For more than four decades the twin goals of nuclear nonproliferation and disarmament have been an almost unchallenged objective of the “international community.” Like drought prevention, or bans on the use of child soldiers, nonproliferation remains a mostly uncontroversial, largely universalistic initiative to which few object. The proponents of nonproliferation are fond of stressing that the Treaty on the Nonproliferation of Nuclear Weapons (NPT) has more signatories than any other arms control treaty. Who would not want to prevent more states (...) from obtaining nuclear weapons? And who, for that matter, would oppose the ideal of a world free of such weapons? (shrink)

It is widely assumed that disability is typically a bad thing for those who are disabled. Our purpose in this essay is to critique this view and defend a more nuanced picture of the relationship between disability and well-being. We first examine four interpretations of the above view and argue that it is false on each interpretation. We then ask whether disability is thereby a neutral trait. Our view is that most disabilities are neutral in one sense, though we cannot (...) make simple generalizations about disability's relationship to well-being in other important senses. After defending this view, we discuss its practical implications for selective abortion for disability, nondisabled people's interactions with disabled people, and the use of QALYs in health policy. This book review of Lieber and Press's “The myth of the nuclear revolution: Power politics in the atomic age" challenges the authors' position that nuclear weapons essentially have the same properties of conventional weapons. We argue that nuclear weapons alter warfare because they can end human civilization, and they pose a shared risk of mutual destruction.

The Occupy Wall Street movement of 2011 and its corollaries, Occupy Sandy and Occupy Debt, have been largely understood as secular movements. In spite of this, religious actors not only participated, but in some cases played an integral role within the movement, lending material support, organizing expertise, and public statements of support. We rely on interviews with faith leaders in New York and Oakland, and engage in an analysis of print and online media to explore the role of religious actors (...) and groups in Occupy Wall Street. Religious participants were often long-time veterans of progressive political struggles and drew inspiration from their faith traditions. Nonetheless, religious commitments were secondary to political objectives shared by themselves and their secular counterparts. Religious leaders believed they offered symbolic authority to the movement and highlighted this in their engagement in the hope of giving it greater moral weight. Current discussions on postsecularism and public religions are considered. (shrink)

In her ground-breaking and highly influential book Transformative Experience, L.A. Paul makes two claims: (1) one cannot evaluate and compare certain experiential outcomes (e.g. being a parent and being a non-parent) unless one can grasp what these outcomes are like; and (2) one can evaluate and compare certain intuitively horrible outcomes (e.g. being eaten alive by sharks) as bad and worse than certain other outcomes even if one cannot grasp what these intuitively horrible outcomes are like. We argue that the (...) conjunction of these two claims leads to an implausible discontinuity in the evaluability of outcomes. One implication of positing such a discontinuity is that evaluative comparisons of outcomes will not be proportionally sensitive to variation in the underlying features of these outcomes. This puts pressure on Paul to abandon either (1) or (2). But (1) is central to her view and (2) is very hard to deny. We call this the Shark Problem. (shrink)

