ethical code based on the principles (...) of autonomy, beneficence, non-maleficence and justice, underpins modern medical ethics. Conflict exists between patient centred commentary that reflects individual autonomy in decision making and the need for supported decision making, as described in the Convention on the Rights of Persons with Disabilities and the increasing use of such coercive measures, which undermines this principle. What appears to have been lost is the analysis of whether CTOs, or any coercive measure in psychiatric practice measures up against these ethical principles. We consider whether CTOs, as an exemplar of coercive psychiatric practice, measures up against the tenets of principalism in the modern context in order to further this debate. (shrink)

Following Axel Honneth, I accept that recognition is integral to individuals’ self-realization and to social justice and that instances of misrecognition are injustices that cause moral injuries. The change in approach to misrecognition that I advocate is to replace a macrosocial top-down picture of misrecognition, such as Honneth’s typology, with a fine-grained phenomenological picture of multiple dimensions in misrecognition behaviors that offers greater explanatory power. This paper explains why a multidimensional view of misrecognition is needed and explores the various ways (...) that engagement with pathological norms or disengagement from individuals lead to injustices of misrecognition and how understanding behaviors in terms of these two dimensions—norms and individuals—illuminates causes of injustice. The multidimensional view of misrecognition replaces Honneth’s binary view of misrecognition as the contrary to recognition without replacing Honneth’s conceptions of the value of recognition. Recent work in artificial intelligence, or AI, has produced programs capable of serious intellectual work in science. Results from AI are used to show that there exist mechanized procedures for discovering hypotheses and that these methods often lead to plausible hypotheses. The question to be answered is: By what methods can a computer program find plausible explanations of empirical data? To answer this, the common metaphor of search for describing several AI programs is examined followed by a look at examples (...) of programs actually constructed. Five types of search considered are: random, exhaustive, selective, heuristic, and opportunistic search. From there, the paper generalizes to some conclusions about mechanizing hypothesis formation. A formal system for Ł ${}_{\infty}$ , based on a "game-theoretic" analysis of the Łukasiewicz propositional connectives, is defined and proved to be complete. An "Herbrand theorem" for the Ł ${}_{\infty}$ predicate calculus (a variant of some work of Mostowski) and some corollaries relating to its axiomatizability are proved. The predicate calculus with equality is also considered.

This volume explores leadership as a form of loving one’s employees, centering on the biblical concepts of Agapao and Agape.
