In this article I examine the legal framework for addressing violence against women in post war Guatemala. Since the signing of the Peace Accords in 1996, judicial reform in Guatemala has included the passing of laws in the area of women‘s human rights, aimed at eliminating discrimination and violence against women. These laws constitute a response to and have occurred concurrently to an increase in violent crime against women, particularly in the form of mass rapes and murders. Drawing on fieldwork (...) conducted in Guatemala‘s Metropolitan Area, this paper juxtaposes the laws for addressing violence against women to Guatemalan women‘s complex, multilayered and multi-dimensional life experiences. The latter expose the limitations of strictly legal understandings of the phenomenon of gender-based violence, and highlight the need for broad social justice approaches that take into account the different structures of violence, inequality, and injustice present in women‘s lives. Entre la abadesa medieval alemana Hildegard von Bingen (siglo XII) y la monja clarisa chilena de fines del siglo XVII sor Úrsula Suárez existe una gran distancia histórica y cultural. Sin embargo, algo las aproxima enérgicamente, tal y como si hubieran sido hermanas del mismo claustro. Y esta aproximación no consiste en la vestimenta de hábitos o la proclamación de votos de pobreza, obediencia y castidad, si no que es, por sobre todo, la peripecia que ambas tuvieron que realizar para (...) poder relatar sus experiencias espirituales: pedir el permiso de una figura masculina en el caso de Hildegard, y someterse a la obediencia de esta misma figura en el caso de Úrsula. En este trabajo me propongo exponer cómo los discursos de las monjas que han escrito se subordinan a la aprobación de un modelo de poder y autoridad. Among the medieval German abbess Hildegard von Bingen (XII Century) and the Chilean late seventeenth century Clarisse Sister Ursula Suárez there exists a great historical and cultural distance. However, something strongly approximates them as if they were sisters of the same cloister. And this approach is not the clothing habits or the proclamation of vows of poverty, obedience and chastity, but it is, above all, the adventures that both had to live through in order to describe their spiritual experiences: ask permission of a male figure in the case of Hildegard, and submit to the obedience of this same figure in the case of Ursula. In this paper we propose to show how the discourses of the nuns who have written are subordinated to the approval of a model of power and authority. (shrink)

The core of the problem discussed in this paper is the following: the Church-Turing Thesis states that Turing Machines formally explicate the intuitive concept of computability. The description of Turing Machines requires description of the notation used for the input and for the output. Providing a general definition of notations acceptable in the process of computations causes problems. This is because a notation, or an encoding suitable for a computation, has to be computable. Yet, using the concept of computation, in (...) a definition of a notation, which will be further used in a definition of the concept of computation yields an obvious vicious circle. The circularity of this definition causes trouble in distinguishing on the theoretical level, what is an acceptable notation from what is not an acceptable notation, or as it is usually referred to in the literature, “deviant encodings”. Deviant encodings appear explicitly in discussions about what is an adequate or correct conceptual analysis of the concept of computation. In this paper, I focus on philosophical examples where the phenomenon appears implicitly, in a “disguised” version. In particular, I present its use in the analysis of the concept of natural number. I also point at additional phenomena related to deviant encodings: conceptual fixed points and apparent “computability” of uncomputable functions. In parallel, I develop the idea that Carnapian explications provide a much more adequate framework for understanding the concept of computation, than the classical philosophical analysis. (shrink)

