The vital data about the electrical activities of the brain are carried by the electroencephalography signals. The recordings of the electrical activity of brain neurons in a rhythmic and spontaneous manner from the scalp surface are measured by EEG. One of the most important aspects in the field of neuroscience and neural engineering is EEG signal analysis, as it aids significantly in dealing with the commercial applications as well. To uncover the highly useful information for neural classification activities, EEG studies (...) incorporated with machine learning provide good results. In this study, a Fusion Hybrid Model with Singular Value Decomposition Based Estimation of Robust Parameters is proposed for efficient feature extraction of the biosignals and to understand the essential information it has for analyzing the brain functionality. The essential features in terms of parameter components are extracted using the developed hybrid model, and a specialized hybrid swarm technique called Hybrid Differential Particle Artificial Bee algorithm is proposed for feature selection. To make the EEG more practical and to be used in a plethora of applications, the robust classification of these signals is necessary thereby relying less on the trained professionals. Therefore, the classification is done initially using the proposed Zero Inflated Poisson Mixture Regression Model and then it is also classified with a deep learning methodology, and the results are compared with other standard machine learning techniques. This proposed flow of methodology is validated on a few standard Biosignal datasets, and finally, a good classification accuracy of 98.79% is obtained for epileptic dataset and 98.35% is obtained for schizophrenia dataset. Documenting how the Japanese state responded to increasing social discontent during initiation of unpopular welfare reforms, this study examines the factors that hindered the political empowerment of civil society despite the timely introduction of participatory policymaking institutions. The Japanese government opted in the early 2000s to introduce a participatory method to initiate the unpopular pension reform. Deliberation councils were established to encourage open discussions among government policymakers and committee members, including citizen representatives. The final outcomes of the deliberations, however, were (...) mostly about parametric adjustments and did not adequately consider the urgent demand of the general public. The participatory measure did not significantly improve the public's trust in the pension programs, but it did justify the government's reform initiatives. The welfare bureaucracy that set the goal, defined the scope of the agenda, and steered the discussions toward technical issues structurally restricted the voices of the citizen members in the deliberation councils. The lack of citizen advocacy groups, which could otherwise have effectively supported the citizen members on the committee, contributed to the limited roles and influences of the citizens. It is argued that the traditional conservative corporatism of Japan was reinforced during this time period, despite the introduction of the idea of participatory governance. (shrink)

This paper analyzes and evaluates quine's influential thesis that epistemology should become a chapter of empirical psychology. quine's main point, it is argued, is that normativity must be banished from epistemology and, more generally, philosophy. i claim that without a normative concept of justification, we lose the very concept of knowledge, and that belief ascription itself becomes impossible without a normative concept of rationality. further, the supervenience of concepts of epistemic appraisal shows that normative epistemology is indeed possible.

