Some philosophers, like Mark Richard and Paul Boghossian, have argued against relativism that it cannot account for the possibility of faultless disagreement. However, I will contend that the objections they moved against relativism do not target its ability to account for the possibility of faultless disagreement per se. Ra- ther, they should be taken to challenge its capacity to account for another element of our folk conception of disagreement in certain areas of discourse—what Cris- pin Wright has dubbed parity. What (...) parity demands is to account for the possibil- ity of coherently appreciating, within a committed perspective, that our oppo- nent’s contrary judgement is somehow on a par with our own judgement. Under- stood in this way, Boghossian’s and Richard’s objections put indeed considerable pressure on relativism—or so I will argue. I will consider John MacFarlane’s at- tempt to resist their objections and I will show that, once their arguments are properly understood as targeting parity, the attempt is not successful. In the last section of the paper I will offer a diagnosis of what is at the heart of the relativist inability to account for parity—namely its assumption of a monistic conception of the normativity of truth. VI.385), and his concept of the self-enclosed particularity of individual peoples with their own cultural forms. Indeed, Husserl often emphasizes that the most prominent feature of cultural plurality is precisely its relativity: “relativity belongs to the normal course of life.”4 I shall evaluate Husserl’s response, which defends the project of realizing the ideal of a critical universal rationality, by situating his discussion in terms of the cultural conflict of the time with the rising National Socialist commitment to racial particularism, and by showing Husserl’s commitment to the inherent universality of the one shared life-world.In his research manuscripts of the 1920s and 1930s Husserl frequently discusses the complex relationships that exist between different cultures and traditions; different cultures have their specific historicities (Crisis, 274/Hua. VI.320), dialects, norms, ways of life, and so on. This is simply a matter of fact. Nishida Kitarō is considered by many as the most important 20th century Japanese philosopher for his ability to employ modern concepts and terminologies, and use them to construct a unique system carrying a distinctly East Asian flavour. In this system, the notion of nothingness plays a fundamental part both in terms of epistemology and ontology. While this conceptual choice was also inspired by Buddhist sources, Nishida also drew on the theoretical philosophy of Hermann Cohen to elaborate, how nothingness could function (...) as both the guarantor of unity and generator of plurality. Close analysis, however, shows that Nishida’s appropriation of Cohen’s concept of the me on as a necessary feature in the „logic of pure knowledge“ sheds the constraints carefully put in place by Cohen. As becomes evident in a comparison between both thinker’s analysis of sensation, Nishida’s unrestricted use of Cohen’s terms collapses precisely those distinctions that give sensation its meaning in the rational assessment of reality. This leaves Nishida’s concept of reality without the critical potential to distinguish between different kinds of normativity and their inter-subjective validity. Nothingness, as Nishida uses the term, is not a logical concept, but functions as an aesthetic symbol invoking sublime ideas of a perfect reality that is one and whole, and at the same time rich and diverse.Nishida Kitarō gilt vielfach als der bedeutendste japanische Philosoph des 20. In chapter one I will try to reconstruct a plot, or a hidden agenda, in the discussion in ethics between the beginning of the twentieth century and 1958, the year of a decisive turning point in ethics, both Anglo-Saxon and Continental, and strangely enough also the year of the beginning of the end of the Cold War, of post-Tridentine Catholicism, and perhaps something else. My hypothesis will be that there are two similar starting points for the Anglo-Saxon and the Continental (...) twentieth-century discussion, the philosophies of Henry Sidgwick and Friedrich Nietzsche, both expressions of some kind of ethical scepticism, and that a third, somewhat analogous starting-point could be found in Émile Durkheim, the proponent of the dream of the morale laïque. I will discuss how far the diagnosis formulated by Karl-Otto Apel of a kind of ‘parallel convergence' between existentialism and analytic philosophy, based on the shared division of facts and values that eventually justified two kinds of 'decisionism' is useful in making sense of the agenda of the discussion. In the second chapter I will discuss the reasons for two parallel U-turns around 1958 which brought back traditional schools of normative ethics, 'deontologism' and utilitarianism, as well as the reasons for criticism to both schools from the heterogeneous alignment of virtue ethics. In the third chapter I will discuss the remarkable phenomenon of the emergence, starting with the Sixties or the early Seventies, of ‘applied’ ethics. I examine the reasons, both theoretical and political, for the revival, the point to which applied ethics may look as a grand return of a casuistic and natural