In many cases of criminality within large corporations, senior management does not commit the operative offense—or conspire or assist in it—but nonetheless bears serious responsibility for the crime. That responsibility can derive from, among other things, management’s role in cultivating corporate culture, in failing to police effectively within the firm, and in accepting lavish compensation for taking the firm’s reins. Criminal law does not include any doctrinal means for transposing that form of responsibility into punishment. Arguments for expanding doctrine—including broadening (...) of the presently narrow “responsible corporate officer” doctrine—so as to authorize such punishment do not fare well under the justificatory demands of criminal law theory. The principal obstacle to such arguments is the large industrial corporation itself, which necessarily entails kinds and degrees of delegation and risk-taking that do not fit well with settled concepts about mens rea and omission liability. Even the most egregious and harmful management failures must be addressed through design and regulation of the corporation rather than imposition of individual criminal liability. (shrink)

A critique of the hypothesis of extended cognition.

This project explored what constitutes “ethical practice of mathematics”. Thematic analysis of ethical practice standards from mathematics-adjacent disciplines (statistics and computing), were combined with two organizational codes of conduct and community input resulting in over 100 items. These analyses identified 29 of the 52 items in the 2018 American Statistical Association Ethical Guidelines for Statistical Practice, and 15 of the 24 additional (unique) items from the 2018 Association of Computing Machinery Code of Ethics for inclusion. Three of the 29 items (...) synthesized from the 2019 American Mathematical Society Code of Ethics, and zero of the Mathematical Association of America Code of Ethics, were identified as reflective of “ethical mathematical practice” beyond items already identified from the other two codes. The community contributed six unique items. Item stems were standardized to, “The ethical mathematics practitioner…”. Invitations to complete the 30-min online survey were shared nationally (US) via Mathematics organization listservs and other widespread emails and announcements. We received 142 individual responses to the national survey, 75% of whom endorsed 41/52 items, with 90–100% endorsing 20/52 items on the survey. Items from different sources were endorsed at both high and low rates. A final thematic analysis yielded 44 items, grouped into “General” (12 items), “Profession” (10 items) and “Scholarship” (11 items). Moreover, for the practitioner in a leader/mentor/supervisor/instructor role, there are an additional 11 items (4 General/7 Professional). These results suggest that the community perceives a much wider range of behaviors by mathematicians to be subject to ethical practice standards than had been previously included in professional organization codes. The results provide evidence against the argument that mathematics practitioners engaged in “pure” or “theoretical” work have minimal, small, or no ethical obligations. (shrink)

Critics of Divine Command Theory (DCT) have advanced the counterpossible terrible commands objection. They argue that DCT implies the counterpossible ‘If a necessarily morally perfect God commanded us to perform a terrible act, then the terrible act would be morally obligatory.’ However, this counterpossible is false. Hence, DCT is false. Philipp Kremers has proposed that the intuition that the counterpossible above is false is due to conversational implicatures. By providing a pragmatic explanation for the intuition, he thinks that DCT proponents (...) can then maintain that the counterpossible is actually true. In this article, I argue that Kremers's conversational implicature response fails because (a) there is good reason to think that no conversational implicature arises given what critics of DCT have expressed, (b) a competent reader would not understand the critics' utterance that TCC is false as implicating that TCC* is false, and (c) the counterpossible terrible commands objection can be easily modified to be immune to the conversational implicature response by cancelling any potential implicature. Thus, an appeal to conversational implicatures cannot save DCT from the counterpossible terrible commands objection. (shrink)

Hannah Arendt disavowed the title of “philosopher,” and is known above all as a political theorist. But the relationship between philosophy and politics animates her entire oeuvre. We find her addressing the topic in The Human Condition (1958), in Between Past and Future (a collection of essays written in the early 1960s), and in Men in Dark Times (another collection of essays, this one from the late sixties). It is treated in her Lectures on Kant’s Political Philosophy, composed during the (...) seventies, and also in the posthumous Life of the Mind, two of three projected volumes of which were complete when she died in 1975. Certainly, Arendt’s thought cannot be understood without taking into account her deep suspicion of and equally deep commitment to philosophy in the context of political reflection. For all that, her writings on this abiding preoccupation do not gel into a systematically articulated theory or programmatic statement. Instead, they reflect Arendt’s appreciation of what remained for her a “vital tension” – an enigma. (shrink)

Histories of German philosophy in the nineteenth century typically focus on its first half--when Hegel, idealism, and Romanticism dominated. By contrast, the remainder of the century, after Hegel's death, has been relatively neglected because it has been seen as a period of stagnation and decline. But Frederick Beiser argues that the second half of the century was in fact one of the most revolutionary periods in modern philosophy because the nature of philosophy itself was up for grabs and the (...) very absence of certainty led to creativity and the start of a new era. Over the past 3 years, the authors have pursued unique cross-college collaboration. They have hosted a National Endowment for the Humanities (NEH)–funded Humanities Gaming Institute and team-taught a cross-listed course that brought together students from the humanities and computer science. Currently, they are overseeing the development of an NEH-supported social history game called Desperate Fishwives. In the process, the authors have realized that “game” is not the most appropriate designator for the kind of projects they are pursuing. Instead, they propose (...) critical interactives, a term that suggests projects that mobilize ludic methods in order to engage participants in socially and politically sensitive, indeed controversial, subject matter. Their most recent project, Ghosts of the Horseshoe, offers an initial look at how critical interactives are particularly apt at raising awareness about the relations among institutional policy, broader public policy, and the ways that people negotiate the public history of a particular place. This book is the first comprehensive study of Rousseau's rich and complex theory of the type of self-love (amour proper) that, for him, marks the central difference between humans and the beasts. Amour proper is the passion that drives human individuals to seek the esteem, approval, admiration, or love--the recognition--of their fellow beings. Neuhouser reconstructs Rousseau's understanding of what the drive for recognition is, why it is so problematic, and how its presence opens up far-reaching developmental possibilities for creatures that (...) possess it. One of Rousseau's central theses is that amour proper in its corrupted, manifestations--pride or vanity--is the principal source of an array of evils so widespread that they can easily appear to be necessary features of the human condition: enslavement, conflict, vice, misery, and self-estrangement. Yet Rousseau also argues that solving these problems depends not on suppressing or overcoming the drive for recognition but on cultivating it so that it contributes positively to the achievement of freedom, peace, virtue, happiness, and unalienated selfhood. Indeed, Rousseau goes so far as to claim that, despite its many dangers, the need for recognition is a condition of nearly everything that makes human life valuable and that elevates it above mere animal existence: rationality, morality, freedom--subjectivity itself--would be impossible for humans if it were not for amour proper and the relations to others it impels us to establish. Weltschmerz is a study of the pessimism that dominated German philosophy in the second half of the nineteenth century. Pessimism was essentially the theory that life is not worth living, and was introduced into German philosophy by Schopenhauer. Frederick C. Beiser examines the intense and long controversy that arose from Schopenhauer's pessimism, which changed the agenda of philosophy in Germany away from the logic of the sciences and toward an examination of the value of life. He examines the major (...) defenders of pessimism and its chief critics, especially Eugen Dühring and the neo-Kantians. The pessimism dispute of the second half of the century has been largely ignored in secondary literature and this book is a first attempt since the 1880s to re-examine it and to analyze the important philosophical issues raised by it.
