The Pareto principle states that if the members of society express the same preference judgment between two options, this judgment is compelling for society. A building block of normative economics and social choice theory, and often borrowed by contemporary political philosophy, the principle has rarely been subjected to philosophical criticism. The paper objects to it on the ground that it indifferently applies to those cases in which the individuals agree on both their expressed preferences and their reasons for (...) entertaining them, and those cases in which they agree on their expressed preferences, while differing on their reasons. The latter are cases of "spurious unanimity", and it is normatively inappropriate, or so the paper argues, to defend unanimity preservation at the social level for them, so the Pareto principle is formulated much too broadly. The objection seems especially powerful when the principle is applied in an ex ante context of uncertainty, in which individuals can disagree on both their probabilities and utilities, and nonetheless agree on their preferences over prospects. Satr al-awrah (Hijab /veiling) is one of the obligatory provisions for men and women in Islam. Satr al-awrah, as a religious/jurisprudential term, means covering the parts of the body (awrah) that should be covered by religion. Islamic jurisprudents have disagreed on whether satr al-awrah is a condition of validity for prayer. There are two basic approaches to this issue, one of which belongs to the public (jumhūr including the Hanafī, Shafiī and Hanbalī schools) and the other to the Mālikīs. According (...) to the majority (jumhūr), satr al-awrah is a validity condition of the prayer. Therefore, a prayer performed without fulfilling the satr al-awrah condition is not valid. A prayer performed in this way must be re-performed absolutely within or outside of time. There are two approaches in the Mālikī school regarding whether the satr al-awrah is a condition for the validity of the prayer. The first approach is (partly) the same as the jumhūr. According to the second approach (without any distinction between prayer and outside the prayer), satr al-awrah is a general obligation in Islam and is not a valid condition for prayer.According to the Mālikīs who accept this second view, it is sunnah to comply with the satr al-awrah condition in prayer. On the other hand, in the Mālikī school, awrah is divided into two as ʿawrah mughallaẓa and ʿawrah mukhaffafa in terms of its effect on the validity of prayer. The disagreement about whether the satr al-awrah is a condition of validity for the prayer is related to the ʿawrah mughallaẓa. On the other hand, there is an agreement that the ʿawrah mukhaffafa is not a condition for the validity of the prayer. The disagreement in the classical fiqh doctrine about whether the satr al-awrah is a condition for the validity of the prayer has some jurisprudential consequences. As a matter of fact, according to the majority, whether it is ʿawrah mughallaẓa or mukhaffafa, a prayer performed with an uncovered awrah is not valid and must be re-performed absolutely. In the Mālikī school, there are different opinions depending on whether it is ʿawrah mughallaẓa or mukhaffafa. If the place uncovered on the body is ʿawrah mughallaẓa; According to those who accept the satr al-awrah as a condition for the validity of the prayer, the prayer is not valid and must be re-performed absolutely. After the time has passed, the prayer does not have to be repeated. If the place uncovered on the body is ʿawrah mukhaffafa, according to all Mālikīs, unanimously the prayer is valid. Although it is recommended to reperformed it in time, it is not required to be returned after the time has passed. The following can be said about the practical examples of the disagreement in the classical fiqh doctrine regarding whether the satr al-awrah is a condition for the validity of the prayer, especially in terms of ʿawrah mukhaffafa: According to Mālikīs, who do not accept the validity of the satr al-awrah for prayer, it is valid for women to pray with their heads down, below the knees and with their arms uncovered. Again, according to them, it is valid for men to perform prayers with their thighs/hips (fakhz) uncovered, since it is considered one of the private parts. (shrink)

Sober and Lewontin's critique of genic selectionism is based upon the principle that a unit of selection should make a context‐independent contribution to fitness. Critics have effectively shown that this principle is flawed. In this paper I show that the context independence principle is an instance of a more general principle for characterizing causes,called the contextual unanimity principle. I argue that this latter principle, while widely accepted, is erroneous. What is needed is to (...) replace the approach to causality characterized by the contextual unanimity criterion with an approach based on the concept of causal mechanism. Alfred North Whitehead was a prominent English mathematician and philosopher who co-authored the highly influential Principia Mathematica with Bertrand Russell. Originally published in 1919, and first republished in 1925 as this Second Edition, An Enquiry Concerning the Principles of Natural Knowledge ranks among Whitehead's most important works; forming a perspective on scientific observation that incorporated a complex view of experience, rather than prioritising the position of 'pure' sense data. Alongside