During the last half of the twentieth century, legal philosophy (or legal theory or jurisprudence) has grown significantly. It is no longer the domain of a few isolated scholars in law and philosophy. Hundreds of scholars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The primary aim of the Law and Philosophy Library is to present some of the best original work on legal philosophy from (...) both the Anglo-American and European traditions. Not only does it help make some of the best work avail able to an international audience, but it also encourages increased awareness of, and interaction between, the two major traditions. The primary focus is on full-length scholarly monographs, although some edited volumes of original papers are also included. The Library editors are assisted by an Editorial Advisory Board of internationally renowed scholars. Legal philosophy should not be considered a narrowly circumscribed field. (shrink)

We propose a non-standard interpretation of Alternating-time Temporal Logic with imperfect information, for which no commonly accepted semantics has been proposed yet. Rather than changing the semantic structures, we generalize the usual interpretation of formulae in single states to sets of states. We also propose a new epistemic operator for ?practical? or ?constructive? knowledge, and we show that the new logic (which we call Constructive Strategic Logic) is strictly more expressive than most existing solutions, while it retains the same model (...) checking complexity. In this paper, we present two experimental studies on reference of complex demonstratives. The results of our experiments challenge the dominant view in philosophy of language, according to which demonstrative reference is determined by the speaker's intentions. The first experiment shows that in a context where there are two candidates for the referent—one determined by the speaker’s intention, the other by some “external” factors—people prefer to identify the referent of a demonstrative with the latter object. The external factors for which (...) this prediction has been confirmed include the speaker’s demonstration and the descriptive content of a demonstrative. The second experiment shows that while this preference can be explained in terms of the speakers’ having different sorts of referential intentions, the relevant kind of intentions are fully opaque to the subjects. At the end of our paper, we point to some alternative accounts of demonstrative reference, including a pluralistic and hybrid approach, which can accommodate our experimental results. (shrink)

In this article I challenge the claim that nuclearity is a central principle in the organization of texts. I propose the Framework for the Relational Analysis of Texts which accounts for the paratactic and hypotactic realization of coherence relations. Within this framework, the taxis of coherence relations is co-textually dictated. I consider the writer choices in the distribution of discoursal salience and the intertextual and intercultural variation of these choices. It is suggested that divergence between approaches that perceive text as (...) exhibiting both hypotactic and paratactic organization and those that see nuclearity as a basic characteristic of text structure arises from differences in the linguistic corpora examined during the construction of respective theoretical frameworks. ABSTRACT This article argues for a unique role of imagination and mental images in the moral education of students. Imagination is rendered here as a capacity oriented toward realizable and salient goals; mental images are understood as particular future-oriented self-representations (FOSRs) devised by and held in imagination. FOSRs have four moral attributes: they are 1) expressive of us as moral agents, 2) shape our moral identity, 3) serve as moral pointers, and 4) help devise mitigating strategies. FOSRs can be created (...) and utilized in educational settings to further the goals of moral education by i) fostering sensitivity to moral situations among students, ii) motivating learners to act morally, iii) facilitating environments supportive of moral practice and moral habituation, and iv) helping strengthen cross-situational consistency of moral action. The four moral attributes of future-oriented self-representations (FOSRs) (1–4) that are to be engaged in moral education to further its goals (i–iv) are correlated with four elements of moral education, namely: a) moral awareness; b) moral competency; c) moral motivation; and d) moral capacity. To argue for the special role of imagination and mental images in moral education this paper integrates philosophical research and conceptual and empirical studies in psychology and education on the morality of imagination and mental images. In [5] we study Nonassociative Lambek Calculus augmented with De Morgan negation, satisfying the double negation and contraposition laws. This logic, introduced by de Grooté and Lamarche [10], is called Classical Non-Associative Lambek Calculus. Here we study a weaker logic InNL, i.e. NL with two involutive negations. We present a one-sided sequent system for InNL, admitting cut elimination. We also prove that InNL is PTIME.