This paper evaluates and criticises the developmental systems conception of evolution and develops instead an extension of the gene's eye conception of evolution. We argue (i) Dawkin's attempt to segregate developmental and evolutionary issues about genes is unsatisfactory. On plausible views of development it is arbitrary to single out genes as the units of selection. (ii) The genotype does not carry information about the phenotype in any way that distinguishes the role of the genes in development from that other factors. (...) (iii) There is no simple and general causal criterion which distinguishes the role of genes in development and evolution. (iv) There is, however, an important sense in which genes but not every other developmental factor represent the phenotype. (v) The idea that genes represent features of the phenotype forces us to recognise that genes are not the only, or almost the only, replicators. Many mechanisms of replication are involved in both development and evolution. (vi) A conception of evolutionary history which recognises both genetic and non-genetic replicators, lineages of replicators and interactors has advantages over both the radical rejection of the replicator/interactor distinction and the conservative restriction of replication to genetic replication. This paper examines the idea, commonly presupposed but seldom explicitly stated in discussions of certain philosophical problems, that the objects and phenomena of the world are structured in a hierarchy of "levels", from the bottom level of microparticles to the levels of cells and biological organisms and then to the levels of creatures with mentality and social groups of such creatures. Parallel to this "layered model" of the natural world is an ordering of the sciences, with physics as our "basic" (...) science and the "special sciences" forming a ladder-like hierarchy, from chemistry to biology to psychology and the social sciences, all grounded in basic physics. Focusing on two formulations of this model, the emergentist model of C. Lloyd Morgan and the reductionist model due to Paul Oppenheim and Hilary Putnam, the paper discusses such questions as these:What makes a given level of objects "higher" or "lower" than another? What makes a given property "higher" or "lower" than another property. Are objects and properties always comparable with respect to "higher" and "lower"? Can an overarching hierarchy of entities and properties be developed that comprehends the entire natural order? The issues turn out to be quite complex, and no definitive general conclusions are reached. (shrink)

In this paper, I argue that the adaptive fit between human cultures and their environment is persuasive evidence that some form of evolutionary mechanism has been important in driving human cultural change. I distinguish three mechanisms of cultural evolution: niche construction leading to cultural group selection; the vertical flow of cultural information from parents to their children, and the replication and spread of memes. I further argue that both cultural group selection and the vertical flow of cultural information have been (...) important. More conjecturally, I identify a potential role for meme-based cultural evolution in the explanation of the ‘human revolution’ of the last 100 000 or so years, and defuse an important objection to that explanation. Change is inevitable, and increasingly rapid and continuous in healthcare as organizations strive to adapt, improve and innovate. Organizational change challenges healthcare providers because it restructures how and when patient care delivery is provided, changing ways in which nurses must carry out their work. The aim of this doctoral study was to explore frontline nurses’ experiences of living with rapid and continuous organizational change. A critical hermeneutic approach was utilized. Participants described feeling voiceless, powerless and apolitical amidst rapid and continuous (...) organizational changes which fuelled apathy, cynicism and disengagement from the organization. However, critical analysis of the data showed that nurses actively engaged with power, voice and politics through resistant and transgressive behaviours in micro‐ethical moments of practice. There is a need to reconceptualize the concepts of voice, power and politics in nursing as there is dissonance between nurses’ beliefs about these concepts and what they are enacting in practice. Recognizing their enactment of power, voice and political agency at the micro‐level may empower nurses. Empowerment would mitigate the high levels of reports of powerlessness experienced in practice during organizational changes. (shrink)

Once upon a time in evolutionary theory, everything happened for the best. Predators killed only the old or the sick. Pecking orders and other dominance hierarchies minimized wasteful conflict within the group. Male displays ensured that only the best and the fittest had mates. In the culmination of this tradition, Wynne-Edwards argued that many species have mechanisms that ensure groups do not over-exploit their resource base. The “central function” of territoriality in birds and other higher animals is “of limiting the (...) numbers of occupants per unit area of habitat”. Species with dominance hierarchies, species with lekking breeding systems, and species with communal breeding regulate their populations. These social mechanisms have population regulation as their “underlying primary function”. Wynne-Edwards argued that these mechanisms evolve through group selection. Populations without such mechanisms are apt to go extinct by eroding their own resource base. (shrink)

This paper criticizes the circularity reading of Frege's argument for the indefinability of truth. According to this reading, Frege is appealing to a sort of circularity in the argument. I argue that the circularity reading is interpretatively incorrect, or makes Frege's argument a non‐starter.