law way of thinking, or in Alan Donagan’s words a case of “reverse subversion” of the modern secular world by traditional Scholastic ways of thinking, and the difficult coexistence between general normative ethics and procedures for settling issues in a ‘reasonable’ way while dissent on issues of principle is as alive as ever. Then I try to draw a provisional moral. My suggestions are that (i) casuistry is more alive than ever; (ii) natural law thinking is more alive than ever; (iii) moral dilemmas never arise; (iv) moral dissent is treatable, with the right strategy; (v) practical philosophy does not need the same degree of exactness as the theoretical sciences but this is no obstacle to its working in practice. Andrea Westlund's account of love involves lovers becoming a Plural Subject mirroring Margaret Gilbert's Plural Subject Theory. However, while for Gilbert the creation of a plural will involves individuals jointly committing to pool their wills and the plural will directly normatively constraining those individuals, Westlund, in contrast, sees the creation of a plural will as a continual process thus rejecting the possibility of such direct normative constraint. This rejection appears to be required to explain (...) the flexibility that allows for a central place for reciprocity in loving relationships. However, this paper argues against the existence of such flexibility and presents instead the case that variance in the normative pain of rebelling against the collective will can be accommodated by replacing Gilbert's notion of all-or-nothing pooling of wills with an account that see wills as becoming entangled through levels of identification with the plural subject. Despite the fact that Aristotle and Frege/Russell differ in how to understand the ambiguity in the meaning of the word “is”, their theories share a common feature: “is” does not have a normative meaning. This paper, however, (I) shows (a) that there is a normative meaning of “is” (and correspondingly a constative meaning of the word “ought”) and (b) that the ambiguity of “is” is itself ambiguous. Furthermore, it proposes (c) a performative criterion for making a distinction between (...) constative and normative “is”. Thereby, (II) a new interpretation of Kant’s critique of the ontological argument (CPR A 598/B626) makes sense: The difference between being as a real predicate and being as a position depends on the difference between “is” as a descriptive and “is” as a normative predicate. (III) The criterion also makes possible a new answer to Leibniz’s and Schelling’s question, “Why is there something rather than nothing?”: The “is” in “there is something” is normative and the question means “Why shall there be something rather than nothing?”. As “there shall be nothing” is self-refuting, the question evokes an ultimate foundation in a practical sense. (shrink)

The first part of the text is a précis of the monograph Phenomenology of Plurality: Hannah Arendt on Political Intersubjectivity, a phenomenological analysis of Arendt’s core notion of plurality that unites the fields of phenomenology, political theory, social ontology, and Arendt studies. In the second, larger part, the author responds to the comments given by Sanja Bojanić and Adriana Zaharijević, in order to clarify some key concepts and positions presented in the book.

Innovative modes of collaboration between archaeologists and Indigenous communities are taking shape in a great many contexts, in the process transforming conventional research practice. While critics object that these partnerships cannot but compromise the objectivity of archaeological science, many of the archaeologists involved argue that their research is substantially enriched by them. I counter objections raised by internal critics and crystalized in philosophical terms by Boghossian, disentangling several different kinds of pluralism evident in these projects and offering an analysis of (...) why they are epistemically productive when they succeed. My central thesis is that they illustrate the virtues of epistemic inclusion central to proceduralist accounts of objectivity, but I draw on the resources of feminist standpoint theory to motivate the extension of these social -cognitive norms beyond the confines of the scientific community. In this article, I argue that Habermas’s method of rational reconstruction faces limitations when it comes to analysing newly emerging and contested political practices. As rational reconstruction aims to criticize existing practices by determining their normative meaning as reflected in the participants’ idealizing presuppositions, it reaches its limits where emerging and contested practices make it impossible to identify a shared self-understanding and a single participants’ perspective. Using the example of membership politics, I argue that this is often the case (...) where nationally constituted forms of politics become controversial or are fundamentally questioned. Building on the work of Benhabib and Fraser, I develop an alternative reconstructive method of plural reconstruction, which modifies the basic premises of rational reconstruction, adjusting it to emerging and contested political contexts. Significant proponents of both postmodern and realistic hermeneutics suggest that our efforts to understand are better when