Democratic theorists often distinguish between two views of democratic procedures. ‘Outcomes theorists’ emphasize the instrumental nature of these procedures and argue that they are only valuable because they tend to produce good outcomes. In contrast, ‘proceduralists’ emphasize the intrinsic value of democratic procedures, for instance, on the grounds that they are fair. In this paper. I argue that we should reject pure versions of these two theories in favor of an understanding of the democratic ideal that recognizes a commitment to (...) both intrinsically valuable democratic procedures and democratic outcomes. In instances in which there is a conflict between these two commitments, I suggest they must be balanced. This balancing approach offers a justification of judicial review on the grounds that it potentially limits outcomes that undermine democracy. But judicial review is not justifiable in any instance in which a bad democratic outcome results from democratic procedures. When the loss that would result from overturning a democratic procedure is greater than the gain to democracy that would result from ensuring against an undemocratic outcome; judicial review is not justifiable. Loss or gain to democracy is defined by the negative or positive impact of each action on the core democratic values of equality and autonomy, aspects of the democratic ideal. Even when judicial review is justified, the fact that it overturns intrinsically valuable procedures suggests that such review is never ideal from the standpoint of democracy. (shrink)

In this paper, we reconstruct Kant’s notion of the practically conditioned, introduced in the Dialectic of Pure Practical Reason, by drawing on Kant’s general account of the faculty of reason presented in the Transcendental Dialectic of the Critique of Pure Reason. We argue that practical reason’s activity of seeking the practically unconditioned for a given condition generates two different conceptions of the practically unconditioned and identify these as virtue and (the ideal of) happiness. We then account for how and why (...) reason proceeds to combine these two distinct ideas into the composite idea of the highest good. Last, we draw on our discussion to determine more precisely what Kant intends by the ‘supremacy’ of virtue within reason’s idea of the highest good. (shrink)

When the Supreme Court in 2003 struck down a Texas law prohibiting homosexual sodomy, it cited the right to privacy based on the guarantee of "substantive due process" embodied by the Constitution. But did the court act undemocratically by overriding the rights of the majority of voters in Texas? Scholars often point to such cases as exposing a fundamental tension between the democratic principle of majority rule and the liberal concern to protect individual rights. Democratic Rights challenges this view by (...) showing that, in fact, democracy demands many of these rights. Corey Brettschneider argues that ideal democracy is comprised of three core values--political autonomy, equality of interests, and reciprocity--with both procedural and substantive implications. These values entitle citizens not only to procedural rights of participation but also to substantive rights that a "pure procedural" democracy might not protect. What are often seen as distinctly liberal substantive rights to privacy, property, and welfare can, then, be understood within what Brettschneider terms a "value theory of democracy." Drawing on the work of John Rawls and deliberative democrats such as Jürgen Habermas, he demonstrates that such rights are essential components of--rather than constraints on--an ideal democracy. Thus, while defenders of the democratic ideal rightly seek the power of all to participate, they should also demand the rights that are the substance of self-government. (shrink)

Corey W. Dyck presents a new account of Kant's criticism of the rational investigation of the soul in his monumental Critique of Pure Reason, in light of its eighteenth-century German context. When characterizing the rational psychology that is Kant's target in the Paralogisms of Pure Reason chapter of the Critique commentators typically only refer to an approach to, and an account of, the soul found principally in the thought of Descartes and Leibniz. But Dyck argues that to do so (...) is to overlook the distinctive rational psychology developed by Christian Wolff, which emphasized the empirical foundation of any rational cognition of the soul, and which was widely influential among eighteenth-century German philosophers, including Kant. In this book, Dyck reveals how the received conception of the aim and results of Kant's Paralogisms must be revised in light of a proper understanding of the rational psychology that is the most proximate target of Kant's attack. In particular, he contends that Kant's criticism hinges upon exposing the illusory basis of the rational psychologist's claims inasmuch as he falls prey to the appearance of the soul as being given in inner experience. Some have recently argued that the current generation dominates future generations by causing long-term climate change. They relate these claims to Philip Pettit and Frank Lovett's neorepublican theory of domination. In this paper, I examine their claims and ask whether the neorepublican conception of domination remains theoretically coherent when the relation is between current agents and nonoverlapping future subjects. I differentiate between an ‘outcome’ and a ‘relational’ conception of domination. Explores the notion of selfhood in the wake of the post-structuralist debates.