Ordinary common sense suggests that we have just one set of shape concepts that we apply indifferently on the bases of sight and touch. Yet we understand the shape concepts, we know what shape properties are, only because we have experience of shapes. And phenomenal experience of shape in vision and phenomenal experience of shape in touch seem to be quite different. So how can the shape concepts we grasp and use on the basis of vision be the same as (...) the shape concepts we grasp and use on the basis of touch? I think this is the intuitive puzzle that underlies the question sent by the Dublin lawyer Molyneux to John Locke. This concerns a man born blind, who learns by the use of his touch to discriminate cubes from spheres. Suppose him now to gain the use of his sight. And suppose him to be presented with a cube and a sphere, of nighly the same bigness. Quaere, will he be able to tell, by the use of his vision alone, which is the sphere, and which the cube? Scholars were greatly indebted to Max Charlesworth for publishing in 1965 the Latin text of Anselm’s Proslogion, together with his own translation and commentary. The intense discussion this argument has received since then has, however, clarified a number of points about the logic of this argument. Its first premise is not a definition of God, and that identification is one of the conclusions of a three-stage argument. Also, the much-discussed issue of the relation of Chap. 3 to Chap. 2 has (...) now been clarified: that the premise with which Anselm begins Chap. 3 is entailed by the conclusion of Chap. 2. For that reason, substituting a description of anything other than God for Anselm’s formula, such as Gaunilo’s Lost Island, entails that that thing both can and could not be thought not to exist. It is argued that those who accept the psychological criterion of personal identity, such as Parfit and Shoemaker, should accept what I call the 'series' view of a person, according to which a person is a unified aggregate of mental events and states. As well as defending this view against objections, I argue that it allows the psychological theorist to avoid the two lives objection which the 'animalist' theorists have raised against it, an objection which causes great difficulties for the (...) conception of a person that most psychological theorists favour, the constitution view. It is also argued that the series view allows that people can body swap and teleport, which the constitution view—which takes a person to be a physical object (but a distinct physical object from the human being)—has great trouble with. When one allows truth to be indeterminate, “fixed point” interpretations can be found even when the language includes sentences such as the liar paradox. In this chapter this kind of account is applied to rational credences, to find non-undermining indeterminate epistemic states even in certain situations which have been discussed as challenges for rationality. In the process of doing this, a deeper understanding of how the supervaluational account of truth works is obtained, especially when one focuses on sets of precisifications.

When I joined the Society in the mid-1970s, it was already a well-functioning organization—if a much smaller one than today. After a few years of attending meetings, I began to submit papers, and I first appeared on the program at (...) our sixth annual meeting at John Carroll University in 1979. (See Fig. 1, the complete program, below.) While I was not one of the founders of SAAP, I did know them all. Presiding at the early meetings were, in the order of their presidencies, such elders as John Lachs, John J. McDermott, Darnell Rucker, James Gouinlock, Beth J. Singer, Peter H. Hare, Sandra B. Rosenthal, Thelma Z. Lavine, Joseph Betz, Charlene Haddock Seigfried, and Andrew J. Reck. Serving in the background at the same time were such patron saints as Justus Buchler, Douglas Greenlee, Abraham Edel, Max Harold Fisch, Elizabeth Flower, Edward H. Madden, David L. Miller, Frank M. Oppenheim, Evelyn Shirk, John E. Smith, and H. S. Thayer. It was a good time to be coming to American Philosophy, under the guidance of a Society that respected the fundamentals of pluralism and "fallibilism."1IThe brief discussion of the evolution of SAAP that I offer here initially emphasizes what the Society has meant to me over nearly five decades.2 As I was entering graduate school in 1974, I was drawn by the American philosophical tradition. It was, as William James writes, my "dumb conviction" that the best answers were to be found in this philosophical direction and not in the others, and that my job was to pursue these answers.3 What I found in this tradition was a refuge from both the analytic style of philosophy then dominant in America, with what I saw as its obsession with truth4 and its [End Page 1] confusion of cleverness with wisdom, and the alternatives of the various continental traditions that, although they pursued wisdom, seemed to me to rely too strongly on the mysterious or the untranslatable. My own sense of the American philosophical tradition at the time was an amalgam of Puritanism, Deism, Transcendentalism, Pragmatism in its various forms, and a large dose of Columbia Naturalism. Through further study and especially through my interactions at SAAP meetings, I became more grounded in these approaches and more open to other strands within the tradition.5 For me, cooperative interaction with others was essential to further understanding. Just as for Josiah Royce, the secret was "the community."6Among the lessons that I drew from the American philosophical tradition were the following. I knew that it was necessary to resist the human tendency to believe that what works for me will work for everyone else. As George Santayana reminds us, all philosophy is "personal."7 Thus, certain thinkers and certain thoughts will benefit from their initial plausibility to us, and other thoughts and thinkers will be initially suspect. To counter this personal prejudice, we need to partake in careful, long-term study. On a related point, Ralph Waldo Emerson urges us to seek insight from others, to accept what he calls "provocation" while not accepting their answers.8 At the same time, we live among these other individuals, marry them, teach their children, and benefit from their contributions to our social existence. In other words, American Philosophy teaches us that people are social creatures—a point which both Emerson and James were wary of, but not blind to—and that our thinking should focus on the world of shared experience. As Benjamin Franklin writes, our efforts in "Philosophy" make sense only when our pursuit of wisdom is related to human well-being.9 This point is so important that we need to wonder how our efforts were ever allowed to narrow and separate from a broad sense of human welfare to focus upon supposedly more important minutiae. With John Dewey, I saw the job of philosophers to be helping individuals to understand and deal with their philosophical "problems" of living.10 And, perhaps more... (shrink)

