Dignity may just be the most promiscuous normative abstraction. This article, informed by dignity’s historical variability, political theoretic multipurpose, and conflicting jurisprudence, focuses on a particular but influential invocation of the term: dignity as the normative ground for the ‘capabilities approach’ model of social justice. We ask whether or not the CA, in particular the influential version propounded by philosopher Martha Nussbaum, requires dignity as its foundational premise, and whether or not dignity may be more costly than beneficial for the (...) CA’s vision of a minimally just society. The first section of this article rehearses the warrants of and criticisms against the dignity-basis of Nussbaum’s CA. We canvass the relatively sparse scholarship on dignity within the CA to situate our contribution. The next two sections are case studies, demonstrating dignity’s shortcomings for assessing and regulating sex and abortion, respectively. The fourth section rebuts two possible objections to our criticisms of dignity. The fifth and final section gestures toward another normative abstraction, ‘minimum conditions of individuation’, less polysemic than dignity, which might alternatively ground the CA. (shrink)

Discerning the Good in the Letters and Sermons of Augustine turns to the vast collection of moral advice found in Augustine's letters and sermons, mining these neglected and highly illuminating texts for examples of Augustine's application of his own moral concepts. It focuses on letters and sermons in which Augustine offers concrete advice on how to interact with the various goods relevant to social and political life. A special set of goods reappears throughout the letters and sermons, namely sexual intimacy (...) and domestic life, power and public office, and wealth and private possessions. Together, these goods form the central topics of this book. Joseph Clair highlights that the most revealing cases are those in which an individual must choose between competing goods, and cases in which an individual's role and role--specific obligations inform their decisions. Such cases uncover the nimbleness of Augustine's moral reasoning in action--an artful blend of scriptural interpretation, virtue theory, and sensitivity to the circumstances of individual lives. He reveals that Augustine's understanding of the goods constitutive of social and political life is deeply indebted to the Stoic and Peripatetic doctrine of oikei=osis, or "social appropriation". The colorful, personal, and practical details found in these writings provide a window onto Augustine's moral reasoning not available in his more theoretical treatments of the good, and the concrete cases often illustrate the human significance of properly discerning the good. Beyond providing one of the first analyses of these ethical writings, this work contributes a new sense of Augustine's ethics--both in terms of the range of questions he addresses and the manner in which he treats them. This article presents a radical claim: American medical ethics is broken, and it needs love to be healed. Due to a unique set of cultural and economic pressures, American medical ethics has adopted a mechanistic mode of ethical reasoning epitomized by the doctrine of principlism. This mode of reasoning divorces clinicians from both their patients and themselves. This results in clinicians who can ace ethics questions on multiple‐choice tests but who fail either to recognize a patient's humanity or to navigate (...) the ethical quandaries into which they are frequently thrown. Drawing on personal experience as well as the philosophical work of Augustine of Hippo, Simone Weil, and Iris Murdoch, we propose a novel ethical approach grounded in a conception of neighbor love, specifically, the virtue of love understood as attention to a sufferer's humanity. We conclude with five practical recommendations for reimagining medical ethics education oriented around the virtue of love. (shrink)

In Justice in Love, Nicholas Wolterstorff argues for a unique ethical orientation called “care-agapism.” He offers it as an alternative to theories of benevolence-agapism found in Christian ethics on the one hand and to the philosophical orientations of egoism, utilitarianism, and eudaimonism on the other. The purported uniqueness and superiority of his theory lies in its ability to account for the conceptual compatibility of love and justice while also positively incorporating self-love. Yet in attempting to articulate a “bestowed worth” account (...) of human dignity—in which dignity is given by divine love and respected in acts of justice—Wolterstorff leans on an unstable characterization of how love and the good are conceptually interwoven. As a result, his reader cannot be sure about the theoretical superiority of care-agapism. Moreover, Wolterstorff's attempt to value self-love and at the same time reject eudaimonism depends on a dubious interpretation of Augustine carried over from Justice: Rights and Wrongs, which itself further depends on a mischaracterization of the possible varieties of eudaimonism. This mistake is unfortunate because, on a closer reading of Augustine, one finds an agapistic account of eudaimonism that could have significantly helped Wolterstorff's overall account of the complementary relation of love and justice. Guidelines advise that x-rays do not contribute to the clinical management of simple nasal fractures. However, in cases of simple nasal fracture secondary to assault, a facial x-ray may provide additional legal evidence should the victim wish to press charges, though there is no published guidance. We examine the ethical and medico-legal issues surrounding this controversial area.

