One barrier to optimal pain management in the neonatal intensive care unit is how the healthcare community perceives, and therefore manages, neonatal pain. In this paper, we emphasise that healthcare professionals not only have a professional obligation to care for neonates in the NICU, but that these patients are intrinsically worthy of care. We discuss the conditions that make neonates worthy recipients of pain management by highlighting how neonates are vulnerable to pain and harm, and completely dependent on others for (...) pain management. We argue for a relational account of ethical decision-making in the NICU by demonstrating how an increase in vulnerability and dependence may be experienced by the healthcare community and the neonate’s family. Finally, an ethical framework for decisions around neonatal pain management is proposed, focussing on surrogate decision-making and the importance of compassionate action through both a reflective and an affective empathy. As empathy can be highly motivating against pain, we propose that, in addition to educational programs that raise awareness and knowledge of neonatal pain and pain management, healthcare professionals must cultivate empathy in a collective manner, where all members of the NICU team, including parents, are compassionate decision-makers. Dramatic modern advances in emergency and resuscitation medicine, starting perhaps with the development of effective mechanical ventilators in the mid-20th century, have created a large class of persons who in earlier times would almost certainly have died, but who can now go on existing, suspended at least temporarily in a state somewhere between death and the conscious life they formerly pursued. A very wide range of brain injuries lead first to coma, in which the patient shows no sign of conscious (...) awareness, or even of wakefulness, in which eye openings and closings indicate the presence of a sleep/wake cycle unconsciously mediated by structures in the brain stem. Following emergence from coma, which may take days to months or more if it happens at all, patients typically show signs of wakefulness without conscious awareness – they are then in a so-called vegetative state (VS). For many this state becomes permanent, but some go on to a more recently described condition called the minimally conscious state (MCS), in which signs of conscious awareness can be detected by careful neurological examination (see Laureys & Tononi, 2009, chapter 14). A very few such persons ultimately progress to more or less full recovery, but another and particularly horrifying possible outcome is the “locked-in” state, in which a patient is fully conscious but has extremely little or no capacity for voluntary motor action. A famous modern example is that of Jean-Dominique Bauby, author of The Diving Bell and the Butterfly, who suffered a stroke to his upper brainstem and awakened 20 days later to find himself fully conscious but capable only of blinking his left eye. A tiny fraction of surgical patients find themselves in similarly terrifying conditions caused by the combination of muscle relaxants with insufficient levels of anesthetic agents (Kelly et al., 2007, p. 387 n. 18). Thus Hegel's philosophy did not, as it were, merely paint "gray on gray." Not surprisingly, however, contemporary interest in this "ultimate philosophy" is due chiefly to the suggestive expansion of its insights, rather than to any desire for systematic reconstruction. In a discretionary way, Hegelian problems and patterns have gained a new lease in the fields of social and religious thought and among those for whom classical political theory is not a dead exercise. One might say that Hegel (...) remains vital because he continues to raise polemical questions. When a giant structure of human speculation is superseded—a fate which some feel, wrongly I think, that Hegel tacitly acknowledged for his own philosophy—but survives in membris disjectis, anthologies tend to be compiled for partisan purposes. Karl Löwith reminds us that this was the destiny of the fragile Hegelian balance in the hands of the philosopher's immediate disciples. The last generation has seen a renewal of this Kulturkampf, but now on the far side of total war, Marxism, and religious crisis. The opposition of "What did Hegel mean?" and "What does Hegel mean for us?" is posed and reposed. I personally feel—as a historian of ideas—that some intellectual mischief is caused by the failure to raise the two questions in mutual rapport. (shrink)

This article explores the representational practices of feminist theorising around gender and violence. Adapting Liz Kelly’s notion of the continuum of women’s experiences of sexual violence, I argue that ‘continuum thinking’ can offer important interventions which unsettle binaries, recognise grey areas in women’s experiences and avoid ‘othering’ specific communities. Continuum thinking allows us to understand connections whilst nevertheless maintaining distinctions that are important conceptually, politically and legally. However, this is dependent upon recognising the multiplicity of continuums in feminist theorising (...) – as well as in policy contexts – and the different ways in which they operate. A discussion of contemporary theory and policy suggests that this multiplicity is not always recognised, resulting in a flattening of distinctions which can make it difficult to recognise the specifically gendered patterns of violence and experience. I conclude by considering how focusing on men’s behaviour might offer one way of unsettling the contemporary orthodoxy which equates gender-based violence and violence against women. (shrink)

Developmental systems theory (DST) is a general theoretical perspective on development, heredity and evolution. It is intended to facilitate the study of interactions between the many factors that influence development without reviving `dichotomous' debates over nature or nurture, gene or environment, biology or culture. Several recent papers have addressed the relationship between DST and the thriving new discipline of evolutionary developmental biology (EDB). The contributions to this literature by evolutionary developmental biologists contain three important misunderstandings of DST.

