This dissertation is an attempt to show that, and how, an inter-species morality of compassion may be grounded reasonably in a phenomenology of body. It provides a literature survey of relevant works and authors, largely drawn from the modern European traditions of philosophic existentialism, phenomenology, and hermeneutics . The ontology and axiology presupposed by a somatically based bioethic are outlined in advance of the latter's presentation . Relevance of the embodied bioethic to actual affairs is demonstrated through exercises in practical (...) philosophy . Max Hallman has put forward an interpretation of Nietzsche’s philosophy according to which Nietzsche is a prototypical deep ecologist. In reply, I dispute Hallman’s main interpretive claim as well as its ethical and exegetical corollaries. I hold that Nietzsche is not a “biospheric egalitarian,” but rather an aristocratically individualistic “high humanist.” A consistently naturalistic transcendentalist, Nietzsche does submit a critique of modernity’s Christian-inflected anthropocentrism (pace Hallman), and yet—in his later work—he endorses exploitation in the quest for nobility (contra Hallman). I (...) conclude thatecophilosophers need to exercise hermeneutical caution in any attempt to appropriate Nietzsche for environmentally ethical designs, lest they illegitimately ventriloquize their own moral voices into an authoritative but alien mouthpiece. According to the interpretation suggested here, Nietzsche does not advance a substantive normative ethics, but proposes, based on his ontological idea of will to power, an instrumentalist theory of value. He is not a realist about value—according to him, nothing is intrinsically valuable. However, things, actions, beliefs, and values can be evaluated with reference to their capacities in serving our fundamental quest for power. The result comprises twenty-five essays from twenty-three contributors, most of which are organized around a single creature (albeit no llama). These essays’ execution of the original idea is, on the whole, excellent. I do not think that they establish the two main conceits of the volume. This book is divided into three parts: in Part I, R. M. Hare offers a justification for the use of philosophy of language in the treatment of moral questions, together with an overview of his moral philosophy of ‘universal prescriptivism’. The second part, and the core of the book, consists of five chapters originally presented as a lecture series under the title ‘A Taxonomy of Ethical Theories’. Hare identifies descriptivism and non‐descriptivism as the two main positions in modern moral philosophy. (...) The former he divides into Naturalism and Intuitionism, and the latter into Emotivism and Rationalism. Hare argues that all forms of descriptivism tend to lead to Relativism because the truth conditions of moral statements are culturally variant. Of the positions discussed, only Hare's own position, a form of Rationalism, which he calls Universal Prescriptivism, meets all of the requirements that an adequate ethical theory should meet. Part III consists of Hare's previously published essay ‘Could Kant have been a Utilitarian?’ (Utilitas 5, 1993). The most glamorous and even glorious moments in a legal system come when a high court recognizes an abstract principle involving, for example, human liberty or equality. Indeed, Americans, and not a few non-Americans, have been greatly stirred--and divided--by the opinions of the Supreme Court, especially in the area of race relations, where the Court has tried to revolutionize American society. But these stirring decisions are aberrations, says Cass R. Sunstein, and perhaps thankfully so. In Legal Reasoning and Political Conflict, (...) Sunstein, one of America's best known commentators on our legal system, offers a bold, new thesis about how the law should work in America, arguing that the courts best enable people to live together, despite their diversity, by resolving particular cases without taking sides in broader, more abstract conflicts. Sunstein offers a close analysis of the way the law can mediate disputes in a diverse society, examining how the law works in practical terms, and showing that, to arrive at workable, practical solutions, judges must avoid broad, abstract reasoning. Why? For one thing, critics and adversaries who would never agree on fundamental ideals are often willing to accept the concrete details of a particular decision. Likewise, a plea bargain for someone caught exceeding the speed limit need not--indeed, must not--delve into sweeping issues of government regulation and personal liberty. Connecticut, a groundbreaking case in which the Supreme Court struck down Connecticut's restrictions on the use of contraceptives by married couples--a law that was no longer enforced by prosecutors. In overturning the legislation, the Court invoked the abstract right of privacy; the author asserts that the justices should have appealed to the narrower principle that citizens need not comply with laws that lack real enforcement. By avoiding large-scale issues and values, such a decision could have led to a different outcome in Bowers v. Hardwick, the decision that upheld Georgia's rarely prosecuted ban on sodomy. And by pointing to the need for flexibility over time and circumstances, Sunstein offers a novel understanding of the old ideal of the rule of law. Legal reasoning can seem impenetrable, mysterious, baroque. This book helps dissolve the mystery. BLWith new text and full apparatus criticus The Eudemian Ethics was one of two ethical treatises which Aristotle wrote on the subject of ethica or `matters to do with character'. Although the two works cover much the same ground, the Nicomachean Ethics is better known; the poor manuscript tradition of the Eudemian Ethics has made correct translation and interpretation of the text extremely difficult. The