BackgroundHIV prevention research in resource-limited countries is associated with a variety of ethical dilemmas. Key amongst these is the question of what constitutes an appropriate standard of health care (SoC) for participants in HIV prevention trials. This paper describes a community-focused approach to develop a locally-appropriate SoC in the context of a phase III vaginal microbicide trial in Mwanza City, northwest Tanzania.MethodsA mobile community-based sexual and reproductive health service for women working as informal food vendors or in traditional and modern (...) bars, restaurants, hotels and guesthouses has been established in 10 city wards. Wards were divided into geographical clusters and community representatives elected at cluster and ward level. A city-level Community Advisory Committee (CAC) with representatives from each ward has been established. Workshops and community meetings at ward and city-level have explored project-related concerns using tools adapted from participatory learning and action techniques e.g. chapati diagrams, pair-wise ranking. Secondary stakeholders representing local public-sector and non-governmental health and social care providers have formed a trial Stakeholders' Advisory Group (SAG), which includes two CAC representatives.ResultsKey recommendations from participatory community workshops, CAC and SAG meetings conducted in the first year of the trial relate to the quality and range of clinic services provided at study clinics as well as broader standard of care issues. Recommendations have included streamlining clinic services to reduce waiting times, expanding services to include the children and spouses of participants and providing care for common local conditions such as malaria. Participants, community representatives and stakeholders felt there was an ethical obligation to ensure effective access to antiretroviral drugs and to provide supportive community-based care for women identified as HIV positive during the trial. This obligation includes ensuring sustainable, post-trial access to these services. Post-trial access to an effective vaginal microbicide was also felt to be a moral imperative.ConclusionParticipatory methodologies enabled effective partnerships between researchers, participant representatives and community stakeholders to be developed and facilitated local dialogue and consensus on what constitutes a locally-appropriate standard of care in the context of a vaginal microbicide trial in this setting.Trial registrationCurrent Controlled Trials ISRCTN64716212. This paper examines the impact of a week-long philosophy summer camp on middle and high school-age youth with specific attention paid to the development of intellectual humility in the campers. In June 2016 a university in Texas hosted its first philosophy summer camp for youth who had just completed sixth through twelfth grades. Basing our camp on the pedagogical model of the Philosophy for Children program, our aim was specifically to develop a community of inquiry among the campers, providing them (...) with a safe intellectual space to be introduced to philosophy and philosophical discussion. In 2017 we launched a formal longitudinal study to determine what impact a week-long philosophy summer camp would have on teens and tweens. Examining quantitative and qualitative data collected from 2016–2020, we found that the camp has had a significant impact on the teenagers who have attended. In particular, we found that intellectual humility increased over the duration of their camp experience and that this increase correlates with an increased affinity for philosophy and philosophical discussion. Despite the frequency of stillbirths, the subsequent implications are overlooked and underappreciated. We present findings from comprehensive, systematic literature reviews, and new analyses of published and unpublished data, to establish the effect of stillbirth on parents, families, health-care providers, and societies worldwide. Data for direct costs of this event are sparse but suggest that a stillbirth needs more resources than a livebirth, both in the perinatal period and in additional surveillance during subsequent pregnancies. Indirect and intangible costs of stillbirth are (...) extensive and are usually met by families alone. This issue is particularly onerous for those with few resources. Negative effects, particularly on parental mental health, might be moderated by empathic attitudes of care providers and tailored interventions. The value of the baby, as well as the associated costs for parents, families, care providers, communities, and society, should be considered to prevent stillbirths and reduce associated morbidity. In the conclusion to this multi-part article I first review the discussions carried out around the six essential questions in psychiatric diagnosis – the position taken by Allen Frances on each question, the commentaries on the respective question along with Frances’ responses to the commentaries, and my own view of the multiple discussions. In this review I emphasize that the core question is the first – what is the nature of psychiatric illness – and that in some manner all further (...) questions follow from the first. Following this review I attempt to move the discussion forward, addressing the first question from the perspectives of natural kind analysis and complexity analysis. This reflection leads toward a view of psychiatric disorders – and future nosologies – as far more complex and uncertain than we have imagined. (shrink)