One of the most notable features in recent Confucian political theory is the advocacy of political meritocracy. Though Confucian meritocrats’ controversial institutional design has been subject to critical scrutiny, less attention has been paid to their underlying normative claims. This paper aims to investigate the two justificatory conditions of Confucian political meritocracy—the service condition and the reciprocity condition—in light of classical Confucianism and with special attention to moral disagreement. Finding the normative argument for Confucian political meritocracy both incomplete (in light (...) of classical Confucianism) and implausible (under the circumstances of moral disagreement), it proposes Confucian constitutional democracy as an alternative that can meet the three conditions of the good Confucian polity—service, reciprocity, and remedy—by reconceiving the people's well-being in terms of their basic rights, as well as by promoting constitutional dialogue among the three branches of the government. This study identifies the roles of consumers’ ethical orientations and CSR motives and the dynamics of these two variables on the subsequent consumers’ attitudinal and behavioral responses to CSR—perceived corporate authenticity and pro-firm behavioral intentions. To examine the impact of individual consumers’ ethical orientations, the authors measured consumers’ ethical orientations such as deontology and consequentialism through a Web-based survey conducted in Korea and in the USA. Further, to investigate the role of perceived CSR motives, the authors measured the perception of (...) a company’s business-oriented motives and society-oriented motives in conducting CSR. Results demonstrate the different role of ethical orientation in impacting consumers’ responses across these countries. Consumers’ consequentialist orientation appears to be positively associated with pro-firm behavioral intention in both the Korean and the US studies. In the Korean study, Consumers’ deontological orientation reduces perceived corporate authenticity when corporate motives seem business-oriented. Theoretical and practical implications are discussed. The purpose of this paper is to investigate the Korean public relations practitioners'' perceptions toward ethical issues, individual practices, and ethical standards in the context of ethical ideology. The survey was conducted with the Korean public relations practitioners. A 2 (Relativism: High/Low) × 2 (Idealism: High/Low) factorial design was devised for the analysis.The MANOVA results showed that ethical ideology (idealism and relativism) had significant effects on ethical decision-making. Idealistic ideology had a main effect on ethical issues, individual practices, and ethical (...) standards. However, relativistic ideology only affected the decision-making process related to ethical issues. No interaction effects were detected. This study indicated that the individual''s ethical ideology could be an important variable in explaining the outcomes of the individual''s ethical decision-making among Korean public relations practitioners. This paper examines the iconic conception of aesthetic education in the work of Friedrich Schiller, with the aim of elucidating Schiller’s unique innovation of this notion in understanding i) the relationship between aesthetic and ethical value and ii) the transformative possibilities within a collective, social dimension of aesthetic experience. The paper provides an overview of the Kantian origins of Schiller’s aesthetic programme (Section 1). It then considers Schiller’s critique of the perceived failings of the Kantian and Enlightenment republican models of (...) ethical value and political emancipation (Section 2) before turning to his positive alternative aesthetic programme (Section 3). This study assessed the demographic characteristics of Koreans engaged in leisure sports activities during the COVID-19 pandemic and the differences in their preventive health behaviors and constraints on leisure activities. For this study, the demographic characteristics of 544 leisure sport participants, who were recruited on a nationwide basis, were examined through an online survey. Then, comparisons between groups were performed using independent t-tests, one-way analysis of variance, and multivariate analysis of variance. Women who participated in both indoor and outdoor leisure (...) sports showed higher adoption of health prevention behaviors than their male counterparts, and married individuals who participated in indoor leisure sports showed higher adoption of health prevention behaviors than unmarried participants. Moreover, individuals who participated in both indoor and outdoor leisure sports by themselves had many interpersonal constraints overall, and the group of married individuals who participated in indoor leisure sports showed structural constraints. In conclusion, leisure sports participants have adopted many health prevention behaviors during the COVID-19 pandemic, but this had led to some interpersonal constraints. These results indicate that, in the case of future pandemics, personal and institutional efforts will need to be made to promote