The aim of this paper is to investigate among a group of non-profit organizations: a) the effect of ethical leadership on volunteers’ satisfaction, affective organizational commitment and intention to stay in the same organization; b) the role played by job satisfaction as a mediator in the relationship between ethical leadership and volunteers’ intentions to stay in the same organization, as well as between ethical leadership and affective commitment. An anonymous questionnaire was individually administered to 198 Italian volunteers of different non-profit (...) organizations. The questionnaire contained the Ethical Leadership Scale, the Volunteers Satisfaction Index, the Affective organization Scale, as well as questions regarding the participants’ age, sex, type of work, level of education, length of their volunteer works, intention to volunteer in the following months in the same organization. The construct as well the effects of EL on volunteers is approached in light of the Social Exchange Theory and the Social Learning Theory. Structural equation models were used to test hypothesized relationships. The results confirm the role of mediation of volunteer satisfaction in the relationships between the variables studied. In particular, ethical leadership was found to be positively associated both with volunteers’ intention of staying and with their affective commitment. In the first case this relationship is fully explained by the mediation of the volunteers’ satisfaction, while the latter is explained by both direct and indirect factors. To the authors’ knowledge, this the first attempt to understand the role played by ethical leadership on volunteers’ behavior and, more in general, in the management of non-profit organizations. Findings are relevant both for practitioners and managers of non-profit organization, since they suggest the relevance of the perception of ethical leadership by volunteers, as well as for scholars, since they further deepen the knowledge on EL and its effects on the followers. Limits of the study: the questionnaire was administered only among a group of non-statistical sample of volunteers. It examines the activities of Canadian ethicists working in healthcare institutions and the way in which their work incorporates more than ethics case consultation. In the past years, many students had problems with their finances, especially their expenses for education. Many of the students are affected by the crisis financially, emotionally, and by their wellbeing. That is why the government provides programs that will help the students with their problems with school expenses, and that is through the Tertiary Education Subsidy (TES) of the Commission on Higher Education (CHED). Further, the primary goal of this study is to explore the TES Grantees' lived experiences, challenges, (...) and coping mechanisms. Furthermore, these are the study's findings: (1) The grantees find the TES very helpful regarding finances that will tackle their academic needs, such as tuition fees and school learning materials. In this article, the author describes sweeping changes in the gender system and offers explanations for why change has been uneven. Because the devaluation of activities done by women has changed little, women have had strong incentive to enter male jobs, but men have had little incentive to take on female activities or jobs. The gender egalitarianism that gained traction was the notion that women should have access to upward mobility and to all areas of schooling and jobs. But persistent (...) gender essentialism means that most people follow gender-typical paths except when upward mobility is impossible otherwise. Middle-class women entered managerial and professional jobs more than working-class women integrated blue-collar jobs because the latter were able to move up while choosing a “female” occupation; many mothers of middle-class women were already in the highest-status female occupations. Individual decisions about how to exercise the legal right to procreative liberty may generate either positive or negative externalities. From within a resource egalitarian perspective, such as that of Ronald Dworkin, it can be argued that procreative justice is asymmetric in the following respect. Justice need not require that parents be subsidised if they produce a public good, yet its ideal achievement may require their activities be taxed if they threaten to produce a public bad.

Thomas Pogge's Global Resources Dividend relies on a flat tax on the use of natural resources to fund the eradication of world poverty. Hillel Steiner's Global Fund taxes the full rental value of owned natural resources and distributes the proceeds equally. The paper compares the Dividend and the Fund and defends the Global Share, a novel proposal that taxes either use or ownership, does so (when possible) progressively, and distributes the revenue according to a prioritarian rather than a sufficientarian or (...) egalitarian principle. In this paper, I present two presumed alternative definitions of metavalidity for metainferences: Local and Global. I defend the latter, first, by arguing that it is not too weak with respect to metainference-cases, and that local metavalidity is in fact too strong with respect to types. Second, I show that although regarding metainference-schemas Local metavalidity is always stable, Global metavalidity is also stable when the language satisfies reasonable expressibility criteria.