Question 5 confronts the issue of utility, whether the manual design of DSM-III and IV favors clinicians or researchers, and what that means for DSM-5. Le cours de Schelling sur le Monotheisme, discretement polemique ( a l'egard de Schleiermacher et surtout de Hegel), enseigne a Munich a partir de 1828, forme dans l'edition posthume le porche de la Philosophie de la mythologie. Cette situation due a l'editeur n'est pourtant pas pleinement satisfaisante. Car alors le Monotheisme fait double emploi avec l'Introduction historico-critique a la Mythologie, avec laquelle il a sans doute alterne selon les semestres. Or l'elaboration parallele de l'expose de l'empirisme philosophique (Darstellung) et, plus (...) tardive, de la Philosophie rationnelle a retenti dans l'intervalle sur la signification du Monotheisme. La distinction de plus en plus accusee d'un negatif rationnel et d'un positif historique englobe desormais celle de la Mythologie ou du paganisme et de la Revelation ou du christianisme. A la philosophie negative revient la dignite de philosophie premiere. La mythologie, des lors coloree negativement, projette ses effigies de neant, mais comme des prefigurations de l'avenir. La refonte successive des seules versions de l'Introduction a la Revelation confere au cours sur le Monotheisme une certaine autonomie. Dans la ligne ideale d'un developpement synchronise, le Monotheisme occupe, bien que relativement en porte-a-faux, l'emplacement charniere, le point delicat d'amorcage de la philosophie historique, documentee. La presentation du Monotheisme comme theogonie transcendantale et theorie des principes ou puissances est en outre le plus simple et le plus clair de tous les textes de Schelling traitant du probleme de la transition. RÉSUMÉ. — Robert Brandom a tenté de déplacer le concept de représentation de sa position de concept explicatif central en philosophie du langage et de le remplacer par un ensemble de concepts explicatifs dérivés de l’analyse de l’action sociale. Il soutient que le concept de norme sociale peut servir de concept primitif dans le développement d’une théorie générale de la signification. Selon Brandom, le problème central lié au fait de considérer la représentation comme un primitif explicatif est que nous n’avons (...) pas une compréhension claire de ce à quoi correspond la relation de « représentation ». Il est donc naturel de s’attendre à ce que Brandom utilise, dans son analyse de l’action sociale, des primitifs explicatifs qui sont, d’une certaine manière, moins mystérieux. En particulier, on s’attend à ce que Brandom démontre que le concept de « norme sociale » peut être compris en termes d’un ensemble plus simple de concepts issus de la philosophie de l’action. Malheureusement, Brandom ne fournit pas une telle explication. Dans cet article, je commence par analyser l’argument proposé par Brandom, et je tente d’expliquer pourquoi cet argument, en définitive, n’est pas concluant. J’essaie ensuite de développer l’explication des origines de la normativité dans l’action sociale que, selon moi, Brandom aurait dû donner. (shrink)

Ce petit livre est concis. Il l’est peut-être trop, mais il demeure clair et stimulant. Il est axé sur des questions de justice sociale que se posent des sociaux-démocrates perplexes. Il se divise en trois parties traitant chacune d’un problème différent. Ce compte rendu les traitera l’un après l’autre, mais ils sont liés dans la pratique. Philippe Van Parijs utilise les notions de maximin, de contrat social passé derrière un voile d’ignorance et de solidarité nationale, et il fonde une (...) partie de son argumentation sur ces notions. Il discute des mérites d’une solidarité élargie à la nation, mais non d’une solidarité qui irait au-delà, bien qu’il tienne compte, à plusieurs moments, du fait que la nation soit de plus en plus tributaire d’une économie mondiale. En introduction, il rend hommage à John Rawls et André Gorz, des maîtres «avec et contre» qui il a écrit ce livre. Il dit aussi vouloir établir des principes cohérents, provisoires sans doute, mais auxquels on puisse adhérer. Il réussit certainement à les tirer au clair et à favoriser leur problématisation. Following Zizek's insight that the blockbuster can constitute the ideal terrain for mapping out the ideological and political dilemmas of our conjuncture, this piece takes a Zizekian look awry at two recent depictions of revolutionary crowds/movements in "The Dark Knight Rises" and "Argo". Viewed through the genealogical lens of representations of the “people” in philosophy and literature, what we find in both films is a (distorted, dispersed) staging not only of our own time and situation, a strange figuration of capital (...) and an ultimately justified revolutionary struggle over the city (or, surplus). While bioethics as a field has concerned itself with methodological issues since the early years, there