participation in leisure sports and prevent excessive social isolation. This paper surveys recent philosophy of biology. It aims to introduce outsiders to the field to the recent literature (which is reviewed in the footnotes) and the main recent debates. I concentrate on three of these: recent critiques of the replicator/vehicle distinction and its application to the idea of the gene as the unit of section; the recent defences of group selection and the idea that standard alternatives to group selection are in fact no more than a disguised form of (...) group selection; and recent ideas on the role of selection in evolution, especially the role of selection in structuring the large-scale history of life. The paper connects philosophy of biology to some more general problems in the philosophy of science, and concludes with a few suggestions about unfinished business. (shrink)

In particular, using elimination of hyperimaginaries we prove that for any supersimple T, canonical base of an amalgamation class P is the union of names of ψ-definitions of P, ψ ranging over stationary L-formulas in P. This essay explores some conceptual and diagnostic frameworks to advance epistemic decolonization in the US philosophical profession. A central focus is the distinction between those philosophies of formerly colonized peoples that are culturally alterior or, simply, alterior and those that are analectical in the Dusselian sense of emerging from a subordinated political position. The paper begins by reflecting upon connections between coloniality, the alterior, and the analectical to frame the discussion of epistemic decolonization in the philosophy profession. It then considers (...) a knower's core theoretic reconstruction in the task of epistemic decolonization and identifies some ambiguities in reconciling alterior traditions with analectical theoretical reconstruction. The work of Charles Mills and Enrique Dussel are considered as case studies. The paper concludes with critical reflections on the institutional network of canon, curriculum, and other conceptual and credentialization structures that constitute institutional Eurocentrism. This paper examines the mechanisms that influence team-level performance, which is critical to organizational effectiveness. It investigates psychological safety, a shared belief that the team is safe for interpersonal risk-taking, and a causal model mediated by learning behavior and efficacy. This model hypothesizes that psychological safety and efficacy are related, which have been believed to be the same-dimension constructs. It also explains the process of how learning behavior affects the team’s efficacy. According to a study of 104 field teams in (...) a multinational enterprise in Korea, psychological safety did not affect team effectiveness. However, when mediated by learning behavior and efficacy, a full mediation effect was found. The result supports a well-known metaphor that psychological safety is the engine of performance, not the fuel. It also explains how individuals contribute to group performance under a psychologically safe climate, enhancing team processes. Based on the findings, this paper suggests theoretical and methodological implications for future research to maximize the effectiveness of teams. (shrink)

Mèngzǐ’s 孟子 advice to King Xuān 宣 to take up his feeling of compassion for an ox and apply it to his people (_Mèngzǐ_ 1A7) is equivocal, and can be understood in two markedly different ways: on one hand, to take immediate care of the people’s needs by performing a kind of (mental) act of applying compassion; on the other hand, to engage in a long-term project of cultivating compassion for them. These views, moreover, when combined with the assumption that (...) emotion is the sole motivator of moral action, give us a perplexing picture of Mèngzǐ as urging the king to do exactly what he cannot—namely, acting out of compassion for his people that he falls short of feeling enough of. This essay explicates the Mengzian model of moral extension (_tuī_ 推) through a solution to this puzzle, specifically by explaining how one’s immediate performance of moral actions are conducive to cultivating related moral emotions. With regard to facial emotion recognition, previous studies found that specific facial regions were attended more in order to identify certain emotions. We investigated whether a preferential search for emotion-specific diagnostic regions could contribute toward the accurate recognition of facial emotions. Twenty-three neurotypical adults performed an emotion recognition task using six basic emotions: anger, disgust, fear, happiness, sadness, and surprise. The participants’ exploration patterns for the faces were measured using the Moving Window Technique (MWT). This technique presented a small window (...) on a blurred face, and the participants explored the face stimuli through a mouse-controlled window in order to recognize the emotions on the face. Our results revealed that when the participants explored the diagnostic regions for each emotion more frequently, the correct recognition of the emotions occurred at a faster rate. To the best of our knowledge, this current study is