they involve a plurality of interpretative perspectives. The author of this essay argues, however, that a realist approach can provide a more persuasive reason for this orientation toward plurality. Postmodern approaches in hermeneutics suggest that we should pursue a plurality of interpretations to help us break free from the influence of reductive interpretations inherited from the past. Yet, this normative orientation runs the (...) risk of a proliferation of interpretations that leaves us in hermeneutical isolation from one another. A realistic hermeneutics, by contrast, suggests that we should pursue a plurality of interpretations because the matters of mutual concern to us are, in and of their own reality, plural. This realistic reason to pursue a plurality of interpretations does not silo us from one another but, on the contrary, reminds us of the need for conversation that allows us to address our shared world of matters of mutual concern. Official documents, such as the Word Anti-Doping Code (WADC), argue that sport can be deemed a homogenous and unitary concept. Even where different sports have varying characteristics, the homogenous view of a given sport (‘a sport’ or ‘the sport’) persists. The WADC, international and national sport associations aim to protect the spirit of (the) sport. In this picture, the intersection of sporting integrity and legal processes occupies a vital place. The article will posit that, from a legal perspective sport is (...) heterogeneous due to its governance, regulation, adjudication, and enforcement structures. International and national associations, such as sport federations and leagues, have separate normative orders. These normative orders lead to differences in ensuring sporting integrity. A plural normative environment is inherent in sport; thus, we need to deal with it. The article will conclude that although harmonising norms and interpretations related to sporting integrity through national and global institutions may be acceptable, these must be achieved by promoting good governance and human rights. Normative pluralism is the view that practical reason consists in an irreducible plurality of normative domains, that these domains sometimes issue conflicting recommendations and that, when this happens, there is never any one thing that one ought simpliciter to do. Here I argue against this view, noting that normative pluralism must be either unrestricted or restricted. Unrestricted pluralism maintains that all coherent standards are reason-generating normative domains, whereas restricted pluralism maintains that only some are. Unrestricted pluralism, (...) depending on how it is cashed out, is either nihilism about practical reason or else it is subjectivism. Neither view is consistent with normative pluralism; hence, pluralism must be restricted. Restricted pluralism, however, faces two problems. The first stems from the question: “Why is it that some standards are normative domains while others are not?” The question seems to demand an answer, but it is hard to give any answer without appealing to considerations that imply facts about what we ought simpliciter to do. Second, restricted pluralism has difficulty accounting for our intuitions about cases in which one option is optimal in all domains, but not better than each alternative in any one domain. The unique option that is optimal in every domain seems better than its competitors, though it isn’t better within any domain. This is different than the widely discussed argument from notable-nominal comparisons. So I conclude that we have good reason to reject restricted pluralism, the only form of normative pluralism really worthy of that name. (shrink)

I demonstrate that a set of well-known objections defeat John Stuart Mill’s plural voting proposal, but do not defeat plural voting as such. I adopt the following as a working definition of political equality: a voting system is egalitarian if and only if departures from a baseline of equally weighted votes are normatively permissible. I develop an alternative proposal, called procedural plural voting, which allocates plural votes procedurally, via the free choices of the electorate, rather than (...) according to a substantive standard of competence. The alternative avoids standards objections to Mill’s proposal. Moreover, reflection on the alternative plural voting scheme disrupts our intuitions about what counts as an egalitarian voting system. Undue emphasis on Mill’s version of plural voting obscures three important reasons to reject plural voting in favor of strictly egalitarian voting systems: that certain choices that generate inequalities of political power are morally impermissible; that even... Norms are apt for reasoning because they have propositional structure and content; they are practical because they aim to guide action, rather than to describe aspects of the world. These two features hold equally of norms construed sociologically as the norms of specific social groups, and of norms conceived abstractly as principles of action. On either view, norms are indeterminate while acts are particular and determinate. Consequently norms cannot fully specify which particular act is to be done. Are they then (...) not genuinely action-guiding unless supplemented by practical judgment? Yet accounts of practical