has been no systematic examination of how ethics is incorporated into research on the Ethical, Legal and Social Implications of the Human Genome Project. Yet ELSI research may bear a particular burden of investigating and substantiating its methods given public funding, an explicitly cross-disciplinary approach, and the perceived significance of adequate responsiveness to advances in genomics. We undertook a qualitative content analysis of a sample (...) of ELSI publications appearing between 2003 and 2008 with the aim of better understanding the methods, aims, and approaches to ethics that ELSI researchers employ. We found that the aims of ethics within ELSI are largely prescriptive and address multiple groups. We also found that the bioethics methods used in the ELSI literature are both diverse between publications and multiple within publications, but are usually not themselves discussed or employed as suggested by bioethics method proponents. Ethics in ELSI is also sometimes undistinguished from related inquiries. (shrink)

This paper suggests that lessons from the field of environmental ethics and sociological perspectives on knowledge are important tools for rethinking what type of ethical analysis is needed for building up further the field of development ethics and, more generally, for addressing some of the most fundamental ethical problems related to global poverty and development. The paper argues for a methodologically pragmatist approach to development ethics that focuses on the interplay between facts, values, concepts and practices. It views development ethics (...) as a hybrid between a public moral?political philosophy and a public conception of social science. Ethical analyses of poverty and development must lead to fundamental changes in the ways knowledge is produced and justified and must challenge the dominance of global institutions and orthodox economics as the single sources of expert knowledge for development. Two of the main tasks of ethical analysis is to provide tools for the formulation of alternative knowledge for development centred on the equal moral worth of all human beings, and to influence global policy making as well as multilateral institutions' goals and policies. The last section of the paper argues that Amartya Sen's version of the Capability Approach is already methodologically pragmatist and points to some convergence between Sen's work and John Dewey's. Further sociological and methodologically pragmatist analysis of the approach is needed to assess the ways in which it is influencing debates on human development and leading to policy changes, and the possible distortions it suffers when adopted by multilateral agencies and policy makers. Naturalism as a guiding philosophy for modern science both disavows any appeal to the supernatural or anything else transcendent to nature, and repudiates any philosophical or religious authority over the workings and conclusions of the sciences. A longstanding paradox within naturalism, however, has been the status of scientific knowledge itself, which seems, at first glance, to be something that transcends and is therefore impossible to conceptualize within scientific naturalism itself. In Articulating the World, Joseph Rouse argues that the most (...) pressing challenge for advocates of naturalism today is precisely this: to understand how to make sense of a scientific conception of nature as itself part of nature, scientifically understood. Drawing upon recent developments in evolutionary biology and the philosophy of science, Rouse defends naturalism in response to this challenge by revising both how we understand our scientific conception of the world and how we situate ourselves within it. In this book Joseph Heath brings Jürgen Habermas's theory of communicative action into dialogue with the most sophisticated articulation of the instrumental conception of practical rationality-modern rational choice theory. Heath begins with an overview of Habermas's action theory and his critique of decision and game theory. He then offers an alternative to Habermas's use of speech act theory to explain social order and outlines a multidimensional theory of rational action that includes norm-governed action as a specific type.In the second (...) part of the book Heath discusses the more philosophical dimension of Habermas's conception of practical rationality. He criticizes Habermas's attempt to introduce a universalization principle governing moral discourse, as well as his criteria for distinguishing between moral and ethical problems. Heath offers an alternative account of the level of convergence exhibited by moral argumentation, drawing on game-theoretic models to specify the burden of proof that the theory of communicative action and discourse must assume. Purpose: We sought to examine the ethical, legal, and social implications (ELSI) literature research and scholarship types, topics, and contributing community fields of training as a first step to charting the broader ELSI community’s future priorities and goals. Methods: We categorized 642 articles and book chapters meeting inclusion criteria for content in both human genetics or genomics and ethics or ELSI during a 5-year