the first to present evidence that an exploration of emotion-specific diagnostic regions can predict the reaction time of accurate emotion recognition among neurotypical adults. Such findings can be further applied in the evaluation and/or training (regarding emotion recognition functions) of both typically and atypically developing children with emotion recognition difficulties. Work-integrated learning is an educational approach that aims to support students’ integration of theory to practice. These rich learning opportunities provide students with real-world experiences and introduce practice and ethical situations that help consolidate and bridge their knowledge and skill. Academic integrity has been defined as the ongoing commitment to values that are consistent with ethical practice: honesty, trust, fairness, respect, responsibility, and courage. It is important to understand what specifically influences students’ intentions to behave with integrity in WIL settings. (...) This paper reports on one study that explored predictors to students’ intentions to behave with integrity across three different WIL settings in their upper years of studies. The Hwang affair, a dramatic and far reaching instance of scientific fraud, shocked the world. This collective national failure prompted various organizations in Korea, including universities, regulatory agencies, and research associations, to engage in self-criticism and research ethics reforms. This paper aims, first, to document and review research misconduct perpetrated by Hwang and members of his research team, with particular attention to the agencies that failed to regulate and then supervise Hwang’s research. The paper then examines the research ethics reforms (...) introduced in the wake of this international scandal. After reviewing American and European research governance structures and policies, policy makers developed a mixed model mindful of its Korean context. The third part of the paper examines how research ethics reform is proactive (a response to shocking scientific misconduct and ensuing external criticism from the press and society) as well as reactive (identification of and adherence to national or international ethics standards). The last part deals with Korean society’s response to the Hwang affair, which had the effect of a moral atomic bomb and has led to broad ethical reform in Korean society. We conceptualize this change as ethical modernization, through which the Korean public corrects the failures of a growth-oriented economic model for social progress, and attempts to create a more trustworthy and ethical society. This paper explores the ontology of digital information or the nature of digital-being. Even though a digital-being is not a physical thing, it has many essential features of physical things such as substantiality, extensions, and thing-totality (via Heidegger). Despite their lack of material bases, digital-beings can provide us with perceivedness or universal passive pregivenness (via Husserl). Still, a digital-being is not exactly a thing, because it does not belong to objective time and space. Due to its perfect duplicability, a digital (...) being can exist at multiple locations simultaneously – that is, it defies normal spatiotemporal constraints. With digital beings on the Internet, we can establish intercorporeal relationships. The World Wide Web opens up new possibilities of Dasein's “being-able-to-be-with-one-another” and new modes of “Being-with-others” (Mitsein). The new modes of communication based on digital-beings compel us to re-read Heidegger's basic concepts such as “Dasein as Being-in-the-world,” since Dasein becomes the “Digi-sein as Being-in-the-World-Wide-Web.” By exploring the ontological characteristics of digital-being, this paper suggests that we conceive digital-beings as res digitalis – a third entity which is located somewhere between res cogitans and res extensa. Buchanan and Powell develop a concept of moral progress, and build a middle-range theory of how moral progress comes about. They argue on the basis of their view of the evolutionary origins of normative thought that further moral progress towards more inclusive moral and political systems is possible. In doing so they rebut a conservative reading of the evolution of normative thought: a reading that regards the hope for inclusive moral systems as utopian. Buchanan and Powell argue that this ‘evoconservative’ (...) argument overlooks overwhelming evidence of the adaptive plasticity of normative thought. I agree with their rejection of that evoconservative position, but give an alternative account of the evolutionary foundations of normative cognition and its plasticity. But I also argue that there is a gap in their defence of their view of moral progress: it begs the question against exclusive, relational conceptions of the naturalistic foundations of normative obligations and rights. Their account is less fully naturalistic than they seem to suppose, for it lacks a developed account of the natural facts which make normative claims true, and it is not clear that there is an account to be given that would vindicate their inclusive liberal intuitions about the