Traditional martial arts continue to be interesting and inspiring to many people around the globe. Some of their contemporary adaptations attract enthusiasts for whom they are especially important. In this article, the author bases his observations on his own long-term participation. The analysis takes into account the influence of the perspectives of Jigoro Kano and several other creators of modern varieties of Japanese budo. Lawrence Nelson (2018) criticizes conscientious objection (CO) to abortion statutes as far as they permit health care providers to escape criminal liability for what would otherwise be the legally wrongful taking of a pregnant woman’s life by refusing treatment (i.e. abortion). His key argument refers to the U.S. Supreme Court judgment (Roe v. Wade 1973) that does not treat the unborn as constitutional persons under the Fourteenth Amendment. Therefore, Nelson claims that within the U.S. legal system any vital interests of (...) pregnant women must always take precedence over fetuses’ interests. While agreeing with the main thesis of the article, we believe that the author’s argument neither vindicates his claim, nor explains why those who believe that fetuses are equally protectable human beings do not have the right to refuse to perform an abortion in lifethreatening emergency circumstances (AE). Therefore, the main aim of our commentary is to outline, by referring to our earlier works on conscientious objection in health care (Z_ uradzki 2016) and cultural exemptions (Ciszewski 2016), a better and universalizable argumentative path that would lead to the same conclusion. Action logic of Pratt [21] can be presented as Full Lambek Calculus FL [14, 17] enriched with Kleene star *; it is equivalent to the equational theory of residuated Kleene algebras (lattices). Some results on axiom systems, complexity and models of this logic were obtained in [4, 3, 18]. Here we prove a stronger form of *-elimination for the logic of *-continuous action lattices and the –completeness of the equational theories of action lattices of subsets of a finite monoid and (...) action lattices of binary relations on a finite universe. This paper claims that the intuitive and widespread legitimating power of majority rule (MR) arises from the link between majority rule and the principle of equality of political opportunity. The egalitarian character of MR is established by exploring “puzzles” in democratic theory, such as the insensitivity of democratic voting procedures to unequal intensity of citizens' preferences, and the relationship between the principle of unanimity (sometimes thought better to respect citizens' equality) and MR. Special attention is directed to the relationship between (...) political equality and equality in the outcomes of political decisions: The claim is made that the language of equal political opportunity captures well the idea of equal political influence, in the circumstance of disagreement about what is required to achieve equal treatment through the outcomes of political decisions. Warsaw Wild Captive Pisula Stryjek rats - Establishing a breeding colony of Norway Rat in captivity It is believed that the history of laboratory rat dates back to 1820-ies, which is about 300 generations. This relatively short evolutionary distance, drastically different environment and selective breeding could have caused differences in behaviour between the laboratory rat and his wild counterpart - Norway rat. The vast majority of research concerning differences between wild and laboratory rats was conducted over 30 years ago. The (...) knowledge acquired as a result of that research seems far from being complete. Over a quarter of a century could have deepened the described differences. Nowadays the change in experimental approach, in favour of low stress conditions, can give a new insight into this problem. This article describes process of establishing a laboratory line of wild Norway rat, which will take part in a broad series of comparative studies. 16 wild rats were trapped in 5 distant parts of Warsaw. Most of wild rats successfully adapted to captive conditions, mating successfully and producing litters, which have survived to adolescence. (shrink)

The purpose of the article is to investigate the philosophical and theological validity and coherence of the classical concept of a miracle within the contemporary scientific world view. The main tool in this process will be the cognitive standard model of the formation of religious beliefs operative in the cognitive science of religion. The application of this model shows why an intentional agent is assigned as responsible for the occurrence of events with no visible cause such as a miracle: miracles (...) are events that violate the intuitively expected behaviors observable in the physical reality. It will become evident that much of the conceptual content of the classical understanding of miracles can be retained despite of the ontological and epistemological challenges of the contemporary science. In particular, this concerns the semantic view of miracles in which a miracle does not occur as an objective Divine intervention but qualifies as religious interpretation of the natural course of events always in reference to a cultural and personal context that is unique to those who directly experience these events either as direct recipients or as observers. Traditionally, political legitimacy has been associated exclusively with states. But are states actually legitimate? And why should discussions of legitimacy focus only on the nation-state? This volume explores how legitimacy is intertwined with notions of statehood and how it reaches beyond the state into supranational institutions.