In the context of COVID-19, we are confronted with the question of whose voice matters and must ask: is adultcentrism ethically permissible during a pandemic? This book, first published in 2006, examines the incentives at work in a wide range of institutions to see how and how well coordination is achieved by informing and motivating individual decision makers. The book examines the performance of agents hired to carry out specific tasks, from taxi drivers to CEOs. It investigates the performance of institutions, from voting schemes to kidney transplants, to see if they enhance general well being. The book examines a broad range of market transactions, from (...) auctions to labor markets, to the entire economy. The analysis is conducted using specific worked examples, lucid general theory, and illustrations drawn from news stories. Of the seventy different topics and sections, only twelve require a knowledge of calculus. The second edition offers new chapters on auctions, matching and assignment problems, and corporate governance. Famous examples of conceivability arguments include (i) Descartes’ argument for mind-body dualism, (ii) Kripke's ‘modal argument’ against psychophysical identity theory, (iii) Chalmers’ ‘zombie argument’ against materialism, and (iv) modal versions of the ontological argument for theism. In this paper, we show that for any such conceivability argument, C, there is a corresponding ‘mirror argument’, M. M is deductively valid and has a conclusion that contradicts C's conclusion. Hence, a proponent of C—henceforth, a ‘conceivabilist’—can be warranted in holding that C's premises (...) are conjointly true only if she can find fault with one of M's premises. But M's premises are modelled on a pair of C's premises. The same reasoning that supports the latter supports the former. For this reason, a conceivabilist can repudiate M's premises only on pain of severely undermining C's premises. We conclude on this basis that all conceivability arguments, including each of (i)–(iv), are fallacious. (shrink)

Advertisements for high-technology products and services visualize processes and phenomena which are unvisualizable, such as globalization, networks, and information. We turn our attention specifically to the case of nanotechnology advertisements, using an approach that combines visual and sonic culture. Just as phenomena such as complexity and networks have become established in everyday discourse, nanotechnology seizes the social imaginary by establishing its own aesthetic conventions. Elaborating Raymond Williams’ concept of structures of feeling, we show that in visualizing nanotechnology, its stakeholders employ (...) spaces, verbs, and objects of feeling. These favorable nanotechnology structures of feeling are woven into the social imaginary, recursively producing the reality they describe. (shrink)