norms we should have. This study investigated the characteristics of neural oscillation and functional connectivity in college students engaging in binge drinking using resting-state electroencephalography. Also, the associations of visual memory, evaluated by the Rey-Osterrieth Complex Figure Test, and neural oscillation with FC during the resting state were investigated. The BD and non-BD groups were selected based on scores of the Korean version of the Alcohol use disorders Identification Test and the Alcohol Use Questionnaire. EEG was performed for 6 min while the participants rested (...) with eyes closed. The theta, lower-alpha, and upper alpha powers did not differ between the BD and non-BD groups. Concerning FC, the BD group exhibited stronger theta coherence than that of the non-BD group, and in the lower and upper alpha bands, the BD group showed stronger coherence in some areas but weaker coherence in others compared with the non-BD group. However, these significant results were not observed after Bonferroni correction. The BD group showed significantly lower delayed recall scores on the RCFT than did the non-BD group. A positive correlation between the left prefrontal-parietal-occipital midline connection and performance on the delayed recall of the RCFT was observed in the BD group. The present results could suggest that binge drinkers have alterations in brain FC, which may be related to their visual memory deficits. (shrink)

A prefrontal control system that is less mature than the limbic reward system in adolescence is thought to impede self-regulatory abilities, which could contribute to poor dietary choices and obesity. We, therefore, aimed to examine whether structural morphology of the prefrontal cortex and the amygdala are associated with dietary decisions and obesity in children and adolescents. Seventy-one individuals between the ages of 8–22 years participated in this study; each participant completed a computer-based food choice task and a T1- and T2-weighted (...) structural brain scans. Two indices of obesity were assessed, including age- and sex-specific body mass index and waist-to-height ratio. The behavioral task included rating 60 food stimuli for tastiness, healthiness, and liking. Based on each participant’s self-ratings, 100 binary food choices were then made utilizing a computer mouse. Dietary “self-control” was calculated as the proportion of trials where the individual chose the healthier food item over the total number of trials. Cortical thickness and amygdala subnuclei volumes were quantified using FreeSurfer 6.0 and CIT168 atlas, respectively. We found that WHtR was negatively associated with the thickness of bilateral superior frontal, left superior temporal, right insula, and right inferior temporal regions. We also found WHtR to be positively associated with the volume of the central nucleus region of the amygdala, after adjusting for the hemisphere, age, sex, and intracranial volumes. A similar data pattern was observed when BMIz was used. Moreover, we found that across all participants, thinner right superior frontal cortex and larger left CEN volumes predicted lower dietary self-control. These results suggest that differential development of the PFC and amygdala relate to obesity and dietary self-control. Further longitudinal studies are merited to determine causal relationships among altered PFC to amygdala neural circuitry, dietary self-control, and obesity. (shrink)

In marketing, the use of visual-art-based designs on products or packaging crucially impacts consumers’ decision-making when purchasing. While visual art in product packaging should be designed to induce consumer’s favorable evaluations, it should not evoke excessive affective arousal, because this may lead to the depletion of consumer’s cognitive resources. Thus, consumers may use heuristic decision-making and commit an inadvertent mistake while purchasing. Most existing studies on visual arts in marketing have focused on preference using subjective evaluations. To address this, we (...) applied a neuroscientific measure, electroencephalogram to increase experimental validity. Two successive tasks were designed to examine the effects of affective arousal and affective valence, evoked by visual artwork, on the consecutive cognitive decision-making. In task 1, to evaluate the effect of visual art, EEG of two independent groups of people was measured when they viewed abstract artwork. The abstract art of neoplasticism group was showing Mondrian’s artwork, while the abstract art of expressionism group viewed Kandinsky’s artwork. The neoplasticism movement strove to eliminate emotion in art and expressionism to express the feelings of the artist. Building on Gallese’s embodied simulation theory, AbNP and AbEX artworks were expected to induce lower and higher affect, respectively. In task 2, we investigated how the induced affect differentially influenced a succeeding cognitive Stroop task. We anticipated that the AbEX group would deplete more cognitive resources than AbNP group, based on capacity limitation theory. Significantly stronger affect was induced in the AbEX group in task 1 than in the AbNP group, especially in affective