In this article, I outline a framework for the sociological study of culture that connects three intertwined elements of human culture and demonstrates the concrete contexts under which each most critically influences actions and their subsequent outcomes. In contrast to models that cast motivations, resources, and meanings as competing explanations of how culture affects action, I argue that these are fundamental constituent elements of culture that are inseparable, interdependent, and simultaneously operative. Which element provides the strongest link to action, and (...) how this link operates, must be understood as a function of the actor's position within wider social contexts. I argue that on average motivations have the most discernable link to action within a social strata, cultural resources provide the strongest link across strata, and meanings have the greatest direct influence when codified and sanctioned. I then offer a reframing and synthesis that reintegrates previously “competing” theories of culture into a more holistic context-dependent model of culture in action. Finally, I use evidence from prior empirical research, as well as new data from an ongoing ethnographic study of health behaviors among the aged, to show how various elements of culture are concretely linked to action in eight different social contexts. In doing so, I provide a roadmap for the transition out of the “either-or” logic underlying much of cultural theory and reemphasize the importance of the classical sociological concern for “when” and “how” various aspects of culture influence action and outcomes in concrete social contexts. In this paper, I consider Baumgarten’s views on the soul in the context of the Pietist critique of Wolff’s rational psychology. My primary aim is to account for the largely unacknowledged differences between Wolff’s and Baumgarten’s rational psychology, though I also hope to show that, in some cases, the Pietists were rather more perceptive in their reading of Wolff than they are typically given credit for as their criticisms frequently succeed in drawing attention to significant omissions in Wolff’s discussion.

There is great interest in understanding whether and how mood influences affective processing. Results in the literature have been mixed: some studies show mood-congruent processing but others do not. One limitation of previous work is that decision components for affective processing and responses biases are not dissociated. The present study explored the roles of affective processing and response biases using a drift-diffusion model of simple choice. In two experiments, participants decided if words were emotionally positive or negative while listening to (...) music that induced positive or negative mood. The behavioural results showed weak, inconsistent mood-congruency effects. In contrast, the DDM showed consistent effects that were selectively driven by an a-priori bias in response expectation, suggesting that music-induced mood influences expectations about the emotionality of upcoming stimuli, but not the emotionality of the stimuli themselves. Implications for future studies of emotional classification and mood are subsequently discussed. (shrink)

Representation is central to contemporary theorizing about the mind/brain. But the nature of representation--both in the mind/brain and more generally--is a source of ongoing controversy. One way of categorizing representational types is to distinguish between the analog and the digital: the received view is that analog representations vary smoothly, while digital representations vary in a step-wise manner. I argue that this characterization is inadequate to account for the ways in which representation is used in cognitive science; in its place, I (...) suggest an alternative taxonomy. I will defend and extend David Lewis's account of analog and digital representation, distinguishing analog from continuous representation, as well as digital from discrete representation. I will argue that the distinctions available in this four-fold account accord with representational features of theoretical interest in cognitive science more usefully than the received analog/digital dichotomy. Previous research has alluded to the predominance of atheism in participant pools of the Nonhuman Animal rights movement (Galvin and Herzog 1992; Guither 1998), as well as the correlation between atheism and support for anti-speciesism (Gabriel et al. 2012; The Humane League 2014), but no study to date has independently examined this demographic. This article presents a profile of 210 atheists and agnostics, derived from a larger survey of 287 American vegans conducted in early 2017. Results demonstrate that atheists constitute (...) one of the movement's largest demographics, and that atheist and agnostic vegans are more likely to adopt veganism out of concern for other animals. While these vegans did not register a higher level of social movement participation than religious vegans, they were more intersectionally oriented and more likely to politically identify with the far left. Given the Nonhuman Animal rights movement's overall failure to target atheists, these findings suggest a strategic oversight in overlooking the movement's potentially most receptive demographic. Relative to digital computation, analogue computation has been neglected in the philosophical literature. To the extent that attention has been paid to analogue computation, it has been misunderstood. The received view—that analogue computation has to do essentially with continuity—is simply wrong, as shown by careful attention to historical examples of discontinuous, discrete analogue computers. Instead of the received view, I develop an account of analogue computation in terms of a particular type of analogue representation that allows for discontinuity. This account (...) thus characterizes all types of analogue computation, whether continuous or discrete. Furthermore, the structure of this account can be generalized to other types of computation: analogue computation essentially involves analogue representation, whereas digital computation essentially involves digital representation. Besides being a necessary component of a complete philosophical understanding of computation in general, understanding analogue computation is important for computational explanation in contemporary neuroscience and cognitive science. This paper brings empirical and theoretical studies of ethical leadership into conversation with one another in an effort to determine the antecedent to perceived ethical leadership. Employing a Levinasian perspective, I argue that ethical leadership entails being faced with the impossible task of realizing the needs of many individual others. For this reason, I argue, perceived ethical leadership is grounded in an employee’s perception that a leader struggles to make decisions based on the conflicting demands placed upon her. More important (...) than the result of a leader’s decision is the degree to which the leader demonstrates concern for the well-being of others in her decision-making process. I ground my discussion through reference to results of empirical studies on behaviors associated with ethical leadership, including Brown, Treviño, and Harrison, Kalshoven, Den Hartog, and De Hoogh, and Treviño, Hartman, and Brown. I identify several mediating factors which may influence employee perception of ethical leadership, proposing avenues for further research which can help to clarify the relationship between concrete leadership behaviors and perceived ethical leadership. When faced with a dilemma between believing what is supported by an impartial assessment of the evidence (e.g., that one's friend is guilty of a crime) and believing what would better fulfill a moral obligation (e.g., that the friend is innocent), people often believe in line with the latter. But is this how people think beliefs ought to be formed? We addressed this question across three studies and found that, across a diverse set of everyday situations, people treat moral considerations (...) as legitimate grounds for believing propositions that are unsupported by objective, evidence-based reasoning. We further document two ways in which moral considerations affect how people evaluate others' beliefs. First, the moral value of a belief affects the evidential threshold required to believe, such that morally beneficial beliefs demand less evidence than morally risky beliefs. Second, people sometimes treat the moral value of a belief as an independent justification for belief, and on that basis, sometimes prescribe evidentially poor beliefs to others. Together these results show that, in the folk ethics of belief, morality can justify and demand motivated reasoning. (shrink)