Early twelfth-century logicians invoked past-tensed statements with future-oriented contents to undermine the assumption that every proposition ‘about the past’ is determinate. In the second half of the century, the notion of future-dependence was used to restrict the scope of necessity per accidens. At some point, this idea began to be applied in theology to solve puzzles surrounding predestination, prescience, prophecy, and faith. In the mid-1160s, Magister Udo quotes some thinkers who insisted that the principle of the necessity of the past (...) should exclude dicta that ‘relate to the future’, such as that he has been predestined. Peter of Poitiers adopted this ‘Ockhamist’ strategy around 1170. We find similar accounts in Simon of Tournai and Alan of Lille, who invoked it in other contexts as well. By the time of Praepositinus of Cremona, Hubert of Pirovano, and Stephen Langton, the restricted principle became something of a common view at Paris. (shrink)

This book examines the relationship between the idea of legitimacy of law in a democratic system and equality, conceived in a tripartite sense: political, legal, and social. Exploring the constituent elements of the legal philosophy underlying concepts of legitimacy, this book seeks to demonstrate how a conception of democratic legitimacy is necessary for understanding and reconciling equality and political legitimacy by tracing and examining the conceptions of equality in political, legal, and social dimensions. -/- In the sphere of political equality (...) this book argues that the best construction of equality in a democratic system - which resonates with the legitimizing function of majority rule - is that of equality of political opportunity. It is largely procedural, but those procedures represent important substantive values built into a majoritarian system. In the sphere of legal equality it argues that a plausible conception of non-discrimination can be constructed through a "reflective equilibrium" process, and should reject a thoughtless assumption that the presence of some particular criteria of differentiations necessarily taints a legal classification as discriminatory. Finally, the chapters on social equality explore, in some detail, the currently influential, and presumptively attractive, "luck egalitarianism": the idea that social equality calls for neutralizing the disparate effects of bad brute luck upon a person's position in society. Truth conditions of sentences ascribing non-doxastic propositional attitudes seem to depend on the information structure of the embedded clause. In this paper, we argue that this kind of sensitivity is a semantic phenomenon rather than a pragmatic one. We report four questionnaire studies which explore the impact of the information structure on the truth conditions of non-doxastic attitude ascriptions from different perspectives. The results of the first two studies show that the acceptability of those ascriptions can be affected by some (...) structural modifications of the embedded clause, in particular, when we replace a simple form by an equivalent complex _conjunctional_ form (‘_p_ and _q_’). However, it is possible that different evaluations of such ascriptions have a pragmatic source, namely, the ascriptions with embedded conjunction _imply_ that the agent’s attitude transfers to both conjuncts. In the second pair of studies, we further investigate the nature of this implication which can be classified as ‘Conjunction Elimination’ (CE) in the scope of an attitude verb. The results show that CE-inferences in the context of non-factive non-doxastic attitude ascriptions are not easily cancellable and hence of a semantic rather than pragmatic nature. The results are not conclusive when it comes to the factive non-doxastic attitudes. We conclude our findings by some considerations about a potential source of the observed difference between non-factive and factive attitude verbs and the significance of our general findings to the semantic theory of non-doxastic attitude ascriptions. In this article the author argues that the 'Liar' Paradox sentence: "This sentence is false" is neither true nor false because it does not express any proposition or "Satz" in the sense of Bernard Bolzano. The difficulty left open is that by a similar line of reasoning also the sentence "This sentence is true" would not express any proposition, yet it is sometimes taken to be true (on the strength of a theorem by Loewe).

Response to spatial and nonspatial change in wild and Wistar rats The purpose of the experiment was to investigate the effects of domestication on exploration in rats. The comparison was made between wild Warsaw-Wild-Captive-Pisula-Stryjek rats and Wistar laboratory rats. The study used a purpose-built maze divided into zones connected with a corridor. Objects were placed in two out of four zones. Their location and shape were subject to experimental manipulation. Transporter used to move rats to the maze provided the opportunity (...) for spontaneous exploration of the experimental arena. Rats were subjected to a series of 10 sessions, followed by a spatial or nonspatial change in the experimental arena, after which another 5 experimental sessions were conducted. The study revealed that wild rats had much higher exploration latency than their laboratory counterparts. At each analyzed stage, WWCPS rats spent much more time in the transporter than Wistar rats. Wistar rats spent much more time during the experiment on object interaction in the experimental arena. In post-manipulation sessions, however, it was wild rats that explored object zones relatively longer than laboratory rats. No differences in the animals' behavior depending on the type of change were observed. Results suggest that wild rats tend to explore much more cautiously than laboratory rats and are more sensitive to changes in their environment. The underlying cause of these differences is likely to be the higher level of stress in wild rats, resulting from threats in their natural habitat. (shrink)