Alternative food networks are emerging in opposition to industrial food systems, but are criticized as being exclusive, since customers’ ability to patronize these market spaces is premised upon their ability to pay higher prices for what are considered the healthiest, freshest foods. In response, there is growing interest in widening the demographic profile given access to these alternative foods. This research asks: what barriers do alternative food businesses face in providing access and inclusion for low income consumers? Surveys and interviews (...) with 45 alternative food businesses in British Columbia, Canada uncovered five key barriers. The findings indicate that the barriers are symptomatic of structural issues in the Canadian food and social welfare systems. Although opportunities exist for business operators to widen access for low income shoppers, these alone cannot meaningfully ameliorate food-access inequality. Rather, these barriers underscore issues of income-disparity, poverty, and food-access inequality more broadly, and require structural and societal change to rectify. (shrink)

We draw attention to a series of implicit assumptions that have structured the debate about Frege’s Puzzle. Once these assumptions are made explicit, we rely on them to show that if one focuses exclusively on the issues raised by Frege cases, then one obtains a powerful consideration against a fine-grained conception of propositional-attitude content. In light of this consideration, a form of Russellianism about content becomes viable.

I certainly find it easier to recognize the deep continuities within Wittgenstein's thought, than the real nature of the contrasts: one only comes to recognize these for what they are after prolonged engagement with the two works.Heather Gert has offered a reading of Investigations §§ 46-50. Her attention devolves primarily on the notorious standard meter paragraph of § 50. Important to her reading is her conviction about what it is from the Tractatus that is being criticized and about how it (...) is being criticized.I believe Gert's reading of the passage is mistaken. Rips et al. raise important questions about the relation between infant quantification and achievement of natural number concepts. However, they may be oversimplifying the interactions that characterize actual development in real time. Though they propose a worthwhile agenda for future research, its explanatory power will be limited if it does not address developmental issues with greater sensitivity.

While political and ethical philosophers today are familiar with critiques of confinement in both critical prison studies and critical animal studies, The Ethics of Captivity is unusual in that it brings these critiques of incarceration together, bridging human and nonhuman animal liberation movements. While Lisa Guenther’s recent book, Solitary Confinement: Social Death and Its Afterlives, also critiques the mass incarceration of both human and nonhuman animals, it is far more common to see human and animal liberation movements opposed on this (...) issue, as when the incarceration of humans is deplored for treating those individuals like animals. In the summer of 2012, “meat” themed posters were hung throughout the city of Edmonton, Alberta. A textual analysis of three of the posters from this collection revels that the concept of sacrifice is more appropriate to describe “meat”-eating in Alberta than the concept of the absent referent. These posters celebrate the consumption of “meat” and unabashedly make evident the living animal origins of “meat.” I argue that that the prominence of the cattle industry relative to Alberta’s economy, and its (...) ties to the production and reproduction of dominant Albertan identity negate the requirement of the absent referent. The consumption of “beef” is largely considered an expression of loyalty to the region, and as a means to preserve Alberta’s heritage. The noncriminal putting to death of nonhuman animals can instead be understood as symbolic and literal sacrifices in the constitution of dominant Albertan identity and economy. As such, this paper makes an intervention into ecofeminist literature as well as vegan literature written for mainstream populations that employ the absent referent in the aim of countering “meat”-eating practices. Hume’s moral philosophy is a sentiment-based view. Moral judgment is a matter of the passions; certain traits of character count as virtues or vices because of the approval or disapproval they evoke in us, feelings that express concern we have about the social effects of these traits. A sentiment-based approach is attractive, since morality seems fundamentally to involve caring for other people. Sentiment-based views, however, face a real challenge. It is clear that our affections are often particular; we favor certain (...) persons over others. This poses a problem when it comes to determining the proper content of morality. The ties of sentiment would seem to be in tension with the aspirations of morality toward impartiality and universality. (shrink)