judgement are often thin, sometimes seeing it as blind, unreasoned `picking' of one rather than another enactment of a norm. However, on another view practical judgement carries the substantive task of seeking ways of acting that satisfy a plurality of norms, which can be both reasoned and practical. Epistemische Autoritäten spielen in unserer durch Spezialisierung geprägten und hochgradig arbeitsteilig organisierten modernen "Informations-" oder "Wissensgesellschaft" eine zentrale Rolle. Die Philosophie hat diesem Umstand in den letzten Jahren durch eine zunehmend intensive Diskussion Rechnung getragen. Ein entscheidendes Defizit dieser Debatte besteht nach Diagnose des Autors allerdings darin, dass sie sich fast ausschließlich auf individuelle epistemische Autoritäten konzentriert hat. In unserer epistemischen Praxis sind plurale epistemische Autoritäten - (...) d.h. wissenschaftliche Gemeinschaften, Expertengremien, Geschworenenjurys usw. - aber mindestens genauso bedeutsam. This Article examines normative arguments for legal pluralism in regulation. First I briefly set out what we know in fact about how plural regulatory orderings interact and compete with state agency regulatory action. Second, I sketch, and reject, a simple legal pluralist response to regulatory pluralism. In the third part of the Article I show that "responsive" and "reflexive" approaches to intentional pluralization in the design of law should be seen as providing different but complementary pictures of pluralized (...) law. Finally I argue that this pluralized view of law might provide us with the conceptual tools to identify a type of emergent, pluralistic law, without or beyond the state, which would be relevant to thinking about both transnational regulation and multiculturalism. In this article, I argue that Habermas’s method of rational reconstruction faces limitations when it comes to analysing newly emerging and contested political practices. As rational reconstruction aims to criticize existing practices by determining their normative meaning as reflected in the participants’ idealizing presuppositions, it reaches its limits where emerging and contested practices make it impossible to identify a shared self-understanding and a single participants’ perspective. Using the (...) example of membership politics, I argue that this is often the case where nationally constituted forms of politics become controversial or are fundamentally questioned. Building on the work of Benhabib and Fraser, I develop an alternative reconstructive method of plural reconstruction, which modifies the basic premises of rational reconstruction, adjusting it to emerging and contested political contexts. This edited volume brings together 18 state-of-the art essays on pluralism about truth and logic. Parts I and II are dedicated to respectively truth pluralism and logical pluralism, and Part III to their interconnections. Some contributors challenge pluralism, arguing that the nature of truth or logic is uniform. The majority of contributors, however, defend pluralism, articulate novel versions of the view, or contribute to fundamental debates internal to the pluralist camp. On the assumption that romantic partners tend to act from a first-person plural perspective, how should the love that binds them be understood? This paper approaches this question by focusing on romantic practical integration, understood as the tendency of romantic partners to integrate their practical perspectives in such a way that allows them to have ‘reasons-for-us’: reasons for action that apply to them as a group, in a collective and non-distributive sense (Westlund Citation2009). After dispelling some reservations about the (...) connection between romantic love and the first-person plural perspective, I argue that the resources offered by one leading account of love, due to Bennett Helm, fall short of accounting for romantic practical integration. Building on Stephen Darwall’s account of romantic love as a ‘second-personal attitude of the heart’, I develop an alternative proposal. The proposed view foregrounds the relational and non-deontic normative character of romantic love, by conceptualizing it as an addressing attitude that intrinsically seeks – but doesn’t demand – reciprocation. On this view, the attitude of romantic love co-involves the addressee of the attitude as a (potential or actual) member of a narratively unified interpersonal community, in light of which putative reasons-for-us may be taken on board or rejected. Resumo O autor defende uma descrição normativa fraca do constitucionalismo internacional à luz de dois factos: a contínua relevância da soberania do Estado face à hegemonia de superpotências e a necessidade imperiosa de um regime supranacional eficaz de direitos humanos. Ao defender uma institucionalização constitucional de direitos humanos, que inclui aspectos de justiça processual e material, mostra-se que, como nos casos domésticos, tal institucionalização pode e, talvez deva, incorporar um procedimento de controlo judicial que ascende ao nível de controlo constitucional. De facto, o parecer do Tribunal Europeu de Justiça no caso Kadi estabeleceu um possível precedente para o controlo do Conselho de Segurança no sentido do cumprimento dos direitos humanos e outras normas peremptórias. Dada a necessidade