This article discusses the “Argument from Inference” raised against the view that definite descriptions are semantically referring expressions. According to this argument, the indicated view is inadequate since it evaluates some invalid inferences with definite descriptions as “valid” and vice versa. I argue that the Argument from Inference is basically wrong. Firstly, it is crucially based on the assumption that a proponent of the view that definite descriptions are referring expressions conceives them as directly referring terms, i.e., the terms which (...) contribute their referents into the semantic content of the sentences in which they occur. However, the framework of direct reference is not essential to the idea that descriptions might have semantic referential interpretation. Secondly, the Argument of Inference - if correct - suffices to establish an overgeneralized conclusion that even paradigmatically referring terms, like proper names, cannot be semantically referential. This fact indicates that the argument is flawed. In the final part of this article, I briefly consider what the source of the problem with the Argument of Inference might be. (shrink)

Unraveling molecular and functional heterogeneity of niche cells within the developing endoderm could resolve mechanisms of tissue formation and maturation. Here, we discuss current unknowns in molecular mechanisms underlying key developmental events in pancreatic islet and intestinal epithelial formation. Recent breakthroughs in single‐cell and spatial transcriptomics, paralleled with functional studies in vitro, reveal that specialized mesenchymal subtypes drive the formation and maturation of pancreatic endocrine cells and islets via local interactions with epithelium, neurons, and microvessels. Analogous to this, distinct intestinal (...) niche cells regulate both epithelial development and homeostasis throughout life. We propose how this knowledge can be used to progress research in the human context using pluripotent stem cell‐derived multilineage organoids. Overall, understanding the interactions between the multitude of microenvironmental cells and how they drive tissue development and function could help us make more therapeutically relevant in vitro models. In this paper, representational structures of arithmetical thinking, encoded in human minds, are described. On the basis of empirical research, it is possible to distinguish four types of mental number lines: the shortest mental number line, summation mental number lines, point-place mental number lines and mental lines of exact numbers. These structures may be treated as generative mechanisms of forming arithmetical representations underlying our numerical acts of reference towards cardinalities, ordinals and magnitudes. In the paper, the theoretical framework for a (...) formal model of mental arithmetical representations is constructed. Many competitive conceptions of the mental system responsible for our arithmetical thinking may be unified within the presented framework. The paradigm underlying our research may be interpreted philosophically as a neo-Kantian approach to modeling the mind’s representational structures. (shrink)

By spelling out the affective dimension of admiration, this paper challenges the view of admiration as a trustworthy means of detecting morally desirable qualities in exemplars. Such a view of admiration, foundational for the current debate on exemplars in moral education, holds that admiration is a self-motivating emotion essentially oriented toward the good and the excellent. I demonstrate that this view ignores the affective aspects of admiration explored widely in the history of philosophy on which the debate on moral exemplars (...) substantially draws. Focusing on Spinoza, Smith, Kierkegaard, and Nietzsche, I bring to light their largely skeptical views of the moral value of admiration. These thinkers indicate that admiration can be influenced by, and is often conflated with, other emotions, and can arise in us through behavioral mimicry; moreover, admiration is often oriented toward the mediocre and corrupt, is contagious, self-referential, collective, and has limited motivational power. Their remarks on the affective dimension of admiration call into question admiration’s applicability and usefulness in moral exemplarity. (shrink)

Well-being is becoming an increasingly popular issue in economics. The aim of the article is to present the concept of well-being and the methods of its measurement and to examine the statistical significance between the results obtained by specific indicators. The article was written based on the meta-analysis of the books and scientific papers on the subject, as well as well-being and welfare measurement reports. The study shows that there is a very wide range of theories and concepts related to (...) well-being which are sometimes exceptive. The most important conclusion from the study is that the correlation between welfare and well-being represented respectively by GDP and HDI is very strong, while the correlation between welfare and life satisfaction as well as well-being and subjective well-being are negligible.