Recent application of theories of embodied or grounded cognition to the recognition and interpretation of facial expression of emotion has led to an explosion of research in psychology and the neurosciences. However, despite the accelerating number of reported findings, it remains unclear how the many component processes of emotion and their neural mechanisms actually support embodied simulation. Equally unclear is what triggers the use of embodied simulation versus perceptual or conceptual strategies in determining meaning. The present article integrates behavioral research (...) from social psychology with recent research in neurosciences in order to provide coherence to the extant and future research on this topic. The roles of several of the brain's reward systems, and the amygdala, somatosensory cortices, and motor centers are examined. These are then linked to behavioral and brain research on facial mimicry and eye gaze. Articulation of the mediators and moderators of facial mimicry and gaze are particularly useful in guiding interpretation of relevant findings from neurosciences. Finally, a model of the processing of the smile, the most complex of the facial expressions, is presented as a means to illustrate how to advance the application of theories of embodied cognition in the study of facial expression of emotion. O objetivo deste artigo é prosseguir a reflexão sobre as diferentes questões que compõem o pensamento ético de Hans Jonas, cujo ápice coincide com a publicação do célebre Princípio responsabilidade (1979), como resultado das décadas de estudos voltados para temas, antes excluídos da discussão ética, como a natureza e a técnica. De fato, natureza e técnica são dois importantes temas presentes no pensamento jonasiano posterior ao estudo da gnose e preparam o caminho para a reflexão ética posterior. En primer lugar, analizaré el pacto realizado entre Poseidón y Atenea en la primera parte del prólogo ; a continuación, me concentraré en la paradójica intervención de Casandra, antes de ser embarcada como esclava de Agamenón ; para terminar, resaltaré algunos puntos del agón entre Hécuba y Helena, que tiene como juez a Menelao. According to one of the most powerful paradigms explaining the meaning of the concept of natural number, natural numbers get a large part of their conceptual content from core cognitive abilities. Carey’s bootstrapping provides a model of the role of core cognition in the creation of mature mathematical concepts. In this paper, I conduct conceptual analyses of various theories within this paradigm, concluding that the theories based on the ability to subitize (i.e., to assess anexactquantity of the elements in a (...) collection without counting them), or on the ability to approximate quantities (i.e., to assess anapproximatequantity of the elements in a collection without counting them), or both, fail to provide a conceptual basis for bootstrapping the concept of an exact natural number. In particular, I argue that none of the existing theories explains one of the key characteristics of the natural number structure: the equidistances between successive elements of the natural numbers progression. I suggest that this regularity could be based on another innate cognitive ability, namely sensitivity to the regularity of rhythm. In the final section, I propose a new position within the core cognition paradigm, inspired by structuralist positions in philosophy of mathematics. (shrink)

In recent years feminist scholarship has increasingly focused on the importance of the body and its representations in virtually every social, cultural, and intellectual context. Many have argued that because women are more closely identified with their bodies, they have access to privileged and different kinds of knowledge than men. In this landmark new book, Paula Cooey offers a different perspective on the significance of the body in the context of religious life and practice. Building on the pathbreaking work (...) of Elaine Scarry in The Body in Pain, Cooey looks at a wide range of evidence, from the Argentine prison narrative of Alicia Partnoy, to the novels of Toni Morrison and the paintings of Frida Kahlo. Drawing on current social theory and critique, cognitive psychology, contemporary fiction and art, and women's accounts of religious experience, Cooey relates the reality of sentience to the social construction of reality. Beginning with an examination of the female body as a metaphor for alternative knowledge, she considers the significance of physical pain and pleasure to the religious imagination, and the relations between sentience, sensuality, and female subjectivity. Cooey succeeds in bringing forward a sophisticated new understanding of the religious importance of the body, at the same time laying the foundations of a feminist theory of religion. (shrink)

Although G. A. Cohen's work on Marx was flawed by a lack of gender-awareness, his work on Rawls owes much of its success to feminist inspiration. Cohen appeals effectively to feminism to rebut the basic structure objection to his egalitarian ethos, and could now appeal to feminism in response to Andrew Williams's publicity objection to this ethos. The article argues that Williams's objection is insufficient to rebut Cohen's ethos, inapplicable to variants of this ethos, and in conflict with plausible gender-egalitarian (...) ethoses. The article also advocates an understanding of basic structuralism and publicity consistent with feminism, and argues that Rawlsians need not reject plausible domestic egalitarian ethoses on either publicity or liberty grounds. La relación entre maternidad y trabajo ha sido materia de políticas públicas desde comienzos del siglo XX, pero en las últimas décadas ha adquirido nuevas connotaciones por el aumento de la participación laboral femenina. Ello no ha conducido a una eliminación de las discriminaciones que enfrentan las trabajadoras por su condición (real o potencial) de madres, ni a una organización del mercado de trabajo que permita articular demandas laborales y familiares, ni una redistribución del trabajo reproductivo. Para analizar cómo actores (...) involucrados en la formulación de políticas relacionadas con esta temática concebían la relación entre trabajo y maternidad y las tensiones que derivaban de ella, se entrevistó a un grupo de actores sociales provenientes de tres ámbitos. Dos ideas caracterizan sus concepciones: las normas de protección a la maternidad en el trabajo afectan negativamente la empleabilidad femenina y la relación maternidad trabajo es difícil porque la organización del mercado de trabajo dificulta la articulación de responsabilidades laborales y familiares. Respecto de las tensiones, se constataron en diferentes dimensiones: económica, demográfica, ejercicio de derechos y sociocultural. (shrink)