The concepts of time and identity seem at once unproblematic and frustratingly difficult. Time is an intricate part of our experience -- it would seem that the passage of time is a prerequisite for having any experience at all -- and yet recalcitrant questions about time remain. Is time real? Does time flow? Do past and future moments exist? Philosophers face similarly stubborn questions about identity, particularly about the persistence of identical entities through change. A fresh explication of the Thomist justification of self-defense casts off the hobbles of the principle of double effects to find a more secure footing in the historicaldevelopment of subjective natural rights by medieval jurists, and a straight-forward application to the latent threat of death in childbirth posed by non-consensual pregnancy. By articulating the implicit Thomistic right to defensive abortion in terms of conditional rights bestowed in Creation as correlative to particular natural law duties, justly proportionate limits to defensive abortion (...) are identified, and balanced against the forfeited or reserved natural rights variously imputed to conceptus and embryo in non-consensual pregnancies. Subsequently, the varieties of involuntary consent are examined from a Thomist perspective with a view to their relevance in justifying recourse to a rehabilitated practice of defensive abortion when free and full consent to impregnation and childbirth is absent. Think as If Your Life Depends on It puts Barbara Branden’s lectures on the Principles of Efficient Thinking in print at last, along with three later lectures. In Roger Bissell’s excellent transcription, the ten lectures introduce readers to psycho-epistemology, the difference between directed and undirected thinking, the role of the subconscious in problem-solving, common faults in thinking, and motivational issues that interfere with thinking. Her contributions were effectively erased from Objectivism after the Nathaniel Branden Institute closed; the original lectures were (...) the most significant part of the Objectivist corpus that remained to be recovered. The article has two aims: firstly, it provides a holistic account of Zygmunt Bauman’s oeuvre, and secondly, it presents an extensive up-to-date and multilingual bibliography of his published writings. The authors discuss Bauman’s prolificacy, as well as the stylistic, formal and substantive heterogeneity of his work. Taking this into account, they reflect on the curious reception of his oeuvre in the wider disciplinary field of sociology. The bibliography attached to the paper provides the most complete account of Bauman’s writings. Building (...) on previous bibliographies, and drawing on archival research in the Janina and Zygmunt Bauman Papers at the University of Leeds, the bibliography spans 63 years from his first publication to his most recent. The claims by the Building Societies Association (BSA), some mutual building societies and other observers that mutual status is associated with higher levels of charitable and community involvement than public status banks are tested using the proxy of charitable donations in cash as a proportion of profits before tax (PBT). Using a sample of 31 of the remaining 65 mutual societies and the population of U.K.-based retail banks and still-independent demutualised banks, two hypotheses were tested: first, that charitable giving as (...) a proportion of PBT over the period 1990–2003 was higher for mutuals than banks and second, that longitudinal records of charitable donations as a proportion of PBT for former mutuals will show a lower rate after demutualisation. Neither hypothesis was convincingly supported allowing for the conclusion that any claims suggesting that mutuals are structurally more generous than public companies are not supported by empirical evidence. During recent years in North America and Europe many feminists have become increasingly critical of responses to street prostitution that concentrate solely on punishing women who sell sex while ignoring their male clients. In order to address this gender imbalance some feminists have advocated the enforcement and/or strengthening of kerb crawling legislation and other schemes that target men who pay for sex. During 1998–9 one initiative, which aimed to target men who pay for sex in the UK, the Kerb Crawler (...) Rehabilitation Programme (KCRP), was piloted in Leeds, West Yorkshire. Although the KCRP received considerable media coverage there has been relatively little critical debate among feminists about this approach to working with clients of sex workers. This paper considers the role of myth and phenomenology in Pierre Schaeffer’s research into music and sound, and argues that engagement with these themes allows us to rethink the legacy and contemporary value of Schaeffer’s thought in sound studies. In light of critique of Schaeffer’s project, in particular that developed by Brian Kane and Schaeffer’s own apparent self-disavowal, this paper returns to Schaeffer’s early remarks on the “myth of the seashell” in order to examine the conditions of this critique. While (...) Kane argues that Schaeffer’s recourse to myth, coupled with his adoption of Husserlian phenomenology, leads to a closure of his inquiry and a failure to accommodate the contingency of his position, this paper argues that Schaeffer’s myth of the seashell brings into focus an open-ended, motivating phenomenological problem concerning subjectivity and objectivity that runs through his thought. Drawing on the philosophical work of Gaston Bachelard and Gilles Deleuze, this paper considers the epistemological significance of this moment in Schaeffer’s thought, suggesting a “problematic” account of the myth of the seashell that puts Schaeffer into conversation with contemporary work in epistemology. This paper concerns the three great modal dichotomies: (i) the necessary/contingent dichotomy; (ii) the a priori/empirical dichotomy; and (iii) the analytic/synthetic dichotomy. These can be combined to produce a tri-dichotomy of eight modal categories. The question as to which of the eight categories house statements and which do not is a pivotal battleground in the history of analytic philosophy, with key protagonists including Descartes, Hume, Kant, Kripke, Putnam and Kaplan. All parties to the debate have accepted that some categories are (...) void. This paper defends the contrary view that all eight categories house statements—a position I dub ‘octopropositionalism’. This article offers a new perspective on the poetic concerns of the Eclogues by looking at goats as the programmatic poetic symbol of the collection. It shows how Virgil has adapted a new poetic identity for the goats of his pastoral world from the bucolic landscape of Theocritus’ Idylls by borrowing and transforming the established poetic identity of a different animal, the bee. In particular, it traces the significance and intricacies of etymological play and markers to deepen our understanding of (...) the relationship Virgil creates between his work and that of Theocritus, and shows how this shift in poetic identity from bees to goats establishes a Virgilian conception of Roman pastoral. It gives especial consideration to Idyll 10 as a source text of inspiration for the Eclogues, with an eye to rehabilitating the importance of this poem to Virgil’s bucolic collection. (shrink)