arousal. In task 2, the AbEX group showed a faster reaction time and higher error rate in the Stroop task. According to our hypotheses, the higher affective arousal state of the AbEX group might deplete more cognitive resources during task 1 and result in poorer performance in task 2 because affect impacted their cognitive resources. This is the first study using neuroscientific measures to prove that high affective arousal induced by visual arts on packaging may induce heuristic decision-making in consumers, thereby advancing our understanding of neuromarketing. This paper addresses an issue with the sign ‘⊢’ in Frege’s mature version of Begriffsschrift, i.e., the version in ‘Function and Concept’ and Grundgesetze. The sign is a performative for asserting in that writing down ‘⊢p’ is equivalent to asserting that p. Frege further says that writing ‘ p’ is also equivalent to identifying the reference of ‘p’ with the truth-value True. It looks as if he holds that asserting that p consists in identifying the True with the reference of (...) ‘p’. Frege’s commitment to it, however, seems to encounter a number of tensions. This paper aims to show that these tensions can be avoided by endorsing a non-assertive conception of identification under which making an identification is not making an identity assertion. The suggested reading leads to an entirely di erent understanding of the compositionality of the sign ‘⊢’ as well as Frege’s conception of assertion and judgment. (shrink)

Right-wing parties and governments in Europe have recently expressed greater hostility towards cultural pluralism, at times officially denunciating multiculturalism, and calling for the closure of borders and denial of rights to non-European nationals. Within this context, this article argues for rethinking Europe through radically transgressive and transnational understandings of cosmopolitanism as articulated by growing transnational populations within Europe such as immigrants, refugees, and irregular migrants. Transgressive forms of cosmopolitanism disrupt European notions of borders and identities in ways that challenge both (...) liberal multiculturalism and assimilationist positions. This article explores the limits of traditional cosmopolitan thinking while offering a vision of cosmopolitanism based on everyday negotiations with cultural differences, explained using two illustrative examples or snapshots. A learning health system (LHS) seeks to establish a closer connection between clinical care and research and establishes new responsibilities for healthcare providers as well as patients. A new set of technological approaches in medication adherence monitoring can potentially yield valuable data within an LHS, and raises the question of the scope and limitations of patients’ responsibilities to use them. We argue here that, in principle, it is plausible to suggest that patients have a prima facie obligation to use novel (...) adherence monitors. However, the strength of the obligations depends considerably on the extent to which data that adherence monitors generate are, in fact, used to further the goals of LHSs. The way in which data ownership is structured in the USA poses a considerable challenge here, while the European Union framework offers a more promising alternative. (shrink)

The problem of wasteful clinical trials has been debated relentlessly in the medical community. To a significant extent, it is attributed to redundant trials – studies that are carried out to address questions, which can be answered satisfactorily on the basis of existing knowledge and accessible evidence from prior research. This article presents the first evaluation of the potential of the EU Clinical Trials Regulation 536/2014, which entered into force in 2014 but is expected to become applicable at the end (...) of 2021, to prevent such trials. Having reviewed provisions related to the trial authorisation, we propose how certain regulatory requirements for the assessment of trial applications can and should be interpreted and applied by national research ethics committees and other relevant authorities in order to avoid redundant trials and, most importantly, preclude the unnecessary recruitment of trial participants and their unjustified exposure to health risks. The prevailing interpretation of ren (humanness) in the Analects is ethical. One consequence of this interpretation is the one-dimensional image of the Confucian junzi (noble man) as a rigid moralist, a fastidious observer of li (ritual). But there are numerous passages in the Analects that resist such a one-sided representation of the junzi, especially Confucius's remarks related to the (Book of) Songs and music. My basic thesis is that Confucius's concept of junji is aesthetic. This is implied by his notion (...) of junji ru (noble scholar) as opposed to xiaoren ru (common scholar). The noble man is one awakened to the beauty of humanness. It is because of this awareness that he 'sets his mind on the Way, depends on virtue, relies on ren and enjoys the arts.' Confucius included the Songs and music in his curriculum precisely for the purpose of cultivating in his pupils this aesthetic sensibility. (shrink)