Purpose The purpose of this paper is to develop an ethical framework for the marketing of corporate social responsibility. Methods The approach is a conceptual one based on virtue ethics and on the corporate identity literature. Furthermore, empirical research results are used to describe the opportunities and pitfalls of using marketing communication tools in the strategy of building a virtuous corporate brand. Results/conclusions An ethical framework that addresses the paradoxical relation between the consequentialist perspective many proponents of the marketing of (...) CSR adopt, and ethical perspectives which criticize an exclusive profit-oriented approach to CSR. Furthermore, three CSR strategies in relation to the marketing of CSR are discussed. For each CSR strategy it is explored how a corporation could avoid falling into the promise/performance gap. (shrink)

Pierre Duhem’s influential argument for holism relies on a view of the role that background theory plays in testing: according to this still common account of “auxiliary hypotheses,” elements of background theory serve as truth-apt premises in arguments for or against a hypothesis. I argue that this view is mistaken. Rather than serving as truth-apt premises in arguments, auxiliary hypotheses are employed as “epistemic tools”: instruments that perform specific tasks in connecting our theoretical questions with the world but that are (...) not premises in arguments. On the resulting picture, the acceptability of an auxiliary hypothesis depends not on its truth but on contextual factors such as the task or purpose it is put to and the other tools employed alongside it. ABSTRACTDiscussions of the reception of materialist thought in Germany in the first half of the eighteenth century tend to focus, naturally enough, upon the homegrown freethinkers who advanced the cause of Lucretius, Hobbes, and Spinoza in clandestine publications and frequently courted the ire of the state for doing so. If the philosophers belonging to the mainstream of German intellectual life in that period are accorded a place in the story, it is only insofar as they actively set themselves against the (...) materialist threat and, in the course of working to undermine it, actually only succeeded in inadvertently drawing more popular attention to it. For much of his career, British political philosopher Michael Oakeshott was identified with Margaret Thatcher’s conservative policies. He has been called by some a guru to the Tories, while others have considered him one of the last proponents of British Idealism. Best known for such books as _Experience and Its Modes_ and _Rationalism in Politics_, Oakeshott has been the subject of numerous studies, but always with an emphasis on his political thought. Elizabeth Campbell Corey now makes the case that (...) Oakeshott’s moral and political philosophies are more informed by religious and aesthetic considerations than has previously been supposed. Hers is the first book-length study of this premise, arguing that Oakeshott’s views on aesthetics, religion, and morality are intimately linked in a creative moral personality that underlies his political theorizing. Corey focuses on a wealth of early material from Oakeshott’s career that has only recently been published, as well as his acclaimed “Tower of Babel” essays, to show that these works illuminate his thinking in ways that could not have been realized prior to their publication. She places Oakeshott squarely in the Augustinian tradition, citing his 1929 essay “Religion and the World,” and then identifies his departure from it. She explores Oakeshott’s recurring theme of “living one’s life in the present”; examines his explicit discussions of religion, aesthetics, and morality; and then considers his political thought in light of this moral vision. She finally compares his idea of Rationalism to Eric Voegelin’s concept of Gnosticism and considers both thinkers’ treatment of Hobbes to delineate their philosophical differences. Through this insightful analysis, Corey shows Oakeshott to be not merely a political philosopher but a thinker with humanistic interests—one who throughout his life was deeply interested in the question of what it means to be human and was moved by art, poetry, and religion while recognizing the necessary evil of political arrangements in order for those activities to flourish. Her work is a major step in a reevaluation of Oakeshott, showing that his conservatism has been greatly misunderstood and that he is more properly regarded as a philosopher whose vision of the human condition, while oftentimes detached and skeptical, is also romantic and inspired. Abstract:“Black art” is often understood as being inherently political. In examining