Did early modern European states make themselves sacred? The historian Paolo Prodi insisted that they did, whereas for the philosopher Giorgio Agamben sacred and secular power were so indistinguishable that the question was moot. This group of articles seeks to explain and explore the approaches of these two accomplished Italian scholars to the problem of early modern sacralisation. This introduction reviews the context in which Prodi and Agamben worked, sketches brief biographies, and describes the arguments that they advanced which are (...) most relevant to early modern history. Their work emerged from the debate on secularisation in the German-speaking lands, the confessionalisation thesis as it was advanced by German historians of Reformation, Counter-Reformation, and Catholic Reform, and twentieth-century Catholic thought about the relationship between religion and totalitarian states. Both Prodi and Agamben belonged to traditions that sat at an angle to the liberalism that underpins historical and philosophical thought in the English-speaking world. (shrink)

Common Law Theory of Judicial Review: The Living Tree, Wil Waluchow neatly sidesteps the critique of judicial review based on the con- tention that constitutional rights are unacceptably indeterminate by arguing that it is this very indeterminacy that makes a common law method of legal interpretation appropriate. However, his contention that judges are able to ‘discover’ the underlying ‘authentic’ moral views of citizens is insufficiently grounded to meet the objection that common law reasoning utilising such unspecific material will result in (...) controversial decisions that reflect the val- ues and experience of an unrepresentative social and professional elite. He also ignores the important fact that electoral democracy is partly about the protection of vulnerable majorities against powerful minorities. However, Waluchow’s approach could be rendered more acceptable where there is the practical possibility of effective legislative on law style decision-making in the arena of human rights.Resumen:En su libro A Common Law Theory of Judicial Review: The Living Tree, Wil Waluchow de manera elegante y sutil evita la crítica al judicial review con el argumento de que los derechos constitucionales son irremediablemen te indeterminados y sostiene que precisamente por este aspecto de inde terminación un método basado en el common law es adecuado para la in terpretación de los derechos. Sin embargo, su postura de que los jueces son capaces de “descubrir” las perspectivas morales “auténticas” de los ciudadanos no está bien fundamentada como para hacer frente a la crítica de que el método del common law, al utilizar dicho material poco específico, da como resultado decisiones controvertidas que reflejan los valores y experiencia de una elite profesional y social no representativa. También el argumento de Waluchow ignora que la democracia electoral tiene como objetivo proteger a mayorías vulnerables de poderosas minorías. No obstante lo anterior, la tesis de Waluchow puede ser más viable donde exista la posibilidad práctica de una revisión efectiva de las leyes a través de las decisiones propias del método del common law en el ámbito de los derechos humanos.