companion volumes The Concept of Nature and The Principle of (...) Relativity, it created a framework for Whitehead's later metaphysical speculations. This volume offers an English translation of John of St. Thomas's Cursus theologicus I, question I, disputation 2. In this particular text, the Dominican master raises questions concerning the scientific status and nature of theology. At issue, here, are a number of factors: namely, Christianity's continual coming to terms with the "Third Entry" of Aristotelian thought into Western Christian intellectual culture - specifically the Aristotelian notion of 'science' and sacra doctrina's satisfaction of those requirements - the Thomistic-commentary tradition, and the (...) larger backdrop of the Iberian Peninsula's flourishing "Second Scholasticism." In this latter context, John of St. Thomas applies the theological principles of Thomas Aquinas to the Scholastic disputes preoccupying Thomist, Franciscan, and Jesuit theologians, such as Cajetan, Bañez, Luis de Molina, Vazquez, Suárez - to name only a few - in a tour de force of theological thinking throughout the entire period of Scholasticism. In the process - and not insignificantly - the status quaestionis of theology's scientific character is clearly framed and answered according to John's satisfaction. Key to John of St. Thomas's resolution of the question is his understanding of the continuity of the power of human reason with the super-intelligibility of divine revelation spelled out in terms of what he calls "virtual revelation." This text presented in this volume is a quintessential example of the deep and abiding harmony that flourished between faith and reason as well as grace and nature within the golden era of Baroque Scholasticism. Reuben Hersh is a champion of maverick philosophy of mathematics. He maintains that mathematics is a human activity, intelligible only in a social context; it is the subject where statements are capable in principle of being proved or disproved, and where proof or disproof bring unanimous agreement by all qualified experts; mathematicians' proof is deduction from established mathematics; mathematical objects exist only in the shared consciousness of human beings. We need to acknowledge that the members of most modern societes adhere to different and partially contradictory moral convictions which to overcome we yet don’t have the intellectual means. Since such convictions typically include opions about which moral rules should be established as laws there will be disagreement about the correct rules of law as well. The article investigates the possibilities to find a system of laws that all can accept on the basis of such moral pluralism. It develops six (...) steps and models for the required justification. In this article we critically examine the principle of equivalence of care in prison medicine. First, we provide an overview of how the principle of equivalence is utilized in various national and international guidelines on health care provision to prisoners. Second, we outline some of the problems associated with its applications, and argue that the principle of equivalence should go beyond equivalence to access and include equivalence of outcomes. However, because of the particular context of the prison (...) environment, third, we contend that the concept of “health” in equivalence of health outcomes needs conceptual clarity; otherwise, it fails to provide a threshold for healthy states among inmates. We accomplish this by examining common understandings of the concepts of health and disease. We conclude our article by showing why the conceptualization of diseases as clinical problems provides a helpful approach in the delivery of health care in prison. (shrink)

We analyse the liberal ethics of noninterference in social choice. A liberal principle, capturing noninterfering views of society and inspired by John Stuart Mill's conception of liberty, is examined. The principle expresses the idea that society should not penalise individuals after changes in their situation that do not affect others. An impossibility for liberal approaches is highlighted: every social decision rule that satisfies unanimity and a general principle of noninterference must be dictatorial. In this study Friedrich Waismann gives a systematic presentation of insights into philosophical problems which can be achieved by clarifying the language in which the problems are posed. Much of the material and the method itself derive from Wittgenstein's work in the early 30s. The book was originally envisaged as a lucid and well organized account of Wittgenstein's distinctive form of linguistic philosophy to enable the Vienna Circle to incorporate these valuable methods into their own programme of analysis. The project (...) evolved over many years into a wide-ranging survey of the dissolution of many philosophical problems and the construction of a systematic philosophical grammar. Waismann shows in detail how puzzlement can be removed by careful description of the uses of the terms employed in framing problems. At the same time, he sketches a general framework for analysis of language, including chapters on names, general terms, logical operators, propositions, questions, etc. This book is an authoritative presentation of Wittgenstein's influential philosophy of language in a format much easier to follow than his own intricate and elusive texts. Waismann exhibits clearly the merits of this