two major Black arts movements, the Harlem Renaissance and the Black Arts movement, many of the works attributed to those periods fit the description of “political art” but not all of them. Black art movements are not defined exclusively by similar styles or methodologies, like Expressionism or Surrealism, either. Instead, Black art movements are complex movements that blend social, political, and aesthetic criteria. In this article, I list seven conditions (...) that I take to be jointly sufficient for a Black art movement to be signified as such. In this assertion, I also argue that this current era, paralleling the Black Lives Matter movement, is worthy of Black art movement signification, if we update the mediums by which the conditions are met in the Harlem Renaissance and the Black Arts movement. Climate scientists often apply statistical tools to a set of different estimates generated by an “ensemble” of models. In this paper, I argue that the resulting inferences are justified in the same way as any other statistical inference: what must be demonstrated is that the statistical model that licenses the inferences accurately represents the probabilistic relationship between data and target. This view of statistical practice is appropriately termed “model-based,” and I examine the use of statistics in climate fingerprinting to show (...) how the difficulties that climate scientists encounter in applying statistics to ensemble-generated data are the practical difficulties of normal statistical practice. The upshot is that whether the application of statistics to ensemble-generated data yields trustworthy results should be expected to vary from case to case. (shrink)

Jasper and Poulsen have long argued that moral shocks are critical for recruitment in the nonhuman animal rights movement. Building on this, Decoux argues that the abolitionist faction of the nonhuman animal rights movement fails to recruit members because it does not effectively utilize descriptions of suffering. However, the effectiveness of moral shocks and subsequent emotional reactions has been questioned. This article reviews the literature surrounding the use of moral shocks in social movements. Based on this review, it is suggested (...) that the exploitation of emotional reactions to depictions of suffering can sometimes prove beneficial to recruitment, but successful use is contextually rooted in preexisting frameworks, ideology, and identity. It is concluded that a reliance on images and narratives might be misconstrued in a society dominated by nonhuman animal welfare ideology. (shrink)

Feminist thinkers have long criticized liberal theory’s public/private distinction for perpetuating indifference to injustices within the family. Thinkers such as Susan Okin have extended this criticism in evaluating the theory of political liberalism, suggesting that this theory’s reliance on a public conception of citizenship renders it indifferent to the way in which the internal politics of the family can undermine equality.However, I argue in this article that the feminist concern to ensure equality within the domestic sphere can in fact be (...) incorporated into a reconstructed account of political liberalism. Central to my strong public reconstruction is the principle of publicly justifiable privacy, according to which the public/private distinction itselfmust be formulated with reference to the values of free and equal citizenship. On my account, the public values of citizenship should figure prominently in evaluations of family life. This reformulation of the public/private distinction answers feminist critics who suggest that political liberalism fails to offer a politics of the personal. (shrink)

Considered in light of the reader’s expectation of a thoroughgoing criticism of the pretensions of the rational psychologist, and of the wealth of discussions available in the broader 18th century context, which includes a variety of proofs that do not explicitly turn on the identification of the soul as a simple substance, Kant’s discussion of immortality in the Paralogisms falls lamentably short. However, outside of the Paralogisms (and the published works generally), Kant had much more to say about the arguments (...) for the soul’s immortality as he devoted considerable time to the topic throughout his career in his lectures on metaphysics. In fact, as I show in this paper, the student lecture notes prove to be an indispensable supplement to the treatment in the Paralogisms, not only for illuminating Kant’s criticism of the rational psychologist’s views on the immortality of the soul, but also in reconciling this criticism with Kant’s own positive claims regarding certain theoretical proofs of immortality.