Peter Kivy investigates the unity of form and content in the arts, particularly in poetry. While Kivy says much with which I happily agree, I sadly disagree with him about the impossibility of form–content identities. Kivy's arguments fail to compel: there are other ways of understanding form–content identities and the need for them that has been felt by artists and critics. Abstract: In this article I contest a reading of Wittgenstein's Philosophical Investigations —a reading of it as debunking philosophy. I concede that such a reading is not groundless, but I show why it is nonetheless mistaken. To do so, I distinguish two different ways of viewing Philosophical Investigations and its concern with philosophical problems, an External View and an Internal View. On the External View, readers of the book are taken to know ahead of time what philosophical problems are. On (...) the Internal View, readers are not taken to know this ahead of time: the task of the book is to disclose what philosophical problems are, to show them coming into being. One thing disclosed is our participatory role in philosophical problems coming to be. Learning about the nature of philosophical problems is thus learning about our own nature; metaphilosophical knowledge is in part self-knowledge. If the Internal View is correct (as I believe it is), then Philosophical Investigations does not debunk philosophy but provides a different conception of philosophy and the philosopher's task. In this essay, I respond to A. W. Moore’s instructive chapter on Frege. I respond by asking various questions, and I question particularly Moore’s claim that Frege, in reacting to Benno Kerry, falls into Hegelian excess. I toy with responding to my question by regarding Frege as anticipating a Wittgensteinian-Heideggerian exaction. It remains unclear whether this constitutes (much) progress.

This book brings together a team of leading theorists to address the question 'What is the right measure of justice?' Some contributors, following Amartya Sen and Martha Nussbaum, argue that we should focus on capabilities, or what people are able to do and to be. Others, following John Rawls, argue for focussing on social primary goods, the goods which society produces and which people can use. Still others see both views as incomplete and complementary to one another. Their essays evaluate (...) the two approaches in the light of particular issues of social justice - education, health policy, disability, children, gender justice - and the volume concludes with an essay by Amartya Sen, who originated the capabilities approach. What is it to read Wittgenstein resolutely? In this essay, I make a suggestion about how to answer that question. I backtrack in time to a debate about Philosophical Investigations between O. K. Bouwsma and Gilbert Ryle. I selectively reconstruct that debate, highlighting features of it that I take to be interesting in their own right and in relation to debates about PI, but also interesting in analogy with debates about resolute and standard readings of Tractatus logico-philosophicus. As will be (...) clear, my sympathies are with Bouwsma against Ryle, and with resolute readers against standard readers. But I do not vindicate Bouwsma; I will, in fact, be critical, carefully or guardedly critical of him.Nor do I vindicate resolute reading of TLP. I suggest a way of seeing resolute reading that makes clearer what it is and how it contrasts with standard reading, and, in so doing, that makes clearer what some of the difficulties of the debate between the readings really are, whether about TLP or about PI. In this essay I investigate the unity of Emerson's sentences. I begin by describing the phenomenology of reading Emerson and use that phenomenology to orient the investigation. I propose to understand the unity of Emerson's sentences by using a variation of Frege's strategy for understanding the unity of sentences generally. I then address how the unity of the Emerson sentence serves to create the unity of the Emerson paragraph and even of the Emerson essay. Along the way I compare Emerson's (...) essays to Lancelot Andrewes’ sermons. I finish by using the results of the investigation and comparisons to provide a partial reading of “Experience” in which I shed light on the nature of Emerson's encounter with the problematic of skepticism. In this essay, we focus primarily on Moore’s “Proof of an External World” and Kant’s “Refutation of Idealism.” We are not exactly commenting on Clarke’s “The Legacy of Skepticism,” interpreting it, although what we do involves us in (some of) that. Instead of directly commenting on it, we do things with Legacy; we read Moore’s Proof and Kant’s Refutation with Clarke in mind. And by way of doing this, we bring onto the stage a post-Legacy Moore, and a post-Legacy Kant. (...) We do not claim to present Moore and Kant per se (to use Clarke’s term); we do not portray Moore and Kant as they are independently of “The Legacy of Skepticism.” We propose instead Moore and Kant as we read them after Legacy, i.e., in light of the pure/plain distinction. This empirical work attends to the tensions and contradictions medical students articulate when they discuss their objection to industry’s influence in medicine. Findings are based on 50 semi-structured interviews with medical students who are critical of the pharmaceutical industry’s influence in medical education in the United States and Canada. These students advocate evidence-based medicine as one solution to the problems with industry influence in medicine; namely industry bias in medical research. This investigation is an effort to understand why EBM is (...) posed as a solution to industry bias in light of the literature demonstrating the ways that what is considered ‘evidence-based’ is influenced by industry. Participants articulate a struggle to find the ‘best’ evidence in a context where industry interests are integral in the production of medical knowledge. (shrink)