de perícia técnico legal para a elaboração de tal controlo, um caso prima facie pode ser feito para o estabelecimento de um Tribunal Constitucional especializado ao nível internacional. Contudo, dado o impacto desempenhado pelo poder político na resolução técnica da adjudicação de casos específicos e concretos, dentro de um sistema jurídico altamente fragmentado, e dado o facto de que o controlo constitucional também toca questões mais abstractas e menos técnicos de justiça social, o autor recomenda, que a função de controlo constitucional seja disseminada por várias instituições globais, incluindo a actual Assembleia Geral das Nações Unidas e na esfera pública global. O controlo constitucional pluricêntrico, bem como a institucionalização dos direitos humanos decorre do desacordo multicultural existente acerca do significado desses direitos e da ameaça da hegemonia de superpotências sobre as instituições globais. Assim antecipa-se também a realização de uma constitucionalização mais monista no Direito Internacional com o crescimento da solidariedade global entre os povos. Palavras-chave : Constitucionalização, Controlo Constitucional, Direitos Humanos, Habermas, Nações Unidades, Pluralismo LegalI defend a weakly normative description of international constitutionalism in light of two facts: the continued salience of state sovereignty in the face of superpower hegemony and the overriding need for an effective supranational human rights regime. In arguing for a constitutional institutionalization of human rights that includes aspects of procedural and substantive justice, I show that, as in the domestic case, such an institutionalization could and perhaps should incorporate a procedure for judicial review ascending to the level of constitutional review. In fact, the European Court of Justice’s review of the Kadi case establishes a possible precedent for reviewing Security Council compliance with human rights and other peremptory norms. Given the need for technical legal expertise in elaborating such review, a prima facie case can be made for establishing a specialized constitutional court at the international level. However, given the impact that political power plays in the technical resolution of concrete, case-specific adjudication within a highly fragmented legal system, and given the fact that constitutional review also touches on more abstract and less technical issues of social justice, I recommend that the function of constitutional review be dispersed in several global institutions, including the current United Nations General Assembly and a global public sphere. The pluralization of constitutional review and the accompanying interpretation and institutionalization of human rights recognizes existing multicultural disagreement on the meaning of human rights and the threat of superpower hegemony over global institutions while anticipating the realization of a more monistic constitutionalization of international law with the growth of global solidarity between peoples. The essay interrogates the cosmopolitan level of Arendt’s political philosophy from the viewpoint of her reflections on plurality, the norm of limitless communication and her diagnosis of political institutions. Arendt’s conception of the political and plurality is inherently non-national in character, but she nevertheless rejects the idea of cosmopolitan citizenship. In place of this she introduces the notion of limitless communication. This ideal can be understood either as a straightforward development of the normative ideal of plurality on a cosmopolitan (...) level or as replacing plurality with a slightly different but possible ideal. The essay brings together Arendt’s conception of plurality with her reflections on the value of political institutions. Plurality comprises five aspects: equality, diversity, active participation, the shared world as a central mediating factor and the interactive or communicative dimension. According to Arendt institutional frameworks should ideally be designed both to make such participatory plurality and politics possible and as safeguards against rule. These tasks should also be preserved on a cosmopolitan level. This implies the importance of cosmopolitan institutions that are not intended as designed towards any ideal to establish a supreme global political authority, an idea that Arendt finds highly dangerous. Some philosophers have argued that truth is a norm of judgement and have provided a variety of formulations of this general thesis. In this paper, I shall side with these philosophers and assume that truth is a norm of judgement. What I am primarily interested in here are two core questions concerning the judgement-truth norm: (i) what are the normative relationships between truth and judgement? And (ii) do these relationships vary or are they constant? I argue for a pluralist (...) picture—what I call Normative Alethic Pluralism (NAP)—according to which (i) there is more than one correct judgement-truth norm and (ii) the normative relationships between truth and judgement vary in relation to the subject matter of the judgement. By means of a comparative analysis of disagreement in three areas of the evaluative domain—refined aesthetics, basic taste and morality—I show that there is an important variability in the normative significance of disagreement—I call this the variability conjecture. By presenting a variation of Lynch’s scope problem for alethic monism, I argue that a monistic approach to the normative function of truth is unable to vindicate the conjecture. I then argue that normative alethic pluralism provides us with a promising model to account for it. (shrink)