method of philosophizing. This book should serve as an important and useful text for those who wish to understand the method and power of linguistic philosophy. It has no equal as an introduction to Wittgenstein's philosophy. BackgroundThis is the first qualitative study to investigate how researchers, who do empirical work in bioethics, relate to objectives of empirical research in bioethics (ERiB). We explore reasons that make some objectives more acceptable, while others are deemed less acceptable.MethodsUsing qualitative exploratory study design, we interviewed bioethics researchers, who were selected to represent different types of scholars working in the field. The interview data of 25 participants were analyzed in this paper using thematic analysis. ResultsFrom the eight objectives presented to (...) the study participants, understanding the context of a bioethical issue and identifying ethical issues in practice received unanimous agreement. Participants also supported other objectives of ERiB but with varying degrees of agreement. The most contested objectives were striving to draw normative recommendations and developing and justifying moral principles. The is-ought gap was not considered an obstacle to ERiB, but rather a warning sign to critically reflect on the normative implications of empirical results.ConclusionsOur results show that the most contested objectives are also the more ambitious ones, whereas the least contested ones focus on producing empirical results. The potential of empirical research to be useful for bioethics was mostly based on the reasoning pattern that empirical data can provide a testing ground for elements of normative theory. Even though empirical research can inform many parts of bioethical inquiry, normative expertise is recommended to guide ERiB. The acceptability of ambitious objectives for ERiB boils down to finding firm ground for the integration of empirical facts in normative inquiry. (shrink)

One objection to the principle of public reason is that since there is room for reasonable disagreement about distributive justice as well as about human flourishing, the requirement of reasonable acceptability rules out redistribution as well as perfectionism. In response, some justificatory liberals have invoked the argument from higher-order unanimity, or nested inclusiveness. If it is not reasonable to reject having some system of property rights, and if redistribution is just the enforcement of a different set of property (...) rights, redistribution is legitimate if chosen democratically. This article explores two problems with this response. First, there are different ways to describe the set of possible policies, and so different ways to specify the noncoercive default that obtains in the absence of conclusive justification. Second, if the coercive exercise of political power must be conclusively justified, policies that are more coercive ought to require conclusive justification as against policies that are less coercive. These problems about the baseline with respect to which we require public justification raise the question of how we measure coercion, and whether or in what sense there is a presumption against coercion. Background:Moral courage is defined as courage to act according to one’s own ethical values and principles even at the risk of negative consequences for the individual. In a complex nursing practice, ethical considerations are integral. Moral courage is needed throughout nurses’ career.Aim:To analyse graduating nursing students’ moral courage and the factors associated with it in six European countries.Research design:A cross-sectional design, using a structured questionnaire, as part of a larger international ProCompNurse study. In the questionnaire, moral courage was assessed with (...) a single question (visual analogue scale 0–100), the questionnaire also covered several background variables.Participants and research context:The sample comprised graduating nursing students (n = 1796) from all participating countries. To get a comprehensive view about graduating nursing students’ moral courage, the views of nurse managers (n = 538) and patients (n = 1327) from the same units in which the graduating nursing students practised were also explored, with parallel questionnaires.Ethical considerations:Ethical approvals and research permissions were obtained according to national standards in every country and all participants gave their informed consent.Results:The mean of graduating nursing students’ self-assessed moral courage was 77.8 (standard deviation 17.0; on a 0–100 scale), with statistically significant differences between countries. Higher moral courage was associated with many factors, especially the level of professional competence. The managers assessed the graduating nursing students’ moral courage lower (66.5; standard deviation 18.4) and the patients slightly higher (80.6; standard deviation 19.4) than the graduating nursing students themselves.Discussion and conclusions:In all countries, the graduating nursing students’ moral courage was assessed as rather high, with differences between countries and populations. The article provides an analysis of the European Court of Human Rights judgments in the case of Lautsi v. Italy (application no. 30814/06), also known as the Italian crucifix case. The applicant claimed that displaying crucifixes in the Italian State-school classrooms attended by her children was contrary to the principle