The value and limits of rights: a reply.Peter Jones - 2012 - Critical Review of International Social and Political Philosophy 15 (4):495-516.
I reply to each of the contributions in this issue. I agree with much that Hillel Steiner argues, especially his insistence that the associated ideas of impartiality and discontinuity are crucial to dealing satisfactorily with a diversity of competing claims. I am, however, less willing to conceive provision for that diversity as the role, rather than a role, that we should ascribe to rights. I question the success of David Miller’s endeavour to provide a unified justification of human rights (...)

  4. The Unique Groundability of Temporal Facts.John Cusbert & Kristie Miller - 2018 - Philosophy and Phenomenological Research 97 (2):410-432.
The A-theory and the B-theory advance competing claims about how time is grounded. The A-theory says that A-facts are more fundamental in grounding time than are B-facts, and the B-theory says the reverse. We argue that whichever theory is true of the actual world is also true of all possible worlds containing time. We do this by arguing that time is uniquely groundable: however time is actually grounded, it is necessarily grounded in that way. It follows that if either the (...)

We discuss misinformation about “the liar antinomy” with special reference to Tarski’s 1933 truth-definition paper [1]. Lies are speech-acts, not merely sentences or propositions. Roughly, lies are statements of propositions not believed by their speakers. Speakers who state their false beliefs are often not lying. And speakers who state true propositions that they don’t believe are often lying—regardless of whether the non-belief is disbelief. Persons who state propositions on which they have no opinion are lying as much as those who (...)

Civil Wrongs and Justice in Private Law.John Oberdiek & Paul Miller (eds.) - 2020 - New York, NY, USA: Oxford University Press.
Civil wrongs occupy a significant place in private law. They are particularly prominent in tort law, but equally have a place in contract law, property and intellectual property law, unjust enrichment, fiduciary law, and in equity more broadly. Civil wrongs are also a preoccupation of leading general theories of private law, including corrective justice and civil recourse theories. According to these and other theories, the centrality of civil wrongs to civil liability shows that private law is fundamentally concerned with the (...)

Ambitious targets to reduce greenhouse gas emissions from agriculture have been set by both national governments and their respective livestock sectors. We hypothesize that farmer self-identity influences their assessment of climate change and their willingness to implement measures which address the issue. Perceptions of climate change were determined from 286 beef/sheep farmers and evaluated using principal component analysis. The analysis elicits two components which evaluate identity, and two components which evaluate behavioral capacity to adopt mitigation and adaptation measures. Subsequent Cluster (...)

It is well established that demographic representation in clinical research is important for understanding the safety and effectiveness of novel therapeutics and vaccines in diverse patient populations. In recent years, the National Institutes of Health and Food and Drug Administration have issued guidelines and recommendations for the inclusion of women, older adults, and racial and ethnic minorities in research. However, these guidelines fail to provide an adequate explanation of why racial and ethnic representation in clinical research is important. This article (...)

  37. Can children withhold consent to treatment.John Devereux, Donna Dickenson & D. P. H. Jones - 1993 - British Medical Journal 306 (6890):1459-1461.
A dilemma exists when a doctor is faced with a child or young person who refuses medically indicated treatment. The Gillick case has been interpreted by many to mean that a child of sufficient age and intelligence could validly consent or refuse consent to treatment. Recent decisions of the Court of Appeal on a child's refusal of medical treatment have clouded the issue and undermined the spirit of the Gillick decision and the Children Act 1989. It is now the case (...)

  38. ‘I like to run to feel’: Embodiment and wearable mobile tracking devices in distance running.John Toner, Jacquelyn Allen-Collinson, Patricia Jackman, Luke Jones & Joe Addrison - 2023 - Qualitative Research in Sport, Exercise and Health 15.
Many experienced runners consider the use of wearable devices an important element of the training process. A key techno-utopic promise of wearables lies in the use of proprietary algorithms to identify training load errors in real-time and alert users to risks of running-related injuries. Such real-time ‘knowing’ is claimed to obviate the need for athletes’ subjective judgements by telling runners how they have deviated from a desired or optimal training load or intensity. This realist-contoured perspective is, however, at odds with (...)

This study describes the results of a retrospective review of patients' charts who had an advanced directive (AD) and who were hospitalized in a tertiary, acute care teaching hospital. The purpose of the review was to understand from clinical, sociological, ethical and legal perspectives the nature and utility of ADs. Findings and implications of the review are discussed in terms of: patient demographics; diagnoses; quality of ADs; influence of ADs on clinical decisions; and legal aspects of ADs.

The classical utilitarian legacy of Jeremy Bentham, J. S. Mill, James Mill, and Henry Sidgwick has often been charged with both theoretical and practical complicity in the growth of British imperialism and the emerging racialist discourse of the nineteenth century. But there has been little scholarly work devoted to bringing together the conflicting interpretive perspectives on this legacy and its complex evolution with respect to orientalism and imperialism. This volume, with contributions by leading scholars in the field, represents the first (...)

The dominant unspoken philosophical basis of medical care in the United States is a form of Cartesian reductionism that views the body as a machine and medical professionals as technicians whose job is to repair that machine. The purpose of this paper is to advocate for an alternative philosophy of medicine based on the concept of healing relationships between clinicians and patients. This is accomplished first by exploring the ethical and philosophical work of Pellegrino and Thomasma and then by connecting (...)

In recent years, the role of self-tracking technologies has been investigated, debated and critiqued within qualitative research circles. The principal means by which self-tracking technologies seek to promote health-related behaviours and behaviour change is through the use of ‘nudges’. Despite the increasing prevalence of nudge-style modes of body-mind governance, there remains little in-depth qualitative research on people’s embodied responses to this form of behavioural management. The current study sought to address this lacuna by drawing on a form of empirical, sociological (...)