As with much contemporary philosophical and scientific research, the predominant metaphysics of situatedness is monism, particularly, physicalism. Here, we claim that while monism is the proper metaphysical thesis, empirically-supported theories of situated phenomena require ontological pluralism as well. We defend this position via the example of bird flocks, which are situated systems that exhibit ontologically plural features, namely, component dominance and interaction dominance. The description of these features will illustrate that understanding these phenomena requires a coevolution of conceptual and (...) methodological development. Specifically, ontological features are partially identified and evaluated by way of the analyses applied to them. Both descriptive and normative lessons are drawn. Descriptively, research on bird flocks demonstrate that natural phenomena may not be readily cast via a monistic ontology (e.g., component dominant), even at the same scale of investigation. The normative consequence is that while research on situated systems need not reject metaphysical monism, it ought to begin from a pluralistic position concerning ontology. (shrink)

This paper explores what kind of uncertainty a research program governing solar climate engineering through Stratospheric Aerosol Injection (SAI) needs to account for. Specifically, it tries to answer two central issues with regards to SAI research and it’s ethical evaluation: One, what irreducible uncertainties remain throughout the decision-process, and, two, how do these remaining uncertainties affect the ethical evaluation of SAI research. The main assumption is that decisions on SAI research governance will be made under normative uncertainty, i.e. situations (...) under irreducible knowledge-constraints that arise in concrete, practical decision-contexts. These decision-contexts are multi-lateral and empirically ambiguous, and the decision-makers need to reconcile a plurality of values. While normative uncertainty complicates the ethical evaluation of policy decisions, I argue that moral considerations can be accommodated through the inclusion of recognitional, participatory justice approaches, as well as adaptive and anticipatory governance methods. Glocal environmental governance lags behind the science regarding the seriousness of the combined environmental and developmental challenges. Governance regimes have developed differently in different issue areas and are often inconsistent and contradictory; furthermore governance innovations in each area lead to new challenges. The combined effect of issue-based, plural, and fragmented governance raises key normative questions in environmental governance. Hence, this overview paper aims to address the following questions: How can the global community move towards a more normatively consistent (...) global architecture for sustainable development? In order to address this question, I first examine the key normative issues and the nature of governance in the area of climate change, water and forests. In doing so I also look at the implications of each for food production, safety and security. The paper concludes that there are strong normative and architectural inconsistencies between the fragmented and plural issue-specific regimes; that such inconsistencies are inevitable in an ‘anarchic’ international order; that some degree of normative coherence can be strived at through the adoption of global constitutionalism and rule of law; and that the present discussion on global sustainable development goals is a first step towards creating a normatively consistent global architecture for sustainable development. Even in its limited state-based form, human law owes its existence to the natural physical world with its self-created value systems. What is understood as human law is grounded in human-nonhuman entanglements, themselves a subset of a multi-dimensional natural nomos consisting of the intricately connected normative worlds of animals, plants, earth, and cosmos. Complex and intersecting plural normative fields include those associated with the nonliving world, the multiple ontological worlds produced by life forms, and the many strata (...) of human becoming – cultural, cognitive, social, and representational. As plural the nomos contains many irreducible dimensions. Normative fields intersect, hybridise, and clash; they can mutually strengthen and also negate other normativities. In this article, I set out and explore some dimensions of the plural nomos with a focus on living beings, notably the connectedness of being, knowing and normativity. The living nomos co-emerges with being and with the embodied knowledge of even the simplest forms of life. Life is both cognitive and normative; living beings inherit ancestral norms but, in living and adapting, life creates new norms, biological, cultural, and behavioural. The living-knowing being is always normative – produced by the norming processes and constraints of life and matter at large. Normative elements are a critical part of the ontological and epistemological embeddedness of human beings in more than human worlds. Before law (or knowledge) can be about life, it is also of or from life. Expanding the analytical frame of law in this way is one method by which we might reshape western narratives of law, with the aims of promoting better openness to First Nations laws, discouraging western cultural superiority and human exceptionalism, and moving toward a more eco-sensitive view of the continuity between human law-culture-society and the natural world. ‘What is justification?’