Chile’s recent history has gone through a hybrid conjuncture between what has been called the “social outbreak” on October 18, 2019, and the declaration of health emergency by COVID-19 promulgated on March 18, 2020. In such a context, this article describes and interprets two presidential speeches that announce the States of Exception based on conjunctural enemies’ rise. This social problem is investigated from Critical Discourse Studies and Systemic Functional Linguistics, particularly the appraisal system, together with the categories of legitimation proposed (...) by van Leeuwen. This research is positioned from a qualitative perspective and takes as a corpus of analysis the two speeches declaring a State of Exception by President Piñera in 2019 and 2020, respectively. These speeches are available to the public at https://prensa.presidencia.cl/. The results show that an enemy is constructed in both cases by contrasting the actions taken or not, which present negative appreciation valuations in the case of COVID-19 and negative integrity judgments in the case of the social outbreak. In both cases, key social actors emerge that are firmly legitimized within the State of Exception framework, which in turn is based on the categories of authority and moral legitimation. In conclusion, the enemy’s construction is identified in both cases with modification of the actors that interact through a problem, an action, and an agent that solves the problem constructed. The present paper discusses the statute of Socrates’ image in The birth of tragedy. From the hypothesis that it is unsatisfactory to treat Socrates only as Nietzsche’s antipode, as supported by a large number of interpreters, I develop the thesis according to which Socrates is a kind of magnifying glass, by means of which the philosopher analyses the beginning and the modern unfolding of western culture. Besides, and mainly, I demonstrate that the richness of antagonisms deliberately used by Nietzsche to (...) analyze Socrates’ images indicates the one of his first conceptions of the philosophical creation itself. Robert Sparrow argues that because of women's longer life expectancy philosophers who advocate the genetic modification of human beings to enhance welfare rather than merely supply therapy are committed to favouring the selection of only female embryos, an implication he deems sufficiently implausible to discredit their position. If Sparrow's argument succeeds, then philosophers who advocate biomedical moral enhancement also seem vulnerable to a similar charge because of men's greater propensity for various forms of harmful wrongdoing. This paper argues there are (...) various flaws in Sparrow's argument that render it unsuccessful. The paper also examines whether dimorphism reduction is a more desirable outcome than male elimination, thereby further illustrating the difficulties besetting the distinction between therapy and enhancement. Stigma taints individuals with a spoiled identity and loss of status or discrimination. This article is the first to examine the stigma attached to abortion and surrogacy and consider how law may stigmatize women for failing to conform to social expectations about maternal roles. Courts should consider evidence of stigma when evaluating laws regulating abortion or surrogacy to determine whether these laws are based on impermissible gender stereotyping.