of secularism, by which she wished to bring up her children, and therefore infringed her right to ensure their education and teaching in conformity with her religious and philosophical convictions, (...) and also breached her freedom of conviction and religion, as protected by Article 9 of the Convention. In its judgment of November 3, 2009, the seven-judge Chamber declared that there had been a violation of Article 2 (right to education) of Protocol No. 1 of the European Convention on Human Rights taken together with Article 9 (freedom of thought, conscience, and religion) of the Convention. The judgment was given unanimously and none of the judges appended a separate opinion. The Italian Government asked for the case to be referred to the Grand Chamber by virtue of Article 43 of the Convention. In the judgment of the Grand Chamber, delivered on March 18, 2011, the Court held, by fifteen votes to two (and with separate opinions of six judges), that there had been no violation of Protocol No. 1 and no violation of the Convention itself. The analysis in the article is focused on selected principal factors determining the Court's decision. It shows that the proposal for the Court to recognize secular convictions as those protected by Article 2 of Protocol No. 1 or Article 9 of the Convention has no sufficient basis in the Convention itself and in earlier Court's case-law and, even, may be considered as promotion of religious intolerance, threatening the freedom to publicly manifest a religion or belief, as guaranteed by Article 9 of the Convention. -/- Opracowanie zawiera analizę wyroków Europejskiego Trybunału, które zapadły w sprawie Soile Lautsi (app. 30814/06), zwaną „włoska sprawa krzyża” (Italian Crucifix Case). W wyroku siedmioosobowej izby ogłoszonym 3 listopada 2009 r. izba uznała naruszenie art. 2 (Prawo do nauki) Protokołu dodatkowego nr 1 do Konwencji o ochronie praw człowieka i podstawowych wolności w powiązaniu z art. 9 (Wolność myśli, sumienia i wyznania) Konwencji. Wyrok zapadł jednomyślnie i żaden z sędziów nie dołączył do wyroku swoich uwag. Rząd Włoch złożył wniosek w trybie przewidzianym art. 43 Konwencji o przekazanie sprawy do Wielkiej Izby. W wyroku Wielkiej Izby ogłoszonym 18 marca 2011 r. Trybunał uznał zdecydowaną większością głosów – 15 za wobec 2 przeciw (sześciu sędziów dołączyło swoje uwagi), że nie doszło do naruszenia ani Protokołu nr 1, ani samej Konwencji. Analizy koncentrują się na wybranych zagadnieniach, kluczowych dla argumentacji Trybunału. Analizy te pokazują, że postulowanie przez izbę uznania za prawo podmiotowe radykalnie pojętej negatywnej wolności religijnej, oraz postulowanie - tak przez izbę, jak i przez Wielką Izbę - ochrony przekonań sekularystycznych jako przekonań chronionych art. 2 Protokołu dodatkowego nr 1 lub art. 9 Konwencji, nie posiada należytego uzasadnienia ani w samej Konwencji, ani w dotychczasowym orzecznictwie Trybunału, a co więcej – może być uznane za propagowanie nietolerancji religijnej, godzącej przede wszystkim chronioną art. 9 Konwencji wolność publicznego uzewnętrzniania przekonań religijnych i filozoficznych. Currently in Japan, it is extremely difficult to realize the basic wish of protecting personal dignity at the end of life. A patient’s right to refuse life-sustaining treatment has not been substantially warranted, and advance directives have not been legally enforceable. Unfortunately, it is not until the patient is moribund that all concerned parties start to deliberate on whether or not death with dignity should be pursued. Medical intervention is often perceived as a worthwhile goal to not only preserve life, (...) but also provide psychological benefit to the family, regardless of its effect on the patient. To feel they are doing something, family members tend to act against the imperative “Do not inflict on others what you would not wish done to you,” and permit extraordinary measures they would not want themselves. Another complication in Japanese culture is the necessity of unanimous decisions for end-of-life care. If there is conflict between a patient and his/her family on accepting medical intervention, the view of the latter is more likely to prevail due to different perceptions of human dignity. As a result, incapacitated patients in Japanese clinical settings often suffer through extraneous medical procedures, particularly during end-of-life care. Patient dignity is in danger from a national refusal to accept major bioethical principles such as having respect for patient autonomy, serving the best interests of the patient, doing no harm, and ensuring fairness at the end of life. We argue that more education about human dignity and legislation for death with dignity are necessary. Peace of mind for patients during end-of-life care will never be achieved in this society unless drastic changes take place in medical ethics and law. (shrink)