-Constructivism of Erlangen/Constanceschool as an example for problems resulting from priority of pragmatics to semantics. - R. Brandom's ‘Making it explicit’ is an attempt to work out how semantics is rooted in pragmatics: meaning in use and conceptual content in social functional roles. A philosophy that also focuses on reconstructing those norms that are implicit in pragmatics and constitutive to semanticsis developed by Constructivism of Erlangen/Constance school. This enquiry tries to work out that a discussion of constructivism might (...) be useful for a comprehension of Brandom's ‘theory of expression’, because both philosophical positions meet themselves in a pragmatic way of justification that makes it impossible to justify claims to all rational beings but only to members of those communities that share the same interests and institutions. In western philosophy and beyond, a tension between pluralism and monism has sparked many developments and debates. Pluralism of norms, of forms of knowledge, of aesthetic and moral values, of interests etc. has often been pitted against monism. Monism usually implies a hierarchical order of such norms etc. After having traced the origin of this tension between pluralism and monism in ancient tragedy and philosophy, I’m asking in this article whether a rejection of monism and embrace of pluralism necessarily raises (...) the specter of inconsistency and contradiction. The threat of inconsistency need not be associated with pluralism as even with regard to logic an argument can be made for a ‘multiplicity of logics’, as van Lambalgen and Stenning argue in several places. They refer to the varieties in reasoning that can be observed in humans and which are partly due to there being ‘dual systems’ of reasoning: System 1 processes information fast, automatized, and emotional, while System 2 is rather slow, more deliberative, and more rational. In contrast to a widely held view, the authors argue that System 1 processing is not without logic, even though it is a different form of logic from System 2. In addition, the multiplicity of logics they discuss is related to the multiple semantics required for distinct domains of reasoning. This perspective raises the subsequent question how this pluralism can be available while maintaining consistency, how should the available options be configured or related to each other? In the remainer of this chapter I’m addressing several such options for configurating pluralism like: non-foundational pluralism and foundational pluralism, moderate or temporary pluralism, antagonistic pluralism, incompatible pluralism, incommensurable pluralism, ‘Anything goes’ pluralism, complementary pluralism, integrative pluralism, and interactive pluralism. The discussion and examples of these options show that irrespective of its domain, the encounter with different configurations of pluralism shows how some forms of pluralism are likely to be productive, whereas others are less so - which is an important lesson given the prominent pluralism of pluralisms in philosophy and beyond. Existing conceptualizations of the demos fail to treat issues of composition and performativity consistently. Recent literature suggests that both aspects are required in a satisfactory account of the demos. An analysis of this literature suggests several desiderata that such an account must meet. I approach the definition of demos with a conceptual framework derived from Margaret Gilbert’s plural subject theory of social groups. I propose an account of demos as a plural subject, constituted by joint commitment. Die philosophische Fragestellung des Kosmopolitismus, wie sich eine Assoziation freier und gleicher „Weltbürger” mit Mitteln der universalistischen Moral herstellen lässt, entwirft erst den normativen Erwartungshorizont, der den Blick auf die vernunftlose Wirklichkeit lenkt. Die vernunftlose Wirklichkeit lässt sich durch den Terminus der „Weltrisikogesellschaft” charakterisieren, den Ulrich Beck zur Diagnose unserer von allen möglichen Katastrophen heimgesuchten Zeit einführt. Katastrophen führen (...) vor Augen, wie unsicher die Fundamente sind, auf denen wir den nationalen Staat und damit die Demokratie errichtet haben. Je mehr sich die Risiken globalisieren, umso mehr werden wir zu „weltbürgerlichem Bewusstsein” angehalten. Trotz der Erkenntnis der sich globalisierenden Risiken sind wir primär „Staatsbürger” und nicht „Weltbürger”. Aber es lässt sich nicht leugnen, dass nationalstaatliche Grenzen an Bedeutung verlieren. Ausgehend von der Annahme, dass die Weltgesellschaft mehr als der Weltmarkt ist, möchte ich das „kosmopolitische Moment” der transnationalen Entgrenzung hervorheben, um eine universalistische Moral der weltbürgerlichen Gesellschaft im Hinblick auf die Zukunft der Demokratie zu entwickeln. Several authors have argued for taxonomic pluralism in biology -the position that there is a plurality of equally legitimate classifications of the organic world. Others have objected that such pluralism boils down to a position of anything goes. This paper offers a response to the anything goes objection by showing how one can be a discerning pluralist. In particular, methodological standards for choosing taxonomic projects are derived using Laudan's normative naturalism. This paper also sheds light on why taxonomic pluralism (...) occurs in biology as well as illustrates the usefulness of normative naturalism. (shrink)