subject of the work is the choice of a certain means of conduct, made by a (...) `man of practical wisdom', between two extremes of behaviour: asceticism and yielding to uncontrolled impulses. Aristotle also stresses the notion of moral intention and the importance of virtue of character. This new Oxford Classical Text of the Eudemian Ethics is the result of many years of work. After Sir David Ross's death, his original text was substantially reworked and revised by his friend and colleague R. R. Walzer, who was aided in the revision by his former pupil Mrs Jean Mingay, who continued his work after his death in 1974. Mrs Mingay was fortunate in being able to make use of previously unpublished contributions from D. J. Allan after his death in the late seventies, and more recently has been helped in her work by the suggestions of Professor D. A. Russell, David Robinson, and Christopher Rowe. (shrink)

The range of coverage is almost exhaustive and is carefully cross-referenced. The citation of material in Dutch, Portuguese, and Norwegian, supplementing complete coverage of English, French, German, and Italian books and articles, should prove of value in revealing common interests and furthering international communication among scholars. Philological and analytic approaches are usually commended, but dialectical treatments which fit (...) neither category usually elicit an unjustified negative appraisal. The gaze is attentive while the stare is intent. Dériver : Equally to drift and/or to derive. —When drifting then, something must be taken along. Something must be derived from the drift. Something of oneself must always become other. Incorporating the other, incorporating oneself as other. Je est un autre , Rimbaud disait; 1 this in his last letter to Georges Izambard, a final correspondence to a former mentor and friend, from whom he was drifting away, having derived much. The drift is a control incomplete. To drift is to come closer and closer, but to always be turning away, pulling apart, pulling oneself apart. It is parabolic in the sense that it is always eluding a formerly established intent. Of all axes, it never finds room to rest. Filling new spaces, always changing places, ever escaping the Cartesian; the indubitable pinpointing of position. It is never pinned down. Love together what we will be apart. Once together, we will drift apart. Il le faut . Attention is held; it traces the path. It follows each point which traces the arc, the line, the swerve. It is not concerned with the figure being drawn, but rather the movement between one point and the next. The smallest movement. The clinamen of De Rerum Natura is the smallest of swerves, it is nothing more than the minimum — nec plus quam minimum . Michel Serres says of the clinamen , that it is an absurdity — a logical, geometrical, mechanical, physical absurdity. 'The clinamen, from here (its state of absurdity), finds refuge in subjectivity; it passes from the world to the soul, from the physical to the metaphysical, from the theory of inert bodies in freefall to the theory of the free movements of the living.' 2 So this swerve is something of the mind and something of the body, both in action, rather than a body which is merely acted upon. Swerve, however, has a connotation of suddenness. It is a movement which is made to avoid an otherwise inevitable impact. Drift, on the other hand, is the unleashing of something which is then allowed to follow a more complex series of forces. These forces now come from within as well as without. It is no longer tethered; now following tides, winds, flows or pitched slopes, now acting on its own. We are not atoms in freefall. Our attention long ago pulled us from this precipitous descent. We now live, ourselves, as one of the many forces. In the drift, as with the gaze, there is an ease. ‘Ease is the proper name of this unrepresentable space.’ It is the space nearest, the next, the neighboring space. To occupy this space requires a turn, a shift or a drift. It cannot be reached by proceeding straight ahead. ‘..the space adjacent, the empty place where each can move freely, in a semantic constellation where spatial proximity borders on opportune time (ad-agio, moving at ease) and convenience borders on the correct relation.’ 3 Intention always seeks to straighten this line, to make it less complex, to isolate the point of departure and the desired destination. It believes there can be two points and, between them, there must be a straight line. Can there be? Maybe. Must there be? Never. Straight lines may exist, but they can never be followed to the finish. After leaving this point, we will never reach that one without being buffeted at least a little — at least the least. One foot in front of the other, this is a very restrictive dance, less even than a two-step. Straight lines lead only to lost intentions, being the shortest and quickest way to get there. When attention drifts it slowly turns away from the intended target, leaving it for something which pulls the attention away. Now we are for a moment free; all at once we can pivot, now we can waltz. Drifting along the page, deriving from what is seen. Reading is seeing; the movement of the eyes as they drift. Reading in the eyes what has been seen, what has been derived from the act of reading. Reading eyes drift back and forth down the page, now and then jump back and forth, up to the top, one word, back down, quickly a few pages back, now gaze out towards the horizon. When attention drifts it is the gaze that follows. Our attention is not restricted to the path the words follow, but links them together; deriving what is to be seen, rather than read. La philosophie fait voir . ‘Thus, philosophers speak through proverbs, and demonstrate. They connect their imaginations with foreign rings, flown into famous tombs.’ 4 Now drifting off to sleep, dreams come as unintended visions.