KANT'S CRITIQUE OF PURE REASON has been studied and analyzed over and over again in relation to its profound affinity with Newtonian science. But for the very reason that the putative validity of the transcendental arguments seems to depend upon this particular form of science as its ultimate model, the claim has been made repeatedly that Kant's philosophical stance can have no literal relevance to the actual problems thought germane to twentieth century physical science. Thus, the advent of the theory (...) of general relativity during the period from 1905 to 1916 has been seen almost unanimously as a sufficiently cogent refutation of some of the essential claims made by Kant regarding the nature of space and time. In the early days of the new theory, philosophers like Schlick, Reichenbach or Meyerson did their utmost to stress the unbridgeable nature of the gap separating the transcendental ideality of space and time from the metrical field used in general relativity. Indeed, the concept of metrical field may be seen as expressing an objective quality of reality because it could not exist at all if there were no phenomena related to matter. More recently, it has been argued that the fatal unrevisability of the Kantian categories necessarily means that the Kantian conception is annihilated and swallowed up by the relativistic one. The traditional distinction drawn by Kant between the form and the content of knowledge is itself reversed, in the sense that "for Kant, the formal components of knowledge are the most stable and objective elements," whereas according to the theory of relativity, "they are the most arbitrary and subjective elements" since the formal universality of the laws of nature depends upon arbitrary transformations of coordinates. This reversal, in turn, indicates that the form-content distinction has in effect been displaced by the very different distinction between the theoretical and the observational. At best, a high degree of correspondence has been accentuated, between the regulative validity of the Kantian a priori and the epistemological foundation underlying the principle of general relativity, inasmuch as the latter's vindication is seen to depend on arguments which are far from merely empirical. Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

The only check on the self-interest of the participants is that there be unanimous acceptance of the principles. But, since animals are not participants, it is possible that principles will be adopted which confiict with what Rawls calls“duties of compassion and humanity” toward animals. This is a consequence of the initial situation’s assumption (...) that principles of justice can be determined independently of other moral considerations. We question this assumption, and show that satisfactory modifications of Rawls’ initial situation undermine its contractarian basis and require the rejection of exclusively self-interested participants. Many of these are traditional virtues and have clear moral significance, such as benevolence, charity, honesty, wisdom, and honor. However, Hume also includes in his list of virtues some character traits whose moral significance is (...) not immediately obvious, such as wit, good manners, and dialogue. Mid-eighteenth century critics of Hume's moral theory almost unanimously felt that his notion of virtue was too broad and that Hume should have distinguished between genuine moral virtues, on the one hand, and mere intellectual abilities on the other. According to the critics, grouping the two together devalues the true virtues. Hume was aware that his broad understanding of the virtues was controversial and we know from his letters that he read at least some of these critiques. He nevertheless vigorously defended his position. Although Hume sees this as an issue worthy of defending, contemporary Hume scholarship has neither discussed the nature of the eighteenth century criticisms nor given adequate attention to the success or failure of Hume's position. I address these issues here. I begin by presenting Hume's defense of his wide view of the virtues as it appears in both the Treatise and the Enquiry concerning the Principles of Morals.1 Then I chronologically present early criticisms of Hume's view, including those by Francis Hutcheson, James Balfour, John Leland, and James Beattie. The three criteria are: (1) moral virtues are a matter of choice and intellectual abilities are not; (2) moral virtues by themsleves aim at a good end and intellectual abilities by themselves do not necessarily do so; and (3) moral virtues are such that the failure to obtain them incites blame, whereas the failure to obtain intellectual abilities does not incite blame. Although I believe that the first criterion fails, I argue that the second and third criteria provide reasonable ways of distinguishing moral virtues from intellectual abilities. Hume's Argument Hume's first account of the wide scope of the virtues appears in Book III, Part iii, of the Treatise, published in 1740. His main criterion in determining the virtue of an agent's character trait is whether the action it produces has consequences that trigger symapthetic feelings of moral pleasure2 in the minds of spectators (T 574-575). In Section 4, entitled "Of Natural Abilities," he argues that the distinction between natural abilities and moral virtues is unfounded since both groups of mental qualities bring forth the same sympathetic moral feelings in the spectator (T 606-614). Anticipating objections, Hume considers several possible points of distinction between natural abilities and moral virtues, but then rejects them all. First, he considers that the precise feelings elicited in the spectator designate two separate classes. Hume's reply is that the precise feelings elicited by each virtue (for example, benevolence, charity, justice) are also distinct in minute ways. Nevertheless, we still classify all such elicited responses as feelings of moral approval. Second, he considers that natural abilities are involuntary whereas