Previous research has demonstrated that reversing the contrast of the eye region, which includes the eyebrows, affects the N170 ERP. To selectively assess the impact of just the eyes, the present study evaluated the N170 in response to reversing contrast polarity of just the iris and sclera in upright and inverted face stimuli. Contrast reversal of the eyes increased the amplitude of the N170 for upright faces, but not for inverted faces, suggesting that the contrast of eyes is an important (...) contributor to the N170 ERP. The debate over the nature of egalitarianism has come to dominate political philosophy. As ever more sophisticated attempts are made to describe the principles of an egalitarian distribution or to specify the good or goods that should be distributed equally, little is said about the fundamental basis of equality. In virtue of what should people be regarded as equal? Egalitarians have tended to dismiss this question of fundamental equality. In the first part of the paper I will examine some of (...) these strategies of marginalisation and assess whether the issue of fundamental equality matters. Jeremy Waldron has criticised this strategy of avoidance in his recent book God, Locke and equality. He argues that Locke’s turn to a theistic grounding for fundamental equality provides a better approach to the problem than the approach taken by contemporary liberals such as John Rawls. I will examine Waldron’s critique of Rawls and show that it is wanting. I will conclude by suggesting that Rawls’s approach to the issue has a bearing on the way in which equality should be understood as a political value. This argument for the primacy of a political conception of egalitarianism has a bearing on the interconnection between core liberal values and the idea of the state that has been emphasised by Rawls, Dworkin and Nagel. The prime number theorem, established by Hadamard and de la Vallée Poussin independently in 1896, asserts that the density of primes in the positive integers is asymptotic to 1/ln x. Whereas their proofs made serious use of the methods of complex analysis, elementary proofs were provided by Selberg and Erdos in 1948. We describe a formally verified version of Selberg's proof, obtained using the Isabelle proof assistant.

This study focused on the influence of American and Chinese cultures on consequentialism orientation in decision-making within the broader context of psychologists’ academic roles and responsibilities. In addition, this study hypothesized that educational level would affect culturally influenced ethical decision making in both cultures. Based on the American Psychological Association Ethics Code, 20 ethical scenarios in 5 domains in psychology were created and used to examine the influence of culturally ethical beliefs on psychologists’ decision making among 181 participants. The results (...) indicated that significant cultural differences in consequentialism orientation differentiated Chinese and American participants and influenced their resolution of ethical issues. These posthumous essays by Joan Kelly, a founder of women's studies, represent a profound synthesis of feminist theory and historical analysis and require a realignment of perspectives on women in society from the Middle Ages to the present.

Between 1787, and the end of his life in 1832, Bentham turned his attention to the development and application of economic ideas and principles within the general structure of his legislative project. For seventeen years this interest was manifested through a number of books and pamphlets, most of which remained in manuscript form, that develop a distinctive approach to economic questions. Although Bentham was influenced by Adam Smith's An Inquiry into the Nature and Causes of the Wealth of Nations, he (...) neither adopted a Smithian vocabulary for addressing questions of economic principle and policy, nor did he accept many of the distinctive features of Smith's economic theory. One consequence of this was that Bentham played almost no part in the development of the emerging science of political economy in the early nineteenth century. The standard histories of economics all emphasize how little he contributed to the mainstream of late eighteenth and early nineteenth-century debate by concentrating attention on his utilitarianism and the psychology of hedonism on which it is premised. Others have argued that the calculating nature of his theory of practical reason reduced the whole legislative project to a crude attempt to apply economics to all aspects of social and political life. Put at its simplest this argument amounts to the erroneous claim that Bentham's science of legislation is reducible to the science of political economy. A different but equally dangerous error would be to argue that because Bentham's conception of the science of legislation comprehends all the basic forms of social relationships, there can be no science of political economy as there is no autonomous sphere of activity governed by the principles of economics. This approach is no doubt attractive from an historical point of view given that the major premise of this argument is true, and that many of Bentham's ‘economic’ arguments are couched in terms of his theory of legislation. Yet it fails to account for the undoubted importance of political economy within Bentham's writings, not just on finance, economic policy, colonies and preventive police, but also in other aspects of his utilitarian public policy such as prison reform, pauper management, and even constitutional reform. All of these works reflect a conception of political economy in its broadest terms. However, this conception of political economy differs in many respects from that of Bentham's contemporaries, and for this reason Bentham's distinctive approach to problems of economics and political economy has largely been misunderstood.