period (2003–2008) according to research and scholarship types, topics, and the area of advanced training of the (...) first-listed author. Research and scholarship type categories were developed and characterized through in-depth review of 95 randomly sampled publications from the larger group. Results: There is a single dominant approach to ELSI, which focuses on ethical and other social issues “downstream” of advances in genomics, the contributors to which predominately have advanced training in medicine or science fields other than social science. A comparatively low percentage of publications primarily offer policy recommendations, and these are much more likely to be written by those with advanced training in law than is the case for the literature as a whole. Social science studies predominately employ qualitative methods and vary significantly with respect to the extent and types of recommendations offered. Two further types of ELSI research and scholarship offer alternative models for so-called “normative” work in this field. Conclusion: Considering topics, training, and types of ELSI research and scholarship from the most recent past allows for a baseline perspective that is sorely needed in charting this field’s future course. In contemporary philosophical debates in the United States "redefining pragmatism" has become the conventional way to flag significant philosophical contests and to launch large conceptual and programmatic changes. This book analyzes the contributions of such developments in light of the classic formulations of Charles S. Peirce and John Dewey and the interaction between pragmatism and analytic philosophy. American pragmatism was revived quite unexpectedly in the 1970s by Richard Rorty's philosophical heterodoxy and his running dispute with Hilary Putnam, who, like Rorty, (...) is a professed Deweyan. Reinventing Pragmatism examines the force of the new pragmatisms, from the emergence of Rorty's and Putnam's basic disagreements of the 1970s until the turn of the century. Joseph Margolis considers the revival of a movement generally thought to have ended by the 1950s as both a surprise and a turn of great importance. The quarrel between Rorty and Putnam obliged American philosophers, and eventually Eurocentric philosophy as a whole, to reconsider the direction of American and European philosophy, for instance in terms of competing accounts of realism and naturalism. Our purpose in this article is to identify and suggest resolution for two core problematics of grounded theory. First, while grounded theory provides transparency to one part of the conceptualization process, where codes emerge directly from the data, it provides no such systematic or transparent way for gaining insight into the conceptual relationships between discovered codes. Producing a grounded theory depends not only on the definition of conceptual pieces, but the delineation of a relationship between at least two of those (...) pieces. Second, the conceptualization process of grounded theory is done in hierarchical fashion, where individual codes emerge from the data but then are used to generate insight into more general concepts and thematic statements. But various works on grounded theory have failed to provide any systematic way of using data specific levels of scale (the codes) to gain insight into more macro levels of scale (concepts and themes). We offer fractal concept analysis as a means of resolving both of these issues. By using a logic structure generator, fractal concept analysis delineates self-similar conceptual frameworks at various levels of abstraction, yielding a method for linking concepts together within and between levels of scale encountered in the grounded theory coding and categorization process. We conclude that this fractal analytic technique can bolster the aims of grounded theory as a formalized and systematic process for generating theory from empirical data. (shrink)

In this book, Joseph Millum explains how parental rights and responsibilities are acquired, what they consist in, and how parents should go about making decisions on behalf of their children. In doing so, he provides a set of frameworks to help solve pressing ethical dilemmas relating to parents and children.

This book examines Aristotle's method in ethics from the vantage point of his broader conception of philosophy. Joseph Karbowski challenges longstanding dialectical orthodoxy and argues instead that, in his ethical treatises, Aristotle is seeking the first principles of a demonstrative ethical science, a science of human goodness, using an ethically adapted version of the method described in the second book of his Posterior Analytics. Part I of this volume develops a novel interpretation of Aristotle's conception of philosophy, which highlights (...) its ambition to scientific knowledge and its flexible approach to philosophical inquiry. Part II then demonstrates Aristotle's scientific and flexible approach to philosophy at work in his ethical treatises. The book shows how the aspiration to scientific knowledge is compatible with Aristotle's remarks about ethical precision, the practical aim of ethics, and the particular orientedness of phronēsis.