ABSTRACTA lawyer's behaviour derives from their own principles and values, the norms of professionalism, the professional conduct rules and the common law. In the past, much emphasis has been placed upon the first two sources as they formed the basis of self-regulation and influenced the development of legal ethics. Recently, the Australian codes of ethics explicitly detail an increasing range of duties which might reasonably have been thought to be implicit characteristics of sound ethical values and professionalism, for example, a (...) duty to be civil, and an explicit prohibition against harassment, intimidation and bullying. Such additions have been deemed necessary as a response to increasing concerns about lawyer incivility and empirical reports detailing high levels of harassment, intimidation and bullying within law firms. There is growing evidence to support the claim that we react differently to robots than we do to other objects. In particular, we react differently to robots with which we have some form of social interaction. In this paper I critically assess the claim that, due to our tendency to become emotionally attached to social robots, permitting their harm may be damaging for society and as such we should consider introducing legislation to grant social robots rights and protect them from (...) harm. I conclude that there is little evidence to support this claim and that legislation in this area would restrict progress in areas of social care where social robots are a potentially valuable resource. Turing and Church formulated two different formal accounts of computability that turned out to be extensionally equivalent. Since the accounts refer to different properties they cannot both be adequate conceptual analyses of the concept of computability. This insight has led to a discussion concerning which account is adequate. Some authors have suggested that this philosophical debate—which shows few signs of converging on one view—can be circumvented by regarding Church’s and Turing’s theses as explications. This move opens up the possibility that (...) both accounts could be adequate, albeit in their own different ways. In this paper, I focus on the question of whether Church’s thesis can be seen as an explication in the precise Carnapian sense. Most importantly, I address an additional constraint that Carnap puts on the explicative power of axiomatic systems—an axiomatisation explicates when it is clear which mathematical entities form the theory’s intended model—and that implicitly applies to axiomatisations of recursion theory used in Church’s account of computability. To overcome this difficulty, I propose two possible clarifications of the pre-systematic concept of “computability” that can both be captured in recursion theory, and I show how both clarifications avoid an objection arising from Carnap’s constraint. G. A. Cohen's critique of Rawls's defence of economic incentives echoes some of J. S. Mill's insights on the subject. Some of Cohen's arguments, however, clash not only with those of Rawls but also with each other as well as with Mill's. A similar charge, however, may be made against Rawls. This article has conciliatory ambitions. It suggests reconciling each author with himself, as well as with each other, by focusing onthe worthof liberty. It stresses the importance of non-pecuniary occupational (...) inequalities and proposes various measures to enhance the worth of the occupational freedom of those with fewer options. (shrink)

Testimony is a source of knowledge. A speaker asserts what a hearer may therefore come to know. Assertion has widely been treated as the exclusive or at least the paradigmatic vehicle for testimony. I argue that we testify not only by asserting something, but also by taking something for granted within some other utterance. In philosophy of language, this is called semantic presupposition. The very reasons leading theorists of testimony have for thinking that assertion can be testimony are equally reasons (...) for thinking semantic presupposition can be testimony. (shrink)

The purpose of this paper is to present the theoretical and philosophical assumptions of the Nursing Manifesto , written by three activist scholars whose objective was to promote emancipatory nursing research, practice, and education within the dialogue and praxis of social justice. Inspired by discussions with a number of nurse philosophers at the 2008 Knowledge Conference in Boston, two of the original Manifesto authors and two colleagues discussed the need to explicate emancipatory knowing as it emerged from the Manifesto . (...) Our analysis yielded an epistemological framework based on liberation principles to advance praxis in the discipline of nursing. This paper adds to what is already known on this topic, as there is not an explicit contribution to the literature of this specific Manifesto , its significance, and utility for the discipline. While each of us have written on emancipatory knowing and social justice in a variety of works, it is in this article that we identify, as a unit of knowledge production and as a direction towards praxis, a set of critical values that arose from the emancipatory conscience-ness and intention seen in the framework of the Nursing Manifesto. In this paper I propose a Fictional Dualism model of social robots. The model helps us to understand the human emotional reaction to social robots and also acts as a guide for us in determining the significance of that emotional reaction, enabling us to better define the moral and legislative rights of social robots within our society. I propose a distinctive position that allows us to accept that robots are tools, that our emotional reaction to them can be important to (...) their usefulness, and that this emotional reaction is not a direct indicator that robots deserve either moral consideration or rights. The positive framework of Fictional Dualism provides us with an understanding of what social robots are and with a plausible basis for our relationships with them as we bring them further into society.