ZusammenfassungWas ist praktisches Wissen?Die Diskussion über diese Frage hat sich in den letzten Jahrzehnten darauf konzentriert, das praktische Wissen als ein Wissen- wie aufzufassen. Im Folgenden wird eine weitere Differenzierung dieser Ansicht vorgenommen, indem durch eine Analyse der Syntax des klinischpraktischen Wissens dafür geworben wird, dieses Wissen als eine Kategorie von bedingten Geboten für das ärztliche Handeln in der klinischen Entscheidungsfindung zu betrachten. Syntaktisch gesehen, sind diese Gebote deontische Normen („conditional obligations“). Da sie durch die diagnostisch-therapeutische Forschung (= klinische Forschung) (...) aufgestellt und erforscht werden, muss die klinische Forschung als eine deontische Disziplin angesehen werden. Sie ist deshalb dem Bereich der normativen Ethik zuzuordnen. Im direkten Zusammenhang damit ist die klinische Praxis – als eine überzeitliche Institution, nicht als das Handeln von Einzelpersonen – als praktizierte Moral im Dienste der Menschen („Karitas“) einzustufen, weil sie aus dem Versuch besteht, jene Gebote umzusetzen. Die Autoren dieses Bandes stellen die wichtigsten Aspekte seiner Staatstheorie vor und fragen nach ihrer Bedeutung für die heutige Staatslehre.

The article tries to inquire a third way in normative ethics between consequentialism or utilitarianism and deontology or Kantianism. To find such a third way in normative ethics, one has to analyze the elements of these classical theories and to look if they are justified. In this article it is argued that an adequate normative ethics has to contain the following five elements: (1) normative individualism, i. e., the view that in the last instance moral norms (...) and values can only be justified by reference to the individuals concerned, as its basis; (2) consideration of the individuals’ concerns and interests—aims, desires, needs, strivings—insofar as they have a justificatory function; (3) a pluralism of references of these concerns and hence of moral norms and values to all possible elements of actions; (4) the necessity of a principle of aggregation and weighing with regard to these concerns; (5) finally, as a central principle of aggregation and weighing, the principle of relative reference to self and others, operating as a generalizing meta-principle that guides the application of concrete principles and decisions. Nature sports have been touted for their value “as ways of pursuing excellence and relating to the environment” (Krein 2014, 207). This value, however, is not widely available, in large part due to structural features that create barriers to access for all but able-bodied white men possessing substantial disposable income. In this paper, we will analyse four ‘isms’ that are prominent in nature sport: ableism, classism/elitism, racism, and sexism/heterosexism. Through an examination of nature sports like surfing, skiing, snowboarding, and climbing, (...) we argue that the current culture of nature sports contains institutionalized isms. If we are to create spaces for inclusion and authentic participation and experiences in nature sports, then change needs to occur. To that end, we will address counterculture(s) and programs that challenge the ism-saturated established norms of nature sports, removing barriers to access and opening value-laden opportunities for all. Generic statements are commonly expressed using the bare plural – ‘tigers are striped’ – or the indefinite singular – ‘a tiger is striped’. Notoriously, some generics can be expressed using the bare plural locution, but not the indefinite singular; bare plural generics and indefinite singular generics pattern differently. I explore this phenomenon as it applies to normative generic statements: expressions like boys don’t cry, women are kind and nurturing, children are seen and not heard – that (...) convey something over and above (and even distinct from) the descriptive reading. I argue that we should look to a metalinguistic theory of generics to understand indefinite singular normative generics. That is, a normative indefinite singular generic is a proposal about what to include in the extension of the generic term. This theory explains why it is more often than not that felicitous indefinite singular generics are about social kind terms. I argue that this explains a crucial way in which language shapes the social world. When we say things like (2), we propose definitions and uses for the word ‘boy’. Such proposals and their consequences actually impact the behavior of the groups they pick out, as well as the attitudes of others towards those groups. (shrink)