moral virtues are the result of free will. Hume's reply is that many involuntary abilities, such as fortitude, have classically been catalogued as virtues. He adds that there is no conceivable reason why any involuntary quality of an agent mazy not produce sympathetic pleasure in the spectator. Third, Hume considers that habits relevant to moral virtues can be altered through reward and punishment, whereas habits relevant to natural abilities are more fixed and cannot be altered by these means. In 1935, the Nazi government introduced what came to be known as the abrogation of the pro- hibition of analogy. This measure, a feature of the new penal law, required judges to stray from the letter of the written law and to consider instead whether an action was worthy of pun- ishment according to the ‘sound perception of the people’ and the ‘underlying principle’ of existing criminal statutes. In discussions of Nazi law, an almost unanimous conclusion is that a (...) system of criminal law ought not to contain legislation of this sort. This conclusion is often based on how the abro- gation relates to the normative claim that the law ought to be predictable. In particular, it has been argued that since the law ought to be predictable, and since this type of analogy legis- lation implied, caused or contributed to the diminution of the law’s predictability, this type of legislation ought to be prohibited. In this paper, we argue that this argument is not entirely correct. While we believe that the law ought to be predictable and that there is evidence for the claim that the Nazis’ intro- duction of analogical reasoning implied, caused, or contributed to a diminution of predictability, this fact is logically too weak to ground the conclusion that necessarily a penal system ought not to contain legislation of this kind. Despite the undeniable wickedness of the Nazi penal system, this type of analogical reasoning can be made consistent with the pre- dictability of the law. We argue that consistency of this sort depends on whether the use of analogy is supplemented by certain contextual background conditions. The occurrence of these conditions blocks an inference from the fact that the law ought to be predictable to the conclusion that a penal system ought not to allow for this type of analogical reasoning. In Arrovian social choice theory assuming the independence of irrelevant alternatives, Murakami (1968) proved two theorems about complete and transitive collective choice rules that satisfy strict non-imposition (citizens’ sovereignty), one being a dichotomy theorem about Paretian or anti-Paretian rules and the other a dictator-or-inverse-dictator impossibility theorem without the Pareto principle. It has been claimed in the later literature that a theorem of Malawski and Zhou (1994) is a generalization of Murakami’s dichotomy theorem and that Wilson’s (1972) impossibility theorem is (...) stronger than Murakami’s impossibility theorem, both by virtue of replacing Murakami’s assumption of strict non-imposition with the assumptions of non-imposition and non-nullness. In this note, we first point out that these claims are incorrect: non-imposition and non-nullness are together equivalent to strict non-imposition for all transitive collective choice rules. We then generalize Murakami’s dichotomy and impossibility theorems to the setting of incomplete social preference. We prove that if one drops completeness from Murakami’s assumptions, his remaining assumptions imply (i) that a collective choice rule is either Paretian, anti-Paretian, or dis-Paretian (unanimous individual preference implies noncomparability) and (ii) that adding proposed constraints on noncomparability, such as the regularity axiom of Eliaz and Ok (2006), restores Murakami’s dictator-or-inverse-dictator result. In the development of modern philosophy self-consciousness was not generally or unanimously given important consideration. This was because philosophers such as Descartes, Kant and Fichte thought it served as the highest principle from which we can 'deduce' all propositions that rightly claimed validity. However, the Romantics thought that the consideration of self-consciousness was of the highest importance even when any claim to foundationalism was abandoned. In this respect, Hölderlin and his circle, as well as Novalis and Schleiermacher, thought that (...) self-consciousness, itself, was not a principle but must be ranked on a minor or dependent level, and presupposed the Absolute as a superior but inaccessible condition or ground. This reservation did not hinder them from recognising that the foundationalist Fichte was the first to have shown conclusively that from Descartes, via German Rationalism and British Empiricism, up to Kant, self-consciousness was misconceived of as the result of an act of reflection by which a second-order act bent back upon a first-order act that is identical to itself. This conception entailed circular entanglements and infinite regresses, and was too high a price to pay. Whereas Fichte thought pre-reflexive self-awareness was a philosophical principle, the Romantics and their vehement critic Kierkegaard, abandoned the idea of self-consciousness as a foundational starting point of philosophy. Instead, they founded self-consciousness on transcendent Being, a prior non-conceptual consciousness ('feeling') and reproached Fichte for having fallen back into the repudiated